L-idjoti (bla sens ta’ etika) fit-tmexxija tal-Awtoritá tal-Ippjanar

L-aħbar fil-media li Jacqueline Gili, Direttur tal-Kuntratti fil-Ministeru tal-Finanzi, persuna nnominata mill-Gvern fuq il-Bord tal-Awtoritá tal-Ippjanar, inġiebet minn Catania bil-jet għal-laqgħa tal-Bord kienet aħbar xokkanti. Fatt li jistabilixxi standards ġodda ta’ governanza ħażina għal din l-amministrazzjoni.

Id-dikjarazzjoni taċ-Chairman Eżekuttiv tal-Awtoritá tal-Ippjanar Johann Buttigieg, li jkun idjota kieku kellu jerġa’ jikri jet privat darba oħra meta jaf li m’għandux appoġġ politiku għal deċiżjoni bħal din, turina b’mod ċar daqs il-kristall in-natura tal-problema reali tal-Awtoritá tal-Ippjanar. Id-deċiżjonijiet ma jittieħdux fuq bażi ta’ prinċipji etiċi ta’ tmexxija imma biss jekk ikunx hemm appoġġ politiku għalihom. L-Awtoritá tal-Ippjanar għandha tmexxija amorali li tippermetti kollox, sakemm ikun hemm l-appoġġ politiku neċessarju.

Hemm mod sistematiku kif jivvutaw il-parti l-kbira tal-membri tal-Bord tal-Ippjanar. M’hemmx bżonn wisq għerf biex tbassar min minnhom jista’ jivvota favur jew kontra applikazzjonijiet kontroversjali. Xi kultant ivarjaw ftit imma ġeneralment tista’ tipprevedi bi kważi preċiżjoni kif ser tmur il-votazzjoni.

Dan ifisser li d-deċiżjoni li jinkera l-jet kien eżerċizzju sempliċi biex ikun assigurat li l-voti favur l-applikazzjoni jkunu kollha preżenti madwar il-mejda. Meta wieħed iqis li Jacqueline Gili m’attendietx 29 minn l-aħħar 75 laqgħa tal-Bord tal-Awtoritá tal-Ippjanar dan kollu jassumi sinifikat ikbar.

Dan kollu, minkejja Ii hu importanti hu huwa kważi insinifikanti f’kuntrast mal-problemi kkawżati mill-konflitt ta’ interess eżistenti fil-laqgħat tal-Bord tal-Awtoritá tal-Ippjanar.

Intqal li żewġ membri tal-Bord tal-Awtoritá tal-Ippjanar għandhom kunflitt ta’ interess li minħabba fih ma kellhomx jipparteċipaw fil-laqgħa li kkunsidrat u approvat l-applikazzjoni tad-dB għal żvilupp f’Pembroke.

Iż-żewġ każi huma ta’ natura kompletament differenti.

L-ewwel każ ta’ kunflitt ta’ interess hu dak tal-membru parlamentari Laburista Mellieħi Clayton Bartolo. Meta kien mistoqsi dwar il-każ wara d-deċiżjoni, l-Onor. Clayton Bartolo spjega li missieru u zijuh jikru fond kummerċjali mingħand id-dB Group: huma sidien ta’ kumpanija fil-qasam tal-isports tal-baħar li topera mit-Tunny Net, propjetá ta’ Silvio Debono. Il-fatt enfasizzat mill-Onor. Bartolo li l-qraba tiegħu ma jirċievu l-ebda ħlas mingħand id-dB Group hu rrelevanti. Dak li hu relevanti hu li Clayton Bartolo qatt ma seta biss jikkunsidra li jivvota kontra l-proġett tad-dB f’Pembroke għax li kieku għamel dan kien ikun qed jipperikola l-interessi kummerċjali ta’ qrabatu. Dan hu l-kunflitt ta’ interess ta’ Clayton Bartolo. Huwa kellu jiddikjara dan l-interess tiegħu immedjatament fil-bidu tal-laqgħa u sussegwentement kellu jwarrab u ma jipparteċipax fid-diskussjoni u d-deċiżjoni dwar il-proġett propost minn dB f’Pembroke.

It-tieni kunflitt ta’ interess hu ferm iktar serju minn hekk. Jinvolvi lil Matthew Pace membru tal-Bord tal-Awtoritá tal-Ippjanar u l-ishma li għandu fl-aġenzija tal-propjetá Remax. Dan l-interess ta’ Matthew Pace fin-negozju tal-propjetá huwa f’kunflitt dirett mad-doveri tiegħu ta’ membru tal-Bord tal-Awtoritá tal-Ippjanar. Bħala sid ta’ ishma f’Remax hu perfettament naturali li Matthew Pace jieħu interess attiv fil-permessi ta’ żvilupp li jistgħu jwasslu għal iktar negozju għall-aġenzija li fiha għandu sehem. Imma bħala membru tal-Bord tal-Awtoritá tal-Ippjanar m’għandu jkollu l-ebda interess ta’ din ix-xorta għax dan inevitabilment iċajpar il-ġudizzju tiegħu huwa u jikkonsidra u jiddeċiedi l-applikazzjonijiet li jkollu quddiemu. Hu ċar li qatt ma messu kien appuntat. Il-fatt li ġie appuntat juri l-importanza li jagħti l-Gvern preżenti lill-imġieba korretta ta’ dawk li jiġu maħtura.

