Ftit ħsibijiet wara t-traġedja f’Ġenova

Wara l-kollass tal-pont f’Ġenova hemm numru ta’ lezzjonijiet, anke għalina, mijiet ta’ kilometri ‘l bogħod mill-pont Morandi.

Minkejja li l-investigazzjonijiet uffiċjali dwar l-għaliex seħħ dan il-kollass tal-pont għadhom bil-kemm bdew, il-media Taljana diġá qed tiddiskuti dak li ġara fid-dettall. Il-pontijiet kollha fl-Italja qegħdin taħt il-lenti, b’mod partikolari dawk li hu magħruf li m’humiex f’kundizzjoni tajba u li allura jistgħu, f’qasir żmien jikkollassaw huma ukoll. Dan jassumi sinifikat ikbar meta wieħed iqis li f’dawn l-aħħar ħames snin, fl-Italja, diġa ikkollassaw seba’ pontijiet oħra, u qiesu ma ġara xejn!

Bla dubju, fost il-lezzjonijiet ewlenin, jeħtieġ nifhmu l-ħtieġa li nieħdu ħsieb u nikkuraw b’mod adegwat il-proġetti pubbliċi. Għax anke f’Malta, wara li l-proġetti pubbliċi jkunu saru, ħafna drabi ftit nagħtu kas tagħhom. Ħarsa ftit lejn il-flyover li tifforma parti mill-bypass tal-Marsa/Ħal-Qormi kif inhi illum, tkun biżżejjed, avolja kif ħabbret Infrastruttura Malta nhar il-Ġimgħa ma hemm l-ebda ħsara strutturali. Huwa biss issa li tħabbar li ser jibda programm ta’ manutenzjoni, issa li n-nies, wara l-istraġi ta’ Ġenova, bdiet tistaqsi l-mistoqsijiet. Forsi, min jaf, mil-lum il-quddiem jibda jkollna skeda regolari ta’ manutenzjoni tal-proġetti pubbliċi kollha. Forsi xi darba l-mini ta’ Santa Venera ma jibqgħux iqattru.

Hemm ukoll x’jingħad dwar il-governanza tajba fil-proġetti pubbliċi.

Deċiżjoni riċenti tal-bord li jirrevedi l-kuntratti pubblici (Public Contracts Review Board) hi ta’ tħassib kbir. L-għoti tal-kuntratt għall-bini u t-tkomplija taċ-Ċentru tas-Saħħa f’Raħal Ġdid ġie mwaqqaf wara li Public Contracts Review Board esprima dubji serji fuq kif tmexxew il-proċeduri tal-evalwazzjoni tal-offerti. Fil-fatt ġie identifikat li żewġ professjonisti (inġinier u Perit) kienu konsulenti kemm tal-Fondazzjoni tas-Servizzi Mediċi tal-Ministeru tas-Saħħa kif ukoll ta’ tnejn minn dawk li tefgħu l-offerti. Fil-fehma tiegħi huwa diffiċli ferm biex nifhem kif ħadd mill-Fondazzjoni għas-Servizzi Mediċi ma nduna b’dan il-konflitt ta’ interess. Kont nistenna xi ħaġa aħjar mill-Fondazzjoni, għax jidher li ftit li xejn qed jagħtu importanza lill-ħtieġa ta’ governanza tajba fil-ħidma tal-fondazzjoni.

Issa li l-Public Contracts Review Board ħa deċiżjoni nistenna li l-korpi professjonali li jirregolaw l-inginiera u l-periti jeżaminaw sewwa l-kaz biex jaraw x’passi għandhom jieħdu f’dak li hu ksur ta’ etika professjonali bażika.

