Minn dak li hu magħruf dwar l-inċidenza dejjem tikber tal-cancer, jidher li l-impatti ambjentali tal-ħidma tal-bniedem qed ikollhom effett qawwi. Ftit huma dawk li huma konxji dwar ir-rabtiet li hemm bejn il-ħsara ambjentali u uħud mill-mard rari li s-soċjetá tagħna qegħda tiffaċċja.

Fil-ġranet tal-Milied, riżultat tal-ħidma bla heda tal-Community Chest Fund, nisimgħu dwar id-domanda ma tieqaf qatt għas-servizzi li jagħti l-istat lil dawk milquta minn kull forma ta’ cancer. Id-domanda hi tant kbira li riżorsi tal-istat huma mgħejjuna mill-ġbir li jsir waqt l-Istrina, li, din is-sena laħaq is-somma record ta’ €5.5 miljuni.

Il-Gvern qed ixandar riklami dwar il-qalba tal-ġenerazzjoni tal-elettriku minn waħda dipendenti fuq il-heavy fuel oil għal waħda dipendenti fuq il-gass naturali. F’dawn ir-riklami qed jgħidulna li ser ikollna titjib fil-kwalitá tal-arja bħala riżultat ta’ din il-qalba. Din id-dikjarazzjoni (tar-riklami) hi biss parzjalment korretta. Dan minħabba li l-kontributur ewlieni għall-kwalitá tal-arja f’Malta qatt ma kienet il-ġenerazzjoni tal-elettriku iżda n-numru ta’ karozzi fit-toroq li donnu ma jispiċċa qatt. Huma dawn il-karozzi fit-toroq li jiffurmaw parti mill-fabbrika reali tal-cancer f’Malta.

Kif anke jidher mill-investimenti sostanzjali dedikati għal titjib fl-infrastruttura tat-toroq huwa ċar li r-rieda politika biex dan ikun indirizzat hi dgħajfa. Għax iktar ma titjieb l-infrastruttura tat-toroq, iktar ikunu inkoraġġiti karozzi fit-toroq, għax it-triq għalihom tkun iffaċilitata. It-titjib fl-infrastruttura tat-toroq, iżżid id-dipendenza tagħna lkoll fuq il-karozzi u bħala riżultat ta’ dan, tostakola l-ħidma biex iktar nies tuża t-trasport pubbliku.

Sar titjib fit-trasport pubbliku, anke bħala riżultat ta’ diversi inizzjattivi li ttieħdu. Imma l-pajjiż qed jagħti sinjali konfliġġenti, għax filwaqt li qiegħed jinkoraġixxi l-użu tat-transport pubbliku, fl-istess ħin qed jinvesti flejjes sostanzjali biex jiffaċilita l-kontinwazzjoni tad-dominazzjoni tat-toroq tagħna mill-karozzi.

Il-ħarsien tal-ambjent jinvolvi ħafna ħidma diversa. Jinkludi ħidma biex ikunu indirizzati b’serjetá s-sorsi differenti ta’ ġenerazzjoni tal-iskart biex b’hekk infasslu t-triq li biha rridu naslu ħalli nilħqu l-mira ta’ “skart zero”. Din hi mira stabbilita mill-Istrateġija Nazzjonali tal-Iskart u trid tintlaħaq sal-2050. Dan ċertament li mhux biżżejjed. X’ngħidu għall-użu eċċessiv ta’ pestiċidi li mhux biss qed jikkontamina dak li jkun prodott fir-raba’ imma parti minnu jispiċċa ukoll f’dak li baqa’ mill-ilma tal-pjan?

L-iżbilanċ ambjentali qiegħed dejjem jiżdied. Kull ġenerazzjoni qed tispiċċa żżid l-impatti mingħajr ma tindirizza sewwa l-impatti akkumulati li tkun wirtet mill-ġenerazzjoni ta’ qabilha.

Il-Gvernijiet qed jinkwetaw fuq l-iżbilanċ finanzjarju imma ftit wisq minnhom jinkwetaw fuq l-iżbilanċ ambjentali li iktar ma jgħaddi żmien iktar qed imur għall-agħar. Ir-riżorsi tad-dinja qed jintużaw qieshom bir bla qiegħ.

