Il-Wasteserve: fil-Magħtab qed topera bla permess

Diversi bdiewa fil-Magħtab ġew mitluba biex jikkuntattjaw il-Wasteserve sa tmiem dan ix-xahar biex ikun iffaċilitat aċċess għall-art li qed jaħdmu u dan bl-iskop li din tkun eżaminata, “bil-ħsieb li possibilment tiġi akkwistata għal skop pubbliku”. L-avviż legali numru 1261 li kien ippubblikat fil-Gazzetta tal-Gvern tas-17 ta’ Diċembru 2019 jgħid li hemm tmien biċċiet art fil-Magħtab li qed ikunu ikkunsidrati. Din l-art għandha qies totali ta’ 254,144 metru kwadru, jiġifieri ftit iktar minn 226 tomna. Il-parti l-kbira minn din l-art għadha qed tinħadem minn bdiewa minkejja ċ-ċirkustanzi diffiċli li nħolqu kemm ilhom joperaw il-miżbliet fil-Magħtab sa mill-1975.

Xi ħtieġa għandha l-Wasteserve għal din l-art? Hemm tlett materji ewlenin dwar l-iskart li huma pendenti.

Il-miżbliet tal-Magħtab dalwaqt jimtlew. Bla dubju din is-sitwazzjoni wasalna għaliha qabel ma kien antiċipat minħabba li qed jintrema wisq skart. Ir-riċiklar għadu f’livell insinifikanti. Il-ġbir tal-iskart organiku b’mod separat għadu fil-bidu. Hemm ħtieġa urġenti biex in-nies tagħraf iktar il-ħtieġa li tnaqqas kemm l-iskart kif ukoll l-ammont tiegħu li qed jintrema fil-miżbliet.

Il-Gvern, probabbilment li qed iħejji biex jimplimenta l-wegħda elettorali dwar l-egħluq tal-impjant ta’ Sant Antnin li jittratta l-iskart. Din hi l-wegħda numru 27 fil-Manifest Elettorali tal-Partit Laburista fl-Elezzjoni Ġenerali tal-2017. Probabbilment li dan ukoll jispiċċa fil-kumpless tal-iskart tal-Magħtab li l-Wasteserve tirreferi għalih bħala iċ-Ċentru Ambjentali tal-Magħtab.

It-tielet pendenza hi dwar l-inċineratur li hu ppjanat li jibda jopera sa mhux iktar tard mill-2025.

Il-Wasteserve teħtieġ l-art għal dan kollu li ser iwassal biex il-Magħtab ikun ikkonvertit permanentement fiċ-ċentru tal-iskart fil-gżejjer Maltin.

Il-Wasteserve, fuq is-sit elettroniku tagħha tiddeskrivi l-kumpless tal-Magħtab bħala ta’ daqs komparabbli mal-Belt Valletta, li hi mifruxa fuq 600,000 metru kwadru.

Iktar kmieni din il-ġimgħa, Aaron Farrugia, Ministru għall-Ambjent u l-Ippjanar, li hu politikament responsabbli għall-Wasteserve, spjega, waqt intervista mxandra fl-aħbarijiet, li l-estensjoni ippjanata għall-miżbla tal-Magħtab teħtieġ 145,000 metru kwadru ta’ art filwaqt li l-inċineratur propost u “faċilitajiet oħra” jirrikjedu 105,000 metru kwadru addizzjonali. Il-facilitajiet oħra hi referenza għall-wegħda elettorali tal-Partit Laburista biex jingħalaq l-impjant ta’ Sant Antnin għat-trattament tal-iskart.

Meta tgħodd din l-art kollha għall-proġetti tal-Wasteserve fil-Magħtab ifisser li d-daqs tal-kumpless għall-iskart ser jikber għal madwar 850,000 metru kwadru, meta l-proġetti jkunu kollha mplimentati. Dan ifisser li l-254,144 metru kwadru ta’ art, primarjament raba’, imsemmija fil-Gazzetta tal-Gvern tas-17 ta’ Diċembru 2019 tista’ isservi bl-eżatt. Xejn ma neħodha bi kbira, iżda, jekk il-Wasteserve, bħal Oliver Twist, tkun trid iktar.