Il-kontroll adegwat tal-materjali li jintużaw fuq is-sit ta’ kostruzzjoni hi materja oħra ta’ importanza fundamentali. Din mill-ewwel tfakkarni fl-investigazzjoni li saret dwar il-kwalitá tal-konkos użat fl-isptar Mater Dei. Anke hawn kienet responsabbli l-Fondazzjoni għas-Servizzi Mediċi. Dwar dan ma kienx hemm biss l-inkjesta li saret taħt it-tmexxija tal-Imħallef irtirat Philip Sciberras imma ukoll rapport tal-Awditur Ġenerali fuq talba tal-Ministru tal-Finanzi. Dan ir-rapport kien konkluż u ippubblikat f’Mejju li għadda.

Niftakru li l-Awditur Ġenerali fir-rapport tiegħu kien emfasizza li rriżultalu li kien hemm nuqqas kbir ta’ dokumentazzjoni dwar kull stadju tal-proġett (significant lack of documentation with respect to all stages of the project). Dan wassal lill-istess Awditur Ġenerali biex jikkonkludi li “l-inkapaċita tal-Fondazzjoni li tipprovdi l-informazzjoni bażika dwar proġett ta’ dan il-kobor ifisser falliment istituzzjonali u negliġenza grassa fl-amministrazzjoni ta’ fondi pubbliċi” (the Foundation’s inability to provide basic information relating to a project of this magnitude represents an institutional failure and gross negligence in the administration of public funds).

Min-naħa l-oħra, anke l-inkjesta immexxija mill-Imħallef irtirat Philip Sciberras identifikat nuqqasijiet kbar li dwarhom irrakkomandat li jittieħdu passi.

In partikolari qed nara quddiemi l-konklużjoni numru 5 tar-rapport Sciberras li tgħid li “in-nuqqasijiet gravi li nkixfu bir-rapporti tekniċi tal-lum jindikaw li l-konkos dgħajjef li nstab f’kull parti tas-sit hu riżultat intenzjonat ta’ azzjonijiet bi skop ta’ frodi. Il-Bord ifforma l-impressjoni ċara li l-ġrajjet li wasslu għal dan ma kienux riżultat ta’ koinċidenza, lanqas ma kienu providenzjali, imma warajhom kien hemm id moħbija li tagħti direzzjoni.” (the widespread failings uncovered by the present day technical reports indicate that the pervasive weak concrete found in the site is a result of intended fraudulent actions. Moreover the Board is left with a distinct impression that events as they transpired were not the fruit of coincidence or providence but seem to indicate an element of concertation and direction.)

Ma tantx jidher li sar wisq dwar dawn ir-rakkomandazzjonijiet. X’qed nistennew? Li jaqa’ x’imkien?

Hemm tagħlim waħda bażika minn Ġenova: in-nuqqas ta’ governanza tajba tista’ twassal ukoll għall-imwiet.

Lessons from the Genova bridge collapse

The collapse of the Morandi bridge in Genova should lead to a number of lessons which have an application hundreds of kilometres away from Genova.

Notwithstanding the fact that the official investigations into the bridge collapse have barely commenced, the media in Italy is discussing the possible causes of the collapse and whether there are any other bridges on the Italian mainland that may shortly have a similar fate. The fact that there have been some seven other bridge collapses in Italy during the past five years adds more fuel to this debate.

Among the many lessons to be learnt is the need to ensure adequate maintenance of public structures at all times. How does Malta score? Not very well, I would say. Have a look at the bridge forming part of the Marsa/Qormi flyover. It does not send out a good message even if, as stated by Infrastructure Malta on Friday, the flyover is structurally safe. The authorities in Malta have only announced the commencement of a maintenance programme for this bridge when questions began being asked as a result of the Genova tragedy.

Hopefully we will henceforth have regular maintenance schedules of all public structures and,  maybe, someday the dripping Santa Venera tunnels will be seen to permanently!

What about good governance in tenders for public projects? A recent decision by the Public Contracts Review Board is cause for concern. The award of the contract for the building and finishing of a health centre in Paola was halted by this Board after serious doubts regarding the evaluation procedure were raised. In fact, two professionals (an engineer and an architect) were identified as being simultaneously advisors of the Health Ministry’s Foundation for Medical Services as well as two of the three tenderers. It is, in my opinion, very difficult to understand how nobody at the Foundation for Medical Services was aware of this glaring conflict of interest. Good governance is apparently not the Foundation’s strong point.

