Tniġġiż tal-arja fil-portijiet

Il-kwalità tal-arja fil-portijiet tagħna hi ta’ tħassib kbir. Niddependu minnha biex nieħdu n-nifs. Ir-residenti fil-lokalitajiet madwar il-portijiet qed isiru iktar konxji ta’ dan u jinsistu b’qawwa li tittieħed azzjoni. Ilkoll huma mħassbin miż-żieda astronomika fil-mard respiratorju madwarhom u fil-pajjiż kollu.

Madwar sena ilu l-għaqda ambjentali Maltija Birdlife flimkien ma’ esperti minn għaqda ambjentali Ġermaniża ħadet sehem f’eserċizzju li fih tkejlet il-kwalità tal-arja. Il-kampjuni tal-arja li nġabru minn madwar il-Port il-Kbir kienu jindikaw presenza għolja ta’ trab fin, li ħafna drabi jispiċċa fil-pulmun tagħna.

Il-Port il-Kbir hu ċentru ta’ attività marittima. Jinkludi terminal tal-cruise liners li tul dawn l-aħħar ħames snin kellu medja ta’ 300 cruise liner fis-sena li ġie Malta.

Il-Cruise liners jużaw ħafna elettriku.

Il-grupp ambjentali T & E (Transport and Environment) f’ rapport li kien ħareġ u li kien hemm referenza għalih fil-media lokali, kien qal li l-emmissjonijiet tal-kubrit mill-cruise liners li żaru Malta żdiedu biex fl-2017 kienu madwar 148 darba tal-emissjonijiet tal-kubrit mill-karozzi karozzi kollha fil-gżejjer Maltin dakinnhar. Din il-konklużjoni kienu waslu għaliha meta studjaw informazzjoni li kisbu mis-satelliti.

Dawn il-vapuri l-kbar jagħmlu użu mill-heavy fuel oil, żejt li kif smajna ħafna drabi tul is-snin iħammeġ ħafna. Fost oħajn fih ammont għoli ta’ kubrit – madwar 3,500 darba daqs kemm hemm fil-fuel li jintuża għall-karozzi.

Jista’ jkun hemm nuqqas ta’ qbil fuq iċ-ċifri eżatti tal-emissjonijiet minn dawn il-vapuri. Ħadd iżda ma jkkontesta li dawn huma sostanzjali.

Il-komunità internazzjonali tfittex kontinwament li tirregola dak li jseħħ fl-ibħra internazzjonali. Aħna, iżda, bħala pajjiż għandna noqgħodu ferm iktar attenti għal dak li qed jiġri fil-portijiet u l-ibħra tagħna. L-emissjonijiet, b’mod partikolari dawk ta’ trab fin minn vapuri fil-portijiet u l-ibħra Maltin għandhom impatt dirett fuq il-komunitajiet residenzjali li jgħixu fil-madwar. Dan jgħodd b’mod partikolari għall-lokalitajiet fil-Port il-Kbir kif ukoll għal dawk fill-Bajja ta’ Marsaxlokk.

Hemm żewġ materji partikolari li għandhom jingħataw prijorità. L-ewwel nett hemm ħtieġa li l-awtoritajiet regolatorji Maltin jinfurzaw b’mod strett ir-regoli ta’ l-Unjoni Ewropea li jobbligaw lill-operaturi tal-vapuri li fil-portijiet juzaw zjut li jniġġsu inqas u b’mod partikolari li dawn ikollhom kontenut baxx ta’ kubrit. It-tieni miżura meħtieġa hi dwar it-titjib fl-infrastruttura tal-portijiet tagħna biex ikun possibli illi l-vapuri li jidħlu fil-portijiet tagħna jagħmlu użu minn elettriku ġġenerat fuq l-art u b’hekk ikun possibli illi jintfew il-ġeneraturi tal-elettriku fuq il-vapuri. Miżura ta’ din ix-xorta telimina t-tniġġiż tal-vapuri fil-portijiet tagħna minn dak il-mument li jitfew il-ġeneraturi.

