Min qed jiġbed l-ispag?

Hemm mistoqsija li bla dubju tberren f’moħħna aħna u nisimgħu jew x’ħin inkunu qed naqraw rapporti dwar ix-xhieda li qed tinġabar il-Qorti in konnessjoni mal-assassinju ta’ Daphne Caruana Galizia. Lil min qed tipproteġi l-pulizija?

Qed joħroġ messaġġ ċar li f’waqtiet partikulari xi uffiċjali tal-Pulizija u l-kriminali li bħalissa qed ikunu investigati kienu id f’id. Naturalment l-uffiċjali in kwistjoni dan jiċħduh. Imma, sfortunatament għal kulħadd, il-kredibilità tagħhom ilha li spiċċat.

Id-deċiżjoni tal-5 t’Ottubru 2018 tal-Qorti Kostituzzjonali dwar Silvio Valletta, dakinnhar Deputat Kummissarju tal-Pulizija, b’kunflitt ta’ interess minħabba r-responsabbiltajiet politiċi ta’ martu Justyne Caruana (politically exposed person) għamlet l-affarijiet ferm agħar. Fl-2018 il-Qorti Kostituzzjonali kienet aċċettat l-argumenti ta’ tal-familja ta’ Daphne Caruana Galizia u ordnat li Silvio Valletta jitbiegħed mill-investigazzjoni dwar l-assassinju.

Fid-dawl tal-allegazzjonijiet kontra id-Deputat Mexxej tal-Partit Laburista Chris Cardona dwar il-possibiltà ta’ ordni separata għall-assassinju ta’ Caruana Galizia, jikber konsiderevolment id-dubju dwar min qiegħed ikun protett mill-Pulizija. Għax kif jista’ jkun li Deputat Kummissarju tal-Pulizija li hu politikament espost jinvestiga politiku ġej mill-istess partit politiku li fih hi attiva martu ukoll Membru tal-Kabinett? Kien fit-8 ta’ Mejju 2016 li din il-gazzetta kienet irrappurtat illi Silvio Valletta kien offrut il-ħatra ta’ Kummissarju tal-Pulizija imma ma aċċettax minħabba li martu Justyne Caruana u l-fatt li “hija Membru tal-Kabinett u persuna prominenti fil-Partit Laburista, seta’ jitfa’ wisq piż u dell fuq l-operat tiegħu kieku aċċetta li jkun fit-tmun tal-Korp.” Dakinnhar iddeċieda tajjeb imma wara insihom id-dellijjiet!

Il-problema tikber konsiderevolment kull meta jissemmgħu dawk li kienu madwar Joseph Muscat, ewlieni fosthom Keith Schembri. Imma hemm oħajn ukoll li kellhom parti importanti fl-iżviluppi ta’ din il-ġimgħa: min jikkonsla u jikkalma u min iwassal il-messaġġi.

Hu magħruf li kemm Chris Cardona kif ukoll Keith Schembri intalbu jwieġbu xi mistoqsijiet mill-Pulizija imma safejn hu magħruf pubblikament s’issa ħadd minnhom mhu qed jiġi investigat.

Jingħad li għad baqa’ informazzjoni sensittiva x’tinkixef.

Irridu nżommu quddiem għajnejna li Daphne kienet stħarrġet u kitbet dwar il-każijiet ta’ korruzzjoni ewlenin fil-pajjiż tul dawn l-aħħar snin, li minnhom ma kellniex ftit. L-atturi xi drabi huma l-istess. Din il-ġimgħa kellna iktar informazzjoni fuq każ kbir. Hu il-kaz tal-Montenegro li stħarrġet it-Times u li minnu irriżulta li 17 Black ta’ Yorgen Fenech daħħlet madwar ħames miljun euro minn fuq dahar l-Enemalta. Min hemm sħab ma Fenech fis-17 Black u s’issa ma jidhirx?

Ix-xhieda fil-Qorti fil-kaz tal-assassinju qed jindikaw il-possibilità li hemm iżjed minn moħħ wiehed wara dan il-qtil. Yorgen Fenech ilu jinsisti li mhux hu l-moħħ iżda li hemm xi ħaddieħor li hu aqwa minnu.

Ma nagħmlux mod li dawn l-idejn moħbija wara l-qtil għandhom interess ukoll fil-qliegħ mill-Montenegro fejn spiċċa jidher Yorgen Fenech għal darba oħra għalihom hux?

Min qed jiġbed l-ispag f’dan kollu? Meta l-Pulizija jagħmlu investigazzjoni iktar fil-fond forsi jkollna ħjiel. Imma ma jiddependix biss minnhom. Jiddependi ukoll minn min s’issa għadu qiegħed jerfa’ l-piz waħdu u jostor lil ħaddieħor.

Il-kobba hi mħabbla sewwa. L-iskandli wieħed wara l-ieħor ilhom jakkumulaw. Dwar uħud minnhom ma sar xejn u dwar oħrajn tapari sar xi ħaġa. F’dan kollu hemm rwol fundamentali għall-ġurnaliżmu investigattiv li b’responsabbiltà jgħarbel u jfittex il-konnessjonijiet bejn in-numru dejjem jikber ta’ skandli. Il-qtil biex isikket lil min jinvestiga mhuwiex biss delitt kontra l-persuna imma hu ukoll delitt kontra d-demokrazija. Għax l-istampa libera li ma tibżax hi pilastru ewlieni tad-demokrazija tagħna.