Hu floku ukoll li niġbed l-attenzjoni li Matthew Pace hu direttur eżekuttiv tal-kumpanija MFSP Financial Management Limited li f’Ġunju li għadda kienet immultata €38,750 mill-FIAU (Financial Intelligence Analysis Unit) talli ma osservatx numru tal-liġijiet kontra l-ħasil tal-flus. Ir-rapporti fl-istampa f’Ġunju li għadda jindikaw li l-kontijiet inkwistjioni kienu ta’ Keith Schembri, Kap Amministrattiv tal-Uffiċju tal-Prim Ministru Joseph Muscat, u ta’ Adrian Hillman li kien Direttur Maniġerjali tal-Allied Newspapers.

Dan jgħinna mhux ftit biex nifhmu ħafna iktar dak li qiegħed jiġri. It-taħwid li għaddej fl-Awtoritá tal-Ippjanar għandu l-barka diretta minn Kastilja, u allura huwa l-Prim Ministru li jeħtieġ li jerfa’ r-responsabbiltá diretta għal dan kollu.

Amoral idiots at the Planning Authority

The revelation that Jacqueline Gili, Director of Contracts at the Ministry of Finance and government appointee on the Planning Authority Board, was brought over for a meeting by a jet plane from Catania is shocking. It takes bad governance under this administration to a new level.

The declaration by PA Executive Chairman, Johann Buttigieg, that he would be an idiot to hire an executive jet next time in view of his not having any “political backing” for his decision to do so on this occasion identifies the real problem. Governance at the PA is dependent on political backing and not upon solid ethical behaviour. The authority has an amoral leadership and anything is permissible, as long as there is political backing.

The voting patterns of the Planning Authority Board members are clear enough. It is not rocket science to identify a priori which members of the Planning Authority Board are in favour and which are against controversial applications. They vary at times, but generally one can be 75 per cent spot-on in identifying who will vote “yes” and who will vote “no” on most applications.

This signifies that the jet plane decision was simply an exercise in ensuring that the potential yes votes were all on board. This in view of the large number of absences of Jacqueline Gili at Planning Board meetings in the recent past: she has not been present at  29 of the last 75.

I submit, however, that the jet plane issue almost pales into insignificance compared with the issue of conflict of interest at Planning Authority Board meetings. It has been said that two members of the Board had a conflict of interest in view of which they should not have participated in the meeting that considered and approved the dB Pembroke development proposal.

The two cases are however of a completely different nature.

The first conflict of interest is of Mellieħa Labour MP Clayton Bartolo. When prodded, after the decision was taken, the Hon Clayton Bartolo explained that his father and uncle are tenants of commercial premises owned by the dB Group: they are shareholders of a water sports company that operates from Silvio Debono’s Tunny Net Complex. The fact underlined by Hon Bartolo that the Bartolo relatives do not receive any payments from the dB Group is irrelevant. What is relevant is that, had Clayton Bartolo decided to vote against the dB Pembroke proposal, the existing commercial relationship between his immediate relatives and the dB Group would have been at considerable risk. This is what gives rise to Clayton Bartolo’s conflict of interest. He should have declared his interest before the PA Board meeting and not participated in the discussion and decision on the dB Pembroke project.

The second conflict of interest is much more serious. It involves PA Board member Matthew Pace and his shareholding in the Remax Estate Agency. Mr Pace’s interests in an estate agency is in direct conflict with his duties as a member of the Planning Authority Board. As a shareholder in Remax, it is natural for him to have an active interest in development permits as this would inevitably lead to more business for his agency. As a PA Board member, he should not have such an interest in any potential development permit as it would inevitably cloud his judgement in accessing and deciding on the applications for his consideration.

It is clear that Matthew Pace should have never been appointed in the first place and the fact that he was signifies the importance that the present government attaches to the ethical behaviour of its appointees.

It would be pertinent to also point out that Mr Pace is also Executive Director of MFSP Financial Management Ltd, an investment company which, last June, was fined €38,750 by the Financial Intelligence Analysis Unit for breaching a number of anti-money laundering laws. Reports in the press at the time indicated that the accounts in question belonged to Keith Schembri, Chief of Staff to Prime Minister Joseph Muscat, and Adrian Hillman former Managing Director of Allied Newspapers.

This makes matters substantially easier to decipher: the useful idiots at the Planning Authority are in the good books of the powers that be at Castille. The buck therefore stops on Joseph Muscat’s desk: it is he who has to shoulder political responsibility for this mess.

Standards fil-Ħajja Pubblika: għadna nistennew

Is-sit tal-Ministeru tal-Ġustizzja jindika b’mod ċar li l-Att XIII tal-2017 imsejjaħ Att dwar l-Istandards fil-Ħajja Pubblika għadu ma daħalx fis-seħħ. Din il-liġi irċiviet il-kunsens tal-President tar-Repubblika nhar it-30 ta’ Marzu 2017 wara li damet perjodu twil pendenti fuq l-aġenda tal-Parlament. Jidher li għad baqgħalna x’nistennew, għax il-partiti politiċi fil-parlament ma tantx jdher li għandhom għaġla.