F’Malta diġa saru tal-inqas żewġ studji dwar l-implikazzjonijiet kemm-il darba l-vapuri li jżuru Malta jkollhom jagħmlu użu minn elettriku ġġenerat fuq l-art. L-ewwel studju kien sar fuq talba ta’ Transport Malta u kien konkluż fl- 2014 filwaqt li t-tieni wieħed, li kienkonkluż fl-2018 kien ġie kkummissjonat mill-management tat-Terminal tal-Port Ħieles. Iż-żewġ studji kkonkludew illi kemm-il darba l-vapuri li jżuru Malta jibdew jagħmlu użu minn elettriku ġġenerat mill-art, meta jkunu fil-portijiet tagħna, ikun hemm titjib sostanzjali fil-kwalità tal-arja fl-istess portijiet u fil-lokalitajiet kollha li jmissu magħhom. Ir-rapporti jikkonkludu ukoll li dwar jekk dan jaqbilx ekonomikament jew le, fl-aħħar jiddependi fuq kif jaġixxu l-kompetituri tagħna!

Irridu nistaqsu mistoqsija waħda ċara: jagħmel sens li ninkoraġixxu u niddependu fuq ħidma ekonomika li tagħmel ħsara lil saħhitna?

It-tweġiba għal din il-mistoqsija hi ovvjament le. Il-portijiet tagħna huma riżors prezzjuz li għandna nużawh biex intejbu l-kwalità tal-ħajja tal-kommunitajiet madwar il-kosta.

Air Pollution in our ports

The quality of the air we breath in our major ports is worrying. More residents in the areas around our ports are aware of this and are demanding action: they are all worried by the astronomic increases in the incidence of respiratory illnesses.

Around 12 months ago Maltese eNGO Birdlife carried out an air quality measurement exercise with the support of German experts from the German eNGO Nature and Biodiversity Union (NABU). Air samples taken from the Grand Harbour area indicted the presence of a high level of microscopic particulate matter, which ends up in our lungs.

The Grand Harbour is a hub of shipping activity and also includes a cruise liner terminal which, during the last five years, has had an average annual call rate of over 300 cruise liners.

Cruise liners make use of a large amount of electricity.  In a report covered in the local media, the campaign group T & E (Transport and Environment) said that sulphur emissions from cruise liners visiting Malta in 2017 were around 148 times as much as those emitted from the entire car fleet on the islands. This conclusion was reached after analysing satellite data.

In an investigative report it carried out two years ago focused on the P & O cruise liner company, the UK Television Channel 4 concluded that a cruise liner carrying around two thousand passengers had a daily pollution equivalent to one million cars. Large ships run on heavy fuel oil, which contains 3.5% sulphur – 3,500 times what is permitted in road fuel. There may be a lack of agreement on the exact figures for emissions from the shipping industry, but no one contests that they are substantial.

The international community continuously deals with what happens on the high seas. We can, however, deal more appropriately with what goes on in our ports. Particulate emissions in our ports by the shipping industry has a direct bearing on the residential communities surrounding our ports, notably Grand Harbour and Marsaxlokk Bay.

There are two specific issues which need to be prioritised. The first is for the regulatory authorities to ensure that EU legislation on restricting fuel use to the low sulphur type is observed. The second concerns the need to focus on infrastructural improvements in our ports to facilitate supplying the shipping industry with shore-based electricity, as a result ensuring that the ships’ generators – and consequently the resulting emissions to air –  stops when the ship berthed.

Two studies have already been carried out in Malta on the implications of a shore-to-ship electricity supply for the shipping industry. The first, which was completed in 2014, was carried out by Transport Malta and the second, carried out on behalf of the Malta Freeport Terminals, was completed in 2018. Both studies came to the conclusion that if the shipping industry changed to shore-side electricity there would be a substantial improvement in air quality in our ports. The issue of feasibility, however, is substantially dependent on what our competitors decide!

Does it make sense to keep encouraging economic activity that harms our health? The answer to this question is a definite “no”. Our ports are a most precious natural resource that we should use to enhance the quality of life of our coastal communities.

