In-negozjant tal-ikel Tork u sieħbu fin-negozju  

Il-mostru ta’ bini li approvat l-Awtorità tal-Ippjanar u li preżentement qed jinbena ħdejn il-kappella tal-Manikata kien ikkunsidrat li hu aċċettabbli, kemm mill-arċidjoċesi ta’ Malta kif ukoll mis-sopra-intendenza tal-wirt kulturali. Kemm l-Arċisqof kif ukoll is-Sopratendent tal-Wirt Kulturali jeħtieġ li jagħmlu apoloġija pubblika għax l-ewwel oġġezzjonaw minħabba li l-bini propost mhux postu ħdejn il-kappella u mbagħad, wara, irtiraw l-oġġezzjoni tagħhom. B’dak li għamlu, t-tnejn li huma taw kontribut biex dan il-mostru jimmaterjalizza.

Iktar kmieni din il-ġimgħa, l-portal elettroniku Shift News svela li Malti fin-negozju tal-ikel Tork, li f’ismu daħlet applikazzjoni ta’ żvilupp biex jinbena dan il-monstru  għandu sieħeb sieket fin-negozju: l-perit li iffirma l-applikazzjoni ta’ żvilupp. Skond ix-Shift News huwa jippossjedi 50 fil-mija tal-ishma tal-kumpanija Juke Developments Limited, il-kumpanija li qed tieħu ħsieb l-iżvilupp.

Mhux aċċettabbli li l-perit ikun ukoll żviluppatur.  Din hi imġieba ħażina li qed titfa’ dell ikrah fuq il-professjoni kollha. Hi materja ta’ etika li l-Kamra tal-Periti, li hi inkarigata milli tirregola l-professjoni, tevita kontinwament milli tesprimi ruħha u tieħu posizzjoni dwarha.

Madwar sentejn ilu, f’artiklu fuq Illum intitolat Il-perit-żviluppatur (8 ta’ Marzu 2020) kont ġbidt l-attenzjoni li l-perit inkarigat mill-proġett tal-Ħamrun, li fl-istadji inizzjali tiegħu kien wassal għall-mewt ta’ Miriam Pace, kien jippossjedi 10 fil-mija tal-ishma tal-kumpanija li kienet qed tieħu ħsieb l-iżvilupp.

Il-Kodiċi dwar l-Imġieba Professjonali għall-periti fil-gżejjer Maltin jipprovdi li  Perit f’Malta “ma għandux jokkupa, jassumi jew xjentement jaċċetta kariga li fiha l-interess tiegħu jkun kontra d-dmirijiet professjonali tiegħu.”

Il-punt hu jekk id-doveri professjonali ta’ perit inkarigat minn żvilupp humiex f’kunflitt ma li tkun ukoll, fl-istess ħin “l-żviluppatur”. Il-perit inkarigat minn lant tax-xogħol huwa ultimament responsabbli  għal dak li jseħħ fuq il-lant  avolja illum ġieli jkun assistit minn xi site officer, li imma rari jkun fuq il-lant! L-iskop tal-żviluppatur, min-naħa l-oħra, kif jgħidu, hu li jdawwar lira: hu interessat li jimmassimizza l-profitti mill-iżvilupp tal-art.

Il-Kodiċi dwar l-Imġieba Professjonali li semmejt iktar il-fuq jemfasizza li l-perit “jirċievi rimunerazzjoni biss bid-drittijiet professjonali tiegħu li jitħallsu mill-klijenti tiegħu u/jew bis-salarju tiegħu li jitħallas mill-prinċipal tiegħu. Hu ma jkunx jista’ jieħu rimunerazzjoni minn riżorsi oħra relattiva għax-xogħol u għad-dmirijiet fdati lilu.”   B’dan, fil-fehma tiegħi, hu ċar li perit ma jistax ikollu sehem minn profitti li jirriżultaw minn żvilupp tal-art u għaldaqstant m’għandux jaġixxi ta’ żviluppatur, la waħdu u l-anqas bi sħab ma ħaddieħor. Il-profitti mill-iżvilupp tal-art m’għandhomx ikunu l-motiv għall-ħidma professjonali tal-perit.  

Jidher li l-Kamra tal-Periti ma taqbilx ma dan għax b’mod konsistenti hi siekta dwar is-suġġett. Dan is-skiet hu inevitabilment interpretat bħala li l-Kamra tal-Periti qed taċċetta is-sitwazzjoni attwali. Mhux ta’ b’xejn, għaldaqstant li n-numru ta’ każi magħrufa ta’ periti li huma sħab fin-negozju ta’ żvilupp ta’ propjetà, imma li isimhom ma jidhirx, qiegħed jiżdied. Isimhom ma jidhirx għax huma konxji mill-kunflitt li hemm u jagħmlu ħilithom li jostru dan kollu fil-mixja tagħhom lejn sehem mill-profitti li jirriżultaw minn dan l-iżvilupp.

Bosta snin ilu, meta kont membru elett tal-Bord li jirregola l-ħruġ tal-warrant tal-periti kont ippreżentajt proposta biex dan kollu, jiġifieri ir-rwol ta’ periti li jaġixxu ta’ żviluppaturi, jkun regolat. Il-proposta tiegħi dakinnhar ma kienitx imxiet il-quddiem.

Sfortunatament, sal-lum, għad ma ittieħdet l-ebda azzjoni dwar dan kollu. Li nibqgħu ma tittieħed l-ebda azzjoni jfisser li l-qagħda preżenti tkun aċċettata bħala n-normalità. Sfortunatament dan hu konsistenti mal-valuri tas-soċjetà amorali li qed tiżviluppa madwarna.

The kebab man and his business partner

The monstrosity dwarfing the Manikata chapel approved by the Planning Authority was considered acceptable by both the Archdiocese of Malta and the Superintendence of Cultural Heritage. Both the Archbishop as well as the Superintendent of Cultural Heritage owe every one of us an apology for having withdrawn their objection to this development. They had originally submitted that the proposed development is incompatible with the chapel and its surroundings. Then they had second thoughts, thereby contributing to the development of this monstrosity.

