Regulating lobbying

When Parliament, some years back, approved the Standards in Public Life legislation it did not arrive at any conclusions on the regulation of lobbying. It postponed consideration of this important matter by delegating the matter to the Commissioner for Standards in Public Life – then still to be appointed. The Commissioner had to draft a set of lobbying guidelines.

It is now almost two years since the publication by the Commissioner for Standards in Public Life of a consultation document entitled “Towards the Regulation of Lobbying in Maltain which document Dr George Hyzler, the Commissioner, outlines his views as to how lobbying should be regulated in Malta.

The Office of the Commissioner for Standards in Public Life has requested technical support from the EU’s Directorate General for Structural Reform in the area of “public integrity”. A technical support team from OECD engaged by the EU is currently in Malta to assist and advise the Office of the Commissioner for Standards in Public Life.  I have had the opportunity of a very fruitful discussion with one of the OECD lobbying experts earlier during the week.

Hopefully in the weeks ahead the Commissioner will be in a position to submit a clear proposal indicating the way ahead for regulating lobbying in Malta.

In his consultation document of two years ago the Commissioner rightly emphasises that due to the particular circumstances of the country, the small size of the country and the population in particular, decision-takers are easily accessible. This leads to the conclusion that there is limited need to regulate the professional lobbyist. Rather, opines the Commissioner, there is a need to address contacts between decision-takers and private individuals who have such easy access.

The Commissioner makes the point that this should be done carefully without obstructing or hindering the direct contact between the politician as decision-taker and the voter at constituency level. This is a valid point but not without its dangers and pitfalls. At constituency level democracy is strengthened. It is also where clientelism is carefully nurtured. This is also a basic characteristic of this small country.

Lobbying is about influencing the decision-taker. It is perfectly legitimate for any citizen, group of citizens, corporations or even NGOs to seek to influence decision-taking. This is done continuously and involves the communication of views and information to politicians, parliamentarians and administrators by those who have an interest in the decisions under consideration.  

Hence the need for lobbying to be transparent and above-board. This is normally done through ensuring that meetings held by holders of political office or senior administrators are well documented and that the resulting minutes and supporting documents are available for public scrutiny.

Formal lobbying would be thus addressed. But that leaves informal lobbying which is the real headache. This can only be regulated if those lobbied are willing to submit themselves to the basic rules of transparency. Self-declarations by those lobbied would in such circumstances be the only way to keep lobbying in check!

This is however not all.

There are more sinister ways through which lobbying is carried out. Well organised sectors of industry and business employ former decision-takers as advisors or in some other high-sounding senior position. This ensures that the “advisor” can share his knowledge and contacts with his “new employer” thereby facilitating the effectiveness of focused lobbying. This practice is normally referred to as “revolving-door recruitment” and is an integral part of the lobbying process which needs regulating the soonest.

There are countless examples of this practice both locally and abroad, in respect of which I have already written various times. This aspect tends to be regulated by establishing a reasonable time-frame during which the former decision-taker or administrator cannot seek employment in areas of economic activity in respect of which he had political or high-level administrative or regulatory responsibilities.

The regulation of lobbying is essential in a democracy. Unregulated, lobbying can, and generally does, develop into corruption.

Lobbying can be a legitimate activity. Adequate regulation of lobbying, properly applied, ensures that it remains within legitimate boundaries.

Meta l-istat jinkoraġixxi l-evażjoni tat-taxxa

F’indirizz li għamlet nhar it-Tnejn liċ-Chicago Council on Global Affairs, Janet Yellen, Segretarju għat-Teżor tal-Istati Uniti, ippreżentat l-argument favur taxxa minima applikabbli għall-korporazzjonijiet multinazzjonali fuq livell globali, irrispettivament minn fejn huma bbażati.  Proposta ta’ din ix-xorta, kif rappurtat min-New York Times, ikollha s-saħħa li żżomm lil dawn il-kumpaniji milli jċaqilqu l-profitti tagħħom minn post għall-ieħor biex jevadu l-ħlas tat-taxxi dovuti minnhom.

Meta jitnaqqsu it-taxxi biex tinġbed l-industrija u n-negozju, emfasizzat  Ms Yellen, hemm is-sogru li mmissu l-qiegħ: fejn ser tieqaf? Ma nistgħux nibqgħu sejrin hekk. Il-kompetittività mhiex biss kif kumpanija tmur fil-konfront ta’ kumpaniji oħra.  Hi ukoll il-mod li bih nassiguraw  li l-gvernijiet ikollhom sistemi ta’ ġbir ta’ taxxa li jkunu stabbli b’mod li jistgħu jiġbru biżżejjed fondi x’jinvestu f’servizzi publiċi u jkunu f’posizzjoni li jirreaġixxu fi żmien ta’ kriżi. Hu meħtieġ li ċ-ċittadini bejniethom jerfgħu b’mod ġust il-piż tal-finanzjament tal-gvern.”

Din il-materja hi diġa fuq l-agenda tal-Unjoni Ewropeja. Hi opposta b’qawwa minn Malta, il-Lussimburgu, l-Irlanda u pajjiżi oħrajn.  L-argument dwar l-armonizzazzjoni tat-tassazzjoni hu parti integrali mill-ġlieda kontra l-evażjoni tat-taxxa u l-ħasil tal-flus.

Hu ta’ sfortuna li Malta (u pajjiżi oħrajn) repetutament abbużat mis-sovranità tagħha fuq materji ta’ taxxa. Huwa riżultat ta’ dan l-abbuż repetut li l-proposta dwar l-armonizzazzjoni tat-taxxa qabdet l-art b’mod li issa hi appoġġata ukoll mill-Istati Uniti tal-Amerka.  Malta rmiet il-vantaġġ kompetittiv tagħha billi abbużat minnu repetutament. Il-ħsara lir-reputazzjoni tal-pajjiż hi għaldaqstant awto-gol mill-kbar.

