L-iżbilanċ ambjentali

L-iżbilanċ ambjentali qiegħed dejjem jiżdied. Fid-diskors twil iżżejjed tiegħu meta ħabbar il-Baġit, il-Ministru tal-Finanzi Edward Scicluna dan il-fatt ma jagħtix kas tiegħu.

L-iżviluppaturi tal-propjetà, permezz tal-assoċjazzjoni tagħhom l-MDA esprimaw is-sodisfazzjon tagħhom dwar Baġit li għal darba oħra aċċetta l-proposti tagħhom biex l-iskemi ta’ inċentivi dwar tnaqqis ta’ taxxi marbuta max-xiri tal-propjetà jkunu estiżi. Il-Baġit jippreżenta dawn il-proposti b’libsa ta’ proposti soċjali. Fir-realtà huma miżuri kontra l-ambjent għax għandhom impatt dirett fuq iktar żvilupp ta’ art kif ukoll fuq l-intensifikazzjoni tal-iżvilupp fiż-żoni urbani tagħna.

It-turiżmu tal-Cruise liners huwa mfaħħar fid-diskors tal-Baġit. Il-Ministru Scicluna jentużjażma ruħu ftit iżżejjed meta jħabbar fid-diskors tiegħu li l-industrija tal-cruise liners f’Malta kibret b’75% tul dawn l-aħħar sitt snin. Il-Ministru Scicluna, probabbilment mhux konxju biżżejjed li l-industrija tal-cruise liners hi kontributur mhux żgħir fil-kontaminazzjoni tal-kwalità tal-arja.

Jeżistu diversi studji dwar l-impatti ambjentali tal-cruise liners fl-ibħra internazzjonali. Il-materja kienet mistħarrġa ukoll minn għaqda ambjentali lokali bl-għajnuna ta’ għaqda ambjentali Ġermaniża. Il-kampjuni tal-arja li ħadu mill-inħawi tal-Port il-Kbir jindikaw preżenza mhux żgħira ta’ partikoli mikroskopiċi fl-arja li qed jispiċċaw fil-pulmun ta’ dawk li jgħixu, jaħdmu inkella sempliċiment jgħaddu mil-lokalitajiet madwar il-Port il-Kbir. Bla dubju l-istess ħaġa insibuha f’Birżebbuġa bħala riżultat tal-operazzjonijiet tal-Port Ħieles.

Biex dan ikun indirizzat, soluzzjoni possibli tkun l-introduzzjoni ta’ obbligu li l-vapuri jagħmlu użu minn elettriku ġġenerat fuq l-art meta dawn ikunu mal-moll. Dwar dan diġa saru studji preliminari. L-istudji, iżda, mhumiex biżżejjed. Jirrikjedu ukoll id-disponibilità għall-azzjoni – disponibilità li presentement ma teżistix. L-istudju dwar il-Port il-Kbir sar fl-2014 filwaqt li dak dwar Birżebbuġa sar fl-2018. Dwar dan kollu d-diskors tal-Baġit hu sieket.

Il-Gvern għadu ma ħabbarx id-data li minnha ‘l-quddiem mhux ser ikun possibli li jkunu impurtati f’Malta karozzi li jaħdmu bil-petrol jew bid-diżil. Ġejna nfurmati li din id-data tista’ titħabbar fl-2020. It-tfassil tal-istrateġija tal-Gvern f’dan il-qasam qed tieħu fit-tul biex tieħu sura meta kien il-Prim Ministru nnifsu li ħabbarha iktar minn sentejn ilu. Ma hemm l-ebda serjetà fil-mod kif din l-istrateġija qed tkun imfassla. Il-materja mhix biss dwar li ma nimpurtawx iktar karozzi li jaħdmu bil-petrol jew bid-diżil.

Tinvolvi ukoll l-interess esaġerat kurrenti fl-iżvilupp ta’ pompi tal-petrol ġodda f’diversi inħawi ta’ Malta. Għax xi ħtieġa hemm għal iktar pompi tal-petrol meta d-deċiżjoni dwar l-elettrifikazzjoni tat-trasport privat qiegħed wara l-bieb? Moratorju immedjat dwar l-iżvilupp ta’ pompi tal-petrol ġodda kienet tkun deċiżjoni tajba u f’waqtha, meta hu aċċettat minn kulħadd li ma hemmx użu għalihom!

Il-Baġit, ifaħħar u jiftaħar bl-investiment massiċċ fl-infrastruttura tat-toroq. B’mod partikolari dwar mini jew fly-overs li x-xogħol dwarhom għaddej inkella qiegħed fi stadju avvanzat ta’ ippjanar.

Il-ġustifikazzjoni għal dan, minn dikjarazzjonijiet diversi li saru matul ix-xhur li għaddew, hi, biex tkun indirizzata l-konġestjoni tat-traffiku. Studji li saru madwar id-dinja kollha repetutament żvelaw li dawn it-tipi ta’ żviluppi fl-infrastruttura tat-toroq inevitabilment twassal għal-iktar traffiku.

Il-Minstru dan kollu jinjorah u jibqa’ jinsisti li jarmi daqstant miljuni ta’ ewro. Apparti li jgħarbel ftit l-esperjenza f’pajjiżi oħra, l-Onor. Ministru għandu jikkonsulta ruħu wkoll mal-Master-Plan għat-Trasport li tfassal taħt id-direzzjoni tal-Gvern li minnu jifforma parti u li b’mod mill-iktar ċar ifisser kif it-tnaqqis tal-karozzi privati mit-toroq tagħna hu għan essenzjali. Il-Ministru għall-Finanzi għandu jfittex li jkun jaf l-għaliex il-Gvern jitlob il-pariri u mbagħad dawn ikunu injorati.

Fl-aħħar il-Gvern irrealizza li hemm ħtieġa ta’ strateġija għal Green New Deal. Din hija strateġija li tindirizza l-impatti tat-tibdil fil-klima b’mod sostenibbli: ekonomikament, ekologikament u soċjalment. Imma biex strateġija ta’ dan ix-xorta tkun tagħmel sens, il-Gvern għandu, l-ewwel u qabel kollox iżarma l-istrateġiji li diġa għandu u li huma dijametrikament opposti għall-Green New Deal.

