Il-burokrazija u l-Belt ta’ Stivala

Xahar wara l-ieħor jibbumbardjawna bi statistika dwar kuntratti ta’ bejgħ tal-propjetà inkella dwar in-numru ta’ konvenji. Dan l-aħħar qieshom inbidlu ftit in-numri b’mod li beda jidher li l-bejgħ qed jonqos.  Dak li jmexxi l-assoċjazzjoni tal-iżviluppaturi qalilna li hi l-burokrazija li qed ittellef ir-ritmu tal-bejgħ.  

Il-proċess tal-permessi għall-iżvilupp, ġeneralment, hu iffukat fid-direzzjoni tar-rgħiba. Ħolqu regoli msejħa regoli tal-flessibilità biex isibu mod kif iduru mar-regoli tal-iżvilupp li oriġinalment saru bl-iskop li jħarsu t-tessut urban u l-kwalità tal-ħajja tal-komunità residenzjali.  Per eżempju, żona intenzjonata għal taraġ pubbliku fil-pjan lokali għall-Gżira għamel il-wisa’ biex tinbena lukanda. Dan qed isir f’żona residenzjali, jiġifieri fejn suppost jinbnew biss djar għan-nies.  Din il-flessibilità estrema fl-ippjanar għall-użu tal-art qed igawdu minnha l-Grupp tal-Kumpaniji Stivala. Dan ngħidu b’referenza għall-parti ta’ fuq ta’ Triq Moroni: żona li r-residenti tal-Gżira illum isibuha bħala l-Belt Stivala. Minkejja dan kollu l-kap tal-MDA għandu l-wiċċ li jilmenta! Qiesu dan mhux biżżejjed.

Żviluppaturi fil-Mellieħa mhumiex daqstant fortunati bir-regoli tal-flessibilità għax lukanda li ħarġilha permess ta’ żvilupp f’ċirkustanzi simili laqqtita meta l-Qorti tal-Appell ħassret il-permess. Il-permess ta’ żvilupp għal lukanda fil-Belt ta’ Stivala għandha ċans li jkollha l-istess destin bħall-dak tal-Mellieħa fil-futur qarib. Għalkemm l-applikazzjoni għall-permess ġie approvat madwar ħames xhur ilu  (PA5962/21) il-permess ta’ żvilupp għadu ma ħarigx.

Kultant l-opinjoni pubblika tiġiha waħda żewġ! Il-protezzjoni riċenti permezz ta’ skedar ta’ Palazzino Vincenti f’San Ġiljan hi materja oħra ta’ kunflitt bejn ta’ Stivala u l-burokrazija tal-ippjanar. Għadu kmieni wisq biex wieħed jista’ jgħid li dan hu każ magħluq.  B’ansjetà u biża’ nistenna l-passi li jmiss, u dan minkejja li hemm xi forma ta’ skedar tal-wirt li ħalla warajh l-Perit Vincenti.

Ta’ Stivala kienu qed jippjanaw li jħottu Palazzino Vincenti u floku, f’San Ġiljan, jiżviluppaw lukanda oħra.  F’Diċembru 2022 Palazzino Vincenti kien protett temporanjament fi Grad 1 permezz ta’ Ordni ta’ Konservazzjoni ta’ Emerġenza.  Din il-protezzjoni temporanja issa spiċċat u flokha għandna protezzjoni fi Grad 2 fuq bażi permanenti kif deċiż mill-Awtorità tal-Ippjanar ix-xahar li għadda. Din mhiex aħbar tajba għax issa probabbilment ser nispiċċaw  bil-faċċata biss ta’ Palazzino Vincenti: ġewwa jispiċċa kollu.

Għal dawk li ferħu bl-aħbar tal-protezzjoni imħabbra, naħseb li għaġġlu. Probabbilment hu biss l-iżviluppatur u l-konsulenti tiegħu li għandhom għax jgħorku jdejhom għax mhux ser ikunu wisq il-bogħod milli jilħqu l-miri tagħhom.

F’dan il-kaz ukoll il-burokrazija tal-ippjanar mhux ser ikun irnexxielha milli żżomm lil ta’ Stivala milli jagħmlu ħerba mill-wirt nazzjonali. Kollox bil-barka tal-Awtorità tal-Ippjanar.

Il-burokrazija tal-ippjanar li minnha jilmenta l-Kap tal-MDA l-anqas ma kienet tidher b’nemes meta ta’ Stivala ġiehom il-ħsieb li jġebbdu l-iżvilupp sat-tarf tal-kosta. Tiftakru? Erba’ snin ilu f’din il-paġna, f’artiklu ntitolat : Il-ħarsien tal-kosta: ma hemmx rieda politika (Illum: 14 t’ April 2019) kont ktibt dwar il-permess ta’ żvilupp tal-blokk bini fejn kien hemm ir-restorant Piccolo Padre mal-kosta ta’ San Ġiljan. Kont emfasizzajt dan li ġej: “L-iżvilupp in kwistjoni ngħata permess fuq art mal-kosta.  B’żieda ma dan …………………. jidher ċar li l-binja tibqa’ ħierġa fuq il-baħar.  Jidher li l-Awtorità tal-Artijiet l-anqas biss tniffset dwar dan.” Minkejja dak li jgħid il-Kap tal-MDA, il-burokrazija tal-ippjanar (u l-kuġini tagħha) kontinwament tagħmel il-wisa’ għal żvilupp bla rażan.  

Din hi l-effettività tal-burokrazija: dejjem fuq in-naħa tar-rgħiba.

Bureaucracy and Stivalaland

Month in month out we are inundated with the latest statistics on property contracts or “promise of sale” agreements. Recently we have had some blips with statistics indicating that property sales were possibly diminishing. Out comes the Malta Developers Association (MDA) supremo thundering that bureaucracy is holding back property deals.