Now that the Public Contracts Review Board has decided the case, I would expect that the professional bodies regulating the professionals involved take appropriate action on what is clearly a very serious breach of professional ethics.

Adequate quality control of materials used on site is another fundamental issue. The investigations regarding the quality of concrete used in the construction of the Mater Dei Hospital project comes to mind. The Foundation for Medical Services was also responsible for this project.

This issue has been dealt with not only by an inquiry led by retired judge Philip Sciberras but also by a report drawn up by the Auditor General at the request of the Finance Minister, which was concluded and published last May.

We may remember that, in the Auditor General’s report, it was emphasised that he found a “significant lack of documentation with respect to all stages of the project”. This led the Auditor General to conclude that “the Foundation’s inability to provide basic information relating to a project of this magnitude represents an institutional failure and gross negligence in the administration of public funds”.

On the other hand, the inquiry led by retired judge Philip Sciberras also identified various deficiencies in respect of which it recommended that action be taken.

I point in particular to conclusion No. 5 of the Sciberras report which states that : “the widespread failings uncovered by the present day technical reports indicates that the pervasive weak concrete found in the site is a result of intended fraudulent actions. Moreover, the Board is left with a distinct impression that events as they transpired were not the fruit of coincidence or providence but seem to indicate an element of concertation and direction.”

Apparently, not much has been done to date regarding the  implementation of the recommendations of these reports. Shall we wait for our own bridge collapse before action?

There is one basic lesson to be learnt from the Genova tragedy: a lack of good governance is a potential killer.

Il-każini tal-banda: liġi għall-allat u oħra għall-annimali

 

Nhar il-Ġimgħa li għaddiet, fil-Gazzetta tal-Gvern, ġie ppubblikat abbozz ta’ liġi li f’parti minnu jitkellem dwar il-każini tal-banda.

Wara li xahar ilu, f’April li għadda, l-Qorti, f’appell deċiż mill-Imħallef Anthony Ellul, iddeċidiet kawża kontra l-każin tal-banda De Paule tar-Raħal Ġdid, il-Gvern permezz tal-Ministru Owen Bonnici kien wiegħed li ser iħares lejn kif jista’ jemenda l-liġi biex iżid il-protezzjoni lill-każini tal-banda. Għalkemm kien tħabbar dakinnhar li l-Opposizzjoni kienet kkonsultata, s’issa mhux magħruf jekk hemmx qbil bejn Gvern u Opposizzjoni dwar l-abbozz ippubblikat.

Il-Qorti kienet iddeċidiet li fil-Każin tal-Banda de Paule kienu saru alterazzjonijiet bla awtorizzazzjoni u għaldaqstant skond ma jipprovdi l-kuntratt tal-kirja ordnat li l-każin jingħata lura lis-sidien u dan għax inkisru l-kundizzjonijiet tal-istess kuntratt.

Bl-emendi proposti ser ikun possibli li dan ma jsirx. L-emendi proposti għal-Kodiċi Ċivili jipproponu li (fil-każ tal-każini tal-banda) l-kirja tista’ tibqa’ fis-seħħ jekk fost oħrajn il-kera tiżdied b’għaxar darbiet kif ukoll li tingħata garanzija li l-binja tkun tista’ tiġi restawrata għall-istat oriġinali qabel ma saru l-alterazzjonijiet mhux awtorizzati.

Bla dubju l-emendi huma motivati mill-ħsieb nobbli li tingħata difiża lill-funzjoni soċjali u importanti tal-każini tal-banda fil-komunitá.

Imma hemm problema kbira. Il-Gvern għal darba oħra qed jagħti l-messaġġ li hemm min hu l-fuq mil-liġi. Jiena u inti jekk niksru l-liġi nħallsu l-konsegwenzi. Imma għat-tieni darba għandna min qiegħed jitqiegħed il-fuq mil-liġi.

