Imnawwar minn ġewwa

Sal-ħin li qed nikteb, l-investigazzjoni interna tal-Pulizija nfirxet minn waħda iffukata fuq it-taqsima tat-traffiku għal taqsimiet oħra tal-korp. Bosta huma mnixxfa kif dawk li suppost iżommu l-ordni u jħarsu l-osservanza tal-liġi qed jiġu nvestigati huma stess dwar allegazzjionijiet ta’ abbuż minn fondi pubbliċi kif ukoll allegazzjonijiet li talbu flus biex ma jagħmlux dmirhom (speċi ta’ protection money).

Supretendent u numru ta’ uffiċjali oħra, rinfaċċjati bil-provi rreżenjaw mill-korp. Numru mhux żgħir ta’ pulizija ġew interrogati.

M’għandniex inkunu sorpriżi b’dan kollu, għax dan huwa kollu riżultat dirett ta’ kultura ta’ impunità li ġiet imxettla b’mod kontinwu mill-Partit Laburista fil-Gvern tul dawn l-aħħar snin. Xejn mhu xejn. B’xi mod jew ieħor kollox jibqa’ għaddej, jew kważi.

Il-Prim Ministru Robert Abela stqarr li l-fatt illi l-Pulizija stess qed jinvestigaw lill-pulizija li dwarhom hemm l-alegazzjonijiet huwa indikazzjoni ċara li l-istituzzjonijiet fil-pajjiż qed jaħdmu sewwa. Fil-fehma tiegħi din hi analiżi skorretta. Dak li qed jiġri trid tarah ukoll fil-kuntest tal-ħbiberija żvelata bejn dak li kien Deputat Kummissarju tal-Pulizija Silvio Valletta u Yorgen Fenech, (l-allegat mandant tal-assassinju ta’ Daphne Caruana Galizia). F’dan il-kuntest, l-investigazzjoni tindika li l-korp tal-Pulizija huwa mnawwar minn ġewwa.

Fil-waqt li l-parti l-kbira tal-membri tal-korp tal-Pulizija huma persuni serji, għandu jkun sottolinejat li mhux l-ewwel darba li rriżulta li uffiċjali anzjani tal-korp tal-pulizija kienu viċin ta’ persuni li kienu taħt investigazzjoni. Kaz ieħor riċenti li niftakar hu ta’ uffiċjal imlaħħaq fit-taqsima tar-reati ekonomiċi (spettur) li kien viċin ħafna ta’ operatur fl-industrija tal-logħob tal-ażżard. Tant kien viċin tiegħu li anke kellu l-aċċess biex jutilizza karozza privata ta’ din il-persuna, Ferrari. Il-każ imur lura sal-2015 meta missier l-ispettur, kien agent Kummissarju tal-Pulizija. Għax il-każ taz-ziju Silvio ċertament mhux l-uniku wieħed.

Kien il-kandidat laburista Andy Ellul li f’artiklu ppubblikat fuq it-Times tat-28 ta’ Jannar 2020 li stqarr li “Police commissioners form part of the executive and they have to toe the electoral programme of the government of the day”. Huwa ċertament ta’ sfortuna li Andy Ellul jikkunsidra li l-pulizija għandha funzjoni politika għax l-implimentazzjoni tal-manifest elettorali hi funzjoni tal-politiċi u tagħhom biss.

Dak li qal Andy Ellul jispjega ħafna dwar meta, kif u għaliex (uħud) mill-Pulizija jaġixxu u jinvestigaw. Andy Ellul kien hu nnifsu membru tal-korp tal-pulizija u allura suppost li jaf ferm iktar minn hekk!