L-istess idejn jidhru repetutament. Min hemm mistoħbi warajhom? Min qed jiġbed l-ispag Delimara, il-Montenegro u lura sal-Bidnija?

Who is the puppet master?

There is a lingering question as we listen to or read reports on the evidence being compiled in Court relative to the assassination of Daphne Caruana Galizia. Who do the police protect?

The clear message being conveyed is that at a point in time specific police officers and the criminals currently under investigation were apparently in cahoots. Naturally, the officers referred to always deny any wrongdoing. Unfortunately for all of us, their credibility has been discarded over the years.

The decision of the Constitutional Court on the 5 October 2018 relative to Silvio Valletta, formerly Deputy Police Commissioner, having a conflict of interest on account of his being a politically exposed person due to his marriage to former Gozo Minister Justyne Caruana made matters worse. In 2018 the Constitutional Court had accepted the arguments of the family of Daphne Caruana Galizia and ordered that Silvio Valletta desists from continuing to be part of the investigation into the assassination.

In view of the allegations against former Deputy Leader of the Labour Party Chris Cardona about the financing of a separate and parallel DCG assassination contract, doubts linger on as to who received police protection. How could a politically exposed Deputy Police Commissioner investigate a politician belonging to the same political party as his wife, a Cabinet Minister? After all it was Silvio Valletta himself who in 2016 was reported in the Press as having declined being appointed as Commissioner of Police due to the perceived incompatibility of the duties of Commissioner with that of Cabinet Minister, as his wife then was. He took the right decision then!

The problem is further compounded by references to Joseph Muscat’s then Chief of Staff Keith Schembri as well as other persons close to the Office of the Prime Minister during the murder proceedings.

It is known that both Chris Cardona and Keith Schembri were questioned by the Police, but as far is publicly known none of them is under investigation yet. We do not know much more except the selected leaks planted in the media over the past weeks by those who certainly have some axe to grind.

The latest twist to the whole saga is the instructions issued by inquiring Magistrate that the police investigate the behaviour of former Police Commissioner Lawrence Cutajar after it was revealed in open court that he may have messed things up in his contacts with potential witnesses.

It is rumoured that there is still much more to be unravelled. While the evidence being heard in Court is pointing towards the possibility of two separate initiatives leading to the assassination of DCG it is still unclear as to who the real mastermind is. Whether Yorgen Fenech is a mastermind is still to be proven to the satisfaction of the Court. We should however remember that he contests this and points elsewhere.

Whether the ultimate puppet master is eventually identified is dependent on the investigative skills of the police. It also however depends on the extent to which those currently shouldering the blame are willing to pay the full price for the crime commissioned by others.

The resignation of Chris Cardona from Deputy Leader earlier this week is long overdue. He should have departed the moment the Acapulco brothel scandal saw the light of day. But that is another matter about which the whole truth is not yet in the public domain. Hopefully at some point in time more will be revealed as it may yet turn out to be of fundamental importance in entangling the whole mess.

At the end of the day it should be clear that crime does not pay.

L-assassinju: meta jkollok il-ħbieb fis-suq

Ix-xhieda fil-Qorti ta’ Melvyn Theuma iktar kmieni din il-ġimgħa fil-proċeduri kriminali ta’ Yorgen Fenech, in-negozjant akkużat bħala l-moħħ wara l-assassinazzjoni ta’ Daphne Caruana Galizia, hi tat-tkexkix. Huwa faċli li tinjora din ix-xhieda u twarrabha bħala bla ebda utilità minħabba li hu stess kien involut fil-preparazzjoni neċessarja biex il-qtil taħt investigazzjoni jseħħ. Xi drabi, sfortunatament, l-istat ikollu jaqa’ għal din it-tip ta’ kollaborazzjoni biex jipprova jsolvi delitti ppjanati sewwa. Hu l-unika mod kif kultant id-dinja kriminali tista’ tiġi megħluba.

Isem Chris Cardona, Deputat Mexxej tal-Partit Laburista, reġa tfaċċa f’dawn il-proċeduri kriminali. Diġa kien issemma’ waqt li Yorgen Fenech kien qed ikun interrogat u irċieva ittri fiċ-ċella fid-Depot tal-Pulizija li kienu jissuġġerulu biex jitfa l-ħtija fuq Cardona.

Fid-dinja demokratika mhiex xi ħaġa ta’ kuljum li isem politiku anzjan jissemma’ f’investigazzjoni dwar qtil. Mhux magħruf kemm il-Pulizija investigaw it-truf li kellhom dwar Cardona. Kien ikun raġjonevolI li nagħtu lill-Pulizija l-benefiċċju tad-dubju kieku ma kienx għal punt wieħed importanti: il-ħbiberija mill-viċin bejn l-akkużat Yorgen Fenech ma’ dak li kien id-Deputat Kummissarju tal-Pulizija Silvio Valletta li, fl-iktar mumenti kruċjali kien qed imexxi l-investigazzjoni dwar l-assassinju ta’ Daphne Caruana Galizia.

