Is-sussidjarjetà fil-Kostituzzjoni

 

Nhar il-Ġimgħa delegazzjoni ta’ Alternattiva Demokratika iltaqgħet ma’ Silvio Parnis, Segretarju Parlamentari għall-Gvern Lokali, biex miegħu niddiskutu l-White Paper ippubblikata mill-Gvern dwar ir-riforma tal-kunsilli lokali.

Waqt id-diskussjoni għaddejna lil Silvio Parnis l-ideat tagħna dwar din il-White Paper. Għamilna tmien proposti b’dik ewlenija tiffoka dwar il-ħtieġa li jkun aċċettat u implimentat il-prinċipju tas-sussidjarjetà. Il-prinċipju tas-sussidjarjetà jeħtieġ li jifforma parti mill-kostituzzjoni biex iservi ta’ linja gwida għall-amminstrazzjoni pubblika tal-pajjiż u allura jħares b’qawwa l-ħidma tal-Gvern lokali u reġjonali.

It-trattati Ewropej diġa għamlu dan il-pass meta addottaw il-prinċipju tas-sussidjarjetà bħala prinċipju bażiku li jirregola r-relazzjonijiet kumplessi bejn l-istituzzjonijiet Ewropej u l-istati membri tal-Unjoni Ewropeja.

Il-prinċipju tas-sussidjarjetà hu l-iktar żviluppat fl-istati hekk imsejħa Ġermaniċi tal-Ewropa u ċjoè l-Ġermanja, l-Awstrija u l-Iżvizzera, liema pajjiżi għandhom qafas ta’ Gvern lokali u reġjonali b’saħħtu u bħala riżultat ta’ dan ir-responsabbiltajiet u l-poteri huma mifruxa.

L-amministrazzjoni pubblika teħtieġ li tkun l-iktar viċin possibli taċ-ċittadin: min jamministra u jiddeċiedi għandu jkun l-iktar qrib possibli ta’ min hu effettwat mid-deċiżjonijiet. L-eċċezzjonijiet għandhom ikunu rari u altru milli ġustifikati. Jacques Delors, li kien President tal-Kummissjoni Ewropeja, hu ikkwota li qal li : is-sussidjarjetà ma tillimitax biss l-intervent ta’ l-ogħla awtorità f’dak li kull persuna jew komunità tista’ tiddeċiedi hi innifisha, imma hi ukoll dover ta’ din l-istess awtorità biex taġixxi b’mod li lil din il-persuna jew komunità tgħinhom biex iwettqu l-ħolm tagħhom.”

Dan jitfa dawl fuq żewġ aspetti tas-sussidjarjetà. L-ewwel li ħlief f’każijiet eċċezzjonali l-ogħla awtorità ma jindaħalx fejn ma jesgħahiex fil-ħidma ta’ awtoritajiet oħra taħtha. It-tieni : l-obbligu li tgħin biex tinkoraġixxi l-kisba tal-awtonomija.

Alternattiva Demokratika qed tipproponi li l-prinċipju tas-sussidjarjetà jkun aċċettat bħala prinċipju kostituzzjonali li jagħti gwida lill-amministrazzjoni pubblika u dan bħala l-ewwel pass għat-twettieq ta’ proposta radikali oħra: id-diċentralizzazzjoni tal-ħidma operattiva tal-amministrazzjoni pubblika lill-awtoritajiet lokali u reġjonali, bil-Gvern iżomm f’idejh il-funzjonijiet regolatorji. Dan jista’ faċilment jitwettaq fuq il-mudell ta’ Għawdex bid-differenza li jitmexxew minn politiku reġjonali flok minn politiku nazzjonali.

Id-dokument bil-proposti ppubblikat minn Alternattiva Demokratika jittratta diversi temi oħrajn bħalissa ċentrali fid-dibattitu dwar ir-riforma proposta tal-gvern lokali u reġjonali.

Is-servizz ta’ kull kunsillier lokali għandu jkun apprezzat, mhux biss is-servizz li jagħti s-Sindku! Il-proposta li l-uffiċċju tas-Sindku jkun wieħed full-time ma hemmx ħtieġa tagħha. Hemm diversi raġunijiet għal dan. Bħala riżultat ta’ din il-proposta dawk kollha li ma jistgħux jieqfu mill-impieg normali tagħhom ikunu esklużi milli joffru s-servizz tagħhom fil-kariga ta’ Sindku. Dan billi tali proposta teffettwa b’mod qawwi l-possibilità li huma jirrintegraw ruħhom fl-impieg meta jintemmilhom il-perjodu tal-ħatra tagħhom. Bla dubju jinħolqu ukoll kunflitti bla bżonn mas-Segretarju Eżekuttiv li l-liġi illum tikkunsidrah bħala l-uffiċjal amministrattiv ewlieni tal-kunsill lokali.

Flok ma tiffoka fuq is-Sindku r-riforma għandha tinkoraġixxi iktar il-ħidma kolleġjali fil-lokalitajiet tagħna b’mod li twassal għal sehem iktar attiv ta’ kull kunsillier fit-tmexxija tal-lokalitajiet. Il-proposta li qed jagħmel il-Gvern li kull kunsillier jingħata responsabbiltajiet hi tajba. Saret diġa minn Alternattiva Demokratika fil-konsultazzjoni pubblika dwar il-kunsilli lokali li saret fl-2008. Waħedha imma mhiex biżżejjed. Trid tkun segwita minn pass ieħor: li kull kunsillier jingħata onorarju raġjonevoli. Din m’għandiex tkun materja riżervata għas-Sindku.