Meta l-Panama Papers saru materja pubblika x’investigazzjoni għamlet il-pulizija? Abbażi ta’ dak li ġie osservat min-naħa tal-uffiċċju tal-Prim Ministru f’Kastilja, il-Pulizija ġew jaqgħu u jqumu. Konrad Mizzi u Keith Schembri ma ġewx mitluba biex jerfgħu ir-responsabbiltà għall-azzjonijiet tagħhom meta waqqfu kumpaniji sigrieta fil-Panama: ħelsuha ħafif. Għaldaqstant wara dan il-messaġġ ċar li qiesu ma ġara xejn, ħadd ma għandu jkollu l-ebda dubju x’kejl kellu japplika għall-pulizija u għall kull min jagħmel affarijiet li s-soltu ma naċċettawhomx. Kien biss meta l-whistle-blower saffar li l-investigazzjoni kellha tibda. Hawn xi ħadd li jemmen li b’mod ġenwin ħadd ma nduna b’xejn? Hu ċar li bosta ħadu sehemhom u allura b’mod konvenjenti “ħadd ma nduna xejn”.

It-triq biex tissewwa l-ħsara li saret lir-reputazzjoni li Malta kisbet illum il-ġurnata mhix triq faċli. Li tkun stabilita mill-ġdid il-fiduċja fil-korp tal-Pulizija hu pass wieħed żgħir minn ħafna meħtieġa.

Malta bil-mod qed tiġi trasformata f’soċjeta amorali fejn il-prinċipji aċċettabbli ta’ imġieba korretta qed jintremew il-baħar. Hemm min jiddieħaq bihom ukoll.

Rappresentanti tas-settur tas-servizzi finanzjarji qalulna li hemm bżonn is-sehem ta’ kulħadd biex naslu li nnaddfu isem Malta mill-ġdid. Huwa ftit diffiċli biex wieħed jifhem kif nistgħu naslu meta hu ċar għal kulħadd li l-korp tal-Pulizija hu mnawwar minn ġewwa.

Rotten to the core

At the time of writing, the Police internal investigation has widened from one focused on the traffic section to other police units. Many are shocked that the upholders of law and order are themselves under investigation in respect of allegations on the fraudulent use of public funds as well as the allegation of being in receipt of protection money.

Faced with the available evidence, a Superintendent – as well as a number of other police officers – has resigned. It is reported that substantial number of officers were interrogated, with some being released on police bail.

I am not at all surprised because, in my view, this is the direct consequence of the culture of impunity which the Labour Party in government has continuously nurtured for the past six years during which it has been in office.

Prime Minister Robert Abela has stated that the fact that the police are investigating their own is, in itself, an indicator that the institutions are functioning properly. His assessment is, in my view, incorrect. Together with the revelations regarding the close friendship of former Police Deputy Commissioner Silvio Valletta and Yorgen Fenech, (the suspected mastermind of Daphne’s assassination), the police investigation is more of an indication that a section of the Police Force may be rotten to the core.

While most of the members of the Police Force are beyond reproach, it has to be underlined that this is not the first instance, in recent years, when senior police officers were reported as being too close to people under investigation. A specific case that comes to mind is that of a senior police officer in the Economic Crimes unit who was so close to an operator in the gaming industry – then under investigation – that it was then reported in the media that he had access to, and made use of, the operator’s private vehicle, a Ferrari. The case goes back to 2015. Uncle Silvio’s case is definitely not a one-off.

It was Labour Party candidate Andy Ellul who, in an opinion published in The Times on 28 January 2020 stated that “Police commissioners form part of the executive and they have to toe the electoral programme of the government of the day”. It is indeed unfortunate that Andy Ellul considers that the police have a political function, as the implementation of the electoral programme is the exclusive function of holders of political office.

Andy Ellul’s utterances explain quite a lot as to when, how and why (some of) the police act and investigate. Andy Ellul, a former policeman himself, certainly knows much better than that!

When the Panama Papers revelations hit the headlines what investigations were carried out by the Police? Taking the cue from the Office of the Prime Minister at Castille the Police were not bothered. If Konrad Mizzi and Keith Schembri can get away with shouldering responsibility for their actions through the setting up of secret companies in Panama, one should not wonder as to the yardstick applied to misdemeanours of some of the members of the Police Force. It was only when the whistle-blower sounded the alarm that matters took a new direction on the allegations relative to police in the Traffic Section and beyond.

