Towards a wider cannabis consensus

It has been more than 10 years since the publication of the report of the Global Commission on Drug Policy led by former UN Secretary General Kofi Anan. One of its main recommendations was to end criminalisation, marginalisation and stigmatisation of people who use drugs but who do no harm to others.  

The changes in drug legislation approved by Parliament earlier this week as a result of which the possession of cannabis for personal use was decriminalised was a definite step in the right direction. This does not however signify that all provisions of the approved legislation are satisfactory. It means that the general thrust of the legislation is positive and acceptable. Improvements are however still necessary.

The legislation approved earlier this week is a radical change and as such there is still a reluctance in some quarters and sectors about it. This is understandable. It is however a fact that the decriminalisation of the possession of cannabis for personal use has been generally accepted. This is a reflection of the positive development in our society’s attitudes and should form the basis for the way forward.

The Daniel Holmes case as a result of which the cultivation of a number of cannabis plants for personal use led to a draconian prison sentence is too recent for anyone of us to forget. Until this week, drug legislation was out of tune and not an adequate reflection of what our society is prepared to accept.

The publication of the 24-page White Paper in March 2021 entitled “Towards the strengthening of the legal framework on the responsible use of cannabis” should not be viewed as an end in itself but rather as part of a continuous consultation process with all stakeholders. It has to be borne in mind that notwithstanding the sterling work of the NGO ReLeaf Malta on behalf of cannabis users there are others who, while recognising the urgent need for reform, are however much more cautious and would prefer that the required reforms are more gradual.

Ignoring the rudderless parliamentary Opposition, which does not yet have a clue on the issue, I refer to various proposals on the drug reform legislation which proposals were prepared by a number of NGOs and presented to Parliament.  Parliament was wrong to ignore these proposals and to steamroll ahead, notwithstanding. Such an attitude is not conducive to good governance. Parliament ought to have listened much more before deciding. This applies even if at the end of the day not all of the proposals made by the NGOs would have been taken on board.

At this critical juncture it is imperative that the drug reform is supported by as wide as possible a base. The consensus achieved has to be as wide as possible. This is essential in order to isolate those elements in our society who still believe that the criminalisation of cannabis users should be the rule.

It has been estimated that in 2021 there are around 40,000 consumers of cannabis in Malta. That is the current state of play after 40 years of militarised crackdown on cannabis use in the Maltese Islands. Criminalisation of cannabis users has not yielded any tangible positive results over the years.

The way forward in drug reform is to ensure that possession for personal use can be dealt with differently from trafficking. The legislation which Parliament approved earlier this week does precisely that. It can however be improved by ensuring that there are suitable buffers which protect children and vulnerable persons. This is one of the principal points made by the NGOs, who, to their credit, accept decriminalisation of possession for personal use of cannabis as a positive step forward.

Greens in Malta support the need for drug reform in general and specifically the decriminalisation for personal use relative to cannabis. In fact, the Green Electoral Manifesto for the 2017 General Election was the only electoral platform which presented this as an electoral pledge.

It is indeed unfortunate that Government and Parliament have squandered a unique opportunity at consensus building. It is however still possible at this late hour to remedy.

Solidarity: practising what we preach

In the local political lexicon, at times, the significance of Malta’s EU membership is incorrectly equated to the financial input of the union in the financing of the development of the local infrastructure, both physical and social. The role of the cohesion funds and regional development funds, in their various forms, are, at times perceived as the be-all of Malta’s EU policy!

Solidarity is a founding principle embedded in the European Union Treaties: however, it is not sufficiently reflected in the behaviour of both EU states and EU citizens. Solidarity signifies the existence of a commitment for mutual support in time of need. As most are aware, solidarity is much more than a financial commitment of the stronger members of the union who are net contributors to the EU budget. Beyond financial assistance, unfortunately, solidarity has time and again proven easier said than done for the EU member states.