The development permitting process is, generally, greed oriented. It has resulted in so-called flexibility policies which seek to facilitate going around development policy restrictions intended to protect the urban fabric and the quality of life of the residential community. For example, an area earmarked for a public staircase in the Gżira local plan was transformed into a hotel. This is taking place in a residential area where only residences ought to have been permitted. The beneficiary of such land use planning extreme flexibility is the Stivala Group of Companies. I am referring to upper Moroni Street in Gżira, which area has nowadays been labelled as Stivalaland by Gżira residents. Yet the MDA supremo has the cheek to complain.

Developers in Mellieħa were less lucky with flexibility bureaucracy as a hotel permitted in similar circumstances has seen its development permit being recently revoked by the Court of Appeal. The Stivalaland hotel permit in Gżira may possibly meet the same fate in the not-too-distant future as although it has been approved by the Planning Commission some 5 months ago (PA5962/21) the development permit has not been issued yet. Consequently, the time frame for objectors to commence the appeal process has not yet commenced.

Occasionally public opinion manages to pull a fast one. The recent scheduling of the Palazzino Vincenti landmark at St Julians is another area of conflict between the Stivala brand and planning bureaucracy. It is still too early to consider this as a closed case. One awaits with trepidation the next steps notwithstanding the scheduling of the Vincenti masterpiece.

The Stivala brand had planned to pull down Palazzino Vincenti and to develop yet another hotel in St Julians. On 12 December 2022 Palazzino Vincenti was temporarily protected at Grade 1 level through an Emergency Conservation Order. This temporary protection has now been lifted and downgraded to a Grade 2 protection on a long-term basis as decided by the Planning Authority last month. This is extremely bad news as it signifies that most probably only the elevation of this landmark will be preserved: its interior will be gutted. Those who rejoiced at this level of protection were ill-advised. I think that it will be the developer and his advisors who will eventually have the last laugh as they will not be too far from their original objectives!

In this specific case planning bureaucracy will, once more, not be preventing the Stivala brand from making mincemeat of our national heritage, with the Planning Authority’s blessing. And yet the MDA supremo complains.

The planning bureaucracy which the MDA supremo complains about was nowhere to be seen when the Stivala brand sought to stretch development as close as possible to the shoreline. Do you remember? Four years ago, in these very columns, in an article entitled: Protecting Our Coast: No political will in sight (TMIS: 14 April 2019) I had written about the development permit relative to the building block of which the restaurant Piccolo Padre along the St Julian’s coastline forms part. I had then emphasised as follows: “The development in question has been permitted on a footprint starting along the coastline itself. In addition, ………………… planning permission issued by the Planning Authority includes part of the approved structure protruding over the sea. Not even a whimper has been heard from the Lands Authority on the matter.”

Contrary to what the MDA supremo says land use planning bureaucracy, and its cousins, continuously make way for unbridled development.

That is the extent of how effective the bureaucracy is, practically always on the side of greed.

In-Nigret: more agricultural land to be bulldozed

The local plans are seven in number. They are supplemented by a land use planning rationalisation exercise. This consists of the identification of land outside the development zone (ODZ), approximately 2 million square metres in area, on the outskirts of existing urban areas and settlements all over the islands. In July 2006, Parliament, decided that this ODZ land was suitable for development.

The PN led government had then proposed and voted in favour of developing this ODZ land with the Labour Opposition voting against the proposal. But come March 2013 nothing changed as a result of the change in government. Notwithstanding that Labour in Opposition had voted against the proposal, the ODZ land remained within the development zone. All two million square metres of it. As aptly underlined by Giuseppe Tomasi di Lampedusa in his Il Gattopardo: the more things appear to change the more they remain the same. Greed is in fact colour blind.

Today, almost 17 years after the event, our local communities are realising what that Parliamentary vote signifies. Together with my colleagues I have been all around the island on a regular basis discussing with residents the resulting overdevelopment which is eating up agricultural land at a fast rate. Most localities are impacted.

This week it is the turn of agricultural land at In-Nigret, on the outskirts of Żurrieq, where more agricultural land will soon be cleared for development. Residents are up in arms as they have realised that another 14,960 square metres of arable agricultural land will be shortly developed. Two particular applications for planning control have been submitted (PC85/18 and PC49/19). The former application has already been approved last year while the second application will be considered shortly: it has already been recommended for approval by the Planning Directorate at the Planning Authority.

The planning process currently in hand is concerned with zoning and with determining the extent of permissible development, that is the permissible height and the development density. The development has however already been approved in principle 17 years ago. Unfortunately, notwithstanding the efforts of my party as well as those of environmental NGOs, residential communities ignored the warning signs staring them in the face. Now that the threat of destructive development is approaching individual communities, they are realising that they have been taken for a ride for quite some time. They are now awakening from their blissful slumber, suddenly realising that those whom they trusted all along have betrayed them by giving up for development the open spaces surrounding our settlements and urban areas.

Giving up agricultural land for building development does not make any sense. This is not just an objective argument in favour of protecting agricultural land. It is also essential to protect the green lungs around our urban areas and settlements.

What sense does it make to embark on a €700 million spending spree on the greening of our urban environment and then, simultaneously to bulldoze through our fertile fields? Project Green, if it is to have any worth should first and foremost seek to protect our existing green lungs. This applies not only to the Nigret fields facing the bulldozer in the coming months. It also applies all around the islands to each and every one of the two million square metres of ODZ land which Parliament, 17 years ago, earmarked for development.

