M’hemmx babaw fil-Port Ħieles

Uħud jidhrilhom illi meta tkun qed issemmilhom il-potenzjal tal-periklu li hemm fil-Port ta’ Marsaxlokk tkun qed tipprova tbeżżagħhom bil-babaw, jiġifieri b’xi ħaġa immaġinarja. Xi ħaġa li ma teżistix.

L-inċident li seħħ fil-Port Ħieles kmieni nhar il-Ħadd 5 t’Ottubru 2014 wara nofsinnhar huwa prova li fil-Port Ħieles m’hemmx il-babaw iżda li l-potenzjal li hemm ta’ periklu hu veru u reali. It-tromba li għaddiet minn fuq Birżebbuġa, wara, baqgħet għaddejja lejn Sqallija fejn ħalliet ħafna ħsarat warajha fl-inħawi ta’ Ragusa, Modica, Scili u Pozzallo.

Apparti li containers waqgħu qieshom kaxxi tas-sulfarini, taħt l-effett tat-tromba, ċ-ċimi fuq in-naħa tal-poppa tal-vapur inqatgħu u għal xi ħin il-vapur kien miżmum kemm kemm viċin il-moll bl-irbit min-naħa tal-pruwa. Fortunatament laħqu malajr fuq il-post il-laneċ tal-irmonk li irrimedjaw is-sitwazzjoni u b’hekk ġie evitat inċident iktar gravi.

Fi snin oħra kien hemm inċidenti simili. Taħt l-effett ta’ riħ qawwi (forza 8 u forza 9) u baħar imqalleb sewwa, iċ-ċimi ta’ vapuri fil-Port Ħieles mhux l-ewwel darba li ġibdu l-bollards minn ġol-moll. Dan mhux inċident ta’ darba kull tant.  Meta jseħħu dawn l-inċidenti jokkupaw numru ta’ laneċ tal-irmiġġ sakemm il-vapur jerġa’ jkun sigur billi jintrabat mal-moll. Jekk il-laneċ tal-irmonk ikunu okkupati fuq xogħol ieħor il-konsegwenzi ta’ inċident fejn vapur jinqala’ minn mal-moll jistgħu jkunu iktar gravi: dan għax eventwalment jinqata’ l-irbit kollu u l-vapur jitħalla fil-baħar għal riħu, fejn laqat laqat.

Meta jkun hemm it-tanker tal-gass (floating gas storage facility) permanentement fil-Port ta’ Marsaxlokk dan ikun madwar 700 metru biss il-bogħod minn vapur li jinqata’ minn mal-moll. Meta tqis li li l-parti l-kbira tal-vapuri fil-Port Ħieles għandhom tul ta’ madwar 400 metru hu ċar li mhux impossibli li jkollna inċident ta’ gravita kbira.

Għalhekk kien meħtieġ studju marittimu qabel ma tittieħed deċiżjoni li l-Power Station taqleb għal gass. Studju bħal dan mhux biss jidentifika l-problemi, jidentifika ukoll is-soluzzjonijiet. Biex studju bħal dan isir jieħu l-ħin u spejjes mhux żgħar. Dan apparti ż-żmien u l-ispejjes neċessarji biex ikunu attwati s-soluzzjonijiet.

Dan mhux babaw li jbeżża’ imma serjeta’ li kienet nieqsa fl-ippjanar tal-introduzzjoni tal-gass fil-Power Station ta’ Delimara.

Is-serjeta’ ma tbeżżax. Tmexxina l-quddiem. Hi l-injoranza biss li tinqeda bil-babaw.

Imbagħad forsi għalhekk diġa għaddew iktar minn sena u nofs u għadu ma sar kważi xejn dwar il-gass. Tgħid hemm min forsi fetaħ għajnejħ?

 

Fil-Port Ħieles il-bieraħ waqt il-maltemp

Il-maltempata tal-bieraħ għall-ħabta ta’ nofsinhar ħalliet ħsara f’diversi partijiet ta’ Malta.

Fil-Port Ħieles numru ta’ containers waqgħu minn posthom.