Il-ħbiberija bejn l-akkużat Yorgen Fenech u Silvio Valletta kienet b’saħħitha tant li quddiem it-tfal kien jirreferi għalih bħala iz-ziju Silvio. Li jivvjaġġaw flimkien biex jaraw logħob taċ-Champions League fi Stamford Bridge, Kiev u bnadi oħra, inkella ikla fir-razzett ta’ Fenech kienu affarijiet normali.

Ix-xhieda ta’ Melvyn Theuma ma tantx poġġiet l-investiġazzjoni f’dawl tajjeb. Il-kamra li l-pulizija jużaw għall-interrogazzjoni qiesha passatur bl-informazzjoni toħroġ permezz ta’ Silvio Valletta inkella permezz tal-uffiċċju tal-Prim Ministru: Joseph Muscat, dakinnhar Prim Ministru jkun aġġornat u b’Keith Schembri ħdejh attent jixrob l-informazzjoni. Ix-xhieda ta’ Theuma indikat li dan wassal biex ċirku limitat barra mill-korp tal-pulizija jkun konxju ta’ numru ta’ dettalji importanti dwar l-investigazzjoni, bħad-data tar-raid fit-tinda tal-patata fejn dawk ikkuntrattati biex iwettqu l-assassinju kienu eventwalment arrestati.

Hemm tlett talbiet oħra għall-proklama. Tħajru minn Melvyn Theuma. It-tlieta ddikjaraw li jistgħu jagħtu biżżejjed informazzjoni li biha jkunu identifikati dawk realment wara l-assassinju. Imma jekk dan iseħħx ħadd ma jista’ jgħid għalissa. Ħaġa waħda biss hi ċara s’issa: li Yorgen Fenech qiegħed jidher għal ħaddieħor. Min hemm warajh? Hemm numru ta’ ismijiet ta’ persuni assoċjati mal-uffiċċju tal-Prim Ministru li ssemmew fi stadji differenti tal-proċeduri kriminali li għaddejjin bħalissa.

Iktar ma qiegħed jgħaddi żmien, iktar qed titħabbel il-kobba!

Il-fatt li Robert Abela, Prim Ministru attwali, kien il-konsulent tal-predeċessur tiegħu ma tantx jagħmilha faċli biex tifhem eżattament x’inhu għaddej. Chris Cardona tneħħa mill-Kabinett imma ma jidhirx li l-Partit Laburista hu b’xi mod ippreokkupat li għandu lid-deputat mexxej kontinwament fl-aħbarijiet għal raġunijiet żbaljati. Iktar ma nisimgħu dwar dan l-assassinju iktar jikkumplikaw ruħhom l-affarijiet. Ma naħsibx li jiċċaraw wisq meta jixhdu iktar persuni fosthom Keith Schembri u Joseph Muscat.

L-impunità li gawdew uħud sal-lum hi dipendenti fuq il-ħbieb proverbjali fis-suq. It-tibdil fit-tmexxija fil-bidu tas-sena setgħet bidlet kollox. Imma jidher li kullma inbidlu huma l-uċuħ: il-bqija kollox baqa’ għaddej. Iż-żmien biss jista’ jwassalna lejn soluzzjoni.

The assassination: having friends in the right places

The testimony delivered in Court this week by Melvyn Theuma in the criminal case of Yorgen Fenech, the businessman accused with masterminding the assassination of Daphne Caruana Galizia, is numbing. It is very easy to dismiss his testimony as being useless as a result of his participation in the preparation required for executing the crime being investigated. Unfortunately, the state must seek this type of collaboration in order to try and solve carefully planned crime. It is the only way in which the criminal brotherhood can at times be outfoxed.

The name of Chris Cardona, Deputy Leader of the Labour Party, has resurfaced in the criminal proceedings. His name had already made the headlines when Yorgen Fenech was under interrogation, having letters delivered to his police HQ cell suggesting that he pins the blame on Cardona.

In the democratic world It is not an everyday occurrence that a senior politician’s name crops up in a murder investigation. So far, the level of investigation carried out by the police into Cardona, remains unknown. It would be reasonable to give the police the benefit of the doubt, were it not for one very important point: the close friendship of the accused Yorgen Fenech with former Deputy Commissioner of Police Silvio Valletta, who was in charge of leading the investigation into the assassination of Daphne Caruana Galizia at its most crucial stages.

The bond of friendship of the accused Yorgen Fenech with Silvio Valletta was so strong that he is known to have referred to him as Uncle Silvio in front of younger members of his family. Travelling to Champion’s League matches at Stamford Bridge, Kiev or elsewhere, and enjoying lunch at Fenech’s ranch was not an out of the normal occurrence.

The testimony of Melvyn Theuma has so far painted a very grim picture of the investigations. The police interrogation room was leaking like a sieve. Theuma’s testimony has indicated that this had resulted in a small circle outside the police HQ being aware of important investigation details, such as the date of the raid at the Marsa potato shed, where those contracted to carry out the assassination were eventually arrested.