The question being asked is: what can be done about it? Is it not too late to act after 17 years? There are very few avenues which can be explored at this late hour but there are some possibilities which hopefully can be utilised to defend the little we have been left with.

Il-kosta (u madwarha) tagħna lkoll

Il-pubblikazzjoni riċenti tar-rapport dwar l-impatti ambjentali (EIA)  tal-proġett ta’   Villa Roża fil-Bajja ta San Ġorġ San Ġiljan ser terġa’ tiftaħ beraħ id-dibattitu dwar il-proġett tal-grupp dB f’Pembroke kif ukoll dwar il-Masterplan ta’ Paceville li kien abbandunat madwar sitt snin ilu, riżultat ta’ dibattitu intensiv li fih kienet involuta attivament is-soċjetà ċivili.

Għal darb’oħra il-proposta ċentrali ta’ żvilupp hi l-kummerċjalizzazzjoni intensiva tal-kosta kif ukoll madwarha, u dan apparti l-impatti konsiderevoli fuq iz-zona kollha.

Il-proposta tikkonċerna medda kbira ta’ 47,572 metri kwadri bi żvilupp propost li jikkonċerna t-turiżmu, id-divertiment flimkien ma’ użu kummerċjali, primarjament  uffiċini. Dan hu propost li jsir f’żona li diġa hi iffullata, prattikament is-sena kollha.

Ir-rapport dwar l-impatti ambjentali fih numru ta’ studji dwar diversi aspetti ta’ relevanza għall-proġett propost. Wieħed minn dawn hu analiżi ekonomika mħejji minn E-Cubed Consultants. Kif mistenni, dan l-istudju jitkellem f’termini pożittivi ħafna tal-proġett. Studji ta’ din ix-xorta li kapaċi jiġġustifikaw kollox, issa drajnihom!  Dan l-istudju jinjora kompletament  l-impatti li l-proġett ta’ Villa Roża ser ikollu fuq l-infrastruttura pubblika. Dawn l-impatti huma spiża li jridu jagħmlu tajjeb għalihom il-fondi pubbliċi. L-impatti tal-proġett innifsu huma sostanzjali. Imma meta tarahom b’mod kumulattiv ma’ dawk iġġenerati minn proġetti oħra kbar ippjanati għaż-żona huma enormi.

Dan hu kaz ieħor fejn il-profitti jmorru fil-but tas-settur privat imma hu mistenni li l-kaxxa ta’ Malta terfa’ l-ispejjes għall-iżvilupp meħtieġ tal-infrastruttura biex huma jkunu jistgħu jinqdew. Dwar dan, l-istudju ta’ E-Cubed hu sieket.

Dan x’mudell hu? Kif ġie indikat b’mod ċar minn studju ta’ Deloitte dwar it-turiżmu f’Malta, studju li kien ikkummissjonat mill-Assoċjazzjoni tal-Lukandi (MHRA), ser inkunu neħtieġu 4.7 miljun turist fis-sena biex jintużaw is-sodod li diġa hawn inkella li huma ippjanati! Dan ġenn, għax il-pajjiż ma jiflaħx għall-piż iġġenerat fuq l-infrastruttura kemm-il darba in-numru ta’ turisti li jżuruna jirdoppja.

Anke l-Gvern ħabbar mira ta’ tlett miljun turist, mira li hi għolja ħafna. Kieku l-Awtorità tat-Turiżmu għandha nitfa serjetà fit-tmexxija tagħha kienet tieħu passi biex trażżan l-iżvilupp sfrenat li għaddej fl-industrija u li fl-aħħar ħsara biss jagħmel. Ir-rebgħa imma m’għandiex limitu u qed twassal għal ħsara kbira għall-pajjiż.

Il-kummerċjalizzazzjoni tal-kosta u taz-zona madwarha teħtieġ li tieqaf qabel li din tibla l-ftit spazji miftuħa li għad baqa’ madwar l-istess kosta.

Permezz ta’ emendi li kienu saru għall-Kodiċi Ċivili f’dik li hi magħrufa bħala l-liġi tad-dimanju pubbliku l-Parlament kien approva leġislazzjoni biex jipproteġi l-kosta u bħala riżultat ta’ hekk iżid l-aċċess għall-pubbliku. Dan kien kollu daħq fil-wiċċ għax fil-prattika ma sar xejn. Kieku din il-leġislazzjoni qed taħdem, proġetti bħal dan ta’ Villa Roża ma jsirux għax dawn imorru kontra kemm il-kelma kif ukoll l-ispirtu tal-liġi.

Għaddej sforz kontinwu biex il-kosta tkun ikkumerċjalizzata.  Xi żmien ilu kellna l-proposta għall-marina ta’ Marsaskala. Kellna ukoll il-proposti dwar Manoel Island, dwar il-Bajja tal-Balluta, il-Waterfront tal-Birgu (inkluż il-marina) u l-marina għall-jottijiet fil-Kalkara u dan flimkien ukoll mal-Waterfront tal-Belt Valletta.

Ma dan wieħed irid iżid il-kummerċjalizzazzjoni sfrenata li għaddejja tal-ispazji pubbliċi mal-kosta, inkluż il-bankini.

L-art pubblika qed tkun kontinwament ittrasformata fi profitti għas-settur privat, ħafna drabi għal ftit magħżulin. Fi prattikament il-każi kollha, ħadd ma jagħti kaz tal-kwalità tal-ħajja tar-residenti. Dawn qed ikun kompletament injorati. Xi drabi r-residenti saħansitra jinbeżqu l-barra miz-zoni residenzjali.