Il-mużika ta’ matul il-lejl

Ir-ritratti mis-satellita juru kemm hu kbir it-tniġġiż mid-dawl f’Malta. Fil-fatt, dan hu komparabbli mat-tniġġiż miż-żoni urbani fil-kontinent Ewropew! It-tniġġiż mid-dawl ma jħallix li nisimgħu l-mużika ta’ matul il-lejl. Joħnoqha u jżommna milli napprezzaw is-sbuħija tal-lejl li bil-mod jurina dak li jostor. Hekk jemfasizza l-Ħares tal-Opra (Phantom of the Opera) fix-xogħol tejatrali kapulavur ta’ Andrew Lloyd Webber.

Xi snin ilu waqt dibattitu dwar il-baġit ġie varat proġett biex id-dwal tat-toroq ikun ikkontrollat b’mod elettroniku. Proġett li meta jkun implimentat għandu jkun ta’ kontribut sostanzjali biex fil-gżejjer Maltin jonqos it-tniġġiż mid-dawl. Imma sfortunatament ftit li xejn smajna dwar xi progress seta’ kien hemm dwar din il-materja mill- 2013 lil hawn, meta tħabbar il-proġett.

Id-dawl eċċessiv użat matul il-lejl mhux biss hu użu ħażin u ineffiċjenti tal-enerġija imma jagħti kontribut konsegwenzjali għal emissjonijiet tal-karbonju li jistgħu jkunu evitati. B’dan il-ħajja fin-natura tul il-lejl qed tiġi ddisturbata u potenzjalment ukoll hi kawża għal ħsara lis-saħħa umana.

Fl-2007, il-Birdlife f’Malta ippubblikat studju dwar l-impatt tad-dwal bil-lejl fuq l-għasafar li jgħixu fl-irdumijiet u qrib il-baħar kif ukoll speċi oħra li jpassu bil-lejl. L-istudju hu intitolat Light Pollution and its effects on Yelkouan Shearwaters in Malta; causes and solutions. Il-kuntest tal-istudju kien proġett fl-iskema EU Life fl-Aħrax tal-Mellieħa fl-inħawi magħruf bħala l-Irdum tal-Madonna, sit li hu kolonja tal-garni, għasfur li jgħix mal-baħar.

L-osservazzjonijiet fir-rapport u s-soluzzjonijiet proposti jistgħu faċilment iservu ta’ bażi għal pjan ta’ azzjoni biex fil-gżejjer Maltin nibdew nindirizzaw bis-serjetà t-tniġġiż mid-dawl billi dan f’Malta mhux biss hu ta’ theddida għall-garnija (Yelkouan Shearwater)imma ukoll kawża ta’ emissjonijiet ta’ karbonju bla bżonn u theddida għall-kwalità tal-ħajja tagħna lkoll.

Bħala riżultat tad-densità qawwija ta’ popolazzjoni, t-tniġġiż mid-dawl matul il-lejl għandu impatt konsiderevoli kemm fuq iż-żoni urbani kif ukoll fuq dawk rurali tal-gżejjer Maltin. Ekologikament għandu impatt fuq l-għasafar, friefet u insetti kif ukoll friefet il-lejl imma ukoll fuq l-imġieba tal-annimali b’mod ġenerali. Lil hinn mill-ħajja naturali, it-tniġġiż mid-dawl joħloq leħħ qawwi li jweġġa’ l-għajn u li għandu impatt fuq is-sigurtà fis-sewqan. Jeffettwa lil min isuq, lil min jimxi, kif ukoll lil min juża’ r-rota u jagħti kontribut mhux żgħir fl-inċidenti tat-traffiku li jseħħu matul il-lejl.

Il-każ dwar it-tniġġiż mid-dawl fid-Dwejra deċiż mit-Tribunal ta’ Reviżjoni dwar l-Ambjent u l-Ippjanar nhar is-27 ta’ Ġunju hu każ rari fejn deċiżjoni tajba tal-Kummissjoni għall-Kontroll tal-Iżvilupp tinbidel mit-Tribunal fl-appell: ġeneralment bil-maqlub jiġri. Meta jinbidlu, s-soltu jkunu d-deċiżjonijiet il-ħżiena li jinbidlu, mhux dawk tajbin! Fil-fatt il-Kummissjoni għall-Kontroll ta’ l-Iżvilupp kienet irrifjutat l-applikazzjoni oriġinali minħabba li l-inħawi tad-Dwejra huma żona ta’ importanza ekologika. Sfortunatament it-Tribunal ittratta it-tniġġiż mid-dawl b’mod leġġer u kien insensittiv għall-impatti ekoloġiċi.

