Unbridled Development: on whose side is the state?

After years of supporting unbridled development the Labour Party in government is trying to signal that, after all, it is on the side of the vulnerable, those who are continuously trampled by developers. Nothing could be further from the truth.

As a result of the Sofia inquiry report, the BCA (Building and Construction Authority), on government’s instructions, issued a call for architects (and lawyers) to offer their services to assist those third parties impacted by development.

The current initiative is a positive step forward but, in my opinion, it is insufficient as it subjects the available assistance to instructions from the BCA. It is the BCA which decides whether and to what extent professional assistance is required.

A 13-page document was issued by the BCA on March 9, entitled “Expression of Interest. Invitation for the Provision of Periti to provide professional assistance to third parties”.

The service to be provided and paid for by BCA shall presumably cover advice relative to a description of the development, as well as the method statements submitted by the developer’s advisors. It will also cover inspections and the required estimates in the eventuality of damage sustained as a result of the development under consideration.

It is however not clear whether taking the BCA itself to task is covered by the said expression of interest. I am saying this because the professional service to be provided is subject to “the specific administrative instructions of the authority” as per paragraph 1.4 of the BCA expression of interest document.  This signifies that the BCA itself must authorize, for example, the seeking of advice to contest the way in which the BCA itself operates as well as to how it decides on specific cases.

This is just one aspect of the problems to be faced. The issues that should have been addressed are much wider and deeper than what is being acknowledged by the conditions of the expression of interest document.

Consider, for example, ground floor properties forming part of a two-storey development originally approved many years ago. When the existing development at first floor (and the overlying airspace) is purchased by developers with the intent to redevelop as a block of flats, it is hell for the ground floor residents. All sorts of pressures are resorted to in order to ensure that, as far as possible, residents acquiesce and shut up.

In such cases the ground/foundation condition reports being submitted leave much to be desired. It is logical that residents in ground-floor properties are reluctant to have their properties subjected to tests and sample boreholes in order that the prevalent geological conditions are identified. In the absence of this information, developers and their advisors are taking short cuts and making several. at times, incorrect assumptions as to the prevalent geological conditions on site. This is being done in order to give a clean bill of health to the proposed development.

Faced with such a situation some succumb to pressure from developers and consider moving out of their homes as a result, providing the desired carte blanche for the developers.

Is this fair? Yet this is what will eventually happen in a number of cases. In fact, it is already happening.

This is not a matter which can be adequately dealt with by the BCA after the development permit has been issued by the Planning Authority. It must be dealt with before the planning application is even submitted. Only then can one safely say that the legislator and the relative authorities are on the side of the downtrodden.

In simple words, it is much better to avoid the creation of a mess then having to deal with the not so pleasant consequences. This is how the vulnerable can be served.

Iktar kmieni din il-ġimgħa, l-portal elettroniku Shift News svela li Malti fin-negozju tal-ikel Tork, li f’ismu daħlet applikazzjoni ta’ żvilupp biex jinbena dan il-monstru  għandu sieħeb sieket fin-negozju: l-perit li iffirma l-applikazzjoni ta’ żvilupp. Skond ix-Shift News huwa jippossjedi 50 fil-mija tal-ishma tal-kumpanija Juke Developments Limited, il-kumpanija li qed tieħu ħsieb l-iżvilupp.

Mhux aċċettabbli li l-perit ikun ukoll żviluppatur.  Din hi imġieba ħażina li qed titfa’ dell ikrah fuq il-professjoni kollha. Hi materja ta’ etika li l-Kamra tal-Periti, li hi inkarigata milli tirregola l-professjoni, tevita kontinwament milli tesprimi ruħha u tieħu posizzjoni dwarha.

Madwar sentejn ilu, f’artiklu fuq Illum intitolat Il-perit-żviluppatur (8 ta’ Marzu 2020) kont ġbidt l-attenzjoni li l-perit inkarigat mill-proġett tal-Ħamrun, li fl-istadji inizzjali tiegħu kien wassal għall-mewt ta’ Miriam Pace, kien jippossjedi 10 fil-mija tal-ishma tal-kumpanija li kienet qed tieħu ħsieb l-iżvilupp.

