Riforma tal-Awtorità tal-Ippjanar

Il-Prim Ministru Robert Abela, fid-diskors tiegħu tal-Ewwel ta’ Mejju, qal li ser jagħti bidu għal riforma fil-qasam tal-ippjanar tal-użu tal-art. Ftit li xejn ta’ dettalji. Fi kliemu, imma, kien ċar li kien qed jipprova jsewwi l-ħsara li rriżultat mill-kritika li saret f’dawn il-jiem minn żewġ Sindki Laburisti. Wieħed minnhom (Christian Zammit – Sindku tax-Xagħra) irriżenja, għax xebbgħuh. L-ieħor, Conrad Borg Manché, Sindku tal-Gżira, baqa’ għaddej. Idu msaħħa riżultat ta’ rebħa fil-Qrati li kellu kontra l-Awtorità tal-Artijiet u d-deċiżjoni tagħha li tieħu lura biċċa mill-ġnien tal-Gżira biex tagħmel il-wisa’ għal pompa tal-petrol.

Bħas-soltu, l-Partit Laburista jipprova jingħoġob ma’ kulħadd. Il-Mexxej tal-Partit Laburista ifaħħar l-impenn ambjentali taż-żewġ sindki. Imma oħrajn fit-tmexxija tal-partit, fl-istess ħin, kontinwament jiddefendu lil min qed jagħmlilhom xogħolhom bħala sindki diffiċli.

Il-problema bażika tal-Awtorità tal-Ippjanar hi li kontinwament tinjora ir-regoli tal-ippjanar tagħha stess. Għal din ir-raġuni, din il-ġimgħa stess, il-Qorti tal-Appell ħassret żewġ deċiżjonijiet oħra tal-istess Awtorità tal-Ippjanar.

Ir-residenti, kif ukoll uħud mill-kunsilli lokali, kontinwament qed isemmgħu leħinhom kontra kull xorta ta’ deċiżjoni tal-Awtorità tal-Ippjanar. Il-permess għall-iżvilupp mill-ġdid tal-villaġġ tal-Mistra kien ħareġ għall-ewwel darba fl- 2013 għal żvilupp b’għoli ta’ tnax-il sular. Ir-residenti opponew it-tiġdid ta’ dan il-permess minħabba li dan mhux kompatibbli mar-regoli tal-ippjanar li huma fis-seħħ illum. It-Tribunal ta’ Reviżjoni għall-Ambjent u l-Ippjanar (EPRT) ma aċċettax l-appell tar-residenti, imma l-Qorti tal-Appell waqqfet kollox u bagħtet il-file lura biex il-każ ikun eżaminat mill-ġdid. Dan, il-Qorti għamlitu, għax ikkonkludiet li t-talbiet tar-residenti ma ġewx eżaminati sewwa mill-EPRT.

Fid-dawl ta’ din id-deċiżjoni tal-Qorti tal-Appell ikun floku li wieħed jistaqsi “il-għala, dawk li jieħdu d-deċiżjonijiet tal-ippjanar, kontinwament jinjoraw ir-regoli”? Xi snin ilu kien l- Ombudsman innifsu li wasal għall-istess konklużjoni.

Dan il-kaz mhux xi eċċezzjoni!

Nhar l-Erbgħa, l-Qorti tal-Appell, tat deċiżjoni oħra, din id-darba dwar żvilupp fil-Mellieħa. Aċċettat appell li sar mill-Kunsill Lokali tal-Mellieħa u ħassret permess ta’ żvilupp għal-lukanda (bil-faċilitajiet anċillari għaliha) liema permess kien inħareg f’żona fejn dan l-iżvilupp ma jistax isir ħlief f’ċirkustanzi eċċezzjonali. Din il-lukanda ta’ tmien sulari hi konnessa mal-interessi tal-iżviluppatur Għawdxi Joseph Portelli.