Il-prinċipju tas-sussidjarjetà għandu japplika ukoll biex materji ambjentali jkunu regolati minn dawk li l-iktar jeffettwawhom mill-viċin. Li jkunu nvoluti sewwa l-kunsilli lokali u reġjonali f’dawn id-deċiżjonijiet għandu jwassal għal deċiżjonijiet aħjar minn dawk li għandna illum. Imma dwar dan, darb’oħra.

Il-konsultazzjoni pubblika dwar ir-riforma tal-gvern lokali u reġjonali issa ġiet fit-tmiem. Nistennew il-posizzjoni li ser jieħu l-Gvern dwar in-numru mhux żgħir ta’ proposti li saru. Nittama li jittieħdu bis-serjetà.

Subsidiarity in the Constitution

 

On Friday, a delegation from Alternattiva Demokratika met Parliamentary Secretary for Local Government Silvio Parnis to discuss the White Paper published by the government concerning the reform of local government.

During the discussion, we handed Mr Silvio Parnis our response to the White Paper, a response that contains eight proposals – the central one focusing on the need to accept and implement the principle of subsidiarity. The principle of subsidiarity needs to be constitutionally entrenched in order to serve as a guiding light to the country’s public administration and, consequently, protect local and regional government.

The European treaties have already entrenched the principle of subsidiarity as a basic tenet, regulating the complex relationship between European institutions and EU member states.

The principle of subsidiarity, mostly developed in the so-called Germanic states in Europe- namely Germany, Austria and Switzerland – which states have a robust local and regional arrangement, as a result of which responsibilities and the corresponding authority is spread.

Public administration should be as close to the citizen as possible: those administering and making decisions should be as close as possible to those who feel the impact of such decisions. Departure from this basic rule should only occur for reasons of absolute necessity. Former President of the European Commission Jacques Delors is quoted as having stated that subsidiarity is not only a limit on the intervention of a higher authority in the affairs of a person or community that can act itself, it is also a duty of this authority to act in relation to that person or community in such a way as to give it the means to fulfil itself.

This brings to the fore two aspects of subsidiarity. Firstly, that of non-interference by the higher authority in the workings of the lower authority, except in exceptional cases and, secondly, the duty to help – that is help that encourages autonomy.

Alternattiva Demokratika is proposing that the principle of subsidiarity be accepted as a guiding constitutional principle for the public administration as a first step to implementing another radical proposal: the decentralisation of the operational functions of public administration to the regions and local authorities with government retaining the regulatory functions. This can be easily carried out on the Gozo model, although with a regional elected politician replacing the current national politician in charge.

The document published by Alternattiva Demokratika deals with various other matters currently being debated as part of the proposed local and regional government reform.

The service of all elected local councillors should be appreciated, not just that rendered by the Mayor! The proposal to transform the office of Mayor in our localities into a full-time role is uncalled for and a number of reasons come to mind. It would automatically exclude all those who cannot take a sabbatical from their employment as it would have a long-term negative effect on their ability to adequately reintegrate when their mayoral term of office comes to an end. It would also create unnecessary conflict with the Executive Secretary, currently defined by the Local Council legislation as the chief executive of Local Councils.

Instead of singling out the Mayor, the local council reform should encourage a more collegial leadership, with all councillors being more actively involved in the running of the localities. The proposal in the White Paper to codify the duty to assign responsibilities to each elected councillor – a proposal first made by Alternattiva Demokratika and highlighted during the public consultation of 2008 on local council reform, is a good first step. It has to be followed by ensuring that all councillors receive a reasonable honorarium: this should not be a reserved for the Mayor alone.

The principle of subsidiarity should also be applied to regulating environmental issues closer to base. Involving regional and local councils in these decisions could lead to much better decisions than those we currently face. But more about that next time.

The public consultation has now been concluded. We await the reaction of the government to the large number of proposals made. Hopefully, these proposals will be seriously considered.

Avukati, pulizija u l-kriminali ta’ wara l-iskrivanija

 

Naħseb li hu ċar għal kulħadd li xi avukati huma familjari ftit iżżejjed ma’ kriminali li hawn jiġru mas-saqajn. Dan kien wieħed mit-temi li Daphne Caruana Galizia analizzat fil-blog tagħha tul is-snin. L-imġieba tagħhom kienet taħt il-lenti tagħha: lenti li tifli b’reqqa.

Dak li qed jingħad bħalissa dwar Chris Cardona, avukat u Ministru, jagħmel ħafna sens f’dan il-kuntest. Nifhem li hu jiċħad b’qawwa l-konklużjonijiet loġiċi ta’ dak li qiegħed jingħad. L-istess bħalma ċaħad l-istejjer dwar żjara fil-burdell FKK Acapulco fil-lokal ta’ Verbert ħdejn Düsseldorf fil-Ġermanja. Hekk kif waslet is-siegħa tal-prova dwar fejn kien skond kif jirriżulta mill-informazzjoni li kien jittrasmetti l-mobile tiegħu, il-kawżi ta’ libell waqfu, u l-provi ma nstemgħux.

Ovvjament kulħadd għandu dritt jasal għall-konklużjonijiet tiegħu. Jiena bħal ħafna oħrajn ikkonkludejt li ċ-ċahdiet ta’ Chris Cardona ma tistax teħodhom bis-serjetá. Din hi materja gravi ħafna, għax Chris Cardona mhux biċċa avukat, imma Deputat Mexxej tal-Partit Laburista u Ministru. Bħala Maltin għandna d-dritt li l-Ministri u l-uffiċjali tal-partiti politiċi jkunu persuni serji u ta’ integritá, li ma twaqqawlniex wiċċna l-art.

