Is-sussidjarjetà fil-Kostituzzjoni

 

Nhar il-Ġimgħa delegazzjoni ta’ Alternattiva Demokratika iltaqgħet ma’ Silvio Parnis, Segretarju Parlamentari għall-Gvern Lokali, biex miegħu niddiskutu l-White Paper ippubblikata mill-Gvern dwar ir-riforma tal-Kunsilli Lokali.

Waqt id-diskussjoni għaddejna lil Silvio Parnis l-ideat tagħna dwar din il-White Paper. Għamilna tmien proposti b’dik ewlenija tiffoka dwar il-ħtieġa li jkun aċċettat u implimentat il-prinċipju tas-sussidjarjetà. Il-prinċipju tas-sussidjarjetà jeħtieġ li jifforma parti mill-kostituzzjoni biex iservi ta’ linja gwida għall-amminstrazzjoni pubblika tal-pajjiż u allura jħares b’qawwa l-ħidma tal-Gvern Lokali u Reġjonali.

It-trattati Ewropej diġa għamlu dan il-pass meta addottaw il-prinċipju tas-sussidjarjetà bħala prinċipju bażiku li jirregola r-relazzjonijiet kumplessi bejn l-istituzzjonijiet Ewropej u l-istati membri tal-Unjoni Ewropea.

Il-prinċipju tas-sussidjarjetà hu l-iktar żviluppat fl-istati hekk imsejħa Ġermaniċi tal-Ewropa u ċjoè l-Ġermanja, l-Awstrija u l-Iżvizzera, liema pajjiżi għandhom qafas ta’ Gvern Lokali u Reġjonali b’saħħtu u bħala riżultat ta’ dan ir-responsabbiltajiet u l-poteri huma mifruxa.

L-amministrazzjoni pubblika teħtieġ li tkun l-iktar viċin possibli taċ-ċittadin: min jamministra u jiddeċiedi għandu jkun l-iktar qrib possibli ta’ min hu effettwat mid-deċiżjonijiet. L-eċċezzjonijiet għandhom ikunu rari u altru milli ġustifikati. Jacques Delors, li kien President tal-Kummissjoni Ewropeja, hu ikkwota li qal li : is-sussidjarjetà ma tillimitax biss l-intervent ta’ l-ogħla awtorità f’dak li kull persuna jew komunità tista’ tiddeċiedi hi innifisha, imma hi ukoll dover ta’ din l-istess awtorità biex taġixxi b’mod li lil din il-persuna jew komunità tgħinhom biex iwettqu l-ħolm tagħhom.”

Dan jitfa dawl fuq żewġ aspetti tas-sussidjarjetà. L-ewwel li ħlief f’każijiet eċċezzjonali l-ogħla awtorità ma jindaħalx fejn ma jesgħahiex fil-ħidma ta’ awtoritajiet oħra taħtha. It-tieni : l-obbligu li tgħin biex tinkoraġixxi l-kisba tal-awtonomija.

Alternattiva Demokratika qed tipproponi li l-prinċipju tas-sussidjarjetà jkun aċċettat bħala prinċipju kostituzzjonali li jagħti gwida lill-amministrazzjoni pubblika u dan bħala l-ewwel pass għat-twettieq ta’ proposta radikali oħra: id-diċentralizzazzjoni tal-ħidma operattiva tal-amministrazzjoni pubblika lill-awtoritajiet lokali u reġjonali, bil-Gvern iżomm f’idejh il-funzjonijiet regolatorji. Dan jista’ faċilment jitwettaq fuq il-mudell ta’ Għawdex bid-differenza li jitmexxew minn politiku reġjonali flok minn politiku nazzjonali.

Id-dokument bil-proposti ppubblikat minn Alternattiva Demokratika jittratta diversi temi oħrajn bħalissa ċentrali fid-dibattitu dwar ir-riforma proposta tal-gvern lokali u reġjonali.

