Proposta nejja tal-Labour dwar l-abort

Nhar it-Tnejn, il-Parlament approva fl-istadju tal-ewwel qari, l-abbozz ta’ liġi numru 28. Dan l-abbozz hu intenzjonat biex jikkjarifika l-provedimenti tal-Kodiċi Kriminali dwar l-abort terrapewtiku. B’mod speċifiku l-għanijiet u r-raġunijiet tal-abbozz huma biex “jipprovdu kjarifika dwar il-parametri fil-Kodiċi Kriminali li għandhom japplikaw għal cirkostanzi ta’ neċessità fejn ikun meħtieġ intervent mediku biex tkun protetta l-ħajja u s-saħħa ta’ mara tqila li tkun qiegħda tbati minn kumplikazzjoni medika.”

Uħud jikkunsidraw li l-abbozz numru 28 hu pass żgħir il-quddiem f’pajjiż li kontinwament ipprova jevita li jiddibatti l-abort. Sfortunatament, imma, l-proposta li ġiet ippreżentata hi waħda nejja.  

Wara snin jevita dibattitu nazzjonali, kien ikun ferm iktar għaqli għall-Gvern li jippubblika White Paper fejn jispjega b’mod ċar u dettaljat dak li jrid jagħmel dwar l-abort kif ukoll dwar dak kollu relatat miegħu. Tajjeb li nirrealizzaw li l-leġislazzjoni dwar l-abort tal-pajjiż ma hi tal-ebda siwi. Wara li ġiet injorata għal 160 sena l-liġi teħtieġ li tkun aġġornata għaż-żminijiet u li tkun tirrifletti l-avvanzi fix-xjenza u l-mediċina tul dawn is-snin kollha. Hemm bżonn li tinkiteb mill-ġdid u dan fid-dawl tal-fatt li tul dawn l-aħħar għaxar sninil-pajjiż ħaddan il-plurliżmu etiku.

Hu ċar li l-Gvern qed jipprova jindirizza l-impatt politiku li rriżulta mill-kaz riċenti tat-turista Amerikana Andrea Prudente, f’liema każ Malta naqset milli tipprovdi l-kura medika li kienet mistennija.

M’għandniex ħtieġa ta’ proposta rejattiva, proposta nejja: imma għandna bżonn proposta li tindirizza ir-realtà tas-seklu wieħed u għoxrin.  L-abort hu parti integrali mill-ħajja Maltija, rridu jew ma irridux! L-indikazzjonijiet huma ta’ medja ta’ 400 abort li jsiru kull sena fost il-Maltin. Il-parti l-kbira jseħħu bl-użu ta’ pilloli li jinkisbu bil-posta.  Oħrajn iseħħu f’pajjiżi oħra, primarjament fir-Renju Unit kif jidher fir-rapporti mediċi annwali ippubblikati.

Il-Partit Laburista jidher li hu xott mill-ideat għax naqas ukoll milli jindirizza l-abort fil-manifest elettorali tiegħu għall-elezzjoni ġenerali ta’ Marzu 2022.

Dan it-tkaxkir tas-saqajn mill-Partit Laburista jikkuntrasta mal-proposti tal-partit immexxi minni li tul ix-xhur li għaddew ippreżentajna proposti diversi biex apparti iktar ċarezza fil-liġi nimxu lejn id-dikriminalizzazzjoni kif ukoll lejn l-introduzzjoni speċifika tal-abort limitat għal tlett ċirkustanzi partikolari u straordinarji. Il-proposta tagħna hi li l-abort ikun permissibli meta l-ħajja jew is-saħħa tal-mara tqila tkun mhedda, fil-kaz ta’ tqala li isseħħ riżultat ta’ vjolenza (stupru u incest) kif ukoll fil-kaz ta’ tqala li ma tkunx vijabbli.

Uħud jikkunsidraw li dak proposta hu ftit wisq, oħrajn li hu wisq. Fil-fehma tagħna il-proposta hi addattata għaċ-ċirkustanzi partikolari lokali. Hi proposta li mhux biss hi ferm aħjar mill-proposta nejja tal-Gvern, imma twassal ukoll biex il-liġi tkun aġġornata għal dak mistenni fi żmienna!

Hemm ukoll materji oħra li huma relatati u li jeħtieġ li jkunu diskussi. Matul din il-ġimgħa grupp ta’ akkademiċi lokali u oħrajn ippubblikaw dokument għad-diskussjoni in konnessjoni mal-proposta tal-Gvern dwar l-abort.

Il-proposti fid-dokument ippubblikat għad-diskussjoni jfittxu li jissikkaw id-definizzjonijiet dwar iċ-ċirkustanzi li fihom ikun ġġustifikat l-intervent mediku biex ikun possibli li tkun protetta l-ħajja u s-saħħa tal-mara tqila. Jeskludi ukoll kull xorta ta’ abort.

Il-punti mqajjma f’dan id-dokument hu dejjem utlili li jkunu diskussi. Għalhekk ilna ngħidu li hemm ħtieġa għal diskussjoni pubblika matura, diskussjoni li l-Gvern ilu żmien jevita.  Imma nistenna ukoll li jkun hemm akkademiċi oħra b’veduti u opinjonijiet differenti li anke huma jsemmgħu leħinhom. Għandhom bżonn joħorġu mill-friża.

Irridu nħarsu lil hinn mill-proposti restrittivi li dan id-dokument għad-diskussjoni jippreżenta. Sa mill-2011, meta kien approvat ir-referendum dwar id-divorzju, Malta għażlet it-triq tal-pluraliżmu etiku: rispett lejn il-pluralità ta’ opinjonijiet u valuri etiċi. Id-dokument li qed nirreferi għalih hu negazzjoni ta’ dan u effettivament hu proposta biex naqbdu triq oħra u differenti. Għandna nirreżistu dan l-attentat.