Repairing Malta’s reputation is not an easy task and restoring confidence in the Police Force is only one small step of the many required. Our country is being slowly transformed into an amoral society in which principles of ethical behaviour are being scourned and thrown overboard.

We have been told by representatives of the financial services sector that we need all hands on deck to repair Malta’s reputation. It is difficult to comprehend how this can commence in earnest when key elements of the Police Force are rotten to the core.

L-idjoti (bla sens ta’ etika) fit-tmexxija tal-Awtoritá tal-Ippjanar

L-aħbar fil-media li Jacqueline Gili, Direttur tal-Kuntratti fil-Ministeru tal-Finanzi, persuna nnominata mill-Gvern fuq il-Bord tal-Awtoritá tal-Ippjanar, inġiebet minn Catania bil-jet għal-laqgħa tal-Bord kienet aħbar xokkanti. Fatt li jistabilixxi standards ġodda ta’ governanza ħażina għal din l-amministrazzjoni.

Id-dikjarazzjoni taċ-Chairman Eżekuttiv tal-Awtoritá tal-Ippjanar Johann Buttigieg, li jkun idjota kieku kellu jerġa’ jikri jet privat darba oħra meta jaf li m’għandux appoġġ politiku għal deċiżjoni bħal din, turina b’mod ċar daqs il-kristall in-natura tal-problema reali tal-Awtoritá tal-Ippjanar. Id-deċiżjonijiet ma jittieħdux fuq bażi ta’ prinċipji etiċi ta’ tmexxija imma biss jekk ikunx hemm appoġġ politiku għalihom. L-Awtoritá tal-Ippjanar għandha tmexxija amorali li tippermetti kollox, sakemm ikun hemm l-appoġġ politiku neċessarju.

Hemm mod sistematiku kif jivvutaw il-parti l-kbira tal-membri tal-Bord tal-Ippjanar. M’hemmx bżonn wisq għerf biex tbassar min minnhom jista’ jivvota favur jew kontra applikazzjonijiet kontroversjali. Xi kultant ivarjaw ftit imma ġeneralment tista’ tipprevedi bi kważi preċiżjoni kif ser tmur il-votazzjoni.

Dan ifisser li d-deċiżjoni li jinkera l-jet kien eżerċizzju sempliċi biex ikun assigurat li l-voti favur l-applikazzjoni jkunu kollha preżenti madwar il-mejda. Meta wieħed iqis li Jacqueline Gili m’attendietx 29 minn l-aħħar 75 laqgħa tal-Bord tal-Awtoritá tal-Ippjanar dan kollu jassumi sinifikat ikbar.

Dan kollu, minkejja Ii hu importanti hu huwa kważi insinifikanti f’kuntrast mal-problemi kkawżati mill-konflitt ta’ interess eżistenti fil-laqgħat tal-Bord tal-Awtoritá tal-Ippjanar.

Intqal li żewġ membri tal-Bord tal-Awtoritá tal-Ippjanar għandhom kunflitt ta’ interess li minħabba fih ma kellhomx jipparteċipaw fil-laqgħa li kkunsidrat u approvat l-applikazzjoni tad-dB għal żvilupp f’Pembroke.

Iż-żewġ każi huma ta’ natura kompletament differenti.

L-ewwel każ ta’ kunflitt ta’ interess hu dak tal-membru parlamentari Laburista Mellieħi Clayton Bartolo. Meta kien mistoqsi dwar il-każ wara d-deċiżjoni, l-Onor. Clayton Bartolo spjega li missieru u zijuh jikru fond kummerċjali mingħand id-dB Group: huma sidien ta’ kumpanija fil-qasam tal-isports tal-baħar li topera mit-Tunny Net, propjetá ta’ Silvio Debono. Il-fatt enfasizzat mill-Onor. Bartolo li l-qraba tiegħu ma jirċievu l-ebda ħlas mingħand id-dB Group hu rrelevanti. Dak li hu relevanti hu li Clayton Bartolo qatt ma seta biss jikkunsidra li jivvota kontra l-proġett tad-dB f’Pembroke għax li kieku għamel dan kien ikun qed jipperikola l-interessi kummerċjali ta’ qrabatu. Dan hu l-kunflitt ta’ interess ta’ Clayton Bartolo. Huwa kellu jiddikjara dan l-interess tiegħu immedjatament fil-bidu tal-laqgħa u sussegwentement kellu jwarrab u ma jipparteċipax fid-diskussjoni u d-deċiżjoni dwar il-proġett propost minn dB f’Pembroke.

