Ħlasijiet kbar: trasparenza xejn

Għadni kif ktibt lill-Awditur Ġenerali fejn talbtu jinvestiga x’inhu jiġri dwar il-ħlasijiet enormi li qed isiru lill-Ministri u Segretarji parlamentari li jispiċċaw mill-ħatra.

Il-kriterji li qed ikunu applikati m’humiex magħrufa. Ma hemm l-ebda trasparenza dwar x’inhu jiġri.

It-talba li bagħatt hi s-segwenti:

“Nikteb biex nitolbok tinvestiga l-ħlas ta’ “golden handshakes” lill-membri tal-Kabinett li jispiċċaw mill-ħatra. Presentment fl-aħbarijiet hemm il-każ ta’ Justyne Caruana imma għad kif kellna ukoll il-ħlasijiet li saru lil Rosianne Cutajar.

Ma hemm l-ebda trasparenza dwar il-ħlasijiet li saru u li qed isiru lill-Ministri u Segretarji Parlamentari, uħud minnhom għal darba tnejn.

Nitolbok għaldaqstant tinvestiga xi kriterji qed ikunu użati biex isiru dawn il-ħlasijiet kif ukoll li teżamina l-ħtieġa li jkunu introdotti mekkaniżmi effettivi ta’ kontroll u verifika dwar dan il-proċess kollu.”

Wara r-riżenja ta’ Justyne

Issa Justyne irriżenjat għat-tieni darba mill-Kabinett ta’ Robert Abela. Il-Kabinett ta’ Abela, l-ikbar wieħed fl-istorja, naqas bi tnejn, Justyne u Rosianne.

Meta irriżenjat Rosianne ma kien daħal ħadd ġdid fil-Kabinett.

Kif diġa għidt, il-każ ta’ Justyne għadu miftuħ, mhux biss għax il-Kumitat Permanenti tal-Parlament dwar l-Istandards fil-Ħajja Pubblika għad irid jiddiskuti r-rapport (m’għandux għaġġla) imma ukoll għax hemm riżenji oħra li jeħtieġ li jsiru.

Frank Fabri u Paul Debattista huma mistennija li jwarrbu ma jdumux. Tal-ewwel għax iffirma l-kuntratt abbużiv u illegali u tat-tieni għax kien hu li iffaċilita dan il-qerq kollu billi kiteb ir-rapport li għal xi żmien kien qed jingħad li taparsi kitbu Daniel Bogdanovic u b’hekk ikun jista’ jsir il-ħlas ta’ ħmistax-il elf euro.

Minn kif tkellem Robert Abela jidher li m’għandux għaġġla biex jaħtar Ministru flok Justyne. Dan isaħħaħ ix-xniegħa, li issa ilha ftit ġranet għaddejja, li mhux biss ġejja reshuffle tal-Kabinett dalwaqt, imma li hu ippjanat ukoll li jinbidlu diversi f’karigi mlaħħqin.

Ma ninsewx ukoll li f’Jannar, xahar ieħor, għandu jibda jinstema l-ġuri dwar il-hold-up li falla fuq l-HSBC. Intqal diġa li f’dan il-ġuri jistgħu jsiru rivelazzjonijiet dwar membru ieħor tal-Kabinett ta’ Robert Abela. Din tista’ twassal għal riżenja oħra!

Technocrats in Cabinet

It is being argued by some that the Prime Minister should have the possibility to appoint technocrats as members of Cabinet.

As things currently stand, there are several posts servicing government departments which should be filled by technocrats but are instead seeing appointment of persons of trust, that is persons who are in the good books of politicians.

How about ensuring that technocrats are appointed where it matters before dreaming of having technocrats in government?

On a final note, we have had three technocrats appointed to Cabinet recently. The first two were responsible for many a mess! I am referring to Edward Scicluna and Konrad Mizzi. The third one, Clyde Caruana is still works in progress!

