Il-kontabilità tal-banek għall-ħsara ambjentali

Meta niddibattu l-ħsara ambjentali li qed tiżdied kontinwament madwarna nagħmlu tajjeb li nippuntaw subgħajna lejn ir-regolaturi nkompetenti u lejn ir-regħba tal-hekk imsejħa żviluppaturi. Wasal iż-żmien li ma dawn inżidu l-banek, għax huma l-banek li jiffanzjaw il-proġetti ta’ żvilupp u allura huma jagħmlu din il-ħsara possibli. Anke l-banek, għaldaqstant għandhom l-obbligu li jerfgħu ir-responsabbiltà fuq spallejhom għall-ħsara ambjentali li qed isseħħ: huma qed jiffinanzjawha.

Meta neżaminaw ir-rapporti annwali tal-banek lokali ewlenin hu ċar li dawn huma nteressati biss fil- profitti. Kontinwament taparsi jħossu għall ambjent. Dan jagħmluh biss u esklussivament biex jipproteġu r-reputazzjoni tagħhom.

Il-banek ipinġu lilhom infushom bħala li qegħdin hemm biex ikunu ta’ għajnuna. Regolarment iroxxu ftit flus favur numru ta’ kawżi ġusti. Iżda minkejja din is-sensittività  artifiċjali lejn setturi diversi tal-komunità, il-profitt jibqa’ dejjem prijorità fuq il-lejaltà lejn in-nies u lejn il-komunità.

L-attitudni tagħhom lejn proġetti ta’ żvilupp hi indikattiva ta’ dan. Il-banek rarament jindikaw fl-istqarrijiet pubbliċi inkella fir-rapporti tagħhom jekk u kif jagħtu każ ta’ impatti ambjentali u soċjali meta jkunu qed jikkunsidraw li jgħinu biex ikun iffinanzjat xi proġett ta’ żvilupp.  

Fl-aħħar rapport annwali tiegħu, per eżempju, l-HSBC jirreferi għal dawk li jissejħu Equator Principles. Dawn l-Equator Principles huma sett ta’ kriterji miftehma fuq skala internazzjonali bejn banek u istituzzjonijiet finanzjarji. Huma qafas regolatorju volontarju dwar kif l-istituzzjonijiet finanzjarji għandhom jeżaminaw u jagħtu piz lir-riskji soċjali u ambjentali assoċjati ma’ proġetti li jkunu quddiemhom għall-finanzjament.  Jistabilixxu l-kriterji minimi li għandhom ikunu applikati huma u jittieħdu deċiżjonijiet dwar dawn ir-riskji.  Fost affarijiet oħra, dawn l-Equator Principles jitkellmu dwar kif il-banek u l-istituzzjonijiet finanzjarji għandhom jiddjalogaw mal-utenti (stakeholders) dwar azzjoni effettiva biex ikunu ndirizzati ir-riskji ambjentali u soċjali minn proġetti li jkunu quddiemhom għall-finanzjament.

L-HSBC, sal-lum, ma ippubblikax rapporti jew xi tip ta’ informazzjoni oħra dwar il-mod prattiku kif il-bank qed japplika dawn il-prinċipji f’Malta. Għad irridu naraw kif il-bank qed jassigura ruħu li r-riskji ambjentali u soċjali ġew identifikati u ndirizzati u speċifikament kif il-klijenti żviluppaturi tal-bank qed jiddjalogaw mal-utenti (stakeholders).

Fir-rapport annwali tal-Bank of Valletta, min-naħa l-oħra, insibu spjegazzjoni tal-miri tal-Ġnus Magħquda dwar l-iżvilupp sostenibbli, deskrizzjoni dwar il-kawżi ġusti appoġġjati mill-bank u rendikont tal-azzjoni mittieħda biex il-friegħi tal-bank ikunu effiċjenti fl-użu tal-enerġija u joperaw b’mod li ma jagħmlux ħsara ambjentali. Ir-rapport jiddeskrivi ukoll is-servizzi tal-bank biex il-klijenti tiegħu ikollhom aċċess aħjar għal finanzi biex jimplementaw diversi miżuri ambjentali. Ir-rapport tal-BoV ma jagħmel l-ebda referenza għall-Equator Principles jew xi qafas regolatorju alternattiv.

Il-Lombard Bank, min-naħa l-oħra, fl-aħħar rapport annwali tiegħu jemfasizza l-attenzjoni tal-management biex jimminimizza l-impatti ambjentali mill-operazzjonijiet tiegħu. Jgħidilna li hu ukoll jgħin kawżi ġusti! L-anqas il-Lombard Bank ma jirreferi għall- Equator Principles jew xi linji gwida oħra dwar x’għandu jsir biex il-klijenti żviluppaturi jkunu sorveljati aħjar mill-bank.