Ma jagħmilx sens, per eżempju, li filwaqt li l-Gvern repetutament jiddikjara ruħu favur il-ħtieġa tal-ħarsien ambjentali, imma mbagħad kontinwament joħroġ inċentivi biex jinkoraġixxi is-suq tal-propjetà. Lanqas ma jagħmel sens li jibqa’ għaddej bil-programm intensiv tal-iżvilupp tal-infrastruttura tat-toroq jew li jibqa’ għaddej bil-pjani dwar l-iżvilupp tal-mina bejn Malta u Għawdex li inevitabilment ser isservi biex iktar karozzi jaqsmu bejn il-gżejjer b’faċilità.

Flok l-għotjiet għax-xiri tal-batteriji għall-ħażna tal-elettriku ġġenerat mill-pannelli fotovoltajiċi kien ikun ferm aħjar kieku l-Gvern jagħti bidu għal investiment massiv biex ikun assigurat li s-sistema tad-distribuzzjoni tal-elettriku titjib għax hu b’dan li jista’ jkun aċċertat illi fid-djar tagħna jkun possibli li niġġeneraw iktar elettriku mix-xemx. In-nuqqas ta’ miżuri effettivi biex tkun iġġenerata iktar enerġija minn sorsi rinovabbli juru kemm mhu veru xejn li l-Gvern hu kommess favur t-tfassil u l-implimentazzjoni ta’ strateġija dwar il-Green New Deal.

Il-Ministru tal-Finanzi qed jgħaddina biż-żmien meta f’nifs wieħed jinsisti jitkellem dwar Għawdex bħala gżira ekoloġika filwaqt li jibqa’ jinsisti fuq “ħtieġa” għall-mina bejn il-gżejjer. Mina li ser taċċellera l-ħsara ambjentali fil-gżira Għawdxija.

L-iżbilanċ ambjentali qed jikber kontinwament, bla ebda kontroll ta’ xejn.

The environmental deficit

The environmental deficit is still rising and  the long-winded Budget speech by Finance Minister Edward Scicluna last Monday did not address it.

Through the MDA, their association, property developers have expressed satisfaction at the Budget as, once more, it has taken up their proposals intended to further extend tax incentive schemes linked to the purchase of property. The budget presents these measures as being of a social nature when, in fact, that are anti-environmental measures because their direct impact is the take-up of more land as well as additional pressure on the intensification of the development of our urban areas.

Cruise liner tourism comes in for substantial praise in the Budget speech. Minister Scicluna was over-enthusiastic in announcing that there has been a 75 per cent  increase in the cruise liner industry in Malta over the last six years. He may not be sufficiently aware that the cruise liner industry is a substantial contributor to the degradation of air quality. Various studies have been carried out on the environmental impacts of cruise liners on the high seas and the subject has also been studied by a local environmental NGO with the support of their German counterparts.

Their studies revealed that air samples taken from the Grand Harbour area indicte the presence of a high level of microscopic particulate matter, which is ending in the respiratory systems of those living, working or passing through this area. Similar issues undoubtedly exist in Birżebbuġa as a result of the operations of the Freeport.

A possible solution to address this problem  is the introduction of a compulsory shore-to-ship electricity supply – in respect of which preliminary studies have already been carried out. The studies, however, are not enough. They require a commitment to act – a commitment is currently non-existent. The studies date back to 2014 in respect of the Grand Harbour and to 2018 in respect of Birżebbuġa.

The government has not yet announced the cut-off date for the importation of cars running on petrol and diesel. We were informed that it may be announced some time in 2020. The government strategy in this respect is taking too long too formulate – given that it was announced by the Prime Minister over two years ago.

There is alack of seriousness about the manner in which this issue is being addressed. It  does not just involve determining when no more vehicles running on petrol or diesel will be imported; it also involves the current acute interest in the development of new fuel service stations in various parts of the island. Why do we need such fuel service stations if electrification of private transport is around the corner? An immediate moratorium on the development of new fuel service stations would have been quite appropriate, given that it is accepted by one and all that there will be no use for them!

In addition, the budget praises the heavy investment in road infrastructure, in particular the construction fly-overs and tunnels, the construction of which are either already in hand or else at an advanced state of planning. The justification for this, as has been made through various statements over the months, is to address the ever-increasing traffic congestion.

Studies carried out all over the world have repeatedly revealed that such developments in the road infrastructure inevitably leads to more traffic. Minster Scicluna ignores this experience from other countries and keeps insisting in channelling millions of euros down the drain. He should consult the Transport Master-Plan, drawn up under the direction of his own government, which clearly lists the reduction of the number of vehicles on our roads as an essential objective. The Finance Minister should query why his government commissions experts for their advice which it then ignores.

The Government has, at last realised that it needs a ‘Green New Deal’ strategy – a strategy which addresses the impacts of climate change sustainably, economically, ecologically and socially. But for such a strategy to make sense, it should first dismantle its existing strategies which are in direct opposition to a ‘Green New Deal’.

It does not make sense, for example, for the Government to declare the need to protect the environment and then hands out all sorts of incentives to encourage the property market. Nor does it make sense to keep to its programme of intensive development of the road infrastructure, or to keep pushing for the development of a tunnel between Malta and Gozo, which will only serve the free movement of more cars between the islands.

Instead of grants for batteries to store electricity generated through solar panels, it would have been much better had the Government embarked on a massive investment to ensure a better distribution network of electricity, as this would – of itself – increase the potential for the generation of more renewable energy by households. The lack of effective measures to generate more energy from renewable sources clearly shows that Government is not really committed to drafting and implementing a real ‘Green New Deal’ strategy.

The Minister of Finance is taking everybody for a ride when, on the one hand he speaks of Gozo as an ecological island and then, on the other, keeps insisting on the ‘need’ for a tunnel between the islands, – which will only serve to accelerate the environmental degradation of Gozo.

