Jgħadduna biż-żmien

L-Awtorità tal-Ambjent u r-Riżorsi (ERA) għadha kif ippubblikat abbozz ta’ Strateġija Nazzjonali dwar l-Ambjent għal konsultazzjoni pubblika. Dan l-abbozz ippubblikatu bl-Ingliż biss. Qiesu t-tmexxija tal-ERA ma tafx bil-Malti.

Minn awtorità pubblika nistennew ferm aħjar minn hekk. Kemm ser iddumu tinsulentawna? L-iskuża li l-Malti mhux addattat għal dokument tekniku mhiex waħda aċċettabbli. In-nuqqas ta’ dokument bil-Malti hi opportunutà mitlufa biex l-ERA tikkomunika iktar man-nies.

Iżda lil hinn mil-lingwa, l-istrateġija ambjentali li qed tkun proposta hi waħda ġenerika. Fiha tmien għanijiet li hu propost li jintlaħqu sal-2050. Il-lista tal-għanijiet li l-ERA trid tindirizza mhiex il-problema, għax il-problema hija li dawn l-għanijiet huma affarijiet li ilna niddiskutu żmien: ġew ippubblikati biżibilju rapporti, strateġiji u regoli jew policies li jkunu saru b’intenzjonijiet tajba tul is-snin!  Il-problemi jinqalgħu dejjem meta nfittxu li nimplimentaw il-miżuri meħtieġa biex jitwettqu dawn l-għanijiet. F’dak il-mument jinqagħu elf skuża, għax fir-realtà ma hemmx il-volontà politika li jittieħdu passi bis-serjetà.

Dan hu bil-bosta differenti milli jipprova jgħid ic-Chairman tal-ERA fid-daħla bl-Ingliż li kiteb għad-dokument konsultattiv! Din hi storja li għaddejna minnha diversi drabi!

Il-ħsara ambjentali li saret tul is-snin mhiex xi ħaġa li ser tkun irranġata mil-lum għall-għada.  Ħadd m’għandu jistenna riżultati malajr fil-mixja biex insewwu l-ħsara ambjentali li tħalliet takkumula tul is-snin.

Il-ħarsien tal-ambjent jinvolvi li jinbidlu deċiżjonijiet politiċi diversi li ittieħdu tul is-snin li kienu parti mill-kawża ta’ ħsara konsiderevoli. Ifisser ukoll li nibdlu attitudnijiet, drawwiet u l-mod kif inġibu ruħna.

Fid-daħla għad-dokument konsultattiv iċ-Chairman tal-ERA Chairman, Victor Axiak, jistqarr li jista’ jkun hemm ħtieġa ta’ sagrifiċċji żgħar fl-immedjat biex niksbu benefiċċji ambjentali fit-tul li jitgawdew minn ġenerazzjonijiet futuri. Din hi dikjarazzjoni li prattikament kulħadd jaqbel magħha. Imma dikjarazzjoni bħal din teħtieġ ukoll li tkun segwita minn lista ta’ miżuri meħtieġa biex tittieħed azzjoni dwarhom,  lista li tvarja minn miżuri li jistgħu jittieħdu immedjatament għal oħrajn li jħarsu iktar fit-tul.

Ma baqax iktar żmien biex noqgħodu niffilosifizzaw dwar l-ambjent.  Il-problemi nafu x’inhuma u  nafu ukoll min fejn ġejjin u min hu l-kawża tagħhom! Tħejjew kwantità ta’ rapporti, strateġiji, pjani t’azzjoni u x’naf jien tul is-snin. Kull Ministru ġdid ipprova jagħti l-impressjoni li hu jew hi sabet is-soluzzjoni b’nisġa ta’ kliem sabiħ li jipprova jimpressjona. Sfortunatament ir-rapporti tekniċi li saru kif ukoll dak li qalu in-nies waqt konsultazzjonijiet pubbliċi, bosta drabi ġie injorat.  Anzi xi drabi l-gvernijiet saħansitra aġixxew bil-maqlub ta’ dak propost jew maqbul!

L-istrateġija proposta illum, per eżempju,  tiffilosofizza dwar il-ħtieġa li innaqqsu id-dipendenza tagħna fuq il-karozzi u tinsisti li għandhom jonqsu l-karozzi mit-toroq tagħna.  Jekk wieħed imur lura u jerġa’ jaqra ftit l-istrateġija nazzjonali dwar it-trasport, li kienet iffinalizzat sitt snin ilu, jsib eżattament l-istess argumenti. Imma minflok ma ħa l-passi meħtieġa, l-Gvern – kemm direttament kif ukoll permezz tal-agenziji u l-awtoritajiet tiegħu – għamel bil-maqlub!