L-applikazzjoni għall-ewwel kien hemm il-parir dwarha (bil-miktub) biex din tkun rifjutata. Imma l-Kummissjoni għall-Kontroll tal-Iżvilupp ma qablitx ma’ dan u approvat il-ħruġ ta’ permess. Dan il-permess ġie ikkonfermat ukoll mit-Tribunal ta’ Reviżjoni għall-Ambjent u l-Ippjanar  (EPRT). L-EPRT l-anqas ma qabel li joħroġ ordni biex ma jsirx xogħol fuq is-sit sakemm jinqata’ l-appell. Riżultat ta’ hekk, il-lukanda li issa tilfet il-permess għax dan ġie mħassar mill-Qorti tal-Appell hi issa lesta u mibnija! Ser ikunu meħtieġa alterazzjonijiet sostanzjali u probabbilment partijiet minn dik li hi lukanda jkollhom jitwaqqgħu minħabba li dan l-iżvilupp ibbenefika minn bonus ta’ żewġ sulari extra li jingħataw għall-iżvilupp tal-lukandi! Jiġifieri dawn kellhom żieda ta’ żewġ sulari fuq dak li hu normali f’dawn iż-żoni! Dawn iż-żewġ sulari ma’ jistgħux ikunu approvati f’ċirkustanzi oħra. GħaIhekk ikollhom jaqgħu!

Dan kollu juri kemm hu possibli li bir-regoli tal-ippjanar tal-lum (anke jekk hemm bosta difetti fihom) xorta hu possibli li wieħed jasal għal deċiżjonijiet raġjonevoli kif uriet il-Qorti tal-Appell!  Ovvjament id-deċiżjonijiet ikunu raġjonevoli jekk dawk li jeħduhom ikun kapaci li jimxu mar-regoli dejjem.

L-ippjanar għall-użu tal-art hu għan-nies. Kif qed nagħtu każ tan-nies fl-ippjanar għall-użu tal-art li għandna? Jekk insegwu l-kazijiet diversi hekk kif dawn jiżviluppaw, hu ċar li dawk li huma maħtura biex jassiguraw li l-affarijiet jimxu sewwa, fl-interess tan-nies u tal-kwalità tal-ħajja tagħhom, qed iħarbtu kollox. Dan hu ċar meta wieħed jara d-diversi deċiżjonijiet tal-Qorti,mhux biss dawk li nsemmi hawn fuq, imma bosta oħra ukoll.

Huwa dan li jeħtieġ li jkun indirizzat minn riforma tal-proċess tal-ippjanar għall-użu tal-art. Jeħtieġ nassiguraw li dawk li jieħdu d-deċiżjonijiet ikunu nies kapaċi jiddeċiedu sewwa: konsistenti u skond ir-regoli fis-seħħ. X’nambuhom ir-regoli jekk b’mod konsistenti jiġu injorati?

Din hi r-riforma meħtieġa fl-ippjanar għall-użu tal-art.

Reforming the Planning Authority

Prime Minister Robert Abela, during his May Day speech, hinted that he will embark on a land use planning reform. His speech was very scant on details. It was however clearly an exercise in damage control after the Labour Party has faced sharp criticism from two of its own Mayors, one of whom (Christian Zammit – Xagħra Mayor) has quit the party in disgust. The other, Conrad Borg Manché, Gżira Mayor, soldiers on. His hand has been strengthened as a result of the Gżira Court case win against the Lands Authority and its decision to reduce the size of the Gżira public garden to make way for a fuel station.

The Labour Party is, as always, running with the hares and simultaneously hunting with the hounds. Party Leader Robert Abela lauds his “environmentalist” mayors. Others within the Labour Party hierarchy, however, are busy defending those who are making their life miserable.

The problem with the Planning Authority is that basically it is ignoring its own policies which it is stretching well beyond any elastic limit. Only this week, for this very reason, the Court of Appeal has cancelled two land use planning decisions.

Residents, and some local councils, are up in arms against all sorts of decisions being taken by the Planning Authority. The permit relative to the Mistra Village re-development was originally issued by the Planning Authority in 2013 for a 12-floor high-rise development. The renewal of the development permit was contested by residents on the grounds of its incompatibility with currently existing planning policies. The Environment Planning Review Tribunal (EPRT) shot down the residents’ appeal but the Court of Appeal thought otherwise and sent the case back to the drawing board. The Court of Appeal has pointed out that the EPRT had not examined adequately the applicable planning policies to ascertain or otherwise the residents’ claims.

In view of this Court of Appeal decision it is pertinent to ask as to why those taking planning decisions continuously ignore planning policies? Some years back it was the Ombudsman himself who had arrived at a similar conclusion.

This is not a one-off case.