In-natura għandha l-modi tagħha kif iġġiegħlna nħallsu għal dan l-iżbilanċ ambjentali. It-tibdil fil-klima, l-kollass tal-agrikultura f’diversi pajjiżi kif ukoll iż-żieda qawwija ta’ kull xorta ta’ cancer huma kollha tweġiba tan-natura li biha kull wieħed minnha qiegħed jerfa’ l-piz tal-ħsara li saret lin-natura. Dawn il-kontijiet li qed tibgħatina n-natura jistgħu jonqsu fil-futur jekk nibdew minn issa ngħixu b’mod li joħloq inqas ħsara ambjentali. Jekk dan ma jseħħx il-kontijiet tan-natura, bla ebda dubju, jwasslu għal kollass totali.

A Christmas carol for Jason Azzopardi

Just like Ebenezer Scrooge, Jason Azzopardi is haunted with scenes from his past. Scrooge had to deal with the Ghost of Christmas Past while Jason has been spotlighted by the Auditor-General in three separate reports. These deal with issues forming part of the political responsibilities which he shouldered when part of the Lawrence Gonzi Cabinet.

The first report was presented one year ago and dealt with the issuance of encroachment permits on the eve of the 2013 general election.  The Auditor-General then commented on Minister Jason Azzopardi’s intervention in the issuance of encroachment permits, emphasising that his intervention was “unwarranted”.

Pompous as ever, Jason Azzopardi insisted that he acted within the parameters of the law. He was not capable of recognising that he erred. Nor was he publicly chastised in any way by his own political party which has called for everybody’s resignation, except his own.

Two other reports were published by the Auditor-General last week.  Both deal with government land: its acquisition in one case, its transfer in another.

The first report investigates the acquisition of 233, 236 and 237, Republic Street Valletta.  The Auditor-General, in this investigation identified significant shortcomings in the process of negotiation, critically and negatively conditioning Government’s negotiating position. “This serious shortcoming,” states the Auditor-General, “was raised in concerns raised by the Permanent Secretary,” who was over-ruled.

Notwithstanding the corrective measures subsequently taken, the process remained flawed. This, emphasised the Auditor-General, represented a fundamental weakness in the process of negotiation (with HSBC), “effectively limiting Government’s bargaining power”.  Bad governance at its worst!

The second report deals with the investigation on the transfer of land at Ta’ L-Istabal, Qormi.   The Auditor-General concluded that “failure in terms of good governance, to varying degrees, is a recurring theme that emerged” throughout his review of the matter. The Auditor-General also noted “extraordinary haste” when as a result of problems being identified authorisations were obtained and contracts signed in a matter of two days.

The Auditor-General lists a number of public officers as being responsible for the mess created when conditions attached to a contract concerning government property were cancelled illegally without Parliament’s approval in terms of legislation regulating the disposal of government land.

Describing this mess, the Auditor-General states that he “did not find any direct evidence of political pressure exerted in the processes reviewed.” The emphasis obviously is on the words “direct evidence” as reading through the report it is amply clear that a selection of the top brass within the civil service would not act in such blatant defiance of the law unless they had at least tacit approval of the holders of political office to which they were responsible. The civil service officials mentioned by the Auditor-General as being directly responsible are: The Director General, the Notary and the Assistant Director Contracts of the Government Property Division.

The Auditor-General makes this very important consideration: “ …………… an element of political pressure was asserted by the Chair Vassallo Builders Group Ltd, who alleged that Marsovin Ltd had prior agreement with the ‘Minister’ and the GPD. The Director Marsovin Group Ltd negated this allegation, as did the Minister of Finance, the Economy and Investment and the Parliamentary Secretary for Revenues and Land, who indicated that they were not aware of the case at the time. Queried in this respect, the Chair Vassallo Builders Group Ltd indicated no knowledge of who the ‘Minister’ was. While the NAO cannot rule out pressure being exerted by any of the aforementioned, or possibly by other persons who did not come to this Office’s attention, the facts of the case render immediately evident that pressure was in fact exerted to the detriment of Government’s interests.”

Ultimately the responsibility for this mess lies on Jason Azzopardi’s lap. He has a lot of pending explanations. He will obviously not resign as clearly he only pays lip service to good governance.

In addition, this report from the Auditor-General possibly throws some light on another incident: the loan of €250,000 by a certain Nazzareno Vassallo to the PN’s commercial arms on the eve of the 2013 general elections. We were then informed that the loan was of a commercial nature on commercial terms.

The proof of the pudding is in the eating. How can anyone believe Jason Azzopardi and his political party preaching adherence to good governance when as recently as 2012 they made a mess on all that they could lay their hands on?

Referring to Joseph Muscat’s gross administrative incompetence and the scandals popping up every other day is no solution. The more we unravel from the past the more clear it becomes that both the Labour Party and the Nationalist Party, each in its own way, as a result of their shady methods of operation, cannot be trusted with the reins of power.