The environmental deficit is clearly out of control.

Il-mużika ta’ matul il-lejl

Ir-ritratti mis-satellita juru kemm hu kbir it-tniġġiż mid-dawl f’Malta. Fil-fatt, dan hu komparabbli mat-tniġġiż miż-żoni urbani fil-kontinent Ewropew! It-tniġġiż mid-dawl ma jħallix li nisimgħu l-mużika ta’ matul il-lejl. Joħnoqha u jżommna milli napprezzaw is-sbuħija tal-lejl li bil-mod jurina dak li jostor. Hekk jemfasizza l-Ħares tal-Opra (Phantom of the Opera) fix-xogħol tejatrali kapulavur ta’ Andrew Lloyd Webber.

Xi snin ilu waqt dibattitu dwar il-baġit ġie varat proġett biex id-dwal tat-toroq ikun ikkontrollat b’mod elettroniku. Proġett li meta jkun implimentat għandu jkun ta’ kontribut sostanzjali biex fil-gżejjer Maltin jonqos it-tniġġiż mid-dawl. Imma sfortunatament ftit li xejn smajna dwar xi progress seta’ kien hemm dwar din il-materja mill- 2013 lil hawn, meta tħabbar il-proġett.

Id-dawl eċċessiv użat matul il-lejl mhux biss hu użu ħażin u ineffiċjenti tal-enerġija imma jagħti kontribut konsegwenzjali għal emissjonijiet tal-karbonju li jistgħu jkunu evitati. B’dan il-ħajja fin-natura tul il-lejl qed tiġi ddisturbata u potenzjalment ukoll hi kawża għal ħsara lis-saħħa umana.

Fl-2007, il-Birdlife f’Malta ippubblikat studju dwar l-impatt tad-dwal bil-lejl fuq l-għasafar li jgħixu fl-irdumijiet u qrib il-baħar kif ukoll speċi oħra li jpassu bil-lejl. L-istudju hu intitolat Light Pollution and its effects on Yelkouan Shearwaters in Malta; causes and solutions. Il-kuntest tal-istudju kien proġett fl-iskema EU Life fl-Aħrax tal-Mellieħa fl-inħawi magħruf bħala l-Irdum tal-Madonna, sit li hu kolonja tal-garni, għasfur li jgħix mal-baħar.

L-osservazzjonijiet fir-rapport u s-soluzzjonijiet proposti jistgħu faċilment iservu ta’ bażi għal pjan ta’ azzjoni biex fil-gżejjer Maltin nibdew nindirizzaw bis-serjetà t-tniġġiż mid-dawl billi dan f’Malta mhux biss hu ta’ theddida għall-garnija (Yelkouan Shearwater)imma ukoll kawża ta’ emissjonijiet ta’ karbonju bla bżonn u theddida għall-kwalità tal-ħajja tagħna lkoll.

Bħala riżultat tad-densità qawwija ta’ popolazzjoni, t-tniġġiż mid-dawl matul il-lejl għandu impatt konsiderevoli kemm fuq iż-żoni urbani kif ukoll fuq dawk rurali tal-gżejjer Maltin. Ekologikament għandu impatt fuq l-għasafar, friefet u insetti kif ukoll friefet il-lejl imma ukoll fuq l-imġieba tal-annimali b’mod ġenerali. Lil hinn mill-ħajja naturali, it-tniġġiż mid-dawl joħloq leħħ qawwi li jweġġa’ l-għajn u li għandu impatt fuq is-sigurtà fis-sewqan. Jeffettwa lil min isuq, lil min jimxi, kif ukoll lil min juża’ r-rota u jagħti kontribut mhux żgħir fl-inċidenti tat-traffiku li jseħħu matul il-lejl.

Il-każ dwar it-tniġġiż mid-dawl fid-Dwejra deċiż mit-Tribunal ta’ Reviżjoni dwar l-Ambjent u l-Ippjanar nhar is-27 ta’ Ġunju hu każ rari fejn deċiżjoni tajba tal-Kummissjoni għall-Kontroll tal-Iżvilupp tinbidel mit-Tribunal fl-appell: ġeneralment bil-maqlub jiġri. Meta jinbidlu, s-soltu jkunu d-deċiżjonijiet il-ħżiena li jinbidlu, mhux dawk tajbin! Fil-fatt il-Kummissjoni għall-Kontroll ta’ l-Iżvilupp kienet irrifjutat l-applikazzjoni oriġinali minħabba li l-inħawi tad-Dwejra huma żona ta’ importanza ekologika. Sfortunatament it-Tribunal ittratta it-tniġġiż mid-dawl b’mod leġġer u kien insensittiv għall-impatti ekoloġiċi.

Li l-15-il għaqda ambjentali ngħaqdu biex jiġbru l-fondi ħalli tkompli l-ġlieda b’appell fil-Qrati hu pass tajjeb ‘il-quddiem. Il-ħarsien tas-siti tan-Natura 2000 hi għadma iebsa, imma jeħtieġ li jibqa’ għaddej. Imma li jsir appell minn din id-deċiżjoni skandaluża tat-Tribunal ta’ Reviżjoni tal-Ambjent u l-Ippjanar għandu jkun biss l-ewwel pass.

Għandna nirrejalizzaw li l-Awtorità għall-Ambjent u r-Riżorsi għandha l-poter u l-awtorità taħt id-Direttiva Ewropea dwar l-abitati li mhiex tagħmel użu tagħhom sewwa. L-ERA għandha tasserixxi ruħha u tenforza r-regoli, u jekk hemm bżonn tibqa’ għaddejja minn fuq l-Awtorità tal-Ippjanar kif tista’ u għandha tagħmel kull meta dan ikun neċessarju.

Ikun ferm aħjar kieku l-Ministru għall-Ambjent jinsisti mal-ERA biex din tieħu ħsieb iż-żoni ekoloġiċi sewwa. Ovvjament għandu jassigura li jkunu ipprovduti riżorsi adegwati.

Il-kaz tad-Dwejra hu każ speċifiku li fih l-ERA tista’ tieħu l-mazz f’idejha. X’ser tagħmel?