Last Wednesday the Court of Appeal delivered another decision relative to a development in Mellieħa and accepted the Mellieħa Local Councl’s appeal to cancel a development permit for a hotel with related amenities in an area where the local plan forbids hotel development, except in extraordinary circumstances. This eight-floor hotel is linked to the extensive commercial interests of Gozitan construction magnate Joseph Portelli.

The original written recommendation for a refusal of the application was overturned by the Planning Commission. The development permission wassubsequently confirmed by the EPRT. The EPRT also refused to issue an order to halt construction until the planning appeal is determined. As a result, the hotel whose permit has now been repealed is now completed! It will have to be extensively altered and possibly parts of it will now have to be demolished as the constructed hotel even benefitted from an additional two-floor bonus over and above the prevailing permissible height! These two floors are not permissible in other circumstances and will then have to be demolished.

All this proves that even on the basis of existing planning policies (which need substantial improvement) one can arrive at reasonable decisions as clearly demonstrated by the Court of Appeal, if only those running the show are capable of strictly observing the rules.

Land use planning is for people.  How are people and their needs factored in our land use planning? Following the various land use planning cases as they develop, it is clear that land use planning is hijacked by those appointed to run the show. This is crystal clear when one examines the different decisions of the Court of Appeal. This refers not just to the decisions referred to above, but to many others too!

This is what a reform of the planning process should address: ensuring that the land use planning decision takers are capable of taking decisions which are both consistent and in line with existing policy. What do we need policy for if it is consistently ignored?

This is the reform required in land use planning.

Il-MEPA u l-froġa tal-Mistra Village

Il-Kummissarju tal-Ambjent u l-Ippjanar David Pace f’rapport li ġie ippubblikat il-bierah it-Tnejn 2 ta’ Diċembru 2013 fi ftit kliem jgħid li l-permessi għall-iżvilupp mill-ġdid tal-Mistra Village huma froġa oħra tal-MEPA. Dan jagħmlu wara li mexxa investigazzjoni fuq talba ta’ Din l-Art Ħelwa.

Il-frejjeġ fil-MEPA li kienu jsiru taħt Lawrence Gonzi, George Pullicino u Mario Demarco għadhom qed isiru taħt Joseph Muscat u Michael Farrugia.

Hu ġustifikat, jgħidilna l-Kummissarju tal-Ambjent u l-Ippjanar, li l-permessi għall-iżvilupp tal-Mistra Village jkunu irtirati.

Ir-rapport li tistgħu taqrawh fuq is-sit elettroniku ta’ Din l-Art Ħelwa jagħti raġunijiet dettaljati biex jispjega għaliex il-Kummissarju David Pace wasal għal din il-konklużjoni. Ir-rapport jispjega xi tħalla barra fil-konsiderazzjonijiet li għamel id-Direttorat tal-Ippjanar u jgħid li l-Bord tal-MEPA kien iggwidat ħażin mill-Major Projects Unit tal-istess MEPA. Il-Bord tal-MEPA ngħata informazzjoni nieqsa u informazzjoni żbaljata.

F’pajjiż ċivilizzat il-Bord tal-MEPA kien jirreżenja en bloc wara deċiżjoni bħal din.

Darba waħda hekk kien sar meta l-Perit Joseph Falzon kien ħareġ rapport dwar il-permess abbużiv tal-LIDL ta’ Ħal-Safi fuq talba għal investigazzjoni li dakinnhar kienet saret minn Alternattiva Demokratika . Dakinnhar 6 minn 7 membri tal-Kummissjoni għall-Kontroll ta’ l-Iżvilupp li approvat il-permess kienu irriżenjaw lejlet l-elezzjoni ġenerali tal-2008.

Ma nafx kemm il-wieħed jew waħda mill-membri tal-Bord tal-MEPA għandhom il-kuraġġ li jammettu li għamlu żball u li għandhom iħallsu tiegħu billi jirreżenjaw.

MEPA: from bad to worse

Government acting through MEPA is playing to the interests of property developers and speculators. This was stated by a group of environmental NGOs who decided to act together in voicing their concern. The eNGOs are Din l-Art Ħelwa, Flimkien għal Ambjent Aħjar, Birdlife Malta, Friends of the Earth Malta, Moviment Graffiti, Greenhouse Malta, Malta Organic Agricutural Movement, Nature Trust Malta and Ramblers’ Association.

There is nothing new in stating that government is in cahoots with property developers and speculatiors. The new element is that it is much more obvious that it ever was. MEPA in fact is functioning worse than it ever did in its 21 year history.