Online news portal, Shift News, has revealed, earlier this week, that a man in the kebab business, in whose name the application was submitted has a silent business partner: the architect who signed the approved development application. The Shift News, also revealed that the architect is a co-owner of the development site through his 50 per cent ownership in Juke Developments Limited, the company which has taken charge of the development.

It is not on that architects are also developers.  This is a professional misconduct which is bringing the whole profession into disrepute. It is an ethical matter which has been repeatedly avoided by the Chamber of Architects and Civil Engineers, the professional body entrusted with regulating the architectural profession in the Maltese islands.

Around two years ago, in these columns, in an article entitled The architect-developer (8 March 2020) I had pointed out that the architect in charge of the development at Ħamrun, which development had, in its initial stages, resulted in the death of Miriam Pace, had a 10 per cent shareholding in the company which was carrying out the development.

The Code of Professional Conduct for architects practicing in the Maltese islands clearly lays down that a locally warranted architect “must not hold, assume or consciously accept a position in which his interest is in conflict with his professional duty.”

The point at issue is whether the professional duties of an architect in charge of a development are in conflict with the interests of being “the developer”. The architect in charge of a site of works is ultimately responsible for what goes on the site, even though he is nowadays assisted by a site officer who in most cases is rarely present on site! The developer, on the other hand is interested in the potential maximisation of profits resulting from the development of the site under consideration: making hay while the sun shines! The profits resulting from development should not be the professional’s motivation.

The Code of Professional Conduct abovementioned goes on to emphasise that a locally warranted architect “is remunerated solely by his professional fees payable by his clients and/or by his salary payable by his employer. He is debarred from any other source of remuneration in connection with the works and duties entrusted to him.”  In my opinion this clearly forbids architects from sharing in the profits of development and consequently in being developers, on their own or together with others.

Apparently, the Chamber of Architects and Civil Engineers disagrees with the above as it has been consistently silent on the matter. This silence has inevitably been interpreted by one and all as acquiescence: accepting the current state of affairs. It is consequently no wonder that the number of known cases of architects being silent partners in development projects is quietly on the increase. They are silent partners, meaning that they are aware that there is a conflict in their responsibilities which they do their best to hide in their pursuit of a share of the profits resulting from development.

Many years ago, when I was an elected member of the architects Warranting Board, I had presented a proposal to start regulating the role of architects who act as developers. My proposal was not acted upon.

Unfortunately, no action has been taken to date. Taking no action signifies accepting the present situation as the normal acceptable behaviour. This is unfortunately consistent with the norms of the amoral society which currently rules the roost.

Saving the little that we have

Almost two years ago, Architect Edward Said submitted a request to the Planning Authority and the Superintendence of Cultural Heritage in order that they take steps to protect a Villa along the St Julian’s promenade. The Villa known as Palazzina Vincenti was designed and constructed for his own use by Architect Gustavo Romeo Vincenti. Architect Vincenti died in 1974.

As far as is known, neither the Planning Authority nor the Superintendence of Cultural Heritage have acted upon the submissions received requesting the protection of Palazzina Vincenti. At the time of writing the Superintendence has passed the buck to the Planning Authority! In the meantime, a development application has been submitted for the demolition of Palazzina Vincenti and its substitution with a 17-storey 136 room hotel, including three levels below street level providing garage space for 58 cars.

In a report drawn up by Architect Edward Said, Palazzina Vincenti is described as “a masterpiece of architecture defined by pure geometric volumes”.  It is considered as one of the earliest examples of the use of reinforced concrete in domestic architecture in Malta.  Quoting from a 2018 Masters of Architecture dissertation by David Ellul, Architect Said emphasises that by taking full advantage of the potential of reinforced concrete, Vincenti’s artistic expression was freed from the limitations of traditional materials. The result is this masterpiece which can be lost quite soon!

Even though to the untrained eye Palazzina Vincenti may seem to be an ugly building specimen, ill-fitting in its present-day concrete jungle surroundings, it is still a masterpiece worth preserving for posterity.

I fail to understand why two years after a request for protection has been submitted no action has yet been taken. As a result of such inaction, the message conveyed by the authorities is a very clear one: that the site occupied by Palazzina Vincenti is ripe for development. This is an inevitable conclusion conveyed by those in charge as a result of their failure to act.

At this point in time, as a minimum, it is expected that an emergency conservation order protecting Palazzina Vincenti is issued urgently. This would be a clear sign to those currently benefitting from a prolonged phase of “development greed” that a red line has been drawn around our heritage, thereby protecting it. It would also provide some breathing space which would be of considerable help in order that the Planning Authority may bring its house in order.

Some have the mistaken idea that all our heritage is necessarily old, very old, going back centuries. This is certainly not the case as this specific architectural masterpiece is less than 75 years old. Unfortunately, there have been other worthy examples of our architectural heritage which have been lost through carelessness, insensitivity and institutional ignorance.

I could remind readers of another outstanding example of modern architecture which has gone to the dogs, this time in Gozo, some 15 years ago. Parts of the Qala Primary School in Gozo were demolished to make way for an Institute of Tourism Studies campus in Gozo. The said school was designed and constructed under the supervision of Architect Joseph Huntingford who as the government architect in charge of schools was responsible for most new schools constructed in Gozo between 1950 and 1961.

Way back in 2006 the Chamber of Architects and Civil Engineers had described the Qala Primary School as one of the finest examples of modern architecture on the island. Even then the Planning Authority was advised to handle our heritage with care. But it was of no use. The advice was ignored as parts of the school were demolished to make way for the ITS campus.

There is still time to save Palazzina Vincenti from being sacrificed on the altar of “development greed”. We need to be more appreciative of our heritage. We have so little of it. I am not however so sure as to whether the Planning Authority is capable of taking decisive action. It has been desensitised for far too long.

Ambaxxati b’daqs ta’ raħal

L-ambaxxata Amerikana nbniet 9 snin ilu fuq medda kbira ta’ art f’ Ta’ Qali li nxtrat mingħand il-Gvern Malti għas-somma ta’  €14.6 miljuni. L-ambaxxata f’Ta’ Qali hi mibnija fuq art b’qies ta’ madwar 4 ettari, jiġifieri 40,000 metru kwadru.