Issa għaddew madwar erba’ snin minn meta l-Parlament approva l-leġislazzjioni biex iħares il-kosta. Biex din il-liġi tkun tista’ titwettaq  l-għaqdiet ambjentali ppreżentaw dokumentazzjoni dwar iktar minn għoxrin sit mal-kosta li jimmeritaw li jkunu mħarsa. Ninsab infurmat li dawn l-għaqdiet ambjentali ippreżentaw ukoll riċerka estensiva dwar min jippossjedi din l-art. Hi ta’ sfortuna li t-tkaxkir tas-saqajn tal-Awtorità tal-Artijiet u tal-Awtorità tal-Ippjanar qed iżżomm u tostakola l-ħidma meħtieġa biex din il-liġi li tipproteġi l-kosta titwettaq. Dan qed isir ukoll fejn ma hemm l-ebda dubju li l-art  hi propjetà pubblika.

Għalfejn isiru dawn il-liġijiet jekk ma hemm l-ebda intenzjoni biex dawn ikunu implimentati?

Jeħtieġ li niċċaqalqu jekk irridu nkunu f’posizzjoni li nħarsu dak li fadal mill-kosta u z-zoni ta’ madwarha, u dan qabel ma jkun tard wisq. Sfortunatament ma hemmx rieda politika dwar dan. Il-Gvern u l-awtoritajiet tiegħu iqiesu l-kosta u z-zona kostali bħala magna biex tagħmel il-flus. Din hi l-viżjoni li qed isegwu fi sħubija kontinwa mal-forzi spekulattivi.

The coast and coastal areas belong to all of us

The recent publication of the EIA for what is commonly referred to as the Villa Rosa project at St George’s Bay St Julians brings us back to the dB Pembroke project debate as well as the Paceville Masterplan aborted some six years ago as a result of an intensive debate which involved heavily civil society.

Once more the issue is a development proposal which seeks further intensive commercialisation of the coast and the coastal area. In addition, the impacts on the surroundings are substantial,

The proposal involves a massive 47,572 square metres footprint with a proposed development mix of tourism, leisure and business uses in an area which is already saturated and as a result overcrowded at practically all times of the year.

The EIA contains a number of studies relative to a multitude of aspects. One of these studies is an economic analysis by E-Cubed Consultants. As expected, this study gives a glowing economic endorsement of the project. We have become used to such studies which seem to be able to justify anything. In arriving at its conclusions this study, completely ignores the impacts which the Villa Rosa project will have on the public infrastructure and on the fact that this will have to be made good for by the public coffers. The impacts are substantial when the project is viewed on its own but they assume enormous proportions when viewed cumulatively with the impacts generated by other major projects already in hand or in the pipeline for the area.

This is another case of profits being channelled to the private sector with the public purse being expected to foot the bill for the infrastructural development required. E-Cubed are completely silent on the matter.

Is this the tourism model for the future? As clearly indicated by the Deloitte study on the tourism carrying capacity in the Maltese islands, commissioned by MHRA, at the end of the day we would require 4.7 million tourists per annum if existing and projected tourism projects are to have around an 80 per cent occupancy. This is pure madness: it would signify a more than doubling of the current number of  tourist arrivals.

Even the government stated target of 3 million tourists per annum is too high. If the Malta Tourism Authority (MTA) was anything close to serious it would have by now have taken urgent action to curtail the unrestrained development spree of these speculative developers. Their greed has no limits. It is driving this country towards a complete ruin.

The commercialisation of the coast and coastal areas has to stop before it engulfs the few open spaces left undeveloped in the vicinity of the coast.

Through amendments to the Civil Code in what is known as the Public Domain Act Parliament has approved legislation to protect the coast and to increase access to the public as a result. This legislative action unfortunately has so far proven to be another gimmick. If it were to be in any way effective this legislation would have nipped in the bud the proposed Villa Rosa development as it goes against both the letter and the spirit of this legislation.

A continuous effort to commercialise the coast is under way. It has been going on for quite some time. Some time back we had the proposal for a Marsaskala yacht marina. Some other glaring examples which come to mind are the case of  Manoel Island, Balluta Bay, the Birgu Waterfront and yacht marina, the Kalkara yacht marina, Valletta Waterfront.

There is also the ongoing commercialisation of the public spaces adjacent to the coast, including pavements and open spaces.

Public land is continuously being transformed into private profits, many times for the chosen few. In practically all cases, the quality of life of residents is not factored in, until the eleventh hour. Whenever possible, it is either avoided completely or else the residents are slowly squeezed out of residential areas.

It has been around four years since parliament approved legislation in order to reinforce the protection of the coastline through the public domain legislation. Environmental NGOs have submitted a list of over twenty sites along the coast which qualify for protection. I am informed that eNGOs have even carried out extensive research on ownership issues related to these sites. It is indeed unfortunate that the Lands Authority and the Planning Authority have ground the whole process to an unacceptable halt as a result rendering legislation ineffective. This applies even in those instances where it is proven beyond any doubt whatsoever that the land in question is public property.

Why approve such laws when there is no intention to implement them?

We need to act to protect what is left of the coast and the coastal areas, before it is too late. Unfortunately, there is no political will to act. Government and its authorities consider the coast and the coastal areas as money spinners. A vision which they pursue relentlessly in bed with the speculators.

Saving the little that we have

Almost two years ago, Architect Edward Said submitted a request to the Planning Authority and the Superintendence of Cultural Heritage in order that they take steps to protect a Villa along the St Julian’s promenade. The Villa known as Palazzina Vincenti was designed and constructed for his own use by Architect Gustavo Romeo Vincenti. Architect Vincenti died in 1974.

As far as is known, neither the Planning Authority nor the Superintendence of Cultural Heritage have acted upon the submissions received requesting the protection of Palazzina Vincenti. At the time of writing the Superintendence has passed the buck to the Planning Authority! In the meantime, a development application has been submitted for the demolition of Palazzina Vincenti and its substitution with a 17-storey 136 room hotel, including three levels below street level providing garage space for 58 cars.

