Estradizzjoni għal Konrad Mizzi?

L-istejjer dwar Konrad Mizzi huma bla limitu: sa mill-ewwel mument li daħal fil-Parliament u l-Kabinett. It-twaqqif tat-trust fi New Zealand u r-registrazzjoni ta’ kumpanija fil-Panama komplew jitfgħu ftit dawl fuq kif jaħdem dan il-bniedem.

Bil-pubblikazzjoni tal-Panama Papers għajnejn ħafna tbexxqu u bdew jistaqsu. Id-dubji għad mhumiex imwieġba anzi inħolqu dubji ġodda bi stejjer ġodda.

Hu fatt li Konrad Mizzi mhux Malta. Ilu nieqes minn Marzu u l-anqas Parlament ma mar. Iċ-ċertifikati mediċi f’dawn iċ-ċirkustanzi ftit li xejn jitwemmnu.

Jason Azzopardi qed jagħmel allegazzjonijiet serji ħafna. Qed jgħid li Mizzi hu maħrub għax jibża’ li jkun investigat mill-kummissarju l-ġdid. Din hi possibiltà realistika u tweġiba, fiċ-ċirkustanzi, ftit hemm min jista’ jagħtiha ħlief Konrad Mizzi nnifsu u possibilment Robert Abela.

Meta Konrad Mizzi tneħħa mill-Kabinett għax ġie mġiegħel jirriżenja kien pass tajjeb. Li ma ntagħżilx bħala Ministru minn Robert Abela meta dan għażel il-Kabinett ġdid tiegħu kien pass ieħor il-quddiem. Issa jonqos pass ieħor: li jwieġeb għal għemilu meta, possibilment, flimkien ma oħrajn jkun imsejjaħ jagħmel hekk.

Sakemm jibqa’ maħrub fir-Renju Unit dan mhux possibli li jsir. Ovvjament jekk il-Kummissarju l-ġdid jirriżultalu li hemm il-provi dejjem hemm il-possibilità ta’ talba ta’ estradizzjoni. Mir-Renju Unit s’intendi għax mill-Montenegro ma naħsibx li jkun possibli!

Imnawwar minn ġewwa

Sal-ħin li qed nikteb, l-investigazzjoni interna tal-Pulizija nfirxet minn waħda iffukata fuq it-taqsima tat-traffiku għal taqsimiet oħra tal-korp. Bosta huma mnixxfa kif dawk li suppost iżommu l-ordni u jħarsu l-osservanza tal-liġi qed jiġu nvestigati huma stess dwar allegazzjionijiet ta’ abbuż minn fondi pubbliċi kif ukoll allegazzjonijiet li talbu flus biex ma jagħmlux dmirhom (speċi ta’ protection money).

Supretendent u numru ta’ uffiċjali oħra, rinfaċċjati bil-provi rreżenjaw mill-korp. Numru mhux żgħir ta’ pulizija ġew interrogati.

M’għandniex inkunu sorpriżi b’dan kollu, għax dan huwa kollu riżultat dirett ta’ kultura ta’ impunità li ġiet imxettla b’mod kontinwu mill-Partit Laburista fil-Gvern tul dawn l-aħħar snin. Xejn mhu xejn. B’xi mod jew ieħor kollox jibqa’ għaddej, jew kważi.

Il-Prim Ministru Robert Abela stqarr li l-fatt illi l-Pulizija stess qed jinvestigaw lill-pulizija li dwarhom hemm l-alegazzjonijiet huwa indikazzjoni ċara li l-istituzzjonijiet fil-pajjiż qed jaħdmu sewwa. Fil-fehma tiegħi din hi analiżi skorretta. Dak li qed jiġri trid tarah ukoll fil-kuntest tal-ħbiberija żvelata bejn dak li kien Deputat Kummissarju tal-Pulizija Silvio Valletta u Yorgen Fenech, (l-allegat mandant tal-assassinju ta’ Daphne Caruana Galizia). F’dan il-kuntest, l-investigazzjoni tindika li l-korp tal-Pulizija huwa mnawwar minn ġewwa.