Il-Ministru kien iħossu mwarrab : Silta (3) mill-Inkjesta

Il-konċentrazzjoni tal-poter u l-kitchen cabinet Dan l-istil ta’ gvern amministrat mill-Prim Ministru Muscat u dan il-modus operandi ġie konfermat b’mod inekwivoku mill-allura Ministru tal-Finanzi s-Sur Edward Scicluna illi minn rajh u mingħajr provokazzjoni da parti tal-Bord ikkonferma illi “bħal kull gvern u f’kull pajjiż ikun dak li ngħidulu ‘kitchen cabinet’ jiġifieri jkun hemm erba’ min-nies dejjem hemmhekk u jidħlu f’ċerti affarijiet”. Iddikjara li hu ma kienx parti minn dak il-“kitchen cabinet”. Il-Ministru kien iħossu mwarrab sal-punt li meta kien ikun id-dar “Kont ngħidilha – isma’ jien għandi esperjenza u dan kollu fin-negozjati, kif qatt ma jdaħħluni biex ninegozja? … fi kwalunkwe ħaġa …”. Mistoqsi biex jagħti l-ismijiet ta’ min kien jipparteċipa f’dan il-“kitchen cabinet” apparti l-Prim Ministru u Keith Scehmbri, l-Ministru Scicluna iddeklina li jagħmel hekk għaliex qal “Jien ma nistax insemmi ismijiet għal raġuni li din hija opinjoni tiegħi. Illi jiena ma kontx parti mill-‘inner core’; li tħossok li inti escluded minn ċerti affarijiet imma ma kellix dik l-intimitá mal-Prim Ministru …”.

Aktar tard elabora “kulħadd jaf bil-closeness ta’ Keith mal-Prim Ministru u li kienu almost one and the same fis-sens ta’ team. Fuq dawn il-proġetti li jissemmew tal-power plant u tal-isptarijiet kien hemm Konrad magħhom. Jiġifieri sa hemmhekk nista’ ngħid. Jiġifieri l-oħrajn ma nistax nikkonkludi li żgur kienu hemm jew le ma nistax ngħid”.

Żewġ livelli ta’ Gvern: Gvern ta’ fuq il-palk u Gvern ta’ wara l-kwinti: Silta (1) mill-inkjesta

Dan il-Bord akkumula muntanja ta’ provi kemm mix-xhieda li sema’ hu stess kif ukoll minn sorsi oħra bħar-rapporti tal-Awditur Ġenerali u xhieda li ngħataw f’diversi inkjesti, dwar irregolaritajiet gravi ta’ governanza ħażina, nuqqas ta’ osservanza ta’ regolamenti u proċeduri maħsuba biex jassiguraw trasparenza u kontabilitá li lkoll kienu jippuntaw lejn l-istess grupp ta’ nies, li lkoll kienu jgawdu l-fiduċja tal-Prim Ministru ta’ allura u li kienu fdati bit-twettieq tal-proġetti mfassla fil-programm elettorali.

Dawn il-provi kienu kostantement jippuntaw lejn realtá – fil-veritá ġeneralment rikonoxxuta – li dan iċ-ċirku ristrett, li kien jinkludi persuni li ma kienux kontabbli lejn l-elettorat, imma kienu jokkupaw karigi għolja f’entitajiet tal-iStat seta’ minħabba s-saħħa li kellu, jaġixxi taħt ir-radar u l-iskrutinju ta’ istituzzjonijiet regolatorji u tal-istess Kabinett tal-Ministri. Il-kweżit li jeħtieġlu jirrispondi għalih il-Bord hu jekk kienx minnu li allura kien hemm żewġ livelli ta’ gvern.