Is-servizz ta’ kull kunsillier lokali għandu jkun apprezzat, mhux biss is-servizz li jagħti s-Sindku! Il-proposta li l-uffiċċju tas-Sindku jkun wieħed full-time ma hemmx ħtieġa tagħha. Hemm diversi raġunijiet għal dan. Bħala riżultat ta’ din il-proposta dawk kollha li ma jistgħux jieqfu mill-impieg normali tagħhom ikunu esklużi milli joffru s-servizz tagħhom fil-kariga ta’ Sindku. Dan billi tali proposta teffettwa b’mod qawwi l-possibilità li huma jirrintegraw ruħhom fl-impieg meta jintemmilhom il-perjodu tal-ħatra tagħhom. Bla dubju jinħolqu ukoll kunflitti bla bżonn mas-Segretarju Eżekuttiv li l-liġi illum tikkunsidrah bħala l-uffiċjal amministrattiv ewlieni tal-kunsill lokali.

Flok ma tiffoka fuq is-Sindku r-riforma għandha tinkoraġixxi iktar il-ħidma kolleġjali fil-lokalitajiet tagħna b’mod li twassal għal sehem iktar attiv ta’ kull kunsillier fit-tmexxija tal-lokalitajiet. Il-proposta li qed jagħmel il-Gvern li kull kunsillier jingħata responsabbiltajiet hi tajba. Saret diġa minn Alternattiva Demokratika fil-konsultazzjoni pubblika dwar il-kunsilli lokali li saret fl-2008. Waħedha imma mhiex biżżejjed. Trid tkun segwita minn pass ieħor: li kull kunsillier jingħata onorarju raġjonevoli. Din m’għandiex tkun materja riżervata għas-Sindku.

Il-prinċipju tas-sussidjarjetà għandu japplika ukoll biex materji ambjentali jkunu regolati minn dawk li l-iktar jeffettwawhom mill-viċin. Li jkunu nvoluti sewwa l-kunsilli lokali u reġjonali f’dawn id-deċiżjonijiet għandu jwassal għal deċiżjonijiet aħjar minn dawk li għandna illum. Imma dwar dan, darb’oħra.

Il-konsultazzjoni pubblika dwar ir-riforma tal-gvern lokali u reġjonali issa ġiet fit-tmiem. Nistennew il-posizzjoni li ser jieħu l-Gvern dwar in-numru mhux żgħir ta’ proposti li saru. Nittama li jittieħdu bis-serjetà.

Subsidiarity in the Constitution

 

On Friday, a delegation from Alternattiva Demokratika met Parliamentary Secretary for Local Government Silvio Parnis to discuss the White Paper published by the government concerning the reform of local government.

During the discussion, we handed Mr Silvio Parnis our response to the White Paper, a response that contains eight proposals – the central one focusing on the need to accept and implement the principle of subsidiarity. The principle of subsidiarity needs to be constitutionally entrenched in order to serve as a guiding light to the country’s public administration and, consequently, protect local and regional government.

The European treaties have already entrenched the principle of subsidiarity as a basic tenet, regulating the complex relationship between European institutions and EU member states.

The principle of subsidiarity, mostly developed in the so-called Germanic states in Europe- namely Germany, Austria and Switzerland – which states have a robust local and regional arrangement, as a result of which responsibilities and the corresponding authority is spread.

Public administration should be as close to the citizen as possible: those administering and making decisions should be as close as possible to those who feel the impact of such decisions. Departure from this basic rule should only occur for reasons of absolute necessity. Former President of the European Commission Jacques Delors is quoted as having stated that subsidiarity is not only a limit on the intervention of a higher authority in the affairs of a person or community that can act itself, it is also a duty of this authority to act in relation to that person or community in such a way as to give it the means to fulfil itself.

This brings to the fore two aspects of subsidiarity. Firstly, that of non-interference by the higher authority in the workings of the lower authority, except in exceptional cases and, secondly, the duty to help – that is help that encourages autonomy.

Alternattiva Demokratika is proposing that the principle of subsidiarity be accepted as a guiding constitutional principle for the public administration as a first step to implementing another radical proposal: the decentralisation of the operational functions of public administration to the regions and local authorities with government retaining the regulatory functions. This can be easily carried out on the Gozo model, although with a regional elected politician replacing the current national politician in charge.

