Through the revolving door: politicians for sale at a discount

US Investment Bank Goldman Sachs announced last week that it had “hired” former EU Commission Chairman Josè Manuel Barroso as an advisor and non-executive Chairman of the Goldman Sachs International arm.

The New York Times quoting co-CEOs of Goldman Sachs International Michael Sherwood and Richard J. Gnoddle explained the relevance of the appointment as being “Josè Manuel’s immense insights and experience including a deep understanding of Europe”. Earlier this week, the EU Observer  further commented that Goldman Sachs hired Barroso “as it struggles with the fallout from Britain’s vote to leave the EU”.

Based in London but offering services across Europe, Goldman Sachs may be faced with limited or no access to the EU’s single market as a result of Brexit. Hence the need to hire Barroso as an advisor and lobbyist as the United Kingdom and the European Union prepare for the negotiations leading to the UK’s exit from the European Union which can be triggered any time in the forthcoming weeks through a declaration in terms of article 50 of the Lisbon Treaty.

Barroso’s engagement with Goldman Sachs is one which will be much debated as, like nine other members of the Commission which he led between 2009 and 2014, he has been catapulted into the corporate boardroom through the revolving door. His value to Goldman Sachs is his knowledge of the privileged information to which he had access during his 10-year tenure as President of the EU Commission and, the influence which he may still have on a number of key EU officials.  This gives great value to his advisory/lobbying role with Goldman Sachs.

European Union regulations on the possible activities of its former Commission members draw a cut-off line after an 18-month cooling-off period at the end of their tenure when, as stated by an EU Commission spokesperson, “there is a reasonable assumption that the access to privileged information or possible influence are no longer an issue”.   This is contested by the different political groupings in the EU Parliament who maintain that the cooling-off period for EU Commissioners taking up sensitive jobs after ceasing their duties as Commissioners should be extended from 18 months to five years as the present length of time is insufficient to ensure that the EU is really the servant of ordinary people and not of multinational corporations or international financial institutions.

This debate at a European Union level contrasts to the provisions of the Standards in Public Life Bill currently being debated by the Maltese Parliament which Bill, so far, does not make any provision on the regulation of lobbying in Malta in any form or format.

It is not unheard of in Malta for politicians to move through the revolving door from the Cabinet to the private sector boardroom or its anteroom, and back again. Three such cases of former Cabinet Ministers in Malta in the recent past come to mind : John Dalli and his involvement with the Corinthia Group and later the Marsovin Group, Karmenu Vella who similarly was heavily involved first with the Corinthia Group and subsequently with the Orange Travel Group as well as with Betfair and finally Tonio Fenech’s recent involvement in the financial industry.

Being unregulated, lobbying through the revolving door is not illegal but it can still be unethical and unacceptable in a modern democratic society as it can result in undue influence of corporations over the regulatory authorities.

Piloting the debate on the Standards in Public Life Bill on Monday 11 July, Deputy Prime Minister Louis Grech recognised the deficiencies of the Bill and declared that a register of lobbyists in Malta was a necessity. While this is a welcome statement and a significant first step forward, it is certainly not enough, as a proper regulation of lobbying in Malta is long overdue. This involves much more than registration of lobbyists or even the regulation of revolving door recruitment in both the private and the public sector.

If done properly, lobbying is perfectly legitimate. It is perfectly reasonable for any citizen, group of citizens, corporations or even NGOs to seek to influence decision-taking. In fact it is done continuously and involves the communication of views and information to legislators and administrators by those who have an interest in informing them of the impacts of the decisions under consideration. It is perfectly legitimate that individuals, acting on their own behalf or else acting on behalf of third parties, should seek to ensure that decision-takers are well informed before taking the required decisions.

However, for lobbying to be acceptable in a democratic society, it must be done transparently. In particular, through regulation it must be ensured  that lobbying should not be transformed into a  process through which the decision-takers make way for the representatives or advisors of corporations to take their place. Lobbying activities must be properly documented and the resulting documentation must be publicly accessible.