Solidarjetá staġjonali?

Is-solidarjetá, bla dubju, hi waħda mill-karatteristiċi ewlenin ta’ pajjiżna f’dan iż-żmien tas-sena. Dan hu tajjeb u ilu hekk għal żmien twil.

Din is-solidarjetá timmanifesta ruħha b’diversi modi, imma prinċipalment permezz tal-ġenerożitá, bosta drabi qawwija, favur kawżi ġusti. Matul dawn il-ġranet, isir ġbir sostanzjali għall-Community Chest Fund, għad-Dar tal-Providenza u anke għal diversi kawżi ġusti oħra. Hi solidarjetá staġjonali, solidarjetá għax-xahar tal-Milied.

Filwaqt li dan huwa kollu pożittiv, ikun tajjeb kieku naħsbu ftit kif nistgħu mmorru lil hin minn solidarjetá staġjonali, għal solidarjetá li tkun preżenti fl-istaġuni kollha. Għax filwaqt li hu tajjeb li fi żmien il-Milied nieqfu ftit u ndaħħlu jdejna fil-but biex inkunu ta’ għajnuna għal min għandu bżonnha, ikun floku iktar jekk nirrealizzaw li l-ħtieġa għall-għajnuna qegħda hemm fil-bqija tal-ġranet tas-sena ukoll. Għax is-sena fiha 364 jum ieħor, barra mill-Milied! U f’sena bħall-2016, ikun hemm ġurnata żejda ukoll.

Il-ħajja hi mgħaġġla. Fl-inħawi mibnijin b’mod intensiv f’dawn l-aħħar snin, naqas sewwa s-sens ta’ komunitá li kienet tinħass ferm iktar meta l-komunitajiet fl-ibliet u l-irħula tagħna kienu ħafna iżgħar milli huma illum. Fi blokki kbar ta’ flats, wieħed ħdejn l-ieħor, ħafna drabi qieshom gallinari tal-konkos, illum l-individwu jintilef fil-massa u mhux dejjem faċli li nindunaw b’dawk fostna li jkunu jeħtieġu l-għajnuna fil-mument li dawn ikunu jeħtiġuha. Ħafna drabi, lanqas ma huwa possibli li dawk li jmexxu s-servizzi li jipprovdi l-istat jindunaw mill-ewwel b’dawk li jkunu jeħtieġu l-għajnuna.

Il-Kunsilli Lokali jista’ jkollhom rwol importanti f’dan ir-rigward. Rwol li uħud minnhom, minkejja l-limitazzjoni ta’ riżorsi, diġa qed jippruvaw jiżviluppaw bil-mod. Mertu għal dan, huwa s-sens ta’ inizjattiva li għandhom uħud mill-kunsilliera lokali tagħna u l-imħabba tagħhom lejn lokalitajiet ħajjin li jagħtu kontribut siewi biex jissaħħu l-egħruq tal-komunitajiet tagħna . Għax il-politika soċjali, biex tkun mill-iktar effettiva, teħtieġ li tkun applikata l-iktar viċin possibli tal-egħruq tas-soċjetá. Hemmhekk, fejn il-biki jinstema’ mill-viċin u fejn l-uġiegħ jinħass sewwa.

Il-biki u l-krib ta’ min qiegħed ibati u l-uġiegħ tal-imġarrab ma jeżistux biss fil-ġranet tal-Milied. Jeżistu ukoll matul l-istaġuni l-oħra, meta l-parti l-kbira tagħna, inkunu għaddejjin bil-ħajja “normali”.

Anke f’dawk il-ġranet hemm ħtieġa tas-solidarjetá.   Għax l-ispirtu tal-Milied għandu japplika matul is-sena kollha.

Kompetizzjoni : min hu l-iktar maħmuġ?

Bħalissa għaddejja kompetizzjoni bejn il-Partit Nazzjonalista u l-Partit Laburista dwar min minnhom hu l-iktar maħmuġ.

Jekk tisma lill-kelliema tal-PN jitkellmu jkollok informazzjoni dettaljata dwar katalgu ta ħmieġ li bih hu mifni dan il-pajjiż. Inevitabilment, jekk tkun smajt lil tal-PN biss jitkellmu tikkonkludi kemm hu żventurat dan il-pajjiż!