The document published by Alternattiva Demokratika deals with various other matters currently being debated as part of the proposed local and regional government reform.

The service of all elected local councillors should be appreciated, not just that rendered by the Mayor! The proposal to transform the office of Mayor in our localities into a full-time role is uncalled for and a number of reasons come to mind. It would automatically exclude all those who cannot take a sabbatical from their employment as it would have a long-term negative effect on their ability to adequately reintegrate when their mayoral term of office comes to an end. It would also create unnecessary conflict with the Executive Secretary, currently defined by the Local Council legislation as the chief executive of Local Councils.

Instead of singling out the Mayor, the local council reform should encourage a more collegial leadership, with all councillors being more actively involved in the running of the localities. The proposal in the White Paper to codify the duty to assign responsibilities to each elected councillor – a proposal first made by Alternattiva Demokratika and highlighted during the public consultation of 2008 on local council reform, is a good first step. It has to be followed by ensuring that all councillors receive a reasonable honorarium: this should not be a reserved for the Mayor alone.

The principle of subsidiarity should also be applied to regulating environmental issues closer to base. Involving regional and local councils in these decisions could lead to much better decisions than those we currently face. But more about that next time.

The public consultation has now been concluded. We await the reaction of the government to the large number of proposals made. Hopefully, these proposals will be seriously considered.

Taming the residential rental market

The proposals in the White Paper entitled Renting as a Housing Alternative is a breath of fresh air in the long overdue debate on the need to regulate the rental market for residential property.

As rightly pointed out in the White Paper, the Maltese community has developed an allergy to local rent regulation as, when it existed, it was generally too rigid. It oscillated from strict over-protection of the tenant to absolutely no controls.

For a very long time, we also ended up with temporary legislative provisions enacted during the war which were over-stretched too long after their useful life. In effect, this reluctance over the years to introduce proper landlord and tenant legislation effectively killed off the rental market for a long time and it is only as a result of this fact that Malta is a nation of home-owners: it would not have developed in this way, had the post-war governments got their priorities right.

The proposals put forward by the White Paper are generally a good step forward. If properly implemented, they will go a long way towards laying the foundations for a stable residential rental market based on adequate (and necessary) protection of both landlords and tenants. A serious debate is, however essential in order to avoid creating unnecessary difficulties.

The rental market is currently in a state of anarchy, where the only applicable rules that apply are those of the jungle – where might is right – because, so far, the state has abdicated its duties to protect the vulnerable from the excesses of the market. Subject to the three exceptions listed in the White Paper (temporary foreign workers, tertiary education students and temporary leases for persons repairing and/or upgrading their own homes) establishing the period of one year as the minimum length of a residential lease addresses the abuse currently resulting from short-term leases. Likewise, establishing as a duty of landlords to give a suitable notice period of their intention not to renew a lease is right and proper. It is in everybody’s interest that everyone is aware of their rights and duties, as this will lead to better planning on all sides and, consequently, to a more stable and civil relationship between landlords and tenants.

It was also about time that the deposit requested on the signing of lease agreements are properly regulated – both as to the actual need for a deposit, its quantum and the circumstances in which it would be reasonable for it not to be refunded. This is a subject about which countless stories of actual abuse on the part of both landlords and tenants abound and regulation of it will bring some sense into the subject.

It is also right that variations to the rent to be paid during the period of the lease are properly regulated,  thereby defining the limits of permissibility. Too strict a limitation, however, will lead to a preponderance of short-term lease agreements because the market prefers frequent rental revisions that enable the rent payable to be as close as possible to the full market value.

Registering lease agreements is a step forward. It will not only lead to a check to  ensure that agreements comply with the new legislation but will also have the potential to ensure that tax evasion associated with rent paid is history.

When considering the White Paper’s proposals, one should avoid introducing unnecessary exceptions as these will only serve to stultify the objective of the exercise: the development of a stable rental market for residential properties. In particular, the proposal in the White Paper to justify the premature determination of a lease agreement, when a landlord needs the property for his own use or in order to sell with vacant possession or else to redevelop it, is uncalled for. Given that the residential leases in question will most probably be short-term leases anyway (between one and five years) no harm will be done to anyone if the landlord patiently awaits until the end of the lease before taking back possession.