Fuq livell ta’ Unjoni Ewropeja il-Bank Ċentrali Ewropew għadu kif approva dokument b’linja gwida dwar ir-riskji klimatiċi u ambjentali li hu applikabbli għas-settur bankarju kollu fl-Unjoni minn din is-sena. Primarjament dan id-dokument jirrigwarda ir-riskji klimatiċi.

Il-banek għandhom responsabbiltà li jassiguraw illi meta jiffinanzjaw proġetti ta’ żvilupp, il-finanzi li jipprovdu ma jkunux użati biex issir jew biex tkun aċċelerata ħsara ambjentali u/jew soċjali. Meta din il-ħsara ambjentali u/jew soċjali sseħħ, ir-responsabbilta m’għandiex tintrefa biss mill-iżviluppatur u mir-regolaturi imma ukoll mill-bank. Għax anke l-bank għandu jkun kontabbli. Wara kollox hu l-bank permezz tal-finanzjament li jipprovdi li jagħmel l-iżvilupp possibli. Kull meta l-banek ikunu kompliċi fi ħsara ambjentali u/jew soċjali ikollhom huma wkoll jerfgħu r-responsabbiltà. Mingħajr l-involviment tagħhom, wara kollox, il-ħsara ma isseħħx!

Il-PN jgħatti x-xemx bl-għarbiel ?

Il-Partit Nazzjonalista ippubblika l-proposti tiegħu dwar l-ambjent fi ktejjeb intitolat  : A Better Quality of Life for You.  Dan hu bla dubju pass ‘il quddiem, kienu x’kienu r-raġunijiet li wassluh għal dan il-pass.

Fid-daħla għad-dokument ippubblikat, il-Kap tal-Opposizzjoni jagħmel dikjarazzjoni importanti. Jgħid: “Bnejna l-istituzzjonijiet u b’mod ġenerali fassalna politika tajba – imma bosta drabi ma assigurajniex li din tkun implimentata, inkella qgħadna nduru mal-lewża u ħloqna wisq eċċezzjonijiet.”

Dan, fil-fehma tiegħi ifisser, li, wara kollox,  hu ċar għal kulħadd li mhux biss hu meħtieġ li tfassal il-politika t-tajba, imma li huwa essenzjali ukoll li l-istituzzjonijiet li jkunu fdati bl-implimentazzjoni ta’ din il-politika jkunu f’posizzjoni li jistgħu jwettqu r-responsabbiltajiet tagħhom. Għax kif jistgħu jiffunzjonaw dawn l-istituzzjonijiet jekk f’posizzjonijiet ta’ tmexxija kruċjali jkollhom persuni partiġjani jew persuni ta’ fiduċja tal-Ministru, flok persuni mħarrġa u teknikament kompetenti?

Wara kollox, it-twettieq tal-politika ambjentali jiddependi fuq tmexxija tajba (good governance) li ilha nieqsa mill-istituzzjonijiet għal perjodu mhux żgħir.

X’jiswa’ li jkollok il-politika tajba dwar l-ippjanar għall-użu tal-art biex imbagħad il-Gvern immexxi mill-PN iċedi għall-pressjoni tal-spekulaturi tal-art meta mexxa ‘l quddiem proposta imsejħa skema dwar ir-razzjonalizzazzjoni li permezz tagħha l-limiti tal-iżvilupp ġew estiżi b’mod orizzontali?  Biex tkompli tgħaqqadha, fl-istess ħin, il-PN fil-Gvern estenda ukoll il-limiti tal-iżvilupp f’direzzjoni vertikali. Bħala riżultat ta’ dan, il-PN fil-Gvern injora l-poltika dikjarat tiegħu kif ukoll l-informazzjoni miġbura fid-diversi ċensimenti li kienu juru ċar li l-bini vojt kien qed jiżdied.

Il-politika ambjentali hi intrinsikament marbuta ma diversi oqsma oħra. L-estensjonijiet bl-addoċċ għal-limiti ta’ żvilupp ħolqu ħafna diffikultajiet lil diversi residenti Maltin li jridu jiġġeneraw l-enerġija alternattiva permezz tal-pannelli foto-voltajċi fuq il-bjut. Waqt li l-Ministru responsabbli mill-politika dwar l-enerġija alternattiva kien qed ifittex li jħajjar lin-nies biex jistallaw il-pannelli foto-voltajċi, min-naħa l-oħra l-Ministru għall-Ippjanar tal-Użu tal-Art kien mehdi jilgħab bl-għoli permissibli tal-bini f’diversi lokalitajiet. Kif nistgħu nippjanaw sewwa għal ġenerazzjoni ta’ enerġija alternattiva jekk l-aċċess għax-xemx f’diversi lokalitajiet m’huwiex garantit b’għoli permissibli ta’ bini li ma jinbidilx?