The music of the night

Satellite photos clearly indicate the extent of light pollution in Malta: it is comparable to that in most urban areas in the European continent. As a result, the music of the night is made inaudible. The night is being “impeded from unfurling its splendour”, as the Phantom of the Opera repeatedly emphasises in Andrew Lloyd Webber’s masterpiece.

Some years back, during the budget debate, a project related to intelligent street lighting was launched. When implemented, such a project would be an effective contribution to the reduction of light pollution all over the Maltese islands. Unfortunately, we have not heard of any substantial progress on the matter since late 2013, when the project was first announced.

Excessive artificial lighting used during the night is not only an inefficient use of energy, and the consequential contribution to additional carbon emissions which can be avoided, it is also a disturbance of nocturnal animal life and potentially injurious to human health.

Way back in 2007, Birdlife in Malta had published a study on the impact of night lighting on seabirds and nocturnal migrant species. The study is entitled Light Pollution and its effects on Yelkouan Shearwaters in Malta; causes and solutions. The context of the study is the EU Life project site at l-Aħrax in Mellieħa, in the area known as l-Irdum tal-Madonna, the site of a seabird colony.

The observations made and the solutions proposed in the study could easily form the basis for an action plan applicable to all of the Maltese islands to address light pollution because, in Malta, this is a serious problem not just for shearwaters but also in terms of carbon emissions and our quality of life.

As a result of Malta’s high population density, nocturnal light pollution has a considerable impact on both urban and rural areas all over the Maltese Islands. Ecologically, it has an impact on birds, moths and bats but it also has a considerable impact on animal behaviour in general. Beyond wildlife, light pollution creates glare which is a road safety issue and has an impact on drivers, pedestrians and cyclists and is known to play a considerable part in nocturnal traffic accidents.

The Dwejra light pollution case decided by the Environment and Planning Revision Tribunal on the 27 June is a rare case when a sensible decision was taken by the Planning Control Commission only for it to be reversed on appeal: normally it is the other way round! In fact, the Planning Control Commission had refused the original application on the basis that the Dwejra area is an area of ecological importance. Unfortunately, the Tribunal treated the issue of light pollution very lightly and was insensitive to its ecological impacts.

The coming together of fifteen environmental NGOs to crowd-fund the fight on appeal in Court is a good step forward. Protecting Natura 2000 sites is a tough fight but it needs to go on. Appealing against the scandalous decision of the Environment and Planning Revision Tribunal should, however, only be a first step. It should be realised that the Environment and Resources Authority (ERA) has powers and authority under the provisions of the EU Habitats Directive that it does not make sufficient use of. The ERA should assert itself and enforce the rules, bulldozing through the Planning Authority whenever this is necessary.

It would be much better if the Hon. Minister for the Environment insists that the ERA manages areas of ecological importance appropriately. Obviously, he must ensure that adequate resources are provided.

This Dwejra case is a specific example of where the ERA can have the final word. Will it?

Qed jingħad li b’dan il-mod ikun possibli li jkunu identifikati persuni li jkunu involuti f’attività kriminali.

Dwar dan ukoll hemm referenza fid-diskors tal-Baġit fejn kien tħabbar li : “Fl-aħħar xhur kienet għaddejja ħidma biex ġie installat l-apparat neċessarju f’data centre għal użu fuq bażi sperimentali u fejn l-apparat ta’ sorveljanza viżiva qiegħed jintuża biss f’ambjent mhux pubbliku u f’rispett sħiħ tal-liġijiet tal-privatezza billi jiġu wżati prattii etiċi internazzjonali.” Ġejna infurmati li Paceville u l-Marsa, probabbilment li jkunu minn tal-ewwel li jospitaw dan l-esperiment. Dan kellu jsir wara li sseħħ konsultazzjoni pubblika.

Imma s’issa ma seħħet l-ebda konsultazzjoni. Nafu iżda li x’aktarx li diġa ġie iffirmat memorandum of understanding mal-Huawei, kumpanija Ċiniża li hi meqjusa ġgant globali fil-qasam tat-teknoloġija tal-komunikazzjoni. Fix-xhur li ġejjin probabbilment tibda l-implementazzjoni. Dan ifisser li jekk il-konsultazzjoni sseħħ ma jkollha tifsira ta’ xejn, għax id-deċiżjonijiet jidher li lesti.

Iktar kmieni din is-sena, Huawei, ftehmu mad-Dipartiment tas-Sigurtà Pubblika tar-reġjun ta’ Xinjiang fil-punent taċ-Ċina. Intefqu flejjes kbar f’dan ir-reġjun biex f’Xinjiang ikun possibli li tkun ippruvata t-teknoloġija għall-għarfien tal-uċuħ, osservazzjoni diġitali u l-applikazzjoni tal-intelliġenza artifijali għal xogħol il-pulizija. Huawei ser jipprovdu lill-pulizija tar-reġjun l-appoġġ tekniku biex ikunu żviluppati l-kapaċitajiet tan-nies involuti u b’hekk tissodisfa l-ħtiġijiet diġitali tal-industrija tas-sigurtà pubblika, ġie rappurtat li qal Fan Lixin, il-Viċi Direttur tad-Dipartiment tas-Sigurtà Pubblika ta’ Xinjiang . Din il-kooperazzjoni kienet meqjusa li tista’ tassigura “l-istabilità soċjali u s-sigurtà fit-tul ta’ Xinjiang”.

Dan jikkuntrasta ma dak li nsibu fir-rapport annwali ta’ Huawei għas-sena 2017 li jwassal messaġġ ċar: Huawei jimpurtha ħafna mill-privatezza. Jgħidulna li fl-2017 “Huawei continued to strengthen compliance in multiple business domains, including trade, cyber security, and data and privacy protection.” Jgħidulna ukoll dwar “il-ħsiebijiet ta’ Huawei dwar is-sigurtà elettronika – li tissaħħaħ bl-innovazzjoni, bil-kollaborazzjoni u bl-iżvilupp tal-fiduċja fid-dinja diġitali.” Probabbilment li dan il-kuntrast jirriżulta minħabba li l-messaġġi huma indirizzati lejn udjenzi differenti!