Diversi qed jinsistu li hemm bżonn inkjesta speċjali dwar il-qtil ta’ Daphne Caruana Galizia. Il-Gvern ħa l-posizzjoni li dwar jekk hemmx din il-ħtieġa jiddeċiedi iktar tard wara l-konklużjoni tal-inkjesta maġisterjali. Joseph Muscat qed jgħid li jekk ma jsirx hekk l-inkjesta maġisterjali tista’ tkun preġudikata.

Ma naqbilx ma dak li qed jgħid Joseph Muscat għax l-iskop taż-żewġ inkjesti hu differenti. Kif kien ġara dwar l-inċident tax-xufier/pulizija li kellu Manwel Mallia, dakinnhar Ministru għall-Intern. Dakinnhar kien hemm żewġ inkjesti għaddejjin flimkien u safejn naf jien l-ebda waħda mill-inkjesti ma kienet ta’ xkiel għall-inkjesta l-oħra.

L-inkjesta speċjali hi meħtieġa dwar il-kollass tal-istituzzjonijiet nazzjonali u l-kontribut ta’ dan il-kollass biex żviluppat is-sitwazzjoni attwali. Hemm bżonn ukoll spjegazzjoni li tagħmel sens għaliex il-maġistrat li kien qiegħed jinvestiga l-qtil ta’ Daphne ingħata promozzjoni fl-iktar mument kritiku għall-inkjesta kif ukoll jekk hux veru li kellu jiffaċċja ostakli kbar fil-ħidma tiegħu.

Għax uħud mill-kriminali li hawn jiġru mas-saqajn jista’ jkun li huma liebsin il-ġlekk u l-ingravata u qegħdin wara l-iskrivanija.

Luigi Di Maio’s threat

US President Donald Trump, over breakfast with NATO Secretary General Jens Stoltenberg, unleashed a blistering criticism of Angela Merkel’s government for being too supportive of Russia’s natural gas pipeline, which provides natural gas to various European states. Germany is too dependent on Russian natural gas, said Donald Trump. Is it appropriate for Angela Merkel’s Germany to do away with energy sovereignty and security in this manner? Being too dependent on Putin’s Russia is not on, he suggested.

Malta also may have its energy sovereignty and security hanging by a string.

Only last month we were reminded by Italian Deputy Prime Minister, Luigi di Maio that Malta’s electricity interconnector supply is plugged in at Ragusa on the Sicilian mainland. The comment was made in the context of the savage debate that developed over the rescue operations involving drowning immigrants picked up from the Mediterranean Sea by NGO operated sea vessels.

The Cinque Stelle politician considered it appropriate to use the Ragusa plug-in for political leverage in the same manner that Vladimir Putin makes use of his Russian gas supply, in relation not just to Angela Merkel’s Germany, but to most of the European mainland.

The fact that Malta is at times too dependent on the Ragusa electricity supply makes matters worse. We have undoubtedly lost count over the last months regarding the number of times we have been subjected to an electricity black-out in Malta: the standard explanation being that there was some technical hitch on either side of the Sicilian Channel which was being taken care of.

Malta will shortly have another Sicilian plug-in, this time a gas pipeline most probably at Gela.

Like the electricity interconnector plugged in at Ragusa the gas-pipeline plugged in at Gela will be another commercial undertaking. Malta will be paying for its gas, just as much as it is paying for its electricity.

Luigi Di Maio’s thinly veiled threat was obviously that the existing electricity plug-in at Ragusa was there at the Italian government’s pleasure which could reverse any commitment entered into so far if the Maltese government persists in irritating it.

It is not known whether there was any follow-up to Di Maio’s declaration, accept that the Maltese government closed all ports to NGO-operated vessels and that criminal proceedings were initiated against the MV Lifeline captain on flimsy sea-vessel registration charges.

This is unfortunately in-line with the Di Maio/Salvini philosophy that good Samaritans have to be treated suspiciously.

At the time of writing, another sea vessel with 450 migrants on board is sailing through Malta’s search and rescue area towards Sicily with Matteo Salvini, Minister for the Interior, insisting that Italy’s ports are closed for such vessels.

What next?

Potentially, as a result of the closure of Maltese and Italian ports, this is another developing tragedy. Di Maio’s veiled threat, maybe, has been taken seriously by the Maltese government.

Such incidents send one clear message: the foundations of solidarity as a value have heavily eroded. It has been transformed into a slogan. Solidarity is one of the basic values of the European Union – it is not limited to the EU’s border states. Successive Maltese governments have tried to nudge other EU member states to shoulder this collective responsibility which is currently shouldered disproportionately by the border states. The response from nine members states when the MV Lifeline debacle came to the fore was encouraging, but it is certainly not enough.

Faced with racist and xenophobic overreactions, opting for solidarity is not an easy choice. It would be certainly helpful if more EU states put solidarity into practice. The problem is that not all of them are convinced that this is the only ethical way forward.

L-għassies taċ-ċimiterju

Malta, bir-raġun kollu, akkużat lill-Italja li kisret id-dritt internazzjonali meta iddikjarat li l-port ta’ Lampedusa kien magħluq għall-vapuri tal-għaqdiet mhux governattivi li kienu fuq missjoni ta’ salvataġġ fiċ-ċentru tal-Mediterran. Wara li faqqgħet l-istorja ta’ MV Lifeline, Malta, imbagħad, għamlet l-istess billi għalqet il-portijiet kollha għal dawn l-għaqdiet. Matteo Salvini, il-bully ta’ ħdejna, pubblikament sforza lill-Gvern Malti biex jaddotta l-valuri tiegħu: valuri li jinjoraw id-dinjitá tal-bniedem.

