Il-ħela tal-elettriku: tniġġiż mid-dawl

Huwa pass tajjeb dak li jirrapporta l-Malta Today illum, li nħarġet direttiva fis-settur pubbliku biex l-enerġija nużawha bil-għaqal.

M’għandux jibqa’ jinħela elettriku bil-bini mixgħul bil-lejl.

Anke dwar l-air conditioners, t-temperatura f’uffiċini pubbliċi, issa, fix-xhur sħan, m’għandiex tkun iktar baxxa minn 24 grad Celsius.

Direttiva tajba, imma mhux biżżejjed. Hemm ħafna iktar x’jista’ jsir fid-diversi oqsma biex tonqos il-ħela. Imma tajjeb li bdejna.

Ikun għaqli li l-Knisja ukoll timxi fuq l-istess passi in partikolari dwar il-Knejjes imdawwlin. Nistennew (min jaf) direttiva dwar dan mill-arċisqof biex anke l-knejjes inaqqsu d-dwal żejda u jnaqqsu l-ħela!

Il-problema  hi kbira ħafna iktar milli naħsbu.

Abusive continuity

The distribution of multiple cheques to every household by the Labour Government on the eve of the general election is more than abusing the power of incumbency. Through the said distribution, the power of incumbency is being transformed into a corrupt practice, specifically intended to unduly influence voters.

What, in normal circumstances should be a simple administrative act is being transformed into blatant political propaganda, at public expense, straight into your letterbox. A covering letter signed by Robert Abela and Clyde Caruana says it all. A Banana Republic in all but name!

Why should such handouts be distributed on the eve of elections if not to influence voters?

Even if one were to accept that such handouts are acceptable, it is certainly not in any way justifiable to plan their distribution specifically on the eve of an election. This goes against the basic principles of good governance.

The power of incumbency is the executive power of a government seeking re-election. Incumbents always have an advantage. The manner in which they handle it defines their governance credentials.

This has been a government characterised by bad governance throughout its term in office. Right from the very beginning, on 13 March 2013. I consider the full 9 years as one continuum. This was reinforced by Robert Abela himself who emphasised that his leadership of the Labour Party seeks to continue the “achievements” of his predecessor and mentor Joseph Muscat. Continuity was his declared mission.

On its first days in office, Labour started off on its Panama tracks. The secret Panama companies set up by Konrad Mizzi, Keith Schembri and someone else, known as the (mysterious) owner of Egrant, went on to rock Labour over the years.

The Electrogas saga and its link to the assassination of Daphne Caruana Galizia intertwined with the Panama debacle.

It is now clearly established that the assassination of Daphne Caruana Galizia was directly linked to her investigative journalism. Her investigations led her to identify the governance credentials of various holders of political office and their links with big business. Defining their relationship as being too close for comfort would be a gross understatement.

As emphasised in the investigation report on the Daphne Caruana Galizia assassination, over the years, a culture of impunity has developed in these islands. This has led to misbehaviour in public office being normalised. It has also led to considerable resistance in the shouldering of political responsibility by holders of political office, whenever they were caught with their hand in the cookie jar! Rosianne Cutajar and Justyne Caruana being the latest examples, as amply proven by the Commissioner for Standards in Public Life George Hyzler.

To add insult to injury Cutajar and Caruana were the recipients of generous termination benefits, notwithstanding that their term of political office ended in disgrace. Caruana received terminal benefits twice in the span of a short time, as she established a national record of resigning twice from Robert Abela’s Cabinet!

With this track record one should not have expected otherwise from the Muscat/Abela administration. With the abusive distribution of cheques on the eve of the general election Labour’s current term is approaching a fitting end.

The Labour Party in government has consistently acted abusively. Robert Abela has followed in the footsteps of his predecessor and mentor Joseph Muscat. Continuity has been ensured, as promised.

Il-politka bl-ixkupa

Bħala partit għażilna l-ixkupa bħala s-simbolu politiku għall-elezzjoni tas-26 ta’ Marzu. L-ixkupa hi għodda tal-indafa. Tgħinna nnaddfu. Hi l-għodda tal-kennies, il-ħaddiem umli li jnaddaf it-toroq tagħna wara li aħna nkunu ħammiġnihom

Kull politiku għandu jkun kapaċi japprezza l-indafa. Għandu jkun kapaċi jmidd għonqu għax xogħol u jkun il-kennies tal-ħajja pubblika. Il-membri tal-parlament għandhom ikunu l-kenniesa tal-politika, determinati li jnaddfu, li jħarsu l-integrità tal-ħajja pubblika u fuq kollox jassiguraw li jittieħdu d-deċiżjonijiet meħtieġa f’waqthom, mingħajr tkaxkir tas-saqajn.  