Solidarity is a two-way process: we speak of the solidarity which we expect of others without giving sufficient attention to the solidarity due from us, in particular to our neighbours. Solidarity due to us is a given, however a multitude of reservations seem to apply to the solidarity which we are expected to deliver to our neighbours in time of need.

The criminalisation of NGOs who save lives (thus filling the gaps created by EU state inaction and dereliction of duty) together with the closure of our ports for humanitarian missions is an affront to the basic principles of solidarity. We should not shift onto NGOs and onto the refugees the failure of the Libyan state to control those who are making a quick buck from the refugees’ plight.

The Covid-19 crisis has once more identified that within the European Union, in time of need, when it really matters, there exists a solidarity deficit. Ursula von der Leyen, President of the EU Commission, has earlier this week publicly apologised to the state of Italy for not helping out at the start of the coronavirus outbreak. Addressing the European Parliament, she stated that “too many were not there in time when Italy needed a helping hand at the very beginning”.

Saying sorry is however not enough. A genuine “sorry” needs to be matched by concrete action which changes behaviour, if it has to mean anything at all.

A time of crisis is a time for more Europe. It is a time where the relatively strong should seek the weak to help them out in overcoming the difficulties being faced. In a time of crises no one should beg for help. Solidarity should be forthcoming almost automatically and without any conditions attached.

As we are well aware, this is not news to us, as we have had to bear a lack of solidarity in respect of the impacts of immigration incident on our shores time and again. Together with other EU member states along the extensive borders of the Union, time and again Malta has been left on its own to face the music. There is as yet no general acceptance within the Union that this is an EU problem which requires an EU solution.

In Malta, at times, we fail to understand that the effectiveness of the EU in any specific area is dependent on the reactions from the individual member states.At times, there has been limited agreement on voluntary action to relocate refugees saved from drowning as well as those arriving in Malta on their own or else assisted by NGOs.

So far, the EU has generally been able to agree on one line of action in tackling the influx of refugees: throwing money at the problem. Development aid has also been used with limited success in aiding the rebuilding of those parts of Africa which have collapsed.

Solidarity should be a fundamental value in our operations as a state not just as an EU member state but more so as a state which claims adherence to basic Christian values. Our solidarity is a value which should stand on its own two feet without being conditioned by whether others act appropriately or not. Do unto others what you expect others do to you. Many a times have we heard this said. Isn’t it about time that we practice what we preach?

Is-Solidarjetà mhiex għażla, iżda obbligu

Iktar kmieni din il-ġimgħa, Evarist Bartolo, il-Ministru għall-Affarijiet Barranin, b’wiċċ ta’ qdusija artifiċjali, iddikjara fuq it-televiżjoni li kien iddiskuta fit-tul il-kriżi tal-immigrazzjoni li qed tiżviluppa fl-ibħra Maltin mal-Kummissjoni Ewropea, mal-Vatikan u ma uffiċjali mlaħħqin tal-aġenzija tal-Ġnus Magħquda dwar ir-Refuġjati (UNHCR). Ilkoll kienu tal-fehma, qal, li Malta għandha raġun.

Evarist Bartolo qed jipprova jagħti l-impressjoni falza li l-għeluq tal-portijiet Maltin għall-NGOs biex ikunu jistgħu jisbarkaw l-immigranti meħlusa mill-għarqa fl-ibħra ta’ madwarna li qed jiżviluppaw f’ċimiterju hi aċċettabbli u jew raġjonevoli għall-komunità internazzjonali. Il-verità hi ferm differenti minn hekk.

Il-Ħodor, kemm f’Malta kif ukoll fl-Unjoni Ewropea, repetutament emfasizzaw li Malta ma tistax titħalla terfa’ waħedha dawn l-obbligi ta’ salvataġġ. Dan ġie emfasizzat din il-ġimgħa stess fi stqarrija konġunta bejn il-Partit tal-Ħodor Ewropej (EGP) u Alternattiva Demokratika. Is-solidarjetà fjakka jew ineżistenti ma tħassarx l-obbligi ta’ Malta fiż-żona ta’ salvataġġ li hi responsabbli għaliha fil-Mediterran ċentrali.

