Is-Solidarjetà mhiex għażla, iżda obbligu

Iktar kmieni din il-ġimgħa, Evarist Bartolo, il-Ministru għall-Affarijiet Barranin, b’wiċċ ta’ qdusija artifiċjali, iddikjara fuq it-televiżjoni li kien iddiskuta fit-tul il-kriżi tal-immigrazzjoni li qed tiżviluppa fl-ibħra Maltin mal-Kummissjoni Ewropea, mal-Vatikan u ma uffiċjali mlaħħqin tal-aġenzija tal-Ġnus Magħquda dwar ir-Refuġjati (UNHCR). Ilkoll kienu tal-fehma, qal, li Malta għandha raġun.

Evarist Bartolo qed jipprova jagħti l-impressjoni falza li l-għeluq tal-portijiet Maltin għall-NGOs biex ikunu jistgħu jisbarkaw l-immigranti meħlusa mill-għarqa fl-ibħra ta’ madwarna li qed jiżviluppaw f’ċimiterju hi aċċettabbli u jew raġjonevoli għall-komunità internazzjonali. Il-verità hi ferm differenti minn hekk.

Il-Ħodor, kemm f’Malta kif ukoll fl-Unjoni Ewropea, repetutament emfasizzaw li Malta ma tistax titħalla terfa’ waħedha dawn l-obbligi ta’ salvataġġ. Dan ġie emfasizzat din il-ġimgħa stess fi stqarrija konġunta bejn il-Partit tal-Ħodor Ewropej (EGP) u Alternattiva Demokratika. Is-solidarjetà fjakka jew ineżistenti ma tħassarx l-obbligi ta’ Malta fiż-żona ta’ salvataġġ li hi responsabbli għaliha fil-Mediterran ċentrali.

Hi tabilħaqq sfortuna li tul is-snin, Malta, repetutament ippruvat taħrab mir-responsabbiltajiet tagħha. Ilkoll niftakru meta l-PN fil-Gvern wasal fi ftehim mal-Gvern immexxi minn Silvio Berlusconi fl-Italja biex il-qawwiet tal-baħar Taljani jimbuttaw lura d-dgħajjes mgħobbija bl-immigranti li jkunu telqu mill-kosta Libjana.

Iktar qrib fiż-żmien il-Gvern immexxi minn Joseph Muscat wasal f’xi forma ta’ ftehim sigriet imma mhux miktub (safejn hu magħruf) li permezz tiegħu il-Gvern Taljan immexxi minn Matteo Renzi b’mod li ma waslux iktar immigranti f’Malta għal perjodu twil.

Imbagħad hemm il-każ ta’ Neville Gafà, il-mibgħut speċjali tal-Prim Ministru Joseph Muscat u l-laqgħat li hu kellu ma’ Haithem Tajouri mexxej tal-brigati rivoluzzjonarji ta’ Tripli. Tajouri, mid-dehra viċin ħafna tal-Gvern ta’ Joseph Muscat jissemma f’rapport ta’ ‘l fuq minn 200 paġna tal-Ġnus Magħquda liema rapport hu dwar ksur ta’diversi drittijiet tal-bniedem. Skond l-istess rapport Tajouri hu responsabbli ukoll għal ċentru privat ta’ detenzjoni fejn jinżammu ħafna nies.

Fl-istampa lokali kien ġie rappurtat ukoll li kien hemm laqgħat fil-Libja bejn Neville Gafà, l-mibgħut speċjali tal-Prim Ministru, Joseph Muscat, u uffiċjali għoljin tal-Gvern Libjan. F’dawn il-laqgħat, li għalihom attenda Kurunell mill-Forzi Armati ta’ Malta ġew diskussi l-mezzi li kellhom jintużaw biex iwaqqfu l-immigrazzjoni. L-ismijiet u r-ritratti ta’ dawk presenti kienu ġew ippubblikati.