In a report drawn up by Architect Edward Said, Palazzina Vincenti is described as “a masterpiece of architecture defined by pure geometric volumes”.  It is considered as one of the earliest examples of the use of reinforced concrete in domestic architecture in Malta.  Quoting from a 2018 Masters of Architecture dissertation by David Ellul, Architect Said emphasises that by taking full advantage of the potential of reinforced concrete, Vincenti’s artistic expression was freed from the limitations of traditional materials. The result is this masterpiece which can be lost quite soon!

Even though to the untrained eye Palazzina Vincenti may seem to be an ugly building specimen, ill-fitting in its present-day concrete jungle surroundings, it is still a masterpiece worth preserving for posterity.

I fail to understand why two years after a request for protection has been submitted no action has yet been taken. As a result of such inaction, the message conveyed by the authorities is a very clear one: that the site occupied by Palazzina Vincenti is ripe for development. This is an inevitable conclusion conveyed by those in charge as a result of their failure to act.

At this point in time, as a minimum, it is expected that an emergency conservation order protecting Palazzina Vincenti is issued urgently. This would be a clear sign to those currently benefitting from a prolonged phase of “development greed” that a red line has been drawn around our heritage, thereby protecting it. It would also provide some breathing space which would be of considerable help in order that the Planning Authority may bring its house in order.

Some have the mistaken idea that all our heritage is necessarily old, very old, going back centuries. This is certainly not the case as this specific architectural masterpiece is less than 75 years old. Unfortunately, there have been other worthy examples of our architectural heritage which have been lost through carelessness, insensitivity and institutional ignorance.

I could remind readers of another outstanding example of modern architecture which has gone to the dogs, this time in Gozo, some 15 years ago. Parts of the Qala Primary School in Gozo were demolished to make way for an Institute of Tourism Studies campus in Gozo. The said school was designed and constructed under the supervision of Architect Joseph Huntingford who as the government architect in charge of schools was responsible for most new schools constructed in Gozo between 1950 and 1961.

Way back in 2006 the Chamber of Architects and Civil Engineers had described the Qala Primary School as one of the finest examples of modern architecture on the island. Even then the Planning Authority was advised to handle our heritage with care. But it was of no use. The advice was ignored as parts of the school were demolished to make way for the ITS campus.

There is still time to save Palazzina Vincenti from being sacrificed on the altar of “development greed”. We need to be more appreciative of our heritage. We have so little of it. I am not however so sure as to whether the Planning Authority is capable of taking decisive action. It has been desensitised for far too long.

PLPN : parrini tar-rgħiba

Il-pjani lokali huma 7. Il-Pjan Lokali dwar il-Bajja ta’ Marsaxlokk kien approvat fl-1995, madwar sentejn wara li twaqqfet l-Awtorità tal-Ippjanar. Kellhom jgħaddu 7 snin oħra biex ġie approvat pjan lokali ieħor, din id-darba dak għall-Port il-Kbir.  Il-bqija kienu approvati f’daqqa bl-għaġġla fis-sajf tal-2006. Fl-2006 ukoll kien ippubblikat u approvat mill-Parlament dokument ieħor dwar ċaqlieq tal-linja tal-iżvilupp, intitolat “Rationalisation of Development Zone Boundaries”.

Kull wieħed minn dawn it-tmien dokumenti huwa wild il-PN fil-Gvern. Il-konsiderazzjonijiet ambjentali fihom huma nieqsa bil-kbira.

B’mod partikulari, d-dokument li ċaqlaq il-linja tal-żvilupp  ġie approvat mill-Parlament b’għaġġla kbira u bħala riżultat ta’ hekk żewġ miljun metru kwadru ta’ art li kienu barra  miż-żona ta’ żvilupp (ODZ) f’daqqa waħda saru tajbin għall-iżvilupp.

Mill-Opposiżżjoni l-Partit Laburista fil-Parlament ivvota kontra dan iċ-ċaqlieq tal-linja tal-iżvilupp, imma, wara, meta tela’ fil-Gvern ġie jaqa’ u jqum minn dan kollu. Dan minħabba li l-opposizzjoni għall-proposti kienet waħda partiġjana mhux minħabba xi viżjoni alternattiva.

Il-pjani lokali jeħtieġu reviżjoni immedjata. Id-dokument li jistabilixxi kif kellha tiċċaqlaq il-linja tal-iżvilupp għandu jitħassar u safejn hu possibli dik l-art kollha (ż-żewġ miljun metru kwadru) terġa’ issir art ODZ – barra miż-żona tal-iżvilupp.  

Fost it-tibdil meħtieġ hemm tnaqqis ġenerali fl-għoli permissibli tal-bini, liema għoli, f’ħafna każi qed itellef lill-komunità residenzjali mid-dritt ta’ aċċess għax-xemx. Dan qed inaqqas u jostakola l-potenzjal tagħna bħala pajjiż fil-ġenerazzjoni ta’ enerġija rinovabbli. Dan kollu kien injorat mill-pjani lokali.

Hemm bosta materji oħra fl-erba’ rkejjen tal-pajjiż li jeħtieġu li jkunu eżaminati mill-ġdid. Kif spjegajt f’artiklu preċedenti l-pjani lokali ma jagħtux każ tal-impatti kumulattivi tal-iżvilupp li huma stess jipproponu. Din hi materja bażika li teħtieġ attenzjoni kbira għax għandha impatt sostanzjali fuq il-kwalità tal-ħajja tagħna. Sfortunatament il-pjani lokali ftit li xejn jagħtu każ tal-kwalità tal-ħajja. Jiffokaw fuq is-sodisfazzjon tar-rgħiba.