There are three pending requests for turning state evidence, joining Melvyn Theuma. All three have declared that they can provide information which could nail those really responsible for contracting the assassination. Whether this can materialise is anybody’s guess. There is however one thing which by now is becoming very clear: Yorgen Fenech may be standing-in for somebody else. Who is it? Various names of persons linked with the Office of the Prime Minister have been mentioned during the different stages of the criminal proceedings currently under way.

The plot thickens by the minute.

The fact that Robert Abela, current Prime Minister, was legal advisor to the former Prime Minister Joseph Muscat, does not make it easier to decipher the links and the at times cryptic messages flying around. Cardona was kicked out of Cabinet but it seems that the Labour Party is not perturbed in having a Deputy Leader who is continuously in the news for the wrong reasons.

The more we hear about the assassination the more confusing it gets. Things may not necessarily get clearer when more witnesses take the stand, possibly including both Keith Schembri and his boss former Prime Minister Joseph Muscat.

The impunity enjoyed to date by some is dependent on having friends in the right place at the right time. The changing of the guard earlier this year could have ended the game. Unfortunately, it seems that nothing has changed. Only time and determination can solve the riddle.

Il-Korruzzjoni m’għandhiex kulur

Id-dibattitu dwar il-korruzzjoni fil-gżejjer Maltin ma jispiċċa qatt. Il-korruzzjoni m’għandhiex kulur u tiddependi ħafna fuq kultura ta’ klijenteliżmu u fuq istituzzjonijiet dgħajfa jew imdgħajfa. Sfortunatament, ma teżisti l-ebda rieda politika biex dan ikun indirizzat.

Ma tidher l-ebda azzjoni ċara u konkreta li tikkorrispondi mad-diskors pubbliku u ma jaqta’ xejn dwar tolleranza żero għall-korruzzjoni.

Ir-resistenza tal-Ministri Edward Scicluna, Konrad Mizzi u Chris Cardona biex tinfetaħ inkjesta kriminali minn maġistrat dwar l-allegazzjonijiet tal-kompliċità kriminali tagħhom in konnessjoni mal-ftehim tal-Vitals Global Healthcare dwar l-isptarijiet ma tinftiehemx. Prim Ministru b’tolleranza żero għall-korruzzjoni kien jitlob l-inkjesta hu stess. Inkella kien ikun minn ta’ quddiem biex jappoġġja t-talba li saret.

Kieku l-Partit Laburista kellu tolleranza żero għall-korruzzjoni ilu li bagħat lil Konrad Mizzi u lil Keith Schembri jixxejru. Il-fatt li l-mexxej Laburista Joseph Muscat ma aġixxiex b’dan il-mod ifisser li hu dispost li jagħlaq għajnejh għall-irregolaritajiet li jagħmlu ta’ madwaru. F’dawn iċ-ċirkustanzi, Partit Laburista b’tolleranza żero għall-korruzzjoni kien jiġbed widnejn il-mexxej tiegħu u jwissieh li jiemu magħduda jekk ma jibdilx triqtu. Il-fatt li l-Partit Laburista ma għamel xejn minn dan ifisser ħaġa waħda: li korruzzjoni hi tollerata.

Ikun għaqli jekk niftakru illi fl-istadji inizzjali tal-iskandlu magħruf bħala Panama Papers diversi membri tal-Grupp Parlamentari tal-Partit Laburista irreaġixxew għal dan kollu bil-bibien magħluqa.

F’April u Mejju tal-2016 kienet ħarġet l-istorja li mhux il-Partit Laburista kollu hu illuppjata dwar allegazzjonijiet ta’ korruzzjoni. Id-dibattitu intern, kif irrappurtat fil-medja, kien imqanqal, imma ma wassal għall-ebda azzjoni konkreta.

Il-Partit Nazzjonalista, għalkemm fl-Opposizzjoni, ma jistax ikun alternattiva għal dan għax minkejja li l-kritika tiegħu hi korretta mhuwiex kredibbli.

Il-Partit Nazzjonalista eleġġa mexxej li ftit li xejn jispira fiduċja fost il-pubbliku. Primarjament dan hu minħabba l-informazzjoni li toħroġ minn rapporti investigattivi dwaru ppubblikati minn Daphne Caruana Galizia, informazzjoni li turi kif diversi drabi ma aġixxiex b’mod korrett. Il-politku ma’ għandux il-possibilità li jagħżel meta jixgħel is-switch tal-imġieba etika. L-imġieba tal-politiku meta ma jkunx taħt il-lenti tal-opinjoni pubblika hi l-iktar indikattiva dwar x’isarraf. Il-kaz ta’ klijenti tal-uffiċju legali ta’ Adrian Delia li bbenefikaw minn dħul minn briedel f’Londra huwa eżempju prattiku ta’ dan. Meta l-informazzjoni kienet ippubblikata Delia fetaħ libell imma wara mhux biss irtirah imma ma ħa l-ebda passi alternattivi biex jisganċa ruħu minn dak li ntqal bl-iswed fuq l-abjad dwaru.

