Edward Scicluna u l-bajtar tax-xewk

Iktar kmieni din il-ġimgħa, l-President tal-Kummissjoni tal-Unjoni Ewropea, Ursula von der Leyen, ippreżentat lill-Parlament Ewropew pjan ta’ €750 biljun biex inqumu fuq saqajna. Pjan li jista’ jiġġenera investiment stmat €3.1 triljun fl-ekonomija Ewropea. Permezz ta’ għotjiet flimkien ma’ self, il-Kummissjoni Ewropea qed tfittex li tegħleb l-impatti ekonomiċi negattivi tal-Covid-19 kif ukoll li tagħti bidu għall-azzjoni meħtieġa biex ikun implimentat il-Ftehim l-Aħdar (the Green Deal).

It-triq biex nirkupraw mhiex faċli. Mhux il-każ li mmorru lura għal kif konna. Dak spiċċa. Irridu nimxu l-quddiem lejn normal ġdid. Li nintegraw flimkien il-ħidma biex nirkupraw mill-impatti tal-pandemija flimkien mal-azzjoni meħtieġa dwar it-tibdil fil-klima mhux ser tkun faċli imma hi essenzjali u mhux possibli li tkun posposta. Kif ġie emfasizzat fuq Euroactive nhar l-Erbgħa, it-triq biex nirkupraw tiddependi minn ħafna kundizzjonijiet konnessi mal-ambjent. 25 fil-mija tal-finanzjament propost mill-Kummissjoni Ewropeja hu fil-fatt marbut ma’ ħidma klimatika.

Edward Scicluna, il-Ministru tal-Finanzi, fl-ewwel reazzjoni tiegħu għall-pjan tal-Kummissjoni ikkummenta mħasseb dwar miżuri prattiċi konnessi mal-klima. Bħala gżira ser inweġġgħu ħafna qal, jekk jindirizzaw l-emissjonijiet tal-ajruplani u l-vapuri. Il-pjan, qal Edward Scicluna, jixbah lill-bajtar tax-xewk. Scicluna jippreferi li ma jsir xejn ħlief paroli. L-anqas m’hu jieħu pjaċir b’dak li qed jingħad dwar it-tassazzjoni tal-kumpaniji, avolja konxju li m’għadx baqa’ żmien biex fl-Unjoni Ewropea tħajjar kumpaniji jibqgħu jħarbu l-obbligi tagħhom tal-ħlas tat-taxxi.

Hu korrett li jingħad li ser nintlaqtu bil-miżuri dwar il-klima. Hekk għandu jkun, għax il-ħidma tagħna għandha impatt fuq il-klima. Nistgħu imma ninnegozjaw biex dawn l-impatti fuqna jonqsu mingħajr ma nnaqqsu l-impenn (reali) tagħna biex ikunu indirizzati l-impatti klimatiċi tal-industrija tal-avjazzjoni u tal-vapuri. Bla ebda dubju dan ser ikun ifisser impatti sostanzjali kemm fuq it-turiżmu kif ukoll fuq il-kummerċ.

Dan ma jistax ikun evitat għax dawn l-industriji għandhom l-obbligu li huma ukoll jġorru fuq spallejhom l-impatti li qed jikkawżaw. Dak hu li wegħdna bħala pajjiż fis-Summit ta’ Pariġi dwar il-klima. Wasal il-waqt li nwettqu dak li ġie imwiegħed. Biex niġu fuq saqajna irridu nfasslu l-futur mill-ġdid. Il-ħsara li teħtieg li tissewwa mhiex biss dik ekonomika u ambjentali. Jinħtieġ li tul l-Unjoni Ewropea kollha nibnu s-solidarjetà fuq pedamenti sodi. Dak li Edward Scicluna jqis bħala l-bajtar tax-xewk huma fil-fatt l-għodda bażiċi tas-solidarjetà.

Għax is-solidarjetà hi meħtieġa mhux biss meta aħna bir-raġun kollu nokorbu ma’ kull mewġa ta’ immigranti fl-ibħra Maltin. Is-solidarjetà hi dak li Malta tinjora meta tfittex li tkun attraenti għal min irid jevadi t-taxxi f’pajjiżu: dawk li jħallsu ftit lill-kaxxa ta’ Malta biex jevitaw milli jħallsu l-biljuni band’oħra. Il-politika dwar l-armonizzazzjoni tat-tassazzjoni fl-Unjoni Ewropea hi r-risposta bis-sens għall-politika li tinkoraġixxi l-evażjoni tat-taxxa f’Malta, l-Olanda, il-Lussimburgu u l-Irlanda.