Kull studju li sar, kemm f’Malta kif ukoll barra minn xtutna, repetutament ikkonkluda li żvilupp massiċċ tal-infrastruttura tat-toroq twassal biex awtomatikament jiżdiedu l-karozzi fit-toroq. Kif mistenni, anke f’Malta, hekk ġara. Il-konġestjoni u l-problemi tat-traffiku żdiedu mhux naqsu riżultat tal-proġetti diversi tat-toroq. Dan seħħ għax kuntrarju tal-pariri li kellu, l-Gvern ma indirizzax il-kawza tal-problemi, imma indirizza l-effett.  Il-problema mhiex il-wisa’ jew it-tul tat-toroq, imma n-numru ta’ karozzi fit-toroq. Is-sitwazzjoni illum – f’ħafna każi  – hi agħar milli kienet qabel ma saru dawn il-proġetti.  

Minnbarra dan, daqslikieku mhux biżżejjed, l-awtoritajiet għamlu is-snin jinkoraġixxu l-iżvilupp ta’ petrol stations kbar, qieshom supermarkets. Dawn ħarbtu ammont mhux żgħir ta’ raba’. Biex issa jiġu jgħidulna kemm iridu jipproteġu l-agrikultura!

Kif nistgħu ntejbu l-kwalità tal-arja jekk nibqgħu nżidu l-karozzi fit-toroq tagħna?  Uħud forsi jargumentaw li s-soluzzjoni qegħda wara l-bieb bl-introduzzjoni tal-karozzi tal-elettriku inkella bl-użu tal-idroġenu jew xi fuel ieħor alternattiv. Dan ikun biss soluzzjoni parzjali għax fl-aħħar mill-aħħar irridu naraw kif ikun ġġenerat l-elettriku meħtieġ inkella kif ikun prodott l-idroġenu jew fuel alternattiv.

M’għandiex ammont suffiċjenti ta’ enerġija rinovabbli iġġenerata lokalment għax l-għorrief li ħadu id-deċiżjonijiet ftaħru fil-passat kemm kien irnexxielhom jinnegozjaw deroga tajba biex il-mira nazzjonali ta’ ġenerazzjoni ta’ enerġija rinovabbli ma tkunx 20% imma 10% tal-elettriku ikkunsmat. Ħtija ta’ hekk, illum m’għandniex ammont suffiċjenti ta’ enerġija rinovabbli.  Meta għandna l-ħtieġa ta’ enerġija elettrika bi prezz raġjonevoli  għandna nuqqas f’dan il-qasam li għalih qed inħallsu bizzalza.

Id-dipendenza li għandna bħala pajjiż fuq il-karozzi privati hi riżultat ta’ traskuraġni politika tat-trasport pubbliku tul is-snin. Li t-trasport pubbliku jkun b’xejn minn dan ix-xahar kienet deċiżjoni prematura. L-ewwel pass messu kien li tkun indirizzata l-effiċjenza u l-puntwalità tas-servizz. Il-prezz qatt ma kien problema.

Hu meħtieġ li l-effiċjenza u l-puntwalità tas-servizz ikunu indirizzati b’urġenza. Meta dan isir jagħmel ġid ambjentali ferm iktar mill-argumenti tekniċi kollha dwar kemm hemm ħtieġa li nħarsu l-ambjent. Trasport pubbliku effiċjenti flimkien ma investiment f’modi alternattivi ta’ transport hu ta’ benefiċċju ambjentali enormi.

Din hi uġiegħ ta’ ras kbira. Pariri ċari kien hemm. Iżda meta kien possibli li l-problema tkun indirizzata, l-Gvern, direttament kif ukoll permezz tal-awtoritajiet u aġenziji diversi tiegħu, ġie jaqa’ u jqum minn dan u għamel bil-maqlub!

Argumenti simili jistgħu jsiru dwar numru kbir ta’ materji ta’ importanza ambjentali: mill-ilma sal-pestiċidi, mill-użu tal-art sal-bijodiversità, mill-isforzi favur ekonomija ċirkulari għal taxxi ambjentali iddiżinjati sewwa.

Il-mod kif il-politika dwar it-trasport tħalliet għan-niżla hu biss eżempju wieħed żgħir minn fost bosta li jwassal għall-konklużjoni inevitabbli li ma teżistix rieda politika biex il-ħsara ambjentali tkun indirizzata bis-serjetà.

Il-konsultazzjoni pubblika tal-ERA sfortunatament hi fażi oħra fi proċess li permezz tiegħu qed jippruvaw jgħadduna biż-żmien.

Greenwashing by ERA

The Environment and Resources Authority (ERA) has published a draft National Strategy for the Environment for public consultation. The proposed strategy is not specific but generic in nature. It lists eight strategic goals which it proposes to address till 2050.

There is no problem with the listed goals. We have, in fact been there before with a multitude of strategies and well-meaning policies. The problems arise when seeking to implement the specific measures required to achieve the said goals. When push comes to shove 1001 difficulties arise as it becomes clear that there exists no political will to act decisively. This is quite contrary to the impression conveyed in the forward penned to the strategy by the ERA Chairman!