Iktar kmieni din il-ġimgħa l-Awtorità tal-Ippjanar approvat permess ta’ żvilupp biex tinbena ambaxxata Ċiniża f’Pembroke fuq art b’qies ta’ madwar 2 ettari, jiġifieri 20,000 metru kwadru.  

Għalkemm il-kumpless tal-ambaxxata Ċiniża ser ikun madwar nofs fid-daqs meta mqabbel ma dak Amerikan f’Ta’ Qali xorta hu kbir wisq. L-art li fuqha ser jinbena dan il-kumpless inxtrat mingħand il-Gvern Malti għas-somma ta’ €7,880,000.

Għalfejn dawn il-pajjiżi barranin qed jitħallew jibnu l-ambaxxati tagħhom fuq art daqshekk kbira?  Jekk verament jeħtieġu dan l-ispazju għaliex ma ġewx imħajra biex jirrestawraw xi bini qadim, preferibilment storiku, b’benefiċċju għall-komunità Maltija?

Kemm ser indumu ma jkollna xi talba oħra għall-iżvilupp ta’ kumpless ieħor għal ambaxxata enormi? Forsi mill-Federazzjoni Russa?

Id-dibattitu pubbliku dwar l-Università Amerikana f’Malta suppost li għamel lil ħafna nies iktar konxji. Imma jidher li ma tgħallmu xejn mid-dibattitu pubbliku li wassal biex l-unika parti ta’ din l-Univeristà li illum qed tiffunżjona qegħda flok it-tarżna f’Bormla. Il-bini storiku li kien jifforma parti mit-tarżna ta’ Bormla, l-imħażen tal-Kavallieri tas-sbatax-il seklu u l-workshops tal-Ammiraljat Ingliż tad-dsatax-il seklu ġew restawrati u ħadu ħajja ġdida. Dan kollu issarraf f’ġid ambjentali għall-pajjiż kollu u l-ħarsien ta’ art f’Marsaskala minn żvilupp li kien jeqridha.

Jekk nistaqsu għaliex dawn l-ambaxxati kbar, daqs raħal, qatt m’hu ser ikollna tweġiba onesta. Għax hu ovvju li apparti x-xogħol konsulari normali u l-iżvilupp ta’ relazzjonijiet tajba mad-dinja tan-negozju u mal-komunitajiet lokali, fir-realtà, dawn l-ambaxxati huma “widna” iffukata biex tisma’ dak li qed jiġri fir-reġjun tal-Mediterran.

Uħud iħobbu jiddeskrivu kemm lill-iStati Uniti kif ukoll lir-Repubblika Ċiniża bħala ħbieb kbar ta’ Malta. Ir-realtà hi ftit differenti. Hu prinċipju bażiku tal-politika barranija li l-pajjiżi m’għandhomx ħbieb, għandhom biss interessi! Ir-relazzjonijiet diplomatiċi, imbagħad, iservu biex iġibu l-quddiem dawn l-interessi!

Il-posizzjoni ta’ Malta fil-Mediterran tagħmilha idejali bħala ċentru fejn tisma’ u tosserva. Dan, hu interess ewlieni li minħabba fih kemm l-Istati Uniti kif ukoll ir-Repubblika Ċiniża għandhom bżonn spazju kbir.

Id-dibattitu riċenti dwar il-possibiltà ta’ ftehim li jirregola l-militar Amerikan f’pajjiżna (Status of Forces Agreement : SOFA) hu indikattiv. Il-kummenti li smajna u qrajna jagħtu idea żgħir ta’ dak li kien għaddej madwar il-mejda.  

F’pajjiżi kbar, ambaxxati kbar jistgħu jagħmlu sens. Imma Malta, tista’ tgħaddi mingħajrhom. M’għandniex bżonn ambaxxati kbar biex intejbu r-relazzjonijiet mal-Istati Uniti jew iċ-Ċina.

L-ambaxxata tal-Istati Uniti f’Ta’ Qali issa ilha mibnija u ilha topera 9 snin. Imma l-ambaxxata Ċiniża għadha fuq il-pjanta. MInkejja li għadha kif ġiet approvata l-ambaxxatur Ċiniż għad għandu ħin biex jaħseb ftit dwar kif jista’ jindirizza n-nuqqas ta’ spazju li għandu mod ieħor. Jista’ jikunsidra r-riabilitazzjoni ta’ bini qadima, possibilment bini storiku minflok ma jibni ambaxxata daqs raħal.  

Jekk jagħmel hekk ikun qed jittrasforma problema f’opportunità.

Villa Gollcher fil-Mosta: nipproteġuha

 

Ministri tal-Gvern, u ta’ madwarhom, qieshom qegħdin fil-kju għall-prosit wara li tħabbar li Ta’ Qali ser ikun estiż biex ikun l-ikbar spazju miftuħ f’Malta. Park Nazzjonali, qalulna. Sal-ħin li qed nikteb għadu mhux ċar x’inhu propost eżattament, avolja l-fatt fih innifsu li l-ispazji miftuħa aċċessibli għal kulħadd ser jiżdiedu hu pass posittiv u li hu inkoraġġanti.

Huwa biss biż-żmien li nistgħu nsiru nafu jekk din l-aħbar hix intenzjonata biex tostor azzjonijiet oħra, bħal, pereżempju, l-qerda ta’ Villa Gollcher fil-Mosta. Ninsab infurmat li din il-possibilità, li Villa Gollcher tinqerd u flokha jkun żviluppat xi ħaġa oħra, ġiet diskussa minn kandidat tal-Partit Laburista għall-Kunsill Lokali tal-Mosta waqt laqgħa b’attendenza miżera li saret għall-komunità tan-negożju fil-Mosta. Speċifikament issemmiet il-possibilità li fuq sit li effettivament hu protett ikun ipprovdut parkeġġ għal 500 karozza!

Villa Gollcher qiegħda fil-qalba urbana tal-Mosta b’kejl superfiċjali ta’ madwar 13,000 metru kwadru. Il-parti l-kbira tas-sit hi okkupata minn ġnien mimli b’siġar taċ-ċitru. Villa Gollcher mhix skedata. Imma kont sorpriż meta identifikajt li hemm protezzjoni permezz tal-policy CG09 tal-pjan lokali għaċ-Ċentru ta’ Malta li kien approvat fl-2006. Mhux normali li nsibu sorpriżi bħal dawn fil-pjani lokali għax ġeneralment dawn kienu użati biex ikun immassakrat il-wirt mibni tagħna.

