L-impotenza tal-Parlament u l-Imħallef Lino Farrugia Sacco

Illum l-Imħallef Lino Farrugia Sacco jagħlaq snienu, 65 sena, u jirtira. Il-lum ukoll, billi l-Imħallef Lino Farrugia Sacco kien qed jiffaċċja mozzjoni Parlamentari biex jitneħħa minn Imħallef, din l-istess mozzjoni tispiċċa.

Il-kritika li l-Opposizzjoni qed tagħmel lill-Gvern hi li illum hu Jum Iswed għall-kontabilita u dan minħabba li l-Gvern ta’ Joseph Muscat qagħad jistenna li jiġu fi tmiemhom il-proċeduri legali li kien beda l-Inħallef Farrugia Sacco. Kien ovvju li dawn kien baqa’ ftit mhux ħażin biex jiġu fit-tmiem tagħhom.

L-Opposizzjoni għandha raġun tikkritika lill-Gvern għax kaxkar saqajh biex jaġixxi – għax kien ovvju li ma riedx jaġixxi. Imma bħas-soltu l-Opposizzjoni tgħid biss biċċa mill-istorja. Il-biċċa li jaqblilha.

Kien ikun aħjar kieku l-Opposizzjoni tipprova tispjega għaliex il-Gvern immexxi minn Lawrence Gonzi ħalla għall-aħħar minuta, fi tmiem l-2012, biex iressaq il-mozzjoni għat-tneħħija tal-Imħallef Lino Farrugia Sacco.

L-Imħallef Farrugia Sacco kien ilu s-snin jisfida l-Kodiċi tal-Etika tal-Imħallfin. Il-Gvern immexxi mill-PN, iżda, ma għamel xejn. Kieku l-Gvern immexxi mill-PN kien serju l-mozzjoni ressaqha snin qabel. Kieku ilna b’deċiżjoni.

Imma dan kieku l-Gvern tal-PN kien serju. Hu ovvju għal kulħadd li la Muscat ma jrid is-serjeta’ u l-anqas Gonzi ma riedha qablu ġhax anke Gonzi kaxkar saqajh.

Ma hemmx x’tagħżel bejniethom.

It-tnejn, kemm il-Partit Nazzjonalista  kif ukoll il-Partit Laburista huma responsabbli biex fil-konfront tal-akkużi li għandu l-Imħallef, il-Parlament hu impotenti.

When to resign

Ombudsman. Joseph Said Pullicino

Jean-Claude Juncker Prime Minister of Luxembourg has just submitted his resignation after accepting political responsibility for a spying scandal.

In Malta Magistrate Francesco Depasquale ruled that the Ombudsman was not right to claim immunity when his statement on Judge Lino Farrugia Sacco was subjected to libel proceedings. Moreover, ruled the Magistrate, the Ombudsman was not even authorised in terms of law to comment on the judiciary.

Would it be right if the Ombudsman Dr Joseph Said Pullicino resigns? I think that it would be the decent thing to do.

Sewwa qal Simon li in-nies għandha tiftaħ ħalqha għand tal-grocer. Ara xi smajt:

” Sewwa qed jgħidu n-Nazzjonalisti li l-Imħallef għandu jirreżenja. Mhux veru, jew, anke tal-Kumitat Olimpiku Internazzjonali qed jgħidu li hemm bżonn jieħdu passi.”

“X’imħallef hu?”

“U dak Farrugia Sacco!”

“Tajba din. Għan-Nazzjonalisti kulħadd għand jirreżenja minbarra huma!”

“U xi trid tgħid biha din?”

“Mela ma smajtx inti l-istorja ta’ Noel Borg Hedley li kien segretarju privat tal-Ministru Tonio Fenech u ammetta li ħa l-flus mingħand il-kuntratturi biex jirranġalhom ħalli jinħafrulhom il-multi.”

“U x’għamel bihom il-flus?”

“Ammetta li nefaqhom ……….. fil-kampanja elettorali ta’ Tonio Fenech.”

“Kif jista’ jkun, Tonio Fenech qal li ma kien jaf b’xejn!”

Fil-Parlament għada t-Tnejn: mera għal Lawrence Gonzi

Għada t-Tnejn 10 ta’ Diċembru 2012, Lawrence Gonzi, Prim Ministru, b’diskorsu, jġib fi tmiemu l-ewwel fażi tad-diskussjoni dwar il-budget ghall-2013. L-oratorija m’hiex ser tonqos imma s-sustanza wisq nibża’ li ser terġa’ tkun assenti.