Meta nfittxu fuq is-sit elettroniku tal-Awtorità għall-Ambjent u r-Riżorsi (ERA) niskopru li l-permessi magħrufa bħala IPPC permits għall-miżbliet fil-Magħtab ilhom ftit li skadew. Dan ifisser li l-Wasteserve qed topera fi stat ta’ illegalità.

Dawn il-permessi imsejħa IPPC permits (Integrated Pollution Prevention and Control) jinħarġu mill- ERA skond kif tistabilixxi direttiva tal-Unjoni Ewropeja u dan wara li jkun hemm studji dettaljati dwar l-attività (f’dan il-kaz miżbla) u l-impatti tagħha. Skont is-sit elettroniku tal-ERA il-miżbla għal skart mhux perikoluż Ta’ Żwejra fil-kumpless tal-Magħtab qed topera fuq bażi ta’ permess li skada fl-24 ta’ Lulju 2018 (permess IP 0001/05). Min-naħa l-oħra l-miżbla għal skart mhux perikoluż tal-Għallis, ukoll fil-kumpless tal-Magħtab, qed topera fuq bażi ta’ permess li nħareġ f’Jannar 2013 u li suppost li skada fil-bidu tal-2018 (permess IP 0001/06).

Jekk il-Wasteserve mhiex kapaċi tosserva liġijiet bażiċi ambjentali, ħadd ma għandu jeħodha bi kbira li sezzjoni tal-pubbliku jimxu fuq l-eżempju tagħha.

Wasteserve illegality: sort it out.

Farmers in Magħtab have been asked to contact Wasteserve by the end of this month in order to facilitate access to their land “for necessary studies with the intent of potential acquisition for public purposes”.

Notice No. 1261, published in The Malta Government Gazette of the 17 December 2019, lists eight plots of land in Magħtab which are being considered. This land has a total area of 254,144 square metres, slightly more than 226 tumoli. Most of it is currently in use as agricultural land, notwithstanding the difficult circumstances arising from the operation of landfills in the vicinity since 1975.

What does Wasteserve need this land for?

There are three pending major waste management issues. The landfills at Magħtab will be shortly filled to capacity. Undoubtedly this state of affairs has been reached earlier than anticipated due to the fact that too much waste is still going to landfill. Recycling is still at an insignificant level and the collection of organic waste as a separate stream is still in its infancy. Much still needs to be done in instilling awareness on the need to substantially reduce both the amount of waste generated as well as the portion of it going to landfill.

The Government will most probably also seek to implement its electoral pledge to close down the Sant Antnin Waste Treatment Plant. This is pledge number 27 in the Labour Party Electoral Manifesto for the 2017 general election and it, too, will most probably be directed towards the Magħtab waste complex, which Wasteserve refers to as the Magħtab Environment Complex.

The third pending issue is the so-called thermal facility, ie the incinerator, scheduled to be in operation by 2025.

Wasteserve needs land to address all three issues, in the process converting Magħtab permanently to the waste centre of the Maltese islands.

The Wasteserve website describes the Magħtab complex as being comparable in size to Valletta, being spread over an area in excess of 600,000 square metres.

Earlier Environment and Planning Minister Aaron Farrugia, politically responsible for Wasteserve, explained on television that the planned extension to the Magħtab landfill requires 145,000 square metres of land, while the proposed incinerator and other facilities would require an additional 105,000 square metres. The “other facilities” is an indirect reference to the Labour Party’s commitment to close down the Sant Antnin Waste Treatment Plant.

Adding up all this land required for the Wasteserve projects at Magħtab would bring the Waste Complex size to around 850,000 square metres when all the pending projects are implemented. This means that the proposed take up of 254,144 square metres of mostly agricultural land as declared in the Malta Government Gazette edition of the 17 December 2019 could be just enough space. Like Oliver Twist, Wasteserve will, however, most probably come back for more.