Il-Pjan Lokali jenfasizza li siti bħal Villa Gollcher fil-Mosta, bi ġnien imdaqqas, identifikati bħala spażji mhux mibnija bejn il-bini, għandhom ikunu mħarsa. Il-pjan lokali għaldaqstant jipprovdi li m’għandhomx ikunu kkunsidrati proposti biex isir żvilupp fuq dawn is-siti li bħala riżultat tiegħu jinħolqu binjiet separati, residenzjali jew mhux, u dan inkluż garaxxijiet għall-karozzi. L-unika possibiltajiet li jistgħu jkunu kkunsidrati huma dawk li jikkonċernaw xogħol żgħir immirat biex jikkonserva u/jew jirrestawra dawn it-tip ta’ propjetajiet fiż-żoni ta’ konservazzjoni urbana. Jista’ jkun hemm il-possibilità ukoll għal żidiet żgħar kompatibbli mar-regoli għaż-żoni ta’ konservazzjoni urbana imma jidher li hu possibli li Villa Gollcher fil-Mosta insalvawha.

Dejjem hemm il-logħob tal-iżviluppaturi, pereżempju, li ma jiħdux ħsieb il-bini biex tiġrilu l-ħsara u eventwalment ma jibqa’ xejn x’ikun protett! Biex nevitaw dawn l-affarijiet għandna ninsistu mal-Awtorità tal-Ippjanar biex tagħti kont ta’ egħmilha. Dan billi tassigura li sidien il-propjetà ma jippruvawx jonqsu mill-obbligi tagħhom biex jirnexxielhom jevitaw milli jintlaħqu l-miri tal-pjan lokali intenzjonati biex ikunu protetti ż-żoni ta’ konservazzjoni urbana.

Jiena infurmat li minkejja dan kollu, diġa ġie iffirmat konvenju biex tinbiegħ Villa Gollcher fil-Mosta, u dan soġġett li jinħareġ permess ta’ żvilupp mill-Awtorità tal-Ippjanar għal svilupp massiċċ. Qed jissemmew miljuni kbar ta’ euro. Ilkoll nafu x’kapaċi jagħmlu l-flus!

Hemm ħafna ġonna mdaqqsa li jeħtieġilhom u jixirqilhom ikunu protetti fiż-żoni urbani tagħna li qegħdin fil-periklu li jkunu ssagrifikati u jkunu soġġetti għal żvilupp. Biex dan iseħħ irid ikun hemm il-kompliċità tal-Awtorità tal-Ippjanar, għax il-bqija dan ma jistax iseħħx. Huwa dover tagħna li nassiguraw li l-Awtorità tal-Ippjanar tkun kontinwament attenta biex dan ikun evitat f’kull ħin. L-Awtorità tal-Ippjanar għandha tkun iffukata biex twettaq dmirha ħalli l-ippjanar għall-użu tal-art ikun servizz li minnu tibbenefika l-komunità kollha.

Forsi, min jaf, il-ħarsien tal-wirt mibni tagħna ikun xi ftit iktar faċli milli hu illum.

Hands off Mosta’s Villa Gollcher

Government Ministers, and hangers-on, are queuing to share credit for the announcement regarding Ta’ Qali’s extension into the largest open space in Malta. A National Park. At the time of writing, it is not at all clear as to what is being proposed -even though the number of increasing accessible open spaces is laudable.

Time will tell whether this announcement will be used to camouflage other action, such as – for example – the chopping up of Villa Gollcher in Mosta. I am informed that this possibility, the demolition of Villa Gollcher and the redevelopment of the site, was recently discussed by a Labour Party Mosta Local Council candidate during a sparsely attended meeting for the Mosta business community. Specifically mentioned was the possibility of providing parking for 500 cars on what is currently a protected site: Villa Gollcher.

Villa Gollcher lies within the urban core of Mosta. It has a superficial area of around 13,000 square metres. Most of the area is taken up by a large garden full of citrus trees. Villa Gollcher is not scheduled. However, I was surprised to identify its protection through Policy CG09 of the Malta Central Local Plan which was approved in 2006. A pleasant surprise – which I am not accustomed to finding in the Local Plans as they have generally been used time and again to place our built heritage on the development chopping board.

The Local Plan, in fact, underlines the special provisions applicable in respect of sites which, like Villa Gollcher in Mosta, are identified as open space enclaves. In this respect, it is stated in the Local Plan, that the Planning Authority “will not consider any development or redevelopment proposals that create new independent residential/non-residential units, including garages for the parking of vehicles.” The only possible developments which may be considered are very minor ones which are aimed at converting/restoring this, and similar properties, in urban conservation areas. There may be room for minor additions compatible with Urban Conservation rules but I believe that – on the basis of the above-quoted policy – it is possible to save Mosta’s Villa Gollcher.

Of course there are the usual tricks which developers play, such as facilitating the dilapidation process through a lack of maintenance. In this respect, we should hold the Planning Authority to account: with appropriate measures it should ensure that owners of properties do not try to successfully stultify the Local Plan policies intended to protect the character of our urban conservation areas.

I am informed that, notwithstanding all this, a promise of sale has been entered into respect of Villa Gollcher, subject to the condition of the issuance of development permits for a large-scale redevelopment. Millions of euros are in play and at stake and we all know that money talks.

Many large gardens worthy of protection in our old urban areas are at risk of being sacrificed on the development chopping board. This will only be possible with the complicity of the Planning Authority and it is our duty to ensure that the Planning Authority is kept on its toes in order that this is avoided. It should be focused on carrying out its duties in ensuring that land use planning is a service from which the whole community stands to gain.

Maybe, who knows, protecting our heritage would be an easier task than it is today.

Fort Campbell f’Selmun: abbandunata, vvandalizzata u fi stat ta’ periklu

Dal-għodu kont Fort Campbell, limiti ta’ Selmun flimkien ma Luke Caruana kandidat ta’ Alternattiva Demokratika għall-Kunsill Lokali tal-Mellieħa u ma Ralph Cassar, Segretarju Ġenerali tal-partit.