Għandu jkun hemm kumpens jekk art li illum tista’ tkun żviluppata terġa’ lura fl-ODZ bħala art mhiex tajba għall-iżvilupp?

Xi ġimgħat ilu l-Ministru  Aaron Farrugia responsabbli għall-Ippjanar u l-Ambjent kien qal li kellu l-parir favur id-dritt ta’ kumpens. Konvenjentement l-Onorevoli Ministru injora l-fatt li l-Qorti Kostituzzjonali f’Malta kif ukoll il-Qorti Ewropeja dwar id-Drittijiet tal-Bniedem diġa kellhom kaz bħal dan fejn kien hemm talba għal kumpens. Il-Qorti Kostituzzjonali irrifjutat it-talba u l-Qorti fi Strasbourg ma ikkunsidratx t-talba f’deċiżjoni fis- 27 September 2011 li fiha iddiskutiet il-parametri legali applikabbli.

Il-kaz huwa dwar il-kumpanija Maltija Trimeg Limited u jikkonċerna 10,891 metru kwadru ta’ art li kienu fil-limiti tal-iżvilupp fl-1989 kif stabilit mill-iskemi temporanji tal-iżvilupp ta’ dakinnhar. Imma fl-1996 din l-art ġiet skedata għal skop ta’ konservazzjoni f’kuntest tal-protezzjoni tal-widien. Fil-Qrati Maltin il-kumpanija Maltija kienet qalet illi li kieku ħarġu l-permessi ta’ żvilupp l-art kien ikollha valur ta’  €11-il miljun. B’daqqa ta’ pinna imma, dan naqas għal  €230,000. Trimeg Limited kienet xtrat din l-art  €140,000.Il-Qorti Kostituzzjonali f’Malta ma aċċettatx dawn l-argumenti. Il-Qorti fi Strasbourg ma bidlet xejn minn dak li qalet il-Qorti Maltija.

Dan hu kaz wieħed biss. Il-ħsieb ġenerali iżda hu li apprezzament tal-ħarsien ambjentali qed jaqbad art fost in-nies illum li huma iktar sensittivi minn qatt qabel dwar dan.  Ħadd m’għandu jistenna kumpens għat-tibdil li jkun meħtieġ.

Din hi ġlieda kontinwa mar-rgħiba u l-ispekulazzjoni. Nafu li fil-passat, u għal żmien twil, ir-rgħiba kienet minn fuq. Ir-rgħiba fl-ippjanar għall-użu tal-art kellha żewġ parrini: il-PN u l-PL. Fl-Opposizzjoni jopponu u fil-Gvern jirrumblaw minn fuq kulħadd.  

Kemm il-PN kif ukoll il-PL ma jistgħux jindirizzaw din il-mandra fl-ippjanar għall-użu tal-art għax huma parti mill-problema: il-PLPN ħolquha, kabbruha u iddefendewha. Il-PN beda l-froġa u il-Labour sostniha.

Hu meħtieġ li nibdew paġna ġdida.  Il-linja tal-iżvilupp trid titraġġa lura u l-pjani lokali jeħtieġu tibdil mill-qiegħ. Aħna l-Ħodor biss nistgħu nagħmluh dan, għax aħna m’aħna fil-but ta’ ħadd. L-oħrajn, bil-provi wrew tul is-snin li bejn ir-rgħiba u l-kwalità tal-ħajja dejjem isostnu r-rgħiba!

PLPN have continuously sponsored greed

The local plans are 7 in number.  The Marsaxlokk Bay Local Plan was approved in 1995, just two years after the setting up of the Planning Authority. It took another 7 years to approve the next one, the Grand Harbour Local Plan. The rest were approved in one go, in a hurry in the summer of 2006. In 2006 a document entitled “Rationalisation of Development Zone Boundaries” was also published and approved by Parliament.

All eight documents above-mentioned have the PN fingerprints on them. They are certainly not green fingerprints.

The Rationalisation document in particular which was rushed through Parliamentary approval during July 2006 transformed 2 million square metres of land outside the development zone into land which could be considered for development. It shifted the development zone boundaries.

Labour, in Opposition when the rationalisation document was submitted for Parliament’s consideration, voted against its adoption only to embrace it as if it were its own once it was elected into government. Labour’s opposition was not on principle due to some alternative vision. It was pure partisan politics.

The local plans should be revisited the earliest. The rationalisation document should be scrapped and the land it refers to returned to ODZ status wherever this is possible.

Among the revisions considered essential to the local plans is a general reduction in permissible building heights which are interfering with the solar rights of our residential community. This is hampering our potential as a country to generate more renewable energy. This was ignored by the local plans!

There are various other issues spread all over the islands which require revisiting and careful analysis. As explained in a previous article the local plans fail to take into consideration the cumulative impacts of the development which they propose. This is one of the basic matters which should be considered in depth as it has a substantial impact on our quality of life.

Unfortunately, quality of life was considered irrelevant on the local plan drawing board. Only servicing greed was deemed essential.

Would any compensation be due if land currently suitable for development is relegated to ODZ status? Some weeks ago, Planning and Environment Minister Aaron Farrugia emphasised that the advice he received was in favour of compensation. Conveniently the Hon Minister failed to point out that the Constitutional Court in Malta and the European Court of Human Rights in Strasbourg has already dealt with a Maltese similar case requesting compensation. The Constitutional Court shot down the case and the Strasbourg Court considered it as being inadmissible on 27 September 2011 in a decision which discusses at some length the applicable legal parameters.