L-Oxfam f’rapport ippubblikat fl-2019 u ntitolat “Off the Hook. How the EU is about to whitewash the world’s worst tax havens” temfasizza li “l-Irlanda, il-Lussimburgu, Malta u l-Olanda huma fost il-pajjiżi li l-iktar jinkoraġixxu l-evażjoni tat-taxxa fid-dinja, b’mod li jagħmluha possibli li kumpaniji kbar jirnexxielhom iħallsu ammont żgħir ta’ taxxa. Per eżempju, ir-regoli internazzjonali tat-taxxa jippermettu lill-Vodafone Group Plc biex jallokkaw kważi 40 fil-mija tal-profitti taxxabbli tagħhom f’Malta u l-Lussimburgu.”

Rajna ukoll rapporti dwar il-BASF, ġgant fl-industrija kimika fil-Ġermanja, li jispjegaw kif din tevadi t-taxxa. Fir-rapport tal-Ħodor Ewropej ippubblikat fl-2016, intitolat “Toxic Tax Deals. When BASF’s Tax Structure is more about style than substance” kien spjegat kif il-BASF irnexxiela tevadi madwar biljun euro f’taxxa, u minflok ħallset ammonti żgħar bil-kompliċità ta’ Gvernijiet Maltin: ħomor u blu.

Jeħtieġ li l-ewwel u qabel kollox nirkupraw l-imġieba etika tagħna, anke qabel ma nirkupraw ekonomikament u ambjentalment. Ir-riġenerazzjoni tal-valuri tagħna għandha tkun prijorità qabel ma nippruvaw insewwu l-kaxxa ta’ Malta li minnha, bħalissa ħerġin il-flus maħmuġin akkumulati mill-bejgħ tal-passaporti. Flejjes miġburin minn persuni bħall-biljunarju Russu Boris Mints, l-Eġizzjan Mustafa Abdel Wadood, il-biljunarju Ċiniż Liu Zhongtian, in-negozjant Russu Pavel Melenikov u l-Iżraeli Anatoly Hurgin, li irnexxielhom jiżgiċċaw minn eżami suppost rigoruż u ngħataw iċ-ċittadinanza Maltija: però xorta spiċċaw għaddejjin proċeduri kriminali f’diversi pajjiżi oħra primarjament dwar frodi u ħasil tal-flus!

F’dan iż-żmien ta’ ħtieġa l-Ministru tal-Finanzi Edward Scicluna spiċċa dipendenti fuq flejjes li oriġinaw minn dawn is-sorsi maħmuġin. Ma tkunx esaġerazzjoni li ngħid li spiċċa dipendenti minn flus li oriġinaw mill-kriminalità.

Fir-reazzjonijiet tagħha għall-proposti tal-Kummissjoni tal-Unjoni Ewropea Evelyne Huytebroech, waħda miż-żewġ mexxejja tal-Partit tal-Ħodor Ewropej, emfasizzat li din il-proposta flimkien ma dik tal-Parlament Ewropew u l-proposta Franco-Tedeska ilkoll qed jaraw proċess ta’ self komuni. Dan hu pass il-quddiem għas-solidarjetà Ewropea. Għax is-solidarjetà tinbena bil-mod u bit-tbatija. Imma għal Edward Scicluna dan kollu bajtar tax-xewk!

The recovery plan and Edward Scicluna’s prickly pears

Earlier this week, EU Commission President Ursula von der Leyen, presented for the consideration of the European Parliament a recovery plan worth €750 billion but which can unleash an investment estimated at €3.1 trillion in the EU economy. Through a combination of loans and grants the EU Commission seeks to integrate the reversal of the economic downturn resulting from the Covid-19 pandemic together with the action required to implement the Green Deal.

The road to recovery will be tough. It is not the case of going back to normal but of going forward to a new normal. Integrating the recovery from the pandemic impacts with climate change action will not be easy but it is essential and cannot be postponed. As emphasised by Euroactive on Wednesday, the road to recovery has plenty of green strings attached. 25 per cent of the funding proposed by the EU Commission is in fact earmarked for climate action.

Finance Minister Edward Scicluna, in his first reaction to the recovery plan, voiced concern on practical climate action measures. It hurts, he says, to address air traffic emissions or shipping pollution. As an island this would impact us substantially. The proposed recovery plan is comparable to prickly pears, he stated. He prefers the status quo: all talk and little walk. Edward Scicluna is not amused by rumblings heard on corporate taxation even though he is well aware that the days of attracting corporations seeking tax havens within the EU may well be numbered.