Il-Manifest ta’ ADPD ġie ippubblikat f’nofs il-ġimgħa iwassal messaġġ ċar li Xkupa ħadra tnaddaf.

Hemm ħafna x’jeħtieġ li jsir biex dan il-pajjiż jinġieb lura għan-normal. Partiti oħra għandhom viżjoni u attitudni differenti u jwasslu messaġġi li ġeneralment jikkuntrastaw ma tagħna. Hemm iżda oqsma fejn hemm qbil u dan hu tajjeb. Għandi nifhem li ilkoll wara kollox nixtiequ l-ġid lil dan il-pajjiż avolja dan ma jkunx dejjem ċar.

Għandna nifhmu li qegħdin naħdmu għall-istess pajjiż, anke jekk b’viżjoni differenti u li kulltant tikkuntrasta! Għandna nagħmlu ħilitna kollha biex nikkontribwixxu għal dibattitu pubbliku pożittiv. Il-kritika tagħna għal dak li jingħad hi essenzjali, imma hi kritika li trid issir dejjem b’mod responsabbli.

L-aħħar xhur tal-ħidma parlamentari kienet iddominata minn diskussjoni dwar rapporti tal-Kummissarju dwar l-iStandards fil-Ħajja Pubblika dwar l-imġieba mhux korretta ta’ uħud mill-membri parlamentari. Dawn ir-rapporti wasslu għar-riżenja ta’ żewġ membri tal-Kabinett u ta’ Segretarju Permanenti.  Kien hemm reżistenza biex isiru dawn ir-riżenji. Hi sfortuna li l-Prim  Ministru xejn ma kien deċiżiv fiż-żewġ każi: ħa passi biss wara pressjoni sostanzjali mis-soċjetà ċivili.

Hu fatt magħruf li d-dinja tan-negozju u l-poter politku huma viċin wisq ta’ xulxin. Dan hu ta’ ostaklu għall-kontabilità, għat-trasparenza u ġhall-osservanza tal-etika fil-ħajja pubblika. Aħna f’ADPD ilna s-snin ngħiduh dan. Anke is-soċjetà ċivili ilha ssemma leħinha dwar dan. Issa anke l-Kummissjoni ta’ inkjesta li investigat iċ-ċirkustanzi li wasslu għall-assassinju ta’ Daphne Caruana Galizia ikkonfermat din il-konnessjoni mhux mixtieqa bejn il-politika u d-dinja tan-negozju. Qegħdin viċin wisq!   

Għandna ħtieġa ta’ Parlament li jkollu sensittività etika.  Għandna bżonn iktar membri parlamentari ta’ integrità, kapaċi jgħarblu b’mod konsistenti l-ħidma tal-amministrazzjoni pubblika. Neħtieġu istituzzjonijiet b’karattru u b’sinsla. Għandna bżonn ta’ Parlament li jinkludi kandidati ta’ ADPD eletti mid-distretti differenti. Kandidati li mhux qegħdin fil-ġirja għal xi interess personali, tagħhom jew ta’ oħrajn, imma biss għas-servizz tal-komunità kollha.

NagħmeI emfasi fuq il-verb “jinkludi” u dan billi l-kandidati ta’ ADPD mhumiex l-uniċi li jistgħu jagħtu kontribut pożittiv għall-iżvilupp tal-politka f’pajjiżna.  Nitkellem b’rispett dwar il-kandidati l-oħra ippreżentati mill-partiti politiċi l-oħrajn. Il-parti l-kbira minnhom huma nisa u irġiel iddedikati li qed jagħtu servizz ġenwin lill-komunità tagħna huma ukoll.

Il-manifest elettorali ta’ ADPD jittratta numru mhux żgħir ta’ proposti li għandhom impatt dirett fuq il-ħajja taċ-ċittadini tagħna. Mhux manifest ta’ Father Christmas iqassam ir-rigali imma hu presentazzjoni ta’ viżjoni li irridu nimxu fuqha.

L-agenda tagħna hi li nkunu ta’ servizz għall-komunità kollha.

L-indafa fil-politika hi essenzjali. Mingħajr indafa ma nistgħux naħdmu sewwa. Aħna irridu li nkunu l-għodda għat-tiġdid tal-politika fil-pajjiż. L-ixkupa ħadra li tnaddaf. B’politika li tagħti servizz illum  waqt li tkun attenta dwar l-impatti fuq għada. B’hekk nistgħu nassiguraw li l-ħidma tal-lum ma xxekkilx lill-ġenerazzjonijiet futuri mid-dritt tagħhom li jieħdu id-deċiżjonijiet li jkunu meħtieġa minnhom.

F’dan il-mument kritiku il-politika bl-ixkupa hi l-unika triq vijabbli l-quddiem. Il-politika Maltija għandha bżonn tindifa nobis!