Fl-aħħar għandu jkun ċar li din mhiex diskussjoni dwar x’inhu tajjeb jew ħażin imma dwar min għandu jieħu d-deċiżjoni kif ukoll dwar il-parametri li jiddeterminaw kif u safejn nistgħu naġixxu. M’aħniex qed ngħixu f’teokrazija: hu dritt li naffermaw illi hu possibli li jeżistu veduti u valuri differenti.

Labour’s half-baked abortion proposal

On Monday Parliament approved at first reading stage Bill number 28 which Bill seeks to clarify the provisions of the Criminal Code relative to therapeutic abortion. Specifically, the objects and reasons of the Bill seek to “provide clarification on the parameters that shall apply in the Criminal Code to circumstances of necessity in which a medical intervention is required in order to protect the life and health of a pregnant woman suffering from a medical complication”.

Some may consider that Bill 28 is a good first step in a country which has continuously avoided debating abortion. Unfortunately, government’s proposal is half-baked.

After years of avoiding a national debate, it would have been much better if government published a detailed White Paper explaining its views on abortion and the related issues and principles. It is about time that we recognise that the country’s abortion legislation is not fit for purpose. After being ignored for 160 years Maltese abortion legislation requires to be brought in line with medical and scientific progress over the years. It also requires a substantial redrafting in view of the fact that for over a decade Malta has embraced ethical pluralism.

It is clear that government has limited itself to addressing the political fallout resulting from the recent case of the American tourist Andrea Prudente as a result of which Malta failed in the provision of the expected medical care.

We do not require a half-baked reactive proposal but rather a proposal which addresses twenty-first century reality. Whether we like it or not, abortion is a regular occurrence among Maltese too! Indications point towards an average 400 abortions which are carried out annually, a substantial portion of which through the use of abortion pills acquired through the post. Others are carried out through abortion tourism, primarily in the United Kingdom as is evidenced by annual published medical returns for England and Wales.

Apparently, the Labour Party is short on ideas as it has even failed to address abortion in its electoral manifesto for the March 2022 general election.

In contrast to the reluctance of the Labour Party to come forward with proposals, the Maltese Greens, which I lead, have, over the past months presented proposals which in addition to the required clarifications in our legislation seek decriminalisation as well as the specific introduction of abortion in three extraordinary circumstances: namely when the pregnant female’s health or life is under threat, in cases of a pregnancy brought about violently (rape and incest) as well as in the case of non-viable pregnancies.

Some have considered our above proposals as being too little, others as being too much. We consider that in view of the prevailing local circumstances our proposals are just right, a substantial improvement over government’s half-baked proposals and an overhaul of the current mid-nineteen century legislation, which is out of tune with what is expected in this day and age.

There are other related issues which we should also discuss. During this week a group of local academics and some hangers-on have published a discussion paper which discusses government’s abortion proposal.

The proposals in the said discussion paper seek to tightly define the circumstances which justify a medical intervention to protect the life and health of a pregnant woman. It also seeks to exclude all forms of abortion by tightly defining the applicable parameters.

It is a point of view which should be considered and discussed. This is what a mature public debate should be about and what government has been continuously avoiding. I would however expect other academics having different views to come out of the deep freeze and speak up.

We should look beyond the restrictive proposals presented in the discussion paper. Since the 2011 divorce referendum Malta has embarked on a journey of ethical pluralism which respects a plurality of views and ethical norms. The discussion paper is a negation of this journey and an attempt to change course, which attempt should be resisted.

At the end of the day the debate is not about what is right and wrong but on who should take the decision and the parameters within which it is permissible to act. We are not living in a theocracy. Differing views and values can definitely co-exist.

Let the debate, at last, begin.

Riforma tal-Parlament

Il-Prim Ministru ilu jinki lill-opinjoni pubblika dwar meta ser ikun xolt il-Parlament kif ukoll dwar meta ser tissejjaħ l-elezzjoni ġenerali.

Imma Robert Abela kien ikkwotat jgħid ukoll li sa Ġunju 2022 ikun għadda kollox!

Kif inhuma  l-affarijiet illum, hi responsabbiltà kostituzzjonali tal-Prim Ministru dwar meta jkun xolt il- Parlament kif ukoll dwar meta tissejjaħ elezzjoni ġenerali.  Dan jagħmlu billi jagħti parir dwar dan lill-President tar-Republika.  Ħafna drabi nassumu li dawn it-tip ta’ deċiżjonijiet jittieħdu fl-interess nazzjonali avolja hu ċar daqs il-kristall li hu l-interess tal-partit fil-Gvern li jiddetermina kollox: dejjem.  Miżura li ssaħħaħ il-posizzjoni tal-Gvern qabel u waqt l-elezzjoni: the power of incumbency.

Dan mhux sewwa u għandu jinbidel kif inbidlu bosta affarijiet oħra.

Il-partit li immexxi qajjem dan il-punt fis-sottomissjonijiet li għamilna quddiem il-Konvenzjoni Kostituzzjonali: konvenzjoni li, dejjem ġejja, imma qatt ma tasal!

Hu propost li t-terminu tal-Parlament ikun wieħed fiss u li l-Prim Ministru ma jkollu l-ebda diskrezzjoni dwar kif u meta dan ikun xolt.  Fil-prattika kemm l-Istati Uniti kif ukoll il-parti l-kbira tal-Ewropa kontinentali għandhom Parlament b’terminu fiss. Anke r-Renju Unit, meta kienet immexxija mill-koalizzjoni bejn il-partit Liberali u dak Konservattiv, ftit snin ilu, introduċiet leġislazzjoni għal Parlament b’terminu fiss.