It is correct to state that we will be impacted substantially. We can however negotiate to reduce such impacts without diminishing our commitment to addressing climate change impacts of the airline and shipping industry. This would mean significant impacts on tourism and trade. These however cannot be avoided as climate change impacts have to be internalised: that is they have to be shouldered by the industries generating them. This is what we promised in the Paris Climate Summit. Promises that we must now honour.

Operation recovery must re-design the future. It must not be just an economic recovery or an environmental rebirth. It must also be a recovery of practical solidarity all over the Union. What Edward Scicluna views as prickly pears are in fact instruments of solidarity.

Solidarity is not just what we rightly cry for when immigrants crash through our borders. Solidarity is what we ignore when Malta insists on being attractive to tax evaders: those who pay peanuts to the Maltese exchequer in order to avoid paying billions elsewhere. The issue of tax harmonisation on an EU level is the sensible response to the tax haven fiscal policies of Malta, the Netherlands, Luxembourg, and Ireland.

Oxfam in its 2019 report entitled “Off the Hook. How the EU is about to whitewash the world’s worst tax havens” emphasises that “Ireland, Luxembourg, Malta and the Netherlands are among the most significant tax havens in the world, enabling some of the biggest corporations to pay minimal amounts of tax. For example, currently, international tax rules allow Vodafone Group Plc to allocate nearly 40% of its taxable profits to Malta and Luxembourg.” We have also seen reports on BASF clearly explaining how the German chemical giant avoids paying taxes due. The European Greens report “Toxic Tax Deals. When BASF’s Tax Structure is more about style than substance” published in 2016 had outlined how BASF had successfully avoided close to a billion euros in tax, paying just a small amount thanks to Maltese governments blue and red.

The recovery must be primarily ethical before being economic and environmental. Regenerating our values should be a priority higher on the list than the regeneration of our coffers, currently dishing out dirty money originating from the sale of citizenship schemes. Monies collected from the likes of Russian billionaire Boris Mints, Egyptian national Mustafa Abdel Wadood, Chinese billionaire Liu Zhongtian, Russian businessman Pavel Melenikov and Israeli Anatoly Hurgin, who slipped through what is described as a rigorous due diligence process and gain Maltese citizenship only to be prosecuted in different jurisdictions for various crimes primarily fraud and money laundering.

It is indeed telling that in time of need Finance Minister Edward Scicluna is dependent on monies originating from such dubious sources! It would not be an exaggeration to state that he is dependent on the proceeds of crime.

In her reaction to the EU Commission proposals Evelyne Huytebroech co-Chair of the European Greens emphasised that the EU Commission’s proposal together with the proposals of the EU Parliament and the Franco-German initiative all foresee a mutualised debt instrument: a major breakthrough for European solidarity. Solidarity is constructed slowly and painfully, while Edward Scicluna juggles with his prickly pears.

Is-Solidarjetà mhiex għażla, iżda obbligu

Iktar kmieni din il-ġimgħa, Evarist Bartolo, il-Ministru għall-Affarijiet Barranin, b’wiċċ ta’ qdusija artifiċjali, iddikjara fuq it-televiżjoni li kien iddiskuta fit-tul il-kriżi tal-immigrazzjoni li qed tiżviluppa fl-ibħra Maltin mal-Kummissjoni Ewropea, mal-Vatikan u ma uffiċjali mlaħħqin tal-aġenzija tal-Ġnus Magħquda dwar ir-Refuġjati (UNHCR). Ilkoll kienu tal-fehma, qal, li Malta għandha raġun.

Evarist Bartolo qed jipprova jagħti l-impressjoni falza li l-għeluq tal-portijiet Maltin għall-NGOs biex ikunu jistgħu jisbarkaw l-immigranti meħlusa mill-għarqa fl-ibħra ta’ madwarna li qed jiżviluppaw f’ċimiterju hi aċċettabbli u jew raġjonevoli għall-komunità internazzjonali. Il-verità hi ferm differenti minn hekk.

Il-Ħodor, kemm f’Malta kif ukoll fl-Unjoni Ewropea, repetutament emfasizzaw li Malta ma tistax titħalla terfa’ waħedha dawn l-obbligi ta’ salvataġġ. Dan ġie emfasizzat din il-ġimgħa stess fi stqarrija konġunta bejn il-Partit tal-Ħodor Ewropej (EGP) u Alternattiva Demokratika. Is-solidarjetà fjakka jew ineżistenti ma tħassarx l-obbligi ta’ Malta fiż-żona ta’ salvataġġ li hi responsabbli għaliha fil-Mediterran ċentrali.