The politics of the broom

ADPD – The Green Party has selected the broom as its political symbol for the 26 March elections. The broom is a tool which assists us in achieving cleanliness. It is the street sweeper’s tool, the humble worker that cleans our streets after we mess them up.

Achieving cleanliness is an objective which should be shared by all parliamentarians.  Parliament and its members should be the political sweepers, keeping politics clean, safeguarding its integrity and above all ensuring that decisions are taken whenever required without unnecessary delay.

The Green political manifesto has been published in mid-week. Its main message is that Green sweeps clean (Xkupa ħadra tnaddaf).

There is so much to do to get this country back to normal. Other parties generally have a different vision and attitude and convey contrasting messages. There are however also areas of overlap between the different political parties. It is to be assumed that all seek the common good, even though at times this is not that clear!

We recognise that we are in this journey all together. We will do all in our power to contribute to a positive debate. We are critical of the political platforms of other parties but we do this in a responsible manner.

The last months of parliamentary debate have been dominated by the consideration of the reports of the Commissioner for Standards in Public Life on the unethical behaviour of members of Cabinet. These reports have led to the resignation of two members of Cabinet and a Permanent Secretary. They were reluctant resignations. The Prime Minister unfortunately did not act decisively in both cases: he acted only as a result of the substantial public pressure of civil society.

It is a well-known fact that accountability, transparency and ethics in public life are severely hindered by the close connections between political power and business concerns. It is not only ADPD that has been saying this for a long time. The ever-increasing voice of civil society has led to these issues being given the attention they deserve. The Inquiry Commission investigating the circumstances into the assassination of Daphne Caruana Galizia also confirmed this unsavoury link between politics and business: they are too close for comfort.  

We need a Parliament that is ethically sensitive. We need more Members of Parliament of integrity, able to oversee continuously and consistently the public administration. We need institutions with character and a solid spine. We need a Parliament that includes ADPD representatives elected from amongst the candidates being presented to the electorate in each district – candidates that are not in it for their personal gain or in the interests of others but for the service of all citizens.

I emphasise the verb “includes” as ADPD candidates are not the only ones who can contribute positively to the development of our politics. I speak with utmost respect of the candidates presented by other parties. Most of them are dedicated men and women willing to be of genuine service to the community.

ADPD’s electoral manifesto presents a wide range of proposals that impact directly on citizens’ rights. It is not a manifesto of Father Christmas promises but a vision laying out a road map to be followed.

Our agenda is to be of service to the whole community. Clean politics in public life is essential. We want to be a political tool for renewal. A green broom to sweep clean. Politics that serves today while keeping an eye on the impact on tomorrow, ensuring that actions taken today do not deny future generations their right to eventually take their own decisions.

At this critical point the politics of the broom is the way forward. It is about time that we sweep Maltese politics clean.

Is-sospensjoni ta’ Victor Vella: editur tal-Orizzont u tat-Torċa

Is-sospensjoni ta’ Victor Vella minn editur ta’ L-Orizzont u it-Torċa hi ta’ tħassib. Mhux biss għax tikkonċerna ġurnalist ewlieni fil-pajjiż, imma ukoll minħabba is-segretezza li hemm dwar x’inhuma r-raġunijiet li wasslu għal dan il-pass.

Qed jingħad li s-sospensjoni seħħet bħala riżultat tal-pressjoni dwar il-linja editorjali mħaddna mill-gazzetti immexxija minn Vella, liema pressjoni jidher li saret mill-Gvern Laburista immexxi minn Robert Abela. Il-Gvern ta’ Abela qed jingħad li nsista li tinbidel il-linja editorjali progressiva ta’ Vella li kienet qed tesponi każi soċjali diversi. Il-Gvern ta’ Abela, jingħad li kien qed jilmenta li l-linja editorjali ta’ Vella kienet qed toskurah.

Il-GWU, sid il-gazzetta ċaħdet dan kollu. Anzi, qalet li hi qed tiddefendi lill-istess Vella quddiem il-Management tal-Union Print li tmexxi l-gazzetti!

Dan kollu jiena ma nifhmux, għax il-Union Print hi tal-General Workers Union stess u fil-fatt Victor Carachi, president tal-GWU hu l-uniku Direttur reġistrat tal-Union Print kif jidher fl-informazzjoni li hemm aċċessibli fir-reġistru tal-kumpaniji.

Il-GWU għandha ħafna x’tirrispondi dwar dan kollu.