Fil-waqt li l-parti l-kbira tal-membri tal-korp tal-Pulizija huma persuni serji, għandu jkun sottolinejat li mhux l-ewwel darba li rriżulta li uffiċjali anzjani tal-korp tal-pulizija kienu viċin ta’ persuni li kienu taħt investigazzjoni. Kaz ieħor riċenti li niftakar hu ta’ uffiċjal imlaħħaq fit-taqsima tar-reati ekonomiċi (spettur) li kien viċin ħafna ta’ operatur fl-industrija tal-logħob tal-ażżard. Tant kien viċin tiegħu li anke kellu l-aċċess biex jutilizza karozza privata ta’ din il-persuna, Ferrari. Il-każ imur lura sal-2015 meta missier l-ispettur, kien agent Kummissarju tal-Pulizija. Għax il-każ taz-ziju Silvio ċertament mhux l-uniku wieħed.

Kien il-kandidat laburista Andy Ellul li f’artiklu ppubblikat fuq it-Times tat-28 ta’ Jannar 2020 li stqarr li “Police commissioners form part of the executive and they have to toe the electoral programme of the government of the day”. Huwa ċertament ta’ sfortuna li Andy Ellul jikkunsidra li l-pulizija għandha funzjoni politika għax l-implimentazzjoni tal-manifest elettorali hi funzjoni tal-politiċi u tagħhom biss.

Dak li qal Andy Ellul jispjega ħafna dwar meta, kif u għaliex (uħud) mill-Pulizija jaġixxu u jinvestigaw. Andy Ellul kien hu nnifsu membru tal-korp tal-pulizija u allura suppost li jaf ferm iktar minn hekk!

Meta l-Panama Papers saru materja pubblika x’investigazzjoni għamlet il-pulizija? Abbażi ta’ dak li ġie osservat min-naħa tal-uffiċċju tal-Prim Ministru f’Kastilja, il-Pulizija ġew jaqgħu u jqumu. Konrad Mizzi u Keith Schembri ma ġewx mitluba biex jerfgħu ir-responsabbiltà għall-azzjonijiet tagħhom meta waqqfu kumpaniji sigrieta fil-Panama: ħelsuha ħafif. Għaldaqstant wara dan il-messaġġ ċar li qiesu ma ġara xejn, ħadd ma għandu jkollu l-ebda dubju x’kejl kellu japplika għall-pulizija u għall kull min jagħmel affarijiet li s-soltu ma naċċettawhomx. Kien biss meta l-whistle-blower saffar li l-investigazzjoni kellha tibda. Hawn xi ħadd li jemmen li b’mod ġenwin ħadd ma nduna b’xejn? Hu ċar li bosta ħadu sehemhom u allura b’mod konvenjenti “ħadd ma nduna xejn”.

It-triq biex tissewwa l-ħsara li saret lir-reputazzjoni li Malta kisbet illum il-ġurnata mhix triq faċli. Li tkun stabilita mill-ġdid il-fiduċja fil-korp tal-Pulizija hu pass wieħed żgħir minn ħafna meħtieġa.

Malta bil-mod qed tiġi trasformata f’soċjeta amorali fejn il-prinċipji aċċettabbli ta’ imġieba korretta qed jintremew il-baħar. Hemm min jiddieħaq bihom ukoll.

Rappresentanti tas-settur tas-servizzi finanzjarji qalulna li hemm bżonn is-sehem ta’ kulħadd biex naslu li nnaddfu isem Malta mill-ġdid. Huwa ftit diffiċli biex wieħed jifhem kif nistgħu naslu meta hu ċar għal kulħadd li l-korp tal-Pulizija hu mnawwar minn ġewwa.

Rotten to the core

At the time of writing, the Police internal investigation has widened from one focused on the traffic section to other police units. Many are shocked that the upholders of law and order are themselves under investigation in respect of allegations on the fraudulent use of public funds as well as the allegation of being in receipt of protection money.

Faced with the available evidence, a Superintendent – as well as a number of other police officers – has resigned. It is reported that substantial number of officers were interrogated, with some being released on police bail.

I am not at all surprised because, in my view, this is the direct consequence of the culture of impunity which the Labour Party in government has continuously nurtured for the past six years during which it has been in office.