Dan m’għadux effettiv għax illum jidher li nbidlet l-istrateġija u jeħtieġilna li niffaċċjaw allegazzjonijiet serji fil-konfront tal-Forzi Armati ta’ Malta dwar sabutaġġ tal-opri tal-baħar użati minn dawk li qed ifittxu l-ażil. Qed ikun allegat li s-suldati/baħrin tal-patrol boat P52 qatgħu l-cable tal-mutur li bih kienet għaddejja l-opra tal-baħar b’mod li ħallihom bejn sema’ u ilma fiż-żona ta’ tiftix li hi responsabbiltà ta’ Malta.

Prosit lill-NGO Repubblika li qed tinsisti li issir investigazzjoni kriminali dwar dan l-inċident biex jiġi stabilit eżattament x’ġara u min huwa responsabbli għalih. Kont nistenna li kellu jkun il-Kmandant tal-Forzi Armati minn rajh li jagħti bidu għall-investigazzjoni hekk kif saru dawk li s’issa għadhom allegazzjonijiet. Ma kellux joqgħod jistenna li jkun ħaddieħor li jinsisti li dan isir.

Il-proposta riċenti tal-Ministru Bartolo biex l-Unjoni Ewropeja tgħin lil-Libja b’mod li ittaffilha l-piz umanitarju li qed iġġorr bħalissa kif ukoll biex ikun iffaċilitat li l-komunità internazzjonali tkun tista’ tipprovdi l-għajnuna tant meħtieġa kemm lir-refuġjati kif ukoll lil-Libjani infushom hi pass il-quddiem. Imma tajjeb li jkun ċar illi minkejja d-diffikultajiet kollha fil-Libja nnifisha dan diġa qed isir.

Fil-fatt mill-2014 sal-lum l-Unjoni Ewropeja diġa ħarget għajnuna umanitarja ta’ madwar €50 miljun indirizzata lejn il-Libja.

Sfortunatament la hemm rieda u l-anqas aptit għal soluzzjoni Ewropea fost il-Gvernijiet tal-Unjoni Ewropeja u dan minkejja li erbgħa fost l-ikbar pajjiżi tal-unjoni (il-Ġermanja, Franza, Spanja u l-Italja), xi ġranet ilu ħadu inizjattiva biex il-migrazzjoni tirritorna fuq l-aġenda.

Naħseb li lkoll napprezzaw li s-sitwazzjoni hi waħda diffiċli. Imma anke f’dawn iċ-ċirkustanzi kulħadd għandu jerfa’ r-responsabbiltajiet tiegħu.

Il-Gvern Malti għandu jibdel ir-rotta u flok ma jibqa’ kontinwament ifittex li jipprova jaħrab mir-responsabbiltajiet tiegħu ifittex li jaħdem id f’id mal-NGOs li qed isalvaw il-ħajjiet b’mod li qed jagħmlu ħidma li messha qed issir mill-Gvernijiet. Li jkun hemm min jipprova jimita lil mexxej lemini Matteo Salvini biex ikunu kkriminalizzati l-NGOs iservi biss biex tkompli tixtered il-mibgħeda imżejna b’lingwaġġ taparsi patrijottiku.

Hemm il-ħtieġa li l-Gvern Malti jifhem li s-solidarjetà mhiex għażla, imma dmir.

Solidarity is not an option but a duty

Earlier this week, Foreign Minister Evarist Bartolo sanctimoniously declared on TV that he had discussed at length the immigration crisis in Maltese waters with the EU Commission, with the Vatican and with senior officers of UNHCR. All agreed, he said, that Malta was in the right.

Mr Bartolo is trying to create a false perception that the closure of Maltese ports to NGOs disembarking immigrants saved from being engulfed in the cemetery developing around us is reasonable and acceptable to the international community. He cannot be more distant from the truth.

Greens, both in Malta and in the EU, have repeatedly emphasised that Malta cannot shoulder its “save and rescue responsibilities” on its own. This was emphasised as recently as this week in a joint statement between the European Green Party and Alternattiva Demokratika. However, inadequate or at times inexistent solidarity from EU member states does not absolve Malta of its international responsibilities from coordinating safety and rescue operations within its area of responsibility in the central Mediterranean.

It is indeed unfortunate that over the years Malta has repeatedly tried to wriggle out of its responsibilities. We do remember when the PN led government arrived at an agreement with the Berlusconi administration in Italy in order that the Italian navy pushes back all departing boats carrying immigrants along the Libyan coast.