Li l-15-il għaqda ambjentali ngħaqdu biex jiġbru l-fondi ħalli tkompli l-ġlieda b’appell fil-Qrati hu pass tajjeb ‘il-quddiem. Il-ħarsien tas-siti tan-Natura 2000 hi għadma iebsa, imma jeħtieġ li jibqa’ għaddej. Imma li jsir appell minn din id-deċiżjoni skandaluża tat-Tribunal ta’ Reviżjoni tal-Ambjent u l-Ippjanar għandu jkun biss l-ewwel pass.

Għandna nirrejalizzaw li l-Awtorità għall-Ambjent u r-Riżorsi għandha l-poter u l-awtorità taħt id-Direttiva Ewropea dwar l-abitati li mhiex tagħmel użu tagħhom sewwa. L-ERA għandha tasserixxi ruħha u tenforza r-regoli, u jekk hemm bżonn tibqa’ għaddejja minn fuq l-Awtorità tal-Ippjanar kif tista’ u għandha tagħmel kull meta dan ikun neċessarju.

Ikun ferm aħjar kieku l-Ministru għall-Ambjent jinsisti mal-ERA biex din tieħu ħsieb iż-żoni ekoloġiċi sewwa. Ovvjament għandu jassigura li jkunu ipprovduti riżorsi adegwati.

The music of the night

Satellite photos clearly indicate the extent of light pollution in Malta: it is comparable to that in most urban areas in the European continent. As a result, the music of the night is made inaudible. The night is being “impeded from unfurling its splendour”, as the Phantom of the Opera repeatedly emphasises in Andrew Lloyd Webber’s masterpiece.

Some years back, during the budget debate, a project related to intelligent street lighting was launched. When implemented, such a project would be an effective contribution to the reduction of light pollution all over the Maltese islands. Unfortunately, we have not heard of any substantial progress on the matter since late 2013, when the project was first announced.

Excessive artificial lighting used during the night is not only an inefficient use of energy, and the consequential contribution to additional carbon emissions which can be avoided, it is also a disturbance of nocturnal animal life and potentially injurious to human health.

Way back in 2007, Birdlife in Malta had published a study on the impact of night lighting on seabirds and nocturnal migrant species. The study is entitled Light Pollution and its effects on Yelkouan Shearwaters in Malta; causes and solutions. The context of the study is the EU Life project site at l-Aħrax in Mellieħa, in the area known as l-Irdum tal-Madonna, the site of a seabird colony.

The observations made and the solutions proposed in the study could easily form the basis for an action plan applicable to all of the Maltese islands to address light pollution because, in Malta, this is a serious problem not just for shearwaters but also in terms of carbon emissions and our quality of life.

As a result of Malta’s high population density, nocturnal light pollution has a considerable impact on both urban and rural areas all over the Maltese Islands. Ecologically, it has an impact on birds, moths and bats but it also has a considerable impact on animal behaviour in general. Beyond wildlife, light pollution creates glare which is a road safety issue and has an impact on drivers, pedestrians and cyclists and is known to play a considerable part in nocturnal traffic accidents.

The Dwejra light pollution case decided by the Environment and Planning Revision Tribunal on the 27 June is a rare case when a sensible decision was taken by the Planning Control Commission only for it to be reversed on appeal: normally it is the other way round! In fact, the Planning Control Commission had refused the original application on the basis that the Dwejra area is an area of ecological importance. Unfortunately, the Tribunal treated the issue of light pollution very lightly and was insensitive to its ecological impacts.