Il-Kodiċi dwar l-Imġieba Professjonali għall-periti fil-gżejjer Maltin jipprovdi li  Perit f’Malta “ma għandux jokkupa, jassumi jew xjentement jaċċetta kariga li fiha l-interess tiegħu jkun kontra d-dmirijiet professjonali tiegħu.”

Il-punt hu jekk id-doveri professjonali ta’ perit inkarigat minn żvilupp humiex f’kunflitt ma li tkun ukoll, fl-istess ħin “l-żviluppatur”. Il-perit inkarigat minn lant tax-xogħol huwa ultimament responsabbli  għal dak li jseħħ fuq il-lant  avolja illum ġieli jkun assistit minn xi site officer, li imma rari jkun fuq il-lant! L-iskop tal-żviluppatur, min-naħa l-oħra, kif jgħidu, hu li jdawwar lira: hu interessat li jimmassimizza l-profitti mill-iżvilupp tal-art.

Il-Kodiċi dwar l-Imġieba Professjonali li semmejt iktar il-fuq jemfasizza li l-perit “jirċievi rimunerazzjoni biss bid-drittijiet professjonali tiegħu li jitħallsu mill-klijenti tiegħu u/jew bis-salarju tiegħu li jitħallas mill-prinċipal tiegħu. Hu ma jkunx jista’ jieħu rimunerazzjoni minn riżorsi oħra relattiva għax-xogħol u għad-dmirijiet fdati lilu.”   B’dan, fil-fehma tiegħi, hu ċar li perit ma jistax ikollu sehem minn profitti li jirriżultaw minn żvilupp tal-art u għaldaqstant m’għandux jaġixxi ta’ żviluppatur, la waħdu u l-anqas bi sħab ma ħaddieħor. Il-profitti mill-iżvilupp tal-art m’għandhomx ikunu l-motiv għall-ħidma professjonali tal-perit.  

Jidher li l-Kamra tal-Periti ma taqbilx ma dan għax b’mod konsistenti hi siekta dwar is-suġġett. Dan is-skiet hu inevitabilment interpretat bħala li l-Kamra tal-Periti qed taċċetta is-sitwazzjoni attwali. Mhux ta’ b’xejn, għaldaqstant li n-numru ta’ każi magħrufa ta’ periti li huma sħab fin-negozju ta’ żvilupp ta’ propjetà, imma li isimhom ma jidhirx, qiegħed jiżdied. Isimhom ma jidhirx għax huma konxji mill-kunflitt li hemm u jagħmlu ħilithom li jostru dan kollu fil-mixja tagħhom lejn sehem mill-profitti li jirriżultaw minn dan l-iżvilupp.

Bosta snin ilu, meta kont membru elett tal-Bord li jirregola l-ħruġ tal-warrant tal-periti kont ippreżentajt proposta biex dan kollu, jiġifieri ir-rwol ta’ periti li jaġixxu ta’ żviluppaturi, jkun regolat. Il-proposta tiegħi dakinnhar ma kienitx imxiet il-quddiem.

Sfortunatament, sal-lum, għad ma ittieħdet l-ebda azzjoni dwar dan kollu. Li nibqgħu ma tittieħed l-ebda azzjoni jfisser li l-qagħda preżenti tkun aċċettata bħala n-normalità. Sfortunatament dan hu konsistenti mal-valuri tas-soċjetà amorali li qed tiżviluppa madwarna.

The kebab man and his business partner

The monstrosity dwarfing the Manikata chapel approved by the Planning Authority was considered acceptable by both the Archdiocese of Malta and the Superintendence of Cultural Heritage. Both the Archbishop as well as the Superintendent of Cultural Heritage owe every one of us an apology for having withdrawn their objection to this development. They had originally submitted that the proposed development is incompatible with the chapel and its surroundings. Then they had second thoughts, thereby contributing to the development of this monstrosity.