F’dan il-kuntest tajjeb li jkun emfasizzat ukoll li t-terminu ta’ ħames snin għall-Parlament huwa ftit twil. Dan ma kienx dejjem hekk. Meta twaqqaf il-Parlament Malti għall-ewwel darba fl-1921, mitt sena ilu, il-ħajja tal-Parlament kienet ta’ tlett snin. Sal-lum il-ġurnata, l-Parlament Federali Awstraljan għadu jkun elett kull tlett snin. Il-Kamra tar-Rappresentanti tal-Istati Uniti min-naħa l-oħra tkun eletta kull sentejn.

X’uħud jistgħu jkunu tal-fehma li għall-Parlament, tul ta’ sentejn jew tlieta bejn elezzjoni u oħra huma ftit wisq. Għal min qiegħed fil-Gvern, ħames snin jistgħu jkun perjodu addattat. Imma għal min qiegħed fl-Opposizzjoni hu twil wisq! Tlett snin hu perjodu ferm iktar addattat.

Il-Parlament għandu ħtieġa ukoll ta’ membri li xogħolhom ikun biss dak ta’ membri tal-parlament u li ma jagħmlu xejn iktar. Hemm bżonn ukoll li n-numru ta’ membri tal-parlament jonqos għax in-numru li għandna illum hu kbir wisq.  Membru Parlamentari full-time jaqta’ għal kollox kull kuntatt ma xogħol u/jew professjoni u bħala riżultat ta’ hekk inaqqas sostanzjalment il-possibiltà ta’ kunflitt ta’ interess meta jkun f’posizzjoni li jieħu kwalunkwe deċiżjoni.

Id-daqs tal-lum tal-Parlament, jiġifieri dak ta’ 65 membru parlamentari, kien determinat bħala riżultat tal-emendi kostituzzjonali tal-1974.  Imma dan, illum il-ġurnata, sa mill-1987, mhux id-daqs definittiv għax miegħu jistgħu jiżdiedu iktar bħala riżultat tal-applikazzjoni tal-mekkaniżmu kostituzzjonali tal-proporzjonalità.   Jista’ jiżdiedu iktar ukoll, bi tnax-il membru ieħor riżultat tal-miżuri kostituzzjonali ġodda dwar il-bilanċ tal-ġeneru, jekk dawn ikunu applikati.

Il-Parlament li jmiss, għaldaqstant, jista’ jkunu kbir mhux ħażin jekk jintużaw kemm il-mekkaniżmu dwar il-proporzjonalità kif ukoll dak dwar il-bilanċ tal-ġeneru. Jista’ jkun daqs li jikber sa 77 membru u possibilment anke sa 81 membru. Dan hu enormi għall-pajjiżna.

Is-sistema elettorali, li ż-żewġ partiti fil-Parlament ilhom ibgħabsu għal żmien twil, tipprovdi għal riżultat proporjonali u b’element korrettiv favur il-bilanċ bejn il-ġeneri meta fil-Parlament ikunu eletti żewġ partiti politiċi biss. Meta jkun elett it-tielet partit dawn il-mekkaniżmi kostituzzjonali dwar il-proporzjonalità u l-bilanċ tal-ġeneru ma jistgħux jaħdmu. Hemm biss eċċezzjoni waħda. Din tkun fil-kaz ta’partit politiku li jikseb iktar minn 50 fil-mija tal-voti fl-ewwel għadd fuq livell nazzjonali. Dan ikollu dejjem il-jedd li jiggverna billi jkun allokat is-siġġijiet neċessarji għal dan l-iskop.  

Hemm numru ta’ soluzzjonijiet alternattivi li kieku ġew applikati kien ikun possibli li l-Parlament tagħna jkollu bilanċ aħjar bejn il-ġeneri u proporzjonalità mingħajr ma jikber fid-daqs.  Dawn is-soluzzjonijiet, imma, ġew skartati kompletament. Dan għax ir-riforma kellha dejjem l-iskop li toħloq l-inqas tibdil possibli. Tibdil kosmetiku fl-istil tal-Gattopardo: tibdil li jħalli kollox kif kien!

Dan hu l-Parlament tagħna. Jeħtieġ li jinbidel mill-qiegħ.

Reforming Parliament

The Prime Minister has been teasing public opinion for some time as to when Parliament will be dissolved and when we will consequently be proceeding to the next general election.

Robert Abela has been quoted as stating that it will definitely be over by June 2022.

As things stand, at this point in time, it is within the Constitutional prerogative of the Prime Minister to determine when Parliament is dissolved and a general election held. This he does by advising the President of the Republic accordingly. It is generally assumed that such decisions are taken in the national interest even though it is amply clear that it is always in the interest of the political party in power. It reinforces the power of incumbency.

Is this right? Should it remain so?

My party has raised this matter in its submissions to the Constitutional Convention which Convention has been pending for a number of years!

It is being proposed that Parliament should be a fixed-term Parliament and that the Prime Minister should have no discretion whatsoever in dissolving Parliament.  In practice both the United States as well as most of continental Europe have fixed-term Parliaments. Even the United Kingdom, some years ago, led by a Liberal-Conservative coalition, introduced legislation for a Parliament having a fixed-term.

Within this context it would be also pertinent to emphasise that a five-year term is a little bit too long. This was not always so. When Malta’s Parliament was originally established in 1921, 100 years ago, it had a three-year life span. The Australian Federal Parliament in this day and age is still elected every three years. The United States House of Representatives on the other hand is elected every two years.

Some could argue that a two- or three-year life span for parliament would be too short. Five years may be right for those governing. It is however too long for those in Opposition! A three-year term could be the right balance.

Parliament also needs fulltime MPs and probably less of them. A fulltime member of parliament would cut off completely all of his/her links with profession and/or employment and as a result substantially reduce instances of conflict of interest when faced with decision taking.