The case involved the Maltese Company Trimeg Limited and concerned 10,891 square metres of land which was within the limits of development as defined by the Temporary Provisions Schemes of 1989 but was then, in 1996, scheduled for conservation purposes as part of a valley protection zone.  The Maltese Company had previously claimed in the Maltese Courts that the land would have a value of €11 million if development permits were issued but was reduced in value to €230,000 at the stroke of a pen. The land was originally purchased by Trimeg Limited for €140,000.

The Constitutional Court in Malta had not accepted the arguments brought forward and the Strasbourg Court did not change anything from that judgement.

This is obviously just one case. The general train of thought however is that it is not a legitimate expectation to expect that the law does not change in the future. Environmental protection is hopefully on the increase as today’s men and women are nowadays more sensitive on the matter.

It is obviously a continuous tug-of-war with greed and speculation. The dreadful news of the past is that greed has for quite a stretch of time had the upper hand. Greed in land use planning has been alternatively sponsored by the PN and the PL. They oppose it when in opposition but adopt it once in government.

Neither the PN nor the PL can offer solutions to the current land use planning mess as both of them are part of the problem: PLPN created it, encouraged it and defended it. PN created the mess, PL sustained it.

It is time to start a new page. Scrap the rationalisation exercise and radically reform the local plans. Only we, the Greens, can do it, as we are in nobody’s pocket. The others have proven, time and again that they support greed at the expense of our quality of life.

Dritt ta’ aċċess għax-xemx

Id-dritt li jkollna aċċess għax-xemx reġa’ għal darba oħra qed jissemma b’insistenza. Dawk fostna li huma konxji li l-użu tax-xemx għall-ħtiġijiet tagħna jagħmel kemm sens ambjentali kif ukoll sens ekonomiku qiegħed dejjem jiżdied. Sfortunatament huma ostakolati mill-politika dwar l-użu tal-art li hi interessata biss biex taqdi lir-rebgħa li, jippruvaw jgħidulna li hi żvilupp.

Li nagħmlu użu mill-enerġija li tiġġenera x-xemx jiddependi minn dak li jkun hemm jostakola l-wasla tar-raġġi tax-xemx meta jkollna ħtieġa tagħhom! Meta l-parti l-kbira tal-pjani lokali kienu approvati fis-sajf tal-2006, kien żdied bil-kbir l-għoli tal-bini permissibli f’diversi lokalitajiet. F’xi każi l-ammont ta’ sulari li jistgħu jinbnew żdiedu minn 2 għal 5, inkluż penthouse. Is-sitwazzjoni hi agħar fejn jista’ jkun hemm garaxxijiet li jkunu parzjalment taħt il-livell tal-triq (semi-basement). Din il-bidla f’dak li jista’ jinbena effettwat ħafna żoni fejn kien hemm bini b’żewġ sulari.

L-impatt ta’ din il-bidla fl-għoli permissibli tal-bini qiegħed jiżdied biż-żmien għax issa qed isir żvilupp mill-ġdid ta’ bosta propjetajiet li ilhom ftit ta’ żmien li nbnew. Dan qed joħloq ħafna dellijiet fuq bosta djar residenzjali fl-ibliet u l-irħula tagħna. Bħala riżultat ta’ dan il-pannelli fotovoltajċi u l-istallazzjonijiet li jsaħħnu l-ilma bix-xemx (solar water heaters) stallati fuq il-bjut ta’ bosta residenzi issa qegħdin fid-dell għall-ħin twil u ġew ma jiswew xejn. Dawn huma investimenti li għamlu ħafna familji Maltin li ġew issagrifikati fuq l-altar tar-rebgħa tal-hekk imsejjaħ żvilupp. Sussidji użati bħala għajnuna biex niġġeneraw l-enerġija mix-xemx, inkluż dawk li oriġinaw minn fondi Ewropej, f’numru mhux żgħir ta’ każi spiċċaw moħlija.

Dan kollu hu riżultat ta’ politika dwar l-ippjanar tal-użu tal-art bla viżjoni fit-tul. Politika li falliet biex tqis u tindirizza impatti ovvji. B’mod speċifiku hi riżultat li teżamina l-proposta dwar l-għoli permissibli tal-bini fid-dawl tal-proċeduri stabiliti mid-direttiva tal-Unjoni Ewropea dwar l-istima ta’ l-effetti ta’ ċerti pjanijiet u programmi fuq l-ambjent (Strategic Environment Assessment Directive). Din hi direttiva li tfittex li teżamina politika (policy), pjani u programmi biex ikun stabilit u eżaminat l-impatt ambjentali tagħhom.

Dawk minnha li huma familjari ma kif taħdem u ħadmet l-Awtorità tal-Ippjanar jafu li l-Pjani Lokali ġew approvati bl-għaġġla fis-sajf tal-2006. Dan sar l-għaliex iktar dewmien kien ikun ifisser illi dawn il-pjani kienu jkun soġġetti għal eżami dwar l-impatti ambjentali tagħhom skond kif tipprovdi d-direttiva tal-Unjoni Ewropea dwar l-istima ta’ l-effetti ta’ ċerti pjanijiet u programmi fuq l-ambjent (Strategic Environment Assessment Directive). Inevitabilment kien jirriżulta minn dan l-eżami li ż-żieda fil-għoli tal-bini li seta jingħata l-permess kien ser ikollu impatt negattiv fuq il-ġenerazzjoni tal-elettriku mix-xemx, kif fil-fatt qed jiġri llum! Dan l-impatt kien ikollu jkun indirizzat u l-għoli tal-bini kien ikollu jonqos.