Prime Minister Robert Abela has stated that the fact that the police are investigating their own is, in itself, an indicator that the institutions are functioning properly. His assessment is, in my view, incorrect. Together with the revelations regarding the close friendship of former Police Deputy Commissioner Silvio Valletta and Yorgen Fenech, (the suspected mastermind of Daphne’s assassination), the police investigation is more of an indication that a section of the Police Force may be rotten to the core.

While most of the members of the Police Force are beyond reproach, it has to be underlined that this is not the first instance, in recent years, when senior police officers were reported as being too close to people under investigation. A specific case that comes to mind is that of a senior police officer in the Economic Crimes unit who was so close to an operator in the gaming industry – then under investigation – that it was then reported in the media that he had access to, and made use of, the operator’s private vehicle, a Ferrari. The case goes back to 2015. Uncle Silvio’s case is definitely not a one-off.

It was Labour Party candidate Andy Ellul who, in an opinion published in The Times on 28 January 2020 stated that “Police commissioners form part of the executive and they have to toe the electoral programme of the government of the day”. It is indeed unfortunate that Andy Ellul considers that the police have a political function, as the implementation of the electoral programme is the exclusive function of holders of political office.

Andy Ellul’s utterances explain quite a lot as to when, how and why (some of) the police act and investigate. Andy Ellul, a former policeman himself, certainly knows much better than that!

When the Panama Papers revelations hit the headlines what investigations were carried out by the Police? Taking the cue from the Office of the Prime Minister at Castille the Police were not bothered. If Konrad Mizzi and Keith Schembri can get away with shouldering responsibility for their actions through the setting up of secret companies in Panama, one should not wonder as to the yardstick applied to misdemeanours of some of the members of the Police Force. It was only when the whistle-blower sounded the alarm that matters took a new direction on the allegations relative to police in the Traffic Section and beyond.

Repairing Malta’s reputation is not an easy task and restoring confidence in the Police Force is only one small step of the many required. Our country is being slowly transformed into an amoral society in which principles of ethical behaviour are being scourned and thrown overboard.

We have been told by representatives of the financial services sector that we need all hands on deck to repair Malta’s reputation. It is difficult to comprehend how this can commence in earnest when key elements of the Police Force are rotten to the core.

Investigating Konrad’s MTA contract

It is known that Johann Buttigieg, former Chief Executive at the Planning Authority, was squeezed out of his post by Minister Ian Borg. Johann Buttigieg, however, found an ally in Konrad Mizzi, then Minister for Tourism, who facilitated his employment as the new Chief Executive of the Malta Tourism Authority.

By the time Johann Buttigieg had taken up his new post at the Malta Tourism Authority, Konrad Mizzi had already resigned as Minister. Although Konrad Mizzi had announced his resignation after a Cabinet meeting on the 26 November 2019 it is not clear if he had volunteered to step down or if he had been forced to go. He was reported as having said: “I felt it my duty – in the context of current political circumstances – to resign in loyalty to the people, the Labour Party and the Prime Minister.”

It would be reasonable to assume that Johann Buttigieg returned the favour from Konrad Mizzi when, on 9th December, he signed the contract appointing Konrad Mizzi as a consultant to the Authority – as one of his first decisions as CEO! However, this would not necessarily be a correct assumption. In fact, elsewhere in the press it has been opined that the decision to engage Konrad Mizzi as consultant was taken by Joseph Muscat himself, because after Konrad Mizzi’s resignation he was directly responsible for the Tourism Ministry.

As Chief Executive of the Malta Tourism Authority, Johann Buttigieg must shoulder substantial responsibility although it is most probable that he was acting on the instructions of Joseph Muscat. He should by now be aware that illegitimate (and unethical) superior orders can – and should be – ignored.

After Minister Julia Farrugia Portelli announced the rescinding of Konrad Mizzi’s contract she was asked to explain the reasons which justified such a revocation. She was very brief in her reply, saying that there were legal and ethical reasons that justified such a course of action. She was reluctant to state more in order to avoid prejudicing any legal action, should this result.

It is very interesting to note that the Honourable Minister has justified the revocation of the contract on ethical grounds. She is, of course, correct, although she chose not to point fingers. The point at issue then is who acted unethically?

I suggest that there are four persons who acted unethically in this specific case.