Hi tabilħaqq sfortuna li tul is-snin, Malta, repetutament ippruvat taħrab mir-responsabbiltajiet tagħha. Ilkoll niftakru meta l-PN fil-Gvern wasal fi ftehim mal-Gvern immexxi minn Silvio Berlusconi fl-Italja biex il-qawwiet tal-baħar Taljani jimbuttaw lura d-dgħajjes mgħobbija bl-immigranti li jkunu telqu mill-kosta Libjana.

Iktar qrib fiż-żmien il-Gvern immexxi minn Joseph Muscat wasal f’xi forma ta’ ftehim sigriet imma mhux miktub (safejn hu magħruf) li permezz tiegħu il-Gvern Taljan immexxi minn Matteo Renzi b’mod li ma waslux iktar immigranti f’Malta għal perjodu twil.

Imbagħad hemm il-każ ta’ Neville Gafà, il-mibgħut speċjali tal-Prim Ministru Joseph Muscat u l-laqgħat li hu kellu ma’ Haithem Tajouri mexxej tal-brigati rivoluzzjonarji ta’ Tripli. Tajouri, mid-dehra viċin ħafna tal-Gvern ta’ Joseph Muscat jissemma f’rapport ta’ ‘l fuq minn 200 paġna tal-Ġnus Magħquda liema rapport hu dwar ksur ta’diversi drittijiet tal-bniedem. Skond l-istess rapport Tajouri hu responsabbli ukoll għal ċentru privat ta’ detenzjoni fejn jinżammu ħafna nies.

Fl-istampa lokali kien ġie rappurtat ukoll li kien hemm laqgħat fil-Libja bejn Neville Gafà, l-mibgħut speċjali tal-Prim Ministru, Joseph Muscat, u uffiċjali għoljin tal-Gvern Libjan. F’dawn il-laqgħat, li għalihom attenda Kurunell mill-Forzi Armati ta’ Malta ġew diskussi l-mezzi li kellhom jintużaw biex iwaqqfu l-immigrazzjoni. L-ismijiet u r-ritratti ta’ dawk presenti kienu ġew ippubblikati.

Dan m’għadux effettiv għax illum jidher li nbidlet l-istrateġija u jeħtieġilna li niffaċċjaw allegazzjonijiet serji fil-konfront tal-Forzi Armati ta’ Malta dwar sabutaġġ tal-opri tal-baħar użati minn dawk li qed ifittxu l-ażil. Qed ikun allegat li s-suldati/baħrin tal-patrol boat P52 qatgħu l-cable tal-mutur li bih kienet għaddejja l-opra tal-baħar b’mod li ħallihom bejn sema’ u ilma fiż-żona ta’ tiftix li hi responsabbiltà ta’ Malta.

Prosit lill-NGO Repubblika li qed tinsisti li issir investigazzjoni kriminali dwar dan l-inċident biex jiġi stabilit eżattament x’ġara u min huwa responsabbli għalih. Kont nistenna li kellu jkun il-Kmandant tal-Forzi Armati minn rajh li jagħti bidu għall-investigazzjoni hekk kif saru dawk li s’issa għadhom allegazzjonijiet. Ma kellux joqgħod jistenna li jkun ħaddieħor li jinsisti li dan isir.

Il-proposta riċenti tal-Ministru Bartolo biex l-Unjoni Ewropeja tgħin lil-Libja b’mod li ittaffilha l-piz umanitarju li qed iġġorr bħalissa kif ukoll biex ikun iffaċilitat li l-komunità internazzjonali tkun tista’ tipprovdi l-għajnuna tant meħtieġa kemm lir-refuġjati kif ukoll lil-Libjani infushom hi pass il-quddiem. Imma tajjeb li jkun ċar illi minkejja d-diffikultajiet kollha fil-Libja nnifisha dan diġa qed isir.