Perusal of the information available on the website of the Environment and Resources Authority (ERA) indicates that the IPPC permit for the landfills at Magħtab expired quite some time ago, signifying that Wasteserve is operating in a state of illegality.

The IPPC (Integrated Pollution Prevention and Control) permits are issued by the ERA in terms of the provisions of the relative EU Directive after detailed studies on the operations and impacts of the proposed activity have been carried out or updated. According to the ERA website, the Ta’ Żwejra non-hazardous landfill within the Magħtab complex is operating on the basis of a permit which expired on the 24 July 2018 (permit IP 0001/05). On the other hand, the L-Għallis non-hazardous landfill, also within the Magħtab complex, operates on the basis of a permit which was issued way back in January 2013 and should have expired at the beginning of 2018 (permit IP 0001/06). Malta’s only landfill complex is thus operating without a valid permit at law.

If Wasteserve does not follow the provisions of basic environmental legislation, it is no surprise that a section of the population is inclined to follow its example.

Why does the Environment and Resources Authority (ERA), the environment regulator, tolerate this state of affairs? The Chairman of ERA, Professor Victor Axiaq, owes an explanation. His resignation is long overdue.

Il-governanza tajba tinbena fuq it-transparenza

It-transparenza hi l-pedament essenzjali għal governanza tajba. B’kuntrast ma dan, il-governanza ħażina, ġeneralment, tkun akkumpanjata mis-segretezza u dan billi jinżamm jew ikun ostakolat l-aċċess għal informazzjoni ta’ kull xorta, liema informazzjoni għandha tkun pubblika.

Il-ħmieġ assoċjat mal-Panama Papers sirna nafu bih fil-mument li nkixfet l-informazzjoni dwar dawk li fittxew l-irkejjen tad-dinja fejn hi inkoraġġita s-segretezza: irkejjen fejn jinħbew il-flus ġejjin mill-korruzzjoni u mill-evażjoni tat-taxxi. Bl-istess mod l-iskandlu tal-Vitals dwar l-isptarijiet kif ukoll it-taħwid kollu assoċjat mal-power station ma kienux iseħħu kieku l-Partit Laburista fil-gvern għażel it-trasparenza flok is-segretezza bħala għodda essenzjali għat-tmexxija. Segretezza li kultant twaħħxek.

Il-kontabilità li tant niftaħru biha, wara kollox, hi dwar ir-responsabbiltà. Tfisser l-għarfien tar-responsabbiltà għal dak li nagħmlu. Dan ma jistax iseħħ jekk ma ssaltanx it-trasparenza, dejjem, u mhux biss meta jaqbel.

Il-ġimgħa l-oħra, l-Kamra tal-Kummerċ ippubblikat dokument bil-ħsibijiet tagħha dwar il-ħtieġa li tkun inkoraġġita u msaħħa l-governanza tajba. Kien f’loku li l-Kamra tal-Kummerċ emfasizzat li l-governanza tajba hi msejsa fuq it-trasparenza, l-kontabilità u s-saltna tad-dritt.

Spiss jingħad li l-informazzjoni hi poter. It-transparenza hi dwar dan il-fatt: li jkun assigurat li l-poter jinfirex. Għax hu biss meta jkollna għarfien ta’ dak li qed jiġri li nkunu nistgħu neżerċitaw id-dritt bażiku tagħna bħala ċittadini li neżiġu illi kull min jiddeċiedi, u allura jeżerċita l-poter, jagħti kont ta’ egħmilu, dejjem.

Il-politiċi mhumiex l-uniċi li jieħdu d-deċiżjonijiet. Dawn jinkludu liċ-ċivil u lil dawk li jmexxu l-awtoritajiet u l-istituzzjonijiet imwaqqfa biex jiffaċilitaw l-amministrazzjoni tal-istat fit-twettieq tal-funzjonijiet u d-dmirijiet tiegħu.