L-istess għandu jingħad dwar ix-xhieda ġuramentata tad-Deputat Nazzjonalista Claudio Grech dwar l-iskandlu taż-żejt liema xhieda ngħatat quddiem il-Kumitat Parlamentari għall-Kontijiet Pubbliċi. Dakinnhar Grech qal li ma kienx jiftakar jekk qatt iltaqa’ ma’ George Farrugia, il-moħħ wara l-iskandlu u li wara ngħata l-maħfra biex jikxef kollox. Il-Kap tal-PN ta’ dakinnhar, Simon Busuttil, bl-ebda mod ma rreaġixxa għal din l-imġieba. Ma ttieħdu l-ebda passi kontra Claudio Grech mill-PN f’dan il-kaz li bosta jqisuh bħala li pprova jevita li jikxef informazzjoni ta’ relevanza għal għarfien aħjar ta’ fatti tal-iskandlu.

Fid-dawl ta’ nuqqas ta’ kredibilità, meta l-Opposizzjoni Parlamentari (kif kostitwita illum) titkellem, l-impatt ta’ dak li tgħid bi kritika tal-Gvern ftit hu effetttiv.

Dan nistgħu narawh ukoll fid-dawl ta’ każi ta’ governanza ħażina li jikkomunikaw messaġġ wieħed: il-PL u l-PN huma pezza waħda. Eżempju ċar ta’ dan hu l-kaz tal-involviment ta’ Mario Demarco fin-negozjati kuntrattwali tad-dB fil-kwalità tiegħu ta’ konsulent legali tal-Grupp dB, meta fl-istess ħin kien Viċi Kap tal-Opposizzjoni u kelliemi għall-Finanzi. Għalkemm Mario Demarco għamel apoloġija pubblika dwar dan meta l-qiegħa kienet saħnet, il-ħsara li seħħet kienet sostanzjali. Il-messaġġ ċar li ġie kkomunikat dakinnhar kien li l-aħjar elementi tal-Opposizzjoni Parlamentari ma kinux kapaċi jiddistingwu bejn l-obbligi pubbliċi u l-interessi privati tagħhom.

Ikun opportun ukoll li niftakru fid-diversi rapporti tal-Awditur Ġenerali dwar abbuż minn propjetà pubblika meta din kienet responsabbiltà politika tad-deputat Jason Azzopardi. Il-PN fl-ebda ħin ma esiġa li Azzopardi jerfa’ r-responsabbiltà politika għall-frejjeġ li ħalla warajh.

Il-governanza ħażina u l-korruzzjoni huma kuġini. Waħda twassal għall-oħra. Xi minn daqqiet hemm min jitfixkel waħda mal-oħra.

Alternattiva Demokratika dejjem kienet ċara. Dejjem kellna tolleranza żero kemm għall-korruzzjoni kif ukoll għall-governanza ħażina. Sfortunatament, la l-PN u l-anqas il-PL ma jistgħu jgħidu l-istess.

Corruption is colour-blind

The debate on local corruption is never-ending. Corruption is colour-blind and is heavily dependent upon a clientelist culture, as well as on the existence of weak or weakened institutions. In addition, unfortunately, there is currently no political will to address either.

The never-ending public utterances on zero-tolerance to corruption are not matched with clear-cut action.

The resistance by Cabinet Ministers Edward Scicluna, Konrad Mizzi and Chris Cardona to the initiation of a magisterial criminal inquiry into the allegation concerning their criminal complicity in the Vitals Global Healthcare Hospitals deal is mind-boggling. A Prime Minister with a zero-tolerance to corruption would have requested the inquiry himself. Alternatively, he should have been the first to support the NGO-requested investigation.

A Labour Party which has a zero-tolerance to corruption would have sent Konrad Mizzi and Keith Schembri packing ages ago. The fact that Labour leader Joseph Muscat did not so act signifies that he is willing to turn a Nelson eye to his colleagues’ misdemeanours. In these circumstances a corruption zero-tolerant Labour Party would have given notice to its leader that his days are numbered if he does not change his ways. The fact that the Labour Party did not so act gives one clear message: it is corruption-tolerant.

It would be pertinent to point out that, in the initial stages of the Panama Papers debate, various members of the Labour Party Parliamentary group reacted behind closed doors. Way back in April and May of 2016, leaks in the media had indicated that not all of the Labour Party is anesthetised in its reactions to allegations of corruption. The internal debate, as then reported, was fierce, but it did not lead to concrete action.

The Nationalist Party, although in opposition, is no alternative to all this, as its criticism, though correct, is not credible.

The Nationalist Party has elected a leader who does not inspire much confidence in the public, primarily as a result of the investigative reports published by Daphne Caruana Galizia which unearthed information that illustrated the various instances in which he acted unethically. Holders of political office have no choice as to when to switch on to an ethical behaviour mode. Their behaviour when they were not under the glaring spotlight of public opinion is most indicative of their ethical worth. A case in point is Adrian Delia’s legal representation of clients benefitting from earnings from London-based brothels in respect of which published information he instituted legal action that he later withdrew. Subsequently he took no action which disproves anything that was published about this brothel business.