The coming together of fifteen environmental NGOs to crowd-fund the fight on appeal in Court is a good step forward. Protecting Natura 2000 sites is a tough fight but it needs to go on. Appealing against the scandalous decision of the Environment and Planning Revision Tribunal should, however, only be a first step. It should be realised that the Environment and Resources Authority (ERA) has powers and authority under the provisions of the EU Habitats Directive that it does not make sufficient use of. The ERA should assert itself and enforce the rules, bulldozing through the Planning Authority whenever this is necessary.

It would be much better if the Hon. Minister for the Environment insists that the ERA manages areas of ecological importance appropriately. Obviously, he must ensure that adequate resources are provided.

This Dwejra case is a specific example of where the ERA can have the final word. Will it?

Il-kaċċa fir-rebbiegħa: referendum ieħor?

 

F’konferenza tal-aħbarijiet illum il-Birdlife qalet li qed tikkunsidra jekk għandhiex tibda t-triq biex jissejjaħ referendum abrogattiv ieħor dwar il-kaċċa.

Il-Birdlife hi motivata mill-attitudni tal-Gvern li jfittex kontinwament li jikkuntenta lill-kaċċaturi. F’dawn iċ-ċirkustanzi, tgħid il-Birdlife, m’għandiex triq oħra. Għax la ma tistax tasal bir-raġuni mal-Gvern, tipprova tasal bil-vot permezz ta’ referendum.

Ir-referendum tal-2015 dwar il-kaċċa fir-rebbiegħa ntilef bi ftit: tikka iktar minn 2000 vot. Il-Birdlife taħseb li r-riżultat din id-darba jkun differenti minħabba li l-ebda wieħed mill-mexxejja politiċi m’hu qed jirrappresenta l-interessi tal-ambjent.

L-analiżi biex ikun ġustifikat referendum abrogattiv ieħor dwar il-kaċċa (fir-rebbiegħa) trid tibda minn analiżi profonda tar-referendum tal-2015. Trid tkun analiżi li twassal biex wieħed jifhem sewwasew x’ġara.

Jiena naqbel li l-kaċċa fir-rebbiegħa tieqaf illum qabel għada imma għadni mhux konvint li d-diffikultajiet li wasslu għat-telfien tar-referendum abrogattiv tal-2015 għad jistgħu jingħelbu f’dan il-mument. Il-ħidma li trid issir hi kbira ħafna.

Huwa tajjeb li l-Birdlife iżżomm l-arma ta’ referendum abrogattiv bħala oġġettiv għax fl-aħħar mill-aħħar, probabbilment li din hi l-unika triq prattika. Imma l-ostakli mhumiex żgħar u biex naslu mhux faċli daqskemm wieħed jista’ jaħseb.

L-esperjenza tgħallimna kontinwament li filwaqt li l-opposizzjoni għall-kaċċa hi kbira, meta niġu għall-vot ikun hemm kwantitá ta’ persuni li joqgħodu lura u dan għal elf raġuni. Hekk ġara fl-2015 u wisq nibża’ li s-sitwazzjoni għadha sostanzjalment l-istess.

Il-qerda tal-għasafar protetti tkompli

Nhar l-Erbgħa il-BirdLife Malta ġabret tliet għasafar protetti midruba – Russett Aħmar (Purple Heron), Bagħdan Aħmar (Marsh Harrier) u Gamiema tal-Kullar (Collared Dove). It-tliet għasafar kienu rraportati minn membri tal-pubbliku u kkonfermati minn veterinarju li soffrew feriti kaġun ta’ tiri ta’ senter.

Ir-Russett Aħmar li instab fl-inħawi ta’ Mġarr ix-Xini f’Għawdex, kellu ksur fil-ġewnaħ tax-xellug u kellu jitraqqad kawża tal-feriti li ġarrab.

Bagħdan Aħmar inġabar minn Birzebbuga b’ferita fil-ġewnah tal-lemin. Ritratt bl-X-ray ikkonferma li l-għasfur kellu ferita qadima fil-ġewnaħ tax-xellug li kienet fieqet, madankollu ġarrab ferita friska minn tir ta’ senter li kkawza ksur fil-ġewnaħ tal-lemin u ħalla diversi ċomb f’ġisem l-għasfur. Il-Bagħdan ġie mgħoddi lill-puluzija tal-ALE.