Ser iwieġeb dak li qal il-Kap tal-Opposizzjoni, li l-anqas hu ma qal kull ma kien jeħtieġ li jingħad. Lawrence Gonzi ser jipprova jfissrilna kif inhu meħtieġ li l-inċertezza li hawn fil-pajjiż tinqata’ billi jkun approvat il-budget.

Lawrence Gonzi iwaħħal f’kulħadd talli l-inċertezza mhux biss nibtet imma firxet l-għeruq tagħha fil-fond. Jaħseb li hu biss m’għandu l-ebda ħtija. Kulħadd għandu l-obbligu li jerfa’ r-responsabbiltajiet tiegħu, jgħid. Imma dawk ta’ madwaru huma esklużi.

Din kienet leġislatura ħażina sa minn l-ewwel jum: għandha fuqha s-saħta tal-Mistra. Saħta li titfa d-dell fuq iż-żewġ naħat tal-Parlament.

Is-saħta tal-Mistra qegħda fuq Lawrence Gonzi għax fl-iskandlu tal-Mistra ipprova jgħatti l-iżbalji u ma kellux il-kuraġġ morali li jgħid li JPO kien żbaljat. Ipprova jpinġieh bħala vittma meta l-vittma vera kienet il-komunita’. Konmunita’ li suppost kellha istituzzjoni maħluqa apposta biex tiddefendiha – il-MEPA. Minflok  iżda din il-MEPA kienet kompliċi u għażlet li tiddefendi l-istupru tal-pajjiż.

Is-saħta tal-Mistra qegħda fuq Joseph Muscat ukoll.  Il-predeċessur tiegħu Alfred Sant kien iddeskriva lil JPO bħala morally and politically corrupt.  Imma Muscat ma ħass l-ebda skruplu biex jinqeda bih.

Hekk ġara fil-każ tal-barriera li Gonzi u RCC riedu li titħaffer quddiem il-Kon Katidral ta’ San Ġwann. Hekk ġara ukoll fuq il-mozzjoni biex il-Parlament iddikjara li m’għandux fiduċja f’RCC.

Id-dnub ma jorqodx u jidher li qed joqrob żmien il-kontijiet.

Il-konfront ta’ Gonzi ma Franco Debono hu żejjed għal partit li diġa qiegħed jegħreq. Kien hemm mument partikolari iżda li kien hemm possibilita’ li l-affarijiet ma jikkumplikawx ruħhom. Kienu ippreżentati quddiem il-Parlament żewġ mozzjonijiet.

L-ewwel mozzjoni kienet ippreżentata minn Franco Debono innifsu u kienet kritika tal-politika tal-Gvern ta’ Gonzi dwar il-Ġustizzja u l-Intern. Kritika qawwija u kienet tieqaf hemm.

It-tieni mozzjoni kienet ippreżentata minn Jose’ Herrera u Michael Falzon: barra li kienet tikkritika l-politika tal-Gvern dwar il-Ġustizzja u l-Intern kienet tipproponi ukoll vot ta’ ċensura fil-Ministru Carm Mifsud Bonnici.

Gonzi għażel li jpoġġi fuq l-agenda tal-Parlament il-mozzjoni tal-Opposizzjoni u ħalla fuq l-ixkaffa l-mozzjoni ta’ Franco Debono. Jiġifieri għamel għażla favur mozzjoni b’konsegwenzi negattivi u warrab mozzjoni li kienet tikkritikah u tieqaf hemm.

Nafu fejn wasslet din l-għażla. B’għażla ta’ Gonzi l-Parlament spiċċa sfiduċja lil Mifusd Bonnici. Deċiżjoni li Gonzi seta’ jevita imma ma riedx. Għaliex għamel hekk hu jaf.

Meta Gonzi jħares fil-mera ma jara l-ebda sinifikat fil-każ ta’ korruzzjoni ta’ Noel Borg Hedley (ex-Segretarju Privat tal-Ministru Tonio Fenech) li fil-Qorti ammetta akkużi ta’ korruzzjoni mill-iżviluppaturi JPM Brothers.

Il-fjask tal-Arriva bir-responsabbilta’ politika dwaru li kellu jinġarr minn Austin Gatt l-anqas ma kellu sinifikat għal Gonzi meta jħares fil-mera.

Issa  ħarġet oħra. Fir-rapport tal-Awditur Nazzjonali l-inkompetenza fl-amministrazzjoni finanzjarja tal-kumpanija tal-Gvern Wasteserve hi imfissra fid-dettall. L-iktar li jispikka hu dak il-kuntratt ta’ miljun euro li spiċċa jissarraf f’kuntratt ta’ disgħa u għoxrin miljun euro. Qiesu ma ġara xejn. Is-sejħa biex George Pullicino jerfa’ r-responsabbilta’ politika u jwarrab ma tfisser xejn.

