Il-legat ta’ Arvid Pardo: niskopru mill-ġdid il-vokazzjoni marittima

“Aħna għandna interess naturali u vitali fil-baħar ta’ madwarna li permezz tiegħu ngħixu u nieħdu n-nifs.” Dan hu kliem Arvid Pardo, dakinnhar ambaxxatur ta’ Malta għall-Ġnus Magħquda, kliem li qal meta kien qed jindirizza  l-Assemblea Ġenerali fuq il-proposta ta’ Malta dwar qiegħ il-baħar u r-rizorsi tiegħu bħala l-wirt komuni tal-umanità.

Il-baħar hu ħajjitna, iżda ftit li xejn jingħata prominenza fil-prijoritajiet politiċi tal-pajjiż. Bħala gżira stat,   il-baħar u dak kollu marbut miegħu, għandu jkun fuq nett fl-aġenda politika tal-pajjiż.  Hu ghalhekk ta’ tħassib li lokalment ma ntqal prattikament xejn mill-Gvern dwar trattat fuq l-ibħra internazzjonali konkluż iktar kmieni din il-ġimgħa fil-qafas tal-istrutturi tal-Ġuns Magħquda. Ftehim li hu ta’ importanza storika u riżultat ta’ negozjati li ilhom sejrin sa mill-2004.  Dan hu ftehim li hu mibni fuq il-legat tal-Konvenzjoni tal-Ġnus Magħquda dwar il-Baħar li dwarha, permezz ta’ Arvid Pardo, Malta tat sehem kruċjali.

Malta teħtieġ li tiskopri mill-ġdid il-vokazzjoni marittima tagħha u li tkun fuq quddiem nett f’dawn l-inizjattivi fid-dibattitu marittimu internazzjonali. Biex inkunu proattivi jeħtieġilna li jkollna Ministeru iffukat fuq il-politika Marittima li jiġbor taħt saqaf wieħed il-politika marittima kollha ta’ relevanza għall-gżejjer Maltin: mill-ekonomija l-blu, is-sajd u l-akwakultura għall-ħarsien ta’ zoni marittimi estensivi anke fl-ibħra internazzjinali, il-ħarsien aħjar tal-kosta kif ukoll li nimplimentaw sewwa l-liġi dwar id-Dimanju Pubbliku bla dewmien u dan biex ikun assigurat l-aċċess pubbliku għall-kosta, u b’hekk, fuq perjodu ta’ żmien tkun ikkontrollata l-kummerċjalizzazzjoni tal-kosta li ilha sejra s-snin.

Darba kellna Segretarjat Parlamentari għall-Affarijiet Marittimi. Illum il-ġurnata l-politika marittima hi linja waħda fil-lista ta’ responsabbiltajiet tal-Kabinett taħt il-Ministeru tat-Trasport. Fir-realtà, imma, l-politika marittima hi frammentata  u dwarha hemm responsabbiltajiet f’diversi Ministeri.  Fil-prattika dan ifisser li ma hemm ħadd li għandu responsabbiltà politika diretta u konsegwenza ta’ hekk il-koordinazzjoni politika f’dan il-qasam hi waħda limitat ħafna.  Din hi ħasra għax dan hu qasam li għandu ħafna potenzjal li jkun ta’ ġid għall-pajjiż.

It-trattat il-ġdid ser ifittex li jindirizza l-ħarsien tas-saħħa tal-oċejani mhux biss fil-present, imma iktar importanti fuq medda ta’ żmien: dan hu il-wirt li ser inħallu warajna lill-ġenerazzjonijiet futuri.   Kif ġie emfasizzat mill-kelliemi għas-Segretarju Ġenerali tal-Ġnus Magħquda Antonio Guterres, dan it-trattat il-ġdid ser ifittex li jindirizza il-kriżi li qed tiffaċċja id-dinja fuq tlett fronti: it-tibdil fil-klima, it-telfien tal-bijodiversità u t-tniġġiż.