Kemm il-Bagħdan Aħmar, kif ukoll ir-Russett Aħmar huma żewġ speċi fost li jaqgħu taħt Anness 1 tad-Direttiva tal-Għasafar u li għandom l-ogħla forma ta’ ħarsien.

Gamiema tal-Kullar, tajra oħra protetta, instabet fil-Madliena b’ ferita fil-ġewnaħ tax-xellug ukoll kaġun ta’ tir ta’ senter. L-għasfur qiegħed jingħata l-kura meħtiega.

 

Dawn l-inċidenti jġibu għal 4 t-total ta’ għasafar midruba kawża ta’ kaċċa llegali li l-BirdLife Malta ġiet mgħodija minn membri tal-pubbliku. Il-BirdLife Malta tisħaq li dawn l-inċidenti huma indikazzjoni tal-ammont ta’ kaċċa llegali li qed isseħħ f’dawn iż-żminijiet b’diversi tajr protett ieħor maqtul li ma jiġix irrapportat. Il-BirdLife tixtieq tfakkar lil membri tal-pubbliku biex jirraportaw kaċċa llegali lill-pulizija fuq 119 jew lill-għaqda fuq 21347644.

Ir-referendum u l-partiti politiċi (2)

Joseph Muscat qal li hu kien ser jivvota IVA. Qal ukoll li l-Partit Laburista ma kienx ser jinvolvi ruħu fil-kampanja referendarja.

L-istrateġija politika tal-Partit Laburista kienet waħda ċara ħafna. Kienet illi jipprova jagħti palata lill-kaċċaturi mingħajr ma jiġġieled mal-ambjentalisti.  Għalhekk dak li qal Joseph Muscat.

Meta, iżda, beda jidher illi parti mdaqqsa tal-votanti Laburisti kienu fehmu dan il-messaġġ bħal li setgħu jivvutaw kif xtaqu u fil-polls (kemm dawk pubblikati kif ukoll dawk li nżammu kunfidenzjali) beda jidher vantaġġ għal-LE, anke b’voti minn żoni tradizzjonalment laburisti, bdiet tiżdied id-doża tal- involviment tal-Partit Laburista fil-kampanja referendarja.

Il-kandidati Laburisti għall-Kunsilli Lokali (f’ħafna lokalitajiet) huma u jduru d-djar bdew jikkampanjaw favur l-IVA. Bdew ukoll it-telefonati, prinċipalment fl-aħħar ġimgħa.  Anke fid-djar ta’ attivisti tal-Birdlife u tal- ADZ (AD Żgħażagħ) ċemplu jikkampanjaw favur l-IVA. Araw ftit dak li kiteb Steve Borg, ambjentalist rispettat u ex-kandidat tal-Partit Laburista għall-Parlament Ewropew.

Jiena m’inix sorpriż b’dan kollu minħabba li l-Partit Laburista kellu commitment politiku fuq il-materja. Kien baħnan min emmen jew ittama li l-Partit Laburista ser jibqa’ barra mill-kampanja u b’ħalqu magħluq. Il-kritika tiegħi lill-Partit Laburista mhux li ikkampanja favur l-IVA, iżda li ma kellux il-kuraġġ li dan jikkonfermaħ fil-pubbliku. Ipprova jistaħba wara subgħajh.

It-tlett partiti politiċi f’Malta ħadu posizzjonijiet kompletament differenti fir-referendum abrogattiv dwar il-kaċċa fir-rebbiegħa.

Alternattiva Demokratika ġiebet flimkien l-għaqdiet ambjentali kollha u flimkien magħhom organizzat il-ġbir tal-firem li kienu meħtieġa biex ir-referendum ikun jista’ jsir.  Sad-data tad-deċiżjoni tal-Qorti Kostituzzjonali  Alternattiva Demokratika kellha rwol ċentrali fil-kampanja referendarja. Wara dik id-data dan ir-rwol ċentrali kif inhu xieraq għadda għand il-Birdlife. Alternattiva Demokratika baqgħet tinvolvi ruħa fil-preparamenti kollha meħtieġa.