It-trasparenza teħtieġ li tinfirex anke fid-dinja tal-kummerċ. Spiss nisimgħu lil min jemfasizza li l-politika m’għandiex tindaħal fis-settur privat, fid-dinja tan-negozju. Għal uħud għadu mhuwiex ovvju li anke s-settur privat, u in-partikolari id-dinja tan-negozju, għandu joqgħod lura milli “jindaħal” fil-politika. Fost affarijiet oħra dan ifisser il-ħtieġa li jkun regolat il-lobbying. Dan ma jsirx billi il-lobbying ikun ipprojibit imma billi kull attività ta’ lobbying tkun transparenti. Għax jekk il-lobbying isir sewwa jista’ ikollu impatt posittiv fuq it-tfassil tad-deċiżjonijiet. Hi is-segretezza li tagħti fama ħażina lill-lobbying, segretezza intenzjonata biex ixxaqleb id-deċiżjonijiet lejn interessi kummerċjali u fl-istess ħin biex tostor it-taħwid.

Huwa f’dan id-dawl li l-inizjattiva tal- Ministru l-ġdid għall-Ambjent Aaron Farrugia li jżomm lista tal-laqgħat kollha tiegħu ma’ dawk li jfittxu li jiltaqgħu miegħu, inkluż mal-utenti, u li jippubblika din l-informazzjoni fil-forma ta’ reġistru ta’ trasparenza hi pass kbir ‘il quddiem. Din l-inizjattiva hi f’waqtha u hi ta’ eżempju lill-politiċi oħrajn biex huma ukoll jipprattikaw it-transparenza. Dan imma għandu jkun biss l-ewwel pass li jeħtieġ li jkun segwit bil-pubblikazzjoni ta’ proposti u dokumenti li l-Ministru jirċievi waqt dawn il-laqgħat, kif ukoll il-minuti tal-laqgħat li jkunu saru.

Hu magħruf li l-Kummissarju dwar l-Istandards fil-Ħajja Pubblika qed iħejji biex jippubblika abbozz ta’ proposti dwar ir-regolamentazzjoni tal-lobbying biex eventwalment tkun tista’ issir konsultazzjoni pubblika dwarhom. Nittama li dan iwassal għal sitwazzjoni fejn f’dan il-qasam Aaron Farrugia ma jibqax l-eċċezzjoni. Il-bqija tal-membri tal-Kabinett m’għandhomx jibqagħlhom għażla. Għandhom ikunu kostretti li huma wkoll jaġixxu biex it-transparenza fil-ħidma politika tkun ir-regola u mhux l-eċċezzjoni.

Għax huwa biss meta it-transparenza jkollha egħruq fondi u b’saħħithom li nistgħu nibdew intejbu d-demokrazija tagħna billi neliminaw id-difetti li tħallew jakkumulaw tul is-snin.

Good governance is founded on transparency

Transparency is the indispensable foundation of good governance. In contrast, bad governance is generally wrapped in secrecy through the withholding of information which should be in the public domain.

The Panama Papers saga saw the light of day when information on those seeking secretive jurisdictions was made public. These locations are sought to hide  the fruits of corruption or tax evasion from public scrutiny. Similarly, the Vitals hospital scandal, as well as the power station scandal, with all their ramifications, would undoubtedly not have occurred if the Labour Party in government had embraced transparency instead of entrenching secrecy as its basic operational rule.

Transparency is a basic characteristic of good governance whereas secrecy is the distinguishing mark of bad governance, inevitably leading to unethical behaviour and corruption.

Without transparency, accountability is a dead letter; devoid of any meaning. A lack of transparency transforms our democracy into a defective process, as basic and essential information required to form an opinion on what’s going on is missing. After all, accountability is about responsibility: it signifies the acknowledgement and assumption of responsibility for our actions. This cannot be achieved unless and until transparency reigns supreme.

Last week, the Chamber of Commerce published its views on the need to reinforce good governance. Pertinently it emphasised that good governance is founded on transparency, accountability and the rule of law.

It is said that knowledge (and information) is power. This is what transparency is all about: ensuring that power is shared by all as it is only when we are aware as to what is going on that we can exercise our basic right as citizens: holding decision-takers to account. Being in possession of information gives each and every one of us the power to act and exercise our civic rights.