Fil-fatt mill-2014 sal-lum l-Unjoni Ewropeja diġa ħarget għajnuna umanitarja ta’ madwar €50 miljun indirizzata lejn il-Libja.

Sfortunatament la hemm rieda u l-anqas aptit għal soluzzjoni Ewropea fost il-Gvernijiet tal-Unjoni Ewropeja u dan minkejja li erbgħa fost l-ikbar pajjiżi tal-unjoni (il-Ġermanja, Franza, Spanja u l-Italja), xi ġranet ilu ħadu inizjattiva biex il-migrazzjoni tirritorna fuq l-aġenda.

Naħseb li lkoll napprezzaw li s-sitwazzjoni hi waħda diffiċli. Imma anke f’dawn iċ-ċirkustanzi kulħadd għandu jerfa’ r-responsabbiltajiet tiegħu.

Il-Gvern Malti għandu jibdel ir-rotta u flok ma jibqa’ kontinwament ifittex li jipprova jaħrab mir-responsabbiltajiet tiegħu ifittex li jaħdem id f’id mal-NGOs li qed isalvaw il-ħajjiet b’mod li qed jagħmlu ħidma li messha qed issir mill-Gvernijiet. Li jkun hemm min jipprova jimita lil mexxej lemini Matteo Salvini biex ikunu kkriminalizzati l-NGOs iservi biss biex tkompli tixtered il-mibgħeda imżejna b’lingwaġġ taparsi patrijottiku.

Hemm il-ħtieġa li l-Gvern Malti jifhem li s-solidarjetà mhiex għażla, imma dmir.

Solidarity is not an option but a duty

Earlier this week, Foreign Minister Evarist Bartolo sanctimoniously declared on TV that he had discussed at length the immigration crisis in Maltese waters with the EU Commission, with the Vatican and with senior officers of UNHCR. All agreed, he said, that Malta was in the right.

Mr Bartolo is trying to create a false perception that the closure of Maltese ports to NGOs disembarking immigrants saved from being engulfed in the cemetery developing around us is reasonable and acceptable to the international community. He cannot be more distant from the truth.

Greens, both in Malta and in the EU, have repeatedly emphasised that Malta cannot shoulder its “save and rescue responsibilities” on its own. This was emphasised as recently as this week in a joint statement between the European Green Party and Alternattiva Demokratika. However, inadequate or at times inexistent solidarity from EU member states does not absolve Malta of its international responsibilities from coordinating safety and rescue operations within its area of responsibility in the central Mediterranean.

It is indeed unfortunate that over the years Malta has repeatedly tried to wriggle out of its responsibilities. We do remember when the PN led government arrived at an agreement with the Berlusconi administration in Italy in order that the Italian navy pushes back all departing boats carrying immigrants along the Libyan coast.

Closer in time the Joseph Muscat administration is known to have arrived at some sort of secret but unwritten agreement with the then Renzi led government in Italy such that the arrival of immigrants in Malta trickled down to zero.

What about Neville Gafà, then special envoy of Prime Minister Joseph Muscat and his meetings with Libyan militia leader Haithem Tajouri of the Tripoli Revolutionary brigades? Tajouri, apparently a close acquaintance of the Muscat led government was singled out in a United Nations report for a number of human rights breaches. He is also, according to the same report, responsible for the running of a private detention centre where many are held in captivity.

It was also reported in the press that at a point in time Neville Gafà, envoy of the Prime Minister had accompanied the Maltese Colonel in charge of AFM Operations at high level meetings in Libya to stem immigration. Photographs and names were published.

Apparently this is no longer effective as we now have to face serious allegations of AFM personnel sabotaging rubber boats carrying asylum seekers in Maltese waters. It is being alleged that the crew of patrol boat P52 cut the cable of the motor driving the rubber boat carrying the asylum seekers leaving them adrift in the Maltese search and rescue area. Hats off to NGO Repubblika for filing criminal complaints. I would have expected the Commander of the Armed Forces to initiate an investigation himself without the need for any prompting, as soon as the allegations surfaced.