Fort Campbell mhux biss ġiet traskurata u żviluppat ħsara kbira, kkawżata miż-żmien u mill-elementi, imma hu ċar li ġiet vandalizzata ukoll.

Din il-forti nbniet mill-Inġliżi fis-snin tletin, ftit qabel ma faqqgħet it-tieni gwerra, bħala parti mit-tħejjija għad-difiża tat-tramuntana ta’ Malta minn attakki mill-ajru jew mill-baħar.

Għalkemm relattivament inbniet fi żmien riċenti, din il-fortizza xorta tifforma parti mill-wirt storiku tagħna. Minflok ma nħalluha tibqa’ tiġi vvandalizzat, sakemm possibilment tinqered għal kollox, huwa obbligu tagħna bħala pajjiż li nirranġaw il-ħsara u li din l-opra tal-gwerra nikkonvertuha fi strument għall-paċi. Strument għall-ħarsien u l-istudju tal-ambjent rurali kif ukoll ċentru biex immexxu l-quddiem l-eko-turiżmu.

X’ħin kont Fort Campbell dal-għodu kien hemm ħafna nies, bil-familji. Tkellimt ma uħud minnhom. Mhux kollha huma konxji mill-gravità tas-sitwazzjoni. Bil-ħafna tfal li kien hemm jiġru min-naħa għall-oħra, l-obbligu tal-Gvern li jieħu passi immedjati, biex min qiegħed jirrikreja ruħu hemm ma jkunx espost għall-periklu, hu ta’ prijorità immedjata.

Imma f’dan il-pajjiż dejjem l-istess. Forsi, min jaf, niċċaqalqu meta tiġri disgrazzja kbira. Imma dakinnhar, għal min ilaqqata jkun tard wisq.

Aħdar ir-risposta

(diskors li għamilt illum is-Sibt 6 t’April 2019 f’egħluq Laqgħa Ġenerali Straordinarja li approvat il-kandidati u l-Manifest Elettorali ta’ Alternattiva Demokratika għall-elezzjonijiet ta’ Mejju 2019)

Il-Manifest Elettorali li għadna kif iddiskutejna u approvajna huwa mibni fuq erba’ argumenti: l-ugwaljanza, l-ekoloġija, is-saħħa u d-demokrazija. Hija r-rabta kontinwa li nfittxu bejn il-politika ambjentali u l-politika soċjali.

Kif ngħidu fil-Manifest li għadna kif approvajna, “Biex tkompli tinbena Ewropa b’saħħitha li tiddefendi liċ-ċittadin hemm bżonn li tissaħħaħ id-demokrazija. Id-demokrazija trid titħaddem dejjem iżjed fl-istituzzjonijiet kollha, b’mod li d-deċiżjonijiet kollha li jittieħdu mhux biss ikunu trasparenti imma fuq kollox jittieħdu minn persuni eletti u politikament kontabbli. Iċ-ċittadini għandu jkunilhom possibli li jinvolvu ruħhom direttament f’dan il-proċess demokratiku.

Għal dan l-iskop, anke l-lobbying għandu jkun trasparenti, b’regoli ċari li japplikaw għal kulħadd. (hu ta’ sodisfazzjoni li illum qrajna fil-gazzetti li l-Kummissarju tal-Istandards fil-Ħajja Pubblika beda jaħdem dwar l-ewwel regoli dwar il-lobbying)

Għax mhux aċċettabbli f’soċjetà Demokratika li ma jkunx magħruf min qed jipprova jinfluwenza d-deċiżjonijiet, kif u għaliex.

Dan ma’ jgħoddx biss fl-Unjoni Ewropeja imma fuq kollox għandu jgħodd f’kull wieħed mill-istati membri.

Ir-rapporti ippubblikati dwar Malta mill-Kunsill tal-Ewropa, mill-Kummissjoni Venezja u il-GRECO (il-kumitat kontra l-korruzzjoni) lilna ma ssorpreduniex. Fihom ħafna affarijiet li mhux biss Alternattiva Demokratika ilha żmien titkellem dwarhom imma dwarhom ukoll għamilna proposti konkreti matul is-snin, inkluż fil-Manifesti Elettorali differenti.

Il-Gvern qed jipprova jiddefendi ruħu li l-kritika qed issir dwar liġijiet li saru żmien ilu li l-gvern tal-lum wiret mingħand il-gverijiet ta’qabel. Filwaqt li f’numru ta’ kazijiet dan hu minnu jibqa’ l-fatt li l-Gvern preżenti sabha komda li jibqa’ għaddej fuq dak li sab, għax hu komdu ħafna li meta tiġi dahrek mal-ħajt twaħħal f’ dawk li ġew qablek.

Ħu per eżempju l-poteri li għandu l-Prim Ministru u l-Ministru tal-Intern li jawtorizza l-intercettazzjoni tat-telekomunikazzjoni (tapping). Ma kellniex bżonn li l-GRECO jiġbdulna l-attenzjoni għaliha din. Ilna ngħiduha, kif għamilna anke fil-Manifest Elettorali tal-2017 ta’ AD. Kif jista’jkun li jibqa’ jkun il-politku li jiddeċiedi jekk jingħatax permess jew le biex isir it-tapping? Kif ser jiddeċiedi l-politiku meta jkun iffaċċjat b’talba biex ikunu investigati dawk ta’ madwaru? Dan mhux konflitt ta’ interess kbir? Hu għalhekk li ilna ngħidu li l-awtorità li jsir it-tapping għandha tingħata lill-ġudikatura li bla dubju tfittex li toqgħod attenta illi fil-ġlieda kontra l-kriminalità mhux biss titwarrab il-politika partiġjana u l-protezzjoni tal-ħbieb tal-politiku imma fuq kollox tassigura li jkun imħarsa d-drittijiet fundamentali.
Għidna ferm iktar minn hekk. Fl-2017 fil-Manifest Elettorali tkellimna ukoll fuq l-FIAU (Financial Intelligence Analysis Unit) fejn insistejna li m’għandiex tkompli tkun imexxija mill-AG (Avukat Ġenerali) u li r-rapporti tagħha m’għandhomx imorru għand il-Pulizija imma direttament għand il-Magistrat tal-Għassa. Irid ikun assigurat li r-rapporti tal-FIAU meta jaslu għand il-Pulizija ma jispiċċawx fil-bir tas-skieken imma li dawn ikunu investigati sewwa u li jittieħdu passi kull fejn jirriżulta meħtieġ.