Bħala riżultat tal-qawwa tar-riħ, li kien jaqbel, kien hemm vapur li nqatgħulu ċ-ċimi u b’hekk ma baqax marbut sewwa mal-moll. Il-gazzetti online jiddeskrivu dan bħala mument ta’ tensjoni. Fortunatament intervjenew fil-ħin il-laneċ tal-irmonk u l-vapur reġa’ intrabat mal-moll.

Mhux l-ewwel darba li nqala’ dan it-tip ta’ incident.  Il-qawwa tar-riħ u s-saħħa tal-mewġ mhux diffiċli li tkun ferm iktar minn dik tal-bieraħ.

Xi darba, fil-viċin, madwar 700 metru l-bogħod mill-vapur li nqatgħulu ċ-ċimi, suppost li  ser ikun hemm t-tanker bil-ħażna tal-gass għall-użu tal-power station il-ġdida. Jekk vapur fil-Port Ħieles jinqatgħulu ċ-ċimi kompletament mhux impossibli li l-qawwa tar-riħ u l-mewġ iħabbtu b’saħħa ġot-tanker bil-ħażna tal-gass.

Dan huma affarijiet tal-biża’ li minkejja li tkellimna dwarhom ma ittieħdux in konsiderazzjoni meta l-MEPA ħadet id-deċiżjoni dwar il-power station.

L-istudju marittimu dwar il-Bajja ta’ Marsaxlokk, kieku sar, seta jitfa dawl fuq dawn it-tip ta’ inċidenti. Dawn huma inċidenti li ġraw fil-passat u li jibqgħu jiġru.

Fil-Port Ħieles ……………. issa x’imiss?

Kienet aħbar tajba dal-għodu li l-permess ambjentali tal-Port Ħieles inbidel biex ġie kif kien qabel ma ħolmu bit-tiswija tal-oil rigs u l-vapuri.

Il-MEPA ġimgħat ilu ħadu d-deċiżjoni li jpoġġu l-vantaġġ kummerċjali tal-Port Ħieles qabel dak li xtaqu r-residenti. Hekk iddeċidew. Ippruvaw ukoll kważi jgħadduna biż-żmien waqt il-laqgħa tal-Bord tal-MEPA meta l-każ kien qed jiġi ikkunsidrat.

Tlett membri tal-Bord tal-MEPA dakinnhar fehmu lin-nies u ivvutaw kontra l-permess ambjentali li kien jippermetti t-tiswijiet tal-oil rigs u l-vapuri. Insellmilhom. Lil Alex Vella mir-Ramblers li jwassal fuq il-Bord tal-MEPA il-leħen tal-għaqdiet ambjentali. Lil Ryan Callus (PN) u Joe Sammut (PL) li ukoll taw l-appoġġ tagħhom lir-residenti ta’ Birżebbuġa.

Ankè Joseph Muscat, Prim Ministru, dakinnhar kien iddikjara li d-deċiżjoni tal-Bord tal-MEPA ma kienitx aċċettabbli. Muscat, dakinnhar kien assoċja ruħu mal-posizzjoni li kien ħa Joe Sammut, membru Parlamentari Laburista fuq il-Bord tal-MEPA li kien ivvota kontra l-permess.

U issa?

Tajjeb li nirrejalizzaw li l-permess ġie irtirat fuq talba tal-Port Ħieles stess li irrealizza li ma setax jibqa’ jaħdem kontra l-volonta tar-residenti.

Jiġifieri l-MEPA m’għandha l-ebda mertu f’dak li qed jiġri. Li kien għal MEPA l-permess għadu hemm kif iddeċidew oriġinalment.

Jiena m’hu ser nitlob ir-riżenja ta’ ħadd. Billi m’għandhomx żejt f’wiċċhom, għalxejn nitlob li jirreżenjaw. Imma hu xieraq li l-Gvern jeżamina ftit x’tip ta’nies qed jaħtar fuq il-Bordijiet. Dan hu eżempju ċar li l-membri tal-Bord tal-MEPA, bl-eċċezzjoni ta’ Falzon, Callus u Sammut jiġu jaqgħu u jqumu min-nies. Tajjeb li jibqgħu jinħatru dawn it-tip ta’ nies? Naħseb li le. Iktar ma jwarrbu malajr, aħjar għal kulħadd.