It-tieni kunflitt ta’ interess hu ferm iktar serju minn hekk. Jinvolvi lil Matthew Pace membru tal-Bord tal-Awtoritá tal-Ippjanar u l-ishma li għandu fl-aġenzija tal-propjetá Remax. Dan l-interess ta’ Matthew Pace fin-negozju tal-propjetá huwa f’kunflitt dirett mad-doveri tiegħu ta’ membru tal-Bord tal-Awtoritá tal-Ippjanar. Bħala sid ta’ ishma f’Remax hu perfettament naturali li Matthew Pace jieħu interess attiv fil-permessi ta’ żvilupp li jistgħu jwasslu għal iktar negozju għall-aġenzija li fiha għandu sehem. Imma bħala membru tal-Bord tal-Awtoritá tal-Ippjanar m’għandu jkollu l-ebda interess ta’ din ix-xorta għax dan inevitabilment iċajpar il-ġudizzju tiegħu huwa u jikkonsidra u jiddeċiedi l-applikazzjonijiet li jkollu quddiemu. Hu ċar li qatt ma messu kien appuntat. Il-fatt li ġie appuntat juri l-importanza li jagħti l-Gvern preżenti lill-imġieba korretta ta’ dawk li jiġu maħtura.

Hu floku ukoll li niġbed l-attenzjoni li Matthew Pace hu direttur eżekuttiv tal-kumpanija MFSP Financial Management Limited li f’Ġunju li għadda kienet immultata €38,750 mill-FIAU (Financial Intelligence Analysis Unit) talli ma osservatx numru tal-liġijiet kontra l-ħasil tal-flus. Ir-rapporti fl-istampa f’Ġunju li għadda jindikaw li l-kontijiet inkwistjioni kienu ta’ Keith Schembri, Kap Amministrattiv tal-Uffiċju tal-Prim Ministru Joseph Muscat, u ta’ Adrian Hillman li kien Direttur Maniġerjali tal-Allied Newspapers.

Dan jgħinna mhux ftit biex nifhmu ħafna iktar dak li qiegħed jiġri. It-taħwid li għaddej fl-Awtoritá tal-Ippjanar għandu l-barka diretta minn Kastilja, u allura huwa l-Prim Ministru li jeħtieġ li jerfa’ r-responsabbiltá diretta għal dan kollu.

Amoral idiots at the Planning Authority

The revelation that Jacqueline Gili, Director of Contracts at the Ministry of Finance and government appointee on the Planning Authority Board, was brought over for a meeting by a jet plane from Catania is shocking. It takes bad governance under this administration to a new level.

The declaration by PA Executive Chairman, Johann Buttigieg, that he would be an idiot to hire an executive jet next time in view of his not having any “political backing” for his decision to do so on this occasion identifies the real problem. Governance at the PA is dependent on political backing and not upon solid ethical behaviour. The authority has an amoral leadership and anything is permissible, as long as there is political backing.

The voting patterns of the Planning Authority Board members are clear enough. It is not rocket science to identify a priori which members of the Planning Authority Board are in favour and which are against controversial applications. They vary at times, but generally one can be 75 per cent spot-on in identifying who will vote “yes” and who will vote “no” on most applications.

This signifies that the jet plane decision was simply an exercise in ensuring that the potential yes votes were all on board. This in view of the large number of absences of Jacqueline Gili at Planning Board meetings in the recent past: she has not been present at  29 of the last 75.

I submit, however, that the jet plane issue almost pales into insignificance compared with the issue of conflict of interest at Planning Authority Board meetings. It has been said that two members of the Board had a conflict of interest in view of which they should not have participated in the meeting that considered and approved the dB Pembroke development proposal.