Malta ma tistax tkun kredibbli fil-ġlieda kontra l-evażjoni tat-taxxa u l-ħasil tal-flus jekk ser tibqa’ tiffaċilita l-evażjoni tat-taxxa fuq skala internazzjonali.  Xi snin ilu il-Grupp tal-Ħodor fil-Parlament Ewropew kien ippubblika studju intitolat Toxic Tax deals: when BASF’s tax structure is more about style than substance. Dan ir-rapport kien svela kif tul is -snin, il-kumpanija Ġermaniża ġgant tal-kimika BASF kien irnexxielha tevita u tiffranka l-ħlas ta’ biljun euro f’taxxi fuq 4 snin billi użat lill-Malta għal dan l-iskop. Dan sar billi kumpanija sussidjarja ġiet reġistrata f’Malta u t-taxxi dovuti, għax l-azzjonisti mhux residenti f’Malta, ħadu lura 6 euros minn kull 7 li kellhom iħallsu f’taxxa!

Il-każ tal-Korporazzjoni Amerikana Apple fl-Irlanda, kif nafu, wassal għall-evażjoni ta’ 13-il biljun euro f’taxxi. L-iskandlu Luxleaks fil-Lussimburgu ukoll wera kif dan il-pajjiż żgħir fost il-fundaturi tal-Unjoni Ewropeja ukoll kien qed jinkoraġixxi l-evażjoni tat-taxxa.

Dawn huma ftit mill-eżempji. Bla dubju hemm bosta oħra li s’issa huma moħbija mill-iskrutinju pubbliku. Bħala riżultat ta’ dan kollu madwarna għaddejja evażjoni ta’ biljuni ta’ euro ta’ taxxi, kontinwament. Malta, l-Irlanda, il-Lussimburgu u xi pajjiżi oħra jiġbru parti żgħira mit-taxxi dovuti bħala ħlas talli jippermettu din l-evażjoni ta’ taxxa fuq skala pjuttost kbira.

F’Malta dan kollu kien possibli bħala riżultant tal-hekk imsejjaħ “kunsens nazzjonali” bejn il-PLPN dwar il-qasam finanzjarju. “Kunsens” li ilu fis-seħħ numru ta’ snin. Il-ħsara lir-reputazzjoni ta’ Malta li seħħet u għad qed isseħħ bħala riżultat ta’ dan kollu, għaldaqstant, ma jġorriex il-Partit Laburista waħdu. Il-Partit Nazzjonalista ukoll għandu resposabbiltà xi jġorr. Għalhekk fuq dawn il-materji in-Nazzjonalisti u l-Labour dejjem iħokku dahar xulxin.  

Sfortunatament l-evażjoni tat-taxxa u l-ħasil tal-flus huma ħafna drabi konnessi. Bosta drabi fejn issib waħda issib l-oħra ukoll.

It-triq il-quddiem m’għandiex ikollha impatt fuq is-sovranità fil-qasam tat-tassazzjoni kif determinat mit-trattati Ewropej permezz tal-ħtieġa tal-unanimità f’materji konnessi mat-taxxa. Imma hemm bżonn urġenti li l-qasam tal-politika fiskali ukoll jinbena fuq prinċipji etiċi b’saħħithom. U mhux dan biss. Għandu jkun assigurat darba għal dejjem li Malta ma tibqax tiddependi minn dħul ġej mill-evażjoni tat-taxxa.

Għax id-dipendenza tal-ekonomija Maltija fuq l-evażjoni tat-taxxa (u l-bejgħ tal-passaporti) hi ta’ inkwiet kbir għall-pajjiż. L-industrija tal-evażjoni tat-taxxa hi sors ta’ dħul kif ukoll ta’ impiegi li it-tnejn li huma inevitabilment jintilfu fi żmien qasir. Wasal iż-żmien li nippjanaw għal futur nadif, futur li mhux iktar dipendenti fuq l-evażjoni tat-taxxa.

When the state encourages tax evasion

In a speech delivered on Monday to the Chicago Council on Global Affairs, Janet Yellen, US Treasury Secretary, made the case for a global minimum tax applicable to multinational corporations irrespective of where they locate their headquarters. Such a proposal, reported the New York Times, would prevent companies from shifting profits to evade taxes.

Lowering tax rates to attract business, emphasised Ms Yellen, is a race to the bottom which has to be addressed. Competitiveness is not just how companies fare against other companies. It is also about making sure that governments have stable tax systems that raise sufficient revenue to invest in essential public goods and respond to crisis, and that all citizens fairly share the burden of financing government.

This issue is already on the agenda of the EU facing fierce opposition from Malta, Luxembourg, Ireland as well as others. The issue of tax harmonisation is an integral part of the fight against tax evasion and money laundering.

It is unfortunate that Malta (and others) have been repeatedly abusing its tax sovereignty. It is as a result of such repeated abuse that the proposal for tax harmonisation is gaining ground such that it now has the support of the United States of America too. As a result of greed Malta has squandered a competitive advantage by abusing it repeatedly and continuously. The resulting reputational damage is hence an own goal.