The recent proposal of Minister Bartolo for the EU to engage with Libya in order to lessen its humanitarian burden and enable the international community to provide much-needed assistance to both refugees and the Libyan people is positive. It is however to be underlined that this is already being done notwithstanding the difficult circumstances within Libya itself.

The EU has in fact disbursed around €50 million in humanitarian aid utilised in Libya since 2014.

Unfortunately there is no will among EU governments for an EU solution even though the four largest EU countries (Germany, France, Spain and Italy), a couple of days ago, have taken steps to push the migration issue back onto the EU agenda.

Everyone recognises that the situation is very difficult. Everyone must however shoulder their responsibilities.

The Maltese government should change tack and instead of constantly seeking ways to wriggle out of its responsibilities actively develop a close collaboration with those NGOs who have volunteered to deploy their own rescue missions to save lives, thereby filling in the gaps left by the EU states. Aping Italian right-wing leader Matteo Salvini in criminalising NGOs only serves to further encourage pseudo-patriotic vitriol.

It is about time that the Maltese Government recognises that solidarity is not an option but a duty.

Luigi Di Maio’s threat

US President Donald Trump, over breakfast with NATO Secretary General Jens Stoltenberg, unleashed a blistering criticism of Angela Merkel’s government for being too supportive of Russia’s natural gas pipeline, which provides natural gas to various European states. Germany is too dependent on Russian natural gas, said Donald Trump. Is it appropriate for Angela Merkel’s Germany to do away with energy sovereignty and security in this manner? Being too dependent on Putin’s Russia is not on, he suggested.

Malta also may have its energy sovereignty and security hanging by a string.

Only last month we were reminded by Italian Deputy Prime Minister, Luigi di Maio that Malta’s electricity interconnector supply is plugged in at Ragusa on the Sicilian mainland. The comment was made in the context of the savage debate that developed over the rescue operations involving drowning immigrants picked up from the Mediterranean Sea by NGO operated sea vessels.

The Cinque Stelle politician considered it appropriate to use the Ragusa plug-in for political leverage in the same manner that Vladimir Putin makes use of his Russian gas supply, in relation not just to Angela Merkel’s Germany, but to most of the European mainland.

The fact that Malta is at times too dependent on the Ragusa electricity supply makes matters worse. We have undoubtedly lost count over the last months regarding the number of times we have been subjected to an electricity black-out in Malta: the standard explanation being that there was some technical hitch on either side of the Sicilian Channel which was being taken care of.

Malta will shortly have another Sicilian plug-in, this time a gas pipeline most probably at Gela.

Like the electricity interconnector plugged in at Ragusa the gas-pipeline plugged in at Gela will be another commercial undertaking. Malta will be paying for its gas, just as much as it is paying for its electricity.

Luigi Di Maio’s thinly veiled threat was obviously that the existing electricity plug-in at Ragusa was there at the Italian government’s pleasure which could reverse any commitment entered into so far if the Maltese government persists in irritating it.

It is not known whether there was any follow-up to Di Maio’s declaration, accept that the Maltese government closed all ports to NGO-operated vessels and that criminal proceedings were initiated against the MV Lifeline captain on flimsy sea-vessel registration charges.

This is unfortunately in-line with the Di Maio/Salvini philosophy that good Samaritans have to be treated suspiciously.

At the time of writing, another sea vessel with 450 migrants on board is sailing through Malta’s search and rescue area towards Sicily with Matteo Salvini, Minister for the Interior, insisting that Italy’s ports are closed for such vessels.

What next?

Potentially, as a result of the closure of Maltese and Italian ports, this is another developing tragedy. Di Maio’s veiled threat, maybe, has been taken seriously by the Maltese government.

Such incidents send one clear message: the foundations of solidarity as a value have heavily eroded. It has been transformed into a slogan. Solidarity is one of the basic values of the European Union – it is not limited to the EU’s border states. Successive Maltese governments have tried to nudge other EU member states to shoulder this collective responsibility which is currently shouldered disproportionately by the border states. The response from nine members states when the MV Lifeline debacle came to the fore was encouraging, but it is certainly not enough.