Il-bieraħ għan-nom tal-Kunsill Lokali ta’ Birżebbuġa ippreżentajt appell mid-deċiżjoni tal-Bord tal-MEPA li l-permess ambjentali tal-Port Ħieles jkun jinkludi d-dritt li jsiru tiswijiet ta’ vapuri u oil-rigs.

Huwa tajjeb li mhux biss il-Kunsill Lokali ta’ Birżebbuġa ma jaqbilx ma dan. Il-Gvern ukoll, madwar 4 ġimgħat ilu, permezz tal-Prim Ministru Joseph Muscat ukoll iddikjara li ma jaqbilx.

Billi d-deċiżjoni tal-Bord tal-MEPA ma tirrispettax lin-nies mhux biżżejjed li l-Gvern jgħid li ma jaqbilx ma din id-deċiżjoni. Għandu ukoll l-obbligu li jipprova jara għaliex ħatar Bord li fid-deċiżjonijiet tiegħu ma jagħtix piż lill-aspirazzjonijiet u x-xewqat tan-nies.

Il-Port Ħieles anke għall-attivita’ ta’ kuljum tiegħu qiegħed viċin wisq tar-residenzi f’Birżebbuġa.

Mela l-gvern sema’ l-karba tal-poplu ta’ Birżebbuga dwar it-trasformazzjoni tal-Port Ħieles f’Tarżna żgħira. Jekk dan hu hekk tajjeb hafna.

Imma eżattament il-Gvern x’qiegħed jgħid?

L-istqarrija sħiħa tal-Gvern tgħid hekk:

Il-Gvern se jappella mid-deċiżjoni tal-MEPA dwar manutenzjoni fil-Freeport Il-Gvern ma jaqbilx u qed joġġezzjona għall-ħruġ ta’ permess sabiex fil-Freeport isiru operazzjonijiet ta’ manutenzjoni ta’ riggijiet taż-żejt għal perjodu ta’ sena.   Il-pożizzjoni tal-Gvern hija riflessa mill-vot kontra tar-rappreżentant tal-Prim Ministru fuq il-board tal-MEPA, l-Avukat Joseph Sammut. Il-Gvern, għalhekk inkariga lill-Uffiċċju tal-Avukat Generali sabiex minn issa, jekk tali permess joħroġ, jappella kontra dan il-permess. Permessi simili ħarġu fil-passat għal żmien qasir biex isiru xogħlijiet fuq proġetti speċifiċi ħafna. Il-Gvern ma jaqbilx li din is-sistema tiġi mibdula u li l-Freeport jingħata permess miftuħ għal dawn ix-xogħlijiet.

Aqraw sewwa dak li tgħid l-istqarrija. L-ewwel net din tgħid li l-Gvern ma jaqbilx li ħareġ permess għal perjodu ta’ sena. Imbagħad jgħid li fil-passat ħarġu permessi għal żmien qasir u li l-Gvern ma jaqbilx li din is-sistema tiġi mibdula.

Dan kollu jfisser illi m’hu veru xejn li l-Gvern sema’ dak li qed jgħidu n-nies ta’ Birżebbuġa. Pjuttost li jrid jgħaddihom biż-żmien għax jippreferi li joħroġ permess għal żmien qasir.

Issa jekk il-permess joħroġ għal żmien qasir jew għal żmien twil fil-prattika x’differenza hemm?

Ħtieġa ta’ kalma u attenzjoni

Madwar il-Bajja ta’ Marsaxlokk diġa hemm attivita’ diversa li hi ta’ riskju.

Matul din l-aħħar sena għadu kif għalaq l-impjant tal-gass tal-Enemalta fil-Qajjenza. Impjant li kien imdawwar b’residenzi għal snin twal. L-impjant ingħalaq u sar wieħed ġdid f’Bengħajsa u dan wara snin kbar ta’ ilmenti.

Ġo nofs Birżebbuġa hemm l-impjant tal-fuel tal-Enemalta. Ilu hemm snin kbar. Imdawwar bir-residenzi. L-Enemalta ilha s-snin tħabbel rasha biex tagħlaq dan l-impjant. Imma s’issa għadu hemm qalb in-nies.