ERA seeks a long-term vision since it is well known that the reversal of environmental damage takes time. One should not expect immediate results in the quest to reverse the accumulated damage to the environment.

Protecting the environment involves reversing political decisions which have been the cause of considerable environmental damage. It involves changing attitudes and behaviour.

In the forward to the document released for public consultation ERA Chairman Victor Axiak states that: “Short-term sacrifices may need to be made for long-term benefits to be reaped by future generations.” It is a statement that anyone in his right senses would agree with. Such a statement should however have been followed by a list of measures which require action, ranging from short term to long-term ones.

The time for philosophising on the environment is long overdue. We all know what the problems are. We also know who and what has caused them. A countless number of reports, strategies, masterplans, and action plans have been produced over the years. Unfortunately, they have been repeatedly ignored. At times governments have acted in a manner which is directly in opposition to what has been proposed or even agreed to!

The currently proposed environment strategy, for example, philosophises on reducing our car dependence and advises on the need to reduce cars from our roads. Leafing through the National Transport Master Plan finalised six years ago one finds the same admonition. Instead of taking definite steps, government, directly as well as through its agencies and authorities followed a path leading in the opposite direction.

All studies carried out in Malta and abroad have repeatedly concluded that large scale road infrastructural improvement leads to more cars on the road. As was expected this is what is happening in Malta at the time being. Traffic congestion has worsened, as instead of addressing the cause of the problem the authorities addressed the effects. They sought to widen roads and introduce new ones instead of addressing the exponential increase of cars on the roads. The traffic situation is worse than ever notwithstanding the monies spent or rather wasted in these projects.

In addition, the authorities have spent years encouraging the construction of large fuel stations, comparable to supermarkets in size, gobbling up quite an amount of good agricultural land in the process. Now, they are telling us how important it is to protect agricultural land!

How can we improve the quality of our air if we keep increasing cars on our roads? Some would say that a solution is round the corner with the electrification of vehicles or with the use of hydrogen as an alternative fuel. This would only partly solve the problem. One must consider the source of electricity utilised or how the hydrogen (or other fuel) is produced.

We do not have enough renewable energy generated from local sources as the ignoramuses leading the country were (in the past) overjoyed at their successful EU negotiations to reduce the national target for the generation of renewable energy from 20 to 10 per cent of the electrical energy consumed. Now, when we desperately need more electricity which is reasonably priced, we are faced with a substantial deficit which is costing the national exchequer considerable expense.

We are faced with a national problem of car addiction as a result of the political neglect of public transport over the years. Having it free of charge as of this month was premature as the first step should have been to address its efficiency and reliability.   Price was never an issue.

This lack of efficiency and reliability of public transport is essential to address with urgency as, once addressed, it will do more for environmental protection that all the philosophising on the environment over the years! An efficient public transport together with a substantial investment in alternative modes of transport would be quite beneficial for the environment.

This is one of the major problems we currently face. Clear advice was available, yet when it was possible to address the problem, government through its various authorities and agencies deliberately made it worse.

Similar arguments can be made about a multitude of other areas of environmental importance ranging from water to pesticides, from land use to biodiversity, from efforts to set up a circular economy to adequate environmental taxes which are appropriately designed.

The way transport policy has developed in a downhill direction is just one small example of many on the basis of which it is inevitable to conclude that there is no political will to address environmental issues seriously. The ERA public consultation is unfortunately another phase of an on-going greenwashing exercise.

The debate on the National Environment Strategy

The human person forms an integral part of the eco-system.  We do not form part of “the economy”. The economy is the manner in which we organise ourselves, but the eco-system is our DNA.

This is what the ERA National Strategy for the Environment for 2050, currently in consultation phase, should be about.

The strategy is entitled “Wellbeing First”.  A strategy drafted only in the English language, once more ignoring Maltese. While our quality of life is of the utmost importance, an environmental strategy which is anthropocentric does not make sense. An anthropocentric environmental policy is short term in nature and does not lead to enhancing well-being. Environmental policy should be eco-centric: its subject matter should be the achievement of a healthy ecology, as free as possible from human toxicity. Ensuring a healthy ecology will definitely also enhance our quality of life too.

Environment and Resources Authority (ERA) Chairperson Victor Axiaq, in the forward to the consultation document, emphasises that we have yet to learn to live within our ecological limits. Obviously, as a result of his participation in the Planning Authority Board over the past seven years, he has first-hand experience of the manner in which these limits have been continuously stretched beyond any elastic limit. There is a need to reverse this trend the soonest.

The pursuit of economic growth as the single most important policy goal is in conflict with the earth’s limited resource base and the fragile ecosystem of which we are a part and on which we depend for our survival. While economic growth is supposed to deliver prosperity, it has instead delivered unbridled climate change, fuel insecurity, sky-high commodity prices, collapsing biodiversity, reduced access to depleted water resources and an ever-increasing global inequality. These are all issues the tackling of which cannot be postponed to the next generation.