Parliament’s present size of 65 members was determined as a result of the 1974 Constitutional amendments. Since 1987, it is however not a definite size, as it is increased as a result of the constitutional adjustment mechanism for proportionality. It will be increased by a further twelve members if the newly introduced constitutional gender balance requirements are applied.

The next Parliament could be quite large if both the proportionality and gender balance adjustment mechanisms are in use. It could inflate to a size between 77 and 81 members! This is enormous for a country our size.

The electoral system, which the two parties currently in parliament have been tinkering with for ages, provides for proportionality and gender balance only if just two parties are elected into Parliament. If a third party is elected, both the constitutional provisions for proportionality and gender balance will not be activated. There is just one exception and this is relative to the political party which obtains more than 50 per cent of the votes on a national level: in such an instant, irrespective of the number of political parties making it to Parliament the party having an absolute majority of votes is ensured of having the parliamentary seats required for governing.

There are a number of alternative solutions available which make it possible for our Parliament to be both gender-balanced and proportional without any increase in its size. These solutions have however been completely discarded as the “reform” brief was always to change as little as possible. Cosmetic change is the order of the day in Gattopardo style: change which leaves everything the same.

Such is the state of our parliament. It needs a complete overhaul, which is long overdue.

Estradizzjoni għal Konrad Mizzi?

L-istejjer dwar Konrad Mizzi huma bla limitu: sa mill-ewwel mument li daħal fil-Parliament u l-Kabinett. It-twaqqif tat-trust fi New Zealand u r-registrazzjoni ta’ kumpanija fil-Panama komplew jitfgħu ftit dawl fuq kif jaħdem dan il-bniedem.

Bil-pubblikazzjoni tal-Panama Papers għajnejn ħafna tbexxqu u bdew jistaqsu. Id-dubji għad mhumiex imwieġba anzi inħolqu dubji ġodda bi stejjer ġodda.

Hu fatt li Konrad Mizzi mhux Malta. Ilu nieqes minn Marzu u l-anqas Parlament ma mar. Iċ-ċertifikati mediċi f’dawn iċ-ċirkustanzi ftit li xejn jitwemmnu.

Jason Azzopardi qed jagħmel allegazzjonijiet serji ħafna. Qed jgħid li Mizzi hu maħrub għax jibża’ li jkun investigat mill-kummissarju l-ġdid. Din hi possibiltà realistika u tweġiba, fiċ-ċirkustanzi, ftit hemm min jista’ jagħtiha ħlief Konrad Mizzi nnifsu u possibilment Robert Abela.

Meta Konrad Mizzi tneħħa mill-Kabinett għax ġie mġiegħel jirriżenja kien pass tajjeb. Li ma ntagħżilx bħala Ministru minn Robert Abela meta dan għażel il-Kabinett ġdid tiegħu kien pass ieħor il-quddiem. Issa jonqos pass ieħor: li jwieġeb għal għemilu meta, possibilment, flimkien ma oħrajn jkun imsejjaħ jagħmel hekk.

Sakemm jibqa’ maħrub fir-Renju Unit dan mhux possibli li jsir. Ovvjament jekk il-Kummissarju l-ġdid jirriżultalu li hemm il-provi dejjem hemm il-possibilità ta’ talba ta’ estradizzjoni. Mir-Renju Unit s’intendi għax mill-Montenegro ma naħsibx li jkun possibli!

Wiċċ b’ieħor

Safe City Malta, li tifforma parti minn Projects Malta li tippjana proġetti ta’ tisħib mas-settur privat, qed tippjana li jkunu installati cameras CCTV b’kapacità li jidentifikaw l-uċuħ ta’ dawk li x-xbieha tagħhom tinqabad fuq is-CCTV. Qed jingħad li b’dan il-mod ikun possibli li jkunu identifikati persuni li jkunu involuti f’attività kriminali.

Dwar dan ukoll hemm referenza fid-diskors tal-Baġit fejn kien tħabbar li : “Fl-aħħar xhur kienet għaddejja ħidma biex ġie installat l-apparat neċessarju f’data centre għal użu fuq bażi sperimentali u fejn l-apparat ta’ sorveljanza viżiva qiegħed jintuża biss f’ambjent mhux pubbliku u f’rispett sħiħ tal-liġijiet tal-privatezza billi jiġu wżati prattii etiċi internazzjonali.” Ġejna infurmati li Paceville u l-Marsa, probabbilment li jkunu minn tal-ewwel li jospitaw dan l-esperiment. Dan kellu jsir wara li sseħħ konsultazzjoni pubblika.

Imma s’issa ma seħħet l-ebda konsultazzjoni. Nafu iżda li x’aktarx li diġa ġie iffirmat memorandum of understanding mal-Huawei, kumpanija Ċiniża li hi meqjusa ġgant globali fil-qasam tat-teknoloġija tal-komunikazzjoni. Fix-xhur li ġejjin probabbilment tibda l-implementazzjoni. Dan ifisser li jekk il-konsultazzjoni sseħħ ma jkollha tifsira ta’ xejn, għax id-deċiżjonijiet jidher li lesti.

Iktar kmieni din is-sena, Huawei, ftehmu mad-Dipartiment tas-Sigurtà Pubblika tar-reġjun ta’ Xinjiang fil-punent taċ-Ċina. Intefqu flejjes kbar f’dan ir-reġjun biex f’Xinjiang ikun possibli li tkun ippruvata t-teknoloġija għall-għarfien tal-uċuħ, osservazzjoni diġitali u l-applikazzjoni tal-intelliġenza artifijali għal xogħol il-pulizija. Huawei ser jipprovdu lill-pulizija tar-reġjun l-appoġġ tekniku biex ikunu żviluppati l-kapaċitajiet tan-nies involuti u b’hekk tissodisfa l-ħtiġijiet diġitali tal-industrija tas-sigurtà pubblika, ġie rappurtat li qal Fan Lixin, il-Viċi Direttur tad-Dipartiment tas-Sigurtà Pubblika ta’ Xinjiang . Din il-kooperazzjoni kienet meqjusa li tista’ tassigura “l-istabilità soċjali u s-sigurtà fit-tul ta’ Xinjiang”.