Faced with racist and xenophobic overreactions, opting for solidarity is not an easy choice. It would be certainly helpful if more EU states put solidarity into practice. The problem is that not all of them are convinced that this is the only ethical way forward.

Il-Kunsill tal-Unjoni Ewropeja qal li l-gwardja tal-kosta Libjana għandha titħalla taħdem.

X’jippretendu dawn:  li l-NGOs isalvaw in-nies mill-għarqa u jgħadduhom lil-Libjani biex dawn jittorturawhom? Għax hekk qed jgħidu Tusk, Muscat, Conte u l-mexxejja Ewropej biex jissodisfaw l-injoranza w il-mibgħeda tar-razzisti li hawn jiġru mas-saqajn.

Kien hemm ksur ta’ regolamenti tat-tbaħħir? Ma nafx. Li naf hu li l-Gvernijiet qed jinħbew wara l-legaliżmi u r-regoli biex jiġġustifikaw li dawk salvati mill-għarqa jingħataw lura f’idejn il-Libjani fejn ikunu ttorturati. Dan jidher li hu l-punt ta’ konvergenza bejn Malta u l-Italja.

Il-Gvernijiet, issa, flok ma jisparaw (figurattivament) fuq l-immigranti qed jisparaw fuq l-NGOs.

Nimmansaw is-suq tal-kera

Il-ġimgħa l-oħra 17-il għaqda, prinċipalment attivi fil-qasam soċjali, ippubblikaw dokument importanti intitolat “A Proposal for Rent Regulation in Malta” dwar dak li għandu jsir biex is-suq tal-kera jkun immansat. Dan id-dokument jipproponi li s-suq tal-kera jkun regulat u dan f’kuntest fejn dak kollu li għandu x’jaqsam mal-propjetá f’Malta tħalla jimxi għal riħu għal ħafna snin. Bosta approfittaw ruħhom minn dan u stagħnew inġustament, xi drabi minn fuq il-miżerja ta’ ħaddieħor.

Wasal iż-żmien għal ftit sens ta’ ġustizzja fis-suq tal-kera. Dawk vulnerabbli, bla ebda dubju l-iktar li ntlaqtu mir-rebus li ilu jiżviluppa prinċipalment mill-2008, ilhom jistennew li l-kuxjenza soċjali tal-pajjiż tagħti ftit kaz tas-suq tal-kera.

Id-dikjarazzjoni tiegħu hi sors ta’ tama għal bosta li wara kollox hu possibli li suq tal-kera immansat jista’ jipprovdi kera ġusta.

Il-proposta fil-qalba tad-dokument tas-sbatax-il għaqda hi dwar il-ħtieġa li l-kirjiet ikunu kollha regolati minn ftehim li jsir bil-miktub. Dan il-ħsieb hu motivat mill-ħtieġa li d-drittijiet u l-obbligi kollha jkunu mfissra b’mod ċar u b’hekk jassigura l-kontroll tal-abbużi kontinwi, kemm mis-sidien kif ukoll mill-inkwilini. Fit-tfassil tal-proposti tagħhom il-koalizzjoni tal-għaqdiet għarblet l-esperjenzi ta’ diversi pajjiżi Ewropej, fejn (ġeneralment) jeżisti suq tal-kera b’saħħtu li hu ukoll wieħed ġust.

Alternattiva Demokratika ilha s-snin tħeġġeg dwar il-ħtieġa ta’ suq tal-kera b’saħħtu għax dan hu kemm ħtieġa soċjali kif ukoll ħtieġa ambjentali. Il-ħtieġijiet soċjali jkunu ndirizzati meta naqbdu t-triq li trid twassalna biex nassiguraw li d-dritt bażiku għal residenza diċenti jkun imnaqqax fil-liġijiet tagħna, kif ukoll applikata fil-prattika. Imma dan iwassal ukoll għal tnaqqis tal-impatti ambjentali tal-industrija tal-kostruzzjoni billi kemm-il darba jkun possibli li l-kera tkun waħda ġusta tonqos konsiderevolment il-pressjoni biex tkun żviluppata iktar art verġni, kif ukoll il-pressjoni fuq iż-żona ta’ konservazzjoni urbana u l-bini protett.