Ftit ġimgħat ilu kellna lil tal-kmamar tan-nar li wara tletin sena jiksru l-liġi kellhom sentenza kontra tagħhom u l-Gvern bidel il-liġi li tirregola d-distanzi li jridu jinżammu mill-kmamar tan-nar, biex il-bdiewa u l-komunitá rurali taż-Żebbiegħ baqgħu jsaffru l-Aida.

Issa għandna lill-każini tal-banda.

Ir-rispett lejn is-saltna tad-dritt (r-rule of law jiġifieri) tfisser ukoll r-rispett lejn is-sentenzi tal-Qrati tagħna. Tfisser ukoll li l-Gvern ma jagħtix messaġġ li f’ċerti ċirkustanzi ma jkun hemm l-ebda diffikulta li xi ħadd, hu min hu, jitqiegħed il-fuq mil-liġi.

Lil hinn mill-importanza soċjali tal-każini tal-banda il-liġi proposta hi liġi ħażina għax timmina s-saltna tad-dritt.

Hemm modi oħra kif jistgħu jkunu mgħejjuna l-każini tal-banda mingħajr ma tkun imminata s-saltna tad-dritt.

Imma mid-dehra l-Gvern mhux interessat: għax issa drajna li f’dan il-pajjiż għandna liġi għall-allat u oħra għall-annimali, kif kien ibbottja Varist Bartolo!

Moving away from Ali Baba politics

Way back in 2008 during the general election, Alternattiva Demokratika – The Green Party in Malta had put the issue of a possible parliamentary coalition on the national political agenda.

The PN, then, did its best to try and ridicule the proposal as it preferred to go it alone. At the end of the day, the PN just managed to scrape through the general election by the minimum of margins (1580 votes) on a national level. Eventually, however, it had to pay the consequences, as it ended up as a political hostage of a couple of unprincipled mavericks.

Simon Busuttil is trying not to repeat his predecessor’s mistake. He has called for the formation of a coalition against corruption, hoping that until the forthcoming general election, such a coalition will coalesce around the PN. This is similar to the strategy adopted by Joseph Muscat who transformed the Labour Party into what he described as a “movement”. In practice, however, Muscat’s endeavours have only transformed his Labour Party into a modern day version of Ali Baba and the Forty Thieves!

To date, both the PN and the Labour Party have acted in such a way that the only coalition that made sense to them was the one within their own parties as both of them have over the years developed into grand coalitions, at times, championing diametrically opposed causes simultaneously.

However, coalitions are forged quite differently, at least those coalitions that are intended to contribute positively to the local political kaleidoscope.

The first foundation on which coalitions are built is reciprocal respect. Without reciprocal respect, those forming part of a coalition end up clowning around, trying to impress those around them with their buffoonery.

A second essential prerequisite for a coalition is an agreed political programme which clearly communicates the agreed common objectives of the coalition members. It would obviously be expected that members of such a coalition act in accordance to such an agreed political programme. Supporting environmental protection as an essential element of a programme to better everyone’s quality of life would undoubtedly feature in such an agreed political programme to which Alternattiva Demokratika could adhere. This would also be in line with the PN’s recent “conversion” in support of environmental activism.

It is not however clear how these newly discovered credentials of the PN are manifested by going around patting the management of Palumbo Shipyards and Malta Freeport Terminals on the back, congratulating them on their achievements which have inconvenienced their neighbours in the surrounding localities. This was recently done by the Leader of the Opposition Simon Busuttil during his visits to the Għajn Dwieli yard and the Kalafrana Terminal.

Consistency by the coalition members is not only desirable, it is an essential prerequisite for a coalition intended to last!

