Il-burokrazija u l-Belt ta’ Stivala

Xahar wara l-ieħor jibbumbardjawna bi statistika dwar kuntratti ta’ bejgħ tal-propjetà inkella dwar in-numru ta’ konvenji. Dan l-aħħar qieshom inbidlu ftit in-numri b’mod li beda jidher li l-bejgħ qed jonqos.  Dak li jmexxi l-assoċjazzjoni tal-iżviluppaturi qalilna li hi l-burokrazija li qed ittellef ir-ritmu tal-bejgħ.  

Il-proċess tal-permessi għall-iżvilupp, ġeneralment, hu iffukat fid-direzzjoni tar-rgħiba. Ħolqu regoli msejħa regoli tal-flessibilità biex isibu mod kif iduru mar-regoli tal-iżvilupp li oriġinalment saru bl-iskop li jħarsu t-tessut urban u l-kwalità tal-ħajja tal-komunità residenzjali.  Per eżempju, żona intenzjonata għal taraġ pubbliku fil-pjan lokali għall-Gżira għamel il-wisa’ biex tinbena lukanda. Dan qed isir f’żona residenzjali, jiġifieri fejn suppost jinbnew biss djar għan-nies.  Din il-flessibilità estrema fl-ippjanar għall-użu tal-art qed igawdu minnha l-Grupp tal-Kumpaniji Stivala. Dan ngħidu b’referenza għall-parti ta’ fuq ta’ Triq Moroni: żona li r-residenti tal-Gżira illum isibuha bħala l-Belt Stivala. Minkejja dan kollu l-kap tal-MDA għandu l-wiċċ li jilmenta! Qiesu dan mhux biżżejjed.

Żviluppaturi fil-Mellieħa mhumiex daqstant fortunati bir-regoli tal-flessibilità għax lukanda li ħarġilha permess ta’ żvilupp f’ċirkustanzi simili laqqtita meta l-Qorti tal-Appell ħassret il-permess. Il-permess ta’ żvilupp għal lukanda fil-Belt ta’ Stivala għandha ċans li jkollha l-istess destin bħall-dak tal-Mellieħa fil-futur qarib. Għalkemm l-applikazzjoni għall-permess ġie approvat madwar ħames xhur ilu  (PA5962/21) il-permess ta’ żvilupp għadu ma ħarigx.

Kultant l-opinjoni pubblika tiġiha waħda żewġ! Il-protezzjoni riċenti permezz ta’ skedar ta’ Palazzino Vincenti f’San Ġiljan hi materja oħra ta’ kunflitt bejn ta’ Stivala u l-burokrazija tal-ippjanar. Għadu kmieni wisq biex wieħed jista’ jgħid li dan hu każ magħluq.  B’ansjetà u biża’ nistenna l-passi li jmiss, u dan minkejja li hemm xi forma ta’ skedar tal-wirt li ħalla warajh l-Perit Vincenti.

Ta’ Stivala kienu qed jippjanaw li jħottu Palazzino Vincenti u floku, f’San Ġiljan, jiżviluppaw lukanda oħra.  F’Diċembru 2022 Palazzino Vincenti kien protett temporanjament fi Grad 1 permezz ta’ Ordni ta’ Konservazzjoni ta’ Emerġenza.  Din il-protezzjoni temporanja issa spiċċat u flokha għandna protezzjoni fi Grad 2 fuq bażi permanenti kif deċiż mill-Awtorità tal-Ippjanar ix-xahar li għadda. Din mhiex aħbar tajba għax issa probabbilment ser nispiċċaw  bil-faċċata biss ta’ Palazzino Vincenti: ġewwa jispiċċa kollu.

Għal dawk li ferħu bl-aħbar tal-protezzjoni imħabbra, naħseb li għaġġlu. Probabbilment hu biss l-iżviluppatur u l-konsulenti tiegħu li għandhom għax jgħorku jdejhom għax mhux ser ikunu wisq il-bogħod milli jilħqu l-miri tagħhom.

F’dan il-kaz ukoll il-burokrazija tal-ippjanar mhux ser ikun irnexxielha milli żżomm lil ta’ Stivala milli jagħmlu ħerba mill-wirt nazzjonali. Kollox bil-barka tal-Awtorità tal-Ippjanar.