Alternattiva Demokratika taqbel b’mod ġenerali mal-proposta tal-għaqdiet. Sadanittant nistennew il-pubblikazzjoni tal-White Paper dwar ir-riforma tas-suq tal-kera u bla ebda dubju ser nieħdu sehem fid-dibattitu nazzjonali dwar is-suġġett. Għax wasal iż-żmien li s-suq tal-kera jkun immansat.

Taming the Rental Market

The policy document entitled “A Proposal for Rent Regulation in Malta” published last week, has been endorsed by 17 NGOs that are mostly involved in the field of social action.

It is a proposal for rent regulation in a situation where everything concerned with property in Malta is spiralling out of control and has been in this state for a number of years. In the process, many have made lots of hay while the sun shone, frequently at the expense of vulnerable people.

It is about time that a sense of justice is restored in the rental market, and the sooner the better. The vulnerable – undoubtedly the hardest hit in the post 2008 free-for-all – have been patiently waiting for the country to listen to its social conscience regarding the rental market.

The creation of a social safety-net, even in rental matters, is primarily government’s responsibility. The government fulfils this not only through the direct provision of affordable housing to the most vulnerable, but also by facilitating access to a tamed rental market to the rest – a market which ought to be relatively free but fair at all times. A tamed market operates within reasonable and just limits: reasonable for landlords but also for a wide range of tenants.

The model proposed by the 17 NGO coalition is founded on a number of basic considerations: the fundamental right to a home, a clear demarcation of the rights and duties of landlords and tenants – both of which have the right to peace of mind, enhancing the long-let rental market, recognising the landlord’s right to establish the initial rent and its variation within a fair regulatory framework and incentivising entry into the rental market of property that is currently vacant for a variety of reasons.

The document is short and very brief, being just 12 pages long, yet it is brimming with far-reaching proposals.

It is encouraging that, when meeting representatives of the 17 NGOs, Parliamentary Secretary for Housing, Roderick Galdes – who is currently applying the finishing touches to a long-awaited White Paper on the Rental Market – indicated that he was generally on the same wavelength in seeking to reconstruct a rental market which operates within acceptable and socially fair limits.

Thanks to his inter-disciplinary experiences Galdes, a land-use planner by profession, is in a unique position to ensure that housing policy moves gradually into the 21st century after having been restrained for the past 80 years or so. His declaration is a source of hope to many that affordable housing can co-exist with a tamed rental market.

The central proposal of the NGO’s document is the need to ensure that all leases are drawn up in writing. This proposal is motivated by the need to clearly spell out rights and duties of both landlords and tenants, thereby ensuring that any abuse (by either) is, if possible, nipped in the bud. In their proposals, the coalition of NGOs drew on the experience of a multitude of other European countries where a healthy and (generally) fair rental market has been in existence for years.

For years, the Greens in Malta have been advocating the need of a healthy rental market, as this is both a social and an environmental necessity. Addressing the social necessity will ensure that we embark on the road which will lead to ensuring that the basic human right to having a decent home is entrenched in our laws and, hopefully, meticulously applied. This will also lead to a reduced environmental impact of the part of the construction industry, as the adequate development of a fair rental market will eventually decrease development pressures on virgin land as well as on urban conservation areas and protected buildings.

Alternattiva Demokratika – The Green Party is generally in agreement with the NGO Coalition’s proposal. We look forward to the publication of the White Paper on the reform of the rental market and will definitely be actively participating in the ensuing national debate.

Taming the rental market is a long overdue objective that should be relentlessly pursued.