Il-qrubija bejn il-poter politiku u l-poter tan-negozju wasslu biex nawwru l-istituzzjonijiet regolatorji tal-pajjiż : Silta (5) mill-inkjesta

Kondotta inaċċettabbli tal-Prim Ministru

Għall-Bord il-kondotta tal-allura Prim Ministru f’din iċ-ċirkustanza u l-mod abbużiv kif baqa’ jipproteġi liċ-Chief of Staff tiegħu u jsostnih fil-kariga importanti li kellu fl-amministrazzjoni sakemm ġie arrestat in konnessjoni mal-assassinju, hi inaċċettabbli, kundannabbli u tirrażenta nuqqas gravi w abbuż fl-eżerċizzju tal-funzjonijiet tiegħu bħala kap tal-gvern u garanti talgovernanza tajba. Hawn mhux si tratta ta’ ġudizzju politiku żbaljat li jeżorbita mit-termini ta’ referenza ta’ dan il-Bord. Si tratta fl-agħar ipotesi għal Dr Muscat għall-kopertura, protezzjoni ta’ persuni li allegatament ikkommettew reati gravi. Il-Bord baqa’ żbalordit bir-risposta li ta għad-domanda jekk kienx tkellem mas-Sur Fenech u lis-Sur Schembri dwar 17 Black wara l-assassinju meta bdew joħorġu aktar dettalji dwar min kien is-sid ta’ din il-kumpanija. Dan anke in vista tal-fatt li kienet teżisti ħbiberija u linja ta’ kommunikazzjoni diretta bejniethom anke permezz ta’ WhatsApp li baqgħet anke għal xi żmien meta kien persuna ta’ interess fl-omiċidju. Dr. Muscat wieġeb hekk: “Le. IsSur Fenech qatt ma staqsejtu u qatt ma tkellimt miegħu fuq dan il-punt. Lil Keith Schembri li kien jaqa’ taħti, staqsejtu wara li ħareġ dan kollu u reġa’ qal li kienet kwistjoni ta’ negozju bejniethom it-tnejn u qalli li ma għandha x’taqsam xejn mal-Electorgas”.

Is-Sur Schembri fil-verità jibqa’ jsostni hekk ukoll anke sal-lum. Mhux ilkompitu tal-Bord li jesprimi ruħu fuq x’inhi l-verità f’dan ir-rigward. Il-punt kruċjali hu illi meta saret l-akkuża, xhur qabel l-assassinju, l-Prim Ministru m’għamel xejn meta missu għamel ħafna. Kien bħal minimu obbligat jirrapporta l-allegazzjoni formalment lill-Pulizija b’talba li tinvestigaha b’urġenza jekk xejn għax kienet tista thedded l-istabilità tal-governanza fil-pajjiż. Il-Pulizija dak iż-żmien taħt il-Kummissarju Lawrence Cutajar għamlu ftit li xejn. Ċertament m’għamlux dak li kellhom jagħmlu. Ċertament għamel inqas mill-Kummissarju ta’ qablu Michael Cassar li wara li ġew żvelati ddettalji dwar il-Panama Papers u ġie informa li l-FIAU kienu qed jaħdmu fuqha, fetaħ file bl-isem ta’ ‘Operation Green’. Hu kien irriżenja xi tlett ġimgħat wara li kien irċieva r-rapporti dwar is-Sur Keith Schembri u l-Ministru Mizzi. Lill-Bord tah x’jifhem illi ma felaħx għall-pressjoni li akkużi gravi ta’ din ix-xorta ġabet fuqu. L-istess kif kien għamel Manfred Galdes.

Abbuż ta’ poter li jekk pruvat ibiddel ix-xenarju

Dawn ir-referenzi qsar għaċ-ċirkostanzi tal-Panama Papers u l-kumpanija 17 Black qed isiru f’dan l-istadju mill-Bord għaliex huma indikattivi ta’ kif kien jiġi abbużat l-eżerċizzju tal-poter fl-ogħla livell biex jiġu protetti persuni fil-qalba tal-amministrazzjoni. Huma importanti wkoll għaliex jekk wieħed jikkunsidra illi tnejn mill-persuni involuti kienu jew jista’ jkun li għadhom persuni ta’ interess għall-pulizija fl-investigazzjoni tagħhom tal-omiċidju li ġie ippjanat tul iż-żmien u jekk l-involviment tagħhom jiġi b’xi mod konstatat minn awtorità kompetenti – salvi dejjem il-preżunzjoni tal-innoċenza u d-dritt tagħhom għal smigħ xieraq u ġust – il-kwistjoni ma tibqax biss li jiġi determinat jekk xi att jew ommissjoni illeċitu minn jew fi ħdan xi entità talIStat iffaċilitatx l-assassinju meta kellha tipprevenih. Ix-xenarju jinbidel għal wieħed ta’ parteċipazzjoni attiva ta’ persuni li jikkomponi enti tal-IStat filkommissjoni tad-delitt. Dan apparti, fuq bażi fattwali u mhux issa ipotetika, l-inattività pależi tal-Prim Ministru u tal-entitajiet tal-iStat, fosthom il-Pulizija li għandhom il-funzjoni li jħarsu lis-soċjetà mill-kriminalità u jiggarantixxu l-ordni pubbliku, li jieħdu passi effettivi u fil-ħin kontra persuni ta’ poter fil-politika u fin-negozju, tnissel sens qawwi ta’ impunità, mhux biss fl-istess persuni involuti, imma wkoll f’kullmin kien intenzjonat li jaġixxi biex jipparteċipa f’xi aġir kriminuż. Kif jirriżulta mill-provi dawn fittxew li jkollhom konnessjonijiet fl-ogħla livell ta’ ħbiberija jew interess ma’ min kellu s-setgħa biex ikun jistgħu jaġixxu flassigurazzjoni reali jew perċepita li ser ikunu minnhom protetti. Dawn iċ-ċirkostanzi huma relevanti wkoll għaliex huma prova tanġibbli tażżwieġ li seħħ bejn l-eżerċizzju tal-poter politiku u l-eżerċizzju tal-poter ekonomiku. Żwieġ inċestuż li kien fil-qalba tal-investigazzjonijiet talġurnalista assassinata u li ngħad, ma setax ma kienx il-movent prinċipali talqtil tagħha.