Quddiem dan kollu it-talba ta’ Gonzi biex il-budget ikun approvat tistona. Għax il-vot fuq il-budget mhux biss vot favur budget rigressiv imma hu ukoll vot favur Gvern li hu moralment zopp. Gvern li jrid lil kulħadd jimxi sewwa imma hu mhux kapaċi jagħti l-eżempju. Għax repetutament irrifjuta li jerfa’ r-responsabbilta politika ta’ għemilu.

X’ser jiġri għada jiena ma nafx. Naf iżda ħaga waħda: li l-Gvern wasal sa hawn għax Lawrence Gonzi ma kienx kapaċi japplika għalih il-kejl li bih hu jkejjel lil ħaddieħor.

Il-Partit Nazzjonalista ġustament qed jitlob li l-Imħallef Lino Farrugia Sacco jirreżenja. Jekk il-PN japplika l-istess kejl għall-Kabinett ta’ Lawrence Gonzi m’għandix dubju li jinbidlu l-Ministri kollha, Gonzi innifsu inkluż!

Malta’s reputation and the Olympics

Last June The Times informed us that Justice Minister Chris Said had called on the Commission for the Administration of Justice to investigate Mr Justice Lino Farrugia Sacco in view of reports carried in London’s Times on the Olympics ticketing scam.

Mr Justice Farrugia Sacco had stated that there was no wrong-doing at his end. In fact he had informed The Times that: “We would never go against the rules of the International Olympic Committee ( IOC). It’s not worth it.”

On the 22 June 2012 The Times had informed its readers that His Excellency President George Abela would abstain from presiding over the investigation requested by the Justice Minister as in the past he (Abela) had represented Mr Justice Farrugia Sacco as legal counsel. The investigation consequently was to be led by the Vice President  of the Commission, the Chief Justice Dr Silvio Camilleri.

No one knows anything else about the investigation requested by Justice Minister Chris Said.

Yesterday 7 December 2012 The Times reported the conclusions of the IOC five-month international investigation into Olympic ticket selling.

I have accessed the website of the International Olympics Committee which reported that on the 5th December 2012 the Executive Committee of the IOC considered and approved “the Ethics Commission proposed recommendations, which were based on a thorough analysis of the evidence provided by the Sunday Times and several hearings.”

The report of the Ethics Committee of the IOC makes interesting reading.

Paragraph 17 of the IOC Ethics Committee Report states the following :

“With regard to the NOC [National Olympic Committee] of Malta,

a) Mr Lino Farrugia, President of the Maltese NOC:

After taking cognisance of all the evidence and his observations, the Commission observes that, by agreeing to take part, with the NOC Secretary General, in a discussion concerning the ATR contract for the Games in Sochi, when it was apparent that his interlocutors seemed to be looking for ways to circumvent the official mechanism, Mr Farrugia allowed the journalists to prove their point.

b) Mr Joe Cassar, Secretary General of the Maltese NOC:

After taking cognisance of all the evidence and his observations, the Commission observes that, by agreeing to discuss the ATR contract for the Games in Sochi when his interlocutors were clearly looking for ways to circumvent the official mechanism and knowing that some of the tickets could be sold in the Middle East; and finally by explaining which means could be used to get around the mechanism, Mr Joe Cassar helped to prove the point being made by the journalists, namely that the sports world and those who work with it are prepared to violate the rules. As a result, Mr Joe Cassar helped the reputation of the Olympic Movement to be tarnished.”

The IOC Ethics Committee concluded by giving its opinion which was unanimously approved: either the local Olympic Committees take action against the named officals who have tarnished the reputation of the Olympic Movement, or else :

“The Commission is further of the view that, in the absence of appropriate action by the NOCs or the individuals concerned, the IOC Executive Board has the authority to take the appropriate administrative measures, particularly with regard to issuing accreditations for the various IOC organized events such as the Olympic Games, the Youth Olympic Games, Sessions and other IOC meetings.”

In view of the above it is clear that the matter is not just an internal matter for the Malta Olympic Committee. It may well involve non-participation of maltese sportsman and women in Olympic activities.

I have no hope that Parliament will act by impeaching Mr Justice Farrugia Sacco, even if that is what he deserves.

What will happen now is anybody’s guess. Will the sports organisations stand up to be counted?

The International Olympic Movement is worried because its reputation has been tarnished. Unfortunately it seems that no one is worried in Malta. No one seems to care that Malta’s reputation is being severely tarnished. It gets worse.

The silence of the authorities is deafening. It defines the ethical standards of public officials!