Il-Kummissjoni Venezja u l-GRECO qalulna li istituzzjonijiet f’Malta għandna ħafna imma li dawn huwa dgħajfa. Qalu tajjeb, imma l-opinjoni pubblika f’Malta ilha konxja minn dan. Imma dan ġie injorat mill-Gvern immexxi mill-Partit Laburista. Il-PN min-naħa l-oħra, kellu jkun fl-Opposizzjoni biex jirrealizza dwar id-djgħufija tal-istituzzjonjijiet. Uħud minnhom ħoloqhom hu stess, iddiżinjati dgħajfa apposta, u dwar oħrajn sakemm inqeda għalaq għajnejh.

Huwa f’dan il-kuntest li ilna naħdmu għal dawn is-snin kollha.
Il-ħidma tagħna f’din il-kampanja elettorali b’differenza is-soltu mhiex limitat inkella iffukatan kważi esklussivament fuq il-Parlament Ewropew. Għall-ewwel darba qed niffaċċjaw l-elezzjonijiet tal-Kunsilli Lokali kollha fl-istess jum.

Ser nippreżentaw tal-inqas 9 kandidati, l-parti l-kbira minnhom żgħażagħ li qed jikkontestaw għall-ewwel darba fuq il-Mellieħa (Luke Caruana), Marsaskala (Daniel Desira), B’Kara (Anna Azzopardi), Naxxar (James Gabarretta), u Ħaż-Żebbuġ (Samwel Muscat). Għandna ukoll Irlandiż li jgħix Malta (Donal Kelly) li offra s-servizz tiegħu bħala kandidat fuq ix-Xgħajra u l-attivist ambjentali fil-Gżira (Jamie Mercieca). Ma dawn ngħodd ukoll lill-veteran tagħna fil-Kunsill Lokali ta’ H’Attard Ralph Cassar, li issa ilu jiġi elett għal snin twal – madwar għoxrin sena.

Grazzi lilkom ilkoll li qed toffru s-servizz tagħkom.

Ma dawn kollha, bħala partit iddeċidejna li għandi nikkontesta jiena ukoll fil-lokalità ta’ San Ġiljan. Għażilna din il-lokalità għax bħala partit irridu nagħtu kontribut dirett lir-residenti f’San Ġiljan li qed jiffaċċjaw problemi kbar. San Ġiljan hu fost dawk il-lokalitajiet li huma l-iktar milquta mill-iżvilupp bla rażan li bħalissa qed iħarbat il-ħajja ta’ kuljum ta’ bosta mill-Maltin.

Fiċ-ċentru tal-ħidma politika tagħna bħalissa hemm il-ħarsien tal-ambjent urban. Tul dawn il-ġimgħat dorna diversi lokalitajiet nitkellmu dwar il-kundizzjonijiet tat-toroq, dwar il-politika tat-trasport intenzjonata biex tkompli iżżid il-karozzi fit-toroq, dwar in-nuqqas ta’ aċċessibilità kif ukoll dwar it-teħid tal-ispazji pubbliċi, inkluż il-bankini, min-negozji għad-detriment tar-residenti.

F’diversi lokalitajiet, primarjament mal-kosta r-residenti ġew ridotti għal priġuniera f’darhom għax il-bankini okkupati minn imwejjed u siġġijiet li qed joħlqu diffikultajiet kbar kemm għall-aċċess tar-residenti għal djarhom kif ukoll għal servizzi bażiċi bħall-ġbir tal-iskart.

It-traskuraġni amministrattiva tul is-snin irrediet lokalità bħall-B’Kara bħala lokalità perikoluża kull meta jkollna maltempata. B’Kara għadha tiffaċċja l-għargħar kull meta jkun hawn ħalba xita, qawwija u mhux. Il-Gvernijiet repetutament fittxew li jindirizzaw l-effett u ftit li xejn saret ħidma dwar il-kawża ta’ dan kollu. Parti mhux żgħira mill-bini ta’ dan l-aħħar ħamisn sena fiħ nuqqas ta’ bjar (jew bjar ta’ qisien żgħar) bil-konsegwenza li f’kull ħalba xita miljuni ta’ litri ta’ ilma tax-xita jispiċċa fit-toroq ta’ B’Kara flok fil-bjar li suppost inbnew. Dan mhux biss hu ħtija ta’ nuqqas ta’ bjar f’B’Kara imma ukoll fil-lokalitajiet fil-madwar. F’dan is-sens B’Kara hi l-vittma ta’ amministrazzjoni pubblika inkompetenti li tul is-snin injorat ir-responsabbiltà li tara illi kull binja hi mgħammra b’bir ta’ daqs adegwat.

Hemm il-ħtieġa li nenfasizzaw iktar fuq il-ħtieġa li tkun implimentata mingħajr iktar dewmien l-istrateġija nazzjonali dwar it-trasport li teżiġi li jonqsu l-karozzi mit-toroq tagħna, primarjament għax m’għandniex bżonn din il-kwantità ta’ karozzi. Għandna bżonn investiment ikbar fit-trasport pubbliku, inkluż transport pubbliku reġjonali u lokali għax dan iservi biex inaqqas l-użu ta’ karozzi privati fit-toroq tagħna għal distanzi qosra. Irridu nirrealizzaw li 50% tal-vjaġġi li jsiru bil-karozzi privati fit-toroq Maltin isiru għal distanzi qosra li jdumu inqas minn 15-il minuta.

Fuq kollox hemm bżonn ta’ investiment ikbar fl-infrastruttura lokali, iffukata fuq il-ħtieġa li niffaċilitaw dejjem iktar l-aċċessibilità għal in jagħżel li jimxi inkella li jsuq ir-rota.

Il-kwalità tal-ambjent urban jirrifletti l-kwalità tal-ħajja tagħna. Jeffettwa l-arja tant essenzjali biex ngħixu. Jeffettwa l-ispazji pubbliċi tant essenzjali biex bħala l-pulmun tal-lokalitajiet tagħna jagħtuna in-nifs u l-ispazju fejn ngħixu.