Dan jikkuntrasta ma dak li nsibu fir-rapport annwali ta’ Huawei għas-sena 2017 li jwassal messaġġ ċar: Huawei jimpurtha ħafna mill-privatezza. Jgħidulna li fl-2017 “Huawei continued to strengthen compliance in multiple business domains, including trade, cyber security, and data and privacy protection.” Jgħidulna ukoll dwar “il-ħsiebijiet ta’ Huawei dwar is-sigurtà elettronika – li tissaħħaħ bl-innovazzjoni, bil-kollaborazzjoni u bl-iżvilupp tal-fiduċja fid-dinja diġitali.” Probabbilment li dan il-kuntrast jirriżulta minħabba li l-messaġġi huma indirizzati lejn udjenzi differenti!

Iktar viċin tagħna, l-pulizija fir-Renju Unit ilhom ftit taż-żmien jesperimentaw bit-teknoliġija li tirrikonoxxi l-uċuħ. Big Brother Watch, grupp li jikkampanja favur id-drittijiet ċivili fir-Renju Unit jirrapporta li s-sistemi użati jagħtu riżultati żbaljati 9 darbiet minn 10. F’rapport twil 56 paġna, li kien ippubblikat f’Mejju li għadda bit-titlu Face Off. The lawless growth of facial recognition in UK policing. kien konkluż li 95 fil-mija tal-uċuħ identifikati mis-sistema kienu żbaljati: kienu wiċċ b’ieħor. Identifikaw uċuħ ta’persuni innoċenti. Dan apparti li r-ritratti biometriċi ta’ persuni innoċenti inżammu u nħażnu mill-Pulizija b’mod sfaċċat kontra kull regola bażika tal-ħarsien tad-data.

L-użu tat-teknoloġija biex jingħarfu l-uċuħ tan-nies bħala għodda ta’ l-ordni pubbliku hi għall-qalb il-pulizija, li fuq il-karta jistgħu jgħidu li qed isaħħu l-kapaċitajiet tagħhom fil-ġlieda kontra l-kriminalità. Għall-bqija imma, dan hu ħmar-il lejl u dan billi jekk it-teknoloġija ma tintużax fil-parametri tar-regoli bażiċi tal-ħarsien tad-data tkun invażjoni tal-privatezza li kull wieħed u waħda minna aħna intitolati għaliha.

Il-Kummissarju għall-Ħarsien tad-Data u l-Informazzjoni Saviour Cachia, f’intervista mal-Orizzont iktar kmieni din il-ġimgha qal li kien jistenna li l-awtoritajiet jagħmlu analiżi addattata qabel ma jagħmlu użu ta’ teknoloġija li kapaċi tagħraf l-uċuħ. Is-Sur Cachia emfasizza li għad baqa’ ħafna xi jsir qabel ma nistgħu nikkunsidraw meta u kif it-teknoloġija għall-għarfien tal-uċuħ tista’ tuntuża fil-qasam tas-sigurtà. Ħadd ma jaf jekk l-analiżi li ġibed l-attenzjoni għaliha s-Sur Cachia saritx, jew jekk tal-inqas inbdietx. Din it-teknoloġija tinvadi l-privatezza ta’ kulħadd b’sogru li tikser d-drittijiet fundamentali tagħna lkoll.

Meta jkun eżaminat dettaljatament kif l-użu ta’ din it-teknoloġija jista’ jkollha effett fuq l-attività kriminali inkunu f’posizzjoni aħjar biex niddeċiedu x’sens jagħmel li nissagrifikaw il-privatezza tagħna, anke jekk b’mod limitat, biex l-istat jissorvelja u sa ċertu punt jikkontrolla parti minn ħajjitna. L-esperjenza tal-użu ta’ din it-teknoloġija fir-Renju Unit għandha twassalna għall-konklużjoni waħda: għandna nsemmgħu leħinna u nieqfu lill-istat li jrid jissorvelja ħajjitna.

Il-Gvern għandu l-obbligu li jibda konsultazzjoni pubblika immedjatament u jpoġġi l-pjanijiet tiegħu taħt il-lenti tal-iskrutinjun pubbliku.

Standing up to the surveillance state

Safe City Malta, part of the government’s public-private partnership arm Projects Malta, is planning to deploy high-definition CCTV cameras with facial recognition software. It is claimed that these cameras can identify those involved in criminal activity. The subject was referred to in the budget speech in which it was announced that, after adequate public consultation, such technology will be introduced in a number of areas. Paceville and Marsa are the prime candidates for this technology.

So far, no consultation has taken place, but a Memorandum of Understanding has apparently already been signed with the Chinese global communication technology giant Huawei, and implementation could begin in the coming months. So, the consultation, if carried out, will serve no purpose because the decisions have already been made.

Earlier this year, Huawei entered into an agreement with the Public Security Bureau in Xinjiang, China’s largest province. The Chinese authorities have spent heavily on making Xinjiang a testing ground for the use of facial recognition, digital monitoring and artificial intelligence in policing.

Huawei will provide the region’s police with technical support, help build up human technical expertise and “meet the digitization requirements of the public security industry”. A local government website paraphrased Fan Lixin, Xinjiang Public Security Bureau’s deputy director, as saying that such co-operation would guarantee “Xinjiang’s social stability and long-term security.”