Theddida għall-eżerċizzju tal-poter ekonomiku

Il-Bord konvint kif inhu, illi fuq bażi qawwija ta’ probabbilitajiet jekk mhux ċertezza, l-assassinju tas-Sinjura Caruana Galizia hu inevitabblilment marbut ma’ dawk li hi kienet tqis li huma skandli serji ta’ amministrazzjoni ħażina, riżultat tal-qrubija bejn il-poter politiku u l-poter tan-negozju kbir li wasslu biex nawwru sewwa l-istituzzjonijiet regolatorji tal-pajjiż, hi inevitabbli l-konklużjoni illi l-ġurnalista sabet in-nemesi fatali tagħha fil-politika dikjarata tal-gvern sa minn qabel l-elezzjoni tal-2013, illi hu kien determinat li jkun għal kollox business friendly. Politika li kellha l-għan li tiffavorixxi n-negozju, tinkorraġġixxi s-sħubija tal-gvern mal-investiment privat u tirrealizza proġetti kbar li joħolqu l-ġid.

Ladarba ġiet eskluża t-teżi illi l-omiċidju seta’ seħħ minħabba xi att inkonsult ta’ fanatiżmu politiku partiġġjan – f’dan ir-rigward ma rriżultat l-ebda provi quddiem dan il-Bord – il-fatti rilevanti li rriżultaw kemm qabel u kemm wara l-omiċidju għandhom jiġu ikkunsidrati minn din l-ottika. Il-Bord ripetutament afferma li ma kien hemm xejn oġġezzjonabbli li l-gvern ikollu politika li tkun business-friendly, anzi fi kliem iċ-Chief of Staff Keith Schembri gvern b’‘mentalità tal-business’, sakemm l-eżekuzzjoni ta’ dik il-politika u r-relazzjonijiet bejn l-amministrazzjoni pubblika u negozjanti w investituri jinżammu strettament fil-limiti tal-liġijiet u r-regolamenti applikabbli. Hu f’dan illi l-aġir tal-gvern falla. Hu għaliex il-mentalità ta’ negozjant għandha bħala regola l-mira illi timmassimizza l-profitt fin-negozju, bl-inqas burokrazija, u billi taqta’ għad-dritt ħadet is-sopravvent fuq dik li għandha tkun il-mira ta’ kull gvern li joħloq il-ġid fl-interess tal-komunità b’mod ġust u trasparenti skont il-liġijiet tal-pajjiż, illi ngħata lok għal sitwazzjonijiet li tista’ tgħid kull proġett maġġuri inizjat mill-amministrazzjoni spiċċa kellu dellijiet ta’ irregolaritajiet, abbuż ta’ poter u korruzzjoni. Allegazzjonijiet li jimplikaw li negozjanti involuti f’dawn il-proġetti għamlu jew kienu intenzjonati li jagħmlu qligħ indebitu minn fuq dahar il-poplu anki f’xi okkażjonijiet b’kollużjoni ma’ personaġġi politiċi ewlenin involuti fit-twettieq ta’ proġetti. Il-proġett tal-Electrogas hu wieħed minn dawn il-proġetti li dwaru l-Awditur Ġenerali esprima riservi kbar dwar ir-regolarità tal-proċeduri fit-twettieq talproġett u l-ħarsien tal-liġijiet applikabbli.