Irrespective of what they say, former Prime Minister Joseph Muscat and his sidekick Konrad Mizzi resigned in disgrace for a number of reasons, including being the cause of reputational damage to the country through their involvement and/or failure to act on the Panama Papers debacle, as well as a direct result of the role of the Office of the Prime Minister in Daphne Caruana Galizia’s murder: a role, the details of which are still emerging.

Joseph Muscat and Konrad Mizzi are at the top of the list of those who acted unethically as they set in motion the revolving recruitment mechanism as a result of which Konrad Mizzi was parachuted straight into the organisation for which he, as Minister, was politically responsible just two weeks earlier. This is unacceptable in any country that has a minimum degree of adherence to good governance: normally there would be a cooling-off period of some two to three years before such appointments are even considered.

Muscat and Mizzi tried to cash in on the fact that, the rules governing the ethical behaviour of holders of political office are still in their infancy. Dr George Hyzler, recently appointed by Parliament as the first Commissioner for Standards in Public Life, is still in the initial phase of his term and has yet to draft some of the appropriate rules.

The same applies to Chairman of the Malta Tourism Authority and Chief Executive Johann Buttigieg, who should not have allowed Prime Minister Joseph Muscat and his sidekick Konrad Mizzi to bully them into submission. The recruitment of Mizzi was kept secret as long as was possible due to the fact that, knowledge of its existence would undoubtedly have created further turmoil within the Labour Party, then in the process of electing a successor to the disgraced Joseph Muscat.

Where do we go from here? In my view those acting unethically should shoulder their responsibilities. I have thus requested the Commissioner for Standards in Public Life to investigate the role of Joseph Muscat, Konrad Mizzi, Gavin Gulia and Johann Buttigieg in the matter and consequently to recommend the necessary action required.

Pass tajjeb Julia: u issa?

Għada kif ħarġet l-aħbar li l-Ministeru tat-Turiżmu, wara li rċieva parir legali, ordna lill-Awtorità tat-Turiżmu biex il-kuntratt ta’ konsulenza ta’ Konrad Mizzi bi ħlas ta’ €80,000 fis-sena jkun annullat.

Pass tajjeb dan għal Julia Farrugia, l-Ministru ġdid tat-Turiżmu li sabet din il-ħatra ma wiċċha u ħadet passi. Ħatra li saret bil-moħbi fl-aħħar jiem tal-Gvern ta’ Joseph Muscat.

Li tħassar il-kuntratt hu pass tajjeb. Imma jeħtieġ ukoll li jittieħdu passi oħra.

Min ordna li Konrad Mizzi jkun ingaġġat bħala konsulent tal-Awtorità tat-Turiżmu? Ma naħsibx li dan sar minn wara dahar Joseph Muscat.

Bla dubju huma nvoluti ukoll Gavin Gulia Chairman tal-Awtorità tat-Turiżmu u Johann Buttigieg Chief Executive li ġie ngaġġat dan l-aħħar wara li Ian Borg ra kif għamel u ħeles minnu mill-Awtorità tal-Ippjanar. Il-kuntratt fil-fatt hu iffirmat minn Johann Buttigieg.

L-istorja m’għandhiex tieqaf hawn. Diġa saret talba biex il-Kumitat tal-Kontijiet Pubbliċi tal-Parlament jinvestiga.

Imma dan il-kaz hu ukoll wieħed dwar nuqqas ta’ mġieba etika u għandu jkun eżaminat mill-Kummissarju dwar l-Istandards fil-Ħajja Pubblika fil-konfront kemm ta’ Joseph Muscat kif ukoll ta’ Gavin Gulia u Johann Buttigieg.

Il-Partit Laburista hu moralment u politikament fallut

Joseph Muscat u l-Partit Laburista huma moralment u politikament falluti. Ir-responsabbiltà għas-sitwazzjoni kurrenti jrid iġorrha Joseph Muscat kemm bħala Prim Ministru kif ukoll bħala Mexxej tal-Partit Laburista. Għalhekk irreżenja. Imma anke l-Kabinett u t-tmexxija tal-Partit Laburista huma kollettivament responabbli flimkien miegħu.

Ma ħadux passi meta kellhom l-obbligu li jaġixxu, jiġifieri meta kienu ppubblikat l-Panama Papers fl-2016. Dakinhar, il-Prim Ministru messu keċċa kemm lil Konrad Mizzi kif ukoll lil Keith Schembri u sussegwentement kellhom ikunu investigati mill-Pulizija, flimkien mal-merċenerji tan-Nexia BT. Iżda ma ġara xejn minn dan!