Malta (and the other countries) cannot be credible in the declared fight against tax evasion and money laundering if it keeps facilitating tax avoidance on an international scale. Some years back the Green Group in the European Parliament had published a study entitled Toxic Tax deals: when BASF’s tax structure is more about style than substance. This report reveals that over the years, the German chemical giant BASF used Malta to avoid the payment of one billion euros in taxes. This was done using the “legal” possibility to have tax refunds of up to six sevenths of the tax due in such cases where shareholders are not resident in the Maltese islands. Tax avoidance is tax evasion sanctioned by the state.

The Apple Corporation case in Ireland as a result of which another €13 billion in taxes were avoided is another example of tax evasion sanctioned by the state of Ireland. Luxleaks had also revealed countless of other examples as a result of which Luxembourg too embarked on state encouraged tax-evasion.

These are just some examples of many: the proverbial tip of the iceberg. There are undoubtedly countless of others, currently below the radar of public scrutiny, as a result of which the payment of billions of euros in taxes are being continuously avoided. Malta, Ireland, Luxembourg and other countries receive a small part of the actual tax due as a result of facilitating this state encouraged tax evasion.

Locally this scam is the result of the PNPL “national consensus” on financial institutions and fiscal policy in force for a number of years in Malta. The responsibility for the resulting reputational damage is thus not one to be shouldered by the Labour Party on its own, it has help from the PN which has continuously buttressed this abusive behaviour.

Unfortunately, tax evasion and money-laundering are inseparable twins!

The way forward need not impact the tax sovereignty afforded by the EU treaties through the unanimity rule on taxation issues. However, it necessitates ensuring that policy on all fiscal issues is also founded on sound ethical principles.

In addition to ensuring that fiscal policy is not in any way unethical it is about time that Malta does not any more, in any way, depend on tax avoidance.

The dependence of Malta’s economy on tax avoidance (and the sale of citizenship) is very worrying. The tax avoidance industry is a source of both revenue to the state and employment opportunities, both of which will be lost in the not-so-distant future. It is about time that we start planning for a cleaner future, a future that is, which is not dependent on the tax avoidance industry!

The Parliamentary Opposition

The fact that government has been forced by the Venice Commission of the Council of Europe to loosen its stranglehold on the Commissioner of Police appointment process is a positive democratic development. It is not as good as it could be, but it is definitely a welcome first step: there is however room for substantial improvement in the process.

In this context the Opposition’s decision to boycott the public hearing process is retrograde.

The Parliamentary Opposition, in any democratic jurisdiction worthy of being so described, is the champion of transparency and accountability. A Parliamentary Opposition demands more opportunities to scrutinise major appointments to public office. Boycotting the first substantial opportunity to scrutinise an appointee to the post of Commissioner of Police is not just a lost opportunity. It risks undermining the democratic requests for more public scrutiny of top appointments to public office.

The PN Parliamentary Opposition is arguing that the existence of the possibility for government to terminate the appointment of the new Police Commissioner within a one-year probationary period is unacceptable as it would keep the new appointee on a leash. The justified preoccupation of the Opposition is that the probationary period could be abused of. This is not unheard of. There is however a solution in seeking to subject the possible dismissal of the Police Commissioner at any stage to a Parliamentary decision as a result of which the Minister for the Interior would be required to set out the case for dismissal and the Police Commissioner himself would be afforded the right to defend himself. This would place any government in an awkward position as it would not seek dismissal unless there is a very valid justification for such a course of action. This would ensure, more than anything else, the integrity of the office of Commissioner of Police.

The Opposition has also sought to subject the appointment of the Commissioner of Police to a two-thirds parliamentary approval, indirectly seeking a veto on the appointment to be considered.

It would have been much better if the debate focused on the real decision taker in the whole matter: that is to say the Public Service Commission (PSC). Originally set up in the 1959 Constitution, the PSC has a role of advising the Prime Minister on appointments to public office and on the removal or disciplinary control of appointees to public office. Section 109 of the Constitution emphasises that when the PSC is appointed by the President of the Republic, he acts on the advice of the Prime Minister who would have consulted with the Leader of the Opposition.

Wouldn’t it be more appropriate if both the Prime Minister and the Leader of the Opposition are taken out of the equation in such matters? Parliament should seriously consider squeezing them both out of the process not just in the appointment of the PSC but in the case of the appointment of all Constitutional bodies. That is an instant where it would be justifiable in ensuring that all appointments are subject to a two thirds approval threshold in Parliament.

In boycotting the scrutinising process, the Opposition is doing a disservice to the country.

Since 2018 it has been possible for Parliament to scrutinise a number of public sector appointments. Perusal of the proceedings of the Parliamentary Public Appointments Committee indicates the very superficial manner in which consideration of appointments is dealt with. Serious objections raised on the non-suitability of candidates are ignored before the proposed appointment is generally rubber-stamped.

Unfortunately, Parliament is not capable of holding government to account. Having a retrograde Parliamentary Opposition certainly does not help in overturning a rubber-stamping practice!

Lejn normal differenti

L-imxija tal-coronavirus għadha fl-istadji bikrija tagħha. In-numri ta’ dawk identifikati bħala infettati, s’issa, s-servizzi tas-saħħa qed ilaħħqu magħhom. Nittamaw li l-affarijiet jibqgħu hekk, anke jekk in-numri inevitabilment ser jiżdiedu. Dan ser ikun jiddependi fuq diversi fatturi, ewlieni fosthom li lkoll kemm aħna qed nosservaw dak li jgħidulna l-awtoritajiet tas-saħħa biex b’hekk tonqos il-possibilità li l-virus ikun trasmess fuq skala kbira.

Bla dubju, l-mistoqsija fuq fomm kulħadd hi: kemm ser jgħaddi żmien biex il-pajjiż jirkupra minn dan kollu?