Moħħhom mistrieħ: Silta (2) mill-Inkjesta

Ma huwiex il-kompitu ta’ dan il-Bord li jidħol fil-meritu tal-pjan tal-assassinju jew min seta’ kien responsabbli ghalih peress li dan hu kompitu tal-Pulizija peró, ma jistax ma jirrimarkax li dawn iċ-ċirkostanzi nisslu is-serħan il-moħħ f’dawk li kellhom il-pjan li jesegwixxu d-delitt li ma kenux ser jinqabdu wara lassassinju. Vince Muscat semma’ partikolarment ex-Ministru. L-allegati eżekuturi tant kellhom moħħom mistrieħ li kienu jafu minn tlett gimgħat qabel li ser jiġu arrestati fl-4 ta’ Diċembru 2017 u kellhom l-opportunità jżarmaw l-ambjenti li kienu jokkupaw fil-magħrufa tinda tal-Patata l-Marsa. Dana ġie konfermat mill-allura Prim Ministru Dr. Joseph Muscat meta xehed (bil-magħluq pero’ wara disponibbli fid-dominju pubbliku) quddiem dan il-Bord fl-4 ta’ Diċembru 2020. “Jien illum il-ġurnata għandi suspett pjuttost fondat illi fil-laqgħa jew laqgħat li kienu qegħdin isiru qabel l-arrest tat-tlett persuni kien hemm leak… F’dawk il-laqgħat kien ikun hemm preżenti iva Keith Schembri u Silvio Valletta … imma huwa car illi l-persuni arrestati kienu jafu … it was a fact”. Vince Muscat xehed li ġie mogħti informazzjoni millaħwa Degiorgio li l-arrest tagħhom kellu jkun wieħed temporanju fejn wara larrest kellhom jiġu interrogati u meħlusa wara ftit ġranet. Fil-fatt ma kienux u dak li ġara wara huwa fid-dominju pubbliku. (pp.257-8)

Żewġ livelli ta’ Gvern: Gvern ta’ fuq il-palk u Gvern ta’ wara l-kwinti: Silta (1) mill-inkjesta

Dan il-Bord akkumula muntanja ta’ provi kemm mix-xhieda li sema’ hu stess kif ukoll minn sorsi oħra bħar-rapporti tal-Awditur Ġenerali u xhieda li ngħataw f’diversi inkjesti, dwar irregolaritajiet gravi ta’ governanza ħażina, nuqqas ta’ osservanza ta’ regolamenti u proċeduri maħsuba biex jassiguraw trasparenza u kontabilitá li lkoll kienu jippuntaw lejn l-istess grupp ta’ nies, li lkoll kienu jgawdu l-fiduċja tal-Prim Ministru ta’ allura u li kienu fdati bit-twettieq tal-proġetti mfassla fil-programm elettorali.

Dawn il-provi kienu kostantement jippuntaw lejn realtá – fil-veritá ġeneralment rikonoxxuta – li dan iċ-ċirku ristrett, li kien jinkludi persuni li ma kienux kontabbli lejn l-elettorat, imma kienu jokkupaw karigi għolja f’entitajiet tal-iStat seta’ minħabba s-saħħa li kellu, jaġixxi taħt ir-radar u l-iskrutinju ta’ istituzzjonijiet regolatorji u tal-istess Kabinett tal-Ministri. Il-kweżit li jeħtieġlu jirrispondi għalih il-Bord hu jekk kienx minnu li allura kien hemm żewġ livelli ta’ gvern.


Ir-riposta għal din id-domanda ngħatat b’mod skjett u ċar mill-Onorevoli Evarist Bartolo li fiż-żmien rilevanti kien Ministru tal-Edukazzjoni u illum huwa Ministru għall-Affarijiet Barranin. Hu żvela l-eżistenza ta’ żewġ livelli ta’ gvern u dana f’dawn it-termini “Imma li għandna, għandna nies tal-flus li jużaw il-flus tagħhom biex jixtru l-influenza f’kull qasam tal-ħajja inkluż fil-politika u jiena wissejt li jista’ jkollok żewġ gvernijiet, jista’ jkollok gvern ta’fuq il-palk u jista’ jkollok gvern parallel ta’ wara l-kwinti”. U meta l-Bord staqsieh espressament jekk kienx hemm żewġ livelli ta’ gvern il-Ministru wieġeb fl-affermattiv “Iva għalhekk tkellimt fuq dawk in-networks. Għalhekk tkellimt b’dak il-mod u wissejt fuq il-ħsara li tista’ ssir fil-pajjiż kollu kemm hu”. Hu kompla jelabora “….anke jekk ħassejtni li f’pajjiżna faċilment ikollok żewġ kabinetti, kabinett uffiċjali li jiltaqa’ f’Kastilja u jkollok kabinetti oħra li jiltaqgħu fl-irziezet u fuq il-boats u jiltaqgħu f’postijiet oħra u jiġu deċiżi affarijiet li jibbajpassjaw l-istituzzjonijiet ta’ pajjiżna. Jiena nkwetat ħafna b’dan. Inkwetat ħafna u billi nkun inkwetat mhux biżżejjed …. jekk ma jkollokx istituzzjonijiet jekk tħalli l-poter li jista’ jiġi ikkonċentrat f’naħa waħda ser ikollok il-problemi”. (pp125-7)