Anke l-Partit Laburista f’dak il-mument kellu l-obbligu li jiċċensura lit-tmexxija tal-Partit talli naqas mill-jaġixxi. Minflok ma għamel hekk il-Partit Laburista, b’mod irresponsabbli, ta’ appoġġ inkundizzjonat lit-tmexxija u nhar is-26 ta’ Frar 2016 eleġġa lil Konrad Mizzi b’96.6% tal-voti validi bħala Deputat Mexxej tal-Partit. Dan kollu seħħ jumejn biss wara li kienu ppubblikati l-Panama Papers. Fi ftit ġimgħat imbagħad, kellu jirreżenja bħala riżultat ta’ pressjoni pubblika.

Għaliex jaġixxu b’dan il-mod?

It-tweġiba jagħtihielna l-eks-Ministru Leo Brincat fi kliem li ma jħallix lok għal misinterpretazzjoni. Dan meta kien qed jiġi eżaminat mill-Kumitat tal-Parlament Ewropew dwar il-kontroll tal-Baġit fl-2016 f’konnessjoni man-nomina tiegħu biex ikun jifforma parti mill-Qorti Ewropeja tal-Awdituri.

Meta Leo Brincat kien qed jixhed, kif mistenni, kien mistoqsi dwar il-Panama Papers. Kien ċar meta qal illi kieku kien hu, kien jirreżenja jew tal-inqas jissospendi ruħu sakemm l-affarijiet ikunu ċċarati.

Brincat, imma, qal iktar minn hekk: huwa informa lill-Kumitat Parlamentari li kien hemm mument, li kien qed jikkunsidra jirriżenja minn Ministru minħabba l-mod kif imxew l-affarijiet dwar l-iskandlu tal-Panama Papers f’Malta. Imma, żied jgħid, reġa’ bdielu u ma rriżenjax għax ma kellu l-ebda xewqa li jkun meqjus bħala eroj f’dak il-jum li jirriżenja, imbagħad wara jispiċċa fil-baħħ politiku!

Il-Membri Parlamentari Ewropej, inbagħad iffukaw fuq l-argument ċentrali: jista’ is-Sur Leo Brincat jispjega għaliex meta l-Parlament kellu quddiemu mozzjoni ta’ sfiduċja f’Konrad Mizzi, huwa kien ivvota kontriha u ta l-fiduċja lil Konrad Mizzi? Brincat emfasizza li hu qatt ma seta’ jivvota favur il-mozzjoni ta’ sfiduċja għax kien marbut kif jivvota mil-Whip Parlamentari tal-partit tiegħu!

B’dik it-tweġiba, Leo Brincat kien qed jagħmilha ċara mal-Kumitat Parlamentari tal-Parlament Ewropew għall-Kontroll tal-Baġit li hu kien qed jagħmel għażla fundamentali.

Fil-mument li ġie biex jagħżel bejn il-lealtà lejn il-partit u l-lealtà lejn il-prinċipji tiegħu, il-prinċipji rmiehom il-baħar u għażel il-partit. Fil-mument deċiżiv is-solidarjetà ma’ Konrad Mizzi kellha prijorità fuq l-osservanza tal-prinċipji ta’ governanza tajba. Huwa dan li dejjaq lil numru sostanzjali ta’ membri tal-Parlament Ewropew u wassalhom biex ma jirrakkomandawx il-ħatra ta’ Leo Brincat bħala membru tal-Qorti Ewropeja tal-Awdituri, l-istess kif kienu għamlu ftit qabel bin-nomina ta’ Toni Abela. Id-dikjarazzjoni ta’ Leo Brincat lil Parlament Ewropew tfisser ħaġa waħda: li dak kollu li qal dwar il-governanza tajba ma jiswiex karlin, għax fil-mument tal-prova ċaħdu.

L-istess ħaġa għandu jingħad dwar Evarist Bartolo u l-prietka tiegħu ta’ kull fil-għodu fuq il-media soċjali. Fis-siegħa tal-prova, anke Varist, bħall-bqija tal-grupp Parlamentari (inkluż Chris Fearne, li qiegħed fuq quddiem fit-tellieqa għat-tmexxija tal-Partit) irmew il-prinċipji tagħhom biex jippruvaw isalvaw ġildhom.