Ġejna ibbumardjati mill-aħbarijiet li l-Kunsill Ewropew kien jaqbel mal-posizzjoni ta’ Malta dwar l-immigrazzjoni. Imma l-qbil tal-Kunsill kien li l-prattika tas-solidarjetá fil-qasam tal-immigrazzjoni kellha tkun fuq bażi volontarja. Ma hemm xejn ġdid f’dan. Ilna nafu b’din il-posizzjoni żmien: sa minn meta Lawrence Gonzi kien għadu jokkupa l-Berġa ta’ Kastilja!

Il-Prim Ministru ta’ Malta Joseph Muscat issa huwa qrib fil-ħsieb mal-Prim Ministru Ungeriż Viktor Orban, il-Kanċellier Awstrijakk Sebastian Kurst u l-Prim Ministru pupazz tal-Italja Giuseppe Conte, li magħhom dal-waqt tingħaqad il-Kanċellier Ġermaniża Angela Merkel, li kellha ċċedi għat-talbiet ta’ Horst Seehofer, mis-CSU, Ministru tal-Intern fil-koalizzjoni tagħha. Ilkoll kemm huma “jittolleraw” is-solidarjetá, sakemm din tkun prattikata minn ħaddieħor.

Nifhem il-ħtiega għat-tejatrin li ħass Muscat biex iċaqlaq lil diversi pajjiżi ħalli jipparteċipaw biex joffru it-tama lill-immigranti fuq MV Lifeline, avolja l-234 persuna umana abbord bagħtew tul l-istennija f’nofs il-Baħar Mediterran, sakemm disa’ stati ddeċidew li kellhom jerfgħu r-responsabbiltajiet tagħhom.

Imma dan kollu kien segwit mill-azzjoni kriminali kontra l-kaptan tal-vapur MV Lifeline, il-ħaruf tas-sagrifiċċju fuq l-artal tal-populiżmu, kif prattikat minn Joseph Muscat. Għax donnu kien meħtieġ għal Joseph Muscat li jinnewtralizza l-azzjoni tajba li għamel meta aċċetta li l-MV Lifeline jorbot mal-moll tal-Isla.

Dawk li jissugraw ħajjithom biex isalvaw dik ta’ oħrajn jispiċċaw jaqilgħu fuq rashom. L-ordni biex il-vapuri f’idejn l-għaqdiet mhux governattivi ma jbaħħrux fl-ibħra ta’ salvataġġ responsabbiltá ta’ Malta, anke jekk taparsi hi ordni temporanja, tagħti l-mano libera lill-gwardja tal-kosta Libjana biex “twettaq dmirha” u tassigura li dawk li jitilqu mil-Libja ikollhom għażla bejn żewġ destinazzjonijiet : iċ-ċentri ta’ detenzjoni Libjani inkella qiegħ il-baħar.

Biex jassigura li l-mewt bl-għarqa tkun l-unika għażla realistika il-Gvern Malti issa ipprojibixxa ukoll li ajruplani għat-tiftix u is-salvataġġ operati mill-għaqdiet mhux governattivi Sea Watch u Swiss Humanitarian Pilots Initiative jitwaqqfu immedjatament. Dan wara li diġa wasslu biex ġew salvati madwar 20,000 persuna umana.

Il-mistoqsija inevitabbli hi: dan kollu għaliex?

Is-soċjoloġi Ungeriżi Vera Messing u Bence Ságvári fl-istudju tagħhom intitolat Looking behind the Culture of Fear. Cross-national analysis of attitudes towards migration. li kien ippubblikat bl-għajnuna tal-Fondazzjoni soċjaldemokratika Ġermaniza Friedrich Ebert Stiftung u l-European Social Survey, f’Marzu li għadda, jistħarreġ tweġiba għal din il-mistoqsija.

“L-attitudni kontra l-immigranti, ftit li xejn għandha x’taqsam mal-immigranti”, ikkonkludew Messing u Ságvári. “Dawk f’pajjiżi b’livell għoli ta’ fiduċja fl-istituzzjonijiet, ftit li xejn korruzzjoni, ekonomija stabbli u li taħdem tajjeb, livell għoli ta’ koeżjoni u inklużjoni soċjali (inkluż tal-immigranti) jibżgħu l-inqas mill-immigrazzjoni” jinnotaw l-awturi. Min-naħa l-oħra jibżgħu dawk li “qegħdin f’pajjiżi fejn in-nies ma tafdax, la lil xulxin u l-anqas l-istituzzjonijiet tal-istat u fejn il-koeżjoni soċjali u s-solidarjetá huma dgħajfa.”

Hi tabilħaqq sfortuna li l-familji politiċi ewlenin ġew kontaminati minn din il-kultura tal-biża’ u b’hekk irrendew ruħhom ostaġġi tal-bulijiet li hawn madwarna.

Il-posizzjoni ġejografika ta’ Malta ma tinbidilx: mhiex negozjabbli. Flok ma niġu mbeżża’ biex b’mod passiv nagħmluha tal-għassiesa taċ-ċimiterju li qed jiżviluppa madwarna nistgħu inkunu proattivi u nfittxu li ninkoraġixxu oħrajn biex jingħaqdu magħna biex inkunu l-port tat-tama fiċ-ċentru tal-Mediterran. Dik dejjem kienet il-missjoni tagħna tant li wieħed mill-isbaħ ċertifikati li għandu pajjiżna huwa dak iffirmat minn San Luqa fl-Atti tal-Appostli meta huwa u jiddeskrivi n-nawfraġju ta’ San Pawl jgħid li l-Maltin “ġiebu ruħhom magħna bi ħlewwa liema bħalha. Laqgħuna tajjeb lilna lkoll ……..”