Closer in time the Joseph Muscat administration is known to have arrived at some sort of secret but unwritten agreement with the then Renzi led government in Italy such that the arrival of immigrants in Malta trickled down to zero.

What about Neville Gafà, then special envoy of Prime Minister Joseph Muscat and his meetings with Libyan militia leader Haithem Tajouri of the Tripoli Revolutionary brigades? Tajouri, apparently a close acquaintance of the Muscat led government was singled out in a United Nations report for a number of human rights breaches. He is also, according to the same report, responsible for the running of a private detention centre where many are held in captivity.

It was also reported in the press that at a point in time Neville Gafà, envoy of the Prime Minister had accompanied the Maltese Colonel in charge of AFM Operations at high level meetings in Libya to stem immigration. Photographs and names were published.

Apparently this is no longer effective as we now have to face serious allegations of AFM personnel sabotaging rubber boats carrying asylum seekers in Maltese waters. It is being alleged that the crew of patrol boat P52 cut the cable of the motor driving the rubber boat carrying the asylum seekers leaving them adrift in the Maltese search and rescue area. Hats off to NGO Repubblika for filing criminal complaints. I would have expected the Commander of the Armed Forces to initiate an investigation himself without the need for any prompting, as soon as the allegations surfaced.

The recent proposal of Minister Bartolo for the EU to engage with Libya in order to lessen its humanitarian burden and enable the international community to provide much-needed assistance to both refugees and the Libyan people is positive. It is however to be underlined that this is already being done notwithstanding the difficult circumstances within Libya itself.

The EU has in fact disbursed around €50 million in humanitarian aid utilised in Libya since 2014.

Unfortunately there is no will among EU governments for an EU solution even though the four largest EU countries (Germany, France, Spain and Italy), a couple of days ago, have taken steps to push the migration issue back onto the EU agenda.

Everyone recognises that the situation is very difficult. Everyone must however shoulder their responsibilities.

The Maltese government should change tack and instead of constantly seeking ways to wriggle out of its responsibilities actively develop a close collaboration with those NGOs who have volunteered to deploy their own rescue missions to save lives, thereby filling in the gaps left by the EU states. Aping Italian right-wing leader Matteo Salvini in criminalising NGOs only serves to further encourage pseudo-patriotic vitriol.

It is about time that the Maltese Government recognises that solidarity is not an option but a duty.

L-ostaklu tal-aċċess għall-informazzjoni hu delitt kontra d-demokrazija

Ir-rapport Annwali tal-Ombudsman għall-2017 li kien ippubblikat iktar kmieni din il-ġimgħa hu inkwetanti. F’partijiet minnu, nazzarda ngħid li hu ukoll tal-biża’. L-Ombudsman jikkummenta fit-tul dwar “in-nuqqas tal-amministrazzjoni li tipprovdi informazzjoni”.

Josserva żewġ tendenzi ġenerali.

L-ewwel tendenza hi li diversi Dipartimenti tal-Gvern u Ministeri qed isibuha bi tqil biex jiżvelaw informazzjoni importanti. Il-kliem li l-Ombudsman juża’: “Sfortunatament l-amministrazzjoni pubblika – u dan jinkludi ukoll awtoritajiet pubbliċi – jidher li addottaw attitudni ġeneralment negattiva dwar l-obbligu li tkun żvelata informazzjoni u d-dritt taċ-ċittadin li jinżamm infurmat. Uħud marru fl-estrem li anke qed jirrifjutaw li jipprovdu kemm informazzjoni importanti kif ukoll imformazzjoni vitali li l-pubbliku hu ntitolat għaliha minħabba li din tikkonċerna setturi importanti tal-ħajja ekonomika u soċjali tal-pajjiż.”

It-tieni tendenza hi agħar: diversi ftehimiet li daħal għalihom il-Gvern fihom klawsola li tobbliga li jinżamm is-skiet dwar il-kontenut tal-ftehim. Dak li hu magħruf bħala “non-disclosure clause”. L-Ombudsman jgħidilna li issa hawn “żvilupp riċenti u Inkwetanti permezz ta’ attentat biex jiġi assigurat skiet totali hi l-prattika li torbot lil dawk li magħhom l-amministrazzjoni pubblika jkollha rabta kuntrattwali biex ma tiżvelax informazzjoni fil-kuntratti infushom mingħajr l-approvazzjoni tal-awtoritá pubblika.”