Fl-aħħar minn l-aħħar, il-Partit Laburista, bħall-Partit Nazzjonalista qablu, mhux interessat fil-governanza tajba ħlief bħala għalf għal diskors politiku. Għax il-Partit Laburista hu moralment u politikament fallut.

Labour is morally and politically bankrupt

Joseph Muscat and his Labour Party are morally and politically bankrupt. The responsibility for the current state of affairs rests primarily on Joseph Muscat’s shoulder as Prime Minister and Leader of the Labour Party – hence his resignation.

However, the Cabinet and the Labour Party leadership are, together with Joseph Muscat, also collectively responsible for the ensuing mess.

They failed to act when they should have acted when the Panama Papers were published in 2016. At that point in time Konrad Mizzi and Keith Schembri should have been fired on the spot by Prime Minister Joseph Muscat and thoroughly investigated by the police, together with the mercenaries at Nexia BT. Yet they were not.

At that point in time, the Labour Party was duty bound to censor its leadership for failing to act. Instead of doing so, it irresponsibly shored up the leadership and elected Konrad Mizzi with 96.6 per cent of available votes, endorsing him as Deputy Leader on the 26 February 2016, two days after the Panama Papers saw the light of day. He resigned some weeks later as a result of public pressure.

Why do they act in this way?

The answer was given in crystal clear language by former Labour Minister Leo Brincat when he was being vetted by the European Parliamentary Committee on Budgetary Control in 2016 with reference to his nomination to form part of the European Court of Auditors. I have already written about the matter in my article entitled: Leo Brincat: loyalties and lip service (TMIS 18 September 2016).

When Leo Brincat gave evidence, he was, as anticipated, quizzed regarding the Panama Papers. He made himself crystal clear by saying that he would have submitted his resignation – or else suspended himself from office until such time as matters had been clarified – had he himself been involved.

Brincat further volunteered the information that there had been a point at which he had considered resigning from Ministerial office due to the manner in which the Panama Papers scandal was handled in Malta. He added that eventually, however, his considerations did not materialise and he did not resign as he had no desire to be a “hero for a day and end up in the (political) wilderness” thereafter.

MEPs then focused on the fundamental issue: what about his vote against the motion of No Confidence in Minister Konrad Mizzi which was discussed by Malta’s House of Representatives? Brincat emphasised that he could not vote in favour of the No Confidence motion as he was bound by his Party’s Parliamentary Whip! He emphasised the fact that this was a basic standard of local politics, based on the Westminster model.

As a result of this exchange, Leo Brincat made it clear to the EU Parliament’s Budgetary Control Committee that he had made a very important and fundamental choice: he preferred loyalty to the Party whip to loyalty to his principles: those same principles about which he has been harping on for ages. When push came to shove, solidarity with Konrad Mizzi took priority over adherence to the principles of good governance. This is what irked a substantial number of MEPs and prompted them not to recommend the approval of Leo Brincat as a member of the European Court of Auditors as they had done previously when faced with the nomination of Toni Abela. Leo’s declaration means only one thing: that his voluminous statements on good governance are only lip service to which there is no real commitment.

The same goes for Evarist Bartolo’s daily sermon on social media in respect of good governance. When push came to shove even Evarist and the rest of the Labour Party Parliamentary group (including Chris Fearne, current front-runner in the leadership elections), dumped their principles overboard to save their skin.

At the end of the day, the Labour Party – like the Nationalist Party before it – is not interested in good governance except as material for political speeches. Labour is morally and political bankrupt.

Tal-mistħija

Il-kwantità ta’ nies li kien hemm jiċċelebraw ma Joseph Muscat fin-Naxxar, Ħaż-Żebbuġ u r-Raħal Ġdid illum, juru li għad hawn bosta li għadhom ma fehmux il-gravità tas-sitwazzjoni li fiha jinsab il-pajjiż illum. Irreżenja biex jerfa’ r-responsabbiltà politika għas-sitwazzjoni kurrenti li żviluppata mill-investgazzjonijiet fuq il-qtil ta’ Daphne Caruana Galizia. Qed jirreżenja ukoll minħabba ta’ madwaru li ma kellux il-kuraġġ li jkeċċihom, meta żbaljaw bil-kbir kif jidher mid-dokumentazzjoni kollha konnessa mal-Panama Papers.