Il-burokrazija tal-ippjanar li minnha jilmenta l-Kap tal-MDA l-anqas ma kienet tidher b’nemes meta ta’ Stivala ġiehom il-ħsieb li jġebbdu l-iżvilupp sat-tarf tal-kosta. Tiftakru? Erba’ snin ilu f’din il-paġna, f’artiklu ntitolat : Il-ħarsien tal-kosta: ma hemmx rieda politika (Illum: 14 t’ April 2019) kont ktibt dwar il-permess ta’ żvilupp tal-blokk bini fejn kien hemm ir-restorant Piccolo Padre mal-kosta ta’ San Ġiljan. Kont emfasizzajt dan li ġej: “L-iżvilupp in kwistjoni ngħata permess fuq art mal-kosta.  B’żieda ma dan …………………. jidher ċar li l-binja tibqa’ ħierġa fuq il-baħar.  Jidher li l-Awtorità tal-Artijiet l-anqas biss tniffset dwar dan.” Minkejja dak li jgħid il-Kap tal-MDA, il-burokrazija tal-ippjanar (u l-kuġini tagħha) kontinwament tagħmel il-wisa’ għal żvilupp bla rażan.  

Din hi l-effettività tal-burokrazija: dejjem fuq in-naħa tar-rgħiba.

Bureaucracy and Stivalaland

Month in month out we are inundated with the latest statistics on property contracts or “promise of sale” agreements. Recently we have had some blips with statistics indicating that property sales were possibly diminishing. Out comes the Malta Developers Association (MDA) supremo thundering that bureaucracy is holding back property deals.

The development permitting process is, generally, greed oriented. It has resulted in so-called flexibility policies which seek to facilitate going around development policy restrictions intended to protect the urban fabric and the quality of life of the residential community. For example, an area earmarked for a public staircase in the Gżira local plan was transformed into a hotel. This is taking place in a residential area where only residences ought to have been permitted. The beneficiary of such land use planning extreme flexibility is the Stivala Group of Companies. I am referring to upper Moroni Street in Gżira, which area has nowadays been labelled as Stivalaland by Gżira residents. Yet the MDA supremo has the cheek to complain.

Developers in Mellieħa were less lucky with flexibility bureaucracy as a hotel permitted in similar circumstances has seen its development permit being recently revoked by the Court of Appeal. The Stivalaland hotel permit in Gżira may possibly meet the same fate in the not-too-distant future as although it has been approved by the Planning Commission some 5 months ago (PA5962/21) the development permit has not been issued yet. Consequently, the time frame for objectors to commence the appeal process has not yet commenced.

Occasionally public opinion manages to pull a fast one. The recent scheduling of the Palazzino Vincenti landmark at St Julians is another area of conflict between the Stivala brand and planning bureaucracy. It is still too early to consider this as a closed case. One awaits with trepidation the next steps notwithstanding the scheduling of the Vincenti masterpiece.

The Stivala brand had planned to pull down Palazzino Vincenti and to develop yet another hotel in St Julians. On 12 December 2022 Palazzino Vincenti was temporarily protected at Grade 1 level through an Emergency Conservation Order. This temporary protection has now been lifted and downgraded to a Grade 2 protection on a long-term basis as decided by the Planning Authority last month. This is extremely bad news as it signifies that most probably only the elevation of this landmark will be preserved: its interior will be gutted. Those who rejoiced at this level of protection were ill-advised. I think that it will be the developer and his advisors who will eventually have the last laugh as they will not be too far from their original objectives!

In this specific case planning bureaucracy will, once more, not be preventing the Stivala brand from making mincemeat of our national heritage, with the Planning Authority’s blessing. And yet the MDA supremo complains.

The planning bureaucracy which the MDA supremo complains about was nowhere to be seen when the Stivala brand sought to stretch development as close as possible to the shoreline. Do you remember? Four years ago, in these very columns, in an article entitled: Protecting Our Coast: No political will in sight (TMIS: 14 April 2019) I had written about the development permit relative to the building block of which the restaurant Piccolo Padre along the St Julian’s coastline forms part. I had then emphasised as follows: “The development in question has been permitted on a footprint starting along the coastline itself. In addition, ………………… planning permission issued by the Planning Authority includes part of the approved structure protruding over the sea. Not even a whimper has been heard from the Lands Authority on the matter.”

Contrary to what the MDA supremo says land use planning bureaucracy, and its cousins, continuously make way for unbridled development.

That is the extent of how effective the bureaucracy is, practically always on the side of greed.