Ir-riposta għal din id-domanda ngħatat b’mod skjett u ċar mill-Onorevoli Evarist Bartolo li fiż-żmien rilevanti kien Ministru tal-Edukazzjoni u illum huwa Ministru għall-Affarijiet Barranin. Hu żvela l-eżistenza ta’ żewġ livelli ta’ gvern u dana f’dawn it-termini “Imma li għandna, għandna nies tal-flus li jużaw il-flus tagħhom biex jixtru l-influenza f’kull qasam tal-ħajja inkluż fil-politika u jiena wissejt li jista’ jkollok żewġ gvernijiet, jista’ jkollok gvern ta’fuq il-palk u jista’ jkollok gvern parallel ta’ wara l-kwinti”. U meta l-Bord staqsieh espressament jekk kienx hemm żewġ livelli ta’ gvern il-Ministru wieġeb fl-affermattiv “Iva għalhekk tkellimt fuq dawk in-networks. Għalhekk tkellimt b’dak il-mod u wissejt fuq il-ħsara li tista’ ssir fil-pajjiż kollu kemm hu”. Hu kompla jelabora “….anke jekk ħassejtni li f’pajjiżna faċilment ikollok żewġ kabinetti, kabinett uffiċjali li jiltaqa’ f’Kastilja u jkollok kabinetti oħra li jiltaqgħu fl-irziezet u fuq il-boats u jiltaqgħu f’postijiet oħra u jiġu deċiżi affarijiet li jibbajpassjaw l-istituzzjonijiet ta’ pajjiżna. Jiena nkwetat ħafna b’dan. Inkwetat ħafna u billi nkun inkwetat mhux biżżejjed …. jekk ma jkollokx istituzzjonijiet jekk tħalli l-poter li jista’ jiġi ikkonċentrat f’naħa waħda ser ikollok il-problemi”. (pp125-7)

Xejn ma jsir b’xejn

Ir-rapport dwar ir-Reżidenza tal-Anzjani San Vinċenż, li ħafna drabi nirreferu għaliha bħala l-Imgieret, ippubblikat il-ġimgħa l-oħra mill-Awditur Ġenerali hu wieħed twil. Jista’, iżda faċilment jinġabar f’sentenza waħda: meta tagħmel dak li jaqbel, addio governanza tajba!

L-ewwel reazzjoni tal-Ministru politikament responsabbli minn din il-froġa kienet li l-Awditur Ġenerali mhux interessat fl-anzjani! Qalilna ukoll li hu, l-Ministru, ma ndaħalx. Mid-dehra l-Onorevoli Ministru ma jafx li għandu resposabbiltà li “jindaħal” u jagħti direzzjoni. Direzzjoni favur it-tisħiħ kontinwu tal-governanza tajba fl-amministrazzjoni pubblika. Flimkien mal-Ministru Falzon iridu jerfgħu ukoll ir-responsabbiltà politika l-Ministru Justyne Caruana u l-ex-Segretarju Parlamentari Anthony Agius Decelis. It-tnejn li huma kienuresponsabbli għall-anzjani bħala Segretarji Parlamentari u allura għandhom sehem fil-ħolqien ta’ din il-froġa.

Li ma tagħmel xejn, għax ma tagħtix kaz inkella għax tiġi taqa’ u tqum hu nuqqas. Nuqqas kbir li l-politiċi jridu jerfgħu r-responsabbiltà għalih.  Politiċi serji u ta’ stoffa jirreżenjaw f’dawn iċ-ċirkustanzi. Jiena naħseb li ma hu ser jirreżenja ħadd.

Bħas-soltu l-Prim Ministru Robert Abela jipprova jmewwet l-affarijiet. Qalilna li kien żball li l-każ ma telax għall-approvazzjoni tal-Kabinett. Bħal dak li qallu li deċiżjoni tal-Kabinett kienet ser iddawwar froġa f’deċiżjoni tajba!  Il-Ministru Falzon qalilna waħda aħjar: ma hemm xejn ħażin f’din id-deċiżjoni, qal Falzon. Azzarda jgħid ukoll li jidhirlu li l-Awditur Ġenerali għandu jikkoreġi uħud mill-konklużjonijiet tiegħu.

Meta f’Malta l-istituzzjonijiet jaħdmu, sfortunatament ikollhom jiffaċċjaw dawn ir-reazzjonijiet tal-politiċi. Dawn huma kollha ostakli għat-twettieq tal-governanza tajba.   