Hi tabilħaqq sfortuna li tul is-snin, Malta, repetutament ippruvat taħrab mir-responsabbiltajiet tagħha. Ilkoll niftakru meta l-PN fil-Gvern wasal fi ftehim mal-Gvern immexxi minn Silvio Berlusconi fl-Italja biex il-qawwiet tal-baħar Taljani jimbuttaw lura d-dgħajjes mgħobbija bl-immigranti li jkunu telqu mill-kosta Libjana.

Iktar qrib fiż-żmien il-Gvern immexxi minn Joseph Muscat wasal f’xi forma ta’ ftehim sigriet imma mhux miktub (safejn hu magħruf) li permezz tiegħu il-Gvern Taljan immexxi minn Matteo Renzi b’mod li ma waslux iktar immigranti f’Malta għal perjodu twil.

Imbagħad hemm il-każ ta’ Neville Gafà, il-mibgħut speċjali tal-Prim Ministru Joseph Muscat u l-laqgħat li hu kellu ma’ Haithem Tajouri mexxej tal-brigati rivoluzzjonarji ta’ Tripli. Tajouri, mid-dehra viċin ħafna tal-Gvern ta’ Joseph Muscat jissemma f’rapport ta’ ‘l fuq minn 200 paġna tal-Ġnus Magħquda liema rapport hu dwar ksur ta’diversi drittijiet tal-bniedem. Skond l-istess rapport Tajouri hu responsabbli ukoll għal ċentru privat ta’ detenzjoni fejn jinżammu ħafna nies.

Fl-istampa lokali kien ġie rappurtat ukoll li kien hemm laqgħat fil-Libja bejn Neville Gafà, l-mibgħut speċjali tal-Prim Ministru, Joseph Muscat, u uffiċjali għoljin tal-Gvern Libjan. F’dawn il-laqgħat, li għalihom attenda Kurunell mill-Forzi Armati ta’ Malta ġew diskussi l-mezzi li kellhom jintużaw biex iwaqqfu l-immigrazzjoni. L-ismijiet u r-ritratti ta’ dawk presenti kienu ġew ippubblikati.

Dan m’għadux effettiv għax illum jidher li nbidlet l-istrateġija u jeħtieġilna li niffaċċjaw allegazzjonijiet serji fil-konfront tal-Forzi Armati ta’ Malta dwar sabutaġġ tal-opri tal-baħar użati minn dawk li qed ifittxu l-ażil. Qed ikun allegat li s-suldati/baħrin tal-patrol boat P52 qatgħu l-cable tal-mutur li bih kienet għaddejja l-opra tal-baħar b’mod li ħallihom bejn sema’ u ilma fiż-żona ta’ tiftix li hi responsabbiltà ta’ Malta.

Prosit lill-NGO Repubblika li qed tinsisti li issir investigazzjoni kriminali dwar dan l-inċident biex jiġi stabilit eżattament x’ġara u min huwa responsabbli għalih. Kont nistenna li kellu jkun il-Kmandant tal-Forzi Armati minn rajh li jagħti bidu għall-investigazzjoni hekk kif saru dawk li s’issa għadhom allegazzjonijiet. Ma kellux joqgħod jistenna li jkun ħaddieħor li jinsisti li dan isir.

Il-proposta riċenti tal-Ministru Bartolo biex l-Unjoni Ewropeja tgħin lil-Libja b’mod li ittaffilha l-piz umanitarju li qed iġġorr bħalissa kif ukoll biex ikun iffaċilitat li l-komunità internazzjonali tkun tista’ tipprovdi l-għajnuna tant meħtieġa kemm lir-refuġjati kif ukoll lil-Libjani infushom hi pass il-quddiem. Imma tajjeb li jkun ċar illi minkejja d-diffikultajiet kollha fil-Libja nnifisha dan diġa qed isir.

Fil-fatt mill-2014 sal-lum l-Unjoni Ewropeja diġa ħarget għajnuna umanitarja ta’ madwar €50 miljun indirizzata lejn il-Libja.

Sfortunatament la hemm rieda u l-anqas aptit għal soluzzjoni Ewropea fost il-Gvernijiet tal-Unjoni Ewropeja u dan minkejja li erbgħa fost l-ikbar pajjiżi tal-unjoni (il-Ġermanja, Franza, Spanja u l-Italja), xi ġranet ilu ħadu inizjattiva biex il-migrazzjoni tirritorna fuq l-aġenda.