Min-naħa l-oħra, wara li tkun smajt lil Owen Bonnici jew lil Deborah Schembri, bi qdusija kbira, jitkellmu dwar l-aħħar każ ta Jason Azzopardi, bil-fors li tibda titkellem waħdek u tibda tistaqsi bejnek u bejn ruħek jekk hux qed tisma sewwa. Għax, tgħid: dan Jason li qed jitkellmu dwaru mhux dak li jippontifika dwar il-korrettezza? Ara trid tkun vera wiċċek imdellek biex titkellem bħal Jason Azzopardi, joħroġ żewġ rapport dwarek l-Awditur Ġenerali u qiesu ma ġara xejn.

Min hu l-iktar maħmuġ? Tagħmel xi differenza dwar min hu l-iktar jew l-inqas maħmuġ? Għax għalija l-grad tad-differenza fil-ħmieġ bejniethom hu irrelevanti. It-tnejn maħmuġin u mhemmx xtagħżel bejniethom. Ma tistax tafda lil ħadd minnhom.

The farce continues

Tomorrow, the Environment and Resources Authority will meet in public to consider the approval of an amendment to the IPPC permit regulating the operations of the power station at Delimara. It is an amendment to an already existing permit as a result of which a definite decision concerning the switch-over to gas-operated turbines will be taken.

The Environment and Resources Authority has been in operation for some months – since February – but this will be the first time it will be possible to observe it in action in a public session.

Last Thursday the Authority, through its secretary to the ‘Environmental permitting-Development Control Commission’ informed those who had taken part in the public consultation that a 71-page document containing responses to feedback received during the public consultation was available online at http://era.org.mt/en/Pages/IPPC-Public-Consultation.aspx.

We are now accustomed to having important information being made available (if at all) at a very late hour and at a time when most people interested in the Delimara public debate are preparing for a well-earned Christmas break.

The document made available last Thursday afternoon, just one working day before the public hearing, is the only document containing the views of the Authority on the subject, even though these views are mostly expressed telegraphically. At the time of writing, I am not aware of the recommendation which the Environment Directorate has submitted for the consideration of the Board of the Authority, that is whether and to what extent it is satisfied with the documentation submitted for its consideration.

The said documentation runs to over 15,000 pages spread into around 300 files of different sizes which could not be adequately examined during the short time available for public consultation, even though this was slightly extended.

Public opinion is not worried about the change to LNG in the operation of the power station. It is, however, still worried about issues of safety. These worries are compounded by the fact that a document prepared by the Civil Protection Department regarding the External Emergency Plan for the Delimara Power Station has been partly excluded from the public consultation exercise. As already stated in a previous article (TMIS, 27 November: A Secret Plan for Delimara) this runs counter to the provisions of the Seveso III Directive of the European Union which has been transposed into the Maltese Statute book through the Control of Major Hazard Regulations of 2015 which provides that: “The Civil Protection Department shall ensure that the public concerned is given early opportunity to give its opinion on external emergency plans when they are being established or substantially modified.”

The Civil Protection Department is failing in its duty to consult. However, by failing to act on the Civil Protection Department’s dereliction of duty, the Environment and Resources Authority, as the ultimate regulator on the matter, is transforming this failure into an abusive exercise of its authority.

How is it possible to voice your opinion on a document that is still shrouded in secrecy?

This is only possible if what should be public consultation is transformed into a farce. The farce continues tomorrow – Monday.

Bħalissa Salvu Mallia qed jitfewwaq spiss. Sfortunatament, dawk ta’ madwaru flok ma jistiednuh iwarrab ftit sakemm forsi jiġi ftit f’siktu, qed jiftaħru bih, għax, jgħidu, li l-lingwaġġ tiegħu jirrifletti l-weġgħat tan-nies tat-triq.

L-istat tas-saħħa ta’ Keith Schembri

Il-Prim Ministru, meta illum ltaqa mal-istampa, ikkummenta, bi tweġiba għal xi mistoqsijiet li sarulu, dwar l-istat tas-saħħa taċ-Chief of Staff tiegħu Keith Schembri. Qal li fil-waqt li qed jieħu l-kura mgħandu xejn gravi.

L-istat ta saħħa ta persuni fil-ħajja pubblika hi ta interess pubbliku u ma kienx għaqli li l-Prim Ministru dam ma ta informazzjoni dwar dan. Kien ikun ħafna aħjar kieku flok kumment lill-ġurnalisti inħareġ bulletin mediku fil-mument li nqala l-kaz.

Din mhiex materja ta kurżitá, iżda neċessitá fsoċjetá demokratika, li l-opinjoni pubblika għadha dritt li tkun infurmata dwarha. Għax l-istat ta saħħa ta dawk li jeżerċitaw il-poter jiddetermina ukoll kif dan l-istess poter ikun eżerċitat. Hekk jiġri fid-dinja demokratika kollha u aħna mgħandniex inkunu eċċezzjoni.

