It-Times online u l-Independent online huma u jirrappurtaw id-diskors ta’ dalgħodu ta’ Robert Abela jirreferu għal laqgħa li Robert Abela qal li kellu ma’ Maġistrat.

L-Independent tgħid hekk: He said that he had the occasion to speak to a magistrate, who told him that the legal framework permits them to give low or high punishments. But, the magistrate said that when they give a high punishment, even though the law allows it, “they appeal and the chances are that the Court of Appeal would reduce the punishment as there are policies or past judgements that militate that punishments not be that high.”

It-Times tgħid hekk: He said that over the past few days he met a magistrate who told him that whenever a tough punishment was handed down, the sentence was inevitably watered down on appeal, with the appeals court citing caselaw.

Newsbook min-naħa l-oħra irrapporta hekk: Hu qal li din il-ġimgħa tkellem ma’ Maġistrat li stqarret miegħu li meta jingħataw pieni ħorox, il-Qorti tal-Appell tnaqqas din il-piena.

Dan il-kumment tal-Prim Ministru Robert Abela jeħtieġ spjegazzjoni immedjata għax hu inkwetanti ħafna. Minn meta l-hawn il-Prim Ministru jiltaqa’ ma’ Maġistrat u jitkellem dwar is-sentenzi? L-affarijiet mhumiex ċari u huma inkwetanti ħafna meta politiku jiltaqa’ ma’ membru tal-ġudikatura.

Min hu jew min hi l-Maġistrat ma nafx imma naħseb li l-Prim Imħallef għandu jara daqsxejn x’ġara.

Anke l-President tar-Repubblika li fost l-inkarigi tiegħu imexxi l-Kummissjoni għall-Amministrazzjoni tal-Ġustizzja għandu l-obbligu li jindaga mingħajr dewmien.

Stephen Calleja : canvassing the PN

 

 

In todays editors blog, in the Malta Independent, Stephen Calleja deemed it fit to write a blogpost entitled A vote for AD is a vote for Labour.

A vote for AD is a vote cast in favour of ADs principles. As things stand it is also a vote against both the PL and the PN.

Has Mr Calleja ever considered what a vote for the PN means?

Stephen Calleja has every right to canvass the PN. I do not seek to deny him such a basic right. When exercising such a right he may consider it superfluous to inquire about the Hon. Claudio Grechs statement that he did not recollect ever meeting George Farrugia, of oil scandal fame. Searching for reasonable explanations and possibly the underlying truth does not seem to bother Mr Calleja the journalist.

He could also inquire deeper into the Capital One Investments Limited and maybe bother to ask whether as a minimum, the Hon Beppe Fenech Adamis judgement in accepting a directorship of the Company was a grave error of judgement.   

Mr Calleja could examine Mario de Marcos legal assistance to the db Group while Deputy Leader  for Parliamentary Affairs of the PN Parlimentary Group. In so doing he may recollect that Dr de Marco had stated that he had sought Dr Simon Busuttils second opinion on whether he should take up the brief with Dr Busuttil not finding any difficulty at all.

Of course, any inquisitive journalist would go one step further and seek an explanation as to what the term conflict of interest means. A Member of Parliaments duty on all sides of the House essentially entails holding the government to account. This definitely includes scrutinising the executives actions in negotiations relative to the transfer of property in public ownership.

When any Member of Parliament does not understand the above, it is serious enough. But having both the Leader of the Opposition and his Deputy without any clue on the matter, certainly says quite a lot about the ethical standards of the Opposition. If these are the ethical standards of the next government I do not think that there will be any change at the helm. It will be simply more of the same.

I could go on and on. I have limited myself to the PNs compromised leadership, as currently it is the most effective canvasser of the Labour Party.

Mr Calleja has every right to ignore all this when he canvasses the PN, but then doesnt that say a lot about his standards and values?

One final point. AD held exploratory talks with the PN during which talks, the above and more were referred to.  The proposals made by AD were aimed to create a functioning coalition which would not be burdened by the accumulated sins of the PN. That no progress was made is certainly not ADs fault. Given the right conditions, AD was willing to participate in a coalition but it never accepted to be tagged as anybodys appendage.