Issa fir-realtá, din il-prattika ma ġietx addottata f’daqqa waħda fl-2017. Kien hemm okkazjonijiet fil-passat meta l-Gvern rabat lil oħrajn inkella aċċetta li jintrabat hu stess li ma tkunx żvelata informazzjoni. Jidher imma li din il-prattika qed iżżid fil-frekwenza. Mhux biss il-kuntratt ta’ Henley and Partners dwar il-bejgħ taċ-ċittadinanza li fih dawn il-provedimenti imma ukoll il-kuntratt dwar il-privatizzazzjoni tal-lotteriji pubbliċi mal-Maltco kif ukoll il-ftehim dwar il-privatizzazzjoni parzjali tas-sistema tas-saħħa mal-Vitals Healthcare inkella l-ftehim mal-Electrogas dwar il-qalba għall-gass tal-impjant tal-ġenerazzjoni tal-elettriku f’Delimara.

Kif jista’ jkun li gvern jippretendi li jkun trasparenti u kontabbli meta juża’ jew jippermetti l-użu ta’ strateġiji bħal dawn li jostakolaw li tkun żvelata l-informazzjoni?

L-Ombudsman hu korrett li jipponta subgħajh lejn dan in-nuqqas bażiku ta’ servizz pubbliku li jridha ta’ wieħed ġust, effiċjenti, trasparenti u kontabbli. Jiena naħseb li dan hu daqstant importanti li jimmerita diskussjoni fil-Konvenzjoni Kostituzzjonali – jekk din xi darba issir. Forsi wasal iż-żmien li tkun il-Kostituzzjoni innifisha li tillimita b’mod strett lill-amministrazzjoni pubblika milli tibqa’ tillimita l-aċċess għall-informazzjoni b’dan il-mod.

Hu meħtieġ li jkollna s-salvagwardji kontra dan l-abbuż sfaċċat li qiegħed jostakola l-aċċess għall-informazzjoni li għandha f’idejha l-amministrazzjoni pubblika. Is-salvagwardji jistgħu jinkludu l-possibilitá ta’ reviżjoni amministrattiva immedjata li tikkanċella l-ostaklu għall-aċċess kif ukoll passi biex dawk responsabbli biex jostakolaw dan l-aċċess għall-informazzjoni mingħajr raġuni valida ma jitħallewx iktar jeżerċitaw il-funzjonijiet ta’ uffiċċju pubbliku.

L-Ombudsman jispjega fir-rapport tiegħu li l-liġi tagħti lill-uffiċċju tiegħu l-għodda meħtieġa biex ikollu aċċess għall-informazzjoni li jeħtieġ ħalli “jmexxi l-investigazzjonijiet dwar l-ilmenti li jkunu waslu” avolja din l-informazzjoni xi drabi tingħata b’mod imqanżaħ. Iżda l-Ombudsman iqis li għandu jiġbed l-attenzjoni għal tlett ċirkustanzi partikolari “li juru kif ir-rispons negattiv tal-awtoritajiet pubbliċi meta dawn jintalbu informazzjoni qed ixekkel l-Ombudsman u lill-Kummissarji fl-uffiċċju tiegħu fil-qadi ta’ dmirijiethom”.

L-ewwel kaz jirrigwarda l-Armata. Ir-rifjut tal-Ministeru għall-Intern u s-Sigurtá Nazzjonali li jgħaddi l-files kollha dwar l-eżerċizzji ta’ promozzjonijiet għall-għola gradi fl-Armata issolva biss wara d-deċiżjoni finali tal-Qorti tal-Appell f’Ottubru 2016 liema deċiżjoni ikkonfermat li Ombudsman kellu l-obbligu li jinvestiga l-ilmenti li rċieva.