The current proposals, with the one exception referred to above, are an essential next step to help the residential rental market develop properly. On their own, however, they are insufficient because they must be supported by a Housing Authority that proactively addresses the needs of the vulnerable when facing the market, which is eager to fleece those who meekly submit themselves as they see no way of becoming homeowners!

Kafè Al Fresco ……… is-sogru huwa tiegħek

Ħwienet tal-kafè jew restoranti al fresco f’numru ta’ lokalitajiet ħadulna l-bankina. F’xi każi anke l-ispazju għall-parkeġġ tal-karozzi ħadu, għax dawn jimpurthom biss minn ħaġa waħda: li jdawru lira. Ovvjament dawn jippretendu li aħna nimxu f’nofs it-triq għax fuq il-bankina ftit iħallulna spazju minn fejn ngħaddu. Iħalluhom, qiesu ma ġara xejn. Lanqas tista’ titkellem, għax il-bankina għamluha tagħhom.

L-awtoritajiet jiġu jaqgħu u jqumu għax dawn jinteresshom biss li jkunu jidhru “business friendly”: ċjoe viċin in-nies tal-flus, ħa jdawru lira. Il-bqija, min jafhom?

Is-sindki tal-Gżira u Tas-Sliema, Conrad Borg Manchè u Dominic Chircop, matul dawn l-aħħar ġimgħat għamlu sewwa li emfasizzaw li l-mod kif tal-kafè u r-restoranti al fresco qed joperaw fil-lokalitajiet tagħhom mhux aċċettabbli, għax ma jagħtux kas tan-nies.

L-inċidenti, kif tafu, jiġru. Biżżejjed incident wieħed ta’ karozza misjuqa ħażin li tista’ tispiċċa toqtol jew tweġġa’ serjament numru ta’ persuni f’xi wieħed minn dawn il-ħwienet tal-kafè jew ir-restoranti. Imbagħad forsi jkun hemm min jagħti kas.

Ftit ġimgħat ilu, f’Lulju, żgħażugħ Olandiz ta’ 25 sena li kien qiegħed jippassiġa San Giljan max-xatt intlaqat minn Subaru Impreza li kienet misjuqa b’veloċitá esaġerata minn żgħażugħ ta’ 20 sena li kien rappurtat li qabeż kull limitu raġjonevoli ta’ alkoħol. Kien pass tajjeb tal-Awtoritá tal-Artijiet li rrifjutat applikazzjoni tas-sidien tal-Lukanda Waterfront max-Xatt tal-Gżira biex dawn ikunu jistgħu jieħdu numru ta’ spazji għal parkeġġ biex ikollhom ħanut tal-kafè jew restorant fuq il-bankina quddiem il-lukanda. Meta sidien il-lukanda ikkontestaw id-deċiżjoni tal-Awtoritá tal-Artijiet, fl-aħħar sabu lil min jagħti kas. Il-Maġistrat Charmaine Galea li ppresjediet l-appell emfasizzat li r-regoli dwar l-imwejjed u s-siġġijiet fl-apert jipprojibixxu li dawn jitqegħdu biswit toroq arterjali, viċin traffiku li jkun għaddej b’veloċitá. Il-Maġistrat Galea emfasizzat li n-nies għandha dritt li tkun imħarsa mit-traffiku, mill-istorbju kif ukoll mid-dħaħen iġġenerati mill-karozzi.

Il-Maġistrat Charmaine Galea għandha raġun. Hemm ħtieġa urgenti li l-loġika tagħha tinfetta l-proċess deċiżjonali tal-Awtoritá tal-Ippjanar għax hu ċar li prattikament il-ħwienet tal-kafè u r-restoranti kollha fuq il-bankina fix-Xatt tal-Gżira u tas-Sliema mhumiex skont ir-regoli. Dan jgħodd ukoll għal inħawi oħra.