Jippruvaw kontinwament inaqqsu is-sinifikat tal-konklużjonijiet tal-Awditur Ġenerali billi jgħidu li, forsi, kull ma hemm huma “xi żbalji żgħar proċedurali”! Dawn huma attentati biex jimminaw l-istituzzjonijiet li jaħdmu.

Meta l-Awditur Ġenerali jgħid li l-kien hemm ksur tar-regoli tax-xiri pubbliku ma kienx qed jitkellem fuq xi proċeduri żgħar li ma ġewx osservati. Anke meta jgħid li d-deċiżjoni kienet waħda illegali, kien ċar daqs il-kristall.

Kelliema għall-Gvern jemfasizzaw li din id-deċiżjoni wasslet għal investiment sostanzjali li ġie b’xejn. Anke hawn l-Awditur Ġenerali hu ċarissimu Ma hemm xejn b’xejn, jgħidilna. Juża dan il-kliem preċiż fir-rapport tiegħu: “In a transaction of such significant value with commercial interests, nothing is ever secured for free”.

L-Awditur Ġenerali kellu kliem iebes anke għad-Direttur tal-Kuntratti talli dan ma ħax prewkazzjonijiet billi pprovda gwida ċara. Dan kien meħtieġ essenzjali minħabba l-konsiderazzjoni tal-hekk imsejjaħ investiment addizzjonali bla ħlas! In-nuqqas ta’ gwida ċara min-naħa tad-Direttur tal-Kuntratti, sostna l-Awditur Ġenerali, jesponi lill-proġett għall-ħafna riskji.

Id-deċiżjoni waslu għaliha permezz ta’ negozjati ma’ min għamel l-offerti. Dan jemfasizza l-Awditur Ġenerali imur kontra dak li jipprovdu r-regolamenti dwar ix-xiri pubbliku.  Kien possibli, jkompli jemfasizza l-Awditur Ġenerali li l-istess servizz jinkiseb mingħand operaturi ekonomiċi oħra u allura is-sistema tal-offerti kompetittivi kienet l-għażla addattata li sfortunatament ġiet skartata.

Dan hu każ ieħor ta’ falliment fit-twettieq ta’ governanza tajba minkejja l-mod kif jipprova jpinġi l-każ il-Prim Ministru Robert Abela. Hemm lezzjoni waħda ċara: xejn ma jiġi b’xejn. Il-kont kollu jitħallas mit-taxxi li jħallsu uħud minna.

Qed jingħad fil-media li saret laqgħa bejn il-pulizija u l-uffiċċju tal-Awditur Ġenerali. Hu tal-biki li qed jingħad li “f’dan l-istadju” mhemmx ħtieġa ta’ investigazzjoni mill-pulizija.

Qed nittama li l-pulizija ma jdumux ma jindunaw li hu neċessarju li issir l-investigazzjoni tagħhom b’mod immedjat.

Nothing is ever secured for free

The St Vincent de Paul Residence report published last week by the National Audit Office (NAO) is quite long. It can however be described by one sentence: this is what happens when political expediency overrides good governance.

The first reaction of the Minister politically responsible for this whole mess is quite indicative. Minister Michael Falzon was reported as stating that “the lives of the elderly not NAO’s concern”. He furthermore emphasised that there was no political interference from his end. The Honourable Minister is apparently not aware that holders of political office are there to give direction, including political direction leading to and entrenching good governance. Together with Minister Michael Falzon the political responsibility should be shouldered by Minister Justyne Caruana and former Parliamentary Secretary Anthony Agius Decelis, both of whom were at different points in time Parliamentary Secretaries responsible for the elderly and consequently co-creators of this mess.

Failure to act is an act of omission. This is the basic point at issue.

The Prime Minister, as usual, sought to minimise these gross governance failures by stating that in this specific case it was a mistake not to seek the approval of Cabinet. As if the approval of Cabinet would have ever transformed such a deal into an acceptable one. Minister Falzon went one better: there is nothing wrong in the deal, he said. He even had the cheek to suggest that the NAO should issue a correction on some of its findings!