Hopefully, Parliament will take note and act.

Ecocide in the Mediterranean. The known consequences so far.

Carmine Schiavone’s secrets are now public knowledge. They  join the testimony of Francesco Fonti at the Mafia’s maxi-processo in Palermo. The mozzarella scandal of 2008 pales into insignificance.

Organised crime has a solid grip on toxic and nuclear waste disposal in the Italian peninsula. They dumped it in  areas where buffalos grazed. They dumped in areas around Naples, in particular around Casale di Principe or in the Mediterranean Sea. Francesco Fonti had mentioned 42 ships laden with toxic and nuclear waste which were sunk in different areas of the Mediterranean. The location of one them, the Cunsky (vide illustration above) had been identified just off the coast of Calabria loaded with 120 barrels of toxic waste.

The latest revelations involve the dumping of nuclear and toxic waste originating from Germany and Northern Italy  in areas where they contaminated ground water.

Legambiente, the Italian environment NGO is not surprised with the information revealed in Schiavone’s testimony. Over the years it has documented countless cases which it classifies under the title Ecomafia: it has published annual reports on the matter since the year 2000.

I will not bother you with more details. Just one tiny bit: one particular health centre in the Naples area has identified that the number of cancer cases it deals with has skyrocketed from 136 in 2008 to 420 in 2012.

The New York Times on Sunday reported : Mafia’s dumping of toxic waste blamed for high cancer rates in Italy.  “Cancer rates have increased 47% for men and 40% for women in the areas around Naples and Pompeii thanks to illegal disposal by Mafia-controlled companies that occurred during a 20-year period, in which the harmful substances were dumped into lakes, farmland, quarries and caves.”

In Malta the above has not triggered any particular interest yet.

Żewġ traġedji f’ġimgħa. Fit-tieni waħda kienu protagonisti l-Forzi Armati ta’ Malta li salvaw mal-150 persuna mill-għarqa. Veru li għamlu dmirhom. Imma li jirnexxilek tagħmel dmirek f’ċirkustanzi bħal dawn hu ta’ sodisfazzjon mhux żgħir.

Din id-darba kien pożittiv ukoll l-atteġġjament tal-Prim Ministru Joseph Muscat. Hu ta’ sodisfazzjoni li bidel l-attitudni li kien ħa iktar kmieni din is-sena. Nittama li l-ħsara li laħqet saret tibda tissewwa. Dan jista’ jseħħ, iżda jieħu ż-żmien. Dejjem jekk il-bdil ta’ attitudni mhiex biss u sempliċiment bdil ta’ tattika.

Kif kien xieraq il-prijorita’ kienet li jsalvaw in-nies. Imma ġustament ġie emfasizzat li l-Unjoni Ewropeja teħtieġ li tiċċaqlaq.

Sal-lum id-dħul tal-immigranti m’hiex responsabbilta’ tal-Unjoni Ewropeja iżda tal-Istati membri individwali. Dan m’għandux jibqa’ hekk. Għax  l-istati fuq il-fruntiera tan-nofsinnhar tal-Ewropa (Malta, l-Italja, Spanja, l-Greċja u Ċipru) qed jerfgħu piż kbir li lkoll, kif nafu, ma jifilħux għalih.

Ir-responsabbilta’ għall-immigranti għandha tintrefa’ mill-Unjoni Ewropeja kollha, f’isem u għan-nom tal-istati membri kollha. Għax dak li jiġri mill-fruntiera l-ġewwa hu responsabbilta’ ta’ kulħadd, inkluż tagħna l-Maltin. Jiġifieri hu meħtieg li r-responsabbilta’ li tatna l-ġografija jgħinuna nerfgħuha.( Il-fruntiera mhiex importanti biss biex jinġabar dak dovut għad-dwana.)