Id-deċiżjoni tal-Maġistrat Galea tagħti piz lill-argumenti tas-sindki tal-Gżira u tas-Sliema li ilhom żmien jinsistu li l-ħwienet tal-kafè u r-restoranti al fresco biswit ir-rotot ewlenin tat-traffiku jeħtieġu iktar ħsieb qabel ma jingħataw il-permess biex joperaw. Jeħtieġ titjib fl-infrastruttura biex it-traffiku jkollu jnaqqas il-veloċitá kif ukoll biex in-nies ikunu protetti minn inċidenti kkawżati minn karozzi misjuqa bl-addoċċ, mill-istorbju kif ukoll mid-dħaħen tal-petrol u d-dijsil. L-Awtoritá tal-Ippjanar ma wriet l-ebda sens ta’ responsabbilta meta injorat lin-nies u qieset biss il-qies li dawk li jridu jdawru lira, irrispettivament mill-konsegwenzi.

Fuq il-bankini ftit qed jitħalla spazju biex jgħaddu n-nies u ma hemm l-ebda protezzjoni la mit-traffiku perikoluż u l-anqas mid-dħaħen. Għall-Awtoritá tal-Ippjanar, sfortunatament, dan kollu ma jfisser xejn.

It-tħassib tal-Kunsilli Lokali dwar il-ħwienet tal-kafè u r-restoranti al fresco hu għal kollox injorat mill-Awtoritá tal-Ippjanar għax ma jidhriliex li huma affarijiet li għandha tikkunsidra qabel ma tieħu d-deċiżjonijiet tagħha.

Qabel ma tippjana passiġġata max-xatt ftakar li hemmhekk hu riżervat għal min irid idawwar lira! Mill-bqija, is-sogru hu kollu tiegħek.

Al fresco dining ……… at your risk

Al fresco dining has taken over pavements in a number of localities and parking spaces too have not been spared either, as the catering business does not care about anything except its bottom line. Apparently, we are expected to walk in the middle of the road.

The authorities do not give a fig, as their brief is apparently to be business-friendly. People friendly? Their dictionary has no reference to the term: never heard of that!

In the last few weeks, the mayors of Gżira and Sliema – Conrad Borg Manchè and Dominic Chircop – have rightfully emphasised that the manner in which al-fresco coffee shops and restaurants in their localities are operating is largely unacceptable. It just takes one car accident to kill a number of diners: then maybe the authorities will take note.

Accidents do happen: a few weeks ago, in July, a 25-year old Dutchman, who was walking along the St Julian’s promenade was hit by an over-speeding Subaru Impreza, driven by a 20-year-old who was reported as being well over the drink-drive limit. The Dutchman died in hospital. Others were injured; street furniture was damaged.

The Lands Authority has taken the right step in refusing an application submitted by the owners of the Waterfront Hotel on The Strand Gżira, to encroach on a number of parking spaces in order to provide an al-fresco extension to the Hotel on the pavement. When the hotel’s owners contested the Lands Authority’s decision,  they were, at last, faced with some common-sense.

Magistrate Charmaine Galea, chairing the Appeals Tribunal, emphasised that the outdoor catering policy prohibited any platforms adjacent to arterial roads or in close proximity to fast-moving traffic. She rightly emphasised the fact that restaurant patrons had to be safeguarded from traffic, noise and air pollution.

She is obviously right and we desperately need her logic to “infect” the Planning Authority decision-making structures because it is clear that practically none of the al-fresco dining areas on the pavement along The Strand in Gżira and Sliema (and many other areas) are in accordance with the policy.

Magistrate Galea’s decision gives considerable weight to the points raised by the mayors of Gżira and Sliema who have been insisting all along that al-fresco dining alongside main traffic routes needs to be given considerably more thought before being given the go-ahead. The infrastructure needs upgrading in order that traffic calming measures are introduced and restaurant patrons are adequately protected – not only from traffic accidents but from noise and exhaust fumes as well. The Planning Authority has not acted responsibly when it has issued a considerable number of permits which ignore patrons but then takes great care of the bottom-line of the catering establishments.