The above quote is in contrast to the contents of Huawei’s Annual Report for 2017,  which drives home the message that Huawei cares a great deal about privacy. We are told that, in 2017, “Huawei continued to strengthen compliance in multiple business domains, including trade, cyber security and data and privacy protection.” We are furthermore informed of the “Huawei’s cyber security concepts – building security through innovation, enhancing security through collaboration and jointly building trust in a digital world.”

The contrast is probably the result of the messages being directed towards different audiences!

Closer to home, police in the United Kingdom have been experimenting with facial recognition technology for some time. Big Brother Watch, a UK based civil liberties group, reports that the systems in use are on average, incorrect nine times out of ten. A 56-page report published in May, entitled Face Off: the lawless growth of facial recognition in UK policing. concluded that “a staggering 95 per cent of matches wrongly identified innocent people”. To add insult to injury, innocent people’s biometric photographs were taken and stored without their knowledge in blatant disregard of basic data protection norms.

The use of facial recognition technology as a law and order tool has been welcomed by the police, as it can theoretically enhance their capabilities in the fight against crime. The proposal, however, is a nightmare for the rest of us because if it is not used within the parameters of data protection legislation, facial recognition technology will be an unacceptable invasion of the basic norms of privacy to which each one of us is entitled to.

The Commissioner for Information and Data Protection Saviour Cachia, interviewed by the GWU’s daily newspaper earlier this week emphasised that he expected that a proper assessment to be carried out by the authorities prior to the use of facial recognition technology. Mr Cachia emphasised the fact much more needs to be done before considering when and how facial recognition technology is used for security purposes. No one is aware whether or not the required assessment indicated by Mr Cachia has, in fact, been done or even if work on it has commenced.

This technology invades our privacy in an indiscriminate manner and our fundamental human rights are at risk of being breeched left , right and centre.

Examining in detail the impacts that this technology could have on criminal activity would help us determine whether it makes any sense to sacrifice our privacy (even minutely) in order for the surveillance state to take over and control segments of our life. If the UK experience is anything to go by, there is one logical conclusion: we should stand up to the surveillance state.

The Government should initiate a public consultation at the earliest opportunity and lay all its cards on the table for public scrutiny.

L-Awtoritá tal-Ippjanar tinkoraġixxi l-ispekulazzjoni tal-art

L-Awtoritá tal-Ippjanar qed toħroġ il-permessi ta’ żvilupp għall-pompi tal-petrol u d-dijsil ħierġin bħall-pastizzi.

Xi xhur ilu, f’diskors li għamel il-Prim Ministru kien qal li l-Gvern immexxi minnu jaqbel li karozzi li jaħdmu bil-petrol jew bid-dijsil għandhom jispiċċaw mit-toroq Maltin. Nhar l-10 ta’ Settembru 2017 Joseph Muscat kien ħabbar li l-Gvern kien fi ħsiebu li “dal-waqt” jagħti bidu għal konsultazzjoni pubblika biex ikun stabilit meta u kif għandha tkun implimentata din il-politika li bħala riżultat tagħha jkunu jistgħu jinxtraw biss karozzi li jaħdmu bl-elettriku jew karozzi simili.

Għaddew seba’ xhur u għadna qed nistennew li jibda dan il-proċess ta’ konsultazzjoni pubblika. Sadanittant, aħna u nistennew, l-ispekulaturi tal-art, bl-għajnuna tal-Awtoritá tal-Ippjanar għaddejjin xalata: jippjanaw kif jirrovinaw iktar raba’, 3000 metru kwadru kull darba, u dan biex jibnu pompi li ftit ieħor mhux ser ikollna bżonn. Imbagħad x’nagħmlu bl-art li tkun diġa ġiet rovinata?

Alternattiva Demokratika taqbel li m’għandniex ħtieġa ta’ karozzi li jaħdmu bil-petrol u d-dijsil fit-toroq tagħna. Fil-fatt kienet Alternattiva Demokratika, bil-ħsieb li tintlaħaq il-mira strateġika ta’ Karbonju Żero fil-gżejjer Maltin li fil-Manifest Elettorali ta’ l-aħħar elezzjoni ġenerali poġġiet quddiem l-elettorat din il-proposta speċifika: li fi żmien 20 sena, ċjoe sal-2037, għandhom jispiċċaw il-karozzi kollha li jaħdmu bil-petrol u d-dijsil mit-toroq Maltin. Alternattiva Demokratika kienet l-uniku partit politiku f’Malta li kien ċar fuq dan f’Malta sa minn qabel l-elezzjoni ġenerali.

Id-dikjarazzjoni tal-Prim Ministru tal-10 ta’ Settembru 2017 kellha twassal għall-konklużjoni loġika li m’għandniex bżonn ta’ iktar pompi tal-petrol u d-dijsil. Kien ikun floku kieku tħabbar moratorju immedjat. Fil-fatt messna qegħdin ngħoddu l-ġranet li neħilsu darba għal dejjem mill-karozzi li jaħdmu bil-petrol u d-dijsil. Bħala riżultat ta’ dan messu hu ovvju li fil-futur qarib m’hu ser ikollna bżonn l-ebda pompa tal-petrol jew dijsil: dawn għandhom jonqsu mit-80 li għandna illum sa xejn u dan meta tkun implimentata b’mod sħiħ il-politika mħabbra mill-Prim Ministru u li dwarha ilna 7 xhur nistennew il-konsultazzjoni pubblika.