F’waħda mill-intervisti li tiegħu, l-Prim Ministru Robert Abela indika li l-kriżi tal-coronavirus tista’ twassal sal-bidu tas-sajf. Jista’ jkun, iżda, li din iddum ferm iktar: possibilment anke sa tnax-il xahar ieħor! Il-medja internazzjonali qed tispekula dwar jekk il-firxa tal-coronavirus tonqosx fis-sajf biex imbagħad tirritorna iktar tard bħall-influwenza “normali” li tkun magħna kull sena. Il-possibilità tat-tieni mewġa tal-coronavirus m’għandiex tkun injorata, għax, jekk dan iseħħ jista’ jkollha impatti konsiderevoli fuq dak li jkun baqa’!

Meta ser niġu lura għan-normal? Il-ħajja f’Malta ser tirritorna għal dak li mdorrijin bih jew ser nieħdu l-opportunità biex nibnu normal ġdid u differenti?

Il-pajjiż jeħtieġlu ż-żmien biex jerġa’ jiġi fuq saqajh, ħafna iktar minn kemm hu meħtieġ biex ikun eliminat il-coronavirus minn fostna. Iż-żmien ta’ stennija nistgħu nagħmlu użu tajjeb minnu billi nibdew nippjanaw bis-serjetà dwar kif ser nibnu mill-ġdid ir-reputazzjoni tal-pajjiż. Huwa iktar diffiċli li nibnu r-reputazzjoni tal-pajjiż milli nsewwu l-ħsara kkawżata mill-firxa tal-coronavirus.

Reċentement ġew ippubblikati żewġ dokumenti bi proposti li jistgħu jkunu ta’ għajnuna kbira f’din il-ħidma li hi tant meħtieġa. L-ewwel dokument ippubblikat huwa dokument konsultattiv li ippubblika xi ġimgħat ilu l-Kummissarju għall-iStandards fil-Ħajja Pubblika. Dan hu intitolat: Towards the Regulation of Lobbying in Malta. It-tieni dokument huwa intitolat Review of the Ethical Framework guiding public employees u kien pubblikat mill-Uffiċċju Nazzjonali tal-Verifika iktar kmieni din il-ġimgħa. Hi ħasra li, safejn naf jiena, ma teżisti l-ebda verżjoni bil-Malti ta’ dawn id-dokumenti. Dan ukoll hu nuqqas amministrattiv li għandu jkun rimedjat. Il-Malti hu lsienna u proposti ta’ din ix-xorta jeħtieġ li jkunu ppubblikati bil-Malti ukoll.

Fid-dokument konsultattiv tiegħu l-Kummissarju għall-iStandards fil-Ħajja Pubblika jargumenta favur it-trasparenza permezz tar-regolamentazzjoni tal-lobbying, materja li s’issa hi nieqsa mill-liġijiet tagħna. Hu biss permezz ta’ transparenza rigoruża tal-proċess politiku li nistgħu nassiguraw il-kontabilità u allura l-iskrutinju pubbliku tal-formazzjoni ta’ proposti politiċi kif ukoll tal-proċess tat-teħid ta’ deċiżjonijiet. Ilkoll konxji li sakemm il-lobbying ma’ jkunx regolat, dan ser jibqa’ sors ewlieni tal-kontaminazzjoni tal-proċess politiku. Meta nirregolaw il-lobbying, min-naħa l-oħra, nistgħu jkollna proċess politiku infurmat u allura nkunu qed nikkontribwixxu b’mod effettiv għall-kontabilità.

Fit-tieni dokument, l-Awditur Ġenerali jeżamina r-regoli dwar l-imġieba etika li huma mifruxa fl-Att dwar l- Amministrazzjoni Publika, fil-Kodiċi tal-Etika u fil-Kodiċi dwar it-Tmexxija tas-Servizz Pubbliku li flimkien jirregolaw il-mod kif jopera is-servizz pubbliku. L-Awditur Ġenerali ġustament josserva, illi, meta tqis il-kontenut ta’ dawn it-tlett dokumenti flimkien jirriżulta li hemm nuqqas ta’ ċarezza, liema nuqqas joħloq l-inċertezza, u b’hekk tkun imnaqqsa l-effettività tagħhom. Huwa jemfasizza illi r-regoli huma ultimament effettivi skond kemm huma kapaċi jwasslu għal azzjoni konkreta. Jiġifieri r-regoli għandu jkollhom il-kapaċita li jittraduċu l-prinċipji f’azzjoni reali.

Permezz tal-proposti tagħhom il-Kummissarju għall-iStandards fil-Ħajja Pubblika u l-Awditur Ġenerali qed iwasslu messaġġ għat-tisħieħ tal-pedamenti tal-amministrazzjoni pubblika. Bħala riżultat ta’ dan, jista’ jkun possibli li nibnu “normal ġdid” u differenti minn dak li drajna bih sal-lum. Normal fejn il-governanza tajba ma tkunx iktar eċċezzjoni imma tkun l-imġieba normali li nistennew mingħand dawk fil-ħajja pubblika u fl-amministrazzjoni pubblika għas-servizz tal-pajjiż.

Il-waqfien tal-pajjiż ħtija tal-mixja tal-coronavirus hi ukoll opportunità għal riflessjoni tant meħtieġa. Huwa l-waqt li l-paroli kollu dwar governanza tajba nittrasformawh f’azzjoni konkreta. Il-pajjiż għandu bżonn ta’ normal ġdid, ta’ normal differenti minn dak imdorrijin bih.

Towards a new normal

The Coronavirus outbreak is still in its initial stages. The numbers of those testing positive are, so far, manageable. We all hope that this will remain manageable even though the numbers are on the increase. This is however dependent on many factors, primarily on our observing the instructions issued by the health authorities in order to reduce the possibilities of transmission of the virus.