A coalition is not formed just to win an election. On the contrary, it seeks to win an election in order to be in a position to implement an agreed electoral programme. Winning an election is a means to an end and not an end in itself. It is for this reason that coalitions seek to bring together people and political parties who share a sufficient number of ideals on the basis of which they can construct a common electoral platform. Otherwise, what purpose would be served if those forming part of a coalition are not at ease with the new political environment which they seek to create?

For this specific reason, coalitions must be based on sound political principles. Having a coalition or a political party based on anything else is a recipe for the creation of an additional Ali Baba den, of which the present one is more than enough.

A solution to the current ethical crisis, which Malta’s political infrastructure is faced with, will not be delivered by a Parliament which is composed of only two political parties. This ethical crisis can only be overcome if more than two political parties make it to Parliament and if the winner-takes-all mentality and behaviour is consigned to the dustbin of history once and for all . This is both essential and possible without any changes to Malta’s electoral legislation and still allows for like-minded political parties to form a coalition.

It is important that those who have discarded good governance are set aside by the electorate in the forthcoming general election. It is however equally important that the machinery of government is never again entrusted into the hands of one single political party. In Malta’s particular circumstances only this can guarantee that good governance is placed on solid foundations.

Comino: beyond sun-block and deckchairs

During the past weeks, the island of Comino has been in the news. The controversy surrounding the deckchair/umbrella hawkers free-for-all at the Blue Lagoon focused on overcharging, breaching of permit conditions and the resulting lack of space for the public making use of public facilities at the beach.

Fines were imposed by the Malta Tourism Authority. This is fine (pun intended) in the short term. However, we need to plan for the long term, keeping in mind  that the island of Comino, is first and foremost a Natura 2000 site and a touristic destination second. Sites forming part of the Natura 2000 network are designated as Special Areas of Conservation (SAC) and Special Protection Areas (SPA) according to the Habitats and Birds Directives of the European Union, where habitats and species are listed. The Directives are designated to provide protection to the most vulnerable of the species listed.

It has been stated that every day, at the peak of the summer season, as many as 5,000 visitors land on Comino, most of whom remain in the Blue Lagoon and its environs .

The Natura 2000 Management Plan for Comino published recently, considers that tourism at the Blue Lagoon needs to be controlled efficiently in order to ensure that it is “in harmony with the site’s conservation needs”. One of the measures which the Comino Management Plan establishes as an operational objective is “to plan and implement a tourism carrying capacity assessment of the Blue Lagoon”.

The Management Plan believes that the tourism carrying capacity assessment should be carried out within the first year of the plan’s implementation, which means pretty soon! The issue is of fundamental importance in ensuring that the activity permitted on the island of Comino is compatible with its ecological requirements.

It is not known whether this carrying capacity assessment has been carried out yet. If not it should be done at the earliest.

This is not the first time that Maltese authorities have been asked to consider a proposal to study the possibility of limiting access to a specific site for protection purposes. Around 12 years ago, after rehabilitation work carried out at the Hypogeum in Ħal-Salfieni was concluded, it was decided that there was an urgent need to control its microclimate in order to better protect this archeological jewel so a maximum limit of 80 visitors per day was established.

Various other countries place limits on tourism in order to better control its environmental impacts. There are various examples, but permit me to point to the Brazilian archipelago of Fernando de Noronha, 545 kilometres off the coastal city of Recife. The archipelago is a UNESCO World Heritage site and the number of visitors is restricted in order  to adequately protect its environmental patrimony. The environmental protection rules of the Brazilian archipelago of Fernando de Noronha go into such detail as to even forbid the use of sunprotection lotions/creams or even the use of footwear on the beach, as well as curtailing various other activities incompatible with the archipelago’s ecological characteristics!

It is a path we should consider following for Comino, if we are serious about protecting the little that we still have.

It is welcome news earlier this week as three of Malta’s environmental NGOs, Din l-Art Ħelwa, Friends of the Earth and Nature Trust, have endorsed the proposal for carrying out the capacity assessment of the Blue Lagoon at Comino. Comino deserves our protection. Implementing the Natura 2000 Management Plan for Comino would be a suitable first step.