The permits issued as a result of the so-called “one stop shop” planning policy may be business friendly, but it is certainly not people-friendly. Serious concerns related to pedestrian access through the labyrinthine footpaths left on the pavements, adequate protection from over-speeding traffic and the impact on health impacts from eating metres away from exhaust fumes are continuously ignored by the Planning Authority.

The inputs from local councils on the subject of al-fresco dining is repeatedly ignored, as the Planning Authority is not bothered. It obviously considers the above issues as being trivial in nature.

Forget it: the promenade is reserved for business!

Id-deċiżjoni tal-Awtoritá tal-Artijiet, issa konfermata minn Tribunal Amministrattiv, li ma jagħtix permess lis-sidien il-Lukanda Waterfront dwar imwejjed u siġġijiet fuq il-bankina quddiem il-Lukanda hi deċiżjoni f’waqtha.

Hemm bosta kazjiet oħra fejn diġa ħarġu permessi li għandhom bżonn ikunu kkunsidrati mill-ġdid. Diversi huma l-kazi fejn l-imwejjed qegħdin eżattament mal-karozzi, bosta drabi jieħu ukoll post ta’ xi parkeġġ jew tnejn.

X’ġost ikun fih platt spaghetti togħma ta’ petrol, jew birra togħma ta’ diesel?

Alternattiva Demokratika tirrikonoxxi l-intenzjonijiet tajba wara dawn il-proposti.

Imma biex jintlaħaq dan l-iskop, hemm iċċans, mhux żgħir, li nispiċċaw bxi grounds tal-futbol barra mill-irħula tagħna mibnijin bi ħwienet u uffiċini u bil-ground tal-futbol fuq il-bejt, bħalma diġa hemm fTignè! U jekk inti toqgħod fit-tarf tar-raħal hemm ċans tajjeb li tkun tista issegwi partita futbol minn fuq il-bejt. Jekk tkun iffurtunat tkun tista issegwiha ukoll mill-kamra tas-sodda! Anke l-floodlights jispiċċaw idawlulek il-kmamar tad-dar. Tispiċċa tiffranka l-konsum tal-elettriku! Dan apparti l-problemi ta parking u l-istorbju, sajf u xitwa. Dan eżempju wieħed. Hemm bosta oħra.

Fi stqarrija li ħriġna Alternattiva Demokratika sena ilu għidna li dak propost, jekk implimentat, jista jkun il-kawża ta ħafna ħsara ambjentali kif ukoll ikollu effett neġattiv fuq iżżoni residenzjali tagħna.

Tajjeb li Simon Busuttil jiftakar sewwa kull hin li dak li wiegħed fid-dokument ambjentali A Better Quality of Life for You. Għax bih rabat idejh u bħala riżultat kellu jaħseb ftit iktar dwar il-konsegwenzi tal-proposti tiegħu għall-kummercjalizzazzjoni tal-facilitajiet sportivi. Bħalissa d-diskussjoni pubblika hi iffukata fuq ta’ l-inqas tlett affarijiet importanti: fuq il-budget, fuq il-Masterplan ta’ Paceville u fuq l-impjant tal-gass fil-power station ta’ Delimara.

Iż-żmien għal dawn il-konsultazzjoniet pubbliċi hu limitat.

Il-konsultazzjoni pubblika dwar Paceville hi ikkumplikata minħabba it-tip ta’ proposti li ġew ippreżentati. Ir-rapport trid taqrah numru ta’ drabi biex tibda tifhmu mhux biss għax ikkumplikat minnu innifsu imma ukoll għax min kitbu qagħad jilgħab bil-kliem. Bil-konsegwenza li hemm numru ta’ proposti kważi moħbijin.

Min-naħa l-oħra l-konsultazzjoni pubblika dwar l-impjant tal-gass tirrikjedi eżami ta’ dokumentazzjoni voluminuza imqassma f’madwar 300 file elettroniku. Il-konsultazzjoni pubblika ser iddum 4 ġimgħat: iktar kien jagħmel sens kieku kella iddum 4 xhur minħabba li biex issir sewwa tirrikjedi ħafna xogħol.