Sfortunatament l-egħluq tal-portijiet tagħna għall-vapuri operati mill-għaqdiet mhux governattivi fuq missjoni ta’ salvataġġ (wara l-eċċezzjoni tal-MV Lifeline) tindika li Joseph Muscat, imniġġeż kif inhu minn Matteo Salvini, abbanduna kull tama u minflok għażel ir-rwol ta’ għassies taċ-ċimiterju.

The cemetery watchman

Malta rightly accused Italy of being in breach of international law when it closed the Lampedusa port to NGO vessels on rescue missions in the central Mediterranean. In the aftermath of the MV Lifeline debacle, Malta then proceeded to follow suit by closing all Maltese ports to NGO vessels. Matteo Salvini, the bully next door, has publicly pressured Malta’s government to submit to his values: those same values which ignore human dignity.

We have been bombarded with the news that the EU Council of Ministers has agreed to, and endorsed, Malta’s position on migration. This is not correct as the EU Council of Ministers only reiterated that, at most, they would consider solidarity as being only voluntary in nature. There is nothing new in such a statement. We have known about it for ages: since the days when Lawrence Gonzi was the tenant at Auberge de Castille!

Malta’s Prime Minister Joseph Muscat, is now almost on the same wavelength as Hungary’s Prime Minister Viktor Orban, Austrian Chancellor Sebastian Kurst, and Italy’s puppet Prime Minister Giuseppe Conte, soon to be joined by German Chancellor Angela Merkel, forced into submission by her CSU coalition partner Interior Minister Horst Seehofer. All of them “tolerate” solidarity, as long as it is only practised by others.

The theatrics resorted to by Muscat to ensure an adequate participation in offering hope to the immigrants on board MV Lifeline were understandable, even though the 234 human beings on board suffered for long days in the middle of the Mediterranean Sea until nine states made up their mind to shoulder their responsibilities.

This was, however, followed by criminal action initiated against the captain of MV Lifeline as the sacrificial lamb on Joseph Muscat’s altar to populism. It seemed that Joseph Muscat had to counter-balance his good deed, when he permitted MV Lifeline to dock at the Senglea wharf.

Those who continuously risk their lives in trying to save the life of others end up at the wrong end of the stick. The order that NGO sea-going vessels do not navigate through the rescue area under Malta’s responsibility, even if falsely camouflaged as a temporary measure, gave a free hand to the Libyan coastguard to “carry out its duty”, that is to ensure that those who try to leave Libya have only two possible destinations: Libyan detention centres or the seabed.

To ensure that death by drowning is the only practical choice, the Maltese government has now also stopped the search and rescue aircraft operated by NGO Sea Watch and the Swiss Humanitarian Pilots Initiative. The aircraft has been involved in the rescue of 20,000 human beings.

The inevitable question is : Why is it happening? Hungarian sociologists Vera Messing and Bence Ságvári in their study entitled Looking behind the Culture of Fear. Cross-national analysis of attitudes towards migration. which was published under the auspices of the German social democratic foundation Friedrich Ebert Stiftung and the European Social Survey, last March, sought an answer to this question.

“Anti-migrant attitudes have little to do with migrants”, concluded Messing and Ságvári. “People in countries… with a high level of general and institutional trust, low level of corruption, a stable, well-performing economy and high level of social cohesion and inclusion (including migrants) fear migration the least,” the authors note. On the other hand: “People are fearful in countries where people don’t trust each other or the state’s institutions, and where social cohesion and solidarity are weak.”

It is indeed unfortunate that the major political families have been contaminated by this culture of fear, thereby rendering themselves hostages to the bullies around us, as a result promoting a culture of death.

Malta’s geographic position is a given: it is non-negotiable. Instead of being bullied to passively supervise the cemetery developing around us, we can be proactive and encourage others to join us in being a port of hope in the centre of the Mediterranean. That has always been our mission, to the extent that one of the best descriptions of Maltese hospitality is the one attested to by St Luke in the Acts of the Apostles when describing St Paul’s shipwreck: “the natives showed us unusual kindness for they kindled a fire and welcomed us all”.

Unfortunately, closing our ports to NGO-operated vessels on rescue missions (after the one-off MV Lifeline debacle) indicates that Joseph Muscat, prodded by Matteo Salvini, has discarded hope and has instead opted for the role of a cemetery watchman.

L-Awtoritá tal-Ippjanar tinkoraġixxi l-ispekulazzjoni tal-art

L-Awtoritá tal-Ippjanar qed toħroġ il-permessi ta’ żvilupp għall-pompi tal-petrol u d-dijsil ħierġin bħall-pastizzi.

Xi xhur ilu, f’diskors li għamel il-Prim Ministru kien qal li l-Gvern immexxi minnu jaqbel li karozzi li jaħdmu bil-petrol jew bid-dijsil għandhom jispiċċaw mit-toroq Maltin. Nhar l-10 ta’ Settembru 2017 Joseph Muscat kien ħabbar li l-Gvern kien fi ħsiebu li “dal-waqt” jagħti bidu għal konsultazzjoni pubblika biex ikun stabilit meta u kif għandha tkun implimentata din il-politika li bħala riżultat tagħha jkunu jistgħu jinxtraw biss karozzi li jaħdmu bl-elettriku jew karozzi simili.