Holders of political office are not the only decision-takers. Decision-takers include the civil service as well as those running authorities and institutions established to facilitate the administration of the state in carrying out its functions and duties.

Even business leaders should be transparent in their actions and decision-taking. Many a time we have heard the expression “we should take politics out of business”, signifying that politics should not interfere in the private sector.

To some it is less obvious that the reverse of that is just as important, meaning that we should also “take business out of politics”. Among other things, this signifies that we should regulate lobbying. This is not done by prohibiting lobbying but by focusing the spotlight of transparency on all lobbying activity. If lobbying is done properly, it could have a beneficial impact on policy making. It is secrecy that gives lobbying a bad reputation: a secrecy intended to derail decisions in a manner beneficial to the different lobby groups as well as to facilitate and shroud underhand deals.

In this respect the initiative of the newly appointed Environment Minister Aaron Farrugia to log all of his meetings with lobbyists and stakeholders and to publish a Transparency Register is a welcome step in laying solid foundations for the practice of transparency by holders of political office. It is, however, only a first step and must be eventually followed by the publication in real time of proposals received as well as the minutes of meetings held.

It is known that the Commissioner for Standards in Public Life will shortly be publishing proposals for the regulating of lobbying. Hopefully, this should lead to a situation where Aaron Farrugia would not be an exception. Others will be compelled to not only follow in his footsteps but to proceed much further in entrenching transparency in the working methods of holders of political office.

A deep-rooted commitment to transparency is the only way by which we can start repairing our defective democracy.

X’hemm lest għal Birżebbuġa?

Il-Port Ħieles, skond Aaron Farrugia, CEO tal-Korporazzjoni tal-Port Ħieles, dalwaqt jixpakka. Għandu bżonn l-ispazju biex jikber.

F’intervista ma’ Vanessa MacDonald ippubblikata fil-Business Observer il-bieraħ (supplement tat-Times of Malta) Aaron Farrugia jara potenzjal ghall-espansjoni tal-Port Ħieles fl-art li l-kumpanija GO kellha fit-triq ta’ Ħal-Far. Mid-dehra ma jafx li diġa hemm applikazzjoni fuq din l-art u li l-MEPA diġa esprimiet ruħha li ma taqbilx fil-principju, għalkemm l-applikazzjoni għadha pendenti.

Qed jara ukoll potenzjal għall-iżvilupp tal-Port Ħieles fil-miljun u nofs metru kwadru ta’ art li hemm bejn il-Port Ħieles u Ħal-Far.

Il-konflitt bejn il-ħtiġijiet tar-residenti (ta’ Birżebbuġa) u l-interessi tal-Port Ħieles huwa wieħed reali li kull jum li jgħaddi qiegħed jinħass iktar u jweġġa’. Għax fir-realtà l-Port Ħieles mhux postu daqshekk viċin in-nies. Kien meħtieġ li jinqata’ min-nies billi jitħalla l-ikbar spazju possibli vojt bejnu u r-residenzi. Imma dan l-ispazju qatt ma nħoloq.

L-intervista ta’ Aaron Farrugia hija inkwetanti għax minn dak li fiha jfisser li ma hemm l-ebda intenzjoni li jħallu lir-residenti ta’ Birżebbuġa bi kwiethom.

Terrimot fil-Partit Laburista

Infqajt nidħaq nisma’ lil Aaron Farrugia, Chairman tal-Fondazzjoni Ideat tal-Partit Laburista ta’ Malta, jipprova jispjega waqt l-aħbarijiet fuq Super One (is-Sibt fil-għaxija) għaliex ġie elett Jeremy Corbyn bħala l-mexxej il-ġdid tal-Partit Laburista Ingliż.