Nitkellmu ukoll dwar il-ħtieġa li nassiguraw titjib fil-kwalitá tal-arja, imma fl-istess ħin ma hemm l-ebda ħeġġa biex ikun indirizzat in-numru ta’ karozzi fit-toroq tagħna li qed jikber b’mod astronomiku. Dawn il-karozzi huma l-kawża ewlenija ta’ kwalitá tal-arja li sejra dejjem għall-agħar, f’uħud mil-lokalitajiet tagħna. Minflok ma nindirizzaw din il-problema reali, gvern wara l-ieħor ipprefera li jagħmilha iktar faċli biex il-karozzi jibqgħu jiddominaw it-toroq tagħna u dan billi jroxxu l-miljuni fi proġetti infrastrutturali għal toroq mhux meħtieġa. Dawn il-proġetti jservu biss biex iżidu l-karozzi fit-toroq, meta l-oġġettiv ta’ gvern serju għandu jkun l-oppost: li dawn jonqsu.

Marbuta ma dan kollu hemm in-nuqqas ta’ attenzjoni lit-trasport pubbliku tul is-snin. Filwaqt li għandna nirrikonoxxu li matul dawn l-aħħar sitta u tletin xahar kien hemm titjib fis-servizz, dan xorta għadu ferm ‘il bogħod minn dak mistenni f’pajjiż żgħir fejn id-distanzi bejn il-lokalitajiet huma minimi. Dan ukoll kien falliment ieħor fit-twettiq ta’ “politika tajba”.

Il-politika ambjentali hi dwar għażliet u deċiżjonijiet. Tul is-snin Alternattiva Demokratika, il-partit ekoloġiku f’Malta, fittex li jqiegħed dawn l-għażliet fuq l-agenda nazzjonali biex il-Maltin ikun f’posizzjoni li jiddeċiedu.

Wara ħafna snin, il-Partit Nazzjonalista stenbaħ għar-realtá ambjentali ta’ madwarna. Waqt li dan, minnu innifsu hu sinjal tajjeb, nistennew li l-PN  jibda l-proċess biex jirrevedi l-bqija tal-politika tiegħu u jġibha konsistenti mal-proposti ambjentali mħabbra. Meta dan iseħħ, forsi nkunu f’posizzjoni li niffurmaw opinjoni dwar jekk il-proposti ambjentali tal-PN humiex frott ta’ konvinzjoni inkella jekk għal darba oħra humiex jippruvaw jgħattu x-xemx bl-għarbiel.

Environmental policy is about political decisions

The Nationalist Party has recently published its proposals for the environment in a document entitled A Better Quality of Life for You. This is a step forward, irrespective of the reasons motivating it.

In the foreword to the published document, the Leader of the Opposition makes a very important declaration. He states: “We built the necessary institutions, and generally put in the right policies – but all too often we did not ensure they were fully implemented, or we circumvented them, and made too many exceptions.”

This signifies a recognition of the fact that, at the end of the day, the real issue is not just the identification of the “right policies”,  but of ensuring that the institutions entrusted to implement them are in a position to carry out their responsibilities. How can these institutions function when key posts are filled with partisan cronies, or so-called “persons of trust” instead of competent technical people?

At the end of the day, the successful implementation of environmental policy is dependent upon a favourable climate of good governance which has been conspicuous by its absence for quite a long time.

What purpose does it serve to have the “right policies” on land use planning when, as a result of pressures from the land speculation lobby, the PN in Government adopted a rationalisation scheme extending the limits of development in a horizontal direction? To make matters worse, simultaneously the PN in government also extended the limits of development in a vertical direction. As a result it ignored both its own sanctimonious declarations as well as the clear indications from data collected and analysed by official bodies that the net result of its actions was a continuous increase in the number of vacant properties.

Environmental policy is intrinsically linked to various other policy areas. The haphazard extensions of the limits to development – the horizontal ones as well as the vertical ones – have, and still are, wreaking havoc on the capacity of Maltese households to generate alternative energy through the placing of photo-voltaic panels on the rooftops of their homes. While the Energy Minister advocates the need to generate alternative energy through the installation of photo-voltaic panels, the Minister responsible for land-use planning has been playing around with flexible permissible building heights in various localities. How can we adequately plan the generation of alternative energy if solar rights are not guaranteed through rigid height limitation regulations?

Similarly, we speak of the need to ensure an improvement in air quality but simultaneously there is a reluctance to address the spiralling number of cars on our roads – the major contributor to poor air quality in a number of areas. Instead of addressing the matter head-on, successive governments have sought to make it easier for car owners to dominate our roads by sprinkling millions of euros on the unnecessary development of the road infrastructure. In my view, such developments are unnecessary, as the end result will be a further increase in the number of cars when the real and only solution is an immediate reduction.