Għaddew seba’ xhur u għadna qed nistennew li jibda dan il-proċess ta’ konsultazzjoni pubblika. Sadanittant, aħna u nistennew, l-ispekulaturi tal-art, bl-għajnuna tal-Awtoritá tal-Ippjanar għaddejjin xalata: jippjanaw kif jirrovinaw iktar raba’, 3000 metru kwadru kull darba, u dan biex jibnu pompi li ftit ieħor mhux ser ikollna bżonn. Imbagħad x’nagħmlu bl-art li tkun diġa ġiet rovinata?

Alternattiva Demokratika taqbel li m’għandniex ħtieġa ta’ karozzi li jaħdmu bil-petrol u d-dijsil fit-toroq tagħna. Fil-fatt kienet Alternattiva Demokratika, bil-ħsieb li tintlaħaq il-mira strateġika ta’ Karbonju Żero fil-gżejjer Maltin li fil-Manifest Elettorali ta’ l-aħħar elezzjoni ġenerali poġġiet quddiem l-elettorat din il-proposta speċifika: li fi żmien 20 sena, ċjoe sal-2037, għandhom jispiċċaw il-karozzi kollha li jaħdmu bil-petrol u d-dijsil mit-toroq Maltin. Alternattiva Demokratika kienet l-uniku partit politiku f’Malta li kien ċar fuq dan f’Malta sa minn qabel l-elezzjoni ġenerali.

Id-dikjarazzjoni tal-Prim Ministru tal-10 ta’ Settembru 2017 kellha twassal għall-konklużjoni loġika li m’għandniex bżonn ta’ iktar pompi tal-petrol u d-dijsil. Kien ikun floku kieku tħabbar moratorju immedjat. Fil-fatt messna qegħdin ngħoddu l-ġranet li neħilsu darba għal dejjem mill-karozzi li jaħdmu bil-petrol u d-dijsil. Bħala riżultat ta’ dan messu hu ovvju li fil-futur qarib m’hu ser ikollna bżonn l-ebda pompa tal-petrol jew dijsil: dawn għandhom jonqsu mit-80 li għandna illum sa xejn u dan meta tkun implimentata b’mod sħiħ il-politika mħabbra mill-Prim Ministru u li dwarha ilna 7 xhur nistennew il-konsultazzjoni pubblika.

M’għandniex bżonn ta’ pompi ġodda: imma għandna bżonn li jagħlqu l-pompi li ġja hawn mingħajr ma jinħolqu oħrajn flokhom. L-20 sena proposti minn Alternattiva Demokratika fil-manifest elettorali tal-2017 biex jispiċċaw mit-toroq Maltin karozzi li jaħdmu bil-petrol jew bid-dijsil kienu meqjusa raġjonevoli, suffiċjenti u fl-istess direzzjoni ta’ deċiżjonijiet politiċi simili li ittieħdu minn pajjiżi oħra. Dan hu żmien biżżejjed biex tkun żviluppata l-infrastruttura nazzjonali meħtieġa għall-karozzi li jaħdmu bl-elettriku. Hu ukoll biżżejjed biex dawk li għandhom dawn it-tip ta’ karozzi jibdew jidraw ftit l-iżvilupp ta’ din ir-realtá ġdida bla petrol jew dijsil.

Bosta pajjiżi oħra diġa ddeċidew, inkella qegħdin fil-proċess li jiddeċiedu li fit-toroq tagħhom ma jkollhomx iktar karozzi li jaħdmu bil-petrol jew bid-dijsil. Dawn jinkludu in-Norveġja u l-Olanda (it-tnejn sal-2025), il-Ġermanja (sal-2030), Franza, r-Renju l–Indja u ċ-Ċina (lkoll sal-2040). Ma jdumx ma jkun hemm oħrajn ukoll.
L-Awtoritá tal-Ippjanar qegħda tkompli tinjora dan l-iżvilupp importanti fil-politika tal-pajjiż billi tibqa’ għaddejja bl-applikazzjoni tal-politika imsejħa 2015 Fuel Service Stations Policy b’mod robotiku. Din il-politika dwar il-pompi tal-petrol u d-dijsil tippermetti qies massimu permissibli ta’ 3000 metru kwadru imma l-Awtoritá qatt ma qieset li kien neċessarju li tordna tnaqqis fil-qies tal-proposti li kellha quddiema. Għax kollha kellhom il-qies massimu ta’ 3000 metru kwadru. Bħala riżultat ta’ dan l-Awtoritá tal-Ippjanar flok għal pompi qed toħroġ permessi għal żoni massiċċi kummerċjali barra miż-żona tal-iżvilupp.

Din hi l-agħar forma ta’ spekulazzjoni tal-art u f’dan il-kaz it-tort hu unikament tal-Awtoritá tal-Ippjanar. L-Awtoritá tal-Ippjanar hi ta’ theddida għall-ġenerazzjonijiet futuri. Dan hu l-punt li għamlu ż-żgħażagħ mill-Moviment Graffiti u l-Kamp Emerġenza Ambjent meta nhar il-Ħamis ipprotestaw u ħarbtu laqgħa tal-Bord tal-Awtoritá tal-Ippjanar waqt li dan kien qiegħed jikkunsidra applikazzjoni għall-pompa ġdida tal-petrol u d-dijsil f’Ħal-Luqa.

Għandna Awtoritá tal-Ippjanar li hi ala bieba mill-ambjent u mill-kwalitá tal-ħajja. Bil-provi.

 

 

The Planning Authority encourages land speculation

Development permits for fuel stations are being approved left, right and centre by the Planning Authority.

Some months ago,  in a speech made in public, the Prime Minister said that the Government agrees that use of petrol and diesel cars should be phased out and that, in future, all cars should be electric. On the 10 September 2017, Joseph Muscat announced that government would “shortly” be launching a consultation on “setting a cut-off date beyond which all new car purchases would have to be electric or similar vehicles.”