It-tieni kaz jirrigwarda ir-rifjut tal-Ministeru tas-Saħħa li jipprovdi l-informazzjoni mitluba mill-Kummissarju għas-Saħħa biex dan jipprovdi il-ftehim sħiħ ma’ Vitals Healthcare dwar il-privatizzazzjoni ta’ sptarijiet f’Malta u Għawdex li kien meħtieġ fl-investigazzjoni dwar jekk l-interessi tal-pazjenti u l-istaff (mediku) kienux adegwatament imħarsa.

It-tielet kaz hu dwar l-ilmenti kontinwa tal-Kummissarji fl-uffiċċju tal-Ombudsman (Saħħa, Ippjanar/Ambjent u Edukazzjoni) dwar id-dewmien li qed jirriżulta f’investigazzjonijiet li jkunu jeħtieġu konklużjoni immedjata. Dan minħabba n-nuqqas tas-settur pubbliku li jagħti tweġiba għat-talbiet diversi għal informazzjoni.

L-obbligu tal-amministrazzjoni pubblika li tiffaċilita l-aċċess għall-informazzjoni u d-dritt taċ-ċittadin li jkun infurmat huma bażiċi f’soċjetá demokratika. Attentati biex dan l-aċċess taċ-ċittadin għall-informazzjoni jkun imblukkat b’dan il-mod jimmina l-proċess demokratiku u dan billi ċ-ċittadin qed ikun ostakolat milli jifforma opinjoni fuq kif qed ikun amministrat l-istat. Dan qiegħed ukoll jostakola lil dawk l-istituzzjonijiet fid-dmir li jiddefendu ċ-ċittadin komuni milli jagħmlu xogħolhom.

F’isem Alternattiva Demokratika jiena nirringrazzja lill- Ombudsman talli qed ikun daqstant ċar fid-difiża tiegħu ta’ dak li hu bażiku f’soċjetá demokratika kif ukoll talli qed isemma’ leħnu b’vuċi ċara kontra dan l-abbuż ta’ poter.

Obstructing access to information is a crime against democracy

The Ombudsman’s 2017 Annual Report, published earlier this week, is very worrying. At times it makes scary reading. The Ombudsman comments at length on “the failure by the administration to provide information” and points at two general trends.

The first of these is the reluctance of various Government Departments and Ministries to disclose important information. The exact words  from the Ombudsman’s report,  which I quote verbatim, are: “Regrettably the public administration – and this includes public authorities – appears to have adopted a generally negative approach towards its duty to disclose information and the citizen’s right to be informed. Some have gone to extremes by even refusing to provide important and even vital information to which the public was obviously entitled since it concerned important segments of the economic and social life of the country.”

The second trend is even worse: various agreements entered into by government are containing a non-disclosure clause. The Ombudsman states “An even more worrying, recent development that has come to light in an attempt to ensure a total blackout of silence is the practice of binding parties with whom the public administration enters into contractual agreements not to disclose information on the contracts themselves without prior approval from the public authority.”

Now, in fairness, this practice has not been adopted suddenly in 2017. There have been a number of instances in the past where the government bound others, or else accepted to be bound, not to disclose information. Apparently this is now increasing in frequency. It is not just the contract with Henley and Partners on the sale of Maltese citizenship which contains such provisions but also the contract concerning the privatisation of the public lottery system with Maltco, as well as the agreements on the partial privatisation of the Health service with Vitals Healthcare as well as the Electrogas agreements in relation to the Delimara power station changeover to gas.

How can a government claim to be transparent and accountable when it uses or permits the use of the non-disclosure weapon?

The Ombudsman is right to point out this basic deficiency of a public service which pretends that it is fair, efficient, transparent and accountable. I consider that it is also of such importance that it merits discussion in the Constitutional Convention, if this is ever convened. Maybe it is about time that the Constitution should limit very strictly the use by the public administration of non-disclosure as a tool to obstruct the public’s access to information.

Safeguards are required against the abusive use of the non-disclosure of information held by the public administration. Such safeguards could include access to fast track administrative review as well as both publication of the suppressed information and the prohibition from holding public office of those found guilty of blocking the public’s access to information without valid reason.

The Ombudsman explains in his report that the law provides his office with the tools to ensure that it has access to the information it requires “to conduct its investigations into complaints received”, even though this information is at times made available very reluctantly. However, the Ombudsman considers it appropriate to underline three specific instances “that show how the negative response of public authorities to provide information hindered the Ombudsman and his Commissioners in the exercise of their functions”.