Online news portal, Shift News, has revealed, earlier this week, that a man in the kebab business, in whose name the application was submitted has a silent business partner: the architect who signed the approved development application. The Shift News, also revealed that the architect is a co-owner of the development site through his 50 per cent ownership in Juke Developments Limited, the company which has taken charge of the development.

It is not on that architects are also developers.  This is a professional misconduct which is bringing the whole profession into disrepute. It is an ethical matter which has been repeatedly avoided by the Chamber of Architects and Civil Engineers, the professional body entrusted with regulating the architectural profession in the Maltese islands.

Around two years ago, in these columns, in an article entitled The architect-developer (8 March 2020) I had pointed out that the architect in charge of the development at Ħamrun, which development had, in its initial stages, resulted in the death of Miriam Pace, had a 10 per cent shareholding in the company which was carrying out the development.

The Code of Professional Conduct for architects practicing in the Maltese islands clearly lays down that a locally warranted architect “must not hold, assume or consciously accept a position in which his interest is in conflict with his professional duty.”

The point at issue is whether the professional duties of an architect in charge of a development are in conflict with the interests of being “the developer”. The architect in charge of a site of works is ultimately responsible for what goes on the site, even though he is nowadays assisted by a site officer who in most cases is rarely present on site! The developer, on the other hand is interested in the potential maximisation of profits resulting from the development of the site under consideration: making hay while the sun shines! The profits resulting from development should not be the professional’s motivation.

The Code of Professional Conduct abovementioned goes on to emphasise that a locally warranted architect “is remunerated solely by his professional fees payable by his clients and/or by his salary payable by his employer. He is debarred from any other source of remuneration in connection with the works and duties entrusted to him.”  In my opinion this clearly forbids architects from sharing in the profits of development and consequently in being developers, on their own or together with others.

Apparently, the Chamber of Architects and Civil Engineers disagrees with the above as it has been consistently silent on the matter. This silence has inevitably been interpreted by one and all as acquiescence: accepting the current state of affairs. It is consequently no wonder that the number of known cases of architects being silent partners in development projects is quietly on the increase. They are silent partners, meaning that they are aware that there is a conflict in their responsibilities which they do their best to hide in their pursuit of a share of the profits resulting from development.

Many years ago, when I was an elected member of the architects Warranting Board, I had presented a proposal to start regulating the role of architects who act as developers. My proposal was not acted upon.

Unfortunately, no action has been taken to date. Taking no action signifies accepting the present situation as the normal acceptable behaviour. This is unfortunately consistent with the norms of the amoral society which currently rules the roost.

When caves collapse: people may be killed

On the 14 September the Planning Authority approved application PA3487/19 which proposed the   “stabilization of dangerous rock slope; repair to deteriorated concrete wall and construction of wave dissipation slope along the Qui Si Sana coastline”.

In simple language this involves a permit for remedial works after a cave along the Sliema Qui Si Sana coastline collapsed, thereby exposing the MIDI development works immediately behind the cave: the basement level of residential blocks T14 and T17.

We have been told that the cave collapsed as a result of erosion along the coastline. Some readers may tend to forget that way back in 2016, a Maltese geologist had sounded the alarm that a “high-rise had been constructed over a fractured and eroded sea cliff, which could collapse any time soon.” The collapse in fact occurred relatively quite soon, signifying that the geologist was pointing out the obvious which was being ignored or not given due consideration by the developer and his advisors.

The point to be made is why the Planning Authority permitted the development to take place so close to the coastline. As far as I am aware, the EIA relative to the Tigne Development by MIDI does not reveal any detailed studies on the condition of the coast as well as on the impacts of erosion on the Qui Si Sana coastline and its relevance to the development of the MIDI project. The issue is not just one of remedial works but on why the Planning Authority  ignored the state of the coast, as a result permitting development too close to the coastline for comfort. The collapse is adequate proof of all this. The Planning Authority has much to explain in this specific case. Its actions, or lack of them, should be investigated.

The issue is not one relative to the structural stability of the development but of the protection of the coastline.