Whenever the institutions do function, they are unfortunately stonewalled by holders of political office. These are the major obstructions encountered on the road to good governance. 

There is an attempt to downplay the significance of the NAO findings into a need “to improve procedures”. Such attempts have to be seen for what they really are: undermining the institutions which function.

When the NAO suggests that the deal is an infringement of procurement rules and does not represent value for money it was not speaking about some minor procedural infringement. The fact that the NAO even concludes that the deal should be deemed invalid is quite damning.

Government spokespersons speak of the deal with glee pointing out that substantial investment was obtained “for free”.  “In a transaction of such significant value with commercial interests, nothing is ever secured for free” is the blunt reply of the NAO.

The NAO also took the Director of Contracts to task for not taking the necessary precautions through legal safeguards and guidance. These were deemed essential in respect of the additional investment required “at no cost” to government and forming part of the deal examined. This, stated the NAO, gave rise to serious risks in the execution of the project.

The deal under the spotlight makes use of what is known as a “negotiated procedure”. This, emphasises the NAO, was applied in breach of the Public Procurement Regulations. The NAO underlined that the services sought could easily have been provided by other economic operators thereby necessitating the use of the competitive tendering procedures and not a negotiated procedure.

This is yet another case of a failure in good governance notwithstanding the attempts at its minimisation by the Prime Minister Robert Abela. There is one basic lesson to be learnt: there are no free lunches available! The bills are invariably paid through the taxes which a number of us pay!

It has been reported that a meeting was held between the NAO and the police. It is flabbergasting to note that a spokesperson for the police has stated that “at this stage a police investigation is not required.” 

I look forward to the stage when a police investigation is considered necessary!

It-taħwid fl-Awtorità tal-Ippjanar

Qatt ħsibt ftit dwar kif inhu possibli li r-regolatur tal-ippjanar tal-użu tal-art f’Malta jinsab fl-istat ta’ taħwid li qiegħed? Ħarsu ftit lejn il-proċeduri kriminali li għaddejjin bħalissa dwar il-ħasil tal-flus. Wieħed mill-akkużati hu Matthew Pace li sa ftit ilu kien membru tal-Bord tal-Awtorità tal-Ippjanar. Spettur tal-Pulizija li kien qed jixhed fil-każ iddeskrivieh bħala professjonist tal-ħasil tal-flus:  a professional money launderer.

Ftit jiftakru li f’Ġunju 2018 kellna aħbar li l-FIAU (Financial Intelligence Analysis Unit) kienet immultat lil  Matthew Pace is-somma ta’ €38,750 minħabba li ma segwiex il-liġijiet kontra l-ħasil tal-flus meta kien qed jieħu ħsieb l-investimenti tal-klijent tiegħu Keith Schembri. Dan kien fatt magħruf. Mid-dehra l-Gvern kien kuntent bih, għax ma għamel xejn dwaru. Qiesu ma ġara xejn.

Ikun interessanti nkunu nafu jekk il-konsulent legali tal-Awtorità tal-Ippjanar, ċertu Dr Robert Abela, ġibitx l-attenzjoni tal-Awtorità dwar il-ħtieġa li taġixxi dwar dan. Jekk le, forsi l-istess Dr Robert Abela bħala l-konsulent legali ta’ Joseph Muscat ġibidlu l-attenzjoni dwar dan? Ma smajna xejn dwar dan kollu.  ilkoll kompromessi. Governanza tajba? U mhux hekk tgħid.