M’għandniex bżonn ta’ pompi ġodda: imma għandna bżonn li jagħlqu l-pompi li ġja hawn mingħajr ma jinħolqu oħrajn flokhom. L-20 sena proposti minn Alternattiva Demokratika fil-manifest elettorali tal-2017 biex jispiċċaw mit-toroq Maltin karozzi li jaħdmu bil-petrol jew bid-dijsil kienu meqjusa raġjonevoli, suffiċjenti u fl-istess direzzjoni ta’ deċiżjonijiet politiċi simili li ittieħdu minn pajjiżi oħra. Dan hu żmien biżżejjed biex tkun żviluppata l-infrastruttura nazzjonali meħtieġa għall-karozzi li jaħdmu bl-elettriku. Hu ukoll biżżejjed biex dawk li għandhom dawn it-tip ta’ karozzi jibdew jidraw ftit l-iżvilupp ta’ din ir-realtá ġdida bla petrol jew dijsil.

Bosta pajjiżi oħra diġa ddeċidew, inkella qegħdin fil-proċess li jiddeċiedu li fit-toroq tagħhom ma jkollhomx iktar karozzi li jaħdmu bil-petrol jew bid-dijsil. Dawn jinkludu in-Norveġja u l-Olanda (it-tnejn sal-2025), il-Ġermanja (sal-2030), Franza, r-Renju l–Indja u ċ-Ċina (lkoll sal-2040). Ma jdumx ma jkun hemm oħrajn ukoll.
L-Awtoritá tal-Ippjanar qegħda tkompli tinjora dan l-iżvilupp importanti fil-politika tal-pajjiż billi tibqa’ għaddejja bl-applikazzjoni tal-politika imsejħa 2015 Fuel Service Stations Policy b’mod robotiku. Din il-politika dwar il-pompi tal-petrol u d-dijsil tippermetti qies massimu permissibli ta’ 3000 metru kwadru imma l-Awtoritá qatt ma qieset li kien neċessarju li tordna tnaqqis fil-qies tal-proposti li kellha quddiema. Għax kollha kellhom il-qies massimu ta’ 3000 metru kwadru. Bħala riżultat ta’ dan l-Awtoritá tal-Ippjanar flok għal pompi qed toħroġ permessi għal żoni massiċċi kummerċjali barra miż-żona tal-iżvilupp.

Din hi l-agħar forma ta’ spekulazzjoni tal-art u f’dan il-kaz it-tort hu unikament tal-Awtoritá tal-Ippjanar. L-Awtoritá tal-Ippjanar hi ta’ theddida għall-ġenerazzjonijiet futuri. Dan hu l-punt li għamlu ż-żgħażagħ mill-Moviment Graffiti u l-Kamp Emerġenza Ambjent meta nhar il-Ħamis ipprotestaw u ħarbtu laqgħa tal-Bord tal-Awtoritá tal-Ippjanar waqt li dan kien qiegħed jikkunsidra applikazzjoni għall-pompa ġdida tal-petrol u d-dijsil f’Ħal-Luqa.

Għandna Awtoritá tal-Ippjanar li hi ala bieba mill-ambjent u mill-kwalitá tal-ħajja. Bil-provi.

 

 

The Planning Authority encourages land speculation

Development permits for fuel stations are being approved left, right and centre by the Planning Authority.

Some months ago,  in a speech made in public, the Prime Minister said that the Government agrees that use of petrol and diesel cars should be phased out and that, in future, all cars should be electric. On the 10 September 2017, Joseph Muscat announced that government would “shortly” be launching a consultation on “setting a cut-off date beyond which all new car purchases would have to be electric or similar vehicles.”

Seven months have elapsed, and we are still waiting for the consultation exercise to be launched. And while we wait, land speculators (with the Planning Authority’s assistance) are in festive mood, plotting the ruin of 3000 square metres at a time to develop fuel stations that we will shortly not need any more. And what will be done with the spoiled land then?

Alternattiva Demokratika agrees with the proposal to establish a cut-off date for cars that run on petrol and diesel. Indeed in its manifesto at the last general election,  with a strategic zero carbon future for the Maltese Islands in mind, it put forward this specific proposal to the electorate: that internal combustion engine cars should be off our roads in 20 years time, that is by 2037. Alternattiva Demokratika was the only political party in Malta that took this clear stand before the general election.

In view of the Prime Minister’s declaration of the 10 September 2017, the logical conclusion is that new fuel stations are not required. An immediate moratorium would be in order and, in fact, we should be on the eve of the start of a countdown that would rid us of cars that run on petrol or diesel. Consequently, there will be no need for fuel stations in the not too distant future: reducing from the current 80 to none, when the phase-out – which is still subject to public consultation – is fully implemented.

We do not need new fuel stations: what we need is that existing fuel stations are closed down without their being replaced. The 20-year time-frame proposed by Alternattiva Demokratika in its 2017 electoral manifesto was considered to be reasonable, sufficient and in line with similar policy decisions taken in other countries. This time-frame was deemed sufficient to develop the required national infrastructure for electric-powered cars. It was also deemed to be a reasonable length of time to permit those who own vehicles running on internal combustion engines to adjust to the development of a new reality without petrol or diesel.

Various other countries have decided on – or are considering – the elimination of internal combustion engine driven vehicles from their roads. These include Norway and the Netherlands (both by 2025), Germany (by 2030), France, the United Kingdom, India and China (all by 2040). Others will soon follow.

The Planning Authority continues to ignore this policy development by applying the 2015 Fuel Service Stations Policy robotically. This policy establishes a maximum permissible size of 3000 square metres but the Authority did not consider it appropriate to scale down any of the proposals submitted for its consideration as all the approved stations cover the maximum size possible. As a result, the Planning Authority is churning out permits for massive commercial areas outside the development zone.

This is land speculation at its worst and the Planning Authority has no one to blame but itself and is a threat to future generations. This is the point made by the protestors from Graffiti and Kamp Emerġenza Ambjent last Thursday, when they stormed a Planning Authority Board meeting considering a development application for a new fuel station at Luqa.