How long will it take for the country to recover?

In one of his interviews Prime Minister Robert Abela has indicated that the current Coronavirus crises may last till the beginning of summer. Recovery, could, however, last longer, even as much as twelve months. The international media is speculating on whether the Coronavirus outbreak will reduce its spread during the summer months as well as whether it will return later in the year just like the “common” flu. The possibility of a second outbreak is not to be overlooked, as if this were to happen, it could have a devastating effect on what’s left.

When will life get back to normal? Will life in Malta be back to what we were used to or will we avail ourselves of the opportunity to seek a new normal?

It will take time for the country to start functioning again, much more than is required to eliminate the Coronavirus from our midst. We can put to good use the available time on our hands to start planning in earnest the rebuilding of our reputation as a country. Reconstructing our reputation is more difficult to achieve successfully than making good the extensive damage caused by the Coronavirus outbreak.

In this respect, lately, two different sets of proposals have been published for our consideration. The first is the document for public consultation published by the Commissioner for Standards in Public Life some weeks ago, entitled: Towards the Regulation of Lobbying in Malta. The second is the Review of the Ethical Framework guiding public employees published this week by the National Audit Office. As far as I am aware no Maltese version of these documents has been published. This is a recurring administrative deficiency which should be remedied at the earliest. Maltese is our national language and proposals of this fundamental nature should be available for consideration in the Maltese language too.

In his consultation paper, the Commissioner for Standards in Public Life argues in favour of transparency through the regulation of lobbying which matter is still missing from our laws. It is only through rigorous transparency of the political process that we can ensure accountability and consequently public scrutiny of the policy formation and decision-taking process. We are all aware that as long as lobbying is unregulated it will remain a primary source of the toxification of the political process. Regulated lobbying, on the other hand, can inform the political process thereby contributing to more effective accountability.

In his review, the Auditor General examines existing ethical rules spread in the Public Administration Act, the Code of Ethics and the Public Service Management Code which together regulate the operation of the civil service. He observes that at times, when one considers these three instruments together, there is a lack of clarity which creates uncertainty, as a result reducing their effectiveness. He emphasises that ultimately effectiveness of the rules is also dependent on follow-up action and an enforcement which is capable of translating principles into tangible action.

Through their proposals the Commissioner for Standards in Public Life and the Auditor General seek to strengthen the foundations of public administration. As a result, it may be possible to construct a new normal where good governance is no longer an exception but the normal behaviour which we expect from people in public office as well as from the public administration serving the country.

The Coronavirus outbreak is thus also an opportunity for a long overdue reflection. The grinding to a halt of the whole country is also the right moment to substitute lip-service to good governance with some concrete action. The country desperately needs a new normal.

Turiżmu li jagħti kas lin-nies

Id-dibattitu dwar l-impatti tat-turiżmu hu wieħed li ma jispiċċa qatt. X’impatti soċjali u ambjentali huma ġustifikabbli minħabba l-gwadann ekonomiku tat-turiżmu? Ir-riżorsi tal-pajjiż, fi ftit kliem x’numru ta’ turisti jifilħu?

Iktar kmieni din il-ġimgħa, Tony Zahra, President tal-MHRA (l-Assoċjazzjoni Maltija tal-Lukandi u r-Restoranti) kien kritiku dwar in-numru ta’ turisti u l-impatt tagħhom. Kien rappurtat li qal li n-numru ta’ turisti li qed jiġu Malta kien qed jikber wisq. Emfasizza li l-pajjiż ma jiflaħx għall-impatti li jiġġeneraw daqshekk turisti. L-interess ta’ Tony Zahra fit-turiżmu dejjem kien limitat għall-impatt fuq dawk li joperaw il-lukandi: fejn Zahra għandu l-interessi finanzjarji tiegħu. Għadni qatt ma smajt lill- MHRA u lil Tony Zahra, per eżempju, jinkoraġixxu l-agri-turiżmu, u l-importanza ta’ dan (kieku jsir sewwa) biex jiddiversifika b’mod sostenibbli l-prodott turistiku Malti.

Kważi simultanjament għall-kummenti ta’ Tony Zahra, l-Istitut tal-Università ta’ Malta dwar il-Gżejjer u l-Istati Żgħar (The Islands and Small States Institute) ippubblika studju tal-Professuri Lino Briguglio u Marie Avellino, intitolat : Has overtourism reached the Maltese Islands?

Fl-istudju tagħhom, Briguglio u Avellino jagħtu daqqa t’għajn u jidentifikaw dak li għaddej fit-turiżmu u jidentifikaw l-argumenti kritiċi li qed ikunu żviluppati dwar il-materja. Turiżmu li qed jikber iżżejjed (overtourism) u l-biża’ mit-turiżmu (tourismphobia) huma termini li qed jintużaw bi frekwenza li qed tiżdied biex jiddeskrivu l-impatti soċjali negativi li qed jiżviluppaw bħala riżultat ta’ turiżmu li qed jikber kważi bla rażan. Kien fl-2008 li l-antropologu Katalan Manoel Delgado ddeskriva it- turistofobia bħala taħlita ta’ stmerrija, nuqqas ta’ fiduċja u tmaqdir tat-turiżmu.

Fl-istudju ta’ Briguglio u Avellino hu analizzat stħarriġ li għalih, 51% ta’ dawk li wieġbu qalu illi ma jixtiqux jaraw iktar turisti fil-belt jew raħal tagħhom. L-awturi jinterpretaw dan bħala li jindika li t-turiżmu f’Malta kiber wisq (overtourism), avolja jqisu li l-kampjun ta’ dawk li wieġbu l-istħarriġ hu ftit dgħajjef minħabba li mhux rappresentattiv b’mod adegwat.