Meta wieħed iqis li ħafna drabi jkunu l-istess nies li jinvolvu ruħhom f’din il-konsultazzjoni pubblika malajr nifhmu id-diffikultajiet li jkollna għax il-ħin hu limitat għal kulħadd.

F’Paceville, il-Gvern jaħdmek

L-Awtorità tal-Ippjanar ippubblikat, għal skop ta’ konsultazzjoni pubblika, dokument dwar Paceville. Dan hu dokument li għal darba jaħseb fit-tul. Iħares lejn l-iżvilupp ippjanat għall-inħawi fit-tul u b’mod ħolistiku. Sa hawn, tajjeb, għax hekk għandhom isiru l-affarijiet.

Imma meta tibda taqra id-dettalji, jibdew il-mistoqsijiet. L-ikbar mistoqsija hi dwar jekk l-awtoritajiet humiex, għal darb’oħra, qed jippruvaw jaħdmuna billi jinqdew bl-ippjanar għall-użu tal-art biex iħaxxnu l-bwiet ta’ uħud: dawk li jmaxtru dejjem u f’kull żmien.

Il-pjan, fost oħrajn, jidentifika l-ħtiġijiet infrastrutturali ta’ numru ta’ proġetti (disa’ fil-għadd), ewlenin fosthom toroq u probabbilment mina taħt l-art u dan biex ikun iffaċilitat l-aċċess għal Paceville li qed titfassal. Dawn il-ħtiġijiet infrastrutturali, jgħid il-masterplan għal Paceville, huma meħtieġa biex jilqgħu għall-moviment sostanzjali ta’ persuni li huwa antiċipat li dan l-iżvilupp kollu ser jiġġenera.

Min ser idaħħal idu fil-but u jagħmel tajjeb għal dawn l-ispejjes kollha?

Qed tissemma ċ-ċifra ta’ nofs biljun ewro li fil-fehma ta’ ħafna għandha tinħareġ kollha, jew tal-inqas il-parti l-kbira minnha, mill-iżviluppaturi. Għax inkella ser nerġgħu nispiċċaw fis-sitwazzjoni li huma jimpalaw il-profitti, u ħaddieħor mit-taxxi jħallas il-kontijiet. Kontijiet li ġieli inħallsuhom b’saħħitna u drabi oħra billi t-taxxi tagħna jagħmlu tajjeb għall-ħtiġijiet tagħhom.

Il-President tal-Assoċjazzjoni tal-Iżviluppaturi Sandro Chetcuti diġà qal, li, fil-fehma tiegħu, jkun aħjar jekk l-ewwel issir l-infrastruttura u wara jsir l-iżvilupp propost. Dan ifisser ħaġa waħda: li l-iżviluppaturi jippretendu li l-investiment massiċċ meħtieġ fl-infrastruttura għandu jsir mill-Gvern, mit-taxxi li jiġbor. Għax taf inti, issa għandna Gvern pro-business u għalihom dan ifisser li l-Gvern qiegħed prinċipalment għas-servizz tagħhom!

Hemm punt ieħor ta’ importanza fundamentali. Il-pjan għal Paceville jitkellem fuq ħafna ħwejjeġ. Imma jħalli barra lir-residenti li joqgħodu hemm illum. Dawk huma l-istess nies li ilhom jaqilgħu ġo fihom snin twal. Il-masterplan ma jsemmihom imkien. Jinjorhom kompletament kif diġà ġara matul is-snin. Dan iwassal għall-konklużjoni inkwetanti li r-residenti li hemm illum m’humiex meqjusa li huma importanti għal min fassal il-pjan. Ovvja għaliex: għax il-pjan hu pro-business u jpoġġi lin-nies fil-ġemb. Għax lir-residenti jqishom xkiel billi dawn dejjem joġġezzjonaw, daqqa fuq  ħaġa u daqqa fuq oħra!

Dan it-tip ta’ ippjanar ma jagħmilx ġid u m’għandniex bżonnu. In-nies u l-ħtiġijiet tagħhom huma wara kollox il-qofol tal-ippjanar serju. Imma sfortunatament il-pjan għal Paceville hu mibni fuq pedamenti differenti. Għax il-filosofija tal-pjan hu li l-art, il-ġebel, il-konkos u l-azzar jiġu qabel in-nies.