Iktar viċin tagħna, l-pulizija fir-Renju Unit ilhom ftit taż-żmien jesperimentaw bit-teknoliġija li tirrikonoxxi l-uċuħ. Big Brother Watch, grupp li jikkampanja favur id-drittijiet ċivili fir-Renju Unit jirrapporta li s-sistemi użati jagħtu riżultati żbaljati 9 darbiet minn 10. F’rapport twil 56 paġna, li kien ippubblikat f’Mejju li għadda bit-titlu Face Off. Meta jkun eżaminat dettaljatament kif l-użu ta’ din it-teknoloġija jista’ jkollha effett fuq l-attività kriminali inkunu f’posizzjoni aħjar biex niddeċiedu x’sens jagħmel li nissagrifikaw il-privatezza tagħna, anke jekk b’mod limitat, biex l-istat jissorvelja u sa ċertu punt jikkontrolla parti minn ħajjitna. L-esperjenza tal-użu ta’ din it-teknoloġija fir-Renju Unit għandha twassalna għall-konklużjoni waħda: għandna nsemmgħu leħinna u nieqfu lill-istat li jrid jissorvelja ħajjitna.

Il-Gvern għandu l-obbligu li jibda konsultazzjoni pubblika immedjatament u jpoġġi l-pjanijiet tiegħu taħt il-lenti tal-iskrutinjun pubbliku.

Standing up to the surveillance state

Safe City Malta, part of the government’s public-private partnership arm Projects Malta, is planning to deploy high-definition CCTV cameras with facial recognition software. It is claimed that these cameras can identify those involved in criminal activity. The subject was referred to in the budget speech in which it was announced that, after adequate public consultation, such technology will be introduced in a number of areas. Paceville and Marsa are the prime candidates for this technology.

So far, no consultation has taken place, but a Memorandum of Understanding has apparently already been signed with the Chinese global communication technology giant Huawei, and implementation could begin in the coming months. So, the consultation, if carried out, will serve no purpose because the decisions have already been made.

Earlier this year, Huawei entered into an agreement with the Public Security Bureau in Xinjiang, China’s largest province. The Chinese authorities have spent heavily on making Xinjiang a testing ground for the use of facial recognition, digital monitoring and artificial intelligence in policing.

Huawei will provide the region’s police with technical support, help build up human technical expertise and “meet the digitization requirements of the public security industry”. A local government website paraphrased Fan Lixin, Xinjiang Public Security Bureau’s deputy director, as saying that such co-operation would guarantee “Xinjiang’s social stability and long-term security.”

The above quote is in contrast to the contents of Huawei’s Annual Report for 2017,  which drives home the message that Huawei cares a great deal about privacy. We are told that, in 2017, “Huawei continued to strengthen compliance in multiple business domains, including trade, cyber security and data and privacy protection.” We are furthermore informed of the “Huawei’s cyber security concepts – building security through innovation, enhancing security through collaboration and jointly building trust in a digital world.”

The contrast is probably the result of the messages being directed towards different audiences!

Closer to home, police in the United Kingdom have been experimenting with facial recognition technology for some time. Big Brother Watch, a UK based civil liberties group, reports that the systems in use are on average, incorrect nine times out of ten. A 56-page report published in May, entitled Face Off: the lawless growth of facial recognition in UK policing. concluded that “a staggering 95 per cent of matches wrongly identified innocent people”. To add insult to injury, innocent people’s biometric photographs were taken and stored without their knowledge in blatant disregard of basic data protection norms.

The use of facial recognition technology as a law and order tool has been welcomed by the police, as it can theoretically enhance their capabilities in the fight against crime. The proposal, however, is a nightmare for the rest of us because if it is not used within the parameters of data protection legislation, facial recognition technology will be an unacceptable invasion of the basic norms of privacy to which each one of us is entitled to.

The Commissioner for Information and Data Protection Saviour Cachia, interviewed by the GWU’s daily newspaper earlier this week emphasised that he expected that a proper assessment to be carried out by the authorities prior to the use of facial recognition technology. Mr Cachia emphasised the fact much more needs to be done before considering when and how facial recognition technology is used for security purposes. No one is aware whether or not the required assessment indicated by Mr Cachia has, in fact, been done or even if work on it has commenced.

This technology invades our privacy in an indiscriminate manner and our fundamental human rights are at risk of being breeched left , right and centre.

Examining in detail the impacts that this technology could have on criminal activity would help us determine whether it makes any sense to sacrifice our privacy (even minutely) in order for the surveillance state to take over and control segments of our life. If the UK experience is anything to go by, there is one logical conclusion: we should stand up to the surveillance state.

The Government should initiate a public consultation at the earliest opportunity and lay all its cards on the table for public scrutiny.

The budget: beyond the €s

Liza Minelli’s song “Money makes the world go round” is the underlying theme of the Budget speech delivered by Finance Minister in Parliament last Monday. The message driven home was that money and the accompanying affluence clearly indicate that we have never had it so good and that handouts to all are not a problem, both to those who need them, and, more importantly to those who don’t.

Today, taxation is a dirty word in our political lexicon: hence, it was suggested that the message that no increases in existent taxes or new taxes have been proposed is a positive one by the Honourable Minister. Handouts are for all, almost. First for those in need, secondly for most of the rest. The dictum “from each according to his means, to each according to his needs” no longer has any significance when trying to understand the political philosophy underlying the budget of this “labour” government.

Taxation collected in Malta apparently only has some significance when taxing foreign companies operating outside Maltese territory but having some small office, or just a letterbox, on this rock. This is done so that they can avail themselves of reduced taxation rates, substantially lower that those payable in the countries where they operate.

Similarly, companies operating in the financial services sector benefit from a tax package which offers them substantial savings on their tax bills in order to entice them to set up shop.

The government thinks it is smart, but all it is doing is encouraging tax avoidance. Malta’s message is clear: those who want to avoid tax in their country are welcome as long as they are prepared to pay a small part of the taxes avoided to the Maltese exchequer.