Air Malta: vittma tal-klijenteliżmu

Nhar it-Tlieta, fil-Parlament, l-Opposizzjoni talbet dibattitu urġenti dwar il-futur tal-Air Malta. L-iSpeaker, korrettement ma laqax it-talba. Għax x’sens jagħmel li żżomm dibattitu ta’ din ix-xorta waqt li għadhom għaddejjin negozjati sensittivi, anke jekk dawn qed joqorbu lejn it-tmiem?

Iktar kien jagħmel sens kieku l-Opposizzjoni tablet li kellha tinżamm infurmata dwar fejn waslu in-negozjati. Dan ikun xieraq li jsir, fl-interess pubbliku u a bażi li l-informazzjoni tinżamm kunfidenzjali. Imma sfortunatament  l-Opposizzjoni iktar hi interessata fit-tejatrin!

Il-PN għandu ħafna x’joffri dwar dan kollu li għaddej, għax bħall-Labour, tul is-snin ta’ kontribut biex żviluppat il-qagħda attwali tal-Air Malta, waħda fejn ġiet żviluppata dipendenza fuq il-klijenteliżmu. It-tnejn li huma jġorru responsabbiltà għall-qagħda attwali.

L-istat attwali tal-Air Malta hu wieħed ta’ eżempju kif il-klijenteliżmu jkollu impatt fuq intrapriża pubblika li tul is-snin tmexxiet b’favoritiżmu politiku. It-tmexxija tal-Air Malta hi ukoll rifless ta’ kif tmexxa l-pajjiż. Il-klijenteliżmu qered lill-Air Malta, bħalma qiegħed jeqred lill-pajjiż.

Tul is-snin l-Air Malta kienet mgħobbija b’ħafna iktar impiegi milli kienet tiflaħ. Deċiżjonijiet ta’ tmexxija ittieħdu minn politiċi li f’xi waqtiet l-anqas rieda tajba ma kellhom!  Tiftakru, per eżempju lil Konrad Mizzi, ex-Ministru li fl- 2019 kien ħabbar li fl-aħħar l-Air Malta kienet għamlet profitt? Dakinnhar kulħadd kien jaf li din kienet gidba ħoxna!

Kellna wieħed ex-Direttur tal-Air Malta, li miet riċentement, li f’artiklu li kien kiteb xi snin ilu kien iddeskriva lill-Air Malta bħala l-baqra li l-politiċi kontinwament jaħilbu. Riżultat ta’ hekk in-numru ta’ impjegati spara l-fuq, b’mod partikolari fil-perjodi qrib ta’ xi elezzjoni ġenerali.

L-affarijiet ilhom ċari. Saru eżerċiżżji ta’ ristrutturar u ħarġu numru ta’ skemi ta’ irtirar kmieni. Intefqu flejjes kbar, imma l- Air Malta xorta baqgħet f’diffikultà minkejja l-fondi pubbliċi li xorbot. Hu għal din ir-raġuni li l-Kummissjoni Ewropeja qed tirreżisti li għal darba oħra jkun hemm għajnuna minn fondi pubbliċi: l-Air Malta kellha kemm-il darba għajnuna biex tirkupra, imma kull darba reġgħet għal li kienet: ħliet dak li rċeviet!

Il-wasla tal-linji tal-ajru low cost għamlu s-sitwazzjoni ħafna iktar diffiċli għall-Air Malta għax dawn huma mibnija fuq mudell ekonomiku li l-Air Malta, frott tal-qagħda tagħha, ftit setgħet tikkompeti miegħu.  Mgħobbija kif kienet bl-spejjes, hemm limitu  kemm l-Air Malta setgħet tiċċaqlaq f’suq dejjem iktar kompetittiv.

L-istrateġija li fassal il-Ministru tal-Finanzi Clyde Caruana lejlet l-elezzjoni tal- 2022 ġiet tard wisq. Il-marda kienet daħlet il-ġewwa wisq.