And we have seen nothing yet. It will get worse .

The recent approval of the redevelopment of the Mistra Village site is a case in point.  In addition to its being a blot on the landscape the approved project consisting of 774 residential units [yes its seven hundred and seventy four] as well as 1,800 square metres of retail area [including a supermarket] spread in 6 rectangual blocks of various heights up to and including 13 floors.  The traffic load on an area already bursting at the seams will be enormous.

In fact, Transport Malta  had initially objected to the project as it was considered that the situation would inevitably develop from bad to worse.

Transport Malta has however had second thoughts and withdrew its objections.  FAA is on record as commenting that “In dropping its objection, Transport Malta insults local residents by claiming that the traffic situation is already so bad that adding heavy construction vehicles and another 1,500 cars to the area will not make a difference.”

This signifies that Transport Malta will now go back to its archives and reconsider the development of the TEN-T road network in the area. All the options have already been discussed and all of them will create even more probelms.  One proposal signifies cutting through the Miżieb aquifer. Other proposals pose serious threats to Manikata, the agricultural community in L-Imbordin as well as being a threat to the Simar Nature Reserve.

This is what MEPA’s decisions are leading to.  It will get worse soon.

Having nine NGOs voicing their concern together on the above and more is a good step. Their protest in Valletta’s streets on the 30th November 2013 deserves everyone’s support.

Il-permess tal-Mistra Village: ftit riflessjonijiet

L-approvazzjoni għall-ħruġ ta’ permess finali biex dak li kien il-Mistra Village ikun żviluppat m’hu xejn ġdid. Bħalu kellna u ser ikollna bil-gzuz.

Imma hemm numru ta’ affarijiet li ġraw li ta’ min jaħseb ftit dwarhom.

L-ewwel nett insellem lil Simone Mizzi minn Din l-Art Ħelwa u Astrid Vella minn Flimkien għal Ambjent Aħjar li ippresentaw il-każ f’isem is-soċjeta’ ċivili. Li ma rnexxilhomx jikkonvinċu maġġoranza tal-membri tal-Bord tal-MEPA mhux tort tagħhom. L-approvazzjoni tal-permess hi kaġun tal-fatt li l-maġġoranza tal-membri tal-Bord tal-MEPA jaħsbuha b’mod differenti.

Kien hemm wieħed mill-membri tal-Bord li ddejjaq bil-kummenti li kienu għaddejjin u ħin minnhom żbroffa u qal li kulħadd irid jifhem li l-Bord tal-MEPA kif kostitwit illum għandu fuq spallejh obbligi li jirriżultaw mid-deċiżjonijiet tal-Bord ta’ qabel.

Issa huwa veru li kien hemm outline permit, jiġifieri permess fil-prinċipju. Imma hu veru ukoll li fil-passat kien hemm ċirkustanzi li fihom il-Bord tal-MEPA xorta ma approvax permess ta’ żvilupp minkejja l-eżistenza ta’ outline permit. Hekk kien ġara fil-każ ta’ żvilupp mill-ġdid (redevelopment) tal-fabbrika tas-7 Up f’Santa Venera. Minkejja l-outline permit il-Bord tal-MEPA dakinnhar immexxi minn Austin Walker kien irrifjuta li joħroġ permess ta’ żvilupp.

Punt ieħor huma l-veduti li jikkuntrastaw fi ħdan il-PN. Ir-rapprezentant tal-Partit Nazzjonalista fuq il-Bord tal-MEPA ippropona li l-iżvilupp propost jitnaqqas u dan biex jonqos l-impatt fuq ir-residenti. Dan jikkuntrasta mal-presenza tal-President tal-PN Dr Ann Fenech fil-kwalita’ tagħha ta’ konsulent legali tal-iżviluppaturi mill-Kuwait. Mhux biċċa tiegħi min ikunu l-konsulenti legali tal-iżviluppaturi. Imma huwa importanti li ninnotaw li President tal-Eżekuttiv tal-PN  xejn ma iddejqet li tagħti messaġġ li jikkuntrasta b’mod negattiv mal-posizzjoni li ħa r-rappresentant tal-grupp Parlamentari Nazzjonalista fuq il-Bord tal-MEPA.

Dan iġibni għall-aħħar osservazzjoni. Iż-żewġ partiti fil-Parlament, il-Partit Nazzjonalista u l-Partit Laburista, it-tnejn li huma, kull wieħed bil-mod tiegħu, fittxew li jaġevolaw l-industrija tal-bini.