Ir-Repubblika hi marida

Aħna u nsegwu l-ġbir tal-provi fil-Qrati dwar id-diversi każi li għadhom għaddejjin in konnessjoni mal-assassinju ta’ Daphne Caruana Galizia nistħajjilni qed nara dokumentarju dwar il-falliment tal-istituzzjonijiet f’Malta. Dokumentarju dwar il-falliment tal-istat Malti, dwar ir-Repubblika li għamlet lilha innifisha impotenti fil-konfront tal-kriminalità.  

L-assassinju ta’ Daphne hu ukoll falliment tal-korp tal-Pulizija li ma rnexxilux isib tarf tal-kriminalità organizzata.  

Kif jista’ l-korp tal-Pulizija jagħmel dmiru meta jkollu uffiċjali bħal Silvio Valletta li jkun fil-but tal-kriminali? Silvio Valletta għadu jiġri mas-saqajn: s’issa għad ma ħadux passi kontrieh minkejja l-ħsara enormi li għamel lill-kredibilità tal-korp tal-Pulizija u lill-pajjiż.

Illum nafu kemm Silvio Valletta tħaxken ma  Yorgen Fenech. Valletta ma kienx xi kuntistabbli  f’xi għassa tal-pulizija mwarrba. Prattikament kien imexxi l-Korp tal-Pulizija bħala Deputat Kummissarju. Kien jirrapresenta lill-Korp tal-Pulizja fuq il-Bord ta’ Tmexxija tal-Financial Intelligence Analysis Unit (FIAU).

Il-fatt li wieħed mill-fizzjali tal-pulizija l-iktar anzjani jaġixxi b’dan il-mod jagħti indikazzjoni ċara ta’ kif kienu jaħsbuha sħabu fit-tmexxija tal-korp fil- Furjana. Rapport tal-Ombudsman irrappurtat iktar kmieni dan ix-xahar dwar investigazzjoni mitluba fuq ilment ta’ Supretendent tal-Pulizija fisser kif kienet tinħatar it-tmexxija tal-korp: il-lealtà lejn il-kummissarju qabel il-lejaltà lejn is-servizz, kienet kwalifika essenzjali.  Meta l-għażla tal-fizzjali tal-korp kienet issir b’dan il-mod xejn m’għandna nissorprendu ruħna li l-korp ilu ftit kompromess.

Iz-ziju Silvio kien investiment li jirrendi għal Yorgen Fenech. Għal żmien twil Silvio Valletta kien il-muftieħ li iffaċilita l-aċċess  ta’ Yorgen Fenech għal kull xorta ta’ informazzjoni li kien jeħtieġ.  Dan hu eżempju ċar ta’ x’nifhmu meta ngħidu li d-dinja kriminali qegħda bosta passi qabel il-korp tal-pulizija.   F’dan il-kaz, permezz ta’ Silvio Valletta d-dinja kriminali setgħet tinfluwenza l-korp bir-remote control.

Diffiċli biex nifhmu kif inhu possibli li jkollna kollass iktar gravi tal-istituzzjonijiet minn hekk.

Dan kollu ma ġarax mil-lum għal għada. Imma hu ċentrali biex nifhmu kif żviluppat l-għanqbuta tal-maniġġi tul is-snin liema maniġġi wasslu għall-assassinju ta’  Daphne Caruana Galizia u lil hinn.  

Meta saret emfasi dwar il-kunflitt ta’ interess ta’ Silvio Valletta minħabba li dakinnhar, martu, kienet membru tal-Kabinett, ir-resistenza biex iwarrab kienet enormi. Kella tkun kawża fil-Qrati, li ħadet iż-żmien, li wasslet biex jitwarrab mill-investigazzjoni.  

Issa ġie ippubblikat ir-rapport finali tal-inkjesta pubblika dwar l-assassinju ta’ Daphne. Ir-rapport ma jgħidilniex min qatilha, jew min ordna l-qtil tagħha: dak qatt ma kien l-iskop tar-rapport. Ir-rapport imma jeżamina l-klima ta’ impunità li nħolqot u li wasslet għall-assassinju tagħha.  Ir-rapport juri kif in-negozju u l-politika saru ħaġa waħda, tant li xi kultant mhux iktar faċli biex tgħid min hu min.