Likewise, no action was taken in respect of the sworn testimony of senior PN Member of Parliament Claudio Grech when giving witness in front of the Public Accounts Committee in its inquiry on the oil scandal. Grech had then stated that he did not recollect if he had ever met George Farrugia, the prime mover in the oil scandal, who was eventually pardoned to reveal all. The then PN leader, Simon Busuttil, had not reacted to this behaviour and no action whatsoever was initiated against Claudio Grech by the PN in what most consider a case of avoiding spilling information of relevance.

In view of its lack of credibility, whenever the Parliamentary Opposition – as presently constituted- speaks up, the impact of what has been revealed about Government’s dubious practices is severely diluted.

This could be viewed also with reference to serious issues of bad governance which communicate one clear message: they are cut from the same cloth. A case in point is Mario Demarco’s involvement in the dB contract negotiations as legal advisor to the dB Group, at a time when he was Deputy Leader of the Opposition and its spokesperson on Finance. Though Mario Demarco issued a public apology when the matter made headlines, the damage done was substantial. The clear message conveyed was that the better elements of the Parliamentary Opposition are incapable of drawing a line between their public duties and their private interests.

We may also deem it fit to remember the various reports issued by the Auditor-General on the mis-management of government property. At the time, this was the political responsibility of the Hon Jason Azzopardi but at no time was he asked by his party to shoulder political responsibility for the mess that he left behind.

Bad governance and corruption are cousins; one leads to the other and at times one is easily mistaken for the other.

At Alternattiva Demokratika we have always been clear: we are zero-tolerant in respect of both corruption and bad governance. Unfortunately, the same cannot be said of the PN and the PL.

Kull qalb trid oħra

Bħalkom qrajt l-istorja dwar ir-rappurtaġġ fuq it-TV Franċiż. Dwar dawk li qalu li jiġbdu l-ispag biex jieħdu li jridu meta japplikaw biex klijenti tagħhom jixtru ċ-ċittadinanza Maltija.

Jidher li hemm doża qawwija ta’ ftaħir biex jimpressjonaw klijent, imma xejn ma nieħodha bi kbira li x’imkien hemm xi toqba, kbira jew żgħira. Hemm ir-regolatur li għandu l-għodda biex jinvestiga. Nifhem li għalhekk ġiet sospisa l-liċenzja temporanjament. Nistenna, ħa nara għandux il-kuraġġ jirrapporta xi ħaga!

L-istorja l-kbira imma, naħseb li mhiex dik tal-passaporti. Hi l-istorja l-oħra tan-negozjant li lmenta li ħallewh barra meta qassmu l-Bajja ta’ San Ġorg. Dan jidher li kellem lill-Ministru Cardona li wassal l-ilment lil sieħbu Konrad, il-Ministru tat-Turiżmu. Konrad ħakk rasu u qallu li l-bajja żgħira, ftit hemm post, imma ser jara x’jista’ jsir.

Sa hawnhekk xejn ġdid. Imma hemm iktar. Hu hemm fejn hu ta’ tħassib.

Ġie rrappurtat li Cardona bagħat messaġġ lil Konrad u qallu li lil din il-familja jeħtieġ li tingħata l-għajnuna għax “huma dejjem tawna l-għajnuna.”

Il-mistoqsija sempliċi hi “din, x’għajnuna hi?” Ma jidhirlix li rajt xi għajnuna finanzjarja minn din il-familja dikjarata fir-rapporti tad-donazzjonijiet. Mela allura x’tip ta’ għajnuna hi din?

Biex ma ninftiehemx ħażin mhux qed nilmenta li din il-familja tagħti għajnuna lil partit politiku. Imma qed niġbed l-attenzjoni li hemm limitu għal x’tip ta’ għajnuna tista’ tingħata. Din hi ukoll regolata bil-liġi.

Ikun tajjeb li dan ikun iċċarat. L-ebda investigazzjoni ma hi ser tasal biex tistabilixxi preċiżament x’inhu jiġri issa, imma xi darba xi ħadd jisparla u forsi jkun hemm xi indikazzjoni tan-natura tal-ġenerosità kbira ta’ din il-familja.

Għax kif qal Cardona lil Konrad kull qalb trid oħra. Anke fir-Repubblika tal-Banana.

Avukati, pulizija u l-kriminali ta’ wara l-iskrivanija

 

Naħseb li hu ċar għal kulħadd li xi avukati huma familjari ftit iżżejjed ma’ kriminali li hawn jiġru mas-saqajn. Dan kien wieħed mit-temi li Daphne Caruana Galizia analizzat fil-blog tagħha tul is-snin. L-imġieba tagħhom kienet taħt il-lenti tagħha: lenti li tifli b’reqqa.