Progress is measured through the Gross Domestic Product (GDP) yet the GDP measures everything except that which makes life worthwhile.

The GDP is just concerned with material wealth ignoring in the process our health, education, the safety of our streets, the social tissue of society, the state of our families, the devastation caused by all forms of hatred…………… GDP includes the production of armaments and the destruction of the environment carried out in the name of “progress” as well as the television programmes that glorify violence in order to sell toys to our children. The earth’s resources are limited and, consequently, they cannot fuel infinite economic growth. There are practical limits to growth, which should lead our economic planners to consider decoupling prosperity and economic growth.

The consultation document seeks to guide the national debate towards identifying the long-term objectives of the National Environmental Strategy. Once this is done ERA should be in a position to develop action plans for the achievement of such objectives.

It should be undoubtedly clear to all that a sustainable future will only be achieved when we start respecting the eco-system without any exception. Our eco-system determines our permissible limits which we only ignore at our peril. This is our challenge which must be addressed by the National Environment Strategy.

Il-Wasteserve: fil-Magħtab qed topera bla permess

Diversi bdiewa fil-Magħtab ġew mitluba biex jikkuntattjaw il-Wasteserve sa tmiem dan ix-xahar biex ikun iffaċilitat aċċess għall-art li qed jaħdmu u dan bl-iskop li din tkun eżaminata, “bil-ħsieb li possibilment tiġi akkwistata għal skop pubbliku”. L-avviż legali numru 1261 li kien ippubblikat fil-Gazzetta tal-Gvern tas-17 ta’ Diċembru 2019 jgħid li hemm tmien biċċiet art fil-Magħtab li qed ikunu ikkunsidrati. Din l-art għandha qies totali ta’ 254,144 metru kwadru, jiġifieri ftit iktar minn 226 tomna. Il-parti l-kbira minn din l-art għadha qed tinħadem minn bdiewa minkejja ċ-ċirkustanzi diffiċli li nħolqu kemm ilhom joperaw il-miżbliet fil-Magħtab sa mill-1975.

Xi ħtieġa għandha l-Wasteserve għal din l-art? Hemm tlett materji ewlenin dwar l-iskart li huma pendenti.

Il-miżbliet tal-Magħtab dalwaqt jimtlew. Bla dubju din is-sitwazzjoni wasalna għaliha qabel ma kien antiċipat minħabba li qed jintrema wisq skart. Ir-riċiklar għadu f’livell insinifikanti. Il-ġbir tal-iskart organiku b’mod separat għadu fil-bidu. Hemm ħtieġa urġenti biex in-nies tagħraf iktar il-ħtieġa li tnaqqas kemm l-iskart kif ukoll l-ammont tiegħu li qed jintrema fil-miżbliet.

Il-Gvern, probabbilment li qed iħejji biex jimplimenta l-wegħda elettorali dwar l-egħluq tal-impjant ta’ Sant Antnin li jittratta l-iskart. Din hi l-wegħda numru 27 fil-Manifest Elettorali tal-Partit Laburista fl-Elezzjoni Ġenerali tal-2017. Probabbilment li dan ukoll jispiċċa fil-kumpless tal-iskart tal-Magħtab li l-Wasteserve tirreferi għalih bħala iċ-Ċentru Ambjentali tal-Magħtab.

It-tielet pendenza hi dwar l-inċineratur li hu ppjanat li jibda jopera sa mhux iktar tard mill-2025.

Il-Wasteserve teħtieġ l-art għal dan kollu li ser iwassal biex il-Magħtab ikun ikkonvertit permanentement fiċ-ċentru tal-iskart fil-gżejjer Maltin.

Il-Wasteserve, fuq is-sit elettroniku tagħha tiddeskrivi l-kumpless tal-Magħtab bħala ta’ daqs komparabbli mal-Belt Valletta, li hi mifruxa fuq 600,000 metru kwadru.

Iktar kmieni din il-ġimgħa, Aaron Farrugia, Ministru għall-Ambjent u l-Ippjanar, li hu politikament responsabbli għall-Wasteserve, spjega, waqt intervista mxandra fl-aħbarijiet, li l-estensjoni ippjanata għall-miżbla tal-Magħtab teħtieġ 145,000 metru kwadru ta’ art filwaqt li l-inċineratur propost u “faċilitajiet oħra” jirrikjedu 105,000 metru kwadru addizzjonali. Il-facilitajiet oħra hi referenza għall-wegħda elettorali tal-Partit Laburista biex jingħalaq l-impjant ta’ Sant Antnin għat-trattament tal-iskart.

Meta tgħodd din l-art kollha għall-proġetti tal-Wasteserve fil-Magħtab ifisser li d-daqs tal-kumpless għall-iskart ser jikber għal madwar 850,000 metru kwadru, meta l-proġetti jkunu kollha mplimentati. Dan ifisser li l-254,144 metru kwadru ta’ art, primarjament raba’, imsemmija fil-Gazzetta tal-Gvern tas-17 ta’ Diċembru 2019 tista’ isservi bl-eżatt. Xejn ma neħodha bi kbira, iżda, jekk il-Wasteserve, bħal Oliver Twist, tkun trid iktar.