Fost l-affarijiet li qed jikkontribwixxu għall-iżvilupp ta’ din il-biża mit-turiżmu hemm il-pressjonijiet soċjali u l-impatti ambjentali (kemm skart b’mod ġenerali kif ukoll il-kontribut għal attività esaġerata tal-industrija tal-kostruzzjoni), konġestjoni tat-traffiku, storbju, it-theddida tat-telf tal-identità kulturali u konflitti soċjo-kulturali.

L-MHRA, kif indika Tony Zahra, tidher li hi tal-istess fehma, avolja Zahra tkellem b’mod ġenerali u evita li jitkellem fid-dettall. L-interess tiegħu, wara kollox, hu l-impatt fuq il-but tal-membri tal-MHRA.

L-istudju ta’ Briguglio u Avellino jemfasizza l-ħtieġa li l-politika dwar it-turiżmu għandha tfittex li tindirizza l-impatti negattivi tal-industrija. Dan mhux biss biex tkun indirizzat il-kwalità tal-ħajja tar-residenti lokali imma ukoll biex l-esperjenza tat-turist tkun waħda aħjar u awtentika. It-triq ‘il-quddiem, jgħidulna Briguglio u Avellino, hi d-demokratizzazzjoni tal-iżvilupp turistiku u dan billi jkun inkoraġġit l-impenn tar-residenti milquta fil-komunitajiet tagħna. L-awturi ma jidħlux f’dettall biex jispjegaw dan kollu x’jista’ jfisser. Għandna nifhmu, iżda, li l-proċess tat-teħid tad-deċiżjonijiet kollha li jikkonċernaw l-iżvilupp tat-turiżmu għandhom ikunu soġġetti għal skrutinju pubbliku kontinwu. Dan m’għandux ifisser biss is-sehem tar-residenti milquta f’dan l-iskrutinju imma fuq kollox li dak li jgħidu jkun rifless fid-deċiżjonijiet li jittieħdu.

Permezz tad-demokratizzazzjoni tal-iżvilupp turistiku, hu iktar possibli li l-interessi u aġendi konfliġġenti fit-turiżmu jkunu indirizzati. Bħala riżultat ta’ dan, l-imprenditur li jħares lejn il-qliegħ immedjat ikollu jiffaċċja r-realtajiet soċjali u l-impatti ambjentali u kulturali tal-ħidma tiegħu. Bħalissa l-operaturi turistiċi jimpalaw il-profitti u aħna, l-bqija, ndewwu l-feriti soċjali, kulturali u ambjentali li jkunu ħolqu b’ħidmiethom.

It-turiżmu mhiex attività li issir f’bozza. Isseħħ f’komunità magħmula min-nies li għandhom ikollhom l-assigurazzjonijiet kollha neċessarji li l-kwalità tal-ħajja tagħhom mhux ser taqla’ daqqa l-isfel bħala riżultat. It-turiżmu mhux dwar numri ta’ turisti, miljuni ta’ ewro li jintefqu inkella dwar il-kontribut lejn il-Prodott Gross Nazzjonali. Hu ukoll dwar il-kwalità tal-ħajja tagħna lkoll.

It-turiżmu sostenibbli huwa primarjament dwar in-nies u mhux dwar il-profitt. Stennejna iktar minn biżżejjed biex dawk li huma effettwati jkunu assigurati li l-ħajja tagħhom ma tibqax imtappna minn dawk li jaraw biss il-flus. Biex dan iseħħ ma hemm l-ebda alternattiva għajr li l-iżvilupp turistiku jkun demokratizzat.

The democratisation of tourism

The debate on the impacts of tourism is never-ending. To what extent does the economic impact of tourism justify its social and environmental impacts? What is the carrying capacity of our islands, that is, what is the number of tourists with which our resources can reasonably cope?

Earlier this week, Tony Zahra, President of the Malta Hotels and Restaurants Association (MHRA) sounded the alarm: he was reported as saying that the number of tourists visiting Malta was too high. He emphasised that it is substantially exceeding the limits of what the country can take sustainably. Tony Zahra’s interest in tourism is limited to the impacts on hotels and hoteliers, his bread and butter. I have yet to hear the MHRA and Tony Zahra advocating agri-tourism, for example, and its importance in diversifying Malta’s tourism product sustainably.

Almost simultaneously The Islands and Small States Institute of the University of Malta published a Paper authored by Professors Lino Briguglio and Marie Avellino, entitled: Has overtourism reached the Maltese Islands?

In their Paper Briguglio/Avellino skim though the issues, identifying the trends and an ever-growing literature on over-tourism. “Over-tourism” and “tourismphobia” are increasingly used as terms to describe the emergence of social discontent with the pressures linked to tourism growth. It was way back in 2008 that  the Catalan anthropologist Manoel Delgado had described turistofobia as a mixture of repudiation, mistrust and contempt for tourists.

In a survey which is discussed in the Briguglio/Avellino paper, 51 per cent of respondents said that they did not want to see more tourists in their town or village. The authors interpret this as indicating the existence of over-tourism in the Maltese islands, even though they consider the sample of respondents as being weak and not adequately representative.

Among the issues contributing to this developing tourist phobia are social discomfort, environmental degradation (including both generation of waste and excessive construction activity), traffic congestion, noise, the loss of cultural identity and socio-cultural clashes.