And the sooner, the better.

Kemmuna: mhux dwar l-umbrelel

Matul il-ġimgħat li għaddew diversi paġni tal-gazzetti imtlew b’aħbarijiet minn Kemmuna: il-battalja bejn dawk li jikru l-umbrelel.

Issa l-għaqdiet ambjentali ħarġu bi proposta dwar il-kontrolli rejali li hemm bżonn isiru fuq Kemmuna: kemm għandhom jirfsu l-art persuni? X’inhu dak in-numru li  jkun aħjar li ma jinqabiżx?

In-numru jrid ikun stabilit bi ħsieb. Imma jeħtieġ li jkun stabilit.

L-idea tal-għaqdiet ambjentali (Nature Trust, Din l-Art Ħelwa u Friends of the Earth) m’hiex oriġinali għax diġa tqegħdet fil-prattika f’diversi postijiet oħra mhux biss fil-postijiet li ġew indikati fil-gazzetti (Blue Lagoon fl-Iżlanda u fir-reġjun pittoresk Taljan Cinque Terre).

Il-Bhutan (pajjiż fil-Lvant imbiegħed) jikkontrolla n-numru ta’ turisti li jidħlu fil-pajjiż għax hu kinxju li numru esagerati ta’ turisti jistgħu jagħmlu ħsara mhux żgħira. Hemm ukoll il-ġzira turistika Latino Amerikana ta’ Fernando de Noronha (parti mit-territorju Brażiljan) li kienet tillimita n-numru massimu ta’ turisti li jistgħu joqgħodu fuq il-gżira għal 420, u kull wieħed minn dawn kellu jħallas taxxa ambjentali li tiżdied iktar ma jdum!

F’Malta ukoll xi żmien ilu kienu ġew introdotti kontrolli fuq in-numru ta’ turisti li f’ħin wieħed jistgħu jidħlu fl-Ipoġew ta’ Ħal-Saflieni kif ukoll in-numru massimu li setgħu jidħlu matul il-ġurnata. Dan kien sar għax kien ġie stabilit li biex dan is-sit arkejolġiku jkun protett aħjar kellhom ikun hemm kontrolli tal-mikro-klima. Dan fil-fatt sar billi kien ġie identifikat in-numru massimu ta’ 80 persuna li setgħu jidħlu f’ġurnata fl-Ipoġew.

L-istess jista’ jsir dwar il-gżira ta’ Kemmuna. Tista’ tiġi protetta billi jkunu limitati n-numri ta’ persuni li jistgħu jinżlu l-art. Dan ikun pass tajjeb li jagħmel il-ġid, lill-Kemmuna, naturalment mhux lil dawk li jikru l-umbrellel!

Fir-Raħal Ġdid : il-kwalità tal-ħajja tar-residenti

Tħabbar dak li ilu ftit magħruf ( 1 u 2). Ċjoe li s-sit tal-Marsa Shipbuilding ser ikun żviluppat f’ċentru għas-servizzi lill-oil rigs li qed jirreferu għalih bħala l-Mediterranean Maritime Hub.

Qed jingħad li dan ser ifisser investiment ta’ €55 miljun u li ser joħloq 150 impieg ta’ kwalità fil-qasam tal-industrija taż-żejt u tal-gass.

Ħadd ma hu ser jargumenta kontra l-ħolqien tal-ġid, imma tajjeb li anke f’dan l-istadju nemfasizza li s-sit magħżul hu viċin ħafna ta’ żona residenzjali – il-parti t’isfel tar-Raħal Ġdid. L-impatt fuq ir-residenti għandu jkun indirizzat minn issa meta d-dettalji tal-proġett għadhom fl-istadju ta’ ippjanar.

Dan ser jinkludi  prinċipalment storbju u tniġġiż tal-arja imma ukoll dwar kif ser ikun immaniġjat l-iskart tossiku li bla dubju ser joriġina mix-xogħolijiet ippjanati.