The two cases are however of a completely different nature.

The first conflict of interest is of Mellieħa Labour MP Clayton Bartolo. When prodded, after the decision was taken, the Hon Clayton Bartolo explained that his father and uncle are tenants of commercial premises owned by the dB Group: they are shareholders of a water sports company that operates from Silvio Debono’s Tunny Net Complex. The fact underlined by Hon Bartolo that the Bartolo relatives do not receive any payments from the dB Group is irrelevant. What is relevant is that, had Clayton Bartolo decided to vote against the dB Pembroke proposal, the existing commercial relationship between his immediate relatives and the dB Group would have been at considerable risk. This is what gives rise to Clayton Bartolo’s conflict of interest. He should have declared his interest before the PA Board meeting and not participated in the discussion and decision on the dB Pembroke project.

The second conflict of interest is much more serious. It involves PA Board member Matthew Pace and his shareholding in the Remax Estate Agency. Mr Pace’s interests in an estate agency is in direct conflict with his duties as a member of the Planning Authority Board. As a shareholder in Remax, it is natural for him to have an active interest in development permits as this would inevitably lead to more business for his agency. As a PA Board member, he should not have such an interest in any potential development permit as it would inevitably cloud his judgement in accessing and deciding on the applications for his consideration.

It is clear that Matthew Pace should have never been appointed in the first place and the fact that he was signifies the importance that the present government attaches to the ethical behaviour of its appointees.

It would be pertinent to also point out that Mr Pace is also Executive Director of MFSP Financial Management Ltd, an investment company which, last June, was fined €38,750 by the Financial Intelligence Analysis Unit for breaching a number of anti-money laundering laws. Reports in the press at the time indicated that the accounts in question belonged to Keith Schembri, Chief of Staff to Prime Minister Joseph Muscat, and Adrian Hillman former Managing Director of Allied Newspapers.

This makes matters substantially easier to decipher: the useful idiots at the Planning Authority are in the good books of the powers that be at Castille. The buck therefore stops on Joseph Muscat’s desk: it is he who has to shoulder political responsibility for this mess.

Il-Grupp Parlamentari Laburista u l-iskandlu tal-Panama

Id-dimostrazzjoni tal-Partit Laburista li saret fuq Kastilja nhar il-Ħadd l-1 ta’ Mejju ma kienitx dwar l-iskandlu tal-Panama. Bħal kull attività politika pubblika tingħata t-tifsira li jkun l-aktar jaqbel. Għalhekk naturali, u nifhem li l-Partit Laburista, taħt assedju tul dawn l-aħħar tmien ġimgħat, jinterpreta d-daqs tal-folla fuq Kastilja bħala waħda li tagħtih appoġġ f’dan il-mument diffiċli.

Peró, fir-realtà, x’appoġġ qed tagħti l-folla lill-partit f’dan il-mument kritiku?

Il-Prim Ministru Joseph Muscat innifsu mhuwiex ċert. Ġie ikkwota jgħid li jekk il-każ Panama huwiex magħluq jew le, iridu jkunu in-nies li jiddeċiedu. Ma kienx qed jirreferi biss għal dawk li kellu quddiemu. Muscat hu konxju li kemm Konrad Mizzi kif ukoll Keith Schembri l-Kasco għamlu gaffe kbir. Imma Konrad u Keith ħadmu miegħu mill-qrib u hu ovvju li jħossu obbligat mhux ftit lejhom. Għalhekk dam biex iddeċieda u meta iddeċieda iċċaqlaq mill-inqas u effettivament ma ddeċieda xejn.