Il-bieraħ quddiem il-Bord tal-MEPA bdiet tiġi diskussa l-applikazzjoni dwar il-pompa tal-petrol fil-Magħtab. Id-diskussjoni kella issir xi ġimgħat ilu, imma kienet posposta minħabba proċeduri fil-Qorti mir-residenti għax ir-rapport li kien ikkonkluda sa dakinnhar id-Direttorat tal-Ippjanar kien qed jinjora l-fatt li l-Pjan Lokali kellu policy li ż-żona fejn kienet proposta l-pompa tal-petrol kien jirriżervaha bħala Category 2 Rural Settlement.

Meta  bdiet id-diskussjoni ma saret l-ebda referenza għal din l-istess policy mill-esperti u professuri li ppreżentaw power points elaborati f’isem l-iżviluppatur u f’isem il-MEPA. Kien hemm minnhom min qalilna biss li l-policy ma tapplikax u waqaf hemm. Ħadd ma indenja ruħu jispjega għaliex.

Iffaċċjati b’dan jiena flimkien mal-persuni l-oħra li f’isem ir-residenti konna qed nippreżentaw il-każ kontra l-proposta ta’ żvilupp tal-pompa spjegajna għaliex il-policy fil-Pjan Lokali kellha tiġi applikata.

Jiena spjegajt għaliex skond il-Pjan Lokali l-permess għall-pompa tal-petrol ma setax joħroġ. Ha nikkwota dak li irrapporta Kevin Schembri Orland fl-Independent :

“He delivered a brief presentation against the project. “The central issue, which seems to have been missing from most presentations given, is that the site forms part of Rural settlement Category 2 (Policy CG04 in the Central Malta Local Plan). If some basic research was conducted, one would see that wall to wall with the site, there is an application refused as it forms part of Rural Settlement Category 2, and this was also confirmed in the appeal of that case. “This is basic information which you must take into consideration”. “Looking at CG04, it specifies what can be built in a rural settlement, and a petrol station is not one of the developments allowed under this policy” Cacopardo read from MEPA policy and said that the aim of this designation as a Category 2 Rural Settlement is to prevent further development of incompatible uses in the area, due to the disorganized state of the settlement. He said that since this is part of a rural settlement, this Board has its hands tied and cannot allow another use that conflicts with policy CGO4.”

Wara li konna spiċċajna nippreżentaw il-każ f’isem ir-residenti, l-esperti li kien hemm bdew iwieġbu xi punti. L-Independent jirrapporta hekk dwar dak li ġara :

“Mr Cacopardo, as well as residents in the area, had been arguing that a particular policy was not taken into consideration. After residents made these arguments, the representative of the Planning Directorate argued that it was considered, and began making his arguments. At this point, Carmel Cacopardo stood up asked why none of these reasons were included in the DPAR report and accused him of professional disloyalty for not including these arguments in their documents.”

Id-Direttorat tal-Ippjanar  għandu l-obbligu li jispjega b’mod ċar u eżatt il-posizzjoni dwar kull applikazzjoni li tkun qed tiġi ikkunsidrata. Irrispettivament xi tkun l-opinjoni professjonali tal-uffiċjali tad-Direttorat għandhom l-obbligu li ma joqgħodux iduru mal-lewża jew li jevitaw xi argument. Imma sfortunatament spiss qed jagħmlu dan.  Għalhekk għidt li dan kien każ ta’ slealta.

Il-MEPA permezz tad-Direttorat tal-Ippjanar għandha l-obbligu li tiskuża ruħha mar-residenti tal-Magħtab.

Qed isiru diversi laqgħat minn esponenti tal-Gvern mal-korpi kostitwiti bl-iskop li jiddiskutu miżuri li għandhom ikunu kkunsidrati fil-Budget li ġej, ġimgħatejn oħra.

F’laqgħa li l-Prim Ministru Joseph Muscat kellu l-bieraħ mal-MHRA (l-Assoċjazzjoni Maltija għal-Lukandi u r-Restoranti) il-Prim Ministru hu rappurtat mill-Malta Independent li qal li ma jistax ikollok lukanda ta’ sitt stilel imbagħad ambjent ta’ tlett stilel madwarha.