Għax il-kwalità tal-ħajja tar-residenti tar-Raħal Ġdid hi importanti daqs il-ħolqien tal-impiegi. Għandna diġa esperjenza qarsa fl-Isla u Birżebbuġa. Nittama li minn din l-esperjenza tgħallimna bħala pajjiż biex l-affarijiet isiru aħjar.

Dom: a giant surrounded by pygmies

Much has been written in the past days on Dom Mintoff. On his service to the nation. On his values. On his methods. On his achievements.

In what we write we ought to be respectful. Not just to Dom, the man and his memory. We must also respect  ourselves. We must be factual.

We cannot respect the man  if we have no self respect!

His first positive contribution was in the development of the tools of  social solidarity,  determined to ensure that all had access to the basic essentials. He did this initially with Sir Paul Boffa his predecessor as Labour Leader. It was Boffa who laid the foundations of the welfare state through the introduction of Old Age Pensions and Income Tax to finance them!  Years earlier Boffa had prodded Gerald Strickland through the Compact to construct St Luke’s Hospital.  Boffa has been sidelined in the past 50 years when in reality it was he who should get the credit for founding the welfare state in Malta. Dom built on Boffa’s solid foundations, widening and deepening social services in the process.

His second positive was his determination that independence be translated into Maltese absolute control of the islands and their strategic infrastructure. This contrasted with Borg Olivier’s more gradual approach.  His negotiations shocked the nation as it was the first time that a Maltese politician stood up and spoke what they had in mind. In his last mass meeting before the 1971 general elections, held  at Marsa,  Mintoff had stated in very clear terms what he had in mind. It was time for Britain to pay up or pack up.

Lord Carrington then Defence Secretary in Edward Heath’s Cabinet states in his memoirs that negotiating with Dom was tough business. He realised “that there was also calculation in every Mintoff mood.”  Mintoff’s moods noted Carrington, would alternate “between periods of civilised charm and spasms of strident and hysterical abuse.”

Dom also opened a third front. He rightly felt the need for a separation of Church and State. It was, and still is  an area which requires much attention. It was much worse 50 years ago with an unelected archbishop-prince wielding political power unwittingly aiding  the colonial masters. Divide and rule was the British policy in its colonies. This front has been the cause of various scars (political and social), still not sufficiently healed.  It was violence from unexpected quarters which multiplied the political problems which each government has had to tackle since.

In his endeavours Dom was undoubtedly influenced by his direct experiences.  His witnessing of abject poverty during his childhood, his youth and immediate post war years formed his vision for developing the welfare state which had been painfully plotted by Sir Paul Boffa.

Having a foreign power controlling any square metre of significance on the islands was too much to bear for someone with Dom’s temperament. His father’s employment in the service of Lord Louis Mountbatten undoubtedly added to the significance of it all and to his determination to make a clean sweep.

It would be dishonest to ignore the above.

It would be however similarly dishonest to ignore the fact that his stewardship was also characterised by arrogance and bullying. It was characterised by organs of the state which sought to protect abusive behaviour. The long list of cases wherein Dom’s government and his most trusted Ministers were found guilty of infringing human rights is there for all to see. None of them was ever forced to resign. This is also part of Dom’s contribution to the development of  post 1964 Malta.

Anyone ever tried to identify the number of victims, some with a one way ticket to l-Addolorata Cemetery?

Former Air Malta chairman Albert Mizzi in an interview carried in The Sunday Times on March 25, 2012 stated: “I remember one time when someone mentioned something to him about corruption. He turned to me and said, ‘is it true?’ I replied: ‘That what’s people are saying’. His response was: ‘What can I do if that person has helped me to build up the party? Can I take action against him?’ You see, this is small Malta.”

That is Dom, the giant surrounded by pygmies: those who helped him build his party and then proceeded to squeeze it dry until the pips squealed.

Respecting Dom also means self-respect. Respect  the facts.  When this is done we can give the man his due.