The first instance is that concerning the Armed Forces of Malta. The refusal by the Ministry for Home Affairs and National Security to provide all files relating to promotion exercises in the top echelons of the AFM was only resolved after a definite decision of the Court of Appeal in October 2016, which confirmed that the Ombudsman had a duty to investigate the complaints received.

The second instance is that concerning the refusal of the Ministry of Health to comply with the request of the Commissioner of Health to supply “clean copies” of the agreements with Vitals Healthcare on the privatisation of hospitals in Malta and Gozo which were required in the investigation into whether the interests of patients and staff were being adequately protected.

The third instance is that of repeated complaints in all the reports of the Commissioners attached to the Ombudsman’s office [Health, Planning/Environment and Education] on the resulting delay in investigations which, by their very nature, require an immediate response. These delays are the direct result of the failure of various sectors in the public administration to submitting an expedient reply to requests for information.

The duty of the public administration to disclose information, and the right of the citizen  to be informed, is basic in a democratic society. Attempts to block the essential flow of information to the citizen through non-disclosure tools undermines the democratic process, as it blocks the essential elements required by the citizen in order to form a clear and unbiased opinion on the way in which the state is being administered. Moreover, it obstructs those institutions entrusted with defending the common citizen from carrying out their duty.

On behalf of Alternattiva Demokratika-The Green Party, I thank the Ombudsman for taking such a clear and unequivocal stand in favour of the basic tenets of democratic rule and against such blatant abuse of authority.

Iż-żamma tal-ordni pubbliku fil-Marsa

L-ordni pubbliku nassoċjawh mal-Pulizija. Għax normalment hu xogħol il-Pulizija li żżomm l-ordni pubbliku. Ikun hemm mumenti straordinarji li l-pulizija jkollhom bżonn l-għajnuna. F’dawn iċ-ċirkustanzi ħafna drabi l-pulizja jingħataw l-għajnuna tal-armata.

M’hiex sitwazzjoni normali li l-armata tkun iddur fit-toroq biex iżżomm l-ordni pubbliku. Dan iseħħ jew f’mumenti ta’ emergenza inkella meta d-demokrazija tkun taħt theddida. Hekk isir fid-dinja kollha.

Huwa f’dan il-kuntest li wieħed għandu jqis id-dikjarazzjoni tal-Prim Ministru nhar l-Ħadd li għadda f’Santa Luċija dwar il-presenza tal-armata fit-toroq tal-Marsa biex tgħin lill-Pulizija fiż-żamma tal-ordni pubbliku. Iktar kmieni tkellem ukoll il-Ministru tal-Intern fuq l-istess punt.

Irrid ngħid li m’huwiex xogħol l-armata li tinżel fit-toroq. L-armata m’hiex imħarrġa għal hekk. It-taħriġ tagħha huwa biex tiddefendi lil pajjiż fil-konfront ta’ perikli ġejjin minn barra xtutna. Biż-żmien l-armata ngħata ukoll it-taħriġ biex tintervjeni f’każ ta’ diżastri naturali, bħal għargħar, kif ġieli fil-fatt tagħmel meta tgħin lid-Dipartiment tal-Protezzjoni Civili. Dan hu kollu tajjeb u l-armata jixirqilha l-grazzi tagħna lkoll għal dak kollu li jirnexxielha twettaq.

Kemm il-Prim Ministru f’Santa Luċija kif ukoll il-Ministru tal-Intern fil-Marsa iktar qabel, ħabbru ukoll li fl-Għassa tal-Marsa ser jibda jkun hemm Spettur kif ukoll li l-presenza tal-Pulizija fil-Marsa ser tiżdied bl-Ghassa tibda tkun miftuħa għal 24 siegħa kuljum. Dan hu kollu tajjeb għax il-presenza tal-Pulizija fit-toroq hi ta’ għajnuna kbira fiż-żamma tal-ordni pubbliku. Għax huwa meħtieg presenza ikbar ta’ pulizija fit-toroq tagħna, mhux biss fit-toroq tal-Marsa imma f’dawk tal-pajjiz kollu.