Hemm ukoll il-ħażna tal-fuel f’San Luċjan bejn Birżebbuġa u Marsaxlokk w il-ħażna taż-żjut fil-kumpless tal-Freeport, l-Oil Tanking.

Dawn ir-riskji diġa qegħdin hawn u dan flimkien mal-ħażna tal-fuel (HFO u gasoil) presentement użat mill-Enemalta f’Delimara.

L-istudji li diġa saru dwar l-impjant tal-gass f’Delimara jinkludu studju minn Roberto Vaccari li għalkemm huwa studju preliminari diġa juri numru ta’ diffikultajiet u riskji ġodda li l-ħażna tal-gass tista’ toħloq. Riskji li meta tieħu in konsiderazzjoni r-riskji li diġa hawn fil-Bajja ta’ Marsaxlokk ikomplu jagħmlu is-sitwazzjoni agħar milli diġa hi.

Huma riskji li pajjiżi oħra sabu tarf tagħhom billi madwar is-sors ta’ riskji joħolqu żona li fiha l-aċċess ikun wieħed limitat u ikkontrollat. Il-ħolqien ta’ żona bħal din issolvi l-problema: ma teliminax ir-riskju imma tnaqqas sostanzjalment l-impatt tiegħu.

Id-diffikulta f’Delimara hi li l-ispazju li hemm hu limitat u ma jidhirx li hu possibli li tinħoloq din iż-żona b’aċċess  limitat u kkontrollat. Għalhekk il-proposta tal-ħażna tal-gass hi waħda problematika.

Li l-Gvern jgħid illi ser jagħmel iktar studji biex jipprova jsib tarf tal-problema hu pass tajjeb.  Irridu nħarsu iktar fil-fond mhux biss lejn l-impjant propost f’Delimara, imma ukoll lejn l-impatt fuq is-sajjieda, fuq il-komunitajiet ta’ Marsaxlokk u Birżebbuga kif ukoll fuq il-Port Ħieles.

Ir-riskju li jkun hemm inċident hu wieħed żgħir u rari. Imma l-konsegwenzi jekk iseħħ l-inċident ikunu kbar ħafna. Għalhekk jeħtieg li nimxu b’kalma u b’attenzjoni kbira.

Bħal daż-żmien sena, waqt il-kampanja elettorali, Alternattiva Demokratika kienet ċara ħafna dwar il-proposta tal-Partit Laburista li jgħaddi biex jipproduċi l-elettriku bl-użu tal-gass. Għidna li l-kwalita’ tal-arja ser titjieb sostanzjalment kif ukoll li tista’ traħħas il-kontijiet tal-elettriku u l-ilma.

Imma għidna ukoll anke tnax-il xahar ilu illi ma kienx ċar x’kien qed jiġi propost dwar ir-riskji li l-ħażna ta’ kwantita’ kbira ta’ gass daqshekk qrib kemm tal-power station innifisha kif ukoll viċin l-abitat u viċin ħafna ta’ operazzjonijiet marittimi.

Alternattiva Demokratika rat l-istudju dwar l-impatti ambjentali (EIA) u in partikolari l-istudju ta’ Roberto Vaccari dwar l-analiżi tar-riskji  liema studju jifforma parti integrali mill-imsemmi EIA.

L-istudju dwar ir-riskji huwa inkonklużiv minħabba illi fil-waqt li jagħmel analiżi ma jwassalx din l-analiżi għal konklużjoni loġika tagħha, in partikolari kif b’mod prattiku l-impjant li jiġġenera l-elettriku bil-gass għandu impatt fuq l-attivitajiet l-oħra li presentement hemm fil-Port ta’ Marsaxlokk.

Vaccari per eżempju jikkonkludi dwar il-possibilita’ ta’ inċident li bħala riżultat tiegħu joħroġ kwantita’ kbira ta’ gass illi s-sħaba (ta’ gass) riżultanti  takkumula fl-area quddiem il-Port Ħieles u preċiżament fil-fairway, l-area fejn jimmanuvraw il-vapuri qabel ma jidħlu jħottu t-tagħbija tal-containers. (ara pjanta hawn fuq) Din biss kellha twassal għal konklużjoni li s-soluzzjoni proposta għall-impjant tal-enerġija li jaħdem bil-ġass  maħżun fuq vapur hi theddida kbira għas-sigurta’ tal-operazzjoni tal-Port Ħieles.