Il-liġi tipprovdi għall-ħatra ta’ Kummissarju dwar l-Istandards fil-Ħajja Pubblika. Dan il-Kummissarju jista’ jkun approvat biss kemm-il darba jikseb il-kunsens ta’ żewġ terzi tal-membri parlamentari. Fi ftit kliem irid ikun hemm qbil dwar il-ħatra tiegħu jew tagħha bejn il-Gvern u l-Opposizzjoni li, sa fejn naf jien, għandhom ma qablux. S’issa ħadd ma jaf xejn, l-anqas jekk ġewx proposti ismijiet, minn min u x’kienet ir-reazzjoni dwarhom.

Il-liġi approvata tapplika għall-Membri kollha tal-Parliament, inkluż il-membri tal-Kabinett. Tapplika wkoll għal dawk il-persuni maħtura f’posizzjoni ta’ fiduċja (position of trust) fil-Ministeri u s-Segretarjati Parlamentari.

Meta iktar kmieni matul din il-ġimgħa iltqajt mal-Ispeaker tal-Kamra tar-Rappreżentanti, l-Onorevoli Anġlu Farrugia, jiena emfasizzajt li dan id-dewmien biex tkun implimentata din il-liġi dwar l-imġieba xierqa tal-Membri Parlamentari u dawk maħtura f’posizzjoni ta’ fiducja qiegħed jibgħat messaġġ ċar ħafna: li l-Membri Parlamentari m’għandhom l-ebda ħeġġa biex iwieġbu għal egħmilhom.

Jiena niftakar lill-Ispeaker, xi snin ilu, jemfasizza li hu ma kienx sodisfatt mill-kontenut tad-dikjarazzjonijiet tal-assi sottomessi minn uħud mill-Membri Parlamentari. Issa għandu l-għodda biex jinvestiga dwar il-veraċitá ta’ dawn id-dikjarazzjonijiet imma sfortunatament m’huwiex jitħalla jagħmel użu minnhom! Il-Membri Parlamentari għandhom jagħtu kont ta’ egħmilhom, iżda l-fatt li l-liġi dwar l-Istandards fil-Ħajja Pubblika għadha ma daħlitx fis-seħħ qiegħed jostakola dan milli jseħħ.

Meta tħares lejn dan in-nuqqas ta’ implimentazzjoni tal-liġi waħdu tista’ tinterpretah bħala tkaxkir tas-saqajn mill-Membri Parlamentari u l-mexxejja tagħhom li jippreferu ma jitqegħdux taħt il-lenti tal-iskrutinjun pubbliku. Imma meta dan kollu tqisu fil-kuntest tar-rapport annwali tal-Ombudsman għas-sena 2017 huwa ċar li dan it-tkaxkir tas-saqajn m’huwiex limitat iżda hu mifrux ħafna. Id-dritt tal-aċċess għall-informazzjoni dwar il-ħidma tal-amministrazzjoni pubblika qiegħed taħt assedju.

Il-kontabiltá u it-trasparenza m’humiex slogans. L-anqas huma negozjabbli. Huma valuri fundamentali li jiffurmaw parti essenzjali mis-sisien tal-istat demokratiku.

Jiena tlabt lill-Ispeaker biex jiġbed l-attenzjoni tal-Kumitat tax-Xogħol tal-Kamra li dan it-tkaxkir tas-saqajn biex ikun implimentat l-Att dwar l-Istandards fil-Ħajja Pubblika mhuwiex aċċettabbli. Huwa essenzjali li l-liġi tkun implimentata malajr kemm jista’ jkun jekk iriduna nemmnu li għall-partiti politiċi fil-parlament il-kontabilitá tfisser xi ħaga.

B’żieda mar-responsabbiltá li jinvestiga l-imġieba kemm tal-Membri Parlamentari kif ukoll dik tal-persuni ta’ fiduċja, il-Kummissarju għall-Istandards fil-Ħajja Pubblika ser ikollu ukoll l-inkarigu li jfassal kemm il-linji gwida kif ukoll ir-regolamenti proposti dwar l-attivitá tal-lobbying. Dwar din l-attivitá b’implikazzjonijiet etiċi sostanzjali l-partiti politiċi fil-Parlament ma qablux meta din il-liġi kienet qed tiġi ikkunsidrata quddiem il-Kumitat Parlamentari għall-konsiderazzjoni tal-abbozzi ta’ liġijiet. Bħala riżultat ta’ dan Il-materja intefgħet f’ħoġor il-Kummissarju dwar l-Istandards fil-Ħajja Pubblika li meta jinħatar ser ikun hu li jkollu jfassal kemm il-linji gwida kif ukoll r-regolamenti proposti.

Il-lobbying hi attivitá essenzjali fil-ħajja pubblika. Jeħtieġ iżda li issir b’mod li jkun assigurat illi d-deċiżjonijiet mittieħda mill-politiċi jkunu kemm trasparenti kif ukoll b’rispett sħiħ lejn r-regoli bażiċi tal-etika.

Il-lobbying huwa ta’ influwenza kontinwa fuq id-deċiżjoniiet li jittieħdu. Huwa essenzjali li dan issir b’mod mill-iktar trasparenti biex ikun ċar għal kulħadd dwar liema interessi jkunu qed jiġu mmexxija l-quddiem. Dan bla dubju jfisser li ikun meħtieġ il-pubblikazzjoni ta’ ammont mhux żgħir ta’ informazzjoni li presentement hi fil-pussess ta’ membri tal-Kabinett u li ġeneralment tibqa’ fil-files – meta tkun miktuba. Din hi informazzjoni li ġeneralment tkun il-bażi għall-azzjonijiet u d-deċiżjonijiet li jittieħdu.