Naħseb li lkoll napprezzaw li s-sitwazzjoni hi waħda diffiċli. Imma anke f’dawn iċ-ċirkustanzi kulħadd għandu jerfa’ r-responsabbiltajiet tiegħu.

Il-Gvern Malti għandu jibdel ir-rotta u flok ma jibqa’ kontinwament ifittex li jipprova jaħrab mir-responsabbiltajiet tiegħu ifittex li jaħdem id f’id mal-NGOs li qed isalvaw il-ħajjiet b’mod li qed jagħmlu ħidma li messha qed issir mill-Gvernijiet. Li jkun hemm min jipprova jimita lil mexxej lemini Matteo Salvini biex ikunu kkriminalizzati l-NGOs iservi biss biex tkompli tixtered il-mibgħeda imżejna b’lingwaġġ taparsi patrijottiku.

Hemm il-ħtieġa li l-Gvern Malti jifhem li s-solidarjetà mhiex għażla, imma dmir.

Solidarity is not an option but a duty

Earlier this week, Foreign Minister Evarist Bartolo sanctimoniously declared on TV that he had discussed at length the immigration crisis in Maltese waters with the EU Commission, with the Vatican and with senior officers of UNHCR. All agreed, he said, that Malta was in the right.

Mr Bartolo is trying to create a false perception that the closure of Maltese ports to NGOs disembarking immigrants saved from being engulfed in the cemetery developing around us is reasonable and acceptable to the international community. He cannot be more distant from the truth.

Greens, both in Malta and in the EU, have repeatedly emphasised that Malta cannot shoulder its “save and rescue responsibilities” on its own. This was emphasised as recently as this week in a joint statement between the European Green Party and Alternattiva Demokratika. However, inadequate or at times inexistent solidarity from EU member states does not absolve Malta of its international responsibilities from coordinating safety and rescue operations within its area of responsibility in the central Mediterranean.

It is indeed unfortunate that over the years Malta has repeatedly tried to wriggle out of its responsibilities. We do remember when the PN led government arrived at an agreement with the Berlusconi administration in Italy in order that the Italian navy pushes back all departing boats carrying immigrants along the Libyan coast.

Closer in time the Joseph Muscat administration is known to have arrived at some sort of secret but unwritten agreement with the then Renzi led government in Italy such that the arrival of immigrants in Malta trickled down to zero.

What about Neville Gafà, then special envoy of Prime Minister Joseph Muscat and his meetings with Libyan militia leader Haithem Tajouri of the Tripoli Revolutionary brigades? Tajouri, apparently a close acquaintance of the Muscat led government was singled out in a United Nations report for a number of human rights breaches. He is also, according to the same report, responsible for the running of a private detention centre where many are held in captivity.

It was also reported in the press that at a point in time Neville Gafà, envoy of the Prime Minister had accompanied the Maltese Colonel in charge of AFM Operations at high level meetings in Libya to stem immigration. Photographs and names were published.

Apparently this is no longer effective as we now have to face serious allegations of AFM personnel sabotaging rubber boats carrying asylum seekers in Maltese waters. It is being alleged that the crew of patrol boat P52 cut the cable of the motor driving the rubber boat carrying the asylum seekers leaving them adrift in the Maltese search and rescue area. Hats off to NGO Repubblika for filing criminal complaints. I would have expected the Commander of the Armed Forces to initiate an investigation himself without the need for any prompting, as soon as the allegations surfaced.

The recent proposal of Minister Bartolo for the EU to engage with Libya in order to lessen its humanitarian burden and enable the international community to provide much-needed assistance to both refugees and the Libyan people is positive. It is however to be underlined that this is already being done notwithstanding the difficult circumstances within Libya itself.

The EU has in fact disbursed around €50 million in humanitarian aid utilised in Libya since 2014.

Unfortunately there is no will among EU governments for an EU solution even though the four largest EU countries (Germany, France, Spain and Italy), a couple of days ago, have taken steps to push the migration issue back onto the EU agenda.

Everyone recognises that the situation is very difficult. Everyone must however shoulder their responsibilities.

The Maltese government should change tack and instead of constantly seeking ways to wriggle out of its responsibilities actively develop a close collaboration with those NGOs who have volunteered to deploy their own rescue missions to save lives, thereby filling in the gaps left by the EU states. Aping Italian right-wing leader Matteo Salvini in criminalising NGOs only serves to further encourage pseudo-patriotic vitriol.

It is about time that the Maltese Government recognises that solidarity is not an option but a duty.