Matthew Pace għamel snin membru tal-Bord tal-Awtorità tal-Ippjanar. Kien biss wara l-każ ċar ta’ kunflitt ta’interess tiegħu  fil-każ tal-applikazzjoni ta’żvilupp mill-Grupp dB f’Pembroke li kien sfurzat jirreżenja u dan wara pressjoni pubblika minn ambjentalisti. Ngħid li kien “sfurzat” għax wara li l-Qorti annullat il-permess mogħti lill-Grupp dB fuq il-kunflitt ta’ interess ta’ Matthew Pace hu kien għall-ewwel irrifjuta li jwarrab. Kien ippruvat li huwa ħa sehem fil-laqgħat li wasslu għal deċiżjoni dwar il-permess tad-dB f’Pembroke, u ivvota favur din l-applikazzjoni.  Fl-istess ħin kellu interess f’aġenzija tal-propjetà li kienet qed tbiegħ  partijiet minn dan l-iżvilupp sa minn qabel mal-Bord tal-Awtorità tal-Ippjanar, bil-vot tiegħu stess favur, approva din l-applikazzjoni! Dik governanza tajba. Dik imġieba korretta!

Din hi l-Awtorità tal-Ippjanar. Sfortunatament il-membri l-oħra tal-Bord huma ukoll effettwati minħabba l-assoċjazzjoni tagħhom miegħu.  Iridu jgħaddu snin kbar qabel mar-regulatur jirkupra minn dan.

Imma hemm iktar minn hekk.

Ambjentalisti skoprew, kważi b’kumbinazzjoni, li c-Chairman attwali tat-Tribunal ta’ Reviżjoni dwar l-Ambjent u l-Ippjanar  (EPRT) li jisma’ appelli dwar każijiet ta’ ippjanar tal-użu tal-art u oħrajn dwar l-ambjent huwa ukoll impjegat tal-Awtorità tal-Ippjanar.  Presentement qiegħed b’leave bla ħlas mill-impjieg normali tiegħu mal-Awtorità tal-Ippjanar bid-dritt li jmur lura għall-impieg normali tiegħu hekk kif tintemm il-ħatra tiegħu bħala Chairperson tat-Tribunal.  

Kif jista’ impjegat tal-Awtorità tal-Ippjanar jikkunsidra appelli minn deċiżjonijiet li jieħu min jimpjegah? Dan imma hu dak li jagħmel kuljum ic-Chairman tal-EPRT.  L-anqas jekk jipprova ma qatt jista’ jkun imparzjali. Imma meta inġibditlu l-attenzjoni dwar dan ma qabilx li s-sitwazzjoni partikolari tiegħu titfa dell fuq l-imparzjalità tiegħu meta jiddeċiedi dwar kazijiet tal-ippjanar dwar l-użu tal-art. Fl-aħħar ser tkun il-Qorti li jkollha tiddeċiedi u l-ħsara li tkun saret sadanittant ser tkun waħda kbira.

It-taħwid, kif qed taraw, hu kbir. B’dawn in-nuqqasijiet etiċi ħadd m’għandu jiskanta li l-proċess dwar l-użu ta’ l-art tilef kull kredibilità.  

A mess by design

Did you ever wonder why it is possible for the land use planning regulator in Malta to be in such a mess? Just take a look at the criminal proceedings currently under way on money laundering. A former Planning Authority Board member, Matthew Pace, is one of the accused. A police inspector, explaining the investigation results has described him as a professional money launderer.

Few may remember that, way back in June 2018, an item in the news had announced that the Financial Intelligence Analysis Unit (FIAU) had fined Matthew Pace the sum of €38,750 for breaching a number of anti-money laundering laws when dealing with investments held by a client of his named Keith Schembri. It was public knowledge and government was apparently happy as it did not act about it.

It would be interesting to know if the then legal advisor of the Planning Authority, a certain Dr Robert Abela, had flagged the issue and drawn the attention of the Authority on the need to take action. If not, could the legal advisor to Joseph Muscat, the same Dr Robert Abela, have drawn attention of his then boss to the matter? We have heard nothing about it. As we are by now aware, they are all compromised. Good governance my foot!

Mr Matthew Pace spent years as a member of the Planning Authority Board and it was only after his blatant case of conflict of interest in the dB Pembroke case that he was forced to resign as a result of public pressures by environmentalists. I say he was “forced to resign” as, when the Court annulled the dB Pembroke permit on the basis of Matthew Pace’s conflict of interest, he initially refused to make way. It was proven that he sat in judgement and participated in the decision on the dB Pembroke permit, voting in favour of its approval. Simultaneously he had an interest in an estate agency which was already “selling” units forming part of the dB Pembroke development even before the development permit was approved by the Planning Board with Matthew Pace’s vote in favour! Governance at its best!