Din hi triq li twassal għal Gvern li jaħdmek biex jistagħnew l-ispekulaturi. Inti trid li pajjiżna jkompli miexi f’din it-triq?

Tall Buildings : the advice ignored by the Maltese authorities

“Tall buildings cannot be avoided in our times. The choice we have is whether to control them or else whether to put up with their future growth.” These were the concluding comments of a report drawn up by Professor Mir Ali from the University of Illinois at Urbana-Champaign USA after a visit to Malta in 2008 during which he met with and advised MEPA on the future of tall buildings in Malta.The report is entitled Urban Design Strategy Report on Tall Buildings in Malta.

Professor Ali’s report contains recommendations most of which are as relevant today as when they were originally drafted. Central to these recommendations, way back in 2008, was the need to draw a master plan addressing tall buildings and their impacts. “Lack of a master plan,”  Professor Ali stated, “results in uncontrolled developments and unpredictable impacts on urban life.”  The developed master plan,  Prof. Ali emphasised, should be “for Malta as a whole and for the selected sites for tall buildings, individually.”  Drawing up such a master plan with a reasonable level of detail will take time to carry out, a considerable portion of which should be utilised in consultation, primarily with the residents to be impacted. Certainly much more time would be required than the November 2016 target indicated by the government earlier this week.  A moratorium on the issuing of any development permit for high-rises until such time that a master plan has been discussed and approved would be a very reasonable course of action.

Professor Ali considered six sites, which were indicated to him by MEPA, as having the potential of hosting high-rise development. He proposed the following rank order : Qawra, Gżira, Tignè, Paceville, Pembroke and Marsa.  Such a ranking order by Prof. Ali is qualified by an emphasis on the substantial infusion of public monies which is required. Prof. Ali commented that if the number of sites are reduced to less than six it would be much better for Malta.

Professor Ali made a number of incisive remarks.

There is a need for an objective market and feasibility study for each project, which study should include the life cycle cost of the project. In view of the high vacancy rate of existing residential units, Prof. Ali queried the kind of occupancy expected of high-rises. Failure of high-rises will impact the economy of the whole of Malta which has no safety valve because of its size and lack of adequate elasticity, he stressed.

An efficient public transport is a fundamental requirement for the Maltese islands irrespective of whether high-rises are developed or not. But for the success of tall buildings “an integrated sustainable public transport system” is absolutely necessary. Yet, surprise, surprise, Professor Ali observed that “there is no efficient public transport system that is efficient and that covers the whole of Malta”

Sounds like familiar territory!

Infrastructural deficiencies must be addressed. If the existing infrastructure is inadequate or in a state of disrepair it must be upgraded and expanded to meet future needs. Tignè residents in Sliema have much to say about the matter, not just with reference to the state of the roads in the area but more on the present state of the public sewers! Residents of the Tignè peninsula are not the only ones who urgently require an upgrade of their infrastructural services. Residents in many other localities have similar requirements.

Social and environmental impacts of tall buildings must be considered thoroughly at the design stage. However Maltese authorities have developed the habit of ignoring the social impacts of development projects. In addition, it is very worrying that, as reported in the press earlier during this week,  Prime Minister Joseph Muscat does not seem to be losing any sleep over the matter.

People living in a low-rise environment consider high-rises as intrusive. Unless public participation is factored in at a very early stage through planned beneficial impacts on the community in terms of economic benefits, upgrade of services and the general benefits of the redevelopment of the surroundings, such projects do not have a future.

The upkeep of high-rises is quite a challenge which requires skills that are different from low-rise buildings. Notwithstanding changes to the relevant provisions of the law, there already exist serious difficulties in bringing together owners of low-rise multi-owned properties in order that they can ensure that maintenance of such properties is addressed. The challenge of high-rises is exponentially more complex.

The above is a snap-shot of Prof. Ali’s report. From what I’ve heard from a number  of people who met Professor Ali, he was more vociferous in his verbal utterances. Unfortunately,  his advice has been largely ignored.