Il-klijenteliżmu flimkien mal-għajununa minn fondi pubbliċi, lill-Air Malta kissruha. Kien għaldaqstant inevitabbli li illum jew għada l-Air Malta kellha tiffaċċja r-realtà.  L-affarijiet ilhom ċari sa mill-2004 meta Malta issieħbet fl-Unjoni Ewropeja: l-ebda pajjiż ma jista’ juża fondi pubbliċi biex joħnoq il-kompetittività. Il-fondi pubbliċi bħala għajnuna lill-intrapriża jistgħu jintużaw biss f’ċirkustanzi eċċezzjonali u ċertament mhux b’mod repetut. L-Air Malta kellha kważi 20 sena ċans, li ħliethom. Xorbot il-fondi pubbliċi bla ma tat riżultati. 20 sena li tulhom kien hemm Gvern immexxi mill-PN u ieħor immexxi mill-Labour!

Minn strateġiji, kieku, l-Air Malta qatt ma kienet nieqsa!  Sfortunatament qatt ma kien hemm rieda biex ikun indirizzat in-nuqqas fundamentali tal-kumpanija, l-kontroll politiku. L-Air Malta għexet kontinwament bil-kontroll politiku li spiċċa qeridha darba għal dejjem. Issa l-qrid li għaddej, kollu għal xejn, tard wisq!

Air Malta: victim of clientelism

On Tuesday the Opposition in Parliament requested an urgent debate on the future of Air Malta. The Speaker rightly refused the request. What sense does it make to have such a public debate when sensitive negotiations are still ongoing, even though it is known that they are approaching the end?

The Opposition should, in my view, have insisted to be kept in the loop, to be kept informed continuously of developments, as to the current state of play of the negotiations. This should have been done in the public interest and on the basis of confidentiality. Unfortunately, the Opposition prefers theatrics!

The PN has much to offer on the matter, in view of the fact that together with Labour, it has, over the years, contributed substantially to the current state of Air Malta, ensuring its dependency on clientelism. Both PN and Labour shoulder responsibility for the current state of affairs.

Air Malta’s current state is a textbook case of the impacts of clientelism on a state enterprise which is, or rather, has been managed on the basis of political favouritism throughout the years. The administration of Air Malta is also a reflection of the manner in which the country is managed. Clientelism has ruined Air Malta just as it is ruining the whole country.

Over the years Air Malta engaged employees much more than it required. Most administrative decisions were taken by holders of political office who at times even lacked good faith. Don’t you remember, for example, the declarations by disgraced Minister Konrad Mizzi in 2019 that Air Malta had at last turned a profit, when it was pretty obvious to one and all that he was lying through his teeth? Mizzi was Minister for Tourism as well as in charge of the restructuring of Air Malta. Unfortunately, as we well know today, fraud permeated practically all areas for which Mizzi was politically responsible over the years!

A former Air Malta Director, recently deceased, had described Air Malta as the politicians’ milch cow in an article he penned some years ago. The number of Air Malta employees spiralled out of control in the run-up to most general elections.

The writing has been on the wall for quite some time. Various restructuring exercises and early retirement schemes have been implemented at considerable expense, only for Air Malta to remain in considerable difficulties notwithstanding the massive state aid utilised in the process. This is the basic reason as to why the European Commission is reluctant to approve further use of state aid for Air Malta.

The advent of low-cost flights over the years made matters more difficult for Air Malta. Low-cost fares are dependent on ensuring the minimisation of costs throughout the airline’s operations. As a result of being overloaded with excess labour, accumulated as electoral favours, Air Malta could never compete with low-cost airlines!

The four-year strategy announced by Finance Minister Clyde Caruana on the eve of the 2022 general election was too little, too late. At that point Air Malta was already on its knees.

Clientelism buttressed by state aid continuously made matters worse for Air Malta. The moment that we joined the EU it was only a matter of time as to when we had to face the music.

There was ample time, almost twenty years, to rectify matters. One Board of Directors after the other ignored the writing on the wall until it was too late. Twenty wasted years spanning PN and Labour led governments!

Air Malta never lacked strategies. It just lacked one crucial target: the political will to be cut loose from political control. Clientelism was its lifeblood for so long. It was also its death certificate.

It is now useless to argue further as it is clear that Air Malta will soon be no more.

Jgħadduna biż-żmien

L-Awtorità tal-Ambjent u r-Riżorsi (ERA) għadha kif ippubblikat abbozz ta’ Strateġija Nazzjonali dwar l-Ambjent għal konsultazzjoni pubblika. Dan l-abbozz ippubblikatu bl-Ingliż biss. Qiesu t-tmexxija tal-ERA ma tafx bil-Malti.