Pajjiżi oħra joħolqu żona ta’ sigurta madwar l-impjant b’mod illi jiżolaw il-possibilita’ ta’ periklu u ma jħalluħx jinfirex. B’hekk inaqqsu l-impatt fuq il-ħajja tan-nies u fuq il-propjeta’ u jimminimizzaw il-ħsara ekonomika li tista’ tirriżulta. Hekk għamel per eżempju l-Gvern Reġjonali tat-Toscana barra l-Port ta’ Livorno meta stabilixxa żona ta’ sigurta f’distanza ta’ tmien kilometri madwar il-ħażna tal-gass fuq vapur li ġie ankrat 22.5 kilomteri l-barra mill-kosta.

Bl-iskuża li r-rapport tal-analiżi tar-riskju hu wieħed preliminari r-rapport ta’ Vaccari ma jagħmel xejn minn dan. Filwaqt li jsemmi l-possibilita ta’ impatt fuq stallazzjonijiet oħra fil-port ta’ Marsaxlokk (domino effect) la Vaccari u l-anqas l-EIA ma janalizzax kif  dan jista’ jseħħ.

Filwaqt li hu magħruf illi l-movimenti maritiimi fil-Port ta’ Marsaxlokk ikollhom jonqsu drastikament, inkluż il-movimenti mis-sajjieda l-EIA hu sieket dwar dan.

Dan kollu kellu jwassal  għal rakkomandazzjoni li s-soluzzjoni tal-ħatt u ħażna tal-gass fil-Port ta’ Marsaxlokk huma ta’ periklu kemm għar-residenti kif ukoll għall-ekonomija tal-pajjiż.

Pajjiżna għadu fil-ħin biex jimxi lejn soluzzjonijiet oħra. Lil hinn mill-piki politiċi l-unika soluzzjoni prattika hi dik ta’ pipeline li dwaru l-Gvern kien sfortunatament irrifjuta offerta mill-Italja fl-1999.

Li hu żgur hu li ħajjet in-nies hi imprezzabbli.

Learning to use chopsticks

We have been told that it is most worrying that China could acquire a share in our energy corporation. It is worrying, we are told, due to the strategic importance of the sector.

We tend to forget that Malta has plenty of foreign investments in other strategic sectors. Another one wouldn’t change much would it?

Our only airport is run by Austrians.

Gambling has been left to  Greek Intralot.  Banking is heavily influenced by global HSBC ironically originating from Hong Kong, the tip of the Chinese mainland.

The public  transport fiasco has an Anglo-German fingerprint through Arriva.

LPG Gas is controlled by Italians through GASCO.

The Freeport is controlled by a Franco-Turkish alliance for the next 65 years. (CMA-CGM and Yildirim Group)

When its Austria, Greece, Anglo-German interests, Italian investments, Franco -Turkish controls, or global HSBC then its globalisation.

The Chinese interest is part of the same process.

Obviously the details of the memorandum of understanding signed earlier this week are not yet known. Hence a proper discussion would have to wait until such details are known. There will surely be positive and negative impacts. China stands to gain. Whether Malta’s potential gains are adequate is still to be seen as we have only been fed titbits of information.

China obviously stands to gain through establishing a stronger foothold in Malta and within the EU.  Whether it will be similarly positive for Malta is still to be seen.

Some Chinese companies are world class. They provide stiff competition to international firms such as Lahmeyer International the one time consultants to the Malta Resources Authority and to Enemalta Corporation. Some of these Chinese companies have reached the same grade in World Bank blacklists !

We have been there before.

It may turn out not to be so difficult to learn to use chopsticks after all !

Minor footnote to 1980s talks

Much has been written about the meetings between Dom Mintoff and Guido de Marco prior to 1987 on finding ways in which to solve the constitutional crisis resulting from the 1981 perverse electoral results.

During these meetings Mintoff and de Marco undoubtedly also discussed various other matters as they considered appropriate. At one point, I too formed part of their agenda.