Throughout this Sunday morning the Electoral Commission will supervise the counting of the votes cast  in yesterday’s  spring hunting abrogative referendum. The first reliable projections of the result should be available at around  10.00am with a final result early in the afternoon.

Irrespective of the result, this is history in the making as, for the first time ever, Maltese voters will be directly taking a decision on environmental policy. They will decide whether spring hunting in the Maltese islands will be consigned to the history books.

This is the end of a two year journey that began in  April 2013 when the first steps were taken to form a broad-based anti-spring hunting Coalition of  environmental NGOs together with Alternattiva Demokratika-The Green Party in Malta. Initially, Alternattiva Demokratika’s initiative was met with scepticism: there was widespread fear of confronting the parliamentary political parties which had created the current spring hunting mess.

Constructive dialogue with both the Maltese authorities as well as with the EU Commission had failed to yield results, yet when push came to shove there was still considerable reluctance to think outside the box.  This mess could not be cleared by applying the same thinking that led to its creation. The spring hunting mess was created by successive governments that were held to ransom by the hunting lobby. There was only one solution: government was the problem so it could never be part of the solution – civil society had to take back control of the decision-making process to have order restored.

This was going to be a mammoth task. The fact that the abrogative referendum tool had never been used since its introduction in 1998 understandably added to the reluctance.

As late as 18 June 2013, some environmental NGOs were still hoping that the Maltese Government, or the EU Commission itself, would act in a reasonable manner and stop spring hunting.  In fact, reports in the press at that time were speculating on then EU Environment Commissioner Janez Potočnik initiating an inquiry into spring hunting in Malta.

Early in the day, few people were conscious of the empowerment potential of the abrogative referendum. Almost none of the eNGOs was aware that the abrogative referendum process is independent  of government or Parliament.  Some eNGOs  supported the initiative almost immediately but it was an uphill struggle to convince others, taking weeks and a great deal of patience until practically all eNGOs were on board.

The collection of signatures to initiate the process for calling this abrogative referendum was launched on 10 August 2013 at Il-Buskett. Initially the uptake was very slow, as voters took some time to understand that this was no ordinary petition.

Then, on 23 and 24 October 2013, one of the worst massacres of wild birds in Malta took place. It is best described in a Birdlife Press release which stated  as follows :

“Despite the presence of six BirdLife Malta teams and as many ALE units in the Buskett area this morning at least one Booted Eagle, Ajkla tal-Kalzetti, was shot down inside Buskett Gardens as it left its roost this morning. Several others, including Short-toed and Booted Eagles, were shot at and many more were seen carrying injuries after last night’s shooting spree by hunters in Dingli, Buskett, Girgenti, Siġġiewi and Zebbuġ.

This morning’s second confirmed victim was a Short-toed Eagle, Ajkla Bajda, shot down in Gozo.

The shootings follow what can only be described as a massacre yesterday evening, after more than 50 eagles were seen by birdwatchers counting passing migrating birds in their regular watch-point above the wooded valley of Buskett. At least 10 eagles are known to have been shot down and many more targeted by dozens of hunters in locations around Buskett. Several as yet unconfirmed reports were also received from members of the public who saw eagles and other large birds of prey being shot at and shot down.”

This marked the turning point in signature collection as within ten days of the massacre of these eagles the required number of signatures had been received . The verification process was commenced immediately and the petition was finalised for submission to the Electoral Commission.

By July 2014, the Electoral Commission had concluded its vetting of the signatures submitted and six months later, in January this year, the Constitutional Court threw out the hunters’ objections.

For the past three months we have been actively campaigning to drive the message home: spring is the time when birds are on the way to their breeding grounds. They need to be protected. This message has been conveyed through the different spokesman and women ambassadors who, together with hundreds of volunteers, have done wonders to ensure that practically every voter is aware the he or she has the power to take a decision in order to clean up the mess which Parliament and the government have created over the years.

Today we will know what the decision is.  Saving any last minute surprises, it is clear that after today’s result Maltese civil society will cherish its newly discovered empowerment. Tomorrow, Monday, will not be just the start of a new week.  Hopefully, it be the start of a new era of ever-vigilant NGOs, now armed with the knowledge that they can hold government to account for inadequate legislation whenever they consider that this is necessary.