The MHRA, as indicated by its President Tony Zahra, seems to be on the same wavelength although Tony Zahra limits himself to speaking in general terms, as his primary interest is the financial bottom-line of MHRA members.

The Briguglio/Avellino paper points at the need for tourism policy to consider mitigating the negative impacts of tourism. This could address not just the well-being of the local residents but also the tourist experience. The democratisation of tourism development through encouraging the active participation of the residents suffering the impact in our communities, opine Briguglio/Avellino, could be the way forward. The authors do not go in detail as to what the “democratisation of tourism development” would actually mean. It is, however, understood that the decision-making process of tourism development should be subjected to more public scrutiny by the community suffering from the impact and, that the views of the community are not only heard but acted upon.

Through the democratisation of tourism development, the conflicting interests and agendas involved in tourism must be addressed. As a result, the short-term gains of tourism entrepreneurs would be compelled to face the reality of social responsibility, as well as cultural and environmental costs. So far, the tourism operators pocket the profits and we, the rest, face the impacts.

Tourism is not an activity that happens in a vacuum. It takes place in a community of persons, who should be assured that their quality of life is not impacted negatively upon as a result of the experience. Tourism is not just about numbers of tourists, or the millions of euros spent or a contribution to the Gross National Product: it is also about our quality of life.

Sustainable tourism is primarily about people – not about profit! Is it not about time that those feeling the impacted are involved in ensuring that their lives are not made miserable by others whose vision is limited to euros on the horizon?

The democratisation of touristic development is the only way forward.

Dwar dan ukoll hemm referenza fid-diskors tal-Baġit fejn kien tħabbar li : “Fl-aħħar xhur kienet għaddejja ħidma biex ġie installat l-apparat neċessarju f’data centre għal użu fuq bażi sperimentali u fejn l-apparat ta’ sorveljanza viżiva qiegħed jintuża biss f’ambjent mhux pubbliku u f’rispett sħiħ tal-liġijiet tal-privatezza billi jiġu wżati prattii etiċi internazzjonali.” Ġejna infurmati li Paceville u l-Marsa, probabbilment li jkunu minn tal-ewwel li jospitaw dan l-esperiment. Dan kellu jsir wara li sseħħ konsultazzjoni pubblika.

Imma s’issa ma seħħet l-ebda konsultazzjoni. Nafu iżda li x’aktarx li diġa ġie iffirmat memorandum of understanding mal-Huawei, kumpanija Ċiniża li hi meqjusa ġgant globali fil-qasam tat-teknoloġija tal-komunikazzjoni. Fix-xhur li ġejjin probabbilment tibda l-implementazzjoni. Dan ifisser li jekk il-konsultazzjoni sseħħ ma jkollha tifsira ta’ xejn, għax id-deċiżjonijiet jidher li lesti.

Iktar kmieni din is-sena, Huawei, ftehmu mad-Dipartiment tas-Sigurtà Pubblika tar-reġjun ta’ Xinjiang fil-punent taċ-Ċina. Intefqu flejjes kbar f’dan ir-reġjun biex f’Xinjiang ikun possibli li tkun ippruvata t-teknoloġija għall-għarfien tal-uċuħ, osservazzjoni diġitali u l-applikazzjoni tal-intelliġenza artifijali għal xogħol il-pulizija. Huawei ser jipprovdu lill-pulizija tar-reġjun l-appoġġ tekniku biex ikunu żviluppati l-kapaċitajiet tan-nies involuti u b’hekk tissodisfa l-ħtiġijiet diġitali tal-industrija tas-sigurtà pubblika, ġie rappurtat li qal Fan Lixin, il-Viċi Direttur tad-Dipartiment tas-Sigurtà Pubblika ta’ Xinjiang . Din il-kooperazzjoni kienet meqjusa li tista’ tassigura “l-istabilità soċjali u s-sigurtà fit-tul ta’ Xinjiang”.

Dan jikkuntrasta ma dak li nsibu fir-rapport annwali ta’ Huawei għas-sena 2017 li jwassal messaġġ ċar: Huawei jimpurtha ħafna mill-privatezza. Jgħidulna li fl-2017 “Huawei continued to strengthen compliance in multiple business domains, including trade, cyber security, and data and privacy protection.” Jgħidulna ukoll dwar “il-ħsiebijiet ta’ Huawei dwar is-sigurtà elettronika – li tissaħħaħ bl-innovazzjoni, bil-kollaborazzjoni u bl-iżvilupp tal-fiduċja fid-dinja diġitali.” Probabbilment li dan il-kuntrast jirriżulta minħabba li l-messaġġi huma indirizzati lejn udjenzi differenti!

Iktar viċin tagħna, l-pulizija fir-Renju Unit ilhom ftit taż-żmien jesperimentaw bit-teknoliġija li tirrikonoxxi l-uċuħ. Big Brother Watch, grupp li jikkampanja favur id-drittijiet ċivili fir-Renju Unit jirrapporta li s-sistemi użati jagħtu riżultati żbaljati 9 darbiet minn 10. F’rapport twil 56 paġna, li kien ippubblikat f’Mejju li għadda bit-titlu Face Off. The lawless growth of facial recognition in UK policing. kien konkluż li 95 fil-mija tal-uċuħ identifikati mis-sistema kienu żbaljati: kienu wiċċ b’ieħor. Identifikaw uċuħ ta’persuni innoċenti. Dan apparti li r-ritratti biometriċi ta’ persuni innoċenti inżammu u nħażnu mill-Pulizija b’mod sfaċċat kontra kull regola bażika tal-ħarsien tad-data.