Tul is-snin il-PN ipprova jitħabbeb maż-żewġ naħat, kemm mal-industrija tal-bini kif ukoll mal-ambjentalisti. Ir-riżultat hu li m’għandu kredibilita’ ma ħadd għax ma tistax togħġob lil kulħadd.

Il-Labour hu iktar ċar: l-industrija tal-bini għalih hi mutur importanti għall-ekonomija. U ħalef li jagħtiha l-għajnuna kollha possibli. Hekk qed jagħmel. Qed jimxi ma dak li wiegħed.  Il-permess tal-Mistra Village hu wieħed li bħalu għad irridu naraw ħafna oħra.

Nipprotestaw? Iva mela le.  Huwa tajjeb li nuru li ma naqblux ma dawn id-deċiżjonijiet. Imma kien ikun aħjar li iktar nies fehmu x’wegħdu l-PN u l-Labour qabel l-elezzjoni ġenerali. Kieku forsi kien ikun hemm bżonn ta’ inqas protesti.

Imma għal bosta dan it-tip ta’ “żvilupp” ma kienx konsiderazzjoni importanti qabel l-elezzjoni! Huwa biss issa li qed jirrealizzaw li wara kollox dan il-bini b’mod goff ser jeffettwalhom il-kwalita’ ta’ ħajjithom.

Imma issa l-froġa lesta.

Mistra Village : Addio l-Politika favur Żvilupp Sostenibbli ?

 

 

 

Il-ħruġ tal-permess ghall-izvilupp tas-sit ta’ dak li kien il-Mistra Village fuq l-għolja tax-Xemxija f’San Pawl il-Bahar hi prova, jekk qatt kien hemm bżonn, ta’ kemm il-ħidma tal-MEPA hi ta’ ħsara kontinwa. 

Meta hawn ‘il fuq minn 53,000 residenza vojta, pajjiżna m’għandux bżonn il-bini ta’ iktar progetti enormi u massiċċi bħal dan biex jiġi żviluppat mill-ġdid is-sit tal-MIstra Village u floku jinħolqu 868 unit residenzjali. Ma hemmx ħtieġa ta’ dan il-progett ħlief għall-industrija tal-bini biex tibqa’ tiġġustifika l-eżistenza tagħha innifisha,Ż

vilupp massiv bħal dan johloq preċedent perikoluż għal żvilupp simili. Wasal iż-żmien li jiġi dikjarat moratorju fuq proġetti kbar residenzjali.

 

F’Novembru li għadda AD ippreżentat petizzjoni b’mijiet ta’ firem lill-Kummissjoni Ewropea dwar dan il-kaz. AD giet infurmata mill-Kummissjoni Ewropea (DG Ambjent) li qed tistudja l-każ u li qegħdha f’kuntatt mal-Gvern Malti għal kjarifiki dwar dan il-progett.

 

B’dan it-tip ta’ permessi nistaqsi : x’sar minnha l-politika tal-Gvern li ser jinkuragixxi l-iżvilupp sostenibbli. Kif sejrin jiġu mħarsa l-generazzjonijiet futuri b’dan it-tip ta’ proġett ?

 

Mistra Village – Il-MEPA bdiet titghallem ?

Dal-ghodu mort il-MEPA biex insegwi applikazzjoni (PA 5538/04) dwar l-izvilupp mill-gdid tal-Mistra Village. Talabni Arnold Cassola biex nipprezenta it-thassib tar-residenti tax-Xemxija f’San Pawl il-Bahar, u in partikolari dawk ta’ Triq Caterina Vitale, dwar dan l-izvilupp massiv.

Meta bdiet tigi diskussa l-applikazzjoni il-Bord tal-MEPA “skopra” li l-EPS (Environmental Planning Statement) ma kienx preciz ghax l-impatt tar-rih madwar il-blokki ta’ bini propost ma kienx jirreferi ghall-ahhar pjanti !

B’solennita kbira konsiderazzjoni tal-applikazzjoni giet posposta halli l-EPS ikun aggornat u dwaru issir konsultazzjoni estensiva.

Jidher li l-MEPA bdiet titghallem ftit. Hasra li daqsxejn tard, ghax kieku kien ikollna hafna decizjonijiet differenti matul is-snin.