In-negozjati dwar it-trattat intemmu fil-lejl bejn l-4 u l-5 ta’ Marzu. Ser iservi biex titwettaq il-wegħda miftehma fil-konklużjonijiet  tal-Konferenza dwar il-Bijodiversità li saret f’Montreal f’Diċembru li għadda u li hi magħrufa bħala  30×30.   Din hi wegħda bl-iskop li tistabilixi fuq sisien legal sodi il-mira ta’ protezzjoni ta’ terz tal-bijodiversità fuq l-art u l-baħar u dan sas-sena 2030. In-negozjati dwar it-trattat fasslu l-qafas legali meħtieġ biex tkun tista’ tibda t-triq twila ħalli jkunu implimentati l-wegħdiet, il-konklużjonijiet u inizjattivi ta’ Montreal.

L-ibħra internazzjonali jibdew fejn jispiċċaw iż-żoni ekonomiċi esklussivi tal-pajjiżi differenti, ġeneralment madwar 200 mil nawtiku (390 km) mill-kosta. Dawn l-ibħra jammontaw għal 60 fil-mija tal-oċejani globali u ma huma tal-ebda pajjiż, u allura huma ta’ kulħadd! Dawn l-ibħra huma taħt theddida kontinwa ta’ ħsara mill-ħidma akkumulata tal-bniedem tul is-snin. Għalhekk il-ħtieġa li l-komunità internazzjonali taġixxi illum qabel għada.

Meta it-trattat jidħol fis-seħħ, forsi, inkunu pass eqreb lejn il-ħolqien ta’ zoni ta’ protezzjoni marittima fl-ibħra internazzjonali. Din, meta isseħħ tkun kisba storika kbira.

Arvid Pardo jkun kburi li wasalna sa hawn. L-aħjar mod kif nikkommemorawh ikun kull darba li nkunu kapaċi nidħlu għar-responsabbiltajiet internazzjonali tagħna dwar l-ibħra. Jeħtieġilna li niftakru kontinwament li bħala gżira, il-baħar hu ħajjitna: il-baħar hu dak li għamilna dak li aħna illum.

Arvid Pardo’s legacy: rediscovering a maritime vocation

“We are naturally vitally interested in the sea which surrounds us and through which we live and breathe.” This was stated by Arvid Pardo then Malta’s UN Ambassador when addressing the United Nations General Assembly in November 1967 on Malta’s seminal proposal on the seabed and its resources as the common heritage of mankind.

The sea is our lifeline, yet it does not feature prominently in our policy priorities. As an island state, all issues relative to the sea should be at the very top of the country’s political agenda. It is with regret therefore that very little was said locally by government on the High Seas Treaty concluded within the UN framework earlier this week. This agreement, of crucial importance, is the culmination of negotiations which started in 2004 and builds on the legacy of the United Nations Convention of the Law of the Sea (UNCLOS) in respect of which Malta had a pivotal role through Ambassador Arvid Pardo.

Malta needs to rediscover its maritime vocation and be at the forefront of such international maritime initiatives and debate. In order to be proactive, we need a focused Ministry for Maritime Affairs which groups under one political head all maritime politics of relevance to the Maltese islands: ranging from the blue economy, fisheries and aquaculture to marine protected areas, the protection of coastal areas as well as ensuring that the Public Domain Act is implemented the soonest to ensure public access all along the coast and over time to reverse the commercialisation of the coast which has been going on for ages.

Once upon a time we had a Parliamentary Secretariat for Maritime Affairs. Nowadays maritime policy is a footnote to the list of Cabinet responsibilities, listed under the Ministry for Transport,  but in reality, it is fragmented over a multitude of Ministries. In practice this means that direct political responsibility and policy coordination in maritime policy is rather limited. This is a pity as it is a policy area which has so much potential!

The new treaty seeks to counter the destructive trends which is faced by the health of the oceans, not just at present, but also, more importantly, for generations to come. As emphasised by the spokesperson for United Nations Secretary General Antonio Guterres, the new treaty seeks to address the triple planetary crisis of climate change, biodiversity loss and pollution.

The treaty, concluded during the night between the 4 and 5 March, is crucial for implementing what is known as the 30×30 pledge of the Montreal Biodiversity Conference held last December. This is intended to protect a third of the biodiversity on land and at sea by the year 2030. This treaty establishes the legal framework required to start the long road towards implementation of the Montreal pledges, conclusions and initiatives.