Meta nfittxu fuq is-sit elettroniku tal-Awtorità għall-Ambjent u r-Riżorsi (ERA) niskopru li l-permessi magħrufa bħala IPPC permits għall-miżbliet fil-Magħtab ilhom ftit li skadew. Dan ifisser li l-Wasteserve qed topera fi stat ta’ illegalità.

Dawn il-permessi imsejħa IPPC permits (Integrated Pollution Prevention and Control) jinħarġu mill- ERA skond kif tistabilixxi direttiva tal-Unjoni Ewropeja u dan wara li jkun hemm studji dettaljati dwar l-attività (f’dan il-kaz miżbla) u l-impatti tagħha. Skont is-sit elettroniku tal-ERA il-miżbla għal skart mhux perikoluż Ta’ Żwejra fil-kumpless tal-Magħtab qed topera fuq bażi ta’ permess li skada fl-24 ta’ Lulju 2018 (permess IP 0001/05). Min-naħa l-oħra l-miżbla għal skart mhux perikoluż tal-Għallis, ukoll fil-kumpless tal-Magħtab, qed topera fuq bażi ta’ permess li nħareġ f’Jannar 2013 u li suppost li skada fil-bidu tal-2018 (permess IP 0001/06).

Jekk il-Wasteserve mhiex kapaċi tosserva liġijiet bażiċi ambjentali, ħadd ma għandu jeħodha bi kbira li sezzjoni tal-pubbliku jimxu fuq l-eżempju tagħha.

Għaliex ir-regolatur ambjentali, l-ERA, tittollera dawn l-affarijiet? Ic-Chairman tal-ERA, l-Professor Victor Axiaq, għandu jispjega x’inhu jiġri. Messu ilu li rreżenja.

Wasteserve illegality: sort it out.

Farmers in Magħtab have been asked to contact Wasteserve by the end of this month in order to facilitate access to their land “for necessary studies with the intent of potential acquisition for public purposes”.

Notice No. 1261, published in The Malta Government Gazette of the 17 December 2019, lists eight plots of land in Magħtab which are being considered. This land has a total area of 254,144 square metres, slightly more than 226 tumoli. Most of it is currently in use as agricultural land, notwithstanding the difficult circumstances arising from the operation of landfills in the vicinity since 1975.

What does Wasteserve need this land for?

There are three pending major waste management issues. The landfills at Magħtab will be shortly filled to capacity. Undoubtedly this state of affairs has been reached earlier than anticipated due to the fact that too much waste is still going to landfill. Recycling is still at an insignificant level and the collection of organic waste as a separate stream is still in its infancy. Much still needs to be done in instilling awareness on the need to substantially reduce both the amount of waste generated as well as the portion of it going to landfill.

The Government will most probably also seek to implement its electoral pledge to close down the Sant Antnin Waste Treatment Plant. This is pledge number 27 in the Labour Party Electoral Manifesto for the 2017 general election and it, too, will most probably be directed towards the Magħtab waste complex, which Wasteserve refers to as the Magħtab Environment Complex.

The third pending issue is the so-called thermal facility, ie the incinerator, scheduled to be in operation by 2025.

Wasteserve needs land to address all three issues, in the process converting Magħtab permanently to the waste centre of the Maltese islands.

The Wasteserve website describes the Magħtab complex as being comparable in size to Valletta, being spread over an area in excess of 600,000 square metres.

Earlier Environment and Planning Minister Aaron Farrugia, politically responsible for Wasteserve, explained on television that the planned extension to the Magħtab landfill requires 145,000 square metres of land, while the proposed incinerator and other facilities would require an additional 105,000 square metres. The “other facilities” is an indirect reference to the Labour Party’s commitment to close down the Sant Antnin Waste Treatment Plant.

Adding up all this land required for the Wasteserve projects at Magħtab would bring the Waste Complex size to around 850,000 square metres when all the pending projects are implemented. This means that the proposed take up of 254,144 square metres of mostly agricultural land as declared in the Malta Government Gazette edition of the 17 December 2019 could be just enough space. Like Oliver Twist, Wasteserve will, however, most probably come back for more.

Perusal of the information available on the website of the Environment and Resources Authority (ERA) indicates that the IPPC permit for the landfills at Magħtab expired quite some time ago, signifying that Wasteserve is operating in a state of illegality.

The IPPC (Integrated Pollution Prevention and Control) permits are issued by the ERA in terms of the provisions of the relative EU Directive after detailed studies on the operations and impacts of the proposed activity have been carried out or updated. According to the ERA website, the Ta’ Żwejra non-hazardous landfill within the Magħtab complex is operating on the basis of a permit which expired on the 24 July 2018 (permit IP 0001/05). On the other hand, the L-Għallis non-hazardous landfill, also within the Magħtab complex, operates on the basis of a permit which was issued way back in January 2013 and should have expired at the beginning of 2018 (permit IP 0001/06). Malta’s only landfill complex is thus operating without a valid permit at law.