Seven months have elapsed, and we are still waiting for the consultation exercise to be launched. And while we wait, land speculators (with the Planning Authority’s assistance) are in festive mood, plotting the ruin of 3000 square metres at a time to develop fuel stations that we will shortly not need any more. And what will be done with the spoiled land then?

Alternattiva Demokratika agrees with the proposal to establish a cut-off date for cars that run on petrol and diesel. Indeed in its manifesto at the last general election,  with a strategic zero carbon future for the Maltese Islands in mind, it put forward this specific proposal to the electorate: that internal combustion engine cars should be off our roads in 20 years time, that is by 2037. Alternattiva Demokratika was the only political party in Malta that took this clear stand before the general election.

In view of the Prime Minister’s declaration of the 10 September 2017, the logical conclusion is that new fuel stations are not required. An immediate moratorium would be in order and, in fact, we should be on the eve of the start of a countdown that would rid us of cars that run on petrol or diesel. Consequently, there will be no need for fuel stations in the not too distant future: reducing from the current 80 to none, when the phase-out – which is still subject to public consultation – is fully implemented.

We do not need new fuel stations: what we need is that existing fuel stations are closed down without their being replaced. The 20-year time-frame proposed by Alternattiva Demokratika in its 2017 electoral manifesto was considered to be reasonable, sufficient and in line with similar policy decisions taken in other countries. This time-frame was deemed sufficient to develop the required national infrastructure for electric-powered cars. It was also deemed to be a reasonable length of time to permit those who own vehicles running on internal combustion engines to adjust to the development of a new reality without petrol or diesel.

Various other countries have decided on – or are considering – the elimination of internal combustion engine driven vehicles from their roads. These include Norway and the Netherlands (both by 2025), Germany (by 2030), France, the United Kingdom, India and China (all by 2040). Others will soon follow.

The Planning Authority continues to ignore this policy development by applying the 2015 Fuel Service Stations Policy robotically. This policy establishes a maximum permissible size of 3000 square metres but the Authority did not consider it appropriate to scale down any of the proposals submitted for its consideration as all the approved stations cover the maximum size possible. As a result, the Planning Authority is churning out permits for massive commercial areas outside the development zone.

This is land speculation at its worst and the Planning Authority has no one to blame but itself and is a threat to future generations. This is the point made by the protestors from Graffiti and Kamp Emerġenza Ambjent last Thursday, when they stormed a Planning Authority Board meeting considering a development application for a new fuel station at Luqa.

We have a Planning Authority which doesn’t give two hoots about the environment and our quality of life.

L-Ippjanar rasu l-isfel

Nhar l-Erbgħa, l-Kumitat Parlamentari dwar l-Ambjent u l-Ippjanar beda d-diskussjoni dwar jekk għandux ikun hemm tibdil fil-politika dwar il-pompi tal-petrol (u d-disil) (Fuel Service Stations Policy) tal-Awtorità tal-Ippjanar. Bla dubju kien xprunat mid-deċiżjonijiet riċenti tal-istess awtorità dwar pompi tal-petrol f’f’Burmarrad, Marsaskala u l-Magħtab. Hemm applikazzjonijiet pendenti għal pompi ġodda f’Ħ’Attard, l-Imqabba u l-Iklin fil-waqt li hemm madwar 60 pompa oħra qed jistennew il-permessi mill-Awtorità tal-Ippjanar biex itejbu l-faċilitajiet inkluż protezzjoni ambjentali u dan minn total eżistenti ta’ 85 pompa.

Il-kummenti validi kienu bosta. Ikkonċentraw l-iktar fuq il-ħtieġa li l-pompi tal-petrol fiż-żona urbana jingħalqu u li dawn jiċċaqalqu xi mkien ieħor. Ftit iżda kien hemm ħeġġa biex tkun diskussa l-qalba tal-materja: xi bżonn għandna tal-pompi tal-petrol?

Madwar ħames xhur ilu, il-Prim Ministru, wara li għal darba oħra ħares ħarsa sewwa lejn il-Manifest Elettorali ta’ Alternattiva Demokratika tal-2017, ħabbar, li l-Gvern immexxi minnu kien ser jagħti bidu għal process ta’ konsultazzjoni pubblika. Dan biex jistabilixxi data minn meta karozzi li jaħdmu bil-petrol u d-disil ma jkunux jistgħu jinbiegħu iktar biex minflok ikollna karozzi li jaħdmu bl-elettriku. Ma smajna xejn iktar dwar dan ħlief artiklu miktub mill-Ministru tat-Trasport Ian Borg entużjażmat li fis-snin li ġejjin ser nimxu fuq il-passi ta’ pajjiżi Ewropej oħra.

Il-Prim Ministru, bir-raġun kollu emfasizza li din il-bidla fil-politika tal-Gvern kienet meħtieġa minħabba li l-emmissjonijiet tal-karozzi kienu l-ikbar sors ta’ tniġġiż tal-arja fil-pajjiż. Għalfejn dan id-dewmien kollu biex ikunu stabiliti u mħabbra d-dettalji ta’ din id-deċiżjoni tajba? Uħud mill-pajjiżi Ewropej ilhom żmien li għamlu dan. In-Norveġja u l-Olanda stabilew is-sena 2025, il-Ġermanja qed tikkonsidra s-sena 2030, fil-waqt li Franza u r-Renju Unit huma mħajra għas-sena 2040 biex iwaqqfu l-bejgħ ta’ karozzi li jaħdmu bil-petrol u d-disil.