The budget: beyond the €s

Liza Minelli’s song “Money makes the world go round” is the underlying theme of the Budget speech delivered by Finance Minister in Parliament last Monday. The message driven home was that money and the accompanying affluence clearly indicate that we have never had it so good and that handouts to all are not a problem, both to those who need them, and, more importantly to those who don’t.

Today, taxation is a dirty word in our political lexicon: hence, it was suggested that the message that no increases in existent taxes or new taxes have been proposed is a positive one by the Honourable Minister. Handouts are for all, almost. First for those in need, secondly for most of the rest. The dictum “from each according to his means, to each according to his needs” no longer has any significance when trying to understand the political philosophy underlying the budget of this “labour” government.

Taxation collected in Malta apparently only has some significance when taxing foreign companies operating outside Maltese territory but having some small office, or just a letterbox, on this rock. This is done so that they can avail themselves of reduced taxation rates, substantially lower that those payable in the countries where they operate.

Similarly, companies operating in the financial services sector benefit from a tax package which offers them substantial savings on their tax bills in order to entice them to set up shop.

The government thinks it is smart, but all it is doing is encouraging tax avoidance. Malta’s message is clear: those who want to avoid tax in their country are welcome as long as they are prepared to pay a small part of the taxes avoided to the Maltese exchequer.

In this respect, the case study entitled “Toxic Tax Deals. When BASF’s Tax Structure is more about style than substance” published by the Green Group in the European Parliament around two years ago is indicative. In that study, it was concluded that BASF, the German chemical giant with its headquarters in Ludwigshafen, used mismatches in national tax systems in order to avoid paying its taxes. It is estimated that, over a five-year period spanning 2010 to 2014, BASF avoided the payment of close to one billion euros in taxes, paying instead a small amount of the taxes avoided, in gratitude for this wonderful opportunity made possible by the Maltese governments, blue and red.

In this context the Finance Minister’s declaration against tax evasion, tax avoidance and money laundering is deemed mere rhetoric. It has to be viewed in the context of the Panama Papers saga, as well as the established fact that a Cabinet Minister and the Chief of Staff in the Office of the Prime Minister set up companies in Panama, a tax haven, and no punitive action was taken against them. With this background, the Minister’s sanctimonious declaration is in no way credible.

The Budget proposals strengthen the social safety net as it assists the vulnerable financially. However, the quality of life is not measured solely by financial metrics. The Budget has various green gaps that affect our quality of life.

The welfare of cars assumes an importance over human quality of life, as government considers it is important to widen and improve roads in order to facilitate the passage of cars, thereby aiming at reducing congestion. An inverted sense of logic: reduction of the number of cars on our roads should have been the target as that is the real and actual problem. Widening roads and improving road infrastructure with flyovers and underpasses only serves to grow the number of cars on our roads, thereby increasing the problem. Providing and facilitating alternative transport is the only solution. Paying lip service to alternative means of transport but simultaneously financing an exponential
increase of the problem signifies that we still have to learn the ABC of transport policy.

The government’s own transport master-plan places considerable emphasis on the need to reduce cars from our roads but it seems that the government is not interested.

Therefore, we have a government which is more interested in the welfare of cars than in our quality of life.

This is just one example. There are countless of others.

The Budget loses an opportunity to make a lasting difference in a number of areas important for our quality of life that goes beyond finances.

Fl-Unjoni Ewropeja : l-immigrazzjoni problema tagħna lkoll?

Mistiedna fi Franza tal-President Francois Hollande diversi mexxejja Soċjalisti ta’ Gvernijiet fl-Unjoni Ewropeja qed jaqblu li l-immigrazzjoni għandha tingħata iktar importanza.

Qalulna ukoll li l-operazzjoni Mare Nostrum immexxija mill-Gvern Taljan għandha tgħaddi f’idejn il-Frontex. Il-Gvern Malti jaqbel ma dan u ser jagħti l-appoġġ kollu tiegħu. Li kieku jseħħ hekk ikun tajjeb. Issa jekk dan isirx jew le ma nafx. Imma anke’ jekk isir, il-proċess ta’ salvataġġ huwa biss parti żgħira minn dak li għandu jsir. Wara li l-immigranti jkunu salvati x’ser jiġri? Hemm qegħda l-problema l-kbira. Dwaha ma hemmx qbil. Min irid il-push-backs u min ma jrid jagħmel xejn.

Issa ħa nkun ċar: jidher li hemm qbil minn Jean Claude Junker li l-Kummissjoni Ewropeja immexxija minnu tagħti prijorita’ lill-immigrazzjoni. M’għandix dubju li ser jipprova  jagħmel hekk. Fid-diskussjoni issemmiet il-ħtieġa ta’ politika olistika dwar l-immigrazzjoni. Junker wiegħed ukoll li ser jeżamina l-proposta tal-Ħodor għall-bdil fir-regoli ta’ Dublin.