Bla ebda dubju, il-linji gwida u r-regolamenti dwar il-lobbying iridu jindirizzaw u jirregolaw x’jista’jagħmel membru tal-Kabinett meta jispiċċa mill-ħatra, materja magħrufa bħala revolving door policy. Dan minħabba li s-settur regolat mill-Ministru jkollu għatx għal informazzjoni (kunfidenzjali) li dan ikun kiseb kemm ikun ilu fil-ħatra kif ukoll għall-kuntatti u influwenzi akkumulati fuq dawk li jieħdu d-deċiżjonijiet. Xi drabi għaldaqstant meta Ministru jew Segretarju Parlamentari, hekk kif itemm il-ħatra tiegħu ikun offrut impieg f’dak l-istess settur li ftit qabel ikun dipendenti minnu jeħtieġ li nieqfu ftit. Dan ovvjament għax miegħu iġorr aċċess akkumulat kemm għal informazzjoni miksuba kif ukoll għal kuntatti u influwenza fuq il-proċess deċiżjonali. Il-linji gwida u r-regolamenti jridu jistabilixxu kemm jeħtieġ li jgħaddi żmien qabel ma dan ikun jista’ jseħħ. .

Huwa dan kollu li qed nistennew. Hemm ħafna li jeħtieġ li jsir imma ma jidher li hemm l-ebda impenn biex dan isir.

Standards in Public Life: still waiting for Godot

The website of the Ministry of Justice clearly indicates that Act XIII of 2017 entitled Standards in Public Life Act is not yet in force. This statute received Presidential assent on  30 March 2017 after an elephantine gestation period. It seems that we are in for a long wait as the parliamentary political parties do not seem to be in any hurry.

The Act provides for the appointment of a Commissioner for Standards in Public Life. The Commissioner can only be appointed if two-thirds of Members of Parliament agree with the nomination, and as far as I am aware there has been no agreement so far between Government and Opposition on the matter. The name or names proposed to date are not in the public domain.

The Act applies to all Members of Parliament, including the members of Cabinet. Moreover, it also applies to those appointed to a position of trust in Ministries and Parliamentary Secretariats.

When I met the Speaker of the House of Representatives, the Hon Anġlu Farrugia, earlier this week, I emphasised the fact that the delay in implementing this legislation on the ethical behaviour of Members of Parliament and those appointed in positions of trust is sending one clear message: that Members of Parliament are not that eager to be accountable for their actions.

I do remember the Speaker – some years back – emphasising the fact that he was not satisfied with the contents of the asset declarations submitted annually by some MPs. He now has the tools to investigate the veracity (or otherwise) of such declarations but is, unfortunately, being prevented from doing so. MPs should be accountable for their actions, but the non-implementation of the Standards in Public Life Act is preventing such accountability.

On its own, this lack of implementation could be interpreted as a reluctance of MPs and their leaders to be personally placed under the spotlight of public opinion. However, when viewed in the context of the 2017 Ombudsman’s annual report, it is very clear that this reluctance is widespread. The right of access to information on the workings of the public administration is under siege.

Accountability and transparency are not slogans and, moreover, they are non-negotiable. They are fundamental values which underpin the democratic state.

I have asked Mr Speaker to draw the attention of the House Business Committee to the fact that this procrastination in implementing the Standards in Public Life Act is not acceptable. Its implementation is a must if we are to believe that the commitment of parliamentary political parties goes beyond slogans.

In addition to investigating the behaviour of Members of Parliament and that of people appointed to positions of trust, the Commissioner for Standards in Public Life will have the task of drawing up guidelines and a proposal for regulations on lobbying activities. This is another ethical minefield in respect of which there was no agreement between the parliamentary political parties when the draft legislation was under consideration in the Parliamentary Committee for the Consideration of Bills. As a result, instead of spelling out the required regulatory regime, the matter was postponed and added to the responsibilities of the future Commissioner for Standards in Public Life, whoever he or she may be.

Lobbying is an essential and unavoidable element of public life. However, it has to be placed under the spotlight to ensure a fuller transparency of the decisions taken by the holders of political office. In addition to subjecting lobbying to clear transparency rules, it is essential that the ethical issues linked to lobbying are addressed forthwith.

Lobbying continually influences decision-making. It is imperative that transparency rules are applied to lobbying so that it be clear to one and all as to whose interests are being advanced and defended. This would undoubtedly include the publication of a substantial amount of information to which Cabinet Ministers are currently privy, which information (generally) forms the basis for their actions and decisions.

Undoubtedly, lobbying guidelines and regulations have to address the issue of revolving doors recruitment, as a result of which politicians may be available for sale at the taxpayers expense. A policy addressing the issue of revolving doors recruitment would also regulate the cooling-off period required for a Minster or Parliamentary Secretary to take up employment (after termination of office) in the sector which was subject to his regulation authority.

This is what we are waiting for. Like Samuel Beckett’s characters in his “Waiting for Godot”. Godot never arrives.

Alleanza Elettorali: m’hemmx għaġġla

 

Id-dibattitu pubbliku dwar jekk, meta u kif għandha tkun żviluppata alleanza elettorali bejn Alternattiva Demokratika u l-Partit Nazzjonalista qabad ritmu sewwa fuq il-media soċjali matul il-ġimgħa li għaddiet. Dan seħħ l-iktar bħala riżultat  tal-intervista ta’ Michael Briguglio fuq din il-gazzetta l-ġimgħa l-oħra.