Minn awtorità pubblika nistennew ferm aħjar minn hekk. Kemm ser iddumu tinsulentawna? L-iskuża li l-Malti mhux addattat għal dokument tekniku mhiex waħda aċċettabbli. In-nuqqas ta’ dokument bil-Malti hi opportunutà mitlufa biex l-ERA tikkomunika iktar man-nies.

Iżda lil hinn mil-lingwa, l-istrateġija ambjentali li qed tkun proposta hi waħda ġenerika. Fiha tmien għanijiet li hu propost li jintlaħqu sal-2050. Il-lista tal-għanijiet li l-ERA trid tindirizza mhiex il-problema, għax il-problema hija li dawn l-għanijiet huma affarijiet li ilna niddiskutu żmien: ġew ippubblikati biżibilju rapporti, strateġiji u regoli jew policies li jkunu saru b’intenzjonijiet tajba tul is-snin!  Il-problemi jinqalgħu dejjem meta nfittxu li nimplimentaw il-miżuri meħtieġa biex jitwettqu dawn l-għanijiet. F’dak il-mument jinqagħu elf skuża, għax fir-realtà ma hemmx il-volontà politika li jittieħdu passi bis-serjetà.

Dan hu bil-bosta differenti milli jipprova jgħid ic-Chairman tal-ERA fid-daħla bl-Ingliż li kiteb għad-dokument konsultattiv! Din hi storja li għaddejna minnha diversi drabi!

Il-ħsara ambjentali li saret tul is-snin mhiex xi ħaġa li ser tkun irranġata mil-lum għall-għada.  Ħadd m’għandu jistenna riżultati malajr fil-mixja biex insewwu l-ħsara ambjentali li tħalliet takkumula tul is-snin.

Il-ħarsien tal-ambjent jinvolvi li jinbidlu deċiżjonijiet politiċi diversi li ittieħdu tul is-snin li kienu parti mill-kawża ta’ ħsara konsiderevoli. Ifisser ukoll li nibdlu attitudnijiet, drawwiet u l-mod kif inġibu ruħna.

Fid-daħla għad-dokument konsultattiv iċ-Chairman tal-ERA Chairman, Victor Axiak, jistqarr li jista’ jkun hemm ħtieġa ta’ sagrifiċċji żgħar fl-immedjat biex niksbu benefiċċji ambjentali fit-tul li jitgawdew minn ġenerazzjonijiet futuri. Din hi dikjarazzjoni li prattikament kulħadd jaqbel magħha. Imma dikjarazzjoni bħal din teħtieġ ukoll li tkun segwita minn lista ta’ miżuri meħtieġa biex tittieħed azzjoni dwarhom,  lista li tvarja minn miżuri li jistgħu jittieħdu immedjatament għal oħrajn li jħarsu iktar fit-tul.

Ma baqax iktar żmien biex noqgħodu niffilosifizzaw dwar l-ambjent.  Il-problemi nafu x’inhuma u  nafu ukoll min fejn ġejjin u min hu l-kawża tagħhom! Tħejjew kwantità ta’ rapporti, strateġiji, pjani t’azzjoni u x’naf jien tul is-snin. Kull Ministru ġdid ipprova jagħti l-impressjoni li hu jew hi sabet is-soluzzjoni b’nisġa ta’ kliem sabiħ li jipprova jimpressjona. Sfortunatament ir-rapporti tekniċi li saru kif ukoll dak li qalu in-nies waqt konsultazzjonijiet pubbliċi, bosta drabi ġie injorat.  Anzi xi drabi l-gvernijiet saħansitra aġixxew bil-maqlub ta’ dak propost jew maqbul!

L-istrateġija proposta illum, per eżempju,  tiffilosofizza dwar il-ħtieġa li innaqqsu id-dipendenza tagħna fuq il-karozzi u tinsisti li għandhom jonqsu l-karozzi mit-toroq tagħna.  Jekk wieħed imur lura u jerġa’ jaqra ftit l-istrateġija nazzjonali dwar it-trasport, li kienet iffinalizzat sitt snin ilu, jsib eżattament l-istess argumenti. Imma minflok ma ħa l-passi meħtieġa, l-Gvern – kemm direttament kif ukoll permezz tal-agenziji u l-awtoritajiet tiegħu – għamel bil-maqlub!