Ittieħdu żewġ miżuri : Konrad ma baqax direttament responsabbli għall-enerġija imma tħalla membru tal-Kabinett bħala Ministru bla portafoll. Kien ġest simboliku li bih Joseph Muscat qed jirrikonoxxi li sar żball imma mhux qiegħed jaċċetta li l-iżball hu gravi biżżejjed li jimmerita tkeċċija. L-iskuża fjakka li qed iġib Muscat hi li ħadd ma qiegħed jallega llegalità. Li mhux qiegħed jgħid Muscat hu li dwar allegazzjonijiet ta’ illegalità ma hemmx ħtieġa ta’ intervent tiegħu għax jeżistu mekkaniżmi legali li jipprovdu għal dan l-intervent min-naħa tal-awtoritajiet. L-issue reali, a bażi ta’ dak li hu magħruf s’issa pubblikament hi waħda ta’ imġieba u ta’ serjetà fit-tmexxija [good governance].

Konrad irriżenja [jew ġie mitlub jirriżenja] minn Deputy Leader tal-Partit ftit ġimgħat wara li inħatar f’elezzjoni fejn kien jidher li kien il-magħżul u tellaq waħdu.

Il-mistoqsija inevitabbli hi : għalfejn ma rriżenjax minn kollox? Dak li għamel [li għandu kumpanija fil-Panama] għandu jkun tal-mistħija għalih, għall-partit u għall-pajjiż. Dwar l-istess ħaġa irriżenja l-Prim Ministru tal-Iżlanda kif ukoll Ministru Spanjol. Imma Konrad le, għax skond Joseph, fil-waqt li l-affarijiet setgħu saru aħjar, ma sar xejn ħażin.

Din hi l-qalba tal-problema. Li Joseph Muscat hu amorali. L-etika għalih hi irrelevanti. Jgħodd x’inhu legali jew illegali imma mhux x’inhu tajjeb jew ħażin.

Fortunatament bosta membri tal-grupp parlamentari jaħsbuha differenti minn hekk. Hemm min tkellem fil-pubbliku bħalma għamlu Evarist Bartolo u Godfrey Farrugia. Hemm oħrajn li tkellmu fil-magħluq waqt laqgħa tal-Grupp Parlamentari. Issemmew l-ismijiet tad-Deputat Prim Ministru Louis Grech u tal-Ministri Leo Brincat, Edward Scicluna u George Vella. Hemm ukoll id-dikjarazzjoni ċara ta’ Alfred Sant. Naf li hemm oħrajn. Kollha talbu r-riżenja ta’ Konrad Mizzi.

Il-grupp parlamentari laburista m’huwiex kuntent bis-sitwazzjoni. Huwa konxju li s-skiet tal-Partit Laburista quddiem it-taħwid tal-Gvernijiet tas-snin 70 u 80 kienet raġuni ewlenija li kkundannat lill-partit għal 25 sena fl-Opposizzjoni. Illum jirrealizzzaw li hu kmieni wisq, wara biss tlett snin, biex il-partit laburista jsib ruħu f’dan it-taħwid kollu. Il-ftit li għamel Joseph dwar il-kaz (anke jekk kosmetiku) għamlu biex jipprova jissodisfa lill-grupp parlamentari tiegħu. Imma xorta ħadd ma hu sodisfatt. Dan kien jidher anke nhar il-Ħadd mill-body language ta’ Joseph x’ħin kien qed jindirizza l-folla fuq Kastilja.

Iċ-ċavetta qegħda f’idejn il-grupp parlamentari laburista biex dan iwassal lill-partit forsi jiġi f’sensieh. Is-soċjetà ċivili ukoll għandha responsabbiltà kbira li tibqa’ ssemma’ leħinha biex tkompli tagħmel il-kuraġġ lil dawk li fil-Partit Laburista qed jinsistu li Konrad (u Keith) għandhom jirriżenjaw. L-intellettwali tal-pajjiż hemm bżonn ukoll li joħorġu mill-friża u jiftħu ħalqhom flok ma jillimitaw ruħhom għat-tfesfis fil-widnejn.

Għax il-folol preżenti għad-dimostrazzjonijiet m’humiex biżżejjed biex tirbaħ l-elezzjonijiet. Hemm bżonn ferm iktar minn hekk. L-imġieba tajba tal-Gvern hi element essenzjali. U dan il-Gvern, bħal ta’ qablu qiegħed iġib ruħu ħażin.