Fi ftit kliem hi l-pulizja li għanda tkun inkarigata miż-żamma tal-ordni pubbliku mhux l-armata. Dan jgħodd għall-Marsa u għal kull rokna ta’ Malta.

Dan jagħti sinifikat ikbar lil ħidma tal-Ombudsman biex jinvestiga l-ilmenti ta’ numru ta’ fizzjali dwar il-mod kif ingħataw il-promozzjonijiet. Bil-Kmandant innifsu jagħmel il-high jump u jieħu numru ta’ promozzjonijiet f’4 ġimgħat.

Minħabba l-budget intilfet ftit l-attenzjoni minn fuq id-deċiżjoni dwar il-kawża li fetaħ l-Ombudsman biex ikun dikjarat jekk għandux il-jedd (jew forsi aħjar l-obbligu) li jinvestiga l-ilmenti li rċieva mingħand l-uffiċjali tal-armata.

Fi stqarrija li ħriġt nhar it-Tnejn fil-għodu f’isem Alternattiva Demokratika, hekk kif ħarġet id-deċiżjoni, apparti li lqajt b’sodisfazzjon d-deċiżjoni tal-Imħallef Wenzu Mintoff esprimejt it-tama li wara din id-decizjoni l-Gvern ma jibqax jostakola lill-Ombudsman fil-qadi ta’ dmirijietu.

Din id-deċiżjoni timmarka punt importanti ħafna fil-ħidma tal-Ombudsman fid-difiża tiegħu taċ-ċittadin Malti. B’din id-deċiżjoni ġie assigurat li anke fl-armata allegazzjonijiet ta’ abbuż ta’ poter għandhom ikunu investigati.

Naħseb li ilkoll nippreferu li ma jkunx hemm abbuż. Imma jekk l-abbuż iseħħ, din id-deċiżjoni tal-Qorti isserħilna rasna li ħadd ma hu il-fuq mil-liġi.

Dan kien pass kbir il-quddiem fit-tisħiħ tal-istituzzjonijiet demokratiċi tal-pajjiż.

This will be a simulation exercise coordinated by Malta’s Civil Protection Department at 4pm next Thursday in Gozo and three hundred people will be involved.

It will be carried out with EU assistance and in conjunction with the Civil Protection Authorities in Sicily who are partners with the Maltese Civil Protection Department (CPD) in establishing a network within the region that is able to manage seismological disasters.

This exercise signals the coming of age of Malta’s CPD. It has to date delivered sterling service in the areas of fire-fighting, managing pollution and providing assistance required as a result of flooding after heavy storms. Training its staff, and subjecting them to a gruelling simulation exercise, is a gigantic step forward for the CPD. It is the first step of a long journey that is dependent on the dedication of the CPD staff  – which is unlimited – as well as the resources allocated by the state. Such resources, although limited over the years, seem to be slowly trickling down, for a change.

Developing the CPD’s ability to handle disasters will be a major challenge. For a start it will identify its capability to develop effective coordination with the Police Force, with the AFM (Armed Forces) and the health authorities as well as with local councils.

At the end of the day the CPD’s proficiency in disaster management will be measured in terms of its response time as well as the number of lives it saves in such situations. This will generally depend on the severity of the disaster with which it is faced.

This will not only translate into a general level of preparedness. It will also require focusing on the needs of the most vulnerable in our communities and in this respect the role of local councils is indispensable. Specific protocols need to be developed and tested in conjunction with local councils regarding the assistance required by children and those who are bedridded or disabled. Catering for all disabilities is an indispensible prerequisite and it requires trained personnel to which the CPD currently has no access. It is an easily identifiable deficiency which needs to be addressed forthwith.

One small example would suffice: how would the CPD personnel, the police, the AFM – or the health authorities for that matter – communicate with persons with  impaired hearing in the absence of staff able to communicate in sign language? Addressing this deficiency is required not just to ensure that Malta is adequately prepared for disaster management. It is also an everyday deficiency that every authority in Malta that offers a direct service to the population at large needs to address. With around five hundred known Maltese with impaired hearing and a number of others who may have remained below the radar, this is an issue which is manageable primarily at a local level. Yet to date it has not been adequately prioritised.