L-użu tat-teknoloġija biex jingħarfu l-uċuħ tan-nies bħala għodda ta’ l-ordni pubbliku hi għall-qalb il-pulizija, li fuq il-karta jistgħu jgħidu li qed isaħħu l-kapaċitajiet tagħhom fil-ġlieda kontra l-kriminalità. Għall-bqija imma, dan hu ħmar-il lejl u dan billi jekk it-teknoloġija ma tintużax fil-parametri tar-regoli bażiċi tal-ħarsien tad-data tkun invażjoni tal-privatezza li kull wieħed u waħda minna aħna intitolati għaliha.

Il-Kummissarju għall-Ħarsien tad-Data u l-Informazzjoni Saviour Cachia, f’intervista mal-Orizzont iktar kmieni din il-ġimgha qal li kien jistenna li l-awtoritajiet jagħmlu analiżi addattata qabel ma jagħmlu użu ta’ teknoloġija li kapaċi tagħraf l-uċuħ. Is-Sur Cachia emfasizza li għad baqa’ ħafna xi jsir qabel ma nistgħu nikkunsidraw meta u kif it-teknoloġija għall-għarfien tal-uċuħ tista’ tuntuża fil-qasam tas-sigurtà. Ħadd ma jaf jekk l-analiżi li ġibed l-attenzjoni għaliha s-Sur Cachia saritx, jew jekk tal-inqas inbdietx. Din it-teknoloġija tinvadi l-privatezza ta’ kulħadd b’sogru li tikser d-drittijiet fundamentali tagħna lkoll.

Meta jkun eżaminat dettaljatament kif l-użu ta’ din it-teknoloġija jista’ jkollha effett fuq l-attività kriminali inkunu f’posizzjoni aħjar biex niddeċiedu x’sens jagħmel li nissagrifikaw il-privatezza tagħna, anke jekk b’mod limitat, biex l-istat jissorvelja u sa ċertu punt jikkontrolla parti minn ħajjitna. L-esperjenza tal-użu ta’ din it-teknoloġija fir-Renju Unit għandha twassalna għall-konklużjoni waħda: għandna nsemmgħu leħinna u nieqfu lill-istat li jrid jissorvelja ħajjitna.

Il-Gvern għandu l-obbligu li jibda konsultazzjoni pubblika immedjatament u jpoġġi l-pjanijiet tiegħu taħt il-lenti tal-iskrutinjun pubbliku.

Standing up to the surveillance state

Safe City Malta, part of the government’s public-private partnership arm Projects Malta, is planning to deploy high-definition CCTV cameras with facial recognition software. It is claimed that these cameras can identify those involved in criminal activity. The subject was referred to in the budget speech in which it was announced that, after adequate public consultation, such technology will be introduced in a number of areas. Paceville and Marsa are the prime candidates for this technology.

So far, no consultation has taken place, but a Memorandum of Understanding has apparently already been signed with the Chinese global communication technology giant Huawei, and implementation could begin in the coming months. So, the consultation, if carried out, will serve no purpose because the decisions have already been made.

Earlier this year, Huawei entered into an agreement with the Public Security Bureau in Xinjiang, China’s largest province. The Chinese authorities have spent heavily on making Xinjiang a testing ground for the use of facial recognition, digital monitoring and artificial intelligence in policing.

Huawei will provide the region’s police with technical support, help build up human technical expertise and “meet the digitization requirements of the public security industry”. A local government website paraphrased Fan Lixin, Xinjiang Public Security Bureau’s deputy director, as saying that such co-operation would guarantee “Xinjiang’s social stability and long-term security.”

The above quote is in contrast to the contents of Huawei’s Annual Report for 2017,  which drives home the message that Huawei cares a great deal about privacy. We are told that, in 2017, “Huawei continued to strengthen compliance in multiple business domains, including trade, cyber security and data and privacy protection.” We are furthermore informed of the “Huawei’s cyber security concepts – building security through innovation, enhancing security through collaboration and jointly building trust in a digital world.”

The contrast is probably the result of the messages being directed towards different audiences!

Closer to home, police in the United Kingdom have been experimenting with facial recognition technology for some time. Big Brother Watch, a UK based civil liberties group, reports that the systems in use are on average, incorrect nine times out of ten. A 56-page report published in May, entitled Face Off: the lawless growth of facial recognition in UK policing. concluded that “a staggering 95 per cent of matches wrongly identified innocent people”. To add insult to injury, innocent people’s biometric photographs were taken and stored without their knowledge in blatant disregard of basic data protection norms.

The use of facial recognition technology as a law and order tool has been welcomed by the police, as it can theoretically enhance their capabilities in the fight against crime. The proposal, however, is a nightmare for the rest of us because if it is not used within the parameters of data protection legislation, facial recognition technology will be an unacceptable invasion of the basic norms of privacy to which each one of us is entitled to.

The Commissioner for Information and Data Protection Saviour Cachia, interviewed by the GWU’s daily newspaper earlier this week emphasised that he expected that a proper assessment to be carried out by the authorities prior to the use of facial recognition technology. Mr Cachia emphasised the fact much more needs to be done before considering when and how facial recognition technology is used for security purposes. No one is aware whether or not the required assessment indicated by Mr Cachia has, in fact, been done or even if work on it has commenced.

This technology invades our privacy in an indiscriminate manner and our fundamental human rights are at risk of being breeched left , right and centre.

Examining in detail the impacts that this technology could have on criminal activity would help us determine whether it makes any sense to sacrifice our privacy (even minutely) in order for the surveillance state to take over and control segments of our life. If the UK experience is anything to go by, there is one logical conclusion: we should stand up to the surveillance state.

The Government should initiate a public consultation at the earliest opportunity and lay all its cards on the table for public scrutiny.