The high seas begin where the exclusive economic zone of the different countries end, generally some 200 nautical miles (390 km) from the coastline. Comprising more than 60 percent of the world’s oceans they belong to no particular country. They are however under continuous threat from anthropogenic activity.

When the treaty enters into force, maybe, we will be a step closer to creating marine protected areas in international waters. That would be a historic achievement.

Arvid Pardo would be proud of such a moment. The best way of honouring his memory would be if we shoulder our international responsibilities, continuously protecting the marine environment which has contributed so much to what we are.

Ħmar il-lejl: l-ippjanar għall-kosta u r-riżorsi marittimi

Nhar it-Tnejn il-Parlament beda d-diskussjoni dwar l-implimentazzjoni tal-leġislazzjoni tad-dimanju pubbliku u b’mod partikolari dwar rapport li ħejjiet l-Awtorità tal-Ippjanar fuq is-siti nominati. Ir-rapport jirreferi għal 24 sit nominati prinċipalment mill-għaqdiet ambjentali: 16-il sit kienu nominati minn Flimkien għal Ambjent Aħjar (FAA), seba’ siti minn Friends of the Earth u sit wieħed mill-Ministru għall-Ambjent Josè Herrera.

Id-diskussjoni għadha fl-istadji inizzjali u s’issa kienet limitata għal spjegazzjoni tal-liġi li l-Parlament approva lejn nofs l-2016.

Moħbi mill-attenzjoni pubblika hemm il-ħtieġa urġenti li tkun implimentata d-Direttiva tal-Unjoni Ewropeja dwar l-Ippjanar tal-Ispazju Marittimu. Din id-Direttiva kellha tkun addottata sa tmiem l-2014. Permezz tal-Avviż Legali 341 tal-2016 Malta nnominat lill-Awtorità tal-Ippjanar bħala l-awtorità kompetenti li ser tieħu ħsieb dak li għandu x’jaqsam mal-ippjanar tal-ispazju marittimu fil-gżejjer Maltin.

Wara li staqsejt inġibdet l-atttenzjoni tiegħi li l-Pjan dwar l-Ispazju Marittimu għal Malta diġà jifforma parti mill-Pjan Strateġiku dwar l-Ambjent u l-Iżvilupp (Strategic Plan for the Environment and Development – SPED). Ngħid il-verità ma kontx irrealizzajt dan. Ħsibt li kien hemm xi paġni f’dak id-dokument li kienu qabżuli u allura mort infittex mill-ġdid u sibt sezzjoni intitolata Coastal Zone and Marine Area u taħtha tlett oġġettivi għall ħarsien tal-kosta. Dawn l-oġġettivi jistgħu, u nittama li jkunu, sviluppati fi strateġija dettaljata dwar l-Ispazju Marittimu Malti.

Waqt li Malta jidher li llimitat ruħha għal tlett oġġettivi xotti, pajjiżi oħra għamlu ħidma kbira biex jippreparaw il-pjani tagħhom dwar l-Ispazju Marittimu. L-Irlanda, per eżempju, ippubblikat dokument ta’ 88 paġna intitolat Harnessing our Ocean Wealth. An Integrated Marine Plan for Ireland. Min-naħa l-oħra, ir-Renju Unit ippubblika dokument ta’ 55 paġna intitolat UK Marine Policy Statement.

Dawn iż-żewġ dokumenti jidħlu fid-dettall dwar l-Ippjanar għall-Ispazju Marittimu meħtieġ fl-Irlanda u r-Renju Unit. Bla dubju dawn id-dokumenti jeħtieġ li jkunu supplimentati bi pjani ħafna iktar dettaljati. Id-Direttiva tal-Unjoni Ewropeja fil-fatt tistabilixxi s-sena 2021 bħala d-data sa meta għandhom ikunu ffinalizzati l-Pjani għall-Ispazju Marittimu.

Malta hi gżira mdawra bil-baħar Mediterran. Fatt li għandu jkun rifless f’politika marittima serja u aġġornata. Sfortunatament dan mhux il-kaz għax jidher li għalina f’Malta it-tlett oġġettivi dwar il-kosta fil-Pjan Strateġiku dwar l-Ambjent u l-Iżvilupp (SPED) huma biżżejjed.