In this respect, the case study entitled “Toxic Tax Deals. When BASF’s Tax Structure is more about style than substance” published by the Green Group in the European Parliament around two years ago is indicative. In that study, it was concluded that BASF, the German chemical giant with its headquarters in Ludwigshafen, used mismatches in national tax systems in order to avoid paying its taxes. It is estimated that, over a five-year period spanning 2010 to 2014, BASF avoided the payment of close to one billion euros in taxes, paying instead a small amount of the taxes avoided, in gratitude for this wonderful opportunity made possible by the Maltese governments, blue and red.

In this context the Finance Minister’s declaration against tax evasion, tax avoidance and money laundering is deemed mere rhetoric. It has to be viewed in the context of the Panama Papers saga, as well as the established fact that a Cabinet Minister and the Chief of Staff in the Office of the Prime Minister set up companies in Panama, a tax haven, and no punitive action was taken against them. With this background, the Minister’s sanctimonious declaration is in no way credible.

The Budget proposals strengthen the social safety net as it assists the vulnerable financially. However, the quality of life is not measured solely by financial metrics. The Budget has various green gaps that affect our quality of life.

The welfare of cars assumes an importance over human quality of life, as government considers it is important to widen and improve roads in order to facilitate the passage of cars, thereby aiming at reducing congestion. An inverted sense of logic: reduction of the number of cars on our roads should have been the target as that is the real and actual problem. Widening roads and improving road infrastructure with flyovers and underpasses only serves to grow the number of cars on our roads, thereby increasing the problem. Providing and facilitating alternative transport is the only solution. Paying lip service to alternative means of transport but simultaneously financing an exponential
increase of the problem signifies that we still have to learn the ABC of transport policy.

The government’s own transport master-plan places considerable emphasis on the need to reduce cars from our roads but it seems that the government is not interested.

Therefore, we have a government which is more interested in the welfare of cars than in our quality of life.

This is just one example. There are countless of others.

The Budget loses an opportunity to make a lasting difference in a number of areas important for our quality of life that goes beyond finances.

Il-messaġġ ċar li wasal fi djarna kien li l-flus u l-“ġid” li hawn jagħmlu possibli li tirċievi ċekk id-dar, kemm jekk għandek bżonnu kif ukoll jekk m’għandekx.

F’dawn iż-żmienijiet il-kelma taxxa donna saret kelma moqżieża fid-dizzjunarju politiku: għalhekk ġie suġġerit li n-nuqqas ta’ taxxi ġodda, inkella ta’ żieda fit-taxxi eżistenti kien element pożittiv fid-diskors tal-Onorevoli Ministru. Ċekkijiet għal kważi kulħadd. L-ewwel għal dawk li għandhom il-ħtieġa u mbagħad għall-parti l-kbira tal-bqija. Dan biex ikunu jistgħu jibbenefikaw minn rati ta’ taxxa sostanzjalment iktar baxxi minn dawk li jkunu soġġetti għalihom fil-pajjiżi fejn joperaw.

Diversi kumpaniji fis-settur tas-servizzi finanzjarji ukoll jibbenefikaw minn rati ta’ taxxa li bihom jiffrankaw sostanzjalment minn dak li jħallsu band’oħra.

Il-Gvern mingħalih li għamel opra. Fir-realtá qed jibgħat messaġġ li Malta tilqa’ li min irid jevadi t-taxxa f’pajjiżu, kemm-il darba jkun lest li jħalli xi ħaġa minn dak li jiffranka fil-kaxxa ta’ Malta!

Huwa stmat li, tul il-ħames snin bejn l-2010 u l-2014, BASF evitaw madwar biljun euro fi ħlas ta’ taxxi. Minflok ħallsu ammonti ferm inqas, b’ħajr lill-gvernijiet Maltin (blu u ħomor) talli għinhom jevitaw dawn it-taxxi kollha.

F’dan il-kuntest id-dikjarazzjoni tal-Ministru tal-Finanzi kontra l-evażjoni tat-taxxa u l-ħasil tal-flus jidhru dak li fil-fatt huma: eżerċizzju ta’ retorika. Inżommu f’moħħna ukoll il-kaz tal-Panama Papers, li kien stabilixxa l-fatt li membru tal-Kabinett u ċ-Chief of Staff fl-uffiċċju tal-Prim Ministru kellhom kumpaniji fil-Panama, pajjiż rinomat għall-evażjoni tat-taxxa, u dwar dan ma kienu ittieħdu l-ebda passi kontra tagħhom. Fid-dawl ta’ dan, id-dikjarazzjoni ta’ “qdusija” da parti tal-Onorevoli Ministru hi nieqsa minn kull kredibilitá.

Il-proposti tal-Baġit isaħħu ix-xibka soċjali u dan billi jgħinu finanzjarjament lill-vulnerabbli. Imma l-kwalitá tal-ħajja ma titkejjilx biss f’termini ta’ flus. Fil-Baġit hemm bosta miżuri ambjentali nofs leħja.

Il-ħarsien tal-karozzi huwa iktar importanti mill-kwalitá tal-ħajja għalina. Il-Gvern jikkunsidra li hu iktar importanti li jwessa’ t-toroq biex jiffaċilita ċ-ċaqlieq tal-karozzi u b’hekk jipprova jnaqqas il-konġestjoni. Loġika rasha l-isfel. Il-mira kellha tkun it-tnaqqis tal-karozzi mit-toroq tagħna għax dik hi l-problema. It-twessiegħ tat-toroq u t-titjib tal-infrastruttura bil-kostruzzjoni ta’ flyovers lil hawn u lil hemm iwassal biss għaż-żieda ta’ karozzi fit-toroq tagħna u b’hekk tikber il-problema tal-konġestjoni. L-unika soluzzjoni hi li jkun inkoraġġit bis-serjetá t-trasport alternattiv. Il-Gvern qiegħed fl-istess nifs jinkoraġixxi kemm lit-trasport alternattiv kif ukoll iż-żieda fenomenali ta’ karozzi: dan ifisser li għadu ma tgħallem xejn. Wara kollox huwa l-pjan nazzjonali tat-trasport imfassal minn dan il-Gvern stess li jpoġġi quddiemna l-mira tat-tnaqqis tal-karozzi mit-toroq tagħna. Imma jidher li l-Gvern qed iwarrab il-pjani tiegħu stess.