Bil-mod kif qed jitkellem Joseph Muscat fil-lokalitajiet fejn qed imur qed iwassal messaġġ ħażin. Qed jgħid li ma għamel xejn ħażin. (Matul il-gimgħa kien qalilna li qed jerfa’ fuq spallejh dak li għamel ħaddiehor.)

Fil-fatt l-affarijiet huma kompletament bil-maqlub: tant mexa ħażin li l-imġieba tiegħu kontinwament qed twassal il-messaġġ li xejn m’hu xejn. Għal Joseph u għal dawk li iddemostraw illum, huma l-ġurnalisti li żbaljaw meta jirrappurtaw u jikkummentaw dwar il-ħmieġ. Għax Joseph ma għamel xejn ħażin.

Riżenji meħtieġa wara l-arrest ta’ Yurgen Fenech

L-arrest ta’ Yurgen Fenech kmieni dal-għodu fuq il-yacht tiegħu barra Portomaso jiftaħ il-bibien beraħ għal ħafna affarijiet.

L-ewwel nett, għal min isegwi, isem Yurgen Fenech ilu iċċirkula fil-widnejn bħala dak il-businessman prominenti li rreferiet għalih it-Times xi ġimgħat ilu bħala l-allegat mandanti, s’issa mhux magħruf, fil-kaz tal-assassinju ta’ Daphne Caruana Galizia.

Il-Korruzzjoni m’għandhiex kulur

Id-dibattitu dwar il-korruzzjoni fil-gżejjer Maltin ma jispiċċa qatt. Il-korruzzjoni m’għandhiex kulur u tiddependi ħafna fuq kultura ta’ klijenteliżmu u fuq istituzzjonijiet dgħajfa jew imdgħajfa. Sfortunatament, ma teżisti l-ebda rieda politika biex dan ikun indirizzat.

Ma tidher l-ebda azzjoni ċara u konkreta li tikkorrispondi mad-diskors pubbliku u ma jaqta’ xejn dwar tolleranza żero għall-korruzzjoni.

Ir-resistenza tal-Ministri Edward Scicluna, Konrad Mizzi u Chris Cardona biex tinfetaħ inkjesta kriminali minn maġistrat dwar l-allegazzjonijiet tal-kompliċità kriminali tagħhom in konnessjoni mal-ftehim tal-Vitals Global Healthcare dwar l-isptarijiet ma tinftiehemx. Prim Ministru b’tolleranza żero għall-korruzzjoni kien jitlob l-inkjesta hu stess. Inkella kien ikun minn ta’ quddiem biex jappoġġja t-talba li saret.

Kieku l-Partit Laburista kellu tolleranza żero għall-korruzzjoni ilu li bagħat lil Konrad Mizzi u lil Keith Schembri jixxejru. Il-fatt li l-mexxej Laburista Joseph Muscat ma aġixxiex b’dan il-mod ifisser li hu dispost li jagħlaq għajnejh għall-irregolaritajiet li jagħmlu ta’ madwaru. F’dawn iċ-ċirkustanzi, Partit Laburista b’tolleranza żero għall-korruzzjoni kien jiġbed widnejn il-mexxej tiegħu u jwissieh li jiemu magħduda jekk ma jibdilx triqtu. Il-fatt li l-Partit Laburista ma għamel xejn minn dan ifisser ħaġa waħda: li korruzzjoni hi tollerata.

Ikun għaqli jekk niftakru illi fl-istadji inizzjali tal-iskandlu magħruf bħala Panama Papers diversi membri tal-Grupp Parlamentari tal-Partit Laburista irreaġixxew għal dan kollu bil-bibien magħluqa.

F’April u Mejju tal-2016 kienet ħarġet l-istorja li mhux il-Partit Laburista kollu hu illuppjata dwar allegazzjonijiet ta’ korruzzjoni. Id-dibattitu intern, kif irrappurtat fil-medja, kien imqanqal, imma ma wassal għall-ebda azzjoni konkreta.