Id-Direttiva tal-Unjoni Ewropeja dwar l-Ippjanar tal-Ispazju Marittimu bla dubju hi intenzjonata biex iċċaqlaqna ħalli nimlew it-toqob fil-politika tagħna. L-ekonomija l-blu, jiġifieri l-ħidma ekonomika li tiddependi fuq l-użu tar-riżorsi marittimi, teħtieġ attenzjoni ħafna iktar dettaljata.

Il-Gvernijiet Maltin, wieħed wara l-ieħor, għamlu ħerba fuq l-art u ħsara bla qies fiż-żoni naturali. F’xi kazi l-ħsara li saret ftit tista’ tiġi rimedjata. L-ilma tal-pjan hu l-eżempju ewlieni.

L-ippjanar b’attenzjoni tal-Ispazju Marittimu jista’ jkun ta’ għajnuna biex din l-imġieba żbaljata tal-Gvernijiet ma tkunx esportata lil hinn mill-kosta ħalli wara li ħarbatna l-art ma nħarbtux il-baħar ukoll.

Snin ilu kien pass għaqli li kienet indirizzata l-kwalità tal-ilma baħar bl-introduzzjoni tal-impjanti għat-tisfija tad-drenaġġ. Għad baqa’ xi jsir biex l-ilma msoffi, flok jintrema, jibda jintuża. Kontinwament għadna niffaċċjaw it-tniġġiż mill-gaġeġ tal-ħut li għandna fl-ibħra u li qed ikollhom impatti kemm fuq iż-żoni residenzjali kif ukoll fuq il-faċilitajiet turistiċi. Imbagħad hemm ukoll is-sajd, it-tibdil fil-klima, l-bijodiversita, is-sigurtà marittima, il-fdalijiet arkeologiċi fil-baħar kif ukoll il-ħmar il-lejl li nassoċjaw mar-riklamazzjoni tal-baħar. Pjan għall-Ispazji marittimi fil-gżejjer Maltin irid jindirizza dawn l-oqsma u bosta oħra b’mod integrat.

Il-gżejjer Maltin fihom 316 kilometru kwadrat. L-ibħra Maltin sa 25 mil nawtiku mill-kosta fihom medda ferm ikbar b’kejl ta’ 11,480 kilometru kwadrat filwaqt li l-blata kontinentali taħt il-ġurisdizzjoni Maltija fiha 75,779 kilometru kwadrat.
Din hi l-isfida li għandna quddiemna biex inħarsu l-ibħra tagħna.

Planning nightmares: the coastline and marine resources

 

Last Monday, Parliament commenced a discussion on the implementation of the Public Domain legislation, in respect of which the Planning Authority has submitted a report entitled “Sites Nominated to be declared as Public Domain”. This report refers to 24 sites, nominated primarily by eNGOs: 16 sites were nominated by Flimkien għal Ambjent Aħjar (FAA), seven by Friends of the Earth and one by Minister for the Environment Josè Herrera.

The discussion is still in its initial stages and so far it has been limited to an explanation of the legislation enacted by Parliament in mid-2016.

Currently under the radar is the urgent need to implement the EU Directive on Maritime Spatial Planning, which had to be adopted by end of 2014. Malta has, in fact, adopted it and through Legal Notice 341 of 2016 it identified the Planning Authority as the competent authority which will deal with issues of maritime spatial planning in the Maltese Islands.

After submitting a query, it was pointed out to me that the Strategic Plan for the Environment and Development (SPED) shall constitute Malta’s Maritime Spatial Plan – something I had not realised. Thinking that I had missed something, I checked the SPED and found a text entitled Coastal Zone and Marine Area under which are listed three coastal objectives. These are clearly objectives that can (and hopefully will) be developed into a detailed Maritime Spatial Plan.

While Malta has apparently limited itself to three brief objectives, other countries have gone into considerable detail to prepare their Maritime Spatial Plans. Ireland, for example, has published an 88-page document entitled Harnessing our Ocean Wealth – an Integrated Marine Plan for Ireland and the United Kingdom has published a 55-page document entitled UK Marine Policy Statement.

Both documents go into some detail as to the Maritime Spatial Planning required in Ireland and the United Kingdom and they will undoubtedly have to be supplemented with more detailed plans. The EU Directive determines the year 2021 as the deadline for the establishment of Maritime Spatial Plans.