L-Gvern hu iktar interessat mill-ħarsien tal-karozzi milli mill-ħarsien tal-kwalitá tal-ħajja tagħna lkoll.

Dan hu biss eżempu wieħed. Hemm bosta oħrajn.

Il-Baġit qed jitlef l-oportunitá li jagħmel differenza f’numru ta’ oqsma fejn li troxx il-flus mhux biżżejjed.

Green gaps in the Budget

The green gaps in the Budget speech cannot be patched up with the millions of euros spread in the pockets of both those in need as well as those who are well off.

Edward Scicluna’s Budget speech last Monday was far too long. Yet in its over 100 pages it missed addressing a number of environmental issues on which different government spokespersons pontificate throughout the rest of the year: confirming that they just pay lip-service to the issues.

The lack of good environmental governance has considerable economic and social impact as is evident to one and all.

While the Budget proposals strengthen the social safety net, it is to be underlined that quality of life is not measured solely in terms of financial metrics. Throwing euros at problems does not lead to any solutions.

The budget speech correctly emphasises the necessity of waste recycling. Unfortunately, the Minister for Finance did not explain how this effort should be integrated into a circular economy, even though the Environment Minister repeatedly boasts of how supposedly the move towards a circular economy is a priority for government. In the entire speech, the circular economy is not mentioned once. Nor does the Economic Survey dwell on the matter or even faintly refer to the matter.

This raises the suspicion that government has lost the plot and does not have any policy ideas on such an important aspect of the economy with its social, economic and environmental effects.

The Budget speech emphasises the energy generation potential from waste incineration which requires large volumes of waste in order to be viable. But the budget speech is silent on how this fits in with the stated commitment to actually reduce the volume of waste.

The government is trying to square the circle; on the one hand it wants to reduce waste but on the other hand it needs more and more waste to make its huge incinerator viable.
The Budget speech also gives the impression that it addresses important aspects which impact the quality of life when in fact offers only half-baked and token solutions.

Among them is the point on water policy. The speech mentions incentives to encourage repairs of existing wells but then it avoids altogether a real and focused effort to address the acute issue of dwellings built without water cisterns, with the consequence that water ends up in the public sewers or flooding our streets.

Developers are let of the hook even when roads are flooded and sewers are overflowing, not to mention the sheer waste of perfectly good water.

The same can be said of the supposed solutions to traffic congestion. The Budget speech refers to the financial incentives available to encourage the use of alternative modes of transport, but here again it ignores the roots of the problem. The government spending of millions of euros for the development of the road infrastructure will only increase traffic congestion, thereby squeezing users of alternative means of transport off the roads.

It is useless to incentivize the purchase of bicycles and pedelecs when there is no investment in adequate infrastructure to ensure that people can commute safely using these important alternative means of transport, which actually help to decrease congestion in our roads.

Over one year ago the Prime Minister had taken a leaf from Alternattiva Demokratika’s electoral manifesto and declared that the government will determine a cut-off date by which new cars will need to be electrically driven or possibly of a hybrid nature.

This declaration had heralded the issue of electrification of transport on our roads addressing two major issues: the quality of air and the contribution of transport emissions to climate change. This, once implemented, would be a substantial contribution to the decarbonisation of the Maltese economy. We are none the wiser on government plans after listening to or reading the budget speech.

Clearly financial parameters are not the only indicators of our quality of life. The green gaps in the budget speech need plugging at the soonest.

Fi stqarrija bl-ewwel reazzjonijiet għall-Budget iċ-Chairperson tal-AD Carmel Cacopardo qal li min-naħa, il-proposti tal-Budget isaħħu ix-xibka soċjali billi jgħin diversi kategoriji ta’ persuni. Madanakollu, l-kejl tal-progress tal-kwalita` tal-ħajja imbagħad jieqaf ħesrem milli jikkunsidra aspetti ohra daqstant ieħor importanti.

Jagħmel sens li tissemma l-ħtieġa ta’ riċiklar tal-iskart. Li l-budget ma jindirizzax huwa kif dan l-isforz jintegra ruħu fl-ekonomija ċirkolari anke jekk il-ministru tal-ambjent kemm-il darba ftaħar fuq il-priorita` ta’ din l-ekonomija. Fid-diskors kollu, l-ekonomija ċirkolari ma tissemmiex darba. Jinbet għaldaqstant is-suspett li l-gvern tilef il-boxxla fuq aspett tant importanti fuq bazi ekonomika, soċjali u ambjentali.

Id-diskors jagħmel enfasi fuq il-generazzjoni tal-enerġija mill-inċinerazzjoni tal-iskart li tirrikjedi volumi kbar ta’ skart biex tkun vijabbli. Id-diskors ma jsemmi xejn fuq kif dan jintrabat ma inizjattivi ta’ riċiklar li jnaqqsu l-istess volum tal-iskart. Il-Gvern qisu jrid jikkonvinċina li min-naħa l-waħda jrid inaqqas l-iskart imma min-naha l-oħra għandu bżonnu għax mingħajru l-inċineratur ma jaħdimx.