Il-veduti ta’ Michael Briguglio, bla dubju, jirriflettu l-esperjenzi tiegħu u jwassluh għall-konklużjoni li t-toroq li jippuntaw lejn alleanza elettorali (jew kif ġieli nirreferu għaliha, koalizzjoni) għandhom ikunu eżaminati sewwa u mingħajr wisq dewmien. Jiena m’għandi l-ebda għaġġla. Dan qed ngħidu minħabba li l-imġieba tat-tmexxija tal-Partit Nazzjonalista hi ta’ tħassib mhux żgħir u li bħala riżultat ta’ dan qed nifforma l-opinjoni li wara kollox jista’ jkun li dan mhux il-mument addattat għal inizjattiva ta’ din ix-xorta.

Il-kobba mħabbla dwar id-donazzjonijiet li qed tiżviluppa bejn il-Partit Nazzjonalista u Silvio Debono tad-db Group tirrikjedi li jitqegħdu l-karti kollha fuq il-mejda biex ikun assigurat li l-fatti kollha huma magħrufa. Kemm hu veru li l-PN irċieva donazzjonijiet moħbija bħala ħlas għal serviżżi li ma nagħtawx u dan billi għamel użu mill-kumpanija kummerċjali tiegħu?  Apparti l-grupp db kemm-il entitá kummerċjali oħra hemm li għamlet din it-tip ta’ donazzjoni moħbija lill-PN?  Dan kollu ma jmurx kontra dak li l-PN ilu jgħid żmien dwar is-suppost tmexxija serja li jrid?  Allura jekk anke fuq xi ħaġa bażika bħas-serjetá fit-tmexxija l-PN jgħid ħaga u jagħmel oħra kif qatt nistgħu nemmnu u nagħtu piż lil dak li jgħid il-PN dwar prinċipji u kwalunkwe xorta ta’ proposta politika?

Hemm diversi materji oħra li jinvolvu l-imġieba ta’ membri parlamentari ewlenin tal-Partit Nazzjonalista li dwarhom tinħtieġ li tingħata spjegazzjoni.

Per eżempju d-dikjarazzjoni ta’ Claudio Grech li ma jiftakarx jekk qatt iltaqa’ ma George Farrugia, u dan fil-kuntest tal-iskandlu taż-żejt, xejn ma tikkonvinċi. L-aċċettazzjoni da parti tal-Kap tal-Opposizzjoni ta’ din id-dikjarazzjoni tixhed dubju fuq kemm qiegħed jiffunzjona l-kumpass etiku tant meħtieġ u essenzjali għal min appunta lilu nnifsu fit-tmexxija tal-koalizzjoni kontra l-korruzzjoni.

L-anqas ma huma ċari l-affarijiet fejn jidħol ir-rwol ta’ Beppe Fenech Adami fil-Capital One Investment Group u l-Baltimore Fiduciary Services. F’sitwazzjoni kważi identika, Joe Cordina, dakinnhar Teżorier tal-Partit Laburista, kien imġiegħel jirreżenja.

Min-naħa l-oħra Mario de Marco għamel apoloġija pubblika dwar il-ġudizzju żbaljat tiegħu meta huwa aċċetta l-inkarigu mill-Grupp db dwar l-akkwista ta’ l-art f’Pembroke fejn illum hemm l-Istitut għall-Istudji Turistiċi. F’dawn iċ-ċirkustanzi, bla ebda dubju, apoloġija mhux biżżejjed.

Irridu nikkunsidraw ukoll il-villa proposta biex tinbena barra miż-żona tal-iżvilupp minn Toni Bezzina kelliemi għall-agrikultura tal-PN u  flimkien ma oħrajn awtur tad-dokument dwar il-politika “ġdida” ambjentali tal-PN. Proposta li tmur kontra dak kollu li kien propost fid-dokument. Il-Kap tal-Opposizzjoni flok ma tajru immedjatament ipprova jeħilsu billi qal li “ma għamel xejn ħażin.

Meta tqies kollox, tista’ tifhem aħjar kemm it-tmexxija tajba u l-iġieba etika huma bosta drabi nieqsa fost l-Opposizzjoni. Kull wieħed minn dawn il-kazijiet, anke jekk meqjus għalih waħdu, kien ikun iktar minn biżżejjed biex tkun xkupata l-barra t-tmexxija kollha tal-Opposizzjoni.

Kif tista’ Alternattiva Demokratika taħdem favur alleanza elettorali ma’ partit politiku li t-tmexxija tiegħu hi kompromessa b’dan il-mod u għandha daqstant x’tispjega dwar l-imġieba tagħha? Kif jista’ l-Partit Nazzjonalista jippretendi t-tmexxija morali ta’ koalizzjoni kontra l-korruzzjoni qabel ma jagħti spjegazzjoni konvinċenti tal-imġieba tal-esponenti ewlenin tiegħu? Il-fatt li l-Partit Laburista għandu ħafna iktar x’jispjega mhu ta’ l-ebda konsolazzjoni u bl-ebda mod ma jiġġustifika l-imġieba tal-Opposizzjoni.