Evarist trusts you

The probe into the corruption allegations at the Foundation for Tomorrow’s Schools is a very serious matter. Reports in the press indicate that the invoices, issued for the construction work carried out by the Foundation at various schools, are being meticulously examined in order that information which might be of relevance to the investigation is gathered.

Of particular interest is the news item that the financing of a newly constructed block of flats at Rabat is under the spotlight. The block of flats, still in shell form, belongs to the person under investigation. It is being emphasised that the fruits of the alleged corruption may have financed the Rabat development. The said site is covered by development permit PA1215/15 as amended by subsequent application PA0260/16. The Planning Authority  permitted the demolition of the previous dwelling on the site and the construction of a five-floor residential block, inclusive of a penthouse and a semi-basement garage in its stead. According to the Planning Authority website, the applicant was Edward Caruana and work on the site commenced on the 19 July 2015.

So far, the press, in part echoing the PN spokespersons, have concentrated firepower on whether the Education Minister Evarist Bartolo acted swiftly enough to ensure that the matter beplaced under investigation.

While the obvious course of immediate action is for the police to investigate in order to identify whether the alleged corruption took place or not, in my view the problems run much deeper than that. Essentially, the issue is one of bad governance through the use of the “person of trust” –  a 21st century version adaptation of a system of political clientelism.

A “person of trust” in Maltese political jargon generally signifies that the person has a political allegiance to the politician who trusts him. Actually, however, it should have a completely different meaning: that the person so appointed is beyond reproach, rather than his being in the Minister’s good books. In fact the person under investigation (Edward Caruana) who was entrusted with procurement duties in the Foundation for Tomorrow’s Schools was a political canvasser of the Education Minister Evarist Bartolo. Incidentally, Mr Caruana’s brother too is a trusted person: he was appointed Permanent Secretary of the Education Ministry.  We do remember the manner in which all Permanent Secretaries in office were swept aside way back in March 2013 to be replaced by a team of “persons of trust”.

The engagement of “politically” trusted persons is not a matter peculiar to Evarist Bartolo’s Ministry, or to the government of which he forms part. While it has been going on for a number of years, it has been done on a much larger scale since the 2013 General Election. In most cases, unfortunately, the political trustworthiness of an individual makes short shrift of meritocracy which should be the foundation stone of a serious public administration.

The trusted person mechanism is circumventing the recruitment procedures of the public service, thereby excluding competent and qualified persons for the simple reason that they are not of the required political colour.

Through the recruitment of persons of trust, clientelism is devaluing years of preparation to obtain qualifications. The end result is not just demotivation : corruption and arrogance are the two other most obvious symptoms.

The Ombudsman in Malta has commented various times on the negative impact which excessive direct appointments in the public sector have due to lack of transparency.  Yet he is consistently ignored.

Under the spotlight Minister Evarist Bartolo has exclaimed that he feels betrayed.

We all have the same feeling that those who preached meritocracy are using political trustworthiness in order to ensure that practising clientelism is done in an efficient a manner as possible.

It-Times online irrappurtat dwar rapport li l-Ministru Manwel Mallia qiegħed fuq il-mejda tal-Kamra wara talba li saret għal dan mill-Membru Parlamentari Anthony Agius Decelis. Rapport li ilna nafu bih xhur twal!

Huwa tajjeb, anzi tajjeb ħafna, li l-Parlament jistenbaħ għar-realtá ta madwarna. U din ir-realtá hi sempliċi ħafna. Mhux diffiċli biex tinftiehem.

Is-suċċess ekonomiku tal-Freeport, tgħid din ir-realtá, qed iħallsu għalih ir-residenti ta Birżebbuġa. Għal ħafna snin ħadd ma kienet qiegħed jagħti kaz. Huwa tajjeb li fl-aħħar hemm min qiegħed jistenbaħ.

Imma waqt li l-Onorevoli Agius Delicata (u oħrajn) kien rieqed, ħaddieħor kien qiegħed jaħdem biex iktar persuni jirrealizzaw xinhu jiġri. Għax ir-rapport dwar il-ħsejjes ma sarx waħdu. Sar għax il-Kunsill Lokali ta Birżebbuġa ħadem kemm felaħ ħalli l-Freeport jerfa r-responsabbiltajiet tiegħu.

L-isfida reali hi li l-Freeport iwettaq ir-rakkomandazzjonijiet li fih dak ir-rapport! Hi triq twila u anke hemm naslu!