If Wasteserve does not follow the provisions of basic environmental legislation, it is no surprise that a section of the population is inclined to follow its example.

Sort it out!

Why does the Environment and Resources Authority (ERA), the environment regulator, tolerate this state of affairs? The Chairman of ERA, Professor Victor Axiaq, owes an explanation. His resignation is long overdue.

The health problems we face by being overweight are not resolved by changing our wardrobe or loosening our belt but by going on a reasonable diet. And it is the same with our roads.

Addressing traffic congestion will not be resolved by road-widening or large road infrastructure projects but by addressing the root cause of such congestion: the number of cars that are using of our roads.

The opposition to the Central Link project is not about trees. Trees, symbolic of environmental vitality, are an important detail in the project that Infrastructure Malta is undoubtedly only too willing to concede through promises of substantially increasing their availability, even though the plans of the project have, at various times, indicated otherwise. This is apparent from the current bombardment of TV adverts by Infrastructure Malta. The opposition to the project is rather about the short-sighted transport policy that ignores the causes of traffic congestion and deals exclusively with the effects thereof. Avoiding the root cause of traffic congestion will only result in temporary relief.

The Environment Impact Assessment on the Central Link project considers six different scenarios: Scenario 0 to Scenario 5. Scenario 0 is defined as the “do-nothing option” with the other five scenarios being different combinations of interventions in the road infrastructure. The “do-nothing option”, as implied, signifies that no infrastructural interventions are involved: everything remains as is.

Infrastructure Malta’s brief is limited to infrastructural interventions. As a consequence, the authors of the Environmental Impact Assessment did not consider it worthwhile to examine whether it is at all possible to address traffic congestion through focused policy interventions over a suitable time frame. The government has already taken some positive steps in this regard through the offering of various carrots enticing different sectors to use alternative means of mobility, which include initiatives on both land and sea transport alternatives.

In the pipeline is the proposal to widen the appeal of public transport through making it free for everyone. Various other policy proposals have been implemented, including the provision of school transport to all schools, with the aim of reducing traffic during peak hours. This is all positive and could form the basis of an exercise to realistically address traffic congestion without the need for substantial infrastructural interventions.

What is the anticipated environmental impact of all this and possibly more? We are none the wiser through reading the Environment Impact Assessment.

The Transport Master Plan emphasises that the average journey length of a private car trip in Malta is 5.5 kilometres and that 50 per cent of trips take no more than 15 minutes. This obviously leads to the important consideration that regional and local public transport, if organised efficiently, could address the movement of a substantial number of cars on our roads with considerable environmental benefits. The EIA is silent on this basic information, which, if properly acted upon, could result in a substantial number of cars being removed from our roads without the need of any infrastructural intervention!

What role does environmental taxation have in encouraging a change in behaviour of those who can address their mobility needs in a reasonable manner without the need of using a private car?

Scenario 0, which considers environmental impacts without any infrastructural interventions, does not consider this. In so doing, the EIA is incomplete as it does not assess all the available options that can have an impact on traffic congestion. This contrasts with the provisions of the EIA Regulations which broadly regulate the process of analysing and reporting on the environmental impacts of major projects and emphasise that a “sufficiently detailed and reasonably exhaustive initial appraisal of potentially suitable alternatives” is essential.

This signifies that the Environment and Resources Authority (ERA) has not carried out its role in moderating the contents of the EIA appropriately. This could possibly explain why, very strangely, Professor Victor Axiaq did not utter one single word during the public hearing of the Planning Authority Board during which he voted in favour of the Central Link project!

The long-term aim of Malta’s transport policy is spelled out in the Transport Master Plan 2025: it is a reduction in the number of cars from our roads. This will increase mobility through the use of sustainable alternatives such as public transport, cycling, walking and even sea transport between locations in our harbour areas.

Transport studies carried out all over the world indicate that major road works always end up generating additional traffic. The Central Link project will not be an exception and consequently, it will not follow the direction spelt out by Malta’s Transport Master Plan approved by government in 2016!

L-Awtorità tal-Ambjent u r-Riżorsi immexija minn Victor Axiaq s’issa qegħda hemm għal xejn. Suppost li l-Ippjanar infired mill-Ambjent biex flok MEPA għandna żewġ awtoritajiet prinċipalment biex l-ambjent ikun iktar b’saħħtu.

Imma, sfortunatament qatt daqs illum ma kien daqshekk dgħajjef l-amministrazzjoni tal-ambjent f’pajjiżna. Meta hu magħruf li fil-memo mibgħuta mill-Professur Victor Axiaq lil Dr Timothy Gambin l-EIA dwar Townsquare f’Tas-Sliema kien deskritt bħala farsa (a sham) bil-fors tistaqsi għalfejn s’issa l-Awtorità tal-Ambjent għadha ma għamlet xejn.