Erosion as a result of natural elements occurs continuously. It is a natural ongoing phenomenon.

In this respect it may be pertinent to draw attention to a report, authored by a team of geologists, dated October 2007 and entitled : “Report on Coastal Sliema. Geology, geomorphology, sites of scientific interest and coastal protection considerations.” This report was commissioned by the Sliema Local Council.

The 50-page report, which makes interesting reading, emphasises that a number of sites along the Sliema coast “are undergoing rapid coastal erosion that will increase with climate change, resulting in instability or failure in coastal infrastructure.”

Of particular interest is that the report, authored in 2007, goes on to state that “The faulted coast along Għar id-Dud is retreating rapidly by dislodgement of boulders along joints and faults. Public structures that may be affected include Tower Road promenade. The Għar id-Dud cave may also partially or totally collapse, leading to the caving-in of the overlying pedestrian promenade. If collapse is sudden and during daytime/early night time, injury and loss of lives may result.”

I have personally drawn attention of the Transport Minister to the above some time ago, however to date I am not aware that any action has been taken.

The matter was already very worrying way back in 2007 and most probably it is even worse now, after thirteen years, given that no coastal protection works have been taken in hand in the area in the intervening period.

The Għar id-Dud cave is the result of natural erosion and collapse accelerated by wave action. This is a natural process that cannot be halted unless adequate coastal protection works are initiated. If nature is left on its own, the end result is quite predictable: a complete collapse of Għar id-Dud, a caving in of the overlying pedestrian promenade and a number of dead or injured pedestrians, depending on the time of day when a collapse possibly occurs.

Will Transport Malta and the other authorities wake up from their slumber and act immediately please?

Ma qalilniex kif tista’ tkun Malta tagħna ilkoll imbagħad il-Labour Party jivvota favur li Bertie Mizzi jieħu f’idejħ (b’tender s’intendi) Manoel Island.

Mal-ambjentalisti ħafna kliem ħelu dwar kemm taħraqhom qalbhom għall-ambjent. Imma meta jkunu ma’ dawk li jiżviluppaw l-art, jitkellmu b’mod differenti. Iktar jitkellmu dwar kemm il-MEPA qed iżżomm l-iżvilupp lura. Ħalluna naħdmu, qalilhom Sandro Chetcuti!

Il-korruzzjoni: meta din tiffinanzja l-kampanja elettorali tal-Ministru

Il-liġi elettorali tistabilixxi li kandidat għall-elezzjoni ġenerali m’għandux jonfoq iktar minn €1,400 (l-ekwivalenti ta’ Lm600). Dan l-ammont jinkludi dak li jonfqu f’isem il-kandidat il-“ħbieb tiegħu”.

Kemm-il kandidat ser jinjora dan il-limitu fl-elezzjoni tad-9 ta’ Marzu 2013 u qiesu ma ġara xejn?

Il-problema mhiex biss l-ammont minfuq, iżda iktar u iktar minn fejn jiġu dawn il-flejjes. Malajr tifhmu għaliex għal sena wara l-oħra jkollna t’kaxkir tas-saqajn biex ikollna liġi suriet in-nies dwar il-finanzjament tal-politika.

Minn fejn jiġu dawn il-flejjes?

Tweġiba żgħira ħadniha meta Noel Borg Hedley, dak li kien Segretarju Privat ta’ Tonio Fenech, Ministru tal-Finanzi, ammetta fil-Qorti, li kkorrompa ruħu billi aċċetta l-flus biex jinfluwenza proċess amministrattiv. Il-flus tal-korruzzjoni li irċieva mingħand żviluppaturi (l-ahwa Jeffrey u Peter Montebello) għamel użu minnhom fil-kampanja elettorali tal-Ministru Tonio Fenech.

Għal Lawrence Gonzi jidher li qiesu ma ġara xejn meta fil-Qorti saret dikjarazzjoni ċara li l-korruzzjoni iffinanzjat il-kampanja elettorali ta’ wieħed mill-Ministri tiegħu.