In this context, one would also need to query the level of preparedness of institutions such as Mount Carmel Hospital and id-Dar tal-Providenza. I am informed that even when it comes to fire drills in residential homes for the elderly, the results were not impressive, to put it mildly.

Prompt and effective coordination between the different authorities is crucial in ensuring disaster management. There is a need to test how the different types of equipment used by the CPD, the Police and the AFM interact. Are they compatible? The planned simulation exercise is an opportunity to identify whether, in an actual practice run, matters will work out as planned. Lessons learned in this area will have to be translated into better procurement procedures in the future to ensure smooth interaction between the CPD, the police and the Army.

This will translate into compatible communication equipment as well as adequately maintained vehicles, sea craft and aeroplanes/helicopters which can be used in difficult circumstances. Knowing that maintenance of equipment has never been our forte, this could be quite a challenge!

The simulation exercise on Gozo on 3 September will necessarily lead to a number of lessons learnt which will have to be acted upon in order that Malta’s capability in disaster management is enhanced. This is definitely a bold step in the right direction.

I look forward to the next steps which require the involvement of local authorities.

Hu tal-mistħija li l-Ombudsman qiegħed jiġi miżmum milli jinvestiga l-ilmenti fl-Armata. Iktar u iktar meta l-argument diġa’ qam xi snin ilu u ġie riżolt bil-kelma t-tajba.

L-attitudni tal-Ministru Manwel Mallia w is-Segretarju Permanenti fil-Ministeru tiegħu hi ta’ ħsara għad-demokrazija fil-pajjiż.

L-Ombudman qiegħed hemm biex jinvestiga u jara x’wassal għall-ilmenti li jkollu quddiem. Min dan ma jifhmux u jostakolah m’għandux ikun afdat bil-poter politiku.

Inġustizzji fl-armata ………… u l-Ombudsman?

Ġie konkluż rapport dwar inġustizzji fl-armata. Intqal li nstab li 60% tal-ilmenti li ġew investigati mill-Bord tal-Ilmenti li twaqqaf, kienu ilmenti ġustifikati u li allura l-Gvern issa għandu l-obbligu li jirrimedja.

Spiss nisimgħu b’ilmenti dwar l-Armata, u ma naħsibx li dawn ser jieqfu. Id-diffikulta naħseb li hi d-dixxiplina militari li wisq nibbża’ li tintuża biex taħbi l-inġustizzji.

Jiena ma naf xejn dwar l-ilmenti li ġew investigati. Naf biss dak li jgħiduli ħbieb li għandhom jew kellhom familjari fl-Armata. Jgħiduli li għad hemm iżjed ilmenti x’jiġu investigati u li probabbilment ikun hemm numru mhux żgħir minn dawk li baqa’ li jinstabu li huma ukoll ġustifikati.

Intqal lili li fi ċrieki militari huma magħrufin fatti tat-twerwir f’dak li hu trattament ta’ uffiċjali u gradi oħra minn klikka li kienet tmexxi l-Armata u li, huwa evidenti, li l-uniċi kwalifiċi ta’ din il-klikka kienu il-lejalta’ assoluta lejn il-politiċi fil-Gvern u d-dellijiet tagħhom. Jgħiduli kif kienu jissawwru career development paths u kif biex jinqabżu ċerti nies anki r-rapporti annwali tagħhom ma kienux isiru.

U tant affarijiet oħra.

Fuq dan kollu jiena nistaqsi mistoqsija sempliċi. Għaliex ħadd ma mar għand l-Ombudsman b’dawn l-affarijiet? Għax l-iktar konklużjoni li qed tinkwetani mhux li saru inġustizzji fl-Armata (dik diġa inkwetanti ħafna) imma li f’post sensittiv bħall-Armata l-uffiċċju tal-Ombudsman li twaqqaf fl-1995 qed jirriżulta li ma kienx effettiv.

Il-mistoqsija li aħna l-politiċi irridu nistaqsu hi għaliex? Huwa importanti li tinstab it-tweġiba malajr għax l-inġustizzji hu importanti li niġġieldulhom dejjem u mill-ewwel.