Kull studju li sar, kemm f’Malta kif ukoll barra minn xtutna, repetutament ikkonkluda li żvilupp massiċċ tal-infrastruttura tat-toroq twassal biex awtomatikament jiżdiedu l-karozzi fit-toroq. Kif mistenni, anke f’Malta, hekk ġara. Il-konġestjoni u l-problemi tat-traffiku żdiedu mhux naqsu riżultat tal-proġetti diversi tat-toroq. Dan seħħ għax kuntrarju tal-pariri li kellu, l-Gvern ma indirizzax il-kawza tal-problemi, imma indirizza l-effett.  Il-problema mhiex il-wisa’ jew it-tul tat-toroq, imma n-numru ta’ karozzi fit-toroq. Is-sitwazzjoni illum – f’ħafna każi  – hi agħar milli kienet qabel ma saru dawn il-proġetti.  

Minnbarra dan, daqslikieku mhux biżżejjed, l-awtoritajiet għamlu is-snin jinkoraġixxu l-iżvilupp ta’ petrol stations kbar, qieshom supermarkets. Dawn ħarbtu ammont mhux żgħir ta’ raba’. Biex issa jiġu jgħidulna kemm iridu jipproteġu l-agrikultura!

Kif nistgħu ntejbu l-kwalità tal-arja jekk nibqgħu nżidu l-karozzi fit-toroq tagħna?  Uħud forsi jargumentaw li s-soluzzjoni qegħda wara l-bieb bl-introduzzjoni tal-karozzi tal-elettriku inkella bl-użu tal-idroġenu jew xi fuel ieħor alternattiv. Dan ikun biss soluzzjoni parzjali għax fl-aħħar mill-aħħar irridu naraw kif ikun ġġenerat l-elettriku meħtieġ inkella kif ikun prodott l-idroġenu jew fuel alternattiv.

M’għandiex ammont suffiċjenti ta’ enerġija rinovabbli iġġenerata lokalment għax l-għorrief li ħadu id-deċiżjonijiet ftaħru fil-passat kemm kien irnexxielhom jinnegozjaw deroga tajba biex il-mira nazzjonali ta’ ġenerazzjoni ta’ enerġija rinovabbli ma tkunx 20% imma 10% tal-elettriku ikkunsmat. Ħtija ta’ hekk, illum m’għandniex ammont suffiċjenti ta’ enerġija rinovabbli.  Meta għandna l-ħtieġa ta’ enerġija elettrika bi prezz raġjonevoli  għandna nuqqas f’dan il-qasam li għalih qed inħallsu bizzalza.

Id-dipendenza li għandna bħala pajjiż fuq il-karozzi privati hi riżultat ta’ traskuraġni politika tat-trasport pubbliku tul is-snin. Li t-trasport pubbliku jkun b’xejn minn dan ix-xahar kienet deċiżjoni prematura. L-ewwel pass messu kien li tkun indirizzata l-effiċjenza u l-puntwalità tas-servizz. Il-prezz qatt ma kien problema.

Hu meħtieġ li l-effiċjenza u l-puntwalità tas-servizz ikunu indirizzati b’urġenza. Meta dan isir jagħmel ġid ambjentali ferm iktar mill-argumenti tekniċi kollha dwar kemm hemm ħtieġa li nħarsu l-ambjent. Trasport pubbliku effiċjenti flimkien ma investiment f’modi alternattivi ta’ transport hu ta’ benefiċċju ambjentali enormi.

Din hi uġiegħ ta’ ras kbira. Pariri ċari kien hemm. Iżda meta kien possibli li l-problema tkun indirizzata, l-Gvern, direttament kif ukoll permezz tal-awtoritajiet u aġenziji diversi tiegħu, ġie jaqa’ u jqum minn dan u għamel bil-maqlub!

Argumenti simili jistgħu jsiru dwar numru kbir ta’ materji ta’ importanza ambjentali: mill-ilma sal-pestiċidi, mill-użu tal-art sal-bijodiversità, mill-isforzi favur ekonomija ċirkulari għal taxxi ambjentali iddiżinjati sewwa.

Il-mod kif il-politika dwar it-trasport tħalliet għan-niżla hu biss eżempju wieħed żgħir minn fost bosta li jwassal għall-konklużjoni inevitabbli li ma teżistix rieda politika biex il-ħsara ambjentali tkun indirizzata bis-serjetà.

Il-konsultazzjoni pubblika tal-ERA sfortunatament hi fażi oħra fi proċess li permezz tiegħu qed jippruvaw jgħadduna biż-żmien.