The fact that Malta is an island should be reflected in more importance being given to maritime policy. Unfortunately, this is clearly not the case as it seems that we have to manage with three coastal objectives in our Strategic Plan for Environment and Development (SPED).

The EU Directive on Maritime Spatial Planning is intended to nudge us to fill the gaps in our policies and plans. The blue economy, which is the economic activity dependent on the utilisation of marine resources, requires much careful planning.

Successive Maltese governments have ruined land-based resources and natural habitats. At times this has been done almost beyond repair. The water table is one such glaring example.

Careful maritime spatial planning could be of assistance in not exporting this erroneous behaviour beyond the coastline so that the environmental damage inflicted on the land is not repeated at sea.

Some years ago, addressing the quality of seawater by ensuring that urban wastewater dumped into the sea was adequately treated was a positive step. More still needs to be done to use the treated water. We repeatedly face issues of contamination arising out of fish-farms that has a negative impact on our residential and tourist facilities. What about fishing, energy, climate change, biodiversity, maritime safety, marine archaeological remains and land reclamation nightmares? A Maritime Spatial Plan for the Maltese Islands has to address all these issues and many more, in an holistic manner.

The Maltese Islands have a land area of 316 square kilometres. On the other hand, the area around the Maltese islands up to 25 nautical miles from the shoreline measures 11,480 square kilometres, while the area of the Continental Shelf under Malta’s jurisdiction in terms of the Continental Shelf Act measures approximately 75,779 square kilometres.

This is the physical extend of the challenge we face to protect our sea.

Arvid Pardo : 50 years on

Going by the Prime Minister’s address to the EU Conference held in Malta this week on the protection of the oceans. it would be reasonable to assume that, as a maritime nation, Malta’s commitment is second to none.

Searching through the website of the Environment and Resources Authority (ERA) reveals a number of reports required by the EU Marine Strategy Framework Directive (MSFD) from EU member states. However, perusal of the relative EU website reveals that Malta’s reports were not presented within the timeframes established by the Directive.

Clearly, notwithstanding what the Prime Minister says, we still need to pull our socks up.

As an island state, it is essential that we lead rather than follow in maritime matters. There was a time when Malta was the leader, when Malta’s Ambassador to the United Nations, Arvid Pardo, presented the ground-breaking initiative to consider the seabed resources as the common heritage of mankind. That was 50 years ago, in November 1967, at a session of the United Nations General Assembly.

Arvid Pardo’s initiative on behalf of Malta was, for a considerable time, pushed to the sidelines by a Labour-led government, permitting other countries to take the lead instead. In fact, when push came to shove, Jamaica squeezed Malta out and was selected to host the International Seabed Authority in Kingston. Malta had, for some time, indicated that it was no longer interested in pursuing its own initiative.

Malta has a maritime vocation. As an island nation, it needs to consider maritime politics as both a duty as well as an opportunity. The implications of all this is explained in some detail in a marine economic and social analysis report commissioned by the ERA in terms of article 8 of the MSFD and available on its website.

Sub-titled “an initial assessment”, the 133 page report concludes that 15.4 per cent of the Maltese economy makes use of the marine environment either as a provider of resources, as an input in the product or service provided or as a sink function. This enormous importance of the marine environment to the Maltese economy is further increased when one bears in mind that in other European Union member states this same statistic varies between three per cent and five per cent.

The report further states that the 15.4 per cent contribution of the marine environment to the economy does not include the use of bathing areas as well as the use of the sea as the primary source of potable water in Malta.

Over the years, I do not recall other political parties giving any weight to the significance of the marine environment in their political discourse. It is about time that this changed, because it is imperative that we realise the central importance of the marine environment.

Malta should follow in Arvid Pardo’s footsteps and take the lead in maritime issues: there is so much to do. The fact that the Marine Framework Strategy Directive is still in its infancy offers a unique opportunity that was not sufficiently highlighted during the six month presidency of the EU held by Malta earlier this year.

F’waħda mill-okkazjonijiet li fihom indirizza lill-istampa riċentement qal li l-budget għall-2015 hu wieħed li jħares l-ambjent!