Id-diskussjoni dwar il-politika li tikkonċerna l-pompi tal-petrol/disil għandha issir f’kuntest wiesgħa tal-politika tat-trasport inkluż l-elettrifikazzjoni tal-mezzi privati tat-trasport.

Il-punt ewlieni tad-diskussjoni huwa li bħala riżultat tal-elettrifikazzjoni n-numru ta’ pompi tal-petrol/disel meħtieġa mhux ser jiżdied imma ser jonqos fuq medda ta’ snin u dan sakemm jasal għal xejn jew kważi xejn. Allura għalfejn nibnu u ninkoraġixxu l-bini ta’ iktar pompi tal-petrol/disil? Ikun ferm iktar għaqli kieku l-investiment nindirizzawh lejn is-soluzzjoni tal-problemi, mhux lejn it-tkattir tagħhom!

Il-pompi tal-petrol eżistenti fiż-żoni urbani qed jintużaw bħala skuża biex jippruvaw jiġġustifikaw it-tħarbit ta’ 3000 metru kwadru ta’ art. Fil-fatt dan hu l-iskop ewlieni tal-politika dwar il-pompi tal-fjuwil approvata fl-2015.

Ma jkunx aħjar li flok ma jingħalqu l-pompi tal-petrol fl-abitat ikunu konvertiti f’lok fejn tiċċarġja l-batteriji tal-karozzi? Dawn il-pompi qegħdin fil-parti l-kbira tagħhom f’żoni ċentrali u huma ġeneralment ta’ qies żgħir. Kull pompa tal-petrol urbana li tkun salvata u konvertita biex fiha niċċarġjaw il-batteriji tfisser ukoll li nkunu salvajna 3000 metru kwadru ta’ art minn spekulazzjoni. Fl-istess ħin inkunu qed nippovdu servizz li ser ikun essenzjali eżatt fejn hu meħtieġ.

Dan ikun użu tajjeb għall-investiment, aħjar milli jintuża f’bini ta’ pompi ġodda barra miż-żona ta’ l-iżvilupp. Jekk dan isir inkunu qed nittrasformaw problema eżistenti f’diversi lokalitajiet f’soluzzjoni addattata għall-bini tal-infrastruttura meħtieġa għall-eletrifikazzjoni tat-trasport privat f’Malta.

Dan ovvjament ifisser li nkunu qed naqilbu ta’ taħt fuq il-politika dwar il-pompi tal-fjuwil. Flok ma nużaw il-pompi urbani bħala skuża biex tkun ġustifikata l-ispekulazzjoni tal-art inkunu qed nagħtu spinta tajba lill-ħarsien ambjentali.

Hu eżattament dan li għandna bżonn f’dan il-mument: naqilbu l-ippjanar rasu l-isfel.

Turning the Fuel Service Stations Policy on its head

Last Wednesday, the Parliamentary Environment and Land Use Planning Committee discussed the possible revision of the Fuel Service Stations Policy. The three development permits issued in the past weeks by the Planning Authority for fuel service stations at Burmarrad, Marsaskala and Magħtab without doubt was the spark that motivated the discussion. Among the pending applications, Attard, Mqabba and Iklin are queuing for new service stations, while over 60 more, from a current total of 85 stations are awaiting the Planning Authority go-ahead for upgrading.

A number of valid observations were made. Most of the discussion dealt with the need to relocate service stations currently within urban areas but there was, however, a reluctance to address head-on the real issue: do we need fuel service stations?

Almost five months ago, the Prime Minister – taking a leaf from Alternattiva Demokratika’s 2017 election manifesto – announced that his government will be launching a public consultation to establish a cut-off date for the sale of diesel and petrol cars in Malta and the use of only electricity-driven vehicles instead. We have not heard much more about this proposal, apart for an article by Transport Minister Ian Borg who wrote about following in the footsteps of other European countries in “phasing out new petrol and diesel vehicles in the next few decades”.

The Prime Minister has rightly emphasised that this change in policy is required in view of the fact that vehicle emissions are the largest source of pollution in Malta, but why wait so long to put flesh on the bare bones of the declared policy? Other European countries have already determined their cut-off date. Norway and the Netherlands are considering the year 2025, Germany is considering 2030, while France and the United Kingdom are opting for the year 2040 by which to halt the sale of diesel and petrol vehicles.

Revisiting the Fuel Service Stations Policy should not be discussed in a vacuum. It has to be placed in the context of related transport policies and in particular the fact (hopefully) that Malta should now be going electric.

The main issue clearly is that, as a result of going electric, the number of fuel service stations required will at some point in the future – hopefully the not so very distant future – will be next to nil. So why build more of them? Why encourage investment in something that is not needed? It would be much better to channel investment into resolving problems instead of adding to them.

The relocation of urban area fuel service stations – the main thrust of the Fuel Service Stations Policy approved in 2015 – is being used to justify the uptake of 3,000 square metres of land. But instead of relocating the existing service stations in urban areas, would it not be much better if these were converted into charging stations? These service stations are centrally located and mostly of a relatively small size. Every conversion one into a charging station would potentially save 3000 square metres of land in the middle of nowhere and simultaneously provide the service of electrically charging vehicles right where that service is required: in our urban areas.

It is towards the conversion of these fuel stations that investment should be channelled. They can be transformed from being a problem in our residential communities to being an integral and focal part of the strategy to develop a suitable, reliable and – above all – sustainable infrastructure so necessary for the electrification of private transport.

This would obviously turn the Fuel Service Stations policy upside down. Instead of using urban service stations as an excuse to trigger more land speculation, it is about time to inject some environmental considerations right where they are most needed.

This is what we need right now: the turning of the Fuel Service Stations Policy on its head.