Dak li qed jingħad bħalissa dwar Chris Cardona, avukat u Ministru, jagħmel ħafna sens f’dan il-kuntest. Nifhem li hu jiċħad b’qawwa l-konklużjonijiet loġiċi ta’ dak li qiegħed jingħad. L-istess bħalma ċaħad l-istejjer dwar żjara fil-burdell FKK Acapulco fil-lokal ta’ Verbert ħdejn Düsseldorf fil-Ġermanja. Hekk kif waslet is-siegħa tal-prova dwar fejn kien skond kif jirriżulta mill-informazzjoni li kien jittrasmetti l-mobile tiegħu, il-kawżi ta’ libell waqfu, u l-provi ma nstemgħux.

Ovvjament kulħadd għandu dritt jasal għall-konklużjonijiet tiegħu. Jiena bħal ħafna oħrajn ikkonkludejt li ċ-ċahdiet ta’ Chris Cardona ma tistax teħodhom bis-serjetá. Din hi materja gravi ħafna, għax Chris Cardona mhux biċċa avukat, imma Deputat Mexxej tal-Partit Laburista u Ministru. Bħala Maltin għandna d-dritt li l-Ministri u l-uffiċjali tal-partiti politiċi jkunu persuni serji u ta’ integritá, li ma twaqqawlniex wiċċna l-art.

Diversi qed jinsistu li hemm bżonn inkjesta speċjali dwar il-qtil ta’ Daphne Caruana Galizia. Il-Gvern ħa l-posizzjoni li dwar jekk hemmx din il-ħtieġa jiddeċiedi iktar tard wara l-konklużjoni tal-inkjesta maġisterjali. Joseph Muscat qed jgħid li jekk ma jsirx hekk l-inkjesta maġisterjali tista’ tkun preġudikata.

Ma naqbilx ma dak li qed jgħid Joseph Muscat għax l-iskop taż-żewġ inkjesti hu differenti. Kif kien ġara dwar l-inċident tax-xufier/pulizija li kellu Manwel Mallia, dakinnhar Ministru għall-Intern. Dakinnhar kien hemm żewġ inkjesti għaddejjin flimkien u safejn naf jien l-ebda waħda mill-inkjesti ma kienet ta’ xkiel għall-inkjesta l-oħra.

L-inkjesta speċjali hi meħtieġa dwar il-kollass tal-istituzzjonijiet nazzjonali u l-kontribut ta’ dan il-kollass biex żviluppat is-sitwazzjoni attwali. Hemm bżonn ukoll spjegazzjoni li tagħmel sens għaliex il-maġistrat li kien qiegħed jinvestiga l-qtil ta’ Daphne ingħata promozzjoni fl-iktar mument kritiku għall-inkjesta kif ukoll jekk hux veru li kellu jiffaċċja ostakli kbar fil-ħidma tiegħu.

Għax uħud mill-kriminali li hawn jiġru mas-saqajn jista’ jkun li huma liebsin il-ġlekk u l-ingravata u qegħdin wara l-iskrivanija.

Daphne: min ordna l-qtil tagħha?

Fi żmien ġimgħa oħra (nhar it-Tlieta 16 t’Ottubru) tkun għaddiet sena mill-qtil ta’ Daphne Caruana Galizia. S’issa l-Pulizija bdiet proċeduri kontra dawk li hu allegat li wettqu l-qtil. Iżda min ordna l-qtil  għadu mhux magħruf. Il-Pulizija għad ma skoprewx min hu, jew min hi jew min huma.

Il-ġimgħa l-oħra l-Qorti Kostituzzjonali iddeċidiet li d-Deputat Kummissarju tal-Pulizija Silvio Valletta, li hu miżżewweġ lill-Ministru Justyne Caruana, ma kellux ikun parti mill-investgazzjoni tal-Pulizija dwar il-qtil ta’ Daphne u dan minħabba li l-presenza tiegħu fl-investgazzjoni tnissel dubji serji f’moħħ in-nies dwar l-imparzjalitá tal-investigazzjoni.

La Republica, il-bierah, f’artiklu intitolat: “Omicidio Daphne Caruana Galizia, ci fu un altro incontro tra uno dei killer e il ministro maltese” bħala parti mill-inkjesta Daphne project titkellem dwar bachleor’s party li sar f’villa fil-Fawwara nhar id-29 ta’ Ġunju 2017, erba’ xhur qabel il-qtil ta’ Daphne Caruana Galizia. Fost dawk preżenti, jkompli jgħid ir-rapport, kien hemm il-Ministru Chris Cardona kif  ukoll Alfred Degiorgio (il-Fulu), wieħed mill-akkużati bil-qtil ta’ Daphne.

Ir-rapport ikompli jgħid li persuna (li isimha ma tissemmiex fir-rapport) wara li ċemplet lil Daphne fuq il-mobile biex tagħtiha informazzjoni dwar l-istorja tal-kuntrabandu taż-żejt, ċemplet lill-Ministru Cardona u immedjatament wara lil Alfred Degiorgio il-fulu.

Il-Ministru Cardona qed jiċħad dan kollu. Dan hu kollu attentat biex iħammġuh Chris Cardona qal lit-Times: hu insista b’qawwa li ma għandu l-ebda konnessjoni mal-persuna li tissemma u li hi akkużata bl-attentat tal-qtil (Il-Fulu, jiġifieri). Tajjeb ħafna!