Il-karozzi ħadulna t-toroq. In-negożji ħadulna l-bankini. Irriduhom lura. Dawn huma essenzjali għall-ħajja urbana. Huma l-ispazji pubbliċi bażiċi li flimkien mal-pjazez tagħna jimmarkaw lill-komunitajiet tagħna.

Neħtieġu toroq u bankini li jkunu aċċessibli għal kulħadd. Il-Kunsilli Lokali, għandhom ikunu fuq quddiem biex iħeġġu lill-gvern sabiex mis-€700 miljun li qed jipproġetta bħala nefqa biex jirranġa t-toroq, jitbiddlu ukoll il-bankini. Ħafna minnhom saru biex jaġevolaw il-karozzi fil-garaxxijiet bil-konsegwenza li diversi bankini spiċċaw tlajja u nżul kontinwi b’detriment għal min huwa vulnerabbli. Bl-istess mod, il-Kunsilli Lokali għandhom jaraw li l-bankini ikunu ħielsa minn ostakli li ħafna drabi iġiegħlu lir-residenti, partikolarment dawk l-iktar vulnerabbli jimxu fin-nofs tat-triq.

Għal kunsilliera f’isem Alternattiva Demokratika, din hija kwistjoni prijoritarja ta′ aċċessibilità għar-residenti kollha.

Irridu nsellmu lill-dawk il-kunsilliera kollha li tul is-snin ħarġu għonqhom b’konvinzjoni kbira biex inħarsu l-wirt storiku u l-wirt ekoliġiku ta’pajjiżna. Mhux xogħol faċli. Ħidma li f’Alternattiva Demokratika nagħmluha bla waqfien. Uħud mill-proġetti l-kbar li huma fuq l-aġenda tal-pajjiż għax-xhur u s-snin li ġejjin huma ta’ ħsara kbira. M’għandix f’moħħi biss il-mina bejn Malta u Għawdex li barra li mhiex meħtieġa ser tagħmel ħsara mhux biss lill-Għawdex fit-totalità tiegħu imma ukoll lill-agrikultura madwar in-Nadur f’ Ta’ Kenuna kif ukoll lill-Wied tal-Pwales u z-zona tal-Għerien fil-limiti tal-Mellieħa. Iktar kmieni din il-ġimgħa ippreżentajna oġġezzjini għall-bini tat-torri tat-Toyota f’Ħaż-Żebbuġ li qed ifittex li joħloq mostru ta’ 14-il sular, 11 minnhom il-fuq mit-triq f’zona li ser ikollha impatti kbar fuq ir-residenti ta’ Ħaż-Żebbuġ.

Aħna qegħdin hawn biex inservu. Ilkoll.

Qed noffru mill-ġdid is-servizz tagħna fil-Parlament Ewropew u fil-Kunsilli Lokali. Hi ħidma li ser tkun imsejsa fuq il-valuri bażiċi li fuqhom hi mibnija l-ħidma ħadra: l-għarfien ekoloġiku, il-ġustizzja soċjali, id-demokrazija parteċipattiva, n-non-vjolenza, s-sostenibilità u r-rispett lejn id-diversità.

Qegħdin nippreżentaw Manifest li jiftaħ il-bibien u t-twieqi għal żiffa li tnaddaf, għal diskussjoni li tfittex risposti għall-mistoqsijiet u teżamina s-soluzzjonijiet possibli. Irridu b’mod kontinwu nisfidaw l-istatus quo u f’dan il-proċess inneħħu l-għanqbut li hemm f’diversi irkejjen mhux biss f’Malta imma ukoll fi Brussell.

Il-politika ħadra tfisser li ma tibża’ tiddiskuti xejn.

Jekk inti tfittex u tistaqsi kif il-kwalità tal-ħajja tagħna lkoll tista′ tkun aħjar, kif għandha tonqos u eventwalment tkun eliminata l-emarġinazzjoni, kif tissaħħaħ id-demokrazija, m’għandekx wisq minn fejn tagħżel.

Pajjiżna ma jistax jibqa’ b’rasu fir-ramel: għalhekk l-aħdar hu r-risposta għall-mistoqsijiet tiegħek.

Alternattiva Demokratika hi l-unika garanzija li leħen kulħadd jinstema’ .

 

Il-Manifest Elettorali issibu hawn

L-istupru tas-Saqqajja

Nitkellmu dwar it-Telgħa tas-Saqqajja. Imma jidher li s-Saqqajja għan-niżla!

L-applikazzjoni ta’ żvilupp biex żewġt idjar qodma fuq is-Saqqajja r-Rabat ikunu mibdula f’lukanda żgħira (boutique hotel) hu attentat ieħor biex ikun sfrakassat il-wirt storiku tal-pajjiż. Il-fillera sħiħa ta’ djar fuq is-Saqqajja flok ma jitħallew jinqerdu minn dak li wħud isejħulu żvilupp għandhom jingħataw protezzjoni fit-totalità tagħhom. Kif ippropona l-Professur Mario Buhagiar dawn id-djar fuq is- Saqqajja , tal-inqas, jistħoqilhom protezzjoni fi Grade 2, jiġifieri li l-faċċata tagħhom ma tkunx tista’ tintmiss. Possibilment jistħoqilhom iktar minn hekk ukoll: li jkunu mħarsa b’mod komplet fi Grad 1.  

 L-applikazzjoni għal żvilupp bin-numru 9516/18 tipproponi li d-djar 14 u 15 fuq Is-Saqqajja Rabat (b’faċċata ukoll fuq Vjal Santu Wistin) jinbidlu f’lukanda fi klassi 3B . Minn eżami tal-pjanti sottomessi jidher ċar li l-proposta tinkludi ż-żieda ta’ żewġ sulari fuq il-binja eżistenti kif ukoll il-mutilazzjoni tal-partijiet interni ta’ dawn iż-żewġt idjar biex ikunu jistgħu jkunu mibdula f’lukanda żgħira.

Bħal bosta oħrajn jiena ukoll ippreżentajt oġġezzjoni għal dan l-aħħar attakk fuq il-wirt tagħna lkoll. Ir-raġunijiet għal dan huma diversi.