This is the Planning Authority. Unfortunately, the other members of the Board are impacted by association. It will be many years before this regulator recovers.

There is more.

Environmentalists have discovered, almost by accident, that the current Chairman of the Environment and Planning Review Tribunal (EPRT) while sitting in judgement on appeal cases concerning planning and environmental issues is still an employee of the Planning Authority. He is currently on leave without pay having the right to return to his employment with the Planning Authority when his current term as Chairman of the EPRT expires.

How can an employee of the Planning Authority sit in judgement on the decisions of his employer? Yet this is what the Chairman of the EPRT does every day. He cannot by any stretch of the imagination be impartial even if he tries his very best. Yet whenever he was challenged, he has refused to accept that his specific circumstances render him unsuitable to Chair the EPRT in all cases concerning the Planning Authority. This matter will eventually have to be decided by the Courts with possible considerable consequences.

The mess gets worse every day.

With these ethical failures it is no wonder that the credibility of the land use planning process has gone to the dogs.

Some reflections on the Mafia State

Reading through the terms of reference for the Public Inquiry into the assassination of Daphne Caruana Galizia, it is amply clear to all as to what the inquiry should be aiming at.

The inquiry’s objective is to determine whether the machinery of government functioned as it should. Did it function in the public interest, or did it function in another manner, in the interest of the few, thereby creating a culture of impunity for the said few?

Some may justifiably argue that the machinery of government, in Malta, never functioned properly. It is further argued that the post 2013 administration made use of a defective machinery of government more efficiently than previous administrations, fine tuning and intensifying political controls in the process, as a result of which the stultification of the functions of the democratic state was accelerated.

The terms of reference agreed to in December 2019 speak of the development of a “de facto state of impunity” and seek to determine whether this could have been avoided through effective criminal law provisions, if such provisions exist.

Do we have a Mafia State? We would definitely have a Mafia State if the machinery of government is tied with organised crime to the extent that state officials become part of a criminal partnership or organisation.

The testimony heard so far in open session during the proceedings of the public inquiry reveals the reluctance of the authorities to investigate thereby paving the way for the development of a culture of impunity. Money-laundering investigations moved at snail’s pace until there was a change in leadership at the Economic Crimes Unit of the Malta Police Force. However, as yet we do not know what was revealed in the testimony behind closed doors. Matters could be considerably worse than what is known so far.

The revelations at the public inquiry must not be seen in isolation. They must be viewed in context of the testimony in the Magistrates Court relative to the criminal proceedings against those accused of carrying out the assassination of Daphne Caruana Galizia, or of masterminding it.

We have learnt that the alleged master-mind has pleaded with the police that he was carrying out the instructions of the Chief of Staff at the Office of the Prime Minister, Keith Schembri, who categorically denied this. The definite truth is not known yet. So far, we are only sure that the assassination planners were too close to the political nerve centre: just like in a Mafia State. It is at the Office of the Prime Minister that the middleman was offered a government job, one which delivered pay for no work. Part payment for his endeavours as a middleman!

The Ministers testifying at the public inquiry were continuously seeking to pass the buck from the Cabinet to the kitchen cabinet. On the other hand, those forming part of this kitchen cabinet feigned ignorance of their role in circumventing the role of the real cabinet. This is the worrying state of play in which those having responsibility take a step backwards as a result of which their authority ends being wielded by those appointed in lieu of those elected. Collective responsibility has been thrown to the winds.

The latest revelations crown it all. Government’s thinly veiled threats in the past days to the members of the judiciary directing the public inquiry reveal a government in panic mode.

Robert Abela’s unease at this point in time is understandable. After all he was former Prime Minister Joseph Muscat’s legal advisor. How many skeletons in the cupboard is he aware of?