Il-mintna li jinsab fiha pajjiżna hi riżultat dirett tat-tmexxija tal-Partit Laburista tul dawn l-aħħar erba’ snin. Imma hi ukoll riżultat tas-sistema ta’ żewġ partiti politiċi li iktar ma tispiċċa malajr, iktar aħjar għal kulħadd. Is-sistema ta’ żewġ partiti li kkontrollat il-makkinarju tal-istat bla interruzzjoni mill-1966 sal-lum hi responsabbli ukoll għas-sitwazzjoni attwali. Dan minħabba li bħala konsegwenza tat-tip ta’ Parlament li ġie elett kien prattikament impossibli (b’xi eċċezzjonijiet żgħar) li dan jeżamina b’reqqa l-ħidma tal-Gvern b’mod li jkun imġiegħel jagħti kont ta’ egħmilu bis-serjetá.

Filwaqt li l-ħolqien ta’ alleanza elettorali tista’ tkun ta’ ġid għall-pajjiż, iċ-ċirkustanzi preżenti ma naħsibx li jipprovdu l-mument addattat. Il-bibien għad-diskussjoni Alternattiva Demokratika żżommhom dejjem miftuħin imma bħalissa hu l-mument li wieħed joqgħod attent biex ikun evitat li jingħataw messaġġi żbaljati.

Huwa biss meta jkunu ċċarati l-affarijiet li jkun il-mument addattat biex jittieħdu d-deċiżjonijiet dwar il-jekk u l-kif ta’ alleanza elettorali.

Electoral Alliance : a cautious approach

The public debate on whether, and to what extent, it is appropriate to have an electoral alliance between Alternattiva Demokratika and the Nationalist Party has been in full swing on social media during the past week, fuelled as it was by Michael Briguglio’s interview on the Maltese weekly Illum last Sunday.

Michael Briguglio presented his views, no doubt based on his experiences and perceptions, concluding that the avenues leading to an electoral alliance (at times also referred to as a coalition) should be explored without delay. The fact that the ethical behaviour of leading members the PN Opposition leaves much to be desired necessitates more caution. There is no need to rush.

The political party donation mess in which the PN and Silvio Debono of the db Group are entangled requires full disclosure in order to ascertain the precise facts. Has the PN (illegally) avoided the provisions of the political party financing legislation through the channelling of funds to its commercial arm under the guise of payment for (fake) services? Is the db Group “donation” a one-off, or is it one of a number?

Wouldn’t this give the lie to the PN’s declared commitment to good governance? If such a basic issue in the PN’s electoral platform is just paying lip service, how can one give weight to any PN declaration of adherence to principle or policy of whatever form or shape?

There are other issues related to the behaviour of senior PN MPs which need clarification.

For example, Claudio Grech’s declaration that he does not recollect ever meeting George Farrugia with reference to the oil sales scandal, is not convincing at all. The acceptance of Claudio Grech’s declaration by the Leader of the Opposition throws considerable light on the functionability of the ethical compass which is an essential tool for the self-appointed leader of an anti-corruption coalition!

Nor are matters on Beppe Fenech Adami’s role in the Capital One Investment Group/Baltimore Fiduciary Services any clearer. In quasi similar circumstances, Joe Cordina, former Labour Party Treasurer was forced to resign.

Mario DeMarco has made a public apology on his error of judgement, which error of judgement was made when accepting the brief of the db Group relative to its acquisition of the land at Pembroke, currently hosting the Institute for Tourism Studies, fro the government. Fine, but apologies are certainly not enough.

One has also to consider the proposed ODZ Villa which Toni Bezzina, PN spokesperson on agriculture and co-author of the PN policy document,  sought to develop contrary to both letter and spirit  of the policy document he had just proposed. The Leader of the Opposition instead of dismissing him on the spot absolved him as “he had done nothing wrong”.

Taken together, the above shed considerable light on the extent to which “good governance” and “ethical behaviour” is often absent in the Opposition’s ranks. In any other democratic country, each one of the above, even if considered separately, would have been more than enough to wipe out the whole Opposition leadership.

Can Alternattiva Demokratika forge an electoral alliance with a political party whose leading members are so compromised and have so much to explain as to their behaviour? Moreover, how can the PN claim moral leadership in a coalition against corruption before it gives satisfactory explanations on the behaviour of its leading exponents? The fact that the Labour Party has even much more to explain is no justification for the Opposition’s behaviour.

The mess in which the country is currently submerged, the direct result of Labour Party stewardship over the past four years, is also the direct consequence of a two-party system which needs to be smashed to smithereens. The two- party system which has controlled the machinery of the state uninterruptedly since 1966 is ultimately responsible for the current state of affairs as it has continuously returned a Parliament which, due to its composition, has, with insignificant exceptions, been unable to hold the government of the day to account.

While the setting up of an electoral alliance could eventually be beneficial to the country, in the present circumstances it is not the right time to rush. At this point in time, linking Alternattiva Demokratika to the PN through an electoral alliance may send wrong messages.

While Alternattiva Demokratika will never close the doors to possible discussions on an electoral alliance, I believe that it is certainly the season to be extremely cautious until such time as the murky waters have cleared. It is only then that the time would be ripe for the necessary decisions.

Beppe u Mario : ma jistax ikollkom saqajkom fuq iż-żewġ naħat.

Ir-rapport tal-inkjesta dwar l-investigazzjoni fuq l-aġir tal-Pulizija meta dawn kienu qed jinvestigaw kaz ta ħasil ta flus u tfaċċa isem Beppe Fenech Adami, issa ġie ippreżentat.