Biex dan iseħħ hemm bżonn li jinbidlu r-regolamenti tal-Unjoni Ewropea magħrufin bħala Dublin II (magħrufa ukoll bħala l-Konvenzjoni ta’ Dublin). It-tibdil meħtieġ jagħmilha possibli li immigranti jiċċaqalqu mill-pajjiż fejn jaslu għal pajjiż ieħor fejn tkun tista’ tiġi ipproċessata t-talba tagħhom għal status ta’ refuġjat.

Alternattiva Demokratika ilha snin li ikkonvinċiet lill-partiti l-Ħodor Ewropej li din hi t-triq il-quddiem: triq li permezz tagħha r-responsabbilta’ li illum qed terfa’ Malta u l-istati l-oħra fuq il-fruntiera tan-nofsinnhar tal-Ewropa tibda  tintrefa’ minn kulhadd flimkien.

Imma mhux kulħadd jaqbel ma dan. Il-Partiti l-oħra fl-Ewropa s’issa ma qablux ma dan.

Il-Ġermanja, per eżempju hu wieħed minn 24 pajjiż fl-Unjoni Ewropeja li ma jridx jibdel l-affarijiet. Jippreferi  li d-deċiżjonijiet dwar kemm il-pajjiż jieħu refuġjati joħodhom hu. Fil-fatt fil-Ġermanja matul is-sena li qegħdin fiha ser ikunu ġew aċċettati 100,000 refuġjat.  Punt interessanti fl-aħbarijiet fi tmiem il-ġimgħa kien dak li intqal minn Katrin Göring-Eckardt co-leader ġdida tal-Ħodor Ġermaniżi li indikat li biex  id-diskussjonijiet dwar il-formazzjoni ta’ Gvern ġdid Ġermaniż bejn id-Demokristjani u l-Ħodor jipproċedu huwa essenzjali (fost ħafna affarijiet oħra) li jkun hemm tibdil fil-posizzjoni dwar l-immigrazzjoni attwalment f’idejn il-Ministru tal-Intern Hans  Peter Friedrich, allejat lemini ta’ Angela Merkel mis-CSU tal-Bavaria. Fid-dawl ta’ dan hu ċar li l-uġiegħ ta’ ras ta’ Joseph Muscat qabel ma jikkonvinċi lill-istituzzjonijiet Ewopej hi biex jikkonvinċi lil sħabu fil-partiti Soċjalisti Ewropej li minn fosthom hemm 10 Prim Ministri.  Jekk dawn jagħtuh l-appoġġ ikun iktar faċli li naslu bħala pajjiż. Imma ħlief Enrico Letta, Prim Ministru tal-Italja, s’issa l-ebda kap ta’ Gvern fl-Unjoni Ewropeja għadu ma esprima ruħu.

Ħafna drabi jsir l-iżball li ninsisitu b’qawwa kbira dwar x’għandha tagħmel l-Ewropa mingħajr ma nirrealizzaw li l-Ewropa hi aħna ukoll, kif ukoll dawk ta’ madwarna.

Alternattiva Demokratika diġa’ ħadet posizzjoni ċara dwar dan kollu. Għax aħna ukoll parti mill-Ewropa għamilna l-parti tagħna u wittejna t-triq. Wrejna li hu possibli li fuq livell ta’ Unjoni Ewropeja jkun hemm appoġġ biex ir-responsabbilta’ għall-immigranti li illum qed jintrefa minn Malta waħedha tibda jintrefa minn kulħadd. Il-Ħodor Ewropej bdew. Il-Ħodor Ewropej tawna l-appoġġ billi qablu ma ħtieġa ta’ riforma tal-Konvenzjoni ta’ Dublin bħala pass essenzjali biex ir-responsabbilta’ għall-immigranti nerfgħuha flimkien. Dan hu l-uniku mod li bih nistgħu naslu. B’solidarjeta’ ta’ vera.