Il-konklużjoni ewlenija tar-rapport hija li Malta inħakmet minn mentalità mafjuża. L-istat Malti ntrikeb minn mentalità kulturali li tippermetti mentalità u attitudni mafjuża li jrabbu l-għeruq.

Ftit hemm proposti fir-rapport tal-inkjesta li huma ġodda għad-dibattitu politiku lokali. Bosta mill-proposti ilhom fl-aġenda pubblika numru ta’ snin. Uħud ġew imbiċċra, mdgħajfa inkella gvernijiet differenti għamlu snin sħaħ iparlaw dwarhom u jagħmlu ftit li xejn.   Il-ħarsien ta’ min ikun lest li jikxef il-ħmieġ (whistleblowing) għadu soġġett għall-ispag politiku kif rajna b’għajnejna għal numru ta’ snin. Ir-regolamentazzjoni tal-lobbying hi soġġetta għal ħafna paroli, imma s’issa ma sar xejn. Ir-regolamentazzjoni tal-imġieba etika saret farsa, minkejja l-isforzi ta’ George Hyzler, il-Kummissarju dwar l-iStandards fil-Ħajja Pubblika.

Huwa essenzjali li l-kuntatti kollha bejn kull negozju u l-friegħi kollha tal-istat ikunu ċari u trasparenti. Kollox, mingħajr eċċezzjoni. Ilu jsir paroli dwar dan imma ftit wisq sar dwaru.

L-istat Malti ġie mdgħajjef minn dawk li fittxew li jsiru sinjuri malajr, a kwalunkwe kost. Jiddependi minna jekk inwaqqfuhomx l-iktar kmieni possibli. Ir-Repubblika marida.

The Republic is sick

Following the compilation of evidence in our law courts relative to the multiple cases dealing with the assassination of Daphne Caruana Galizia is in itself a detailed continuously developing documentary of the failure of our institutions, the failure of the state.

Daphne’s assassination is also a failure of the police corps to keep a tag on criminal activity.

How could the police corps carry out its duties with officers like Silvio Valletta hibernating deep inside criminal pockets? Silvio Valletta has to date not been prosecuted for his criminal activity which has been the cause of considerable reputational damage and to the effectiveness of the police corps.

Today we know of Valletta’s cavorting with Yorgen Fenech. Valletta was not an ordinary simple cop languishing in some out of the way police station. He practically ran the Police Corps as Deputy Commissioner of Police and represented it on the governing board of the Financial Intelligence Analysis Unit (FIAU).

The fact that this top policeman acted in such a manner is a clear indication of the forma mentis of the contemporary top brass at Floriana Police HQ. An Ombudsman report made public earlier this month on the investigation relative to the complaint of a Police Superintendent has dwelt at some length as to how police officials were selected: loyalty to the boss before loyalty to service was a basic requirement. With police officer selection being carried out on the basis of such a “qualification” it is no surprise that that the Police Corps was compromised for such a long time.

Uncle Silvio was the perfect investment for Yorgen Fenech. For a long time, Silvio Valletta was the key that facilitated access to Yorgen Fenech to all sorts of intelligence. A perfect example which illustrates what it means when we emphasise that the criminal world is many steps ahead of the police force.  In this specific case, for quite a time, the criminal world had the police force on a remote control, through Silvio Valletta.

It is difficult to comprehend how we could ever have an institutional failure of larger proportions.

This did not happen overnight. It is however central to the web of intrigue which developed over the years and leading up the assassination of Daphne Caruana Galizia and beyond.

When Valletta’s conflict of interest as the then husband of a cabinet minister was spotlighted, the resistance to let got was enormous. It had to be a laborious court case which at the end of the day had him removed from coordinating the assassination investigation.

The final report of the public inquiry into Daphne’s assassination has now been published. It does not identify who signed Daphne’s death warrant: that was not its purpose. It does however examine how a state of impunity has developed over time such that her assassination was the direct consequence. It points out how business and politics became intertwined until you could not tell which was which.

The main takeaway from the inquiry report is that the state has been taken over by a Mafia mentality. The state has been hijacked by a cultural mindset that allows and encourages a Mafia attitude to take root and prosper.

Few of the proposals of the inquiry are new to the political debate. Most have been put forward over the years but they were shot down, diluted or had the breaks applied by different governments. Effective whistleblowing is still subject to political strings as has been evidenced over the years. Lobbying regulation is still talked of but not implemented.  The regulation of ethical behaviour has developed into a farce, notwithstanding the efforts of George Hyzler, the Commissioner for Standards in Public Life.

It is about time that the links between business and all branches of the state are transparent. Everything, without any exception, must be above board. This has been on the books for years, yet continuously ignored.

The Maltese state has been severely weakened by those who sought their fast-track enrichment at all costs. It is up to all of us, to stop them in their tracks. The soonest. The state has failed us. The Republic is sick.