The abrogative referendum is the tool through which civil society can bring government to order. Today’s result will just confirm whether it can make use of it.

Abolish spring hunting

Spring hunting has been a contentious issue for many years in the Maltese Islands. Throughout the years both the Labour Party and the Nationalist Party have sought to deal with spring hunting through backroom deals with organisations representing the hunting community. Time and again promises to uphold hunters’ privileges have been made by both the Labour Party and the Nationalist Party.

Only one political party in Malta, Alternattiva Demokratika-The Green Party, expressed itself clearly and unequivocally against spring hunting. The others boot-licked their way through imaginary exceptions and ineffective enforcement measures.

The current state of affairs is the direct result of government policies which have repeatedly ignored Malta’s obligations. Unfortunately even the Environment Directorate General of the European Union has proven itself to be ineffective in enforcing the provisions of the Birds’ Directive in Malta. Hence the only practical solution to tackle spring hunting is for the Maltese electorate to decide the matter itself as is provided for in the Referenda Act.

The Coalition for the Abolition of Spring Hunting is composed of Ramblers Association of Malta, Nature Trust (Malta), Movement of Organic Agriculture in Malta (MOAM), Moviment Graffiti , International Animal Rescue Malta, Greenhouse Malta, Gaia Foundation,Friends of the Earth Malta, Flimkien għal Ambjent Aħjar (FAA), Din l-Art Ħelwa,Coalition for Animal Rights, Birdlife Malta and Alternattiva Demokratika. It was formed some eight months ago for one specific purpose: the abolition of spring hunting at the earliest possible date.

Last week, the Coalition submitted a petition to the Electoral Commission calling for an abrogative referendum to end spring hunting on the Maltese islands. The signatures to the petition had to exceed 10% of the registered voters in the latest electoral register, that is 33,418 signatures were required as a minimum.

44,376 persons signed the referendum petition making it the first ever submitted petition requesting an abrogative referendum in the Maltese islands since the Referenda Act was amended in 1996 to introduce the right to call an abrogative referendum.  Those who signed the petition have considered it their duty to respond to the Coalition’s invitation because they care. They care about the birds and they care about Malta. They deserve everybody’s appreciation as their commitment is sending one clear message: that voters can decide on spring hunting and in so doing they will clear the mess created by the parliamentary political parties.

This is an historic moment, very important for the protection of biodiversity but also of paramount significance in the development of democracy in the Maltese islands. It was not easy to achieve and cannot be underestimated.

There are various reasons which have motivated voters to sign the petition calling for a referendum to abolish spring hunting.

Spring is breeding time for birds which fly over the Maltese islands on their way back to mainland Europe. Signatories to the referendum petition believe that birds should be able to fly safely over Malta on the way to their breeding grounds.

During the spring hunting season, when nature is at its best, people do not feel at ease in the Maltese countryside as they consider themselves to be under the constant threat of hunters, few in number but convinced just the same that they have a free hand. Access to the countryside during spring is further hampered by public footpaths which are closed to the public so as to facilitate the free access of hunters. The aggressiveness of some hunters has given all their colleagues a bad name.

Spring is a very special time of year when the Maltese countryside invites all to appreciate its abundance of life and colour. Those who have signed the petition feel that they are being impeded from enjoying nature’s gifts. Furthermore, hunting in spring definitely has a negative impact on birds which breed or can breed in the Maltese islands.

A large number of the signatories of the petition believe that the deals (both secret and the not so secret) that the hunting lobby has signed with successive governments to gain more privileges is not how a modern democracy should function. They believe that governments should work in the common interest. This has not been the case so far and the only solution is the utilisation of the referendum as a decision tool. It is only the referendum which will settle matters once and for all.

These birds flying through our airspace in spring do not belong to us. Other countries dedicate a lot of time and resources to ensure that these birds are adequately protected, only to be blasted when they fly through Malta.

We now await the Electoral Commission to verify the petition signatures and hand over the process to the Constitutional Court. This will enable all of the Maltese voters to finally have their voice heard on spring hunting so it can be stopped on these islands once and for all.