L-ikbar raġuni hi li l-iżvilupp propost jistona fil-kuntest li hu propost li jsir.  Ser jeqred darba għal dejjem l-omoġenejità u l-armonija tal-faċċati tal-bini kemm fuq is-Saqqajja kif ukoll fuq Vjal Santu Wistin. Fuq Vjal Santu Wistin  l-iżviluppatur irid iħarbat parti kbira mill-ġnien li jagħti karattru uniku u hu parti integrali mill-binja. Hi l-binja kollha, kif inhi, bil-ġnien kollu  li teħtieġ li tkun protetta.

Il-Pjan Lokali, li jqis liż-żona bħala waħda ta’ konservazzjoni urbana jillimita l-iżvilupp fiż-żona għal żewġ sulari. Il-proposta ta’ żvilupp tinjora din il-limitazzjoni kompletament. Huwa għaldaqstant ovvju li jekk din l-applikazzjoni tibqa’ għaddejja u tkun approvata ser twassal għall-qerda tal-filliera sħiħa tad-djar  fuq is-Saqqajja għax li jgħodd għal wieħed jgħodd għal kulħadd. Imbagħad  tkun ġiet stuprata ż-żona kollha.

Iżjed ‘l-isfel, fit-Telgħa tas-Saqqajja, fejn sa ftit ilu kien hemm it-Tattingers Club u xi propjetajiet oħra, il-ħerba tkompli.  Dan is-sit ukoll għandu mdendla miegħu proposta ta’ żvilupp: lukanda massiċċa ta’ 110 kmamar mifruxa fuq 5600 metru kwadru. Mhumiex l-uniċi applikazzjonijiet fl-inħawi għax hemm oħrajn. Iżda huma l-iktar li jagħtu fil-għajn. 

Jidher li waslet id-daqqa tar-Rabat li jrid jiffaċċja l-forza tal-qerda li tpoġġi l-flus qabel il-wirt komuni tagħna lkoll.

Il-mod kif ġiebet ruħha l-Awtorità tal-Ippjanar fil-passat ma tantx hu ta’ awgurju tajjeb li din b’xi mod kapaċi tieqaf lill-forzi tal-qerda. Permezz tad-deċiżjonijiet tagħha sal-lum, l-Awtorità tal-Ippjanar bagħatet messaġġ ċar li, fil-fehma tagħha, l-impatt ekonomiku tal-industrija tal-kostruzzjoni jixirqilha ferm iktar attenzjoni minn kwlaunkwe ħaġa oħra.  B’ġustizzja ngħid li hemm xi żewġ membri tal-Bord tal-Awtorità tal-Ippjanar li jispikkaw minħabba li b’differenza minn sħabhom jiddefendu regolarment kemm il-wirt storiku kif ukoll dak naturali. Imma dawn qegħdin f’minoranza assoluta, avolja xi kultant ġieli jappoġġawhom uħud mill-bqija.

Imma x’tistenna minn Bord tal-Awtorità tal-Ippjanar li l-membri tiegħu ma jħossuhomx skomdi madwar l-istess mejda ma’ agent tal-propjetà biex jgħaddu ġudizzju dwar liema applikazzjonijiet ta’ żvilupp jixirqilhom ikunu approvati u liema le?  

M’għandi l-ebda idea dwar x’deċiżjoni ser ikollna, imma fid-dawl ta’ kif ġiebet ruħha sal-lum l-Awtorità tal-Ippjanar xejn ma niskanta jekk tagħti l-approvazzjoni tagħha biex il-qerda tibda tiela’ t-Telgħa tas-Saqqajja.

The mutilation of Saqqajja

The planning application to convert two old town-houses at Saqqajja, Rabat into a boutique hotel is another attempt to mutilate our historical heritage. The whole row of town houses at Saqqajja, rather than being placed on the chopping board of so-called development should be protected in their totality. As proposed by Professor Mario Buhagiar, these Saqqajja town houses, as a minimum, deserve a Grade 2 protection, that is to say their elevation must be preserved in its entirety. Their protection should possibly be even more extensive: total protection at Grade 1.

Planning application 9516/18 proposes to change the use of residences at 14 and 15 Is-Saqqajja Rabat (with back elevations onto Vjal Santu Wistin) into a Class 3B hotel. Through an examination of the proposed drawings, it is clear that the proposal includes the addition of two new floors as well as an internal mutilation of the properties to render them usable as a boutique hotel.

I have joined countless others in submitting an objection to this latest assault on our historical heritage. The reasons for objecting are numerous.

The most obvious reason for objecting is that the proposed development is out of tune with its surroundings. It will ruin the homogenous eloquence of both the Saqqajja elevation as well as that of Vjal Santu Wistin on which elevation the developer is proposing to gobble up an extensive part of the existing garden that contributes to a unique setting which needs the maximum protection possible.

The Local Plan, defining the area as an Urban Conservation Area, limits any proposed development in the area to two floors. This limitation is blatantly disregarded by the proposal for this boutique hotel. If this application is not stopped in its tracks, it is inevitable that it will eventually lead to the complete mutilation of the whole row of Saqqajja town-houses, because what’s good for the goose is naturally good for the gander.

Further down the hill, on the site currently occupied by Tattingers Club and a number of adjoining properties, the mutilation exercise continues. This site has another development proposal for a massive 110-room hotel spread over an area of around 5600 square metres. There are other planning applications in the vicinity but the above two are the most conspicuous. It seems that the mutilation brigade has shifted their attention towards Rabat and its surroundings.

The past performance of the Planning Authority is not very reassuring as it does not seem capable of withstanding the pressures of the development lobby. The Planning Authority has, as a result of its past decisions, sent a clear message that it considers the economic activity of the building industry more worthy of its attention and protection than anything else. In all fairness, there are a couple of members on the Planning Authority Board who stand out because they continuously defend the national heritage and the natural environment. But they are unfortunately a very small minority even when, occasionally, they are supported by others.

What else do you expect from a Planning Authority Board whose members are not uncomfortable when they sit with an estate agent in judgement as to which applications for a development permit are approved or refused?

I have no idea what the decision will be, but, based on past performance it is not beyond the Planning Authority Board to give its approval to the massacre brigade marching up Saqqajja Hill.