Ir-rapport tal-inkjesta iwieġeb il-mistoqsija ċentrali tal-istess inkjesta fis-sens li ma instabet l-ebda prova li kienet tindika li Beppe Fenech Adami indaħal bxi mod biex l-investigazzjoni waqfet. Beppe Fenech Adami fil-fatt qal li l-anqas biss jaf li kienet għaddejja din l-investigazzjoni.

Imma jibqa mistoqsijijiet mhux inwieġba tant li ġustament il-pulizija intalbet tinvestiga iktar fil-fond. Sa hawn tajjeb.

Jibqa mistoqsija oħra li l-ebda inkjesta mhi ser twieġeb. Il-mistoqsija hi : kemm hu etiku li politiku jinvolvi ruħu bħala Direttur ta kumpanija fejn l-attivita reali ma tkunx maghrufa? Din hi mistoqsija li Beppe qatt ma wieġeb.

Mhiex problema biss għall-politiku imma hi problema għal kull professjonist. Imma għall-politiku hi problema ikbar.  

Il-problema tal-etika bejn il-prattika professjonali u l-impenn politiku hu wieħed ċar fl-informazzjoni li ħarget dwar l-involviment professjonali ta Mario Demarco bħala konsulent legali tal-kumpanija ta Silvio Debono tal-Mellieħa li ħadet l-art tal-ITS fPembroke.

Anke Mario Demarco għandu problema serja etika għax donnu ma jistax jagħżel bejn l-impenn politiku u l-professjoni legali. Fi ftit kliem ma jistax ikollok saqajk fuq iżżewġ naħat.

Veru qegħdin ottu. L-aħħar polemika fir-Repubblika tal-Banana hi dwar il-pastizzi tas-Serkin, skond Ann Fenech.

GħaI bosta ma tagħmel l-ebda differenza fejn Joseph u ħbiebu jmorru għall-pastizzi.

Imma min-naħa l-oħra l-imġieba tal-politiku u l-pastizzi ta Velbert kellha tittieħed iktar bis-serjetá. Il-libelli ma jsolvu xejn ħlief itawwlu ftit iżżmien. L-importanti imma hu li fir-Repubblika tal-Banana għandna l-aqwa Kabinett fl-Ewropa!

Mela fl-aħħar, il-lejla, l-Parlament ta’ Malta għandu fuq l-aġenda bħala l-ewwel item l-abbozz ta’ liġi li jirregola l-imġieba fil-ħajja pubblika. Wara li dan l-abbozz ilu lest iktar minn sentejn hu ġustifikat li ngħidu “about time”. Jew forsi “aħjar tard milli qatt”!

Ir-rapport finali tal-Kumitat Magħżul kien ippreżentat lill-Parlament nhar l-24 ta’ Marzu 2014. Xahrejn wara, nhar l-20 ta’ Mejju, l-abbozz ta’ Liġi imsejjaħ Att tal-2014 dwar l-Istandards fil-Ħajja Pubblika ingħata l-ewwel qari fil-Parlament. Wara, nhar il-15 ta’ Lulju 2014 kien ippubblikat fil-Gazzetta tal-Gvern u tqiegħed fuq l-agenda tal-Parlament fejn għandu hemm sal-lum!

L-abbozz ta’ liġi jfittex li joħloq l-istrutturi meħtieġa biex ikun possibli li jkunu investigati imġieba li ma tkunx kompatibbli mal-liġi inkella man-normi etiċi minn persuni fil-ħajja pubblika. Il-moniteraġġ ser ikun vestit f’kumitat parlamentari permanenti kif ukoll f’Kummissarju għall-Istandards fil-Ħajja Pubblika li jinħatar bl-approvazzjoni ta’ żewġ terzi tal-voti tal-membri parlamentari.

Il-leġislazzjoni proposta ser tapplika għal żewġ kategoriji ta’ persuni fil-ħajja pubblika: il-Membri Parlamentari (inkluż il-Ministri, s-Segretarji Parlamentari u l-Assistenti Parlamentari) kif ukoll dawk impjegati fis-settur pubbliku minħabba li jgawdu l-fiduċja tal-politiċi, dawk li ħafna drabi nirreferu għalihom bħala li qegħdin “in a position of trust”.

L-abbozz jinkludi edizzjoni aġġornata tal-Kodiċi tal-Etika applikabbli għall-membri parlamentari kif ukoll għall-Kodiċi l-ieħor applikabbli għall-membri tal-Kabinett imma ma jinkludix il-Kodiċi tal-Etika applikabbli għad-Diretturi maħtura fuq awtoritajiet, korporazzjonijiet jew korpi parastatali li kien oriġinalment ippubblikat madwar ħamsa u għoxrin sena ilu. L-abbozz l-anqas ma jgħidilna dawn il-persuni ta’ fiduċja kif ser ikunu regolati!

Il-Kummissarju għall-Istandards fil-Ħajja Pubblika ser ikun jista’ jinvestiga allegazzjonijiet dwar imġieba mhux etika kif ukoll dwar il-veraċità tad-dikjarazzjonijiet tad-dħul u l-assi li jagħmlu l-Membri Parlamentari, u l-membri tal-Kabinetti jew dawk impjegati f’posizzjoni ta’ fiduċja u dan skond kif jistabilixxu l-Kodiċi tal-Etika inkella r-regoli li jsiru taħt l-Att dwar l-Amministrazzjoni Pubblika.