Inews ikkwota lill-Prim Ministru jgħid hekk: “meta jiżdiedu t-turisti donnu ż-żibel ma jinġabarx u din issa se tkun fuq l-aġenda”.

Billi kellu lil Winston Zahra (President tal-MHRA) quddiemu, u lil Edward Zammit Lewis Ministru tat-Turiżmu ħdejh kien ikun għaqli kieku l-Prim Ministru staqsihom ftit biex jgħidulu x’jagħmlu r-ristoranti bl-iskart li jiġġeneraw, primarjament fiż-żoni turistiċi.

Seta staqsihom jekk hux veru li dawn fil-liċenzja tagħhom li toħrog l-Awtorità Maltija tat-Turiżmu (MTA) għandhom kundizzjoni li teħtieġilhom li jkollhom kuntratt ma’ operatur privat tal-iskart (li jħallsuh huma) li jieħu ħsieb jiġbor l-iskart li huma jkunu ġġeneraw u jiddisponi minnu.

Dan l-obbligu li għandhom is-sidien tar-restoranti qiegħed jiġi onorat? 

Il-Ministru tat-Turiżmu naħseb li jaf li l-MTA f’diversi lokalitajiet m’hiex tinforza din il-kundizzjoni tal-liċenzja. Minflok  l-iskart iġġenerat qed jispiċċa fit-toroq, piz żejjed fuq il-Kunsilli Lokali. Tajjeb hekk Joseph? Dan m’huwiex servizz ta’ tlett stilel mis-settur privat. Għax l-anqas jikkwalifika għal stilla waħda.

Joseph jekk irid jista’ jdur dawra għall-għarrieda u jkun jista’ jara b’għajnejh. Forsi l-ħmar ma jibqax iwaħħal f’dembu. Imbagħad naraw min jara l-istilel.

Għax qabel ma jigglorifika lis-settur privat ikun aħjar kieku Joseph jara li dawn jerfgħu r-responsabbiltajiet tagħhom.

 

 

 

Tonio Borg: his nomination and Malta’s reputation

Stephen Calleja heads the editorial team at Standard Publications, publishers of the Malta Independent as well the The Malta Independent on Sunday.

He considers himself to be “independent” so much that he did not bat an eyelid in accepting to present a TV discussion programme on the PN political TV station NET TV: l-Iswed fuq l-Abjad. Its independence can be attested by considering his choice of speakers and his myopic consideration of the  issues discussed.

In today’s edition of the Independent on Sunday Mr Calleja speaks of “restoring Malta’s reputation” when discussing the consideration by the EU institutions of Tonio Borg’s nomination as John Dalli’s successor on the EU Commission.

Calleja’s point is that The Green’s criticism of Tonio Borg’s nomination and credentials will tarnish Malta’s reputation.

It seems that those defending Tonio Borg’s nomination, including Mr Calleja, consider that he has only one positive point, that he is Maltese and they expect all to rally behind this nomination on the basis of his nationality.

Calleja fails to give due weight that Tonio Borg has destroyed his own candidacy by his utterances and actions as a Minister. His actions on immigration  when he supported Berlusoni’s agreement with Gaddafi’s Libya to send back immigrants to Libya to be tortured is compounded by the 2002 Eritrean refugee mishap documented by Amnesty International amd UNHCR. Tonio Borg as Malta’s Minister for the Interior  was responsible for sending back Eritrean immigrants. Some were tortured others disappeared.

Tonio Borg’s utterances against tenancy rights of same sex couples during the rent reform debate in Malta’s Parliament may have been forgotten by Stephen Calleja.  Calleja may even consider as unimportant the fact that Tonio Borg defied the referendum result and opposed divorce legislation.

In view of Tonio Borg’s record as pointed out above I do not consider that his nomination was the appropriate one.

When Lawrence Gonzi, notwithstanding the above decided to proceed with Tonio Borg’s nomination he was gambling Malta’ reputation.  He should have nominated someone else. There are plenty of suitable candidates amongst Malta’s  404,000 population.

It is on Lawrence Gonzi’s doorstep that Stephen Calleja should direct his criticism. But obviously, as he is “independent” he will find considerable difficulty in doing so.