L-anqas ma kellha toqgħod tistenna sa wara li tittieħed id-deċiżjoni biex l-Awtorità tal-Ambjent tiċaqlaq. Għax jekk kienet taf li l-EIA kien farsa kellha l-obbligu li tiċċaqlaq ħafna qabel. L-anqas biss indenja ruħu jinkariga uffiċjali tal-awtorità li jmexxi biex jippreżentaw il-kaz ambjentali kontra it-torri ta’ Gasan (Townsquare) f’tas-Sliema. Għax dawn l-uffiċjali, nhar l-4 t’Awwissu 2016 kienu preżenti għas-seduta pubblika tal- Awtorità tal-Ippjanar, imma kollha baqgħu b’ħalqhom magħluq. Dan minkejja l-memo li ħejja Victor Axiaq u li inżammet mistura minn Dr.Timothy Gambin.

Kif qalu l-attivisti ambjentali li iddimostraw quddiem l-uffiċini tal-Awtorità tal-Ambjent u Riżorsi dalgħodu :  l-Awtorità hi baħħ. S’issa jidher li biha u mingħajrha xorta. Ma nafx x’inhu jistenna l-Professur Victor Axiaq biex jirreżenja.

Bħalkom qrajt id-dikjarazzjonijiet tal-Professur Victor Axiak u tal-arkejologu marittimu Dr Timothy Gambin fejn qalu li minkejja li taw il-kontribut professjonali tagħhom fl-EIA tal-Power Station tal-gass f’Delimara huma qatt ma irrappurtaw lill-membri individwali tal-konsorzju.

Huma qalu li jirrappurtaw direttament lill-koordinatur tal-EIA u qatt lill-applikant.

Din il-kontroversja ma bdietx b’Axiaq u Gambin imma ilha sejra is-snin. Ir-responsabbiltajiet ta’ dawk li jħejju l-EIA, irrispettivament lil min jirrappurtaw, m’humiex kompatibbli mar-responsabbiltà li tkun membru tal-Awtorità tal-Ippjanar jew tal-Awtorità tal-Ambjent u r-Riżorsi.

Ma jagħmilx sens illi fuq kaz jagħmlu r-rapport tal-EIA u ma jeħdux sehem fid-deċiżjoni imma fuq każi oħra jibqgħu hemm. Jeħtieġ li jifhmu illi l-funżjoni tal-membri ta’ dawn iż-żewġ awtoritajiet (Ippjanar u Ambjent/Riżorsi) hi waħda li jgħidulha kważi-ġudizzjarja. Meta terfa’ l-piz li tagħti d-deċiżjonijiet ma tagħżilx inti li f’xi każi tħejji r-rapporti u f’oħrajn tiddeċiedi. Qiesu avukat li għal xi kazi jirrappreżenta lill-klijenti tiegħu u għal oħrajn joqgħod fuq il-pultruna ta’ imħallef!

Ma jistgħux ikunu fuq iż-żewġ naħat, anke jekk jiddefinixxu lilhom infushom bħala “indipendenti”. Għax hekk jippretendu li huma. Indipendenti dejjem. Meta jħejju r-rapport jgħidu li huma indipendenti u meta jkunu fuq l-awtorità biex jiddeċiedu jippretendu li huma indipendenti ukoll. Indipendenti minn xiex?

Fil-fehma tiegħi u ta’ ħafna ambjentalisti oħra, l-indipendenza tal-membri individwali tal-Awtorità tal-Ippjanar u tal-Awtorità tal-Ambjent u r-Riżorsi hi kompromessa kull darba li dawn jaċċettaw l-inkarigu li jħejju parti mir-rapport tal-EIA għal xi proġett partikolari.

Iridu jagħżlu. Jew membri indipendenti tal-awtorità inkella esperti indipendenti li jħejju r-rapporti. Imma dawn iridu jagħmlu it-tnejn, kif jgħidu l-Inġliżi: running with the hares and hunting with the hounds!

Kif jista’ membru tal-Awtorità tal-Ippjanar jippretendi li waqt li hu membru ta’ din l-awtorità jibqa’ jipprattika ta’ konsulent dwar l-EIAs? Kif jista’ membru jippretendi li meta titla’ applikazzjoni dwar proġett għal deċiżjoni  quddiem l-Awtorità dwar persuna li kienet “klijent” tiegħu, qiesu ma ġara xejn.

F’pajjiż żgħir bħal tagħna m’huwiex aċċettabbli li l-membri tal-awtoritajiet ikunu fuq ix-żewġ naħat anke jekk f’każi differenti. Hemm konflitti kbar li m’humiex ser jissolvew bid-dikjarazzjonijiet li għalihom kollox sar sewwa.