Għalkemm l-abbozz huwa avvanz fuq il-qagħda attwali xorta hemm ħtieġa ta’ titjib sostanzjali fil-proposti li fih l-abbozz. Fosthom huwa neċessarju li jidħlu għall-ewwel darba miżuri li jirregolaw il-lobbying illi jsir tal-politici f’laqghat kemm formali kif ukoll informali. Regolamentazzjoni illi tista’ issir b’diversi modi.

Imma l-abbozz jinjora l-lobbying kompletament u ma jippruvax jirregolah.

Huwa essenzjali li issa l-Parlament ma jkaxkarx saqajh u li l-abbozz ikun approvat b’emendi fl-iqsar zmien possibli.

Kien hemm diversi kazi u ċirkustanzi matul dawn l-aħħar sentejn li setgħu jkunu investigati kieku liġi ta’ din ix-xorta kienet teżisti. Huwa għalhekk essenzjali illi l-abbozz ikun imtejjeb u approvat u li fl-qasir żmien jinħatar il-Kummissarju ghall-iStandards fil-Ħajja Pubblika. Għandu jkun emfasizzat li l- Kummissarju għall-iStandards fil-Ħajja Pubblika għandu l-inkarigu li jinvestiga mhux biss l-imġieba tal-Membri Parlamentari u l-Ministri imma ukoll, kif jipproponi l-istess abbozz, l-imġieba tal-persuni ta’ fiduċja li nħatru mill-amministrazzjoni. Huwa mehtieg li anke dawn jirrealizzaw illi anke huma jeħtieġ li jagħtu kont ta’ egħmilhom.

Kull rigal li jirċievi persuna fil-politika huwa intenzjonat biex jinfluwenza, fis-sens wiesa’ tal-kelma, u  dan irrispettivament mill-valur. Anke l-oġġetti ta’ bla valur jew dawk b’valur insinifikanti huma intenzjonati biex jinfluwenzaw. Issa l-influwenza intenzjonat bl-għoti ta’ diary, jew biro inkella xi flixkun inbid jew xi xarba alkoholika oħra hi bla dubju differenti minn l-influwenza b’lift f’jet privat għal partita futbol fi Spanja.

L-affarijiet żgħar li jingħataw huma ħafna drabi iktar riklami milli rigali u l-iskop tagħhom ikun wieħed ta’ nota ta’ introduzzjoni jew inkella ta’ apprezzament. Imma l-biro, id-diary u l-flixkun inbid biż-żmien jikbru ftit ftit u jsiru ikla, hampers u affarijiet oħra ukoll. Ħafna drabi t-tixħim ma jkunx f’moħħ min jagħti “token”, l-anqas f’min jagħti xi ħaġa iktar sostanzjali bħal hamper. Niftakru forsi li fis-settur privat ħafna drabi dan hu l-mod kif jingħad grazzi lil klijenti li jiġġeneraw ħafna xogħol. In-nies tan-negozju mhux dejjem jirrealizzaw li l-prattiċi tagħhom, għalkemm validi għalihom, għandhom sinifikat u implikazzjoni differenti meta applikati fis-settur pubbliku

Niftakar lil sid il-jet privat li kien stieden lil Tonio Fenech miegħu sa Spanja biex jaraw partita futbol kien qal lil waħda mill-gazzetti  li ma kellux bżonn jistenna l-partita futbol biex jiltaqa’ ma Tonio Fenech. Seta jagħmel appuntament miegħu meta ried, mingħajr l-iċken diffikulta. Kien korrett. Għalih ma kellu l-ebda sinifikat li ta’ lift lil Tonio Fenech.

Dakinhar ħadd ma qal li Tonio Fenech kien ixxaħħam bil-lift fuq il-jet privat. Imma Tonio Fenech xorta għamel ħażin bħalma kien għamel ħażin Lawrence Gonzi li għalih ukoll kien qiesu ma ġara xejn. Aċċetta rigal meta kien ipprojibit milli jagħmel dan mill-Kodiċi tal-Etika tal-Ministri u s-Segretarji Parlamentari.

Il-mod kif żviluppa l-każ ta’ Dr Joe Cassar dwar ir-rigali (karozza u CCTV) riċentement kien għal kollox differenti. Cassar inqabad bis-sunnara mingħajr ma nduna. Li l-Kap tal-Opposizzjoni ħa passi kien posittiv imma mill-Opposizzjoni ma ħtieġlu l-ebda sforz partikolari għal dan. Ovvjament qed jipprova jerġa’ jibni l-kredibilità li l-PN tilef meta kien fil-Gvern.

Ma neskludix li hemm kazijiet oħra li s’issa għadhom ma rawx id-dawl tax-xemx. Huwa importanti li meta dawn il-kazijiet tifaċċaw ikollna l-għodda lesta biex tkun tista’ issir l-investigazzjoni meħtieġa. Kien għal dan l-iskop li sentejn ilu Kumitat Magħżul tal-Parlament wara diskussjoni twila ħejja abbozz ta’ liġi dwar l-Istandards fil-Ħajja Pubblika.

Imma jidher li l-volontà politika hi nieqsa għax dan l-abbozz għadu pendenti wara li għaddew sentejn.