Semma kull raġuni possibli, minnbarra r-raġuni rejali: li Jeremy Corbyn ma jagħmilx kompromessi ma dak li jemmen fih. Kienet l-awtentiċità ta’ Corbyn il-kawża ewlenija tat-terrimot li l-effetti tiegħu għadhom jibdew. Corbyn kien l-unika wieħed mill-kandidati li kien soċjalista u ma jistħix jgħid li hu hekk. Naħseb li Aaron ħassu ħafna imbarazzat li jgħid li osserva dan, ħaga li probabbilment ilu ħafna jinnota ukoll fil-Headquarters tal-Ħamrun.

Fil-bidu tal-kampanja għat-tmexxija tal-Partit Laburista Ingliż fil-Parlament, għall-ħabta ta’ nofs Lulju, il-Gvern Ingliż ressaq abbozz ta’ liġi biex inaqqas il-benefiċċji soċjali. Tlieta mill-kandidati għat-tmexxija Laburista, dakinnhar astjenew fil-votazzjoni. Kien Jeremy Corbyn l-uniku wieħed mill-erba’ kandidati li ivvota kontra dan l-abbozz ta’ liġi.

Rebħa bi kważi 60% tal-voti ma l-ewwel għadd m’hiex ċajta. Id-distakk bejn Jeremy Corbyn u Andy Burnham kienet ta’ tlett darbiet (Burnham ma qabiżx l-20%). L-oħrajn ġiebu inqas!

Il-kampanja għat-tmexxija tal-Partit Laburista Ingliż uriet li hemm distakk kbira bejn dak li jaħsbu l-membri tal-partit u dak li jaħsbu l-Membri Parlamentari tal-istess partit. Bħala riżultat tal-elezzjoni ta’ Jeremy Corbyn diversi membri ewlenin tal-grupp parlamentari ippreferew li jwarrbu jew ma jaċċettawx posizzjoni fis-Shadow Cabinet. Dan ingħata prominenza fil-gazzetti Ingliż matul il-jum tal-bieraħ. Fatt li jista’ joħloq diffikultajiet għal Corbyn mhux biss ta’ natura temporanja.

M’huwiex faċli tgħid kif ser jiżviluppaw l-affarijiet. L-ikbar ostaklu għal Corbyn m’huwiex il-Gvern konservattiv, iżda “sħabu” fil-grupp Parlamenti.

Fil-ġimgħat li ġejjin hemm ippjanati sfidi kbar. Fosthom liġi li tikontrolla lit-Trade Unions u li tfittex ukoll li tnaqqas sostanzjalment il-finanzjament tal-Partit Laburista Ingliż mill-istess Trade Unions. Hi imminenti ukoll deċiżjoni mill-House of Commons dwar l-armamenti nuklejari Inġliżi.

Ser ikunu ġimgħat li fihom nosservaw kemm hu possibli li f’partit politku jikkoeżistu veduti radikalment differenti fuq ħafna affarijiet : fuq l-Unjoni Ewropeja, fuq in-NATO, fuq l-armamenti nuklejari, fuq l-awsterita, fuq l-użu tal-forza militari bħala għodda għall-politika barranija ……………. Kollha materji li dwarhom ftit kien hemm x’tagħżel fil-passat riċenti bejn in-New Labour u l-Konservattivi.

Minn tmiem il-ġimgħa in-New Labour fir-Renju Unit spiċċa. Dawk li sa ftit ġranet ilu kienu meqjusa bħala r-ribelli issa qegħdin fit-tmexxija, u dawk li kienu qed jinsistu fuq il-lealtà lejn it-tmexxija issa qegħdin minn taħt. Id-demokratizzazzjoni tal-partit ser tkun iċ-ċavetta biex il-Partit Laburista Ingliż ma jibqax jistħi jgħid li hu soċjalista. Kollox jiddependi minn kemm l-entużjażmu li nisslet il-kandidatura ta’ Corbyn jibqa’ ħaj fl-egħruq tal-partit. Jekk dan jibqa’, Corbyn ikompli biex jittrasforma l-Partit Laburista Ingliż in konformità mat-twemmin tiegħu. Jekk le, il-partit jerġa’ lura biex ikun kopja tal-konservattivi.