Ħadd ma jistax jiċħad li l-budget fih numru ta’ miżuri ambjentali. Imma b’daqshekk ma jfissirx li dan hu budget ambjentali. Kulma jagħmel il-budget hu li jiġbor flimkien id-diversi miżuri li qed jippjana li  jieħu l-Gvern matul is-sena 2015. Jonqsu viżjoni koerenti ambjentali li la għandu u l-anqas jidher li jista’ jkollu fil-futur immedjat.

Il-ħarsien tal-ambjent m’huwiex biss dwar il-kostruzzjoni, imma ukoll dwar il-bijodiversita, is-sostenibilita’, l-kwalita tal-arja, il-politika dwar ir-riżorsi, il-viżjoni marittima, l-ilma, il-politika dwar il-klima, l-enerġija alternattiva, t-trasport, l-ekonomija l-ħadra, l-ekonomija l-blu, l-ekonomija ċirkulari, it-tassazzjoni ambjentali u tant affarijiet oħra.

Il-politika tal-Gvern ta’ Joseph Muscat dwar l-Iżvilupp sostenibbli (jekk  teżisti) tqieset mill-Ministru Edward Scicluna bħala li m’għandiex relevanza għall-budget tal-2015

Il-politika dwar l-iżvilupp sostenibbli tinseġ flimkien il-politika ambjentali, dik ekonomika u soċjali. Meta tkun żviluppata kif imiss, il-politika dwar l-iżvilupp sostenibbli tassigura l-interessi tal-ġenerazzjonijiet futuri billi tmexxi l-quddiem l-ekonomija b’rispett sħiħ lejn l-ambjent u lejn il-bniedem. Għalhekk ngħidu li l-politika dwar l-iżvilupp sostenibbli hi mibnija fuq erba’ pilastri: l-iżvilupp ekonomiku, l-ħarsien tal-ambjent, il-ħarsien soċjali u l-politika kulturali.

Fil-ġranet li ġejjin ikolli l-opportunita’ nispjega iżjed fid-dettall kemm il-budget ippreżentat għall-2015 bl-ebda mod ma jista’ jitqies budget li jħares l-ambjent.  Minkejja li hemm miżuri individwali li huma pożittivi ma teżistix viżjoni ambjentali ċara u koerenti.

Għalhekk Joseph qed jiċċajta meta jgħid li dan hu budget ambjentali.

On Monday 29 September at 2.30pm Karmenu Vella, Malta’s nominee to the Juncker led EU Commission will meet with Members of the European Parliament who sit on the Parliamentary Committees dealing with the Environment, Fisheries and Maritime Affairs. They will listen to his introductory views on the responsibilities which he has been assigned and subsequently they will ask questions.

For three hours they will listen to his answers after which they will decide whether in their opinion he is suitable for the post to which he has been nominated, that is as EU Commissioner for the Environment, Maritime Affairs and Fisheries.

The MEPs will be interested to hear Karmenu Vella explain as to how he will go about with the proposed revision and possible consolidation of the Birds Directive and the Habitats Directives which matter he was specifically instructed by Commission President-elect Jean-Claude Juncker to take in hand. These views are especially significant in view of the quasi unconditional support which the Labour Party in Malta gives to hunters and trappers. The European Voice on Monday 22 September paraphrased it very accurately when it stated that: the matter “is particularly sensitive because Malta has been in repeated and continued violation of these laws because of bird hunting.” Will Karmenu Vella, for example, in view of the Labour’s experiences in Malta seek to sanction spring hunting within the rest of the EU? MEPs will undoubtedly be very eager to learn about what possiblies lies ahead if EU Environmental governance is dependent on Karmenu Vella!

In the letter of appointment Jean-Claude Juncker identified 5 clear targets which Karmenu Vella has to attain, namely:

  1. The overhaul of existing environmental legislative framework,
  2. The European Union strategy about the quality of air,
  3. The circular economy and the results achieved to date and in the light of the first reactions of the European Parliament and of the Council of Ministers,
  4. The implementation of the common fisheries policy,
  5. Active participation in international fora on the Oceans within the United Nations and other multilateral and bilateral fora.

MEPs would be very much interested as to what is in store as a result of environmental deregulation. Which legislative instruments will be targeted? How will Karmenu Vella in his role as Commissioner  seek to ensure that the protection which the EU has to date afforded to both man and the eco-system is not dismantled but rather reinforced?