Għax saru sewwa l-affarijiet biss, fejn xejn m’hu xejn.

Delimara EIA contents

 

Fl-artiklu tagħha tal-bieraħ il-Ħadd fuq is-Sunday Times intitolat Of hats and despicability, Claire Bonello identifikat problema oħra kbira konnessa mal-proċess tal-permessi tat-torrijiet tal-Imrieħel u Tas-Sliema (Townsquare).

Victor Axiak u Timothy Gambin fil-passat riċenti kellhom fost il-klijenti tagħhom lill-gruppi ta’ Gasan u ta’ Tumas li jiffurmaw parti mill-konsortium li twaqqaf għall-Power Station tal-Gass f’Delimara. Għalihom Victor Axiak u Timothy Gambin għamlu xogħol li kien jikkonsisti fi studji dwar impatti ambjentali ta’ dak il-proġett. Axiak dwar l-ekoloġija marittima u Gambin dwar l-arkejoloġija marittima. Il-mistoqsija ċara hi jekk hux etiku li Axiak u Gambin jieħdu sehem f’laqgħat tal-Awtorità tal-Ippjanar li fihom jagħtu l-opinjoni u jiddeċiedu dwar applikazzjonijiet tal-klijenti tagħhom.

Axiak ma attendiex għal uħud mil-laqgħat. Imma la hu u l-anqas Gambin ma ħassew il-ħtieġa li jgħidu li għandhom xi konflitt ta’ interess. Din x’serjetà hi?

L-imġieba korretta mhiex qegħda għall-politiċi biss iżda ukoll għal kull min hu involut fit-teħid ta’ deċiżjonijiet.

The professor who messed things up

Professor Victor Axiaq, Chairman of the Environment and Resources Authority, is not at fault for being absent at a Planning Authority public meeting on the 4 August which discussed the Mrieħel and Sliema high-rise applications. By now everyone is aware that he had just been discharged from hospital and was instructed to rest for 15 days.

There were various officers of the Environment and Resources Authority present for the 4 August public meeting, yet instead of entrusting one of them with presenting the environment’s case on the Sliema high-rise, Professor Axiaq preferred to entrust Dr Timothy Gambin with a memorandum which Gambin opted to keep to himself.

There were various environmentalists, Sliema Local Councillors and civil society activists present for the public hearing. Those of us who were present for the public hearing presented the environment case and managed to convince six out of 13 Planning Authority members to vote against the proposed high-rise at TownSquare Sliema. Support for the environment case from a representative of the Environment and Resources Authority during the public hearing would have been most welcome. It could also have had a determining impact.  Yet it was not forthcoming notwithstanding the presence of a number of the Environment and Resources Authority employees at the public hearing.

The split of MEPA into two separate and distinct authorities, we were irresponsibly told by Government representatives some months ago, would ensure that the environmental issues would be more easily defended when considering land use planning applications. Yet prior to the split, an official of The Environment Protection Directorate would have addressed the public hearing. On the 4 August none were invited. The only person who was briefed to speak (Dr Timothy Gambin) opted instead to ignore his brief and instead openly supported the development proposal for a high-rise at TownSquare.

Professor Victor Axiaq, as Chairman of the Environment and Resources Authority, missed the opportunity to contribute to convince the majority of members of the Planning Authority due to his two basic mistakes. He entrusted his memorandum to another Planning Authority member (Dr Timothy Gambin) who had opposing views and hence had no interest in communicating Professor Axiaq’s memorandum on TownSquare to the Planning Authority. Professor Axiaq also failed to engage with his own staff at the Environment and Resources Authority as none of those present for the public hearing uttered a single word in support of the case against the high-rise proposal. The person sitting on the chair next to me, for example, preferred to communicate continuously with his laptop correcting with track changes some report he was working on. I have no idea why he even bothered to be present for the public hearing.

Unfortunately, Professor Axiaq, as chairman of the Environment and Resources Authority, messed up the first opportunity at which the input of the authority he leads could have made a substantial difference in the actual decision taken. It would have been much better if a proper decision was taken on the 4 August instead of subsequently considering whether to present an appeal, as this will be an uphill struggle as anyone with experience in these matters can confirm.  This could only have happened if Professor Axiaq had acted appropriately, which he unfortunately did not.

Next Wednesday, the Sliema Local Council will be convened for an extraordinary session in order to discuss the planning appeal relative to the TownSquare high-rise development permit. Environmental NGOs will also be meeting presently to plot the way forward and consider whether they too will appeal the decision.

Even the Environment and Resources Authority will be shortly considering whether to appeal. In view of the way in which Professor Axiaq handled the whole issue, the Sliema Local Council and the environmental NGOs would do well if they do not place any trust in the Authority led by Professor Victor Axiaq. They will avoid ending up in another mess.

After creating this mess, there is only one option left for Professor Victor Axiaq in my opinion. He should immediately resign from his post as chairman of the Environment and Resources Authority. The sooner he resigns the better.