Id-diskors tal-budget jagħti wkoll impressjoni li qed jindirizza aspetti importanti li jimpattaw il-kwalita` tal-ħajja meta fil-fatt joffri biss soluzzjonijiet nofs leħja. Fosthom hemm il-politika dwar l-ilma. Id-diskors isemmi inċentivi għal tiswijiet ta’ bjar eżistenti imma ma jagħmel l-ebda sforz biex jindirizza il-kwistjoni akuta ta’ abitazzjonijiet bla bjar li bħala konsegwenza ta’ dan jarmu l-ilma tax-xita fid-drenaġġ jew fit-toroq. AD kienet tistenna kif dan in-nuqqas nazzjonali jibda jiġi ndirizzat kemm għax jikkonserva l-ilma kif ukoll għax itaffi l-gharghar kif ukoll inaqqas il-fawran tad-drenaġġ fit-toroq Maltin wara xita qalila bħalma kellna fl-aħħar jiem.
L-istess jista’ jingħad għal soluzzjonijiet tal-konġestjoni tat-traffiku. Id-diskors jalludi għal inċentivi fiskali li jħajru l-użu ta’ mezzi alternattivi ta’ trasport filwaqt li jinjora għal kollox aspetti iktar kruċjali. Il-Perit Cacopardo tenna li inutli li l-gvern ser jonfoq mitt miljun fit-toroq f’sena meta kull ma qed jagħmel huwa li jakkomda iktar karozzi fit-toroq. Daqstant ieħor huwa inutli li l-budget jagħti inċentivi fuq ix-xiri ta’ roti u pedelecs jekk ma jiżgurax infrastruttura adegwata biex dawn il-mezzi jintużaw mingħajr periklu.

Fuq l-ambjent in ġenerali il-budget għal darb’ oħra jerġa’ jitkellem fuq pjan strategiku għall-ambjent qisu pjan strategiku bħala pajjiz qatt ma kellna. Il-Perit Cacopardo qal li dan jinkwieta lil AD għax jagħti l-impressjoni li pajjiżna ser jerġa’ jinħela fuq strateġija oħra meta li jonqos hija fuq kollox l-azzjoni konkreta li biha jiġu attwati il-pjanijiet strateġiċi li bħala pajjiz ilna s-snin li ddiskutejna u fassalna.

Cacopardo qal ukoll li d-diskors tal-budget kien saħansitra kontradittorju. F’waqt minnhom il-ministru tal-finanzi jiddikjara ruħu kontra l-evażjoni tat-taxxa. Fl-istess ħin iżda, ma jitkellimx fuq il-fatt li l-gvern malti tal-lum, bħal ta’ qablu, sistematikament jinkoraggixxi kumpaniji barranin li jirreġistraw Malta bil-karrotta ta’ ħlas ta’ inqas taxxi milli kieku jħallsu fil-pajjiz tal-oriġini tagħhom. Fl-istess waqt ukoll, il-ministru tal-finanzi naqas milli jidħol fuq kif il-gvern biħsiebu jindirizza l-kontradizzjoni li jaħdem kontra l-evazjoni tat-taxxa meta fi ħdanu hemm funzjonarji li fetħu kontijiet fil-Panama bl-intenzjoni li l-gwadann tagħhom ma jidhirx u għaldaqstant jevadu t-taxxa. Bejn il-kliem u l-fatti hemm il-baħar jikkumbatti, tenna jghid il-Perit Cacopardo.

Id-diskors jirreferi wkoll għas-saltna tad-dritt u għal darb’ohra jipprova jagħti l-impressjoni li pajjiżna miexi fuq ir-rubini. Madanakollu id-diskors iħalli barra aspett l-iktar kruċjali li jindirizza it-tisħiħ tas-saltna tad-dritt; it-tnedija tal-konvenzjoni kostituzzjonali li konvenjentement tħalliet fuq l-ixkaffa għal snin sħaħ. “Huwa biss meta nindirizzaw it-tqassim tal-poter u s-sorveljanza tiegħu li jkun possibbli li nagħmlu qabża fil-kwalita` lejn saltna tad-dritt li tkun effettiva” sostna l-Perit Cacopardo.

Hemm imbagħad aspetti li id-diskors tal-budget injora kompletament. Dawn jinkludu l-proposta li qed issir minn numru ta’ korpi kostitwiti għal determinazzjoni tal-living wage li taghti dinjita` lil ħaddiema kollha. Huwa ta’ għajb ukoll li l-bagit jitkellem fuq l-imigrazzjoni bħala kwistjoni ta’ sigurta` u ma jsemmi xejn fuq investiment fl-integrazzjoni ta’ persuni li qed jagħtu kontribut lis-soċjeta` Maltija. Il-budget lanqas ma jitkellem fuq mezzi kreattivi li ilhom l-għexieren ta’ snin jeżistu f’pajjiżi oħra fosthom il-ħolqien ta’ koperattivi fil-qasam tal-housing li jnaqqsu l-pressjoni finanzjarja fuq numru sostanzjali ta’ persuni. Il-budget ikompli jitkellem fuq iż-żieda tan-numru ta’ turisti f’Malta u Ghawdex u ma jitkellem xejn fuq is-sostenibbilta` tal-attivita` turistika li mingħajrha jiddgħajjef l-prodott turistiku nnifsu b’detriment għall-ekonomija u l-kwalita` tal-ħajja tal-Maltin u Għawdxin.

Cacopardo tenna wkoll it-tħassib tal-Alternattiva Demokratika li għal darb’oħra, iż-żieda fuq l-għoli tal-ħajja qed tinħadem fuq formola li thejjiet snin ilu u li għaldaqstant tagħti stampa żbaljata ta’ kemm attwalment għandu jkun il-kumpens tal-għoli tal-ħajja illum.

Huwa ndikattiv ukoll li l-ħarsien ta’ persuni bl-awtiżmu, fost persuni oħra, l-budget jitkellem fuqhom fil-kapitlu tas-saħħa meta illum ilna li morna lil hinn mill-mudell mediku tal-mod kif inħarsu lejn dawn il-kundizzjonijiet. Alternattiva Demokratika tistenna li l-inklużjoni ta’ persuni differenti tigi ttrattata mil-lat edukattiv mhux mil-lat mediku.

“Kollox ma kollox filwaqt li l-budget jenfasizza l-ġid finanzjarju, fl-istess waqt jitlef opportunita` li jagħmel differenza f’numru ta’ oqsma li jmorru lil hinn mill-but imma li għandhom impatt sostanzjali fuq il-kwalita` tal-ħajja ta’ kulhadd” temm jgħid il-Perit Cacopardo.