The European Chemicals Agency which deals with the implementation of the REACH Directive has been removed from the Environment portfolio and transferred to the portfolio dealing with Enterprise. This is not a matter which Karmenu Vella has to answer for but it is indicative as to the forces at play on Juncker’s table. The REACH Directive is not considered as an environmental matter by Jean-Claude Juncker. In his opinion it has to be administered primarily in the interests of enterprise, that is of business and industry.

Committees of the European Parliament will by now have digested the experiences of former European Commissioner John Dalli. As a result they would be more than interested about Karmenu Vella’s contacts with the business world, about his thoughts on lobbying as well as what he think’s transparency is all about.

A report published by the Corporate Europe Observatory earlier this month is entitled: Do not bet on the commissioner: the case of Karmenu Vella of Malta.  Since this report emphasises that Karmenu Vella “is not suitable to be a commissioner” the members of the Committees of the European Parliament would undoubtedly wish to hear from Karmenu Vella as to why, in his opinion they should arrive at a different conclusion.

Il-biża’ dwar Karmenu Vella: strument biex imexxu l-arloġġ lura

Il-ħatra ta’ Karmenu Vella minn Jean-Claude Juncker biex ikun responsabbli (fost affarijiet oħra) għall-politika ambjentali tal-Unjoni Ewropeja qed tnissel biża’ mhux żgħira fost l-għaqdiet ambjentali Ewropej w internazzjonali.

Karmenu Vella mhux bniedem li jbeżża’ n-nies. Huwa l-programm politiku li għandu quddiemu li hu tal-biża’. Huwa programm politiku li fil-qasam tal-ambjent imexxi l-arloġġ lura.

Jean-Claude Juncker jidher li għandu l-mira li jdgħajjef jew jelimina kull regolament ambjentali li jista’ jitqies bħala li hu ta’ xkiel għall-ħidma ekonomika. Issa meta jingħad kliem f’dan is-sens ifisser li l-business u l-industrija jitħallew jagħmlu li jridu għax dawn iqiesu kull regola bħala li ixxekkilhom fl-iskop uniku tagħhom: dak li jimpalaw l-euros! Regoli li jipproteġu n-nies u l-ambjent. Regoli li jippruvaw jasiguraw imġieba korretta. Dawn kollha qegħdin fil-mira tal-Kummissjoni immexxija minn Jean-Claude Juncker.

Karmenu Vella ġej minn pajjiż (u minn partit politiku) li ftit li xejn għandu kredibilita’ fejn tidħol l-osservanza tar-regolamenti ambjentali. Il-lista hi twila u mhux il-Gvern tal-lum biss ta’ kontribut għal din il-fama ħażina: il-Gvernijiet ta’ Gonzi u Fenech Adami ukoll għandhom jerfgħu ir-responsabbilta’ għal dan.

L-għaqdiet ambjentali internazzjonali, għaxra minnhom, mhux minn Karmenu Vella biss qed jibżgħu. Huma inkwetati mill-programm politiku tal-Kummissjoni immexxija minn Jean-Claude Juncker li jidher li jrid idawwar l-arloġġ lura fil-qasam ambjentali.

F’ittra pubblika grupp ta’ għaxar għaqdiet ambjentali isemmu r-raġunijiet dettaljati għal din il-biża’ tagħhom kif ġej:

  1. Ir-responsabbiltajiet ambjentali flimkien ma dawk għas-sajd u l-politika marittima taħt Kummissarju wieħed ser idgħajfu l-impenn u l-prijorita’ li għandu jkollha l-politika ambjentali,
  2. L-oġġettiv ewlieni tal-Kummissjoni għall-ħames snin jidher li hu tnaqqis tar-regolamentazzjoni (deregulation),
  3. L-inkarigu ċar u speċifiku lil Karmenu Vella biex jinbidlu id-direttivi dwar l-Għasafar u l-Habitats: hu messaġġ ċar kontra l-ħarsien tal-bijodiversita’,
  4. Ġew imqegħda flimkien, taħt Kummissarju wieħed ukoll, l-enerġija u t-tibdil fil-klima: dan ifisser li l-azzjoni dwar il-bidla fil-klima ser tkun soġġetta għas-suq tal-enerġija,
  5. L-għażla bħala Kummissarju għall-Klima u l-Enerġija ta’ persuna b’kuntatti magħrufa fl-industrija taż-żejt jnissel biża’ addizzjonali ta’ kunflitt ta’ interess,
  6. Iċ-ċaqlieq tar-responsabbilta’ għal Aġenzija Ewropeja dwar il-Kimiċi (u allura d-Direttiva REACH) mid-Direttorat Ġenerali dwar l-Ambjent għad-Direttorat Ġenerali tal-Intrapriża juri b’mod ċar li l-interessi tal-industrija qed jitpoġġew qabel l-interessi tan-nies, qabel il-ħarsien tas-saħħa u qabel konsiderazzjonijiet ta’ ħarsien ambjentali,
  7. Ma hemm l-ebda Viċi President tal-Kummissjoni inkarigat milli jikkorodina l-ħidma ambjentali (ekonomija l-ħadra, żvilupp sostenibbli, ħarsien tar-riżorsi ………….).

 

Dan kollu jfisser li l-Kummissjoni Juncker ser tkun Kummissjoni kontra l-politika ambjentali. Il-kliem li l-għaqdiet ambjentali jużaw hu li ser ikun hemm “a de facto shut-down of EU environmental policy making.”

Din hi l-biża’. Mhux biss biża’ minn Karmenu Vella, imma biża’ li l-Kummissjoni immexxija minn Jean-Claude Juncker ser iddawwar l-arloġġ lura fil-qasam tal-ambjent u Karmenu Vella ser ikun l-istrument biex dan iseħħ.

 

Jean-Claude Juncker, Karmenu Vella and the missing cluster

EU Juncker Commission

When Jean-Claude Junker announced the distribution of the responsibilities in his Commission on Wednesday 10 September 2014 he decided to group the Commissioners into a number of clusters which he called project teams led as follows:

Frans Timmermans (NL), the First Vice President will deal with Better Regulation, Inter-Institutional Relations, the Rule of Law and the Charter of Fundamental Freedoms. He will oversee the Project on Home Affairs and Justice in addition to being Juncker’s Deputy.

Federica Mogherini (IT) the High Representative for Foreign and Security Policy will oversee a Project Team dealing with Enlargement, Development, Humanitarian Aid and Trade

Andrus Ansip (ET) will be the Vice President leading the project on the Digital Single Market.

Alenka Bratusek (SL) will be the Vice President leading the Energy Union project whilst Vladis Dombrovskis (LT) will as Vice president lead the project on the Euro and Social Dialogue.

Jyrki Katainen (FI) will lead the project on Growth, Investment and Competitiveness Project whilst Kristalina Georgieva (BG) will head the EU Budget and Human Resources Project.

These clusters or projects will bring together Commissioners responsible for specific areas such that there is coordination and purpose in the work of the Commission. Whilst the treaties provide for such a horizontal structure this is the first time that it is being tried. If it succeeds it will become the new template and it will settle once and for all the debate on the size of the Commission.

There is however one missing cluster: a cluster dealing with Sustainable Development. This point has been emphasised by the international NGO World Wildlife Fund in its comments about Juncker’s Commission.

The EU Sustainable Development Strategy is by its very nature a well defined cluster of priorities which identified seven key priority challenges many of which are predominantly environmental.

Yet the Juncker Commission has ignored all this and grouped together the Environment with Fisheries and Maritime Policy, in the process downgrading the importance of all three areas of policy.

Jean Claude Junker needs the approval of the EU Parliament to implement this plan.  From the various statements being made it seems that some MEPs do not have the intention of giving this stamp of approval as they consider that the Environment on the one hand and Fisheries and Maritime Affairs on the other hand each require a separate Commissioner to be dealt with appropriately. The same goes for Energy and Climate Change which likewise have been assigned as responsibilities of one Commissioner instead of two separate Commissioners.

Its fine for the President-elect of the EU Commission to encourage the development of the Green Economy and the Blue Economy as he has emphasised in the mission letter to Commissioner-designate Karmenu Vella. This will not however be achieved sidelining sustainable development, nor by relegating the Environment, Fisheries  and Maritime Policy to a second class status within the Commission.