Il-Partit Nazzjonalista, għalkemm fl-Opposizzjoni, ma jistax ikun alternattiva għal dan għax minkejja li l-kritika tiegħu hi korretta mhuwiex kredibbli.

Il-Partit Nazzjonalista eleġġa mexxej li ftit li xejn jispira fiduċja fost il-pubbliku. Primarjament dan hu minħabba l-informazzjoni li toħroġ minn rapporti investigattivi dwaru ppubblikati minn Daphne Caruana Galizia, informazzjoni li turi kif diversi drabi ma aġixxiex b’mod korrett. Il-politku ma’ għandux il-possibilità li jagħżel meta jixgħel is-switch tal-imġieba etika. L-imġieba tal-politiku meta ma jkunx taħt il-lenti tal-opinjoni pubblika hi l-iktar indikattiva dwar x’isarraf. Il-kaz ta’ klijenti tal-uffiċju legali ta’ Adrian Delia li bbenefikaw minn dħul minn briedel f’Londra huwa eżempju prattiku ta’ dan. Meta l-informazzjoni kienet ippubblikata Delia fetaħ libell imma wara mhux biss irtirah imma ma ħa l-ebda passi alternattivi biex jisganċa ruħu minn dak li ntqal bl-iswed fuq l-abjad dwaru.

L-istess għandu jingħad dwar ix-xhieda ġuramentata tad-Deputat Nazzjonalista Claudio Grech dwar l-iskandlu taż-żejt liema xhieda ngħatat quddiem il-Kumitat Parlamentari għall-Kontijiet Pubbliċi. Dakinnhar Grech qal li ma kienx jiftakar jekk qatt iltaqa’ ma’ George Farrugia, il-moħħ wara l-iskandlu u li wara ngħata l-maħfra biex jikxef kollox. Il-Kap tal-PN ta’ dakinnhar, Simon Busuttil, bl-ebda mod ma rreaġixxa għal din l-imġieba. Ma ttieħdu l-ebda passi kontra Claudio Grech mill-PN f’dan il-kaz li bosta jqisuh bħala li pprova jevita li jikxef informazzjoni ta’ relevanza għal għarfien aħjar ta’ fatti tal-iskandlu.

Fid-dawl ta’ nuqqas ta’ kredibilità, meta l-Opposizzjoni Parlamentari (kif kostitwita illum) titkellem, l-impatt ta’ dak li tgħid bi kritika tal-Gvern ftit hu effetttiv.

Dan nistgħu narawh ukoll fid-dawl ta’ każi ta’ governanza ħażina li jikkomunikaw messaġġ wieħed: il-PL u l-PN huma pezza waħda. Eżempju ċar ta’ dan hu l-kaz tal-involviment ta’ Mario Demarco fin-negozjati kuntrattwali tad-dB fil-kwalità tiegħu ta’ konsulent legali tal-Grupp dB, meta fl-istess ħin kien Viċi Kap tal-Opposizzjoni u kelliemi għall-Finanzi. Għalkemm Mario Demarco għamel apoloġija pubblika dwar dan meta l-qiegħa kienet saħnet, il-ħsara li seħħet kienet sostanzjali. Il-messaġġ ċar li ġie kkomunikat dakinnhar kien li l-aħjar elementi tal-Opposizzjoni Parlamentari ma kinux kapaċi jiddistingwu bejn l-obbligi pubbliċi u l-interessi privati tagħhom.

Ikun opportun ukoll li niftakru fid-diversi rapporti tal-Awditur Ġenerali dwar abbuż minn propjetà pubblika meta din kienet responsabbiltà politika tad-deputat Jason Azzopardi. Il-PN fl-ebda ħin ma esiġa li Azzopardi jerfa’ r-responsabbiltà politika għall-frejjeġ li ħalla warajh.

Il-governanza ħażina u l-korruzzjoni huma kuġini. Waħda twassal għall-oħra. Xi minn daqqiet hemm min jitfixkel waħda mal-oħra.

Alternattiva Demokratika dejjem kienet ċara. Dejjem kellna tolleranza żero kemm għall-korruzzjoni kif ukoll għall-governanza ħażina. Sfortunatament, la l-PN u l-anqas il-PL ma jistgħu jgħidu l-istess.