We have a Planning Authority which doesn’t give two hoots about the environment and our quality of life.

L-Ippjanar rasu l-isfel

Nhar l-Erbgħa, l-Kumitat Parlamentari dwar l-Ambjent u l-Ippjanar beda d-diskussjoni dwar jekk għandux ikun hemm tibdil fil-politika dwar il-pompi tal-petrol (u d-disil) (Fuel Service Stations Policy) tal-Awtorità tal-Ippjanar. Bla dubju kien xprunat mid-deċiżjonijiet riċenti tal-istess awtorità dwar pompi tal-petrol f’f’Burmarrad, Marsaskala u l-Magħtab. Hemm applikazzjonijiet pendenti għal pompi ġodda f’Ħ’Attard, l-Imqabba u l-Iklin fil-waqt li hemm madwar 60 pompa oħra qed jistennew il-permessi mill-Awtorità tal-Ippjanar biex itejbu l-faċilitajiet inkluż protezzjoni ambjentali u dan minn total eżistenti ta’ 85 pompa.

Il-kummenti validi kienu bosta. Ikkonċentraw l-iktar fuq il-ħtieġa li l-pompi tal-petrol fiż-żona urbana jingħalqu u li dawn jiċċaqalqu xi mkien ieħor. Ftit iżda kien hemm ħeġġa biex tkun diskussa l-qalba tal-materja: xi bżonn għandna tal-pompi tal-petrol?

Madwar ħames xhur ilu, il-Prim Ministru, wara li għal darba oħra ħares ħarsa sewwa lejn il-Manifest Elettorali ta’ Alternattiva Demokratika tal-2017, ħabbar, li l-Gvern immexxi minnu kien ser jagħti bidu għal process ta’ konsultazzjoni pubblika. Dan biex jistabilixxi data minn meta karozzi li jaħdmu bil-petrol u d-disil ma jkunux jistgħu jinbiegħu iktar biex minflok ikollna karozzi li jaħdmu bl-elettriku. Ma smajna xejn iktar dwar dan ħlief artiklu miktub mill-Ministru tat-Trasport Ian Borg entużjażmat li fis-snin li ġejjin ser nimxu fuq il-passi ta’ pajjiżi Ewropej oħra.

Il-Prim Ministru, bir-raġun kollu emfasizza li din il-bidla fil-politika tal-Gvern kienet meħtieġa minħabba li l-emmissjonijiet tal-karozzi kienu l-ikbar sors ta’ tniġġiż tal-arja fil-pajjiż. Għalfejn dan id-dewmien kollu biex ikunu stabiliti u mħabbra d-dettalji ta’ din id-deċiżjoni tajba? Uħud mill-pajjiżi Ewropej ilhom żmien li għamlu dan. In-Norveġja u l-Olanda stabilew is-sena 2025, il-Ġermanja qed tikkonsidra s-sena 2030, fil-waqt li Franza u r-Renju Unit huma mħajra għas-sena 2040 biex iwaqqfu l-bejgħ ta’ karozzi li jaħdmu bil-petrol u d-disil.

Id-diskussjoni dwar il-politika li tikkonċerna l-pompi tal-petrol/disil għandha issir f’kuntest wiesgħa tal-politika tat-trasport inkluż l-elettrifikazzjoni tal-mezzi privati tat-trasport.

Il-punt ewlieni tad-diskussjoni huwa li bħala riżultat tal-elettrifikazzjoni n-numru ta’ pompi tal-petrol/disel meħtieġa mhux ser jiżdied imma ser jonqos fuq medda ta’ snin u dan sakemm jasal għal xejn jew kważi xejn. Allura għalfejn nibnu u ninkoraġixxu l-bini ta’ iktar pompi tal-petrol/disil? Ikun ferm iktar għaqli kieku l-investiment nindirizzawh lejn is-soluzzjoni tal-problemi, mhux lejn it-tkattir tagħhom!

Il-pompi tal-petrol eżistenti fiż-żoni urbani qed jintużaw bħala skuża biex jippruvaw jiġġustifikaw it-tħarbit ta’ 3000 metru kwadru ta’ art. Fil-fatt dan hu l-iskop ewlieni tal-politika dwar il-pompi tal-fjuwil approvata fl-2015.

Ma jkunx aħjar li flok ma jingħalqu l-pompi tal-petrol fl-abitat ikunu konvertiti f’lok fejn tiċċarġja l-batteriji tal-karozzi? Dawn il-pompi qegħdin fil-parti l-kbira tagħhom f’żoni ċentrali u huma ġeneralment ta’ qies żgħir. Kull pompa tal-petrol urbana li tkun salvata u konvertita biex fiha niċċarġjaw il-batteriji tfisser ukoll li nkunu salvajna 3000 metru kwadru ta’ art minn spekulazzjoni. Fl-istess ħin inkunu qed nippovdu servizz li ser ikun essenzjali eżatt fejn hu meħtieġ.

Dan ikun użu tajjeb għall-investiment, aħjar milli jintuża f’bini ta’ pompi ġodda barra miż-żona ta’ l-iżvilupp. Jekk dan isir inkunu qed nittrasformaw problema eżistenti f’diversi lokalitajiet f’soluzzjoni addattata għall-bini tal-infrastruttura meħtieġa għall-eletrifikazzjoni tat-trasport privat f’Malta.

Dan ovvjament ifisser li nkunu qed naqilbu ta’ taħt fuq il-politika dwar il-pompi tal-fjuwil. Flok ma nużaw il-pompi urbani bħala skuża biex tkun ġustifikata l-ispekulazzjoni tal-art inkunu qed nagħtu spinta tajba lill-ħarsien ambjentali.

Hu eżattament dan li għandna bżonn f’dan il-mument: naqilbu l-ippjanar rasu l-isfel.