Imma biex jittieħdu d-deċiżjonijiet meħtieġa huma l-Gvernijiet li jridu jiċċaqalqu u mhux il-Kummissjoni Ewropeja biss. Il-Kummissjoni tul is-snin għamlet bosta proposti. Iżda l-passi l-quddiem kienu ftit u bil-mod.

Il-laqgħa ta’ Pariġu hi pass tajjeb. Iżda xi tfisser fil-fatt għad irridu naraw meta niġu għad-deċiżjonijiet. Pariġi kienu presenti rappreżentanti minn 10 pajjiżi, meta fl-Unjoni Ewropeja hemm 28 pajjiż! Kif jaħsbuha it-18-il pajjiż l-ieħor?

Fil-passat kemm il-Gvernijiet immexxija mis-Soċjalisti kif ukoll dawk immexxija mid-Demokristjani jew mill-Liberali dejjem qagħdu lura milli jaċċettaw li l-immigrazzjoni hi problema tal-pajjiżi kollha fl-Unjoni Ewropeja, u mhux biss ta’ dawk fuq il-fruntiera. Jekk is-Soċjalisti hux ser jibdlu it-triq għad irridu naraw.

Meta kienu Malta f’Mejju li għadda kemm Martin Schultz kif ukoll Jean Claude Junker tkellmu b’mod li jpoġġihom viċin ħafna tal-posizzjoni tal-Ħodor fil-Parlament Ewropew.

Jekk dak kienx tejatrin, għad irridu naraw.

Digital Rights and Responsibilities

 

The Greens in the European Parliament are at the forefront of the fight for digital rights. We helped stop the Anti-Counterfeit Trade Agreement (ACTA) and we are fighting for strong protection of personal data, for the right to privacy and for strict net neutrality. Now it is time to defend and protect both European citizens and the internet from pervasive corporate and governmental surveillance and to safeguard fundamental rights in the digital age. Personal data belongs to individual citizens, not to companies or governments. Privacy must be respected. The data retention law, which obliges telecom providers to store data about whom citizens communicate with, is a serious mistake and must be abolished.*   Governments have to abide by their own laws. Whilst national security is important, personal freedoms and liberties must not be overridden. Governments must ensure that national security agencies work for all citizens to secure freedom and liberty for everybody. (EGP 2014 Manifesto section entitled  : A Digital Bill of Rights).

The European Green Party 2014 Manifesto proposes the setting up of a European Renewable Energy Community: Trade policy should support a sustainable industrial renaissancein Europe and show respect and solidarity for our global partners. One project of particular relevance in this context will be creating a European Renewable Energy Community to help break our addiction to fossil fuels. (EGP 2014 Manifesto section entitled  : Renaissance of Industry for a Sustainable  Europe)

The Council of the European Greens meeting in Malmö Sweden in October 2009 approved a resolution on the European Renewable Energy Community, in brief ERENE. Renewable sources are the only viable sources of sustainable energy, says the title of the resolution.

The existing community for cooperation on energy, the Euratom, is unsustainable and obsolete. The current framework for energy policies in Europe is an obstacle for increased cooperation in this field.

Climate change mitigation implies the reduction of greenhouse gases in Europe in the order of 90% by 2050.

Whilst in 2009 only 11% of the energy generated in Europe was renewable energy it is recognised that the economic potential for renewable energy in Europe greatly exceeds the expected use of electricity in 2050.

There are great differences in national potential for renewable energy. As a consequence, cooperation on the development and deployment of renewable energy and energy systems in Europe is crucial to an enhanced production and use of renewable energy.

Vast investments are needed to realize the potential.

Never been so close

The interventions in the local debate on immigration by Martin Schulz and Jean Claude Junker have moved both the PN and the PL closer to the AD position as well as closer to each other.

Both the PN and the PL have in the past supported pushbacks. They may blush about it when they are reminded. Fortunately they have now moved closer to upholding European values in immigration policy too.

The influx of immigrants in their thousands has transformed the Mediterranean Sea into a cemetery: a human tragedy developing around us. So many human lives are being lost. Each life lost is testimony to a failure which can only be addressed if we urgently put our heads together and come up with a long term solution.