Il-Kunsilli Lokali : qed nagħtu kas tagħhom ?

 

Nhar is-Sibt kien ta’pjaċir għalija li nindirizza l-laqgha plenarja tal-Kunsilliera Lokali li tkun organizzata kull sena mill-Assoċjazzjoni tal-Kunsilli Lokali. Din is-sena din il-laqgħa saret fil-Lukanda Corinthia ġewwa Ħ’Attard.

Osservajt illi fid-dokument konsultattiv tal-Istrateġija Nazzjonali dwar l-adattament għall-Impatti tal-Klima l-Kunsilli Lokali la jissemmew u l-anqas jidher li hemm rwol maħsub għalihom.

Meta nqiesu illi uħud mill-impatti tal-klima jolqtu direttament lill-lokalitajiet dan jistona. Ġibt l-eżempju tal-kapaċita tal-infrastruttura tat-toroq tagħna li tilqa’ għal bidla fl-intensita’ u l-frekwenza tax-xita.  Xi ħaġa li naraw b’għajnejna ta’ spiss, kull meta jkollna maltempata mhux tas-soltu kif kellna reċentement.

Għad hawn awtoritajiet u kummissjonijiet maħtura mill-Gvern li m’humiex konxji biżżejjed tar-rwol importanti li għandhom il-Kunsilli Lokali. Din il-Kummissjoni dwar il-Klima hi waħda minnhom.

F’Birżebbuġa per eżempju kellu jkun l-intervent tas-Segretarju Parlmentari Chris Said biex il-MEPA tieqaf min-negozjati  li kienet għaddejja mal-Port Ħieles dwar il-kundizzjonijiet ta’ permess ambjentali. Dan sar minħabba li dawn in-negozjati kienu għaddejjin mingħajr l-involviment tal-Kunsill Lokali ta’ Birżebbuġa. Issa li l-Kunsill ġie involut in-negozjati bdew mill-ġdid u qed jiġu ndirizzati issues li qabel mhux neċessarjament li kienu qed jitqiesu bl-istess profondita’.

Hemm iżda eżempji oħra li jixhdu illi mhux il-Kunsilli Lokali kollha huma impenjati bl-istess mod.

Meta l–MEPA ħarget il-permess għall-inċineratur tal-biċċerija il-Kunsilli Lokali tal-Marsa u r-Raħal Ġdid ġew mogħtija id-dritt li a spejjes tal-Wasteserve jistabilixxu sistema alternattva għall-monitoraġġ tal-arja fl-inħawi, kif ukoll d-dritt l jqabbdu espert li jgħinhom biex jifhmu l-informazzjoni li tkun ippubblikata dwar l-emissjonijiet. Il-parti relevanti tal-permess fil-fatt tgħid hekk :

”   1.3.2     Public access to emission data (most recent half hour average values and daily average values plus results from the most recent discontinuous measurements) shall be enabled via Internet.

1.3.3     The Marsa and Paola Local Councils may, jointly and in agreement with MEPA, establish an independent ambient air monitoring system covering particulate matter, nitrogen oxides and sulphur oxides, as well as any other parameters that may be agreed with MEPA, at the expense of the permit holder.

1.3.4     The Marsa and Paola Local Councils may, in agreement with MEPA, jointly appoint an independent expert to assist in the interpretation of the emission data made publicly available pursuant to condition 1.3.2.”

Huwa ċar mill-kritika li ssir għall-operazzjoni ta’ dan l-inċineratur illi dawn iż-żewġ Kunsilli Lokali għadhom m’humiex konxji minn dan id-dritt li għandhom u s’issa jidher li m’għamlux użu minnu.

Jidher illi hemm bżonn illi l-Assoċjazzjoni tal-Kunsilli Lokali tgħin lil dawn il-Kunsilli Lokali u oħrajn bħalhom biex jiżviluppaw il-kapaċita tagħhom biex ikunu jistgħu jkunu ta’ servizz aħjar.