Ir-rapport jgħid iktar. Jgħid li l-Maġistrat Anthony Vella, li mexxa l-inkjesta mill-bidu nett, kien talab għar-records telefoniċi ta’ dawk li kienu qed jissemmew għal dati ferm qabel ma seħħ il-qtil. Din l-informazzjoni damet ħafna ma waslet għand il-Maġistrat, jgħid ir-rapport, tant li sadanittant kien laħaq imħallef u allura ma kienx għadu inkarigat mill-inkjesta.

S’issa għad mhux magħruf x’ġara iktar minn din l-informazzjoni, jigifieri jekk kienx hemm min investiga jekk din hiex vera jew le. Iċ-ċaħda tal-Ministru Cardona hi importanti, imma ċertament mhiex biżżejjed.

Dan kollu jista’ jfisser ħafna. Imma jista’ ukoll ma jfisser xejn. Jista’ jkun stabilit jekk din hiex informazzjoni relevanti biss jekk ikun hemm il-possibilitá li din l-informazzjoni tkun eżaminata bir-reqqa. Jidher li dan kien qed jipprova jagħmel il-Maġistrat Anthony Vella sakemm, ingħata promotion, u allura ma setax jibqa’ jmexxi l-inkjesta.

Din gravi ħafna. Xi ħadd għandu l-obbligu li jispjega.

Sakemm ta’ La Republica m’humiex qed iħarrfu, jekk l-investigazzjoni issir bis-serjetá, din tista’ tkun il-bidu reali tat-tiftix tal-mandant tal-qtil ta’ Daphne Caruana Galizia.

Kif qal fil-Qorti Silvio Valletta, Deputat Kummissarju tal-Pulizija, minn din l-inkjesta ħadd ma hu eskluż!

Zero waste : a 2050 target

Malta’s Waste Management Strategy for 2014-20 establishes the year 2050 as the one by which our society should achieve a zero waste target. In fact the first of four principles of Malta’s national waste policy is specifically: “to reduce waste and to prevent waste occurring, with a view to achieving a zero-waste society by 2050” (page 14 of Malta’s strategy).

It is pertinent to point out that the Zero Waste International Alliance has defined zero waste as follows: “Zero Waste is a goal that is both pragmatic and visionary, to guide people to emulate sustainable natural cycles, where all discarded materials are resources for others to use. Zero Waste means designing and managing products and processes to reduce the volume and toxicity of waste and materials, conserve and recover all resources and not burn or bury them. Implementing Zero Waste will eliminate all discharges to land, water, or air that may be a threat to planetary, human, animal or plant health.”

A Zero waste philosophy is thus a strategy and a set of practical tools seeking to eliminate waste and not just to manage it. The point at issue is how to go about reducing and eventually eliminating the waste that we generate.

This is basically a cultural change, waking up from our slumbers and realising that we live in a world where resources are finite. It is about time that we address our ecological deficit: from which there is no bale-out option.

There is one basic first step in the road towards zero waste which should be carefully planned and managed and this is a meticulous recycling strategy. Zero waste municipalities in Europe are continuously indicating that an 80 to 90 per cent recycling rate is achievable. The fact that Malta’s recycling rate is, at best, estimated at around 12 per cent, shows that there is room for substantial improvement: a seven-fold increase in Malta’s recycling rate.

How can this be brought about?

A first step would be to discard the apparently easy solutions which lead nowhere. Government’s proposed incineration policy, as a result of which 40 per cent of the waste generated will be burned, is a policy that seeks to manage waste and does away with the target of reducing and eventually eliminating its generation. The very fact that incineration is being proposed signifies a failure in the implementation of the waste management strategy just three years after its last revision, in 2014.

A second step would be to ensure consistency in waste policy. Malta’s Waste Management Strategy is aptly sub-titled ‘A Resource Management Approach’. By no stretch of the imagination can Malta’s proposed incineration policy be deemed to be consistent with such an approach. It is, in my view, just a panic reaction to the fact that there is no more space available for landfills.

The issue involved is very straightforward: can we deliver on our own target of a zero waste society by 2050? In planning to achieve this objective, each Minister has to be a Minister for the Environment, as each Ministry has a role in preventing or re-using the waste generated by the different economic activities. It is certainly a headache not only for Environment Minister José Herrera, but also for all the other Ministers, in particular Tourism Minister Konrad Mizzi and Minister for the Economy Chris Cardona.

In analysing waste management strategy targets achieved to date, it is not only Wasteserve that should be in the dock. The Minister responsible for the Economy has a duty to give account as to what measures and initiatives are in hand to develop the circular economy. It is the point where the paths of environment policy and economic policy cross, and rhetoric has to give precedence to results achieved or in the pipeline to be achieved.

Likewise, it is about time the Tourism Ministry seriously addresses the waste generated by hotels, bars and restaurants. This is an area that has been neglected for several years and is creating considerable difficulties in various parts of the Maltese islands, especially those along the coastline.

It is about time we realised that the implementation of an environment policy is not to be restricted to the corridors of the Environment Ministry: it is an activity that should be carried out by each and every Ministry.