Immigration through EU borders is not and should not be dealt with as an issue to be dealt with by the border states alone. Due to their geographic position the border states act on behalf of the whole Union. Immigration is a responsibility of all the member states of the European Union. The matter has been on the EU agenda for some years, even though some have been reluctant to handle it. Martin Schultz and Jean Claude Junker together with Green candidates José Bové and Ska Keller have focused on it a number of times in their speeches. Not only in Malta. In fact it cropped up in the Firenze Presidential debate last week too.

Being on the EU agenda means that all the political forces in Malta have succeeded in sensitising their sister parties in Europe on the matter. This has not only meant that the matter is now on the agenda but more so that the PN and the PL have identified more acceptable positions.

Would it be too much to desire the formulation of a national immigration policy which is truly national, that is, one owned by one and all. Whilst there are still a number of differences, it is about time that we recognise that the three main political parties have never been so close on immigration.

Ix-xahar li għadda l-Qorti Ewropeja tal-Ġustizzja (ECJ) ħassret Direttiva tal-Unjoni Ewopeja (Data Retention Directive) li kienet tippermetti l-ħażna u l-użu ta’ data elettronika personali mill-awtoritajiet fl-istati membri. Dan l-ECJ għamlitu wara li kienet mitluba mill-għola Qrati fl-Irlanda u l-Awstrija biex teżamina din id-Direttiva minħabba numru ta’ kawżi dwar dan li kienu pendenti f’dawk il-pajjiżi.

Id-dinja diġitali hi l-fruntiera l-ġdida tad-drittijiet tagħna. Id-Direttiva imħassra (Data Retention Directive) kienet tagħti aċċess faċli għad-data diġitali personali kemm lill-Gvernijiet kif ukoll lill-Korporazzjonijiet. Il-Qorti Ewropeja tal-Ġustizzja fil-fatt qalet li, kif imfassla, din id-Direttiva tiġġenera is-sensazzjoni li l-ħajja personali tagħna hi taħt sorveljanza kontinwa.

Minħabba d-dipendenza tagħna fuq it-teknolġija diġitali kif applikata, per eżempju, fit-telefonija kif ukoll bl-użu kontinwu tal-internet, kull wieħed minna jħalli warajh traċċi kontinwi ta’ informazzjoni diġitali ta’ natura privata li jekk isir abbuż minna tista’ isservi ta’ theddida kontinwa għall-privatezza tagħna. Permezz tal-mobiles inħallu, per eżempju traċċi diġitali ta’ kull fejn inkunu f’kull ħin. Anke fuq l-internet, kif nafu ilkoll, inħallu warajna ħafna informazzjoni dwarna infusna. Ħafna minn din l-informazzjoni tista’ ma tfisser xejn, imma inħallu warajna ukoll, xi drabi bla ma nafu ħafna informazzjoni privata sensittiva. Min irid jabbuża minn din l-informazzjoni fil-fatt għandu fejn jixxala.

Ovvjament din it-tip ta’ informazzjoni jista’ jkollha użu importanti fil-ġlieda kontra l-kriminalita’. Imma daqskemm hi utli fil-ġlieda kontra l-kriminalita, daqstant ieħor tista’ issir ħsara jekk din l-informazzjoni, essenzjalment ta’ natura privata tiġi f’idejn u tintuża minn min m’għandux jedd għaliha.

Anke’ meta l-istat qiegħed jiġġieled kontra l-kriminalita’ m’għandu l-ebda jedd li jinjora d-drittijiet tagħna. F’kuntest diġitali l-iktar li jsir emfasi hu fuq il-privatezza tad-data kif ukoll li s-sidien tad-data huma n-nies individwali. Dan ifisser li la l-istat u l-anqas il-Korporazzjonijiet m’għandu jkollhom xi jedd assolut fuq informazzjoni diġitali ta’ natura privata. Fi ftit kliem la is-sigurta’ nazzjonali u l-anqas il-kummerċ m’għandhom iservu ta’ skuża biex fid-dinja diġtali jitnaqqru id-drittijiet tagħna.

Huwa essenzjali li f’din l-era diġitali kull ċittadin ikun imħares minn sorveljanza żejda mill-Gvernijiet u l-Korporazzjonijiet. L-informazzjoni personali la hi tal-istat u l-anqas tal-korporazzjonijiet. Għaldaqstant la l-istat u l-anqas il-korporazzjonijiet m’għandu jkollhom drittijiet fuq din l-informazzjoni li hi tagħna u mhux tagħhom.

Alternattva Demokratika u l-Ħodor Ewropej qegħdin fuq quddiem nett f’din il-ġlieda biex id-drittijiet diġitali tagħna jkunu imħarsa.