It was early in October 1984 and I was carrying out duties of architect and civil engineer at the then Public Works Department. Called to the office of the director, I was informed that, in view of my articles published in newspapers of the Nationalist Party, my employment was being terminated forthwith.

Being without a job was further compounded by the fact that the then Labour government had also withheld my professional warrant.

I initiated human rights proceedings claiming that my right to freedom of expression and protection from discrimination on political grounds had been breached by the Director of Public Works and his minister, Lorry Sant.

The first session of the court case was fixed for early November 1984. Witnesses were heard and submissions made.

Some time in April or May 1985, de Marco called to tell me that he had a message for me from Mintoff. My dismissal from the Public Works Department had cropped up in one of his meetings with Mintoff who had suggested that he would be prepared to take me on board as a civil engineer on the Freeport project, then under his wings and in its early stages.

However, this proposal was subject to the conditions that I had to halt legal proceedings against Sant and, in addition, I had to bind myself not to write any more articles in newspapers.

My response was a clear no.

We met a second time at the request of de Marco, presumably as Mintoff was pressing for an answer. But I did not budge. In view of my refusal, the message was relayed through two alternative routes. De Marco had asked two high-ranking PN officials to persuade me to compromise. Fortunately, they fully understood my position and did not press the matter any further.

On June 27, 1985, just weeks after receiving Mintoff’s message, the case was decided by Mr Justice Joseph Filletti. He concluded that my freedom of expression and my right not to be discriminated against on political grounds were breached by the Director of Public Works. The director, the court ruled, had to shoulder administrative responsibility for the happenings in his department on his own.

Mr Justice Filletti had exonerated the minister!

Subsequent to Mr Justice Filletti’s decision I received a phone call that a senior army officer attached to Mintoff’s office at Kalafrana wanted to speak to me.

I clearly remember that it was an August afternoon in 1985 when I called at his office. This army officer, eventually a colonel, told me that I should not count my chickens yet because, while I had a favourable first decision from the law courts, it was inevitable that it would be reversed on appeal.

He prodded me to accept Mintoff’s proposal and stop legal proceedings. I told the colonel that I had already refused the proposal and that I had no intention of changing my mind.

In the meantime, the Constitutional Court had fixed dates for hearings of the appeals submitted. I myself had submitted an appeal because, in my view, the minister should have been found responsible together with the director for breach of human rights. Proof had been submitted that the instructions for my dismissal had been issued by the minister himself.

The Constitutional Court decided the case on January 29, 1986. It concluded that Sant had, in fact, issued the instructions for my dismissal himself. It further acknowledged that proof of the minister’s direct involvement had been submitted through the evidence of various witnesses.

The Constitutional Court decided that both Sant and the director were responsible for political discrimination.

As to freedom of expression, the Constitutional Court reversed the first court’s decision and concluded that those in public employment sign away their rights of freedom of expression. By accepting public employment, the Constitutional Court held that you renounce your freedom of expression.

As it turned out, it seems that the colonel was most probably bluffing after all.

It was clear to me that Mintoff was trying to find a way out for Sant.

When my name cropped up in the de Marco-Mintoff talks it seems that I was considered as a pawn that could be easily sacrificed in the quest for the larger prize.

Fortunately, matters developed differently in this minor footnote to the de Marco/Mintoff talks.

Fil-permess dwar id-dredging fil-Freeport il-MEPA imponiet kundizzjoni li ma jistax isir xogħol ta’ dredging waqt l-istaġun tal-għawm.

Minkejja dan il-Freeport ser jagħmel ix-xogħol xorta, waqt l-istaġun tal-għawm .

Il-Freeport minkejja l-kundizzjonijiet tal-permess jidher li “irranġa”.  Il-kundizzjonijiet tal-permess tal-MEPA ġew ma  jiswew xejn !

Il-MEPA għal darba oħra uriet li hi b’saħħitha ma min hu dgħajjef (ir-residenti ta’ Birżebbuġa) u dgħajfa ma’ min u b’saħħtu (mal-Freeport).

Ir-riforma tal-MEPA jidher li ma swiet għal xejn. Għax min hu b‘saħħtu baqa’ jagħmel li jrid. Il-MEPA jew hi inkompetenti inkella kompliċi.