L-integrità fil-ħajja pubblika

L-OECD (Organizzazzjoni għall-Kooperazzjoni Ekonomika u l-Iżvilupp) għadha kif ippubblikat tlett rapporti dwar aspetti differenti tal-integrità tal-ħajja pubblika f’Malta. Dan għamlitu bħala parti mill-proġett iffinanzjat mill-Unjoni Ewropeja dwar it-tisħiħ tal-ħidma tal-uffiċċju tal-Kummissarju għall-Istandards fil-Ħajja Pubblika.

L-ewwel rapport hu dwar kif il-leġislazzjoni eżistenti tista’ titjieb filwaqt li t-tieni wieħed hu dwar it-titjib organizzattiv meħtieġ fl-uffiċċju tal-Kummissarju għall-Istandards fil-Ħajja Pubblika. It-tielet rapport fih rakkomandazzjonijiet dwar ir-regolamentazzjoni tal-lobbying.

It-tlett rapporti fihom total ta’ 71 rakkomandazzjoni li l-esperti u l-konsulenti tal-OECD iddiskutew mad-diversi persuni u organizzazzjonijiet li ltaqgħu magħhom f’Malta. Mingħajr ma innaqqas mill-mertu ta’ dawn it-tlett rapporti irrid nemfasizza bi kważi ċertezza li l-parti l-kbira ta’ dawn ir-rakkomandazzjonijiet kienu ilhom preżenti fid-dibattitu politiku lokali għal żmien konsiderevoli. Sfortunatament dawn ġew repetutament injorati mill-partiti fil-parlament.

F’dawn il-paġni jiena ktibt diversi drabi dwar il-ħtieġa li nirregolaw il-lobbying fil-pajjiż. Il-lobbying huwa parti essenzjali mill-proċess demokratiku. Jeħtieġ, iżda, li jkun trasparenti. Sentejn ilu, il-Kummissarju għall-Istandards fil-Ħajja Pubblika Dr George Hyzler, ippubblika dokument konsultattiv dettaljat dwar il-mod kif nistgħu nirregolaw il-lobbying fil-pajjiż. Wara sentejn, iżda,  għadu ma sar xejn: il-proposti tiegħu għadhom qed jiġu “studjati”! Hi sfortuna li s’issa l-partiti fil-parlament ma jidhrux li huma interessati.  

Il-ħolqien tal-uffiċċju ta’ Kummissarju għall-iStandards fil-Ħajja Pubblika kien pass tajjeb ħafna, avolja kien hemm ħafna dewnien u tkaxkir tas-saqajn sakemm il-liġi għaddiet mill-Parlament.

Dan l-uffiċċju jeħtieġ li jkun allinejat kemm mal-uffiċċju tal-Ombudsman kif ukoll mal-Uffiċċju Nazzjonali tal-Verifika. Meta tqishom flimkien dawn huma tlett funzjonijiet essenzjali biex il-governanza tajba tinfirex u tissaħħaħ fl-oqsma kollha tal-amministrazzjoni pubblika.

It-tlieta li huma qed jagħmlu xogħol utli.  Jistgħu jkunu anke aħjar kieku jkollhom inqas tfixkil kull meta jkunu jeħtieġu informazzjoni biex jeżaminaw dak li jkollhom quddiemhom.  Ir-rapporti tal-OECD jezaminaw il-liġi Maltija li biha twaqqaf l-uffiċċju ta’ Kummissarju għall-iStandards fil-Ħajja Pubblika u jigbdu l-attenzjoni għad-diversi oqsma fejn jista’ jsir titjib biex ikun assigurat li l-indipendenza tal-Kummissarju tkun imħarsa b’mod prattiku.

Il-pubblikazzjoni tal-files Uber, iktar kmieni din il-ġimgħa, wrew li hemm bosta gvernijiet u istituzzjonijiet oħra (inkluż l-Unjoni Ewropeja) li minkejja li għandhom biżibilju liġijiet u regolamenti dwar il-lobbying, xorta nqabdu fuq sieq waħda. Għax li jkollok il-liġijiet li jiregolaw il-lobbying mhux biżżejjed: neħtieġu ukoll ir-rieda politika biex nimplimentawhom. Bosta drabi din ir-rieda politika ma teżistix!  