Kellna parti mill-Gvern taħdem favur il-ħtieġa li nagħmlu użu mix-xemx biex niġġeneraw enerġija nadifa. Imma kellna parti oħra mill-Gvern li kienet ostaġġ tal-lobby tal-iżviluppaturi li riedu iktar spazju fejn jistgħu jiżviluppaw. Il-bqija nafu x’ġara. Dak l-ispazju issa qed jiġi żviluppat u bħala riżultat spiċċajna bil-pannelli fid-dell fuq il-bjut!

Iktar kmieni din il-ġimgħa, fil-Parlament, Miriam Dalli, Ministru għall-Enerġija, l-Intrapriża u l-Iżvilupp Sostenibbli fi tweġiba għal mistoqsija parlamentari ta’ Ryan Callus kelliemi tal-Opposizzjoni dwar l-Enerġija qalet li l-Gvern għaddej b’konsultazzjonijiet interni dwar dan kollu.

Tant ilna niddiskutu dan kollu li mhux nifhem x’għandha f’moħħha l-Onorevoli Ministru. Fil-fatt ftit hemm possibilitajiet x’jiġu kkunsidrati.

L-iktar possibilità ovvja hi li fejn hu possibli jitreġġa’ lura l-għoli permissibli tal-bini għal dak li kien fl-2006. Dan imma, hu diffiċli biex isir, u kieku kellu jsir immedjatament tasal talba għal kumpens ta’ miljuni ta’ euro.

Hu possibli li jkunu introdotti drittijiet dwar l-aċċess għax-xemx f’bini ġdid. Dan għandu jsir immedjatament. Hu possiblili li jkunu emendati r-regoli tal-ippjanar b’mod li jkun assigurat illi fil-bini ġdid, b’mod partikolari fil-bini ta’ flats, ikun possibli li minn fuq il-bjut tagħhom tkun ġġenerata l-enerġija mix-xemx. Dan għandu jkun biżżejjed u jagħmel tajjeb għall-konsum tal-elettriku fil-blokk tal-flats kollu. Dan ikun ifisser li l-arja ma tinżammx mill-iżviluppatur iżda tkun parti mill-blokk f’idejn is-sidien tal-flats biex fuqha jistallaw pannelli foto-voltajiċi. Dan jassigura li kull blokk ġdid ta’ flats ikun carbon neutral, jiġifieri jiġġenera elettriku mix-xemx daqs kemm ikun ikkunsmat. Il-pannelli b’hekk jieħdu post il-penthouse.

B’hekk nistgħu nibdew bil-mod insewwu l-ħsara li saret.

Solar rights and planning wrongs

Solar rights are once more in the public debate. The number of those aware that utilising solar energy for our needs makes both environmental and economic sense is on the increase. Unfortunately, they are being obstructed by land use planning policy which is only interested in serving greed, camouflaged as development.

The utilisation of the sun’s energy is dependent on what gets in the way of the sun’s rays when we need them!  When most of the Local Plans were approved way back in summer of 2006, the permissible heights of building development in a multitude of areas were substantially increased. At times this increase was from 2 to 5 floors, including a penthouse level. It is worse where semi-basement garages are permissible. This change was in particular applied in respect of large areas with a previous predominance of two floored terraced houses. 

The impact of this change in the permissible height limitation is increasing in severity with time as the redevelopment of old properties is being gradually taken in hand. This is resulting in the shadowing of an ever-increasing number of residential units in a number of residential areas. As a result, solar water heaters and photo voltaic panels installed on a number of roofs in the past years, are now in the shade for a considerable amount of time and consequently are practically useless. Investments made by a number of our families have been sacrificed on the altar of development greed. Subsidies (including those originating from EU funds) which were utilised to assist the tapping of solar energy in a substantial number of cases have thus been thrown down the drain.

This is the result of myopic land use planning which failed to consider obvious impacts. Specifically, it is the result of the failure to subject the proposed height relaxation planning policies to the EU Strategic Environment Assessment Directive. The Strategic Environment Assessment Directive seeks to examine policies, plans and programmes in order to ensure that their environmental aspects are effectively considered.

Those of us familiar with the workings of the Planning Authority are aware that most of the Local Plans were rushed through to approval during the summer of 2006. This was done as any further delay would have made them subject to Strategic Environment Assessment procedures which would have inevitably highlighted the impact of height relaxation on the generation of solar energy. As a result, the conflict with the need to have solar energy generated would have been highlighted and most probably addressed.

While one section of government was encouraging one and all on the need to tap the sun’s rays to generate clean and renewable energy, another section, hostage to the development lobby was obstructing this and pushing forward their need for more space to develop! The rest is history. That space is currently being developed today, in the process obstructing the further generation of renewable energy on our rooftops.

In Parliament, earlier this week Minister for Energy, Enterprise and Sustainable Development Miriam Dalli in reply to a Parliamentary Question from Ryan Callus, spokesperson for Energy on behalf of the Opposition, stated that government was holding internal discussions on the matter.

The matter has been discussed many times to date so I cannot decipher exactly what Minister Miriam Dalli has in mind. There are in fact very few possible options which can be considered.

The most obvious option is to revise as much as possible the height relaxation carried out in 2006. This will be very difficult to carry out, and, if done, it will be immediately followed-up by a request for compensation running into many millions of euro.

Alternatively, one can seek to introduce solar rights on new buildings without further delay. It is possible that planning policy is amended to ensure that all new properties, in particular blocks of flats, should generate sufficient electricity to cater for the number of units in the new block, thus ensuring carbon neutrality. Such a measure would essentially require that the roof is owned together with the individual units in order that owners of the said units may install photo voltaic panels. Consequently, it would signify that the space which till now has been utilised for the development of penthouses would henceforth be reserved for the generation of renewable energy.

In so doing a history of planning wrongs would commence the long and difficult road of correction.