Linked to all this is the lack of importance given to public transport. While acknowledging that there has been an improvement in the use of public transport during the past 36 months, this is still considerably way off what it should be in a small country where distances between localities are minimal. This, too, is a failure to implement the “right policies”.

Environment policy is about making choices and taking decisions – some of which may be difficult and contentious. Over the years, it has been the objective of Alternattiva Demokratika, the Green Party in Malta, to place these choices on the national agenda so that our citizens are in a position to consider them and decide.

After many years, the Nationalist Party has woken up to the environmental realities around us. While this is positive, I await the revision of the PN’s other policies, which are inconsistent with their environmental proposals. When that happens, we may be able to form a definite opinion as to whether the publication by the Nationalist Party of its environment proposals is for real, or else another green-washing exercise in which matter the Nationalist Party has accumulated considerable experience.

Thoughts for an Environmental Policy

The government has published a number of policy documents for public consultation. Two deal with different aspects of water policy while a third deals with issues for a National Environment Policy.

Also of relevance is an Ernst & Young Report commissioned by the Malta Environment and Planning Authority on a 2008 Public Attitudes Survey. It is dated April 2010. Although recently published I do not recollect reading anything in the press about this survey. One of the conclusions of this survey should be an eye opener to policy makers as to the central importance which the Maltese public attaches to the environment.

In the 2008 Public Attitudes Survey it was concluded that 69 per cent of respondents held the view that the environment was as important as the economy. On the other hand 23 per cent of respondents considered that the environment was more important than the economy while only eight per cent considered the economy as being of overriding importance.

To my mind these are significant conclusions contrasting with current national policy which considers that the economy has an ­overriding priority over the environment. The Maltese public thinks otherwise: 92 per cent of respondents of the Mepa Public Attitudes Survey have understood that the economy should not be an overriding consideration in environmental policy formulation. Now this is what sustainable development is all about.

Contrary to what green-washers imply, being committed to sustainable development does not mean that one seeks to balance or mitigate environmental, social and cultural impacts of economic development. Sustainable development speaks another language altogether for which unfortunately there is still a lack of translators. Real commitment to sustainable development conveys the message that humankind does not own the earth. It shares the earth with other species together with which it forms part of one eco-system.

The way in which our society has evolved and is organised is such that it considers human activity as meriting overriding importance. In fact it is often stated that policies are anthropocentric. Both PN and PL environmental policies can be grouped in this category. AD together with other Green parties around the globe differs as it follows a eco-centric path. But then the ecology has no vote!

Sustainable development properly construed considers the need of an eco-centric environmental policy. This signifies that a holistic approach is applied through which impacts on the whole eco-system are considered.

Now this is completely different from the manner in which our society is accustomed to look at itself. An eco-centric approach leads us to take a long term view in contrast to the short-sighted view of our immediate interests. This does not only impact land use but also waste management, agriculture and fishing, light pollution, acoustic pollution, air quality, water resources, mineral deposits, transport policy, the protection of our ecological heritage and many other areas.

When one considers the above I cannot understand why the authors of the National Environment Policy Issues Paper ignored the National Sustainable Development Strategy when formulating the Issues Paper for public consultation. They considered the 2008 State of the Environment Report and the Parliamentary debate which ensued together with the Ernst & Young report above quoted as the basis for a discussion.

In so doing they ignored completely a consultation process spanning a number of years which answered most of the questions which the Issues Paper poses.

This is surely not a new way of doing politics. It is a way with which most of us are familiar as it does away with past achievements and seeks to start a fresh page, ignoring everything and everyone. Knowing that at least one of the drafters of the National Environment Policy Issues Paper was actively involved in the process leading to the National Sustainability Strategy, I must ask the obvious question: Is the Issues Paper the first step towards the scrapping of the National Sustainability Strategy?

The current Bill before Parliament which seeks to consolidate existing legislation on land use planning and the environment removes all references to the National Sustainable Development Commission. It was stated repeatedly that a separate legislative measure will be proposed dealing with issues of sustainable development. Yet to date this is nowhere in sight. Does this confirm that there have been second thoughts on the National Sustainability Strategy?

The Strategy should currently be in the process of implementation. Section 5 of the Strategy entitled “The Way Ahead” provides that ministers have to produce action plans for the implementation of the National Sustainable Development Strategy in their portfolio within 18 months from the adoption of the strategy.

The strategy was adopted by Cabinet more than 18 moons ago yet the action plans are nowhere in sight.

I have never had any doubt that this government is being consistent with its beliefs: it says one thing, but when push comes to shove it proceeds with doing something else.