Il-kontabilità, it-trasparenza u l-governanza tajba huma ferm iktar minn slogans: huma valuri fundamentali li fuqhom jinbena l-istat demokratiku modern.  L-uffiċċju tal-Kummissarju dwar l-iStandards fil-Ħajja Pubblika, l-Ombudsman u l-Uffiċċju Nazzjonali tal-Verifika huma parti integrali mill-infrastruttura demokratika li hi essenzjali biex dawn il-valuri jrabbu għeruq b’saħħithom fl-istituzzjonijiet u s-soċjetà tagħna.

Madwar tnax-il xahar ilu l-Ombudsman kien indika li ma kellux intenzjoni li jaċċetta li l-ħatra tiegħu tkun imġedda. Ghad ma ġiex identifikat min ser jinħatar floku avolja qed jingħadu bosta affarijiet dwar dak li għaddej bejn il-partiti parlamentari  huma u jiddiskutu dwar min jista’ jinħatar.  Sadanittant Dr George Hyzler ser ikollu jwarrab ukoll  għax inħatar mill-Gvern Malti fil-Qorti Ewropeja tal-Awdituri. F’dan il-mument delikat ser ikun hemm post ieħor vojt.

Jekk verament nemmnu li f’dan l-istat demokratiku l-istituzzjonijiet għandhom valur, huwa essenzjali li dawn il-vakanzi jimtlew illum qabel għada. F’ġieh is-serjetà fil-ħajja pubblika hemm bżonnhom bla ħafna iktar dewmien.

Standards Matter

The Organisation for Economic Cooperation and Development (OECD), has just published three reports dealing with various aspects of the integrity of public life in Malta. This was done as part of the EU funded project on “Improving the Integrity and Transparency Framework in Malta”.

The first published report deals with the need to reinforce existing legislation, while the second one deals with the organisational review required at the office of the Commissioner for Standards in Public life. The third report deals with recommendations for the improvement of transparency and integrity in lobbying.

The three reports contain a total of 71 recommendations arrived at by experts and advisors at OECD after having carried out various meetings with stakeholders in Malta. Without in any way diminishing the positive contribution of all three OECD publications I can safely state that the great majority of the recommendations made in the three OECD publications have been present in the local public debate for a considerable time. Unfortunately, they have been repeatedly ignored by the parliamentary parties.

I have written on the need to regulate lobbying many times from these columns. Lobbying is an essential part of the democratic process. It needs, however, to be transparent. Two years ago, Dr George Hyzler, the Commissioner for Standards in Public Life published a detailed consultation paper on lobbying entitled: Towards the Regulation of lobbying in Malta. Two years down the line nothing has been done to regulate lobbying: his proposals are still being “studied”. Unfortunately, none of the parliamentary parties is remotely interested, so far.

The creation of the office of Commissioner for Standards in Public life was the achievement of a milestone, even though it took too long a time to drive the relevant legislation through Parliament.

The office needs however to be aligned with the Office of the Ombudsman and that of the National Audit Office. Viewed together these are the three essential offices which seek to ensure good governance, in all its aspects, throughout the different levels of public administration.

All three are doing sterling work. They can however do better if they encounter less obstructions whenever they seek information to examine issues at hand. The OECD reports dissect the legislation setting up the Office of the Commissioner for Standards in Public Life and pinpoint the several areas where improvements are essential in order to ensure that the independence of the Commissioner is protected in practical ways.

Standards matter. 

The Uber files published earlier this week indicate that many other governments and institutions (the EU included) are not up to scratch notwithstanding the at times detailed legislation regulating lobbying. The point being made is that having legislation regulating lobbying on our statute books is not enough: we need the political will to implement it. Many times, this political will is inexistent.

Accountability, transparency and good governance are not just slogans: they are fundamental values which underpin the modern democratic state. The office of the Commissioner for Standards in Public Life, the Ombudsman and the National Audit Office are the essential democratic infrastructure to ensure that these fundamental values have strong roots in our institutions.

Around twelve months ago the Ombudsman has signified his intention that he does not desire a renewal of his term of office. His replacement has not been identified yet as a result of the  horse-trading in which the PN and PL are currently engaged in. In the meantime, Dr George Hyzler has been kicked upstairs, being nominated as the Maltese member  at the European Court of Auditors. As a result, very shortly, another vacancy in the Office of Commissioner for Standards in Public Life has been created at such a delicate point in time.

If we really believe that, in a democratic state, institutions really matter, it is imperative that these vacancies are addressed at the earliest. Standards matter.
